The Framers understood the Constitution to be the fundamental expression of the rule of law over against the arbitrary, intemperate, and unjust “rule of men” that all too frequently existed in the political world, unfortunately both democratic as well as monarchical. Accordingly, the rule of law requires a well functioning political and legal system that includes legislative checks and balances, the separation of power between the President and Congress, an independent judiciary, federalism, etc. What happens when this “Madisonian” constitutional system, (...) designed to express “the deliberate sense of the community,” runs into a Judicial branch that, in effect, claims we live under a Constitution, but the Constitution is what we say it is. Must the Judiciary itself be subject to the rule of law, and the decisions of a constitutional majority, or does their “independence” extend to being independent of the constraints of the rule of law and, thus, decent majority rule? How did the original John Marshall Court answer these questions, and what light do the leading cases and controversies shed on the relationship between the Marshall Court and the Madisonian System? After biologist Deborah Gordon made a series of experimental discoveries in the 1980s, she argued that a change in terminology regarding the division of labor among castes of specialists was needed. Gordon’s investigations of the interactive effects of ants in colonies led her to believe that the established approach Edward O. Wilson had pioneered was biased in a way that made some alternative candidate adaptive explanations invisible. Gordon argued that this was because the term “division of labor” (...) implied a division among specialists that was unwarranted, and proposed “task allocation” as a better description that did not bias research against the alternative causes she had discovered. Gordon’s empirical findings and theoretical proposals also vindicate the initial critics of Wilson’s human sociobiology who have been dismissed as political radicals, but her proposals have been widely misunderstood by many contemporary behavioral ecologists. The terminological and methodological confusions rampant in contemporary discourse can be clarified by applying a framework developed by Elisabeth Lloyd involving an analysis of the constraints imposed by different research questions. Applying this framework will show how the methodological problems involving description raised by the initial critics of Wilson’s human sociobiology extended to his analysis of ants, indicating that they were not challenging Wilson’s naturalistic approach to the study of human evolution, but rather his methods. It will also show how confusion over how Gordon’s proposed research questions have been conflated with the possible answers she has argued ought to be investigated. This in turn will clarify contemporary disputes over her proposal to abandon the term “division of labor.”. (shrink)

Moral latitude is only ever a matter of coincidence on the most popular decision procedure in the literature on moral uncertainty. In all possible choice situations other than those in which two or more options happen to be tied for maximal expected choiceworthiness, Maximize Expected Choiceworthiness implies that only one possible option is uniquely appropriate. A better theory of appropriateness would be more sensitive to the decision maker’s credence in theories that endorse agent-centred prerogatives. The biblical notion of dominion has often been cited as the source and sanction for Western attitudes of environmental disregard. An analysis of the Genesis passage in which dominion (radah) is mentioned reveals a curious misreading of the text: dominion is actually an ideal of human-divine intimacy and peacefulness-as one ought to expect in a paradise creation story. I analyze Genesis dominion not only as areligious concept, but also as a philosophical notion manifesting the Hebrew self-understanding of its contemporary experience (...) with the natural world. Being a verb, radah is also an action concept that connotes an ethic of environmental responsibility. Dominion authorizes a philosophical critique of Western attitudes and practices of environmental exploitation. I defend it here as an intentional expression of the Western religious consciousness that could, if it were understood as an ideal of responsible action rather than as an authorization for callous disregard of the natural world, actually promote interreligious dialogue on environmental issues. A study of 612 CPAs employed in four separate regions of the People’s Republic of China shows that they exhibit ethical orientations that are not significantly different from one another and that they do not, as a group identify with the Subjectivist description provided in the Forsyth et al. (Journal of Business Ethics 8(83):813–833, 2008) meta-analytic international study involving the Ethical Position Questionnaire. Confirmatory factor analysis did however establish the validity of the instrument as a measure of idealistic and relativistic (...) tendencies. It was established that the ethical tone within local accounting firms plays a significant role in forming ethical positions and that these variables together work to influence ethical judgement making with respect to issues involving independence and objectivity. The constructs of relativism and idealism act as reliable predictors of moral choice, but need to be carefully interpreted in the context of field research. The study highlights concerns about the ethicality of a fledgling group of professionals having to cope with the exigencies associated with the world’s fastest developing economy. (shrink)

In this paper, I explore the origins of the ‘problem of universals’. I argue that the problem has come to be badly formulated and that consideration of it has been impeded by falsely supposing that Platonic Forms were ever intended as an alternative to Aristotelian universals. In fact, the role that Forms are supposed by Plato to fulfill is independent of the function of a universal. I briefly consider the gradual mutation of the problem in the Academy, in Alexander of (...) Aphrodisias, and among some of the major Neoplatonic commentators on Aristotle, including Porphyry and Boethius. (shrink)

Self-Deception and the Common Life investigates the topic of self-deception from three points of view: philosophical psychology, ethics, and theology. Empirical evidence and an -ordinary language- analysis support the case that the linguistic expression 'self-deception' is literally meaningful and that the language of the common life can be trusted. After critically analyzing the cognition, translation, and action accounts, along with the contributions of Freud and Sartre, Steffen proposes a new synthetic -emotional perception- account, one that avoids paradox. Giving attention to (...) relevant moral issues, he argues that self-deception is not immoral, but represents a peculiar form of akrasia. Finally, because theologians employ 'self-deception' to describe the cognitive component of sin, Steffen considers the logic of theological self-deception. This paper has two central purposes: the first is to survey some of the more important examples of fallacious argument, and the second is to examine the frequent use of these fallacies in support of the psychological construct: Attention Deficit Hyperactivity Disorder. The paper divides 12 familiar fallacies into three different categories—material, psychological and logical—and contends that advocates of ADHD often seem to employ these fallacies to support their position. Religion and ethics overlap and are in many respects related; yet, they differ in their primary focus of concern. Ethics projects are anthropocentric in that they are constructed in the context of self-other relationships, which includes human beings in relation to the "other" of the natural world, and even religious ethics reflect this relational structure. Religion, however, is focused on the human relation to ultimacy and presents a distinctive consciousness of the self and its relations, including relation to the natural (...) world. As religion decenters the self and reframes how the self is related to the other of the natural world-Thomas Merton and Thich Nhat Hanh articulate this distinctively religious consciousness in relation to the environment-religious consciousness can provide positive support for actions of care and regard toward the natural world. But religion need not go this direction. Focused as it is on ultimacy, which is a power concept that can be dangerous, religion can also sponsor destructive environmental action. Although religion can, indeed, yield in distinctive ways actions and attitudes that amount to support for an ethic of positive regard for the natural world, religiously inspired actions must always be subject to moral critique. Two arcas of continuing interest to direct marketing professionals are the perceived myths and unethical practices in the field. Documentation of specific cases and more abstract discussion of these two points of interest frequently appear in the direct marketing literature (e.g. Gitlitz and Barton, 1983; Lewis, 1982; Pierce, 1985). Indeed, the Direct Marketing Association (DMA) has promulgated specific guidelines (DMA, 1985) for ethical business practices within the industry. Up to this point, however, there has been no attempt at a systematic (...) evaluation of the perceptions of professionals in the field.Such an evaluation of these two areas of practice would appear to beg the following questions: (1) What are the major common myths which abound in direct marketing as perceived by professionals who come into direct contact with the operations of direct marketing organizations? (2) Which of these so-called myths are most requently mentioned? (3) What are the most commonly perceived unethical practices? (4) Which of these unethical practices are most frequently mentioned by direct marketing professionals?
