황우석 교수 사건을 종합적으로 분석한 책이 나왔다. 『황우석의 나라』는 황 교수 사태가 요동칠 때 에서 기자생활을 한 이성주가 현장을 지켜보고 이를 분석한 책이다. 저자는 7년 동안 의학팀장을 맡았고 2004년 8월부터 1년 동안 미국 존스홉킨스대에서 연수를 하고 귀국한 뒤 4개월 동안 과학 및 의학 분야의 곁에서 황 교수 사태가 요동치는 현장을 지켜보았다. 이 책은 황우석 사건 보도와 관련해 알려지지 않은 언론계의 현장 이야기, 과학계의 분위기, 황우석의 로비 실태 등을 생생하게 보여준다. 또 이번 사태가 발생하기 이전의 각종 기사를 분석해 언론이 무비판적으로 보도한 (...) 황 교수의 업적이 얼마나 허점투성이인지 설득력 있게 제시하고 있다. 동시에 19세기 말 프랑스를 뒤흔들었던 ‘드레퓌스 사건’과 마찬가지로 언론이 줄기세포처럼 똬리를 틀고 있다고 진단하고 언론의 본질과 역할에 대해 문제를 제기한다. 저자는 제2의 황우석 사건을 예방하기 위해 연구비 심사제도 개선, 연구비에서 간접비의 비중 강화, 언론의 에디터제 도입 등 세세한 대안도 내놓고 있다. In their analysis of the eligibility criteria for assisted dying in Canada, Downie and Schuklenk put forward a strong argument for the ethical defensibility of including mental illnesses and disabilities as underlying conditions driving a person’s request for assisted dying.1 In this commentary, we add a view on these debates from our home state of Victoria, Australia, where voluntary assisted dying has been legal since June 2019. We highlight the more conservative approach to eligibility in our setting compared with Canada, (...) and argue for debates about eligibility criteria to be conceptualised as part of a broader discussion about access to assisted dying that includes clinicians’ roles and perspectives. In our view, clinicians’ perspectives may have a significant impact on individuals’ ability to access assisted dying, regardless of legislative or other changes made to any system. ‘Voluntary assisted dying’ is the terminology used in our context, rather than Medical Assistance in Dying, so we will use that term when referring to the Victorian system. The paper proposes that the narrative functions of magical transformations and the characters’ articulated beliefs in the ways of spirits and ghosts in Alejo Carpentier's The Kingdom of this World and Ben Okri's The Famished Road represent polar extremes in magical realist writing. In the former text, spirits serve as the main measure of responsibility and responsiveness, enabling social actors to plot the ordinarily unimaginable. Spectral bodies transform marvelously in furtherance of the work of freedom and enchanting events proliferate so (...) that the spirit of independence set loose with physical struggles can flourish unhindered. The latter text blurs the borders of spirituality and literality; humans aspire to ghostliness and ghosts compete with humans. Nevertheless, human physical struggles for freedom long for a direction which the story's plentiful, flourishing spirits and ghosts seem unable to provide. The paper concludes that the different functions of spirits and ghosts in these novels reflect fundamental changes in the apprehension of historical progress in the postcolonial world since WWII. (…) 그는 임진왜란 당시의 참담한 상황을 기록하면서, 동시에 난이 일어나기 이전의 일도 기록해 그 원인이 어디에 있었는지를 밝히려고 했습니다. (31~32쪽) 세상의 중심에 서서 세상을 이어주는 것이 바로 인문 정신이며 시민의 지혜라고 생각합니다. 시민의 지혜로 세상을 바라볼 때, 논쟁이 화쟁적 대화로 이어질 때, 갈등과 분쟁은 더 이상 문제 상황이 아니라 더 큰 진리가 드러나는 에너지요, 기회가 될 것입니다. (97쪽) 톨스토이는 ‘어떻게 살 것인가’라는 질문에 대한 답을 작품을 통해 보여주게 되는데요, 그 답은 바로 ‘성장’입니다. 성장이란 인간이 끊임없는 성찰과 학습을 통해 자기완성에 도달하는 과정입니다. 톨스토이는 성장에 대해 “끊임없이 보다 나은 사람이 되어가는 것”이라고 이야기합니다. (99~100쪽) 개인의 사소한 사정은 더더욱 표현하기 어렵습니다. 사회적인 문제들을 표현하기 위해서는 연대도 가능하고 협력도 가능합니다. 그러나 자기 안에 있는 문제는, 실제로 모든 사람들이 똑같이 느끼고 있음에도 불구하고 연대가 불가능하고 협력도 어렵습니다. 바로 그 사이에 다리를 놓고 협력할 수 있도록 해주는 것이 문학입니다. 또한 그것들을 표현할 말을 만들어내고, 그것들을 표현하기 위해 어떤 특별한 세계를 개발하고 또 그것들을 전파할 수 있도록 약속하는 것이 문학입니다. 그리고 그 문학의 전위가 바로 시(詩)이며, 시가 바로 그 일을 합니다. (135쪽) 아내가 “삶은 상처다”라고 아주 멋진 말을 하더군요. 그리고 삶은 상처를 치유하는 과정이라고 덧붙였습니다. 일상은 늘 상처를 만들고 상처와 만나고 그 상처를 조금씩 치유해주고 가라앉혀주는 것이라고요. 진짜 삶은 누구에 의해 혹은 누구의 규범과 교훈에 종속되어 노예로 사는 것이 아니라 자기 자신으로 살아가는 것입니다. (…) 실존의 존엄성을 우주의 그 누구도 모독할 수 없습니다. (154~155쪽) 우리는 우리의 행동이 어떤 경로를 거쳐 어떤 결과를 가져올지 알아야 하고, 그 결과에 따른 책임도 져야 합니다. 그것이 오늘날 우리에게 필요한 윤리입니다. 그러려면 선한 동기만이 아니라 지식도 있어야 하고, 능력도 있어야 합니다. (185쪽) 고통을 극복하기 위해서는 누구도 자신의 고통을 이해해주지 못한다는 사실을 받아들여야 합니다. 기대할수록 상처는 더욱 커집니다. 고통은 홀로 맞서야만 하는 주관적인 체험입니다. 그렇더라도 고통에 빠진 사람 옆에서 함께 걸어주십시오. 그러면 내가 고통스러울 때 그 사람도 나와 함께 걸어줄 것입니다. 이런 홀로서기와 함께 걷기를 통해서 우리는 고통을 넘어서는 희망을 찾을 수 있습니다. We describe a corpus of speech taking place between 30 Korean mother–child pairs, divided in three groups of Prelexical, Early-Lexical, and Advanced-Lexical. In addition to the child-directed speech, this corpus includes two different formalities of adult-directed speech, i.e., family-directed ADS and experimenter-directed ADS. Our analysis of the MLU in CDS, family-, and experimenter-directed ADS found significant differences between CDS and ADS_Fam, and between ADS_Fam and ADS_Exp, but not between CDS and ADS_Exp. Our finding suggests that researchers should pay more attention (...) to controlling the level of formality in CDS and ADS when comparing the two registers for their speech characteristics. The corpus was transcribed in the CHAT format of the CHILDES system, so users can easily extract data related to verbal behavior in the mother–child interaction using the CLAN program of CHILDES. The dynamical equations of quantum mechanics are rewritten in the form of dynamical equations for the measurable, positive marginal distribution of the shifted, rotated, and squeezed quadrature introduced in the so-called “symplectic tomography”. Then the possibility of a purely classical description of a quantum system as well as a reinterpretation of the quantum measurement theory is discussed and a comparison with the well-known quasi-probabilities approach is given. Furthermore, an analysis of the properties of this marginal distribution, which contains all the (...) quantum information, is performed in the framework of classical probability theory. One the most interesting debates in moral philosophy revolves around the significance of empirical moral psychology for moral philosophy. Genealogical arguments that rely on empirical findings about the origins of moral beliefs, so-called debunking arguments, take center stage in this debate. Looking at debunking arguments based on evidence from evolutionary moral psychology, experimental ethics and neuroscience, this book explores what ethicists can learn from the science of morality, and what they cannot. The aim of this paper is to motivate and defend a conventional approach to assertion and other illocutionary acts. Such an approach takes assertions, questions and orders to be moves within an essentially rule-governed activity similar to a game. The most controversial aspect of a conventional account of assertion is that according to it, for classifying an utterance as an assertion, question or command, “it is irrelevant what intentions the person speaking may have had” (Dummett 1973, p. 302). I understand (...) this to mean that it is irrelevant for the issue of whether an utterance is an assertion whether the utterer has certain communicative intentions, such as the intention to utter something true, the intention to get one’s audience to believe (that one believes) what one has asserted etc. Just as one can commit a foul in football without meaning to do so, one can make an assertion, issue a command or ask a question without meaning to do so. The rules of football specify that a certain form of conduct (tackling an opponent in a certain way), carried out under certain general conditions (being a member of a team engaged in a game of football) counts as committing a foul. Similarly, I claim, the rules of language specify that a certain form of conduct (uttering an assertoric sentence), carried out under certain general conditions (being a member of a speech community engaged in a conversation) counts as making an assertion. Ludwig Wittgenstein has exerted a more powerful influence on contemporary philosophy than any other twentieth-century thinker. But what is the nature of this influence and why has it proved so enduring? Um so überraschender ist dann aber die Tatsache, dass die Einbildungskraft für Solgers Ästhetik, anders als etwa bei Schlegel und Novalis, gar keine Rolle spielt. Sie (...) gehört zu den »gemeinen Erkenntnisarten« und wird der Phantasie, die die Form der »höheren Erkenntnis« ist, entgegengesetzt. Die »Einbildungskraft [ist] an die sinnliche Wahrnehmung geheftet und vom Triebe ganz bestimmt, die Phantasie aber führt das göttliche Wesen in die Erscheinung über«. Nun spricht Solger häufig in diesem Sinne von der »gemeinen Einbildungskraft«, und man könnte meinen, dass es hier nur um eine Frage der Benennung gehe, indem die produktive Einbildungskraft bei ihm den Namen Phantasie erhält, während er die Bezeichnung,Einbildungskraft’ für die reproduktive Einbildungskraft reserviert, wofür der Zusatz »gemeine« steht. Auch wenn dem so wäre - die Frage, ob es sich so verhält, soll noch untersucht werden –, so muss es doch einen Grund geben, warum Solger sich von der Tradition abkehrt und einen in ihr bewährten Begriff ersetzt. Nun spricht Solger häufig in diesem Sinne von der »gemeinen Einbildungskraft«, und man könnte meinen, dass es hier nur um eine Frage der Benennung gehe, indem die produktive Einbildungskraft bei ihm den Namen Phantasie erhält, während er die Bezeichnung,Einbildungskraft’ für die reproduktive Einbildungskraft reserviert, wofür der Zusatz »gemeine« steht. Auch wenn dem so wäre - die Frage, ob es sich so verhält, soll noch untersucht werden –, so muss es doch einen Grund geben, warum Solger sich von der Tradition abkehrt und einen in ihr bewährten Begriff ersetzt. Legal reasoning settles morally pressing matters through a technique that largely bypasses open-ended moral argument. That technique makes central what certain persons validly decided in the past, for example in creating statutes, judicial resolutions, contracts, or wills. Identifying valid decisions is a lawyerly skill and, echoing legal practice, legal philosophy has paid considerable attention to validity criteria. But it has neglected to explore validity's point: whether, and if so exactly how, the special technique of validity contributes to a legal system's (...) ability to realise justice and human rights. Even the most sensible defences of the moral need for positive law have insufficiently probed this key step in the argument. This book lays bare the workings of legal validity, and shows why, and within what general limits, this technique equips legal systems with privileged tools to foster human well-being. In so doing, the book explains how power-conferring norms setting out validity criteria endow agents' intentions with 'performative' effect ('I hereby.') and can secure the requirement of justice that there be widespread convergence on specific patterns of conduct shaped through a cooperative effort. Legal meaning is accordingly systemic, resulting from the valid acts of multiple agents whose decisions can, by virtue of exercising legal power, also exercise moral power (authority). In short, the book articulates why it is morally necessary that validity does not primarily turn on moral considerations. (shrink)

Die Spurensuche nach dem Körper schafft Momentaufnahmen, aus denen heraus neue Suchbewegungen erst möglich werden. In diesem Spannungsverhältnis ist der Band zu sehen, so sind die hier versammelten Texte entstanden. Der Band ist ein Versuch, Fächergrenzen zu überschreiten, die in der Fokussierung auf den (...) Körper ohnehin keinen Sinn mehr machen. Deshalb sind Soziologen, Philosophen, Sportwissenschaftler, Ethnologen und Pädagogen darin vertreten. Alle nähern sich auf ihre spezifische Weise ihrem Objekt.
