Legislatures enact laws and the courts interpret them. Under the doctrine of legislative supremacy, a judge is not free to ignore or modify a statutory provision in order to substitute a rule that seems to him to be better reasoned; thus where the language of a statute is clear and unambiguous, interpretation is unnecessary and it must be enforced according to its terms. Nevertheless, gaps and ambiguities can arise and, in such cases, courts apply interpretive rules, or ‘canons of construction’, (...) to resolve these ambiguities. One frequently invoked rule requires that words that are not defined by a statute be given their ordinary meaning by the interpreting court. In recent years, the United States Supreme Court has increasingly relied upon dictionary definitions in applying this rule. The Court’s use of dictionaries as authority for its interpretations incorporates the assumption that the dictionary is the best source for ascertaining the meaning of statutory texts. This article challenges that assumption on linguistic grounds. I argue that the focus on definitions skews the interpretation of statutory language by isolating words from their semantic context. By comparing two cases in which the Court used dictionary definitions to a third case in which the definition used by the Court was contained in the statute itself, I demonstrate that the ordinary meaning of legal terms cannot be determined by dictionary definitions. The practice of medicine involves obtaining, evaluating and analyzing information drawn from a variety of sources; thus physicians assess and act upon information that varies in terms of both reliability and the extent to which it may be directly perceived. In the hospital setting, physicians’ progress notes provide a record of this process that serves as a primary means of communication between treaters who are not co-present with one another; accordingly, in order to permit independent evaluation of the information they (...) contain, physicians have developed a repertoire of linguistic devices to express differing attitudes towards the information that their notes convey. In this article, through the microanalysis of a pediatric resident’s note, I demonstrate how physicians use evidential markers, including the passive voice and agentless constructions, to construct frameworks of credibility and responsibility that both underlie and enable medical work. These grammatical devices permit the physician-reader to weigh for himself or herself the evidence which supports the conclusions reached. (shrink)

The role of metaphor in political discourse has received significant attention in recent years. Expanding on the cognitive theory of metaphor developed by Lakoff and Johnson, scholars in the fields of sociolinguistics and discourse analysis have examined politicians' use of metaphorical concepts to justify policies and define events. The metaphors examined in these studies frequently have attained the status of idioms; they consequently pass unnoticed while retaining their ability to frame perspectives. However, political discourse does not limit itself to such (...) lexicalized metaphors, but makes use of new metaphors as well. Such uses are specifically designed to attract attention, which may become problematic if the metaphor is rejected, resulting in a classic `failure to launch'. This article examines such a case. Through an analysis of the metaphors used to describe President Bush's military plan to increase US forces in Iraq, I explore the mechanisms by which the meanings of novel metaphors are negotiated in the political arena, and demonstrate that, although their vivid imagery can generate persuasive force in political language, this effect may backfire when they encounter resistance. Since the early 1980’s, with the clinical advent of in vitro fertilization resulting in so-called “test tube babies,” a wide array of ethical considerations and concerns regarding artificial womb technology (AWT) have been described. Recent breakthroughs in the development of extracorporeal neonatal life support by means of AWT have reinitiated ethical interest about this topic with a sense of urgency. Most of the recent ethical literature on the topic, however, pertains not to the more imminent scenario of a physiologically improved (...) method of neonatal care through AWT, but instead to the remote scenario of “complete ectogenesis” that imagines human gestation occurring entirely outside of the womb. This scoping review of the ethical literature on AWT spans from more abstract concerns about complete ectogenesis to more immediate concerns about the soon-to-be-expected clinical life support of what we term the fetal neonate or fetonate. Within an organizing framework of different stages of human gestational development, from conception to the viable premature infant, we discuss both already identified and newly emerging ethical considerations and concerns regarding AWT and the care of the fetonate. We surveyed 1005 postdoctoral fellows by questionnaire about ethical matters related to biomedical research and publishing; 33% responded. About 18% of respondents said they had taken a course in research ethics, and about 31% said they had had a course that devoted some time to research ethics. A substantial majority stated willingness to grant other investigators, except competitors, access to their data before publication and to share research materials. Respondents’ opinions about contributions justifying authorship of research papers were mainly consistent (...) but at variance with those of many biomedical journal editors. More than half said they had observed what they considered unethical research practices. To increase the chances of getting a grant funded, 27% said they were willing to select or omit data to improve their results; to make publication of their work more likely or to benefit their career, 15% would select or omit data and 32% would list an undeserving author. Of respondents who thought they had been unfairly denied authorship on a paper, or been listed with or asked to list an undeserving author, 75% said they would be willing to list an undeserving author (P<0.001). Having taken a course dealing with research ethics had no effect on stated willingness to select or omit data or to fabricate data in the future, but was positively associated with willingness to grant undeserved authorship (P<0.04). Although these results do not controvert research demonstrating the effectiveness of ethics courses during professional education, they indicate that the research environment is a powerful component of a trainee’s experience and ethical development. Ideas of love within religion are usually driven by one of two mythologies – either a personal God who commands love or a mystical God of ineffable love – but both are inadequate for motivating love of neighbour. The first tends towards legalism and the second offers no cognitive guidance. The situation is further complicated by there being different understandings of love of neighbour in the various Abrahamic religions, as exemplified in the approaches of two philosophers, Søren Kierkegaard and Emmanuel (...) Levinas. A better approach is therefore to explore actual practices of love in everyday life, and to discover how love might be performed openly and creatively. One such practice is recognition of vulnerability, and this too is often driven by a mythology, in this case one marked by fear, and by a violence either imposed or avoided. One paradigmatic example is the vulnerability felt by speakers, especially women, in front of an audience. A turning from wilful ignorance of vulnerability and a turning to reliance on collective work, modelled on an awareness of mutual vulnerability and openness to the unknown, will help to change our philosophical and social imaginary. The dark myth of vulnerability can be transformed into finding opportunities in vulnerability for openness to affection and so to an enhancement of life. It is only from the perspective of this new imaginary, and from everyday practices of it, that the double love-command – love of God and love of neighbour – will function as any kind of common ground between religions. The problem of collective action is that each member of a group wants other members to make necessary sacrifices while he or she 'free rides', reaping the benefits of collective action without doing the work. Inevitably the end result is that no one does the work and the common interest is not realized. This book analyses the social pressure whereby groups solve the problem of collective action. The authors show that the problem of collective action requires a model of group (...) process and cannot be deduced from simple models of individual behaviour. They employ formal mathematical models to emphasize the role of small subgroups of especially motivated individuals who form the 'critical mass' that sets collective action in motion. The book will be read with special interest by sociologists, social psychologists, economists and political scientists. It will also be of concern to those in industrial relations and communications research working on issues in collective action and rational choice. (shrink)

Past research has demonstrated that employees’ perceptions of abusive supervision are positively associated with the enactment of bullying behaviors. However, an investigation of the factors influencing employees’ decision to bully others at work has yet to be completed. In this study, we propose that the relationship between perceptions of abusive supervision and the enactment of bullying behaviors is mediated by state self-regulation, and that active coping moderates the relationship between state self-regulation and bullying. Further, we analyze how the situational context (...) affects employees’ levels of self-regulatory resource depletion and ultimately, the extent to which they engage in bullying behaviors. A moderated mediation analysis using time-separated data provided support for our hypotheses, suggesting that employees’ state self-regulation helps explain why abusive supervision is associated with bullying and that active coping helps to reduce bullying behaviors. Further, the results suggest that negative environments are associated with more bullying. Contributions, practical implications, and future research directions are discussed. (shrink)

Individuals with Acquired Brain Injury (ABI) suffer chronic impairment across cognitive, physical and psycho-social domains, and the experience of anxiety, isolation and apathy has been amplified by the COVID-19 pandemic. A qualitative evaluation was conducted of 14 individuals with ABI who had participated in series of COVID adapted group-based intervention(s) that had been designed to improve wellbeing. Eight themes were identified: Facilitating Safety, Fostering Positive Emotion, Managing and Accepting Difficult Emotions, Promoting Meaning, Finding Purpose and Accomplishment, Facilitating Social Ties, (Re)Connecting (...) to Nature, and Barriers to Efficacy. Findings are discussed with respects to recent theoretical developments in positive psychology and wellbeing science and support the use of online and outdoor interventions to enhance wellbeing in individuals living with ABI during the COVID-19 pandemic. This paper makes a unique contribution to second wave positive psychology (PP2.0) through the application of recent advances in wellbeing science to an ABI population during the COVID-19 pandemic. In doing so, this paper lays the foundation for new interventions that not only reduce impairment and distress, but also create opportunities for meaning and enhanced wellbeing in people living with chronic conditions and those individuals living with ABI in particular. Despite the emergence of corporate social responsibility, the impact of CSR efforts on customer relationships remains decidedly unclear. Moreover, previous studies have examined CSR in cross-sectional, experimental, and/or artificial settings. Through field survey data collected at both the beginning (n = 750) and conclusion (n = 469) of the 2007-2008 NBA season, the authors investigate linkages between customers' perceptions of the CSR performance of an NBA team and the strength of their relationship with this same organization. With all respondents of (...) the latter survey participating in both samples, the authors assess how CSR performance impacts customer relationships over time. The findings show how a firm that engages in CSR initiatives may reap rewards by building trusting and committed customer relationships which, in turn, help forge desirable customer behaviors. The results also demonstrate how CSR's influence strengthens over the course of the tested business cycle, thus yielding revealing insights to academics and practitioners when it comes to understanding the real-world impact of CSR performance for strengthening customer relationships. In this paper, we claim that we can only seek to eradicate the stigma associated with the contemporary opioid overdose epidemic when we understand how opioid stigma and the epidemic have co-evolved. Rather than conceptualizing stigma as a parallel social process alongside the epidemiologically and physiologically defined harms of the epidemic, we argue that the stigmatized history of opioids and their use defines the epidemic. We conclude by offering recommendations for disrupting the burden of opioid stigma.

We examine the impact of activated versus non-activated ethical norms on the aggressiveness of accounting decisions, in the presence of self-interest favoring aggressiveness. Using a case in which the accounting rules are ambiguous, we ask professional accountants to make an accounting decision as though they were in their own organization; we measure the ethical norms of their organization at the end of the experiment. Based on the focus theory of normative conduct, we argue that the general ethical norms of the (...) participants’ organizations are activated when the decision structure is such that the participant receives a recommendation from a subordinate, whereas those norms are not activated when the participant is making the decision alone. We find that higher ethical norms decrease aggressiveness when the decision maker receives a recommendation, whereas higher ethical norms have no impact on aggressiveness when the decision maker makes the decision alone. Our results demonstrate that general ethical norms, known to impact decisions having clear ethical content, can also curb accounting aggressiveness when these norms are activated. Furthermore, firm practices such as decision structure can activate norms. These findings are of interest to practitioners and regulators who seek to temper aggressive accounting. (shrink)

Advocacy is an important concept in nursing practice; it is frequently used to describe th nurse-client relationship. The term advocacy, however, is subject to ambiguity of interpretation. Such ambiguity was evidenced recently in criticisms levelled at the nursing profession by hospital ethicist Ellen Bernal. She reproached nursing for using 'patient rights advocate' as a viable role for nurses. We maintain that, for nursing, patient advocacy may encompass, but is not limited to, patient rights advocacy. Patient advocacy is not merely the (...) defence of infringements of patient rights. Advocacy for nursing stems from a philosophy of nursing in which nursing practice is the support of an individual to promote his or her own well-being, as understood by that individual. It is an ethic of practice. La défense des malades joue un grand rôle dans la pratique des infirmiers/ères. Le terme est souvent utilisé pour définir les rapports entre malades et soignants. Le mot 'defénse' pourtant, peut être mal compris. Une ambiguïté était évidente récemment dans la critique de la profession infirmière faite par la philosophe éthique Ellen Bernal. Elle reproche à la profession d'utiliser le terme 'avocat des droits des malades' pour désigner le rôle primordial des infirmiers/ères. Nous croyons que pour les soignants, la défense des malades peut comprendre le rôle 'd'avocat des droits des malades' mais elle ne s'y borne pas. The French feminist philosopher Michèle Le Doeuff has taught us something about “the collectivity,” which she discovers in women’s struggle for access to the philosophical, but also about “the unknown” and “the unthought.” It is the unthought which will matter most to what I intend to say today about a fundamental ignorance on which speaker vulnerability is built. On International Women’s Day, it seems appropriate to speak about – or, at least, to evoke – the silencing which has been imposed (...) on women by an oppressive form of ignorance. My question is: how do our resounding voices as women – on 8 March 2016 – avoid what feminist philosophers have distinguished as wilful forms of silencing? Silencing exploits vulnerability; and speaker vulnerability is an exposure either to violence or affection, in its dependence on an audience. My response seeks to undo the silencing of women by transforming an ignorance of vulnerability into a distinctively ethical avowal. To see the significance of this undoing, we will consider how our contemporary global world reduces vulnerability to an openness to violence, ignoring what has been unthought: an openness to affection. A wilful ignorance of vulnerability develops not as a lack of knowledge but its disavowal – on which various forms of oppression are built. An active disavowal of thinking (the unthought) is the other side of a striving for invulnerability; and this striving is encouraged by a social world which remains ignorant of its own wounding, as well as its own potential for ethical relations in vulnerability. Like la mauvaise foi of the French existentialist, invulnerability is a form of self-deception; and those who claim it embrace ignorance of their own and others’ vulnerability too. (shrink)

Human beings respond to their immediate environments in a variety of ways, with emotion playing a cardinal role. In evolutionary theories, emotions are thought to prepare an organism for action. The interplay of acoustic environments, emotions, and evolutionary needs are currently subject to discussion in soundscape research. Universal definitions of emotion and its nature are currently missing, but there seems to be a fundamental consensus that emotions are internal, evanescent, mostly conscious, relational, manifest in different forms, and serve a purpose. (...) Research in this area is expanding, particularly in regards to the context-related, affective, and emotional processing of environmental stimuli. A number of studies present ways to determine the nature of emotions elicited by a soundscape and to measure these reliably. Yet the crucial question—which basic and complex emotions are triggered and how they relate to affective appraisal—has still not been conclusively answered. To help frame research on this topic, an overview of the theoretical background is presented that applies emotion theory to soundscape. Two latent fundamental dimensions are often found at the center of theoretical concepts of emotion: valence and arousal. These established universal dimensions can also be applied in the context of emotions that are elicited by soundscapes. Another, and perhaps more familiar, parallel is found between emotion and music. However, acoustic environments are more subtle than musical arrangements, rarely applying the compositional and artistic considerations frequently used in music. That said, the measurement of emotion in the context of soundscape studies is only of additional value if some fundamental inquiries are sufficiently answered: To what extent does the reporting act itself alter emotional responses? Are all important affective qualities consciously accessible and directly measurable by self-reports? How can emotion related to the environment be separated from affective predisposition? By means of a conceptual analysis of relevant soundscape publications, the consensus and conflicts on these fundamental questions in the light of soundscape theory are highlighted and needed research actions are framed. The overview closes with a proposed modification to an existing, standardized framework to include the meaning of emotion in the design of soundscapes. (shrink)

This article analyses the nature of mental imagery in metaphoric thought as envisaged by the contemporary theory of metaphor in Cognitive Linguistics (Lakoff, Cambridge University Press, 1993). Our study of metaphor in the field of marine biology draws on two crucial aspects of mental imagery, namely dynamicity and pervasiveness. Image metaphors and behaviour-based metaphors have generally been regarded as two different types of resemblance metaphor. In our view, the dynamicity of certain mental images highlights inherent similarities between these two types (...) of metaphor, and makes the differences between them more apparent than real. For this reason, we propose a more refined description of resemblance metaphors in terms of the static or dynamic nature of the mental images underlying them. Our study also underlines the fact that mental images permeate all classes of metaphor, and that the pervasiveness and dynamicity of mental images affords insights into both resemblance metaphors and non-resemblance metaphors. The field of social entrepreneurship, a domain focused on implementing solutions to social, cultural and environmental issues, remains highly male-dominated. Research continues to emphasise that women social entrepreneurs are often expected to behave in masculine ways in order to become successful. The study presented in this article explored the perceptions and experiences of thirty-three women living in the United Kingdom who were developing their skills in social entrepreneurship. Documenting their experiences, we sought to understand how women work in a male-dominated (...) field. Our analysis primarily builds on a Bourdieusian-revisionist approach of emotional capital to advance understandings of how women’s networks with other women allow them to navigate social entrepreneurship. Drawing on emotional capital, as a theory, we examine the ways in which these women find these spaces generative and how it contributes to their problematising of masculine orthodoxies. (shrink)

Por ello, en un primer punto mostraremos en qué consiste según estos autores la lógica del pensamiento burocrático y, en un segundo punto, señalaremos el fundamento patológico-religioso de esta lógica. The developmental history of the vertebrate eye begins at an early embryonic stage, with the formation of the body axes and induction of neural tissue. Several recent experimental embryological and genetic studies in teleost fish have produced new insights into the morphogenetic and molecular regulation of eye formation. Molecular signaling pathways and patterned expression of transcription factors implicated in eye determination are discussed, and the importance of morphogenetic cell movements is emphasized. The objective of this study is to evaluate if use of a patient decision aid, when choosing between a repeat cesarean or a trial of labor after a cesarean, reduces medical liability exposure. The authors conclude that use of a PDA conferred liability protection when potential jurors were presented with a hypothetical malpractice claim against an obstetrician following a TOLAC.

New discoveries in neuroscience challenge our understanding of human responsibility and justice. Recent studies suggest that psychopaths not only exhibit specific behavioral patterns but may also have a distinct neuroanatomical blueprint. Scientists have shown that a significant number of individuals who have demonstrated psychopathic behaviors have reduced volume and other anatomical changes in various regions of the cerebral cortex as well as decreased functional connectivity between different brain areas (i.e., smaller dysfunctional amygdalae). These findings raise ethical questions about how our (...) criminal system deals with these individuals. Should dysfunctional anatomical or diseased features exonerate affected individuals from any responsibility for their criminal activity or the suffering they have caused to their victims? It is estimated that individuals with the signs and symptoms of antisocial personality disorder make up 25% of inmates. Should individuals classified with this disorder be incarcerated with other criminals? In this paper, we summarize the results of the latest brain imaging studies performed on individuals with antisocial personality traits, referred to as psychopaths or sociopaths, and we explore some of the ethical issues concerning psychopathy and the law. El principal supuesto del texto considera la imposibilidad de un análisis conceptual acerca de la democracia que no incluya en su discusión la tensión entre la posición y ejercicio de la ciudadanía implicada y demandante en este proceso. El análisis propuesto confronta los imaginarios hegemónicos instituidos en la postdictadura con los imaginarios instituyentes que (...) emergen de los movimientos secundarios por la defensa de la educación pública en la ciudad de Valparaíso. Estos imaginarios se expresan en formas de organización en la esfera pública, por medio de la función que ejerce el imaginario radical, que impugnan la construcción de una ciudadanía capturada y una democracia tutelada. Some of the most difficult clinical ethics consultations involve patients who have both medical and mental health needs, as these cases can result in considerable moral distress on the part of the bedside staff. In this article we examine the issues that such consults raise through the illustrative example of a particular case: several years ago our ethics consultation service received a request from a critical care attending physician who was considering a rarely performed psychosurgical intervention to address intractable and (...) life-threatening agitation and aggression in an adolescent patient for whom standard treatments had proven unsuccessful. We consider strategies that may be useful in addressing not only the ethical dilemmas or the clinical problems, but also the emotional, social, and moral distress that arise in delivering care in such complex cases, in which standard routine practices of care have been exhausted. In addition, we explore the processes that led to this situation and suggest ways to promote early recognition and intervention for similar cases in the future. (shrink)

We conducted focus groups with 47 potential jurors who were presented with diferent scenarios in a hypothetical malpractice case involving failure to order a PSA test. Better documentation that a patient made an informed decision to decline a PSA test appeared to provide more medical-legal protection for physicians, especially with the use of a decision aid.

Screening for prostate cancer with the prostate-specific antigen blood test is controversial, as evidence to date has not demonstrated such screening does more good than harm. While the potential benefit of PSA screening on reducing prostate cancer mortality has not been documented in randomized trials, many risks of PSA screening have been well documented. These risks include a substantially higher risk of a prostate cancer diagnosis over a screenee’s lifetime, false-positive and false-negative test results, possible complications from biopsies done in (...) response to suspicious test results, and substantial risks of side effects from subsequent prostate cancer treatments. Nevertheless, PSA screening is widespread in the United States, and many physicians in a national survey reported supporting routine PSA screening as well as getting PSA tests themselves, despite the lack of evidence. We refer to hospitalized convicted hunger strikers in Padua Hospital who decided to fast for specific reasons, often demanding, to be heard by the judge, to complain about the existing custodial situation or to claim unjust treatment. The medical ethics of hunger strikers are debated because the use of force feeding by physicians is widely condemned as unethical, but courts, in Italy, sometimes order to transfer the convicted person to hospital and oblige healthcare practitioners to perform forcible feeding. This can (...) engender a profound insecurity for the physicians taking action on the one hand, while preventing patients from fully availing themselves of this principle of self-determination on the other. Physicians are mainly concerned about how to manage this situation and they may request ethical consultation. When it comes to managing hospitalized hunger strikers, the ethics consultant may be able to facilitate the relationship between physicians and hunger strikers, enhance the latter’s trust in the former, ensuring that strikers are aware of the risks associated with their fasting, and helping them to arrive of their own free will at the right decision concerning their behavior and their demands.
