Dickert et al. (2020) effectively address how factors such as time limitations, stress, and illness severity in acute conditions warrant a deeper evaluation of how current consent processes serve patients. While data suggests that patients “prefer to be asked for permission upfront rather than waiving consent” (2), consent forms themselves “are frequently long and technical, follow rigid templates, and contain language that appears to prioritize institutional protection” (1). Such findings elucidate patients’ valuation of personal agency over settling for the “benefit (...) of the doubt” that physicians and the consent forms they provide are acting in the patients’ best interests. In response, the authors recommend revisions to consent forms in terms of content, structure, and tone to better facilitate patient understanding beyond the mere conveyance of information. We aim to build Dickert et al.’s discussion of how “consent processes serve functions beyond facilitating an informed, autonomous decision” (2), but with a broader focus on an underrecognized purpose of the consent process: namely, reaffirming a patient’s status as a capable, rational agent. The BRAIN 2.0 Neuroethics Report reflects on the ways in which neuroscientific research may inform our understanding of concepts such as consciousness and empathy, and how advances in this understanding might in turn affect practices such as research on non-human animal primates. Generally, the Report calls for “the integration of neuroscience and neuroethics during the remaining years of the BRAIN initiative and beyond” (NIH 2019). In responding to the Report, the articles in this issue grapple with theoretical questions about what (...) the integration of neuroscience and neuroethics might look like, as well as how specific practices might be affected. In this commentary, we don’t grapple with these questions ourselves. Instead, we propose a framework for debates about them. Specifically, we introduce the idea of ‘morally-salient features,’ suggesting that the concept may be helpful in providing a framework for the kinds of questions addressed by the BRAIN 2.0 Neuroethics Report as well as those tackled by the authors of this issue. Berger (2019) argues effectively that “representativeness is more aptly understood as a variable that is multidimensional and continuous based on relational moral authority,” and also makes some useful suggestions about how taking this observation seriously might require changes in current patterns of practice regarding surrogates. But the essay raises additional important questions about how the Best Interest Standard (BIS) should be used among unrepresented patients and other patients as well because many surrogates besides those who “have no actionable knowledge of (...) a patient’s preferences” find themselves in positions in which they need to determine, with the physician, what is in the patient’s best interests. In this commentary, we therefore provide support for the ethical superiority of BIS judgments made by a multi-stakeholder process (rather than solo decision-makers), and sketch a process by which such judgments might be made. Curnow, Rohan This article is concerned with the beginning of the trajectory of thought that links two events: Vatican II and the emergence of an explicit doctrine of the Preferential Option for the Poor in the official documents of the Latin American Episcopal Conference's (CELAM) meetings at Puebla, Mexico in 1968, and Medell n, Columbia in 1979. Specifically, this article concentrates on a group that formed early in proceedings at Vatican II, known as both the 'Group of the Church (...) of the Poor' or the 'Belgian College Group' (after the place in which it met). The group, albeit an informal one, championed the issue of poverty in work that was conducted largely behind the scenes and outside official Conciliar structures. This article illustrates that, via the work of the Group of the Church of the Poor, the poor broke into the Church's consciousness at the Council in a new - if limited - way. To demonstrate this point, this article focuses on the Group of the Church of the Poor's: (a) origins and complexion; (b) aims and activities; and, (c) achievements and shortcomings at the Council. It is a truism that some industries are controversial either because the processes employed or the resulting products, for instance, can potentially harm the well-being of people. The controversy that surrounds certain industries can sharply polarise public opinion and debate. In this article, we employ legitimacy theory and morality policy to show how one industry sector (the electronic gaming machine sector as part of the wider gambling industry) is subject to this reaction. We suggest that the difficulty in establishing legitimacy (...) surrounding CSR practices in this sector is related to morality policy, whereby ideology and personal values play important roles in dividing opinion. Thus, gambling is often framed as an activity that is morally and ethically problematic. To show how this can manifest, we examine the veracity of two state-funded studies in Australia used in the development of gambling policy and their subsequent adoption in academic research. We highlight methodological, analytical and reporting issues in these studies that normally should be identified by those using such findings. The significance is that when morality policy and conflict surrounding legitimacy are involved, then it can explain why adherence to normative research standards is potentially lowered. Our theoretical posture leads us to further speculate that the adoption and communication of CSR in electronic gambling will be contested by opponents of the industry. (shrink)

In their view, death is embedded in the everydayness of the living. Carlos A. Sánchez, in "Death and the Colonial Difference," explains that the Mexican idea of death reveals much about the (...) life and the situatedness of those who subscribe to the relational dynamic between life and death. Death is linked to the living, especially for those who are situated in inferiorized positions. In the accounts promoted by Paz and by Uranga, the historical and social conditions of lived experience provide the context for how death is conceived, and, subsequently, treated. They advance Mexican conceptions of death and provide interesting perspectives into how some colonized peoples are resisting narrow narratives of death. This is to say that their approaches do not grant the dominant assumption that death is merely a biological event or a life event ceasing the life of the individual. In this essay, I examine their critiques of dominant assumptions of death to elaborate on conceptions of death contextualized within historical and social entanglements, namely, a Mexican analysis of death. In particular, I utilize Paz's work on Day of the Dead fiestas to study communal practices and theorize the ritual dimensions of the life and death relationship. Through an examination of a Mexican approach to death, I contend that rituals of death help locate the non-dominant social logics that engender resistant activity and cultivate a distinct interconnected communal relation.To develop this position, I clarify the historical and social distinctions between Mexican and Anglo-American approaches to death and analyze literature promoting a Mexican view of death. Ultimately, I share a similar view [End Page 31] with Paz, Uranga, and Sánchez who charge that there is a unique Mexican idea of death. However, to be clear, my interest in their work does not assume they represent the Mexican view of death (Brandes, Skulls to the Living). Rather, I am interested in exploring how their discussions of death, from a particular socio-historical situation, reveal ways in which colonized peoples refuse dichotomous narratives of death. Sánchez's work, in particular, provides valuable insights into the Mexican relation with death, particularly the role of coloniality/modernity with temporality. Lastly, as I return to Paz's own discussion of death, I refer to the sensibilities and practices relevant to the resistant dimensions of a Mexican relationship with death. An analysis of Paz's focus on fiestas offers a focus distinct from Sánchez in that it pays significant attention to the ritual dimensions of death and helps illustrate the resistant responses to hegemonic social norms. Thus, paying attention to communal practices, this essay emphasizes the relationship between death rituals and deviant activity to dominant modes of being.What Is Death? Examining the DistinctionsScholars have noted a distinction between the logics involved in European and Anglo-American approaches to death and those of Mexican people. Emilio Uranga asserts that "[f]or the North American (el norteamericano), death is a reality that must be hidden, a phenomenon that is silenced and masked as much as possible so that it will not disturb, with its impertinence, the flow of a life that unfolds in radical dedication to [self]-realization and work" (qtd. in Sánchez 180). I raise three worries according to which there is no conception of a semantic rule that can serve the needs of a modal normativist. The first worry focuses on de re and a posteriori necessities. The second worry concerns Thomasson's inferential specification of the meaning of modal terms. The third worry asks about the normative status of semantic rules.

According to the plurivaluationist, our vague discourse doesn’t have a single meaning. Instead, it has many meanings, each of which is precise—and it is this plurality of meanings that is the source of vagueness. I believe plurivaluationist positions are underdeveloped and for this reason unpopular. This paper attempts to correct this situation by offering a particular development of plurivaluationism that I call supersententialism. The supersententialist leverages lessons from another area of research—the Problem of the Many—in service of the plurivaluationist position. (...) Does moral vagueness require ontic vagueness? A central challenge for nonontic treatments of moral vagueness arises from the referential stability of moral terms across small changes in how they are applied: if moral vagueness is not ontic vagueness, it’s hard to explain this referential stability. However, these techniques were evaluated on a small multilingual corpus of directives and NIMs. In this paper, we utilize word and paragraph embedding models learned by shallow neural networks from a multilingual legal corpus of European directives and national legislation (...) to develop unsupervised semantic similarity systems to identify transpositions. We evaluate these models and compare their results with the previous unsupervised methods on a multilingual test corpus of 43 Directives and their corresponding NIMs. We also develop supervised machine learning models to identify transpositions and compare their performance with different feature sets. Rituals are able to transform ordinary objects into extraordinary objects. And while rituals typically do not cause physical changes, they may imbue objects with a particular specialness – a simple gold band may become a wedding ring, while an ordinary dessert may become a birthday cake. To treat such objects as if they were ordinary then becomes inappropriate. How does this transformation take place in the minds of observers, and how do we recognize it when we see it? Here, we (...) suggest that two under-examined elements of ritual need deeper consideration within the context of ritual cognition. We propose a fully integrated operational definition in which these two critical ritual elements – causal opacity and goal demotion – are included. In a pre-registered experiment one-hundred and one adults, in a 2 × 2 mixed-within participants design observed actions performed upon profane objects. These actions were either ordinary or ritualized, and were described as a blessing, a curse, or were not described at all. Contrary to established findings and pre-registered predictions, we found that ritualized actions alone are not enough to influence perceptions of, and attributions towards, objects, and that positive goal information are more behaviorally persuasive than negative information. However, we found that participants recalled ritualized action in greater detail and with more specificity than ordinary actions. In effect, we demonstrate that causal opacity and goal information interact to allow us to recognize a ritual as a ritual. (shrink)

Adam Elga (Philosophers’ Imprint, 10(5), 1–11, 2010) presents a diachronic puzzle to supporters of imprecise credences and argues that no acceptable decision rule for imprecise credences can deliver the intuitively correct result. Elga concludes that agents should not hold imprecise credences. In this paper, I argue for a two-part thesis. First, I show that Elga’s argument is incomplete: there is an acceptable decision rule that delivers the intuitive result. Many accept David Lewis's (1983) claim that, among the candidate meanings for our predicates, some are more natural than others -- they do better or worse at ``carving nature at its joints''. Call this claim predicate naturalism. Disagreement remains over whether the notion of naturalness extends ``beyond the predicate'' (à la Sider, 2011). Are the candidate meanings of logical vocabulary also more or less natural? Call this claim logical naturalism. -/- One motivation for predicate naturalism comes from its supposed ability (...) to help rebut various radical indeterminacy arguments associated with Hilary Putnam (1977, 1980, 1981). It does so in combination with a popular meta-semantic theory called reference magnetism. I argue that the same threats of Putnam-style radical indeterminacy rearise for proponents of predicate naturalism -- threats which logical naturalism helps rebuts. So, if we accept predicate naturalism because it helps fend off threats of indeterminacy, we should also accept logical naturalism. (shrink)

By exploring this double “seeing,” I articulate the relationship between resistant socialities and Lugones’s notion of decolonial aesthesis. In her only published text on decolonial aesthesis, Lugones states: “Thinking about (...) aesthesis, I think about the body and permeability and all that permeability allows us to reconceive about the world we live in” (qtd. in Ortega 275). Lugones promotes a notion of decolonial aesthesis that engages a resistant permeable sensing and, I argue, is exposed by her distinct approach to cosmology.1My analysis begins with Lugones’s decolonial methodology to articulate a “seeing” of coloniality that I contend leads to her development of decolonial aesthesis. In particular, I show that Lugones sketches a view of decolonial aesthesis as a sensing that grounds resistance to dehumanizing social reductions and reveals a non-dominant social relationality expressed through concrete sensuous movements. I suggest that Lugones theorizes a communal interconnected dimension of resistance as decolonial aesthesis through cosmologic relation. To flesh out this point, I turn to two interlocutors central to Lugones’s intellectual genealogy: Gloria Anzaldúa and Rodolfo Kusch. I conclude by interpreting Lugones’s reading of Anzaldúa as a coalitional movida performing decolonial aesthesis.Moving to “Seeing” ColonialityLugones’s 2010 essay “Toward a Decolonial Feminism” constitutes a methodological intervention or movida in gender scholarship. Referring to the [End Page 22] expansive global power system, Lugones argues that gender is historically implicated as part of the colonial/modern project and sustains a dominative closure that marks alternative socialities as unintelligible. The colonial/modern system established norms that did not previously inform social communities. A gender binary was imposed onto colonized peoples, erasing the existing socialities that informed the everyday of those peoples. Lugones’s analysis of gender exposes the deep social fissures that emerge from coloniality, and the tremendous harm sustained by reading gender across all social arrangements and onto all knowledge systems.According to Lugones, the colonial/modern category of gender shows a pervasive subjugation to non-humanity of peoples whose sex status does not conform to binary logics. Regarding these reductive processes, Lugones writes: “This dehumanization and bestialization occurred precisely because these people were not understood by the colonizers and enslavers as social agents, and thus their sexual difference [was] not socializable. Thus, one does not find gender; animals do not have gender” (“Gender and Universality” 44). Since gender is assigned to humans, reading gender onto colonized peoples covers up dehumanization, even in calls for gender-based liberation.It is precisely through seeing coloniality that we can track the concealed social arrangements and see the worlds of sense that do not conform to the colonial/modern system. Lugones suggests this point in the following quote:To see the coloniality is to see both jaqi, the persona, the being that is in a world of being without dichotomies, and the beast, both real, both vying under different powers for survival. Thus to see the coloniality is to reveal the very degradation that gives us two renditions of life and a being rendered by them.(“Toward a Decolonial Feminism” 751–52)As Lugones’s words indicate, seeing coloniality involves a complex sensing that goes beyond seeing from dominant social norms and gender roles.Lugones’s methodological movida of seeing coloniality reveals the dichotomous categorization as part of the immense violence committed against peoples as colonized subjects with non-human status. In a paper from the 1980s, Byrd claims that the logic of "eventual permanence" for linear time is KD5. In this note we take up Byrd's novel argument for this and, treating the problem as one concerning translational embeddings, show that rather than KD5 the correct logic of "eventual permanence" is KD45.

Duty of care is the core ethical responsibility of healthcare workers. Getting the workforce vaccinated will provide safety to the public, protect the vulnerable population and provide a safe working environment. While most agree that healthcare workers should be prioritised in the vaccination programme, mandatory vaccination remains a complicated and contentious issue with political, legal and ethical dimensions. This study aims to determine the ethical considerations associated with mandatory vaccinations among healthcare workers. A total of 152 abstracts were identified of (...) which, 142 were excluded based on abstracts because they did not meet the inclusion criteria. The remaining ten articles were further evaluated with three articles that fit the inclusion criteria specifically discussing mandatory vaccination among healthcare workers and the ethical issues. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were used as a framework to discuss the ethical considerations which resonated both directly from the included papers, as well as more generally from the other literature associated with this search. There is limited literature on the topic of ethical considerations associated with COVID-19 mandatory vaccination of healthcare workers, as a systematic review identified only 3 papers. Benefits, risks, effectiveness, equity and justice, autonomy, reciprocity and trust were among the seven ethical considerations identified and discussed. (shrink)

BackgroundThe COVID-19 pandemic has presented extraordinary challenges to worldwide healthcare systems, however, prevalence remains low in some countries. While the challenges of conducting research in high-prevalence countries are well published, there is a paucity from low COVID-19 countries.MethodsA PRISMA guided systematic review was conducted using the databases Ovid-Medline, Embase, Scopus and Web of Science to identify relevant articles discussing ethical issues relating to research in low prevalence COVID-19 countries.ResultsThe search yielded 133 original articles of which only 2 fit the inclusion (...) criteria and aim, with neither specific to low prevalence. Most of the available literature focused on clinical management and resource allocation related to high prevalence countries. These results will be discussed under the ethical dimensions of equity, individual liberty, privacy and confidentiality, proportionality, public protection, provision of care, reciprocity, stewardship and trust..ConclusionsA systematic review failed to identify articles relating to COVID-19 research ethics, specific to low prevalence countries. It shows that there is a significant gap in the literature that warrants further investigation. Common ethical principles were used to present a distinct set of challenges experienced by a country with a low prevalence of COVID-19. This unique perspective of some of the common ethical problems surrounding research, may help guide further discussion and guide research in similar countries. (shrink)

We present four classical theories of counterpossibles that combine modalities and counterfactuals. Two theories are anti-vacuist and forbid vacuously true counterfactuals, two are quasi-vacuist and allow counterfactuals to be vacuously true when their antecedent is not only impossible, but also inconceivable. The theories vary on how they restrict the interaction of modalities and counterfactuals. We provide a logical cartography with precise acceptable boundaries, illustrating to what extent nonvacuism about counterpossibles can be reconciled with classical logic.

This paper argues that adopting a particular dialogical account of logical consequence quite directly gives rise to an interesting form of logical pluralism, the form of pluralism in question arising out of the requirement that deductive proofs be explanatory.

This paper asks: Is the quantifier variantist committed to metaphysical vagueness? My investigation of this question goes via a study of vague existence. I’ll argue that the quantifier variantist is committed to vague existence and that the vague existence posited by the variantist requires a puzzling sort of metaphysical vagueness. Specifically, I distinguish between (what I call) positive and negative metaphysical vagueness. Positive metaphysical vagueness is (roughly) the claim that there is vagueness in the world; negative metaphysical vagueness is (roughly) (...) the claim that there is vagueness that is not in our language or thought. I’ll argue that the quantifier variantist’s commitment to vague existence comes with positive metaphysical vagueness -- even if it doesn't require negative metaphysical vagueness. (shrink)

This paper argues that a prominent—and oft-thought to be persuasive—argument against general validity as the best account of validity for languages containing the actuality operator is flawed, the flaw arising out of inadequate attention to the formalisation of mood distinctions.

The present note investigates the connection between nonreflexive and nontransitive logics from a bounds-theoretic perspective. What will emerge is one way in which, if we focus on the ways in which strict and tolerant acts constrain one another, nonreflexive and nontransitive notions of consequence can be seen as simply reflecting different aspects of the same underlying reality.

In Parts of Classes David Lewis argued that mereology is ‘ontologically innocent’, mereological notions not incurring additional ontological commitments. Unfortunately, though, Lewis’s argument for this is not fully spelled out. Here we use some formal results concerning translations between formal languages to argue for the ontological innocence of mereology directly.

The effects of climate change are far reaching and widespread. As the issue continues to batter the world, the call for mitigation initiatives is becoming louder. In responding to this call we take a multidisciplinary approach to examining board diversity as an innovative solution in tackling climate change. Utilizing data from 69 fossil fuel organizations, our findings suggest that increasing female representation and foreign culture representation on the board can effectively reduce greenhouse gas emissions, the main contributor to climate change. (...) In part, this is achieved through responsible leadership and innovation. Our contributions reach beyond traditional board diversity literature, where the benefits of diversity are confined primarily to a discussion of corporate social responsibilities. Instead, we depict the benefits of board diversity as a direct lever in mitigating climate change. We propose that this is through the diversified board's enhanced ability to identify stakeholder needs and, subsequently, conceive of more effective and responsibly innovative solutions. (shrink)

What does it take for two logics to be mere notational variants? The present paper proposes a variety of different ways of cashing out notational variance, in particular isolating a constraint on any reasonable account of notational variance which makes plausible that the only kinds of translations which can witness notational variance are what are sometimes called definitional translations.

We give a simple sequent calculus presentation of R.B. Angell’s logic of analytic containment, recently championed by Kit Fine as a plausible logic of partial content.

Some theorists have developed formal approaches to truth that depend on counterexamples to the structural rules of contraction. Here, we study such approaches, with an eye to helping them respond to a certain kind of objection. We define a contractive relative of each noncontractive relation, for use in responding to the objection in question, and we explore one example: the contractive relative of multiplicative-additive affine logic with transparent truth, or MAALT. -/- .

_Many scholars argue that the spiritual dimensions of aesthetic practices and resistance have been undertheorized or omitted. This paper examines aesthetic processes taken up by Amelia Mesa-Bains (1994, 1999) and Gloria Anzaldúa (1987, 2015) to theorize how some Chicanx artists employ an aesthetic based on spirituality as relational, memorial, and material practice to critique colonial ideologies embedded in dichotomies such as man/woman, subject/object, fine/folk art, and individual/community. By focusing on Mesa-Bains’ altar installations and Anzaldúa’s writing process, I draw out how (...) social relations and memory work operate to interpret the relationship between aesthetics and spirituality. I argue that the relational dynamic of their aesthetic sensibilities and techniques show ways some Chicanx scholars and artists subscribe to a sense of spirituality that maintains interconnected relations with others who have been disempowered and marginalized._ _ __To support this position, in the first half of the paper, I analyze the relational sensibilities central to_ _Chicanx aesthetic sensibility of _rasquache domesticana,_ which highlights the concrete spaces in which Chicanx, their aesthetic perception, and techniques generate a communal resistance that is sustained through spirituality. The second half turns to Mesa-Bains’ altar installation for Sor Juana Inés de la Cruz (1994) and Anzaldúa’s writing process described in Borderlands (1987) to clarify ways in which aesthetics and spiritual relations engender practices of resistance to social dichotomies. _.
