This study builds on the work of contemporary civic republicans, supplying a detailed analysis of the concept of domination absent in the familiar accounts of political freedom as non-domination.

This masterly study has a grand sweep. It ranges over centuries, with a long look backward over several millennia. Yet the history it unfolds is primarily the story of individuals: thinkers and dreamers who envisaged an ideal social order and described it persuasively, leaving a mark on their own and later times. The roster of utopians includes men of all stripes in different countries and eras--figures as disparate as More and Fourier, the Marquis de Sade and Edward Bellamy, Rousseau and (...) Marx. Fascinating character studies of the major figures are among the delights of the book. Utopian writings run the gamut from fictional narratives to theoretical treatises, from political manifestos to constitutions for a new society. The Manuels have structured five centuries of utopian invention by identifying successive constellations, groups of thinkers joined by common social and moral concerns. Within this framework they analyze individual writings, in the context of the author's life and of the socio-economic, religious, and political exigencies of his time. Concentrating on innovative works, they highlight disjunctures as well as continuities in utopian thought from the Renaissance through the twentieth century. Witty and erudite, challenging in its interpretations and provocative in the questions it poses, the Manuels' anatomy of utopia is an adventure in ideas. (shrink)

This article aims to offer a refined way of understanding what we mean by the concepts of meaningfulness and meaning in life. The first step is to separate worthwhileness, as the broadest evaluation of life taking all types of values into account, from meaningfulness, which is seen as one type of intrinsic value along with, for example, well-being, moral praiseworthiness, and authenticity, which I argue are also separate types of intrinsic value. After discussing why we should not settle with the (...) currently popular fitting attitudes analysis of meaningfulness, I argue that the meaningfulness of a life should be seen to be about the positive contribution beyond itself that this particular life is able to make. I show how this analysis is different from previous similar accounts and how it is able to avoid a number of challenges that have troubled these previous accounts, such as the pleasure machine challenge, the results machine challenge, and the doing good unintentionally challenge. I also demonstrate how it is able to account for prototypical examples of meaningful and meaningless lives and how it is compatible with subjectivism, supernaturalism, and objective naturalism, which is seen as a merit. Finally, I conclude with some notes about what could make life meaningful, given the current analysis of meaningfulness itself. (shrink)

We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

In this forcefully argued collection of essays, Frank Cioffi examines Wittgenstein's reflections on the comparative claims of clarification and empirical enquiry. Though writing out of admiration and indebtedness, he expresses reservations as to the limits Wittgenstein places on the relevance and (...) desirability of empirical knowledge. His discusssions extend from Wittgenstein's reflections on human sacrifice and other ritual practices dealt with by Frazer to Freud's account of the sources of anxiety, depression, dreams and laughter. This book presents a reinvigorating look at psychology and its societal purpose, offering a bold new philosophical foundation from which professionals in the field can deeply examine their work.

Professor Hausman has written an interesting and instructive book. Though I am by no means favourably disposed to methodology for economists,, I found reading Hausman enjoyable and I came away having learned things worth learning. But not all is well, largely because Hausman is a philosopher first and an economist a poor second. There are also important questions where one would have expected philosophic help which are not asked at all.

. Can the label “law” apply to rules as amoral as the enactments of the Nazis? This question confronted the courts in Germany after 1945. In dealing with it, the judges had to take sides in the philosophical debate over the concept of law. In this context, the prominent voices of the legal philosophers Gustav Radbruch and Hans Kelsen could not go unheard. While the rule of law is surely a very important good, the familiar discussions found in the literature lead many to conclude that it is either a relatively trivial political ideal, or else a redundant one. What is needed is a new and persuasive defense of the rule of law that properly reflects its great significance for human well being. An important step towards building such an argument is to question a widely-shared but often unnoticed assumption that the rule of (...) law should be understood as a virtue of legal systems. The path is then cleared for a republican argument built on two theses: first, the thought that an ideal society would be one in which no one is the master of anyone else, and second, the thought that our freedom from domination is not natural or pre-institutional. The literature on human mate preferences is vast but most data come from studies on college students in complex societies, who represent a thin slice of cultural variation in an evolutionarily novel environment. Here, I present data on the mate preferences of men and women in a society of hunter-gatherers, the Hadza of Tanzania. Hadza men value fertility in a mate more than women do, and women value intelligence more than men do. Women place great importance on men’s foraging, and (...) both sexes rate character as important. Unlike college students, Hadza men place considerable importance on women being hard-working, and Hadza women cite looks about as often as men do. (shrink)

The present article represents a further critical use of this material that we deem worthy of publication.in this vital and splendidly crafted work, Bethany Henning recovers a philosophy of aesthetic wisdom far richer (...) than the narrow epistemological lens dominant today. From its start, American philosophy looked beyond Europe's atomistic empiricism toward a continuity between our thought and nature's aesthetic splendor. Jonathan Edwards found beauty in the structure of being reflected in relations among ideas. For Emerson, each of us is a "transparent eyeball" in which nature's beauty fortifies our moral and spiritual agency. At the apex of this tradition is John Dewey, for whom "aesthetic experience [is] the highest mode of human experience" (Henning 55).Although aesthetic theory is usually associated with the cognitive evaluation of art, Dewey explores a broader non-reflective or unconscious dimension. Henning's appropriation of "unconscious"—the cradle of Freud's infantile id—is intentionally provocative. American culture, reflected in academic thought, has largely resisted appeals to subterranean urges and drives. In doing so, however, we perpetuate a myth of rational and moral exceptionalism masking a history of colonialism, oppression, and crass commercialism. In accepting the unconscious, European thought has taken strides to acknowledge and address such ills. Henning wonders whether America might accept "a dynamic unconscious, were it presented with an alternative mythology" (10) and finds a viable candidate in Dewey's underappreciated notion of qualitative immediacy: an "aesthetic (directly felt) connection between ourselves and [End Page 77] the world" (Henning 5). In affirming the unconscious depth of experience, this American reconfiguration welcomes "aesthetic experience back into our philosophical lives" (Henning 5).When embodied meaning supplements cognitive reflection, we come to champion "the sensuous, lived body" as "the primary reality" of qualitative immediacy—a felt aesthetic unity punctuated by "impulsions" arising from an organism's needs (Henning 69). As "a site of adaptive adjustments," Henning continues, "the body is responsive to the brink of coalescence at the point of contact with the world, in which things that are 'outside of it' belong to it" (71). "To move adeptly into aesthetic experience means to be skilled at loosening focal consciousness" so as to cultivate "the essential porousness of the world" (130).With this, the body-mind relation becomes a problem of normative aesthetics, not epistemology. Strong reciprocity is an effective way to promote cooperation. This is especially true when one not only cooperates with cooperators and defects on defectors (second-party punishment) but even punishes those who defect on others (third-party, “altruistic” punishment). Some suggest we humans have a taste for such altruistic punishment and that this was important in the evolution of human cooperation. To assess this we need to look across a wide range of cultures. As part of a cross-cultural project, I played three (...) experimental economics games with the Hadza, who are hunter-gatherers in Tanzania. The Hadza frequently engaged in second-party punishment but they rarely engaged in third-party punishment. Other small-scale societies engaged in less third-party punishment as well. I suggest third-party punishment only became more important in large, complex societies to solve more pressing collective-action problems. (shrink)

Algorithmic decision-making increasingly shapes people's daily lives. Given that such autonomous systems can cause severe harm to individuals and social groups, fairness concerns have arisen. A human-centric approach demanded by scholars and policymakers requires considering people's fairness perceptions when designing and implementing algorithmic decision-making. We provide a comprehensive, systematic literature review synthesizing the existing empirical insights on perceptions of algorithmic fairness from 58 empirical studies spanning multiple domains and scientific disciplines. Through thorough coding, we systemize the current empirical literature along (...) four dimensions: (1) algorithmic predictors, (2) human predictors, (3) comparative effects (human decision-making vs. algorithmic decision-making), and (4) consequences of algorithmic decision-making. While we identify much heterogeneity around the theoretical concepts and empirical measurements of algorithmic fairness, the insights come almost exclusively from Western-democratic contexts. By advocating for more interdisciplinary research adopting a society-in-the-loop framework, we hope our work will contribute to fairer and more responsible algorithmic decision-making. (shrink)

This article reconstructs Badiou’s oeuvre from the vantage point of the last volume of his Being and Event trilogy. It determines the perspective and task of The Immanence of Truths and demonstrates in what way an “absolute ontology” is the result of an act of forcing that serves as the measure for a truth’s truthness. This allows to argue that Badiou’s is and always was a philosophy of freedom.

Menopause is puzzling because life-history theory predicts there should be no selection for outliving one’s reproductive capacity. Adaptive explanations of menopause offered thus far turn on women’s long-term investment in offspring and grandoffspring, all variations on the grandmother hypothesis. Here, I offer a very different explanation. The patriarch hypothesis proposes that once males became capable of maintaining high status and reproductive access beyond their peak physical condition, selection favored the extension of maximum life span in males. Because the relevant genes (...) were not on the Y chromosome, life span increased in females as well. However, the female reproductive span was constrained by the depletion of viable oocytes, which resulted in menopause. (shrink)

In a modern, plural society, there can be no settled agreement on the concrete legal content of a country's constitution. The idea of the constitution is nonetheless pivotal in contemporary, liberal‐minded theories of political justification, such as the ones advanced by Jürgen Habermas and John Rawls. Justification in these theories depends finally on “constitutional patriotism,” a consciously shared sentiment arising from an ethical assessment of their country by the country's people, according to which the country credibly pursues a certain regulative (...) political ideal for which the constitution stands. The main response to the multiple crises besetting Western societis in the past decades has been the attempt of the academic and scientific as well as political circles to gain a sense of orientation—and of social cohesion—by two main modes of thinking: identity politics and evidence-based knowlegde. Regarding the latter, I argue that if scientific knowledge is reduced to facts, data and numbers, as the basis for political decisions without any alternatives, it would become a dogma propagating the truth—that is, (...) a new religion. Politicians will no longer have to struggle with other perspectives, once there is a consensus about following the line that “the numbers or the facts speak for themselves.” While many people would perhaps find in this new religion a guarantee of security in an insecure world, this sense would be illusionary. I argue that the role intellectuals should play in a spiritual crisis of this kind is paradoxically to cultivate a sense of more security by strengthening a culture of “insecureness” or docta ignorantia against the dogmas within science and religion. To create and encourage a new art of questioning and listening, and of learning to appreciate non-knowledge as the basis of coming together. This notion is found in the Greek and Christian as well as the Jewish tradition of European thought, and it continues in the works of modern thinkers such as Paul Ricoeur, Hermann Cohen, Martin Buber, Hartmut Rosa, and of philosophers who focus on the question of the ineffable. My aim is to present this quality of certainty within uncertainty by examples from different fields, including philosophy, art and psychotherapy, and to elaborate on the paradoxical question: does a troubled Geist need more trouble in order to help us find a sense of orientation through disorientation? For several decades, renewed interest in the connection between perception and knowledge has sustained a robust debate over external world skepticism. Recently, however, a growing consensus claims the skeptical challenge has been substantially met, and that realism in some robust form has emerged a clear victor. I invite us to rethink this consensus in a two-part response. The first forges a temporary alliance with skepticism against prominent forms of contemporary realism. That these fail to rebuff ews bolsters Barry Stroud’s call (...) for a new paradigm of objectivity. In the second part I sketch such a paradigm based upon a transactional interpretation of John Dewey’s pragmatism, and indicate its resilience to skeptical attacks. (shrink)

In contrast to educational policies in the U.S., which assume an individualistic path of success and promote the assimilation of students, this essay argues for pedagogies where teachers focus upon facilitating the development of strong relationships en route to creating exciting educational environments and fertile contexts for social justice movements. Powerful teachers model the process whereby a commitment to appreciating the perspectives of individual students is combined with the orchestration of a dynamic intersubjective context, because such contexts call out the (...) strongest performances of individuals. Viewing educational events in terms of the patterns and rhythms that transpire in a particular social fields allows educators ways to create powerful educational environments even in neocolonial contexts that pit students and teachers against one another. Viewing educational events as social fields also allows us to understand how the common classroom, which focuses each student on the material in front of them, creates impotent individuals who dissociate themselves from others. Increasing complexities facing physicians negotiating the bedside decision continue to fuel the debate over who is the appropriate party to offer ethics consults, should one be needed, during the decision-making process. Some very good arguments have been put forth on behalf of clinical ethicists as being the proper and best party to engage in ethics consultations. However, serious questions remain about the role of the clinical ethicist and his ability to provide the necessary level of objectivity called for in an (...) ethics consult.I argue that the clinician's professional psyche, or mode of thinking as a professional, leaves him little room to maneuver as an objective and detached third party ethics consultant. Several factors are cited and discussed that greatly influence the analyses applied to a case problem by physicians. The most formidable of these factors are habits and the practice of defensive medicine. I conclude that clinical ethicists are less suited for the overall tasks required of an objective consultant in medical cases that appear to involve insurmountable ethical issues. (shrink)

With few exceptions, it has been put forward as representing positivism in contemporary sociology. Sellars refers to it as a new and virulent form of positivism—logical positivism. In philosophy, logical positivism is the culmination of the sensationalism of Berkeley and Hume, the positivism of Mach and Avenarius and Comte, and the logistic of Russell and Wittgenstein. In sociology, (...) the philosophic assumptions of this school have been stated in a naive form, in addition to presenting Kantian idealism contradicted by an assumption of philosophic realism. Positivists since the time of Comte have defined objectivity in science in terms of the absence of prejudice on the part of the scientist towards the phenomena with which he deals. It has been assumed that if the observer would contemplate the facts himself, this objectivity—an absence of bias—could be attained. However, social psychologists, notably C. H. Cooley and G. H. Mead, have shown that this is not necessarily the case. In the study of culture, an outstanding positivist, W. G. (...) Sumner, in his discussion of folkways and mores, has shown that this objectivity is impossible to attain. These men have described the process through which objects arise in one's experience, and come to be defined in terms of that experience, so that the same object may mean different things to different people.
