A radical critique of modernity crystallized in the German Bildungsburgertum at the end of the last century. A broad cross-section of this stratum equated "mass democracy" with anarchy, foresaw a future populated only by "atomized modern men," and disdained the "vulgarity" of industrial capitalism. The origin and expansion of the intense and persistent configuration of cultural values that constituted German Kulturpessimismus deserves exploratory theoretical examination. The sociology of knowledge analysis suggested here is based on a Weberian framework that examines the (...) cultural values indigenous to several sectors of the public sphere in pre-industrial and nineteenth century Germany and the particular dynamic of interaction between these values and those indigenous to the private sphere in early twentieth century Germany. Comparisons to the American public sphere and its relationship to the American private sphere are noted in order to isolate clearly the German situation. This case study offers an illustration of the manner in which heterogenous cultural values may persist over extended periods of time despite fundamental structural transformation. (shrink)

An analysis of the manner in which believers' "relations to the supernatural" influence and even rationalize their action is central to Weber's sociology as a whole as well as his analysis of the development of modern capitalism and to his sociology of religion. Yet Weber never systematically presents the highly differentiated analytic course followed by the "rationalization of action" in the life-sphere of religion to the "methodical rational way of life." This study reconstructs this meandering route. In doing so, it (...) emphasizes the ways in which action, according to Weber, is altered as believers alter their mode of interacting with the supernatural. A sharp distinction between the merely cognitive and ideational influence upon action of "world views" and the influence of "salvation paths" is held to throughout. Because they place "psychological premiums" upon action, the latter are seen to be of far greater importance for the rationalization of action. Most salvation paths, however, and despite the explanations they offer for injustice, fail to introduce the enduring "religious mood" and to rationalize action radically. Those few salvation paths that do so articulate an acute tension between the world view and human suffering, yet "virtuoso religious qualifications" must also be present if the methodical rational way of life is to arise. Because it has been read almost exclusively as a study of the "role of ideas" in economic development, its diverse and multifaceted theoretical contributions generally have been neglected. This chapter defends the property dualism argument. The term “semantic premise” mentioned is used to refers to an assumption identified by Brian Loar that antiphysicalist arguments, such as the property dualism argument, tacitly assume that a statement of property identity that links conceptually independent concepts is true only if at least one concept picks out the property it refers to by connoting a contingent property of that property. It is argued that, the property that does the work in explaining the (...) possibility of a posteriori identities need not be a first-order property of the referent in question. On his view, the property dualism argument requires only a weaker semantic premise, which allows that the property in question be a higher order property. A refined version of the property dualism argument is formulated, which uses the weaker premise, and defends the argument against various objections. (shrink)

Perhaps less well known, amongst philosophers at least, are the ways in which some of these problems not only recur with pronouns but also cross-cut further problems exposed by the study in generative linguistics of morpho-syntactic constraints on interpretation. Despite holding that all concepts are strictly speaking innate, Leibniz attempts to accommodate the common belief that at least some concepts are adventitious by appealing to his theory of ideal action. The essential idea is that an innate concept can be considered adventitious, in a sense, just in case its ideal cause is to be found outside the mind of the one who possesses the concept. I examine the (mediated) correspondence between Spinoza and Robert Boyle concerning the latter’s account of fluidity and his experiments on reconstitution of niter in the light of the epistemology and doctrine of method contained in the Treatise on the Emendation of the Intellect. I argue that both the Treatise and the correspondence reveal that for Spinoza, the proper method of science is not experimental, and that he accepted a powerful under-determination thesis. I argue that, in contrast to modern versions, Spinoza’s (...) form of naturalism was a highly rationalist and anti-empirical one. I conclude with a brief account of the value of experience and experimentation for Spinoza’s scientific method. (shrink)

Substantial efforts have recently been made to reform the physician-patient relationship, particularly toward replacing the `silent world of doctor and patient' with informed patient participation in medical decision-making. This 'new ethos of patient autonomy' has especially insisted on the routine provision of informed consent for all medical interventions. Stronly supported by most bioethicists and the law, as well as more popular writings and expectations, it still seems clear that informed consent has, at best, been received in a lukewarm fashion by (...) most clinicians, many simply rejecting what they commonly refer to as the `myth of informed consent'. The purpose of this book is to defuse this seemingly intractable controversy by offering an efficient and effective operational model of informed consent. This goal is pursued first by reviewing and evaluating, in detail, the agendas, arguments, and supporting materials of its proponents and detractors. A comprehensive review of empirical studies of informed consent is provided, as well as a detailed reflection on the common clinician experience with attempts at informed consent and the exercise of autonomy by patients. In the end, informed consent is recast as a management tool for pursuing clinically and ethically important goods and values that any clinician should see as meriting pursuit. Concurrently, the model incorporates a flexible, anticipatory approach that recognizes that no static, generic ritual can legitimately pursue the quite variable goods and values that may be at stake with different patients in different situations. Finally, efficiency of provision is addressed by not pursuing the unattainable and ancillary. Throughout, the traditional principle of beneficence is appealed to toward articulating an operational model of informed consent as an intervention that is likely to change outcomes at the bedside for the better. Bradwardine’s solution to the the logical paradoxes depends on the idea that every sentence signifies many things, and its truth depends on things’ being wholly as it signifies. This idea is underpinned by his claim that a sentence signifies everything that follows from what it signifies. But the idea that signification is closed under entailment appears too strong, just as logical omniscience is unacceptable in the logic of knowledge. What is needed is a more restricted closure principle. A clue can (...) be found in speech act pluralism, whereby indirect speech reports are closed under intersubstitutivity of co-referential terms. This article explores how the institutional context, including central and local governments, has co-evolved with business in relation to small cars and sustainability. This issue is very relevant for business and society in view of the environmental implications of the rapidly growing vehicle fleet in China, the economic importance attached to this pillar industry by the government, and citizen interest in owning and driving increasingly larger cars. The interactions between different levels of government, and with business in countries with a (...) large role for the state is a novel area of study in the business-society area and a complex one given the multitude of objectives and interests involved in industry competitiveness, economic development, energy security, and sustainability. The article shows that the central government has adopted policies to further the production and use of small cars, which it perceives as serving environmental, economic, and social goals. Concurrently, however, many local governments imposed restrictions on small cars and have, implicitly or explicitly, favored larger cars. There seems to be a clear linkage to municipal ownership of those domestic automobile companies which, via joint ventures with foreign firms, focused more on larger cars. By adopting a co-evolutionary approach focused on macro-level interactions, the case helps to shed some more light on concrete sustainability challenges, and broader government–business interactions in a highly institutionalized setting, contributing insights on issues that have remained underexposed in business and society research. Although public law scholars have long addressed the problems of accountability generated by private decision-making and "privatization," they have largely ignored this phenomenon in the immigration context. Our ignorance is increasingly indefensible. Millions of employers - private parties - are required by law to screen their workers for unauthorized immigrants, and growing evidence suggests that they use their screening power to ignore workplace protections and to otherwise exploit these workers. This article is the first attempt to apply the insights generated (...) by the privatization literature to immigration law. It argues that our nation's employers have emerged as private immigration screeners who, like airport inspectors screening for ineligible entrants and law enforcement officers screening for criminal noncitizens, assist the Department of Homeland Security in identifying unauthorized workers for removal. More than just agents of exploitation, reframing employers as private screeners demonstrates that they are also agents of the state. Borrowing analytical concepts developing in the privatization literature, I argue that the high risk of abuse and the lack of readily available mechanisms for reducing that risk raise troubling implications over the kind of power that employers wield as private immigration screeners in the workplace. Reframing our nation's employers as private screeners gives theoretical coherence to the discretionary decision-making authority they actually wield, and explains why they have used that authority to exploit workers - as private parties carrying out public duties, they are incentivized to serve their own interests instead of verifying the immigration status of their workers in good faith. Examining the problem of private immigration screening also forces us to reconsider two aspects about immigration screening generally. First, although immigration law tends to reward unauthorized immigrants who lay low and tends to punish those who draw attention to themselves, I suggest that we ought to rethink this logic at least in the context of the workplace. Because workplace violations committed by employers are typically enforced by private parties, punishing unauthorized immigrants who attempt to assert these rights and thus draw attention to themselves, only encourages workplace violations by employers and fosters a culture of lawlessness. Second, thinking about how decision-making authority within immigration law should be allocated between the public and the private contributes to the current conversation over how similar decision-making authority should be allocated between federal entities and local entities. Although questions of accountability have lingered in the backdrop of the immigration federalism debate, I suggest that scholars would be well served to foreground these questions and answer them head-on.
