Die Beiträge des vorliegenden Bandes erkunden das Phänomen der Musse in seiner Räumlichkeit und in seinem Verhältnis zur Zeit. Im mussetypischen Verweilen tritt das Nacheinander der Zeit zurück, während der Raum mit seinen Ordnungen des Nebeneinander bestimmend wird. Diese spezifische Raumzeitlichkeit wird in vier Abschnitten ausgelotet: Der erste ist Konzepten und Theorien der Musse gewidmet, der zweite der ästhetischen Erfahrung von Räumen der Natur und Kunst, der dritte gebauten Räumen der Musse, der vierte der Musseerfahrung, wie sie sich in Kommunikations- (...) und Schreibprozessen darstellt. Die Bandbreite der Untersuchungen reicht von der philosophischen, begriffsanalytischen Reflexion über die phänomenologische Analyse sowie von der literaturwissenschaftlichen Falluntersuchung hin zur kunsthistorischen Betrachtung. Wir haben uns bei unseren Handlungen und Entscheidungen nie vollständig an Fakten orientiert und die westliche Kultur existierte bereits vor der Erfindung des Faktenbegriffs. Aufzeichnungen zeigen, dass der Begriff der Tatsache von der Rechtswissenschaft erfunden wurde, um Zufälligkeiten von abstrakten Regeln zu unterscheiden. Von der Rechtswissenschaft wanderte der Begriff der Tatsache in die Naturwissenschaften, wo sich die Bedeutung von Taten auf die Existenz materieller Dinge verlagerte. Der naturwissenschaftliche Begriff des Faktischen durchdringt seit der Aufklärung die gesamte Kultur, wurde aber in (...) der zweiten Hälfte des zwanzigsten Jahrhunderts wegen seiner sozialen Konstruktion kritisiert. Diese nützliche Kritik zog Populisten mit destruktiven Motiven an und infolgedessen hat sich ein Element der Missachtung von Fakten in den zivilgesellschaftlichen Diskurs eingeschlichen, einschließlich bei Umweltfragen. Ohne die Möglichkeit, Argumente auf wissenschaftliche Fakten zu stützen, muss das Recht anerkennen, dass große Teile der Öffentlichkeit ihre Entscheidungen auf der Grundlage von Werten und nicht von wissenschaftlichen Fakten treffen. Die öffentlichen Reaktionen auf den Klimawandel und COVID-19 sind Beispiele für dieses Phänomen. Die Staaten haben es in den letzten dreißig Jahren versäumt, sinnvolle rechtliche Maßnahmen zur Eindämmung des Klimawandels zu ergreifen, obwohl die wissenschaftlichen Fakten immer zahlreicher wurden. In der Pandemie weigern sich Bürger, Maßnahmen zu ergreifen, um die Verbreitung von COVID-19 unter ihren Mitbürgern zu verhindern, und berufen sich dabei auf ein gewisses Maß an persönlichen Freiheiten. Wie kann man Werte schaffen, ohne sie durch Fakten zu stützen? Welche Rolle kann das Umweltrecht bei der Festlegung dieser Werte jenseits faktenbasierter Systeme von Rechten und Pflichten spielen? In der vorfaktischen Kultur Griechenlands wurden in den Gerichten Ethos und Pathos gleichberechtigt neben dem Logos empfohlen. Es gibt jedoch keine Aufzeichnungen über eine vorfaktische Berufung auf das Pathos im Namen von nicht-menschlichen oder abstrakten Gebilden wie,,der Umwelt“. Die postfaktische Welt der empathischen Überzeugung ist also zum großen Teil Neuland. (shrink)

Ethische Leitlinien für die klinische Praxis erfreuen sich zunehmender Beliebtheit. Damit klinisch-ethische Leitlinien aber überhaupt erfolgreich wirksam werden können, ist noch Pionierarbeit zu leisten. Solche Leitlinien müssen wissenschaftlich stärker fundiert und ihre praktische Anwendbarkeit muss verbessert werden. In dieser Arbeit werden die ersten Schritte des Projekts METAP zur methodischen Entwicklung und praktischen Implementierung einer Leitlinie für eine patientengerechte Versorgung am Krankenbett beschrieben und zur Diskussion gestellt. Das Projekt orientiert sich methodisch an der Entwicklung medizinischer Leitlinien und generiert damit eine (...) forschungs- und konsensgestützte Leitlinie, die systematischer Evaluation und Modifikation unterliegt und Rechenschaft über ihre wissenschaftliche Fundierung gibt. Zusätzlich zur Leitlinie bietet das Projekt in der Form eines Handbuchs ein Entscheidungsfindungsverfahren an, welches unter anderem deliberative Aspekte unterstützt. Das Handbuch konzentriert sich auf ethische Fragen der Mikroallokation und liefert darüber hinaus Informationen über empirische, ethische und rechtliche Grundlagen für Therapieentscheidungen. Anhand eines Eskalationsmodells können unterschiedliche Instrumente nach Bedarf als ethische Lösungsstrategien eingesetzt werden, von der Kurzfassung im Kitteltaschenformat („Leporello“) mit den wichtigsten Fakten, weiterführenden Texten und Empfehlungen mit normativen und prozeduralen Hinweisen, über stationsinterne Lösungsversuche bis hin zum Ethikkonsil. Klinische Partner sind von Beginn an aktiv in den Entwicklungsprozess eingebunden und verbessern so die Praxistauglichkeit und Akzeptanz sowie die Ausrichtung des Instrumentariums an den tatsächlichen Bedürfnissen. Dieses partnerschaftliche, partizipative Vorgehen scheint eine wichtige Voraussetzung dafür zu sein, dass METAP in der Klinik Fuß fassen konnte. (shrink)

Ein sicheres Kriterium für den menschlichen Tod gibt es nicht. Die neu entfachte Diskussion über den Hirntod zeigt, dass allein aus einem medizinisch-naturwissenschaftlichen Verständnis heraus keine angemessene Bestimmung des Todes zu gewinnen ist. Die Beiträge des Bandes verdeutlichen: Um den Tod begrifflich angemessen zu fassen, muss die personale Dimension des menschlichen Lebens berücksichtigt werden.

Kann Gott tun, was er will oder will Gott, was seinem Wesen entspricht? Ist Gott an notwendige Prinzipien gebunden oder ist notwendig, was Gott dekretiert? Derartige Fragen nach dem Verhältnis von Modalitäten und Gotteskonzepten sind Bestandteil unzähliger Debatten und reichen weit in die Philosophie- und Theologiegeschichte zurück. Die vorliegende Studie untersucht zunächst die Modalmetaphysiken G.W. Leibniz', D. Lewis' und A. Plantingas samt ihren sehr unterschiedlichen ontologischen Voraussetzungen. Im Anschluss werden die in der gegenwärtigen analytisch-religionsphilosophischen Debatte dominanten Formen des Theismus analysiert: (...) der klassische und personale Theismus und der Panentheismus. Das Kernstück dieser Studie bildet die Analyse von Konsistenzen und Inkonsistenzen, die zutage treten, will man aus metaphysisch-ontologischen Gründen diese unterschiedlichen Formen des Theismus mit den Modaltheorien Lewis', Leibniz' oder Plantingas verbinden. In the Transcendental Aesthetic (TA), Kant is typically held to make negative assertations about “things in themselves,” namely that they are not spatial or temporal. These negative assertions stand behind the “neglected alternative” problem for Kant’s transcendental idealism. According to this problem, Kant may be entitled to assert that spatio-temporality is a subjective element of our cognition, but he cannot rule out that it may also be a feature of the objective world. In this paper, I show in a new (...) way how Kant’s view (focusing on his conclusions about space) is not subject to this objection, by showing that he does not make the denial about mind-independent reality that he is typically held to make. The argument develops consequences of a new reading of Kant’s expression “an sich selbst” (‘in itself’; ‘in themselves’). I argue that “an sich selbst” or “per se” has a special, judgment-level role, so that this expression does not form new noun-terms adjectivally. It follows that the conceptual unit of Kant’s “Conclusions” in the TA is simply “things” (Dinge), since “things in themselves” is not a nominal expression; Kant adopts the Wolffian ontological use of “thing” as the basic kind-term for any existent. The arguments that things per se are not in space are arguments that space cannot be a necessary property or relations of things as a kind. I show that this does not involve the positive claim about mind-independent reality that inspires the neglected alternative objection. (shrink)

While the idea of philosophy as conceptual analysis has attracted many adherents and undergone a number of variations, in general it suffers from an authority problem with two dimensions. First, it is unclear why the analysis of a concept should have objective authority: why explicating what we mean should express how things are. Second, conceptual analysis seems to lack intersubjective authority: why philosophical analysis should apply to more than a parochial group of individuals. I argue that Hegel’s conception of social (...) ontology, focused on his concept of “ethical life” (Sittlichkeit), helps to explain how concepts (and their explication) have both objective and intersubjective authority in the social domain. Hegel claims that modern institutions are the product of self-conscious purposes, so that they are conceptually constituted. Concepts do not just represent these objects and so depend on a contingent relation to them. As many contemporary social ontologists agree, this means that our concepts of these institutions are uniquely epistemically “transparent.” They have objective authority. Concepts have intersubjective authority in the modern world as well, according to Hegel. However, I show that this feature of Hegel’s account does not rely on the solution to a philosophical problem. Rather, since the concepts of modern ethical life are “essentially contested,” their content depends on the practical and political agreement of modern subjects. This means that concepts can only have objective authority if some prior intersubjective agreement has been reached. The role of philosophy as conceptual analysis is thus importantly dependent on political developments. (shrink)

No bojo de uma exposição "positiva" do marxismo` a obra do último Engels, além de promover uma expansão das fronteiras dessa doutrina, promove uma outra articulação, distinta daquela pensada por Marx - entre método e sistema. Tomada como uma ordenação categorial independente a dialética toma-se a liga de um encadeamento enciclopédico que reduz o marxismo ao projeto de um conhecimento unificado do homem e da natureza.

Procura-se destacar aqui, a partir da relação de mútua dependência entre o concreto e o especulativo em Theodor Adorno, algumas características próprias de sua exposição filosófica. A recusa de definições, a busca de constelações, a construção de “modelos críticos” tornam-se mais inteligíveis quando examinadas à luz da relação entre os conceitos e o não-conceitual. Pretende-se assim esclarecer melhor a relação entre verdade e história no pensamento de Adorno.

The key question now concerns the relationship between [Formula: see text] and Axiom [Formula: see text]. This is because the foundational issues raised by the problem of Axiom [Formula: see text] vs. [Formula: see text] arguably persist in the problem of Axiom [Formula: see text] vs. (...) [Formula: see text]. The first of our two main theorems is that Axiom [Formula: see text] is equivalent to Axiom [Formula: see text], and as a corollary we show that Axiom [Formula: see text] fails in all the known models of [Formula: see text]. This suggests that [Formula: see text] actually refutes Axiom [Formula: see text]. Our second main theorem is that the [Formula: see text] Conjecture holds assuming [Formula: see text]. This is the strongest partial result known on this conjecture which is one of the central open problems of [Formula: see text]-theory and [Formula: see text]-logic. Torna-se assim possível estabelecer a singularidade de Adorno perante as críticas empreendidas pelo idealismo alemão, por Nietzsche, pela psicanálise e pela própria tradição marxista na qual ele se insere. This article evaluates the pertinence of Engel's lemma according to which Marxism is the "heir of German idealism" in Lukác's, Horkheimer's and Adorno's theories. While Lukács considers the Marxist method as springing from the Hegelian philosophy and Horkheimer explicitly assumes the Kantian legacy, Adorno does not intend to be himself the heir, but the critic of the German idealism.Acompanha-se, aqui, a pertinência do lema de Engels, que concebe o marxismo como "herdeiro do idealismo alemão" nas teorias de Lukács, Horkheimer e (...) In this study, W. J. Waluchow argues that debates between defenders and critics of constitutional bills of rights presuppose that constitutions are more or less rigid entities. Within such a conception, constitutions aspire to establish stable, fixed points of agreement and pre-commitment, which defenders consider to be possible and desirable, while critics deem impossible and undesirable. Drawing on reflections about the nature of law, constitutions, the common law, and what it is to be a democratic representative, Waluchow urges a different (...) theory of bills of rights that is flexible and adaptable. Adopting such a theory enables one not only to answer to critics' most serious challenges, but also to appreciate the role that a bill of rights, interpreted and enforced by unelected judges, can sensibly play in a constitutional democracy. Neutral monist, panpsychist, naturalist, and phenomenological interpretations of James's theory of mind are canvassed. Culling the true tenets from each, I make a case for a reconciling view on the basis of a distinction between mental and proto-mental properties. The resulting interpretation is compared to two forms of panpsychism identified by T Nagel in his essay of that name.
