Noncompete agreements are among the most commonly used methods to restrict employment. Upwards of 38% of American workers, many of which are low-wage workers, have signed noncompete agreements. These agreements effectively hold those workers hostage to their current employer. This project analyzes the use of noncompete clauses in employment contracts with low-wage workers. We show that noncompetes with low-wage workers are not enforceable in the U.S.; employers nevertheless continue to include noncompete clauses in employment contracts with low-wage workers. We survey (...) states’ attempts to regulate the use of (even unenforceable) noncompetes and argue that current legislation is ineffective at preventing employers from including noncompetes in low-wage worker contracts. We argue that employers’ use of (even unenforceable) noncompete agreements with low-wage workers is wrongfully exploitative of those workers, and we provide suggestions for how states can effectively regulate the use of noncompetes, and thus protect low-wage workers from exploitation, using Virginia’s recently passed noncompete bill as a model. One of the most controversial issues to emerge in recent studies of Fichte concerns the status of his normative ethics, i.e., his theory of what makes actions morally good or bad. Scholars are divided over Fichte’s view regarding the ‘final end’ of moral striving, since it appears this end can be either a specific goal permitting maximizing calculations (the consequentialist reading defended by Kosch 2015), or an indeterminate goal permitting only duty-based decisions (the deontological reading defended by Wood (...) 2016). While I think each interpretive position contains an element of truth, my aim in this paper is to defend a third alternative, according to which Fichte’s normative ethics presents us with a unique form of social perfectionism. It is often assumed that Fichte's aim in Part I of the System of Ethics is to provide a deduction of the moral law, the very thing that Kant – after years of unsuccessful attempts – deemed impossible. On this familiar reading, what Kant eventually viewed as an underivable 'fact' (Factum), the authority of the moral law, is what Fichte traces to its highest ground in what he calls the principle of the 'I'. However, scholars have largely overlooked (...) a passage in the System of Ethics where Fichte explicitly invokes Kant's doctrine of the fact of reason with approval, claiming that consciousness of the moral law grounds our belief in freedom (GA I/5:65). On the reading I defend, Fichte's invocation of the Factum is consistent with the structure of Part I when we distinguish (a) the feeling of moral compulsion from (b) the moral law itself. (shrink)

Fichte’s Jena Wissenschaftslehre is often thought to occupy a standpoint from which claims about what there really is, as opposed to claims about how we necessarily represent things to be, are metaphilosophically prohibited or methodologically precluded. This essay argues that for Fichte a transcendental account of the necessary conditions for knowing supports an accordant understanding of the basic nature of being. These are linked by a reconception of the nature of rationality, and thus of rational justification, that (...) class='Hi'>Fichte’s transcendental epistemology secures and which his ontology draws on and develops. In particular, his account of the nature of rationality issues in a distinctive form of nonevidentialism, according to which we possess unimpeachable rational grounds, albeit not narrowly evidential ones, for assent to certain metaphysical claims. While the relation between embodiment and intersubjectivity is often remarked upon in the literature on Fichte, it is not sufficiently acknowledged that for Fichte the two are strongly interdependent. In this paper, by elaborating on his account of the fine structure of the embodied agency, I argue that for Fichte one's relation to one's own body is socially constituted. Further, I show that the usual stricture in the literature, according to which Fichte does not allow for (...) bodily passivity, is misleading. Indeed, as I argue, Fichte's account of embodied agency is sufficiently nuanced as to be able to explain “passive bodily expressions,” that is, those bodily expressions that are not under direct control of the agent. And related to that, contrary to the commonly held view, Fichte does offer a satisfactory account of the more sentient bodily phenomena, such as pain, hunger, and fatigue, which happen to the agent without her being capable of controlling their happening. Indeed, as I will show, for Fichte, these latter phenomena, rather than being simply restrictive of agency, may positively contribute to the exercise of agency. (shrink)

In der Antisemitismuskritik insbesondere nach dem Zweiten Weltkrieg wird Fichte vielfach eine zentrale Rolle zugedacht: nämlich als dem Angelpunkt des Umschlags vom religiösen Antijudaismus zur politischen Judenfeindlichkeit. Diese Sicht, die sich im Wesentlichen auf eine Äußerung in einer Frühschrift des Philosophen von 1793 stützt, hat — so die These des Buches — dessen weitere Entwicklung, wenn überhaupt, dann nur völlig unzureichend zur Kenntnis genommen. Für überraschend viele jüdische Zeitgenossen, seine jüdischen Studenten voran, ist Fichte der wegweisende Philosoph der (...) Epoche gewesen. Die weitere, gerade jüdische Rezeptionsgeschichte seines Werkes belegt bis ins Dritte Reich hinein eine erstaunliche, bislang in diesem Umfang nicht zur Kenntnis genommene Affinität des Judentums zu Fichte. Dabei erweisen sich Fichtes Reden an die deutsche Nation — für viele sicherlich überraschend — gerade für den Zionismus als beispielhaft für jedes Volk im Werden und für das jüdische allemal. Auch die französische Fichte-Rezeption — ebenfals dort ist die jüdische prominent vertreten — hat, die Zeit des Grande Guerre ausgenommen, bis zu Beginn des Zweiten Weltkrieges in Fichte vor allem den Erben der Freiheitsversprechen von Aufklärung und Revolution in Frankreich gesehen. Fichte's philosophy represented one of the first coherent attempts to provide a utopian philosophical foundation for preventative police power, one which anticipated in surprising ways the fundamental logical premises of modern dataveillance or "datapower." This article examines Fichte's proposals for a new system of police passports and the logic of control on which it rests, contextualizing it within the transformation of police practices during his lifetime. Fichte argues that the conclusion of Kant’s transcendental deduction of the categories is correct yet lacks a crucial premise, given Kant’s admission that the metaphysical deduction locates an arbitrary origin for the categories. Fichte provides the missing premise by employing a new method: a genetic deduction of the categories from a first principle. Since Fichte claims to articulate the same view as Kant in a different, it is crucial to grasp genetic deduction in relation to the sorts (...) of deduction that Kant offers. I propose to interpret genetic deduction as the simultaneous fulfillment of two tasks: answering the question quid facti by deriving the categories from the I and answering the question quid juris by establishing our entitlement to the categories as conditions of experience. While the second task represents Fichte’s agreement with Kant’s transcendental deduction, the first reflects his correction of Kant’s metaphysical deduction. (shrink)

The concept of facticity denotes conditions of experience whose necessity is not logical yet whose contingency is not empirical. Although often associated with Heidegger, Fichte coins ‘facticity’ in his Berlin period to refer to the conclusion of Kant’s metaphysical deduction of the categories, which he argues leaves it a contingent matter that we have the conditions of experience that we do. Such rhapsodic or factical conditions, he argues, must follow necessarily, independent of empirical givenness, from the I through a (...) process of ‘genesis.’ I reconstruct Fichte’s argument by tracing the origin of his neologism, presenting his Jena critique of Kant’s rhapsodic appeal to the forms of judgment, and illustrating the Jena period’s continuity with the Berlin period’s genetic method, while noting a methodological shift whereby Fichte directs his critique against his own doctrine of intellectual intuition in order to eliminate its ‘factical terms.’. Fichte’s ambitious project in the Foundations of Natural Right is to provide an a priori deduction of the concept of right independently from morality. So far, interpretations of Fichte’s deduction of the concept of right have persistently fallen into one of two rough categories: either they (re)interpret the normative necessity of right in terms of moral or quasi-moral normativity or they interpret right’s normative necessity in terms of hypothetical imperatives. However, each of these interpretations faces significant exegetical difficulties. (...) By contrast, I argue that we can understand the normative necessity of right in terms of conceptual necessity. On this view, right does not tell us what ought to be done, but instead tells us what we are doing and have done. Not only does this provide for a promising philosophical account of the non-moral normativity of right, but also provides a compelling reading of Fichte’s text in both the deduction of the concept of right in the Foundations of Natural Right as well as his discussion of the application of the concept of right and coercion. As I hope to show in this paper, Fichte’s rejection of traditional social contractarian accounts of human social relations is related to his rejection of the search for a criterion, or external standard, by which we might measure our knowledge in epistemology. More specifically, Fichte’s account of the impossibility of a normative social contract (as traditionally construed) is related to his account of the impossibility of our knowing things as they might be “in themselves,” separate from and independent (...) of our own activity in knowing them. Addressing the question of whether we finite human knowers can ever transcend the limits of our own consciousness, Fichte argues that Hume was not sufficiently critical: “…the Humean system holds open the possibility that we might someday be able to go beyond the boundary of the human mind, whereas the Critical system proves that such progress is absolutely impossible, and it shows that the thought of a thing possessing existence and specific properties in itself and apart from any faculty of representation is a piece of whimsy, a pipe dream, a nonthought.” In a very real sense, then, Fichte aims to “out-Hume” Hume on the question of whether we can ever know “things-in-themselves” or an external criterion for testing our knowledge. That is, Fichte goes beyond Hume and insists on the necessary – and not merely contingent – character of our ignorance of so-called things-in-themselves (i.e., things that supposedly exist antecedent to and independent of our consciousness of them). But unlike Hume, Fichte argues that radical skepticism regarding all possible knowledge of things-in-themselves does not undermine – but actually confirms and sustains – our belief in the emancipatory power of reason. Dans cet essai l'auteur s'est donné pour tâche de dégager la " leçon de Fichte ". En effet, qu'a voulu dire Fichte, tant dans ses textes les plus philosophiques que dans ses discours et écrits à l'adresse de tous? A suivre Philippe Riviale, Fichte serait le frère savant de Gracchus Babeuf : selon lui, ils partagent le même désir de faire venir la vie en nous, de dénoncer l'imposture de la civilisation marchande et de la propriété, fondées (...) sur le déni du moi, tel qu'il est en son impulsion originaire. Le moi, loin d'être déjà constitué, s'élabore dans l'agir et le pâtir par quoi il se fait place dans le monde à venir, qui ne saurait être sans former un " nous " ensemble. Fichte, tout comme son frère en pensée, ne nous parle pas d'un monde hors de notre atteinte. Il ne pose pas l'esprit en marche, qui mènerait les hommes malheureux à un fabuleux destin. Par avance, il réfute Heidegger qui prétend nous donner à voir qu'il n'est rien d'autre que ce que nous sommes, en tant qu'existants ; que la pensée de la liberté est l'illusion suprême qui nous cache le devenir qui nous attend. A l'inverse, Fichte nous fait découvrir qui nous sommes, qui nous avons vocation à être si seulement nous acceptons de faire taire en nous le désir de servitude, la crainte des puissants, la croyance en un au-delà réparateur. C'est de la destination de l'homme qu'il s'agit. Mais Fichte ne fut compris ni de ses contemporains, ni des nôtres. A défaut d'être compris, il fut comparé à Hegel, à Schelling, renvoyé du côté des illuminés, des prémodernes. Cette tendance ne serait pas grave, s'il n'y avait là matière à recherche sur les complications de celui qui voulut annoncer sans répit, comme Babeuf le fit, qu'il n'y a pas de secret. Il est en nous d'aller là où nous conduit notre impulsion, au lieu de stagner misérablement dans des formes d'existence aliénée. Les hommes ne sont pas condamnés à errer sans avenir, nus, ignorants et traîtres à eux-mêmes. In this paper I provide an interpretation of Hegel’s account of ‘recognition’ (Anerkennung) in the 1802-3 System of Ethical Life as a critique of Fichte’s account of recognition in the 1796-7 Foundations of Natural Right. In the first three sections of the paper I argue that Fichte’s account of recognition in the domain of right is not concerned with recognition as a moral attitude. I then turn, in section four, to a discussion of Hegel’s critique and transformation of (...) Fichte’s conception of recognition. Hegel’s transformation consists, I argue, in the claim that a comprehensive account of recognition in the domain of right must be concerned with recognition as a moral attitude. (shrink)

“I am only what I make myself to be”, Fichte tells us. In this paper, I outline Fichte’s views on sex, marriage and gender, with two aims. Firstly, to elucidate an aspect of his moral theory which has received little attention, and secondly to argue that Fichte’s distinctive stance on selfhood, freedom, and normativity lead to a revisionary account of gender expression and identity, where people can freely carve out their own identity, irrespective of “nature”. In this (...) paper, I therefore outline Fichte’s own views, highlighting what I see as a tension in the texts between essentialism and antiessentialism about gender, before reconstructing a neo-Fichtean view which foregrounds the anti-essentialist aspect. Fichte’s Foundations of the Entire Wissenschaftslehre 1794 is one of the most fundamental books in classical German philosophy. The use of laws of thought to establish foundational principles of transcendental philosophy was groundbreaking in the late eighteenth and early nineteenth century and is still crucial for many areas of theoretical philosophy and logic in general today. Nevertheless, contemporaries have already noted that Fichte’s derivation of foundational principles from the law of identity is problematic, since Fichte lacked the (...) tools to correctly present the formal parts of Foundations. In this paper, however, we argue that Fichte’s approach intuitively offers an important contribution to transcendental philosophy, and especially to philosophy of logic. We first point out the difficulties of Fichte’s logic in the Foundations and improve it in a second part on the basis of a formal system in which both propositional logic and syllogistic are combined. Investigates the concept of recognition (anerkennen) under which term the German idealists discussed the Other, intersubjectivity, the interhuman.

In this paper I return to the familiar territory of the Lord-Bondsman "dialectic" in Hegel's Phenomenology of Spirit in order to raise the question of the relation of Hegel's use of the theme of recognition there to Fichte's. Fichte had introduced the notion of recognition in his Foundations of Natural Right, to "deduce" the social existence of humans within relations of mutual recognition as a necessary condition of their very self-consciousness. However, there it also functioned as part of (...) a solution to a problem within the work on which the theory of rights was meant to be based, the earlier Foundation of the Complete Wissenschaftslehre of 1794-5. In Hegel's classic account in chapter 4 of the Phenomenology we find recognition offered as a solution to a problem within an account of "self-consciousness" that has a number of clearly Fichtean features. But I suggest that to the degree that the lord-bondsman episode there expresses any "theory of recognition", it is not Hegel’s own theory but rather his interpretation of Fichte's, a theory of which he is critical. Freed from this misleading assumption that the "lord-bondsman dialectic" represents something deep about Hegel's own philosophy, we might then be more able to get clearer about Hegel's actual views about recognition and the role it plays in his own philosophy. Der Artikel verfolgt, in welcher Weise Johann Gottlieb Fichte mit seiner Wissenschaftslehre die Diskussion um das Wesen der Natur in ihrem Verhältnis zum Subjekt beeinflusst. Dabei wird besonders sein Ansatz zur Fassung der Subjektivität und der Dialektisierung der Erkenntnisbeziehung zwischen Subjekt und Objekt herausgearbeitet. Dabei wird Fichtes Beitrag zur Entwicklung einer modernen dialektischen Methode gewürdigt. -/- The article follows the way in which Johann Gottlieb Fichte influences the discussion about the essence of nature in its relationship to the (...) subject with his science theory. His approach to the definition of subjectivity and the dialectization of the cognitive relationship between subject and object will be worked out in particular. En particular, se trabaja su aproximación a la definición de subjetividad y la dialéctica de la relación cognitiva entre sujeto y objeto. Für Fichte gab es 1799 keine Lebensunmittelbarkeit ohne die Abstraktionsarbeit philosophischer Spekulation. Es gab keinen gemeinsamen Boden, den sowohl Spekulation als auch Leben einnehmen könnten. Reinhold strebte einen solchen gemeinsamen Boden an. Für Fichte stand aber dieser gemeinsame »Vereinigungspunkt« einer dialektischen Verhältnisbestimmung beider im Wege. Denn beide negieren einander, und sind in dieser Negation von einander abhängig. Leben gibt es nicht ohne spekulative Thematisierung. Philosophisches Denken muss andererseits aber auch in der Unmittelbarkeit des Lebens verwurzelt sein, um seine (...) abstrahierende Gedankenarbeit ausüben zu können. Fichte hat dies ganz deutlich gemacht 1799, zur Zeit des Höhepunktes des Atheismusstreits, in seinem Brief an Jacobi vom 22. April dieses Jahres. Er sagt. (shrink)
