The recent renewal of interest in the philosophy of Henri Bergson has increased both recognition of his influence on twentieth-century philosophy and attention to his relationship to phenomenology. Until now, the question of Martin Heidegger’s debt to Bergson has remained largely unanswered. Heidegger’s brief discussion of Bergson in Being and Time is geared toward explaining why he fails in his attempts to think more radically about time. Despite this dismissal, a close look at Heidegger’s early works dealing with temporality reveals (...) a sustained engagement with Bergson’s thought. In The Origin of Time, Heath Massey evaluates Heidegger’s critique of Bergson and examines how Bergson’s efforts to rethink time in terms of duration anticipate Heidegger’s own interpretation of temporality. Massey demonstrates how Heidegger follows Bergson in seeking to uncover “primordial time” by disentangling temporality from spatiality, how he associates Bergson with the tradition of philosophy that covers up this phenomenon, and how he overlooks Bergson’s ontological turn in Matter and Memory. Through close readings of early major works by both thinkers, Massey argues that Bergson is a much more radical thinker with respect to time than Heidegger allows. (shrink)

Institution and Passivity is based on course notes for classes taught at the Bibliothèque Nationale de Paris. Philosophically, this collection connects the issue of passive constitution of meaning with the dimension of history, furthering discussions and completing arguments started in The Visible and the Invisible and Signs. Leonard Lawlor and Heath Massey’s translation makes available to an English-speaking readership a critical transitional text in the history of phenomenology.

On April 22, 1922, the Societé française de Philosophie hosted Albert Einstein for a discussion of the theory of relativity. In the course of this discussion, Henri Bergson, who was at that time writing Duration and Simultaneity, which explored some of the philosophical implications of Einstein's theory, was asked to share his thoughts. The resulting remarks offer a glimpse into Bergson's analysis of the concept of simultaneity, and Einstein's brief reply reveals his insistence that time itself, not just "the physicist's (...) time," is relative. Heidegger claims in Being and Time that Bergson fails to overcome traditional ontology because his concept of time is fundamentally Aristotelian. On the basis of this hasty dismissal, it is tempting to conclude that Heidegger was not terribly interested in Bergson or that he only wanted to prevent readers from confusing his view of time with Bergson’s. To the contrary, a survey of Heidegger’s early lectures and writings on the issue of time reveals a strong interest in Bergson and an (...) acknowledgement of his importance as a pivotal thinker concerning time. In fact, Heidegger appropriates key aspects of Bergsonism, such as Bergson’s way of contrasting the measurement of time and its experiential origins, revealing that his ambivalence toward Bergson initially arises from concerns about his method and his concept of life rather than his understanding of time. ABSTRACT Philosophers who work on race and racism have been reluctant to embrace the notion that the United States is, or will soon be, a postracial society. For many, this view is refuted by a wealth of evidence that racism persists in many forms and that race continues to have a significant impact on one's life chances. Nevertheless, some critics of postracialism have refused to reject it in principle or have exempted a particular variety of it from their critiques. This (...) essay attempts to show that the ideal of a postracial society is actually a combination of two contradictory tendencies, each defined by its temporality. Distinguishing these tendencies allows us to see that there are two fundamentally different types of postracialism with contradictory assumptions and conflicting priorities. (shrink)

According to Hannah Arendt, the first impetus for her final project, The Life of the Mind, was her astonishment at the apparent lack of thought at the root of Adolf Eichmann’s crimes against humanity—a “manifest shallowness” which, nevertheless, “was not stupidity, but thoughtlessness.” This spectacle of the absence of thought, in the light of the immeasurable harm done to the victims of the Nazi regime, motivated her to get to the bottom of what it means to think. Since thinking is (...) often portrayed by philosophers as a withdrawal from the world, Arendt raises the question “Where are we when we think?” In pursuit of an answer, she provides a reading of Kafka’s parable “HE,” which she interprets as a description of the “region of thought” as a battleground between the past and thefuture. This parable enables Arendt to understand the activity of thinking in terms of temporality. While Kafka’s protagonist dreams of rising above the conflict and adopting a position outside time, Arendt argues that thoughtful reflection happens in the “gap between past and future” which philosophers have called the nunc stans or the moment. Rather than being timeless, in her view, thinking moves along a diagonal “thought-train” emerging from this gap. Arendt sheds more light on thinking by considering how its temporality differs from that of willing, which is determined by a primacy of the future. This difference between thinking and willing produces a conflict between them, which many philosophers have struggled to resolve. Arendt presents Hegel as a case in which this conflict is resolvednot, as we might expect, by a triumph of thought, but rather a triumph of the will. Arendt’s reflections on the temporality of thinking in Kafka and Hegel enable us to distinguish several different forms of thoughtlessness according to their dominant tense. Although Arendt does not spell out these distinctions herself, they make it possible to develop a deeper understanding of Eichmann’s thoughtlessness and its relation to evil. (shrink)

Heidegger, mettant plus particulièrement en lumière l’influence de celui-là sur celui-ci, une influence largement passée inaperçue. L’importance de cette œuvre tient dans la façon dont l’A. conteste la philosophie du temps que Heidegger attribue à Bergson. Notre guide considère la lecture bergsonienne de Heidegger comme une « oversimplication » (p. 84) et vise à éclaircir comment, malgré les propos du penseur allemand, le philosophe français a été capable de radicalement repenser le temps d’un point de vue ontologique. In public accounting, it is well documented that auditors’ focus on the financial/profitability aspects of their work creates ethical challenges that can compromise the auditors’ ability to uphold the public interest :C28–C36, 2008; Chow et al., in Res Prof Responsib Ethics Account 17:97–138, 2013; Fogarty and Rigsby, in J Account Org Change 6:300–329, 2010; Gendron, in Contemp Account Res 18:283–310, 2001; Account Org Soc 27:659–684, 2002; Lampe and Garcia, in Res Prof Responsib Ethics Account 17:1–45, 2013; Wyatt, in Account Horiz (...) 18:45–53, 2004; Zeff, Account Horizons 17:189–205, 2003a; Account Horizons 17:267–286, 2003b). In their paper, Fiolleau and Kaplan, 2016) address the void by providing insight into the impact of corporate reward structure on the ethical sensitivity of accountants practicing in industry and accounting students. Further, they contribute to the literature by measuring ethical sensitivity using a novel funnel questioning technique, which addresses methodological challenges associated with studying ethical sensitivity. In these comments, I discuss my perspective on Fiolleau and Kaplan’s, 2016) key contributions to the literature and provide suggestions for moving the research forward in the future. (shrink)

Loss of the Y‐chromosome is a common feature of species with chromosomal sex determination. However, our understanding of why some lineages frequently lose Y‐chromosomes while others do not is limited. The fragile Y hypothesis proposes that in species with chiasmatic meiosis the rate of Y‐chromosome aneuploidy and the size of the recombining region have a negative correlation. The fragile Y hypothesis provides a number of novel insights not possible under traditional models. Specifically, increased rates of Y aneuploidy may impose positive (...) selection for (i) gene movement off the Y; (ii) translocations and fusions which expand the recombining region; and (iii) alternative meiotic segregation mechanisms (achiasmatic or asynaptic). These insights as well as existing evidence for the frequency of Y‐chromosome aneuploidy raise doubt about the prospects for long‐term retention of the human Y‐chromosome despite recent evidence for stable gene content in older non‐recombining regions. Habermas has argued that many of the endemic socio- economic problems of Western society are either symptoms or prod ucts of a 'lopsided' process of cultural rationalization, one that has emphasized instrumental forms of rationality over communicative. But other than presenting a rather general typology of lifeworld pathologies, Habermas has not done much to specify what these problems might be, nor has he provided any 'middle-range' analysis of the mechanisms through which they might be generated. This paper discusses some of (...) the ways in which, consistent with Haber mas's general framework, rational choice theory can be used for pre cisely this task. In this analysis, rational choice theory is not presented as a comprehensive theory of action, but is employed as a critical- diagnostic tool that allows the theorist to identify undesirable social interaction patterns that arise from a broader instrumentalization of the lifeworld. Moriarty argues that the Market Failures Approach to business ethics is inapplicable to “real world” problems, because it treats “market failure” as a failure to achieve Pareto efficiency. Depending upon how it is applied, Pareto efficiency is either trivially easy to satisfy or else so demanding that no real-world market could ever satisfy it. In this Commentary, I argue that Moriarty overstates these difficulties. The regulatory structure governing markets is best understood as an attempt to maximize the number of Pareto-improving (...) exchanges that occur. There is no reason to think business self-regulation cannot be guided by the same normative-conceptual framework. (shrink)

Society, based on contract and voluntary exchange, is evolving, but remains only partly developed. Goods and services that meet the needs of individuals, such as food, clothing, and shelter, are amply produced and distributed through the market process. However, those that meet common or community needs, while distributed through the market, are produced politically through taxation and violence. These goods attach not to individuals but to a place; to enjoy them, individuals must go to the place where they are. Land (...) owners, all unknowingly, distribute such services contractually as they rent or sell sites. Rent or price is the market value of such services, net after disservices, as they affect each site. By distributing occupancies to those who can pay the highest price, land owners’ interests align with those of society. Without this, tenure would be precarious—by force or favor of politicians. The 18th-century separation of land from state, so little studied by historians, permitted the development of modern property in land. This change is perhaps “the greatest single step in the evolution of Society the world has ever seen.” When land owners realize that they market community services, they will organize to produce and administer them as well, and society will be made whole. This book advances a novel theory of international justice that combines the orthodox liberal notion that the lives of individuals are what ultimately matter morally with the putatively antiliberal idea of an irreducibly collective right of self-governance. The individual and her rights are placed at center stage insofar as political states are judged legitimate if they adequately protect the human rights of their constituents and respect the rights of all others. Yet, the book argues that legitimate states have a moral (...) right to self-determination and that this right is inherently collective, irreducible to the individual rights of the persons who constitute them. Exploring the implications of these ideas, the book addresses issues pertaining to democracy, secession, international criminal law, armed intervention, political assassination, global distributive justice, and immigration. A number of the positions taken in the book run against the grain of current academic opinion: there is no human right to democracy; separatist groups can be morally entitled to secede from legitimate states; the fact that it is a matter of brute luck whether one is born in a wealthy state or a poorer one does not mean that economic inequalities across states must be minimized or even kept within certain limits; most existing states have no right against armed intervention; and it is morally permissible for a legitimate state to exclude all would-be immigrants. Any theory of practical irrationality necessarily imposes a division of labour between an account of the agent's intentional states and how these are formed, and an account of how these intentional states get applied in particular circumstances to choose a particular action. Nevertheless, questions that concern the content of the agent's beliefs and desires are still routinely lumped together with questions that deal with the way the agent chooses in the light of these beliefs and desires. Despite their centrality and importance to both science and philosophy, relatively little has been written about thought experiments. This volume brings together a series of extremely interesting studies of the history, mechanics, and applications of this important intellectual resource. A distinguished list of philosophers and scientists consider the role of thought experiments in their various disciplines, and argue that an examination of thought experimentation goes to the heart of both science and philosophy.

Husserl’s early picture of explanation in the sciences has never been completely provided. This lack represents an oversight, which we here redress. In contrast to currently accepted interpretations, we demonstrate that Husserl does not adhere to the much maligned deductive-nomological (DN) model of scientific explanation. Instead, via a close reading of early Husserlian texts, we reveal that he presents a unificationist account of scientific explanation. By doing so, we disclose that Husserl’s philosophy of scientific explanation is no mere anachronism. It (...) is, instead, tenable and relevant. We discuss how Husserl and other contemporary thinkers draw theoretical inspiration from the same source—namely, Bernard Bolzano. Husserl’s theory of scientific explanation shares a common language and discusses the same themes as, for example, Phillip Kitcher and Kit Fine. To advance our novel reading, we discuss Husserl’s investigations of grounding, inter-lawful explanation, intra-mathematical explanation, and scientific unification. (shrink)

This work analyzes the centrality of law in nineteenth-century historical and institutional economics and is a prehistory to the new institutional economics of the late twentieth century. In the 1830s the 'new science of law' aimed to explain the working rules of human society by using the methodologically individualist terms of economic discourse, stressing determinism and evolutionism. Practitioners stood readier than contemporary institutionalists to admit the possibilities of altruistic values, bounded rationality, and institutional inertia into their research program. Professor Pearson (...) shows that the positive analysis of law tended to push normative discussions up from the level of specific laws to that of society's political organization. The analysis suggests that the professionalization of the social sciences - and the new science's own imprecision - condemned the program to oblivion around 1930. Nonetheless, institutional economics is currently developing greater resemblances to the now-forgotten new science. (shrink)
