The papers in this symposium were delivered at the Society of Catholic Social Scientists’ spring conference of the same name on April 17, 1999 at Notre Dame Law School. The Society in its history has given some particular attention to this issue, having sent letters to all the members of Congress opposing the early Clinton Administration initiative to let known homosexuals into the military and to all the U.S. bishops pointing out the serious problems with the homosexual-specific ministries which (...) have sprung up in various dioceses. The latter letter gained attention from a couple of national publications and generated numerous requests for copies. The fact that we have given this focus to the issue of homosexuality accords with the Society’s intention to especially stress family issues. The election of Bill Clinton (born in 1946) to the Presidency signaled the generational shift in the United States (...) as early as 1992, and that shift was confirmed by the election campaign of 2000, in which both candidates, Al Gore (born in 1948) and George W. Bush (born in 1946), in spite of their differences, represented the same generation. In Germany the political shift in generations did not occur until 1998, when Gerhard Schröder (born slightly before the beginning of the German baby boom, in 1944) defeated Helmut Kohl (born in 1930).Significantly, Kohl is a member of the generation of Germans born during the 1930s and reared during the years of the Third Reich but too young to have played any significant role, either negative or positive, during the Nazi era. No member of this generation born in the 1930s ever became President in the United States, where the generation of World War Two veterans dominated national politics from Eisenhower to George Herbert Walker Bush. However what in America is a "silent generation" has been, in Germany, the generation most closely identified with the success of the Federal Republic of Germany: these were the so-called Flakhelfer (antiaircraft helpers) who had been children during the war. Kohl therefore famously referred to them as having the "grace of late birth," meaning that they, unlike the war veterans, were presumably untouched by any form of collective guilt for Nazi crimes against humanity. Whereas in the United States the Presidency was transferred directly from the World War Two veterans to [End Page 341] baby boomers—and in the case of the two Bush presidencies, literally, albeit indirectly, from father to son—in Germany the transition from the World War Two veterans (particularly former Chancellor Helmut Schmidt) to the baby boomers was interrupted by a long period of domination by the in-between generation of Flakhelfer.In both countries the baby-boom generation represents a significant shift in sensibilities and encompasses the generation involved in student protest and oppositional social movements in the 1960s and 1970s. In the United States these included the anti-Vietnam War movement, the feminist and gay-rights movements, the sexual revolution, the civil-rights movement, and the ecological movement, as well as, on the extreme fringes, terrorist groupings such as the Weather Underground and a great many religious sects and cults. In Germany the baby boomers formed many parallel groups and movements, including antiwar, feminist, ecological, and gay segments, as well as a proliferation of sectarian Marxist political groupings (so-called K-Gruppen, with the "K" meaning "Kommunist"). In the United States, Bill Clinton was an antiwar protester in the 1960s and 1970s, while both Gerhard Schröder and his Green Foreign Minister Joschka Fischer (born in 1948) had participated in left-wing political movements during the same period.In both West Germany and the United States the heyday of protest movements in the 1960s and 1970s signaled a generational split, with younger people—the very generation that is now in power in the two countries—accusing their elders of Machiavellian cynicism, imperialism, patriarchy, and worse. Such accusations can be recalled by the formerly popular slogans "Hey, hey, LBJ, how many kids did you kill today?" in the United States and "Unter den Talaren der Muff von tausend Jahren" ("under the academic regalia the stench of a thousand years") in Germany. The latter slogan was a reference not just to a generalized stodginess on the part of elderly German academics but to Hitler's invocation of a "Thousand-Year Reich;" German students were none-too-subtly suggesting that many of their professors had once been Nazis.The difference in these two slogans—one referring to past and the other to present sins—corresponds to a major distinction between the two baby... The Clinton administration's revised rules regulating but not prohibiting the common practice in managed care of linking physician compensation with cost cutting and control of services demonstrates the complexity of ethical issues in managed care. As originally proposed, the federal guidelines on payment for Medicare and Medicaid services would have precluded any interrelationship between payment to physicians and delivery of services. Such a restriction would have gutted the primary mechanism in managed care plans to curb the unacceptably high cost (...) of healthcare delivery: making physicians directly responsible for cost control by placing them at direct financial risk. At first blush such a linkage seems to involve an obvious and irreconcilable conflict of interest. How can a physician be responsible for the well-being of a patient while at the same time aware that a proportion of his or her income is linked to the provision of cost-conscious care? (shrink)

A central theme throughout the impressive series of philosophical books and articles Stephen Toulmin has published since 1948 is the way in which assertions and opinions concerning all sorts of topics, brought up in everyday life or in academic research, can be rationally justified. Is there one universal system of norms, by which all sorts of arguments in all sorts of fields must be judged, or must each sort of argument be judged according to its own norms? In The (...) Uses of Argument Toulmin sets out his views on these questions for the first time. In spite of initial criticisms from logicians and fellow philosophers, The Uses of Argument has been an enduring source of inspiration and discussion to students of argumentation from all kinds of disciplinary background for more than forty years. There is an increasing recognition by friends of personal probability that the standard systems of personal probability do not provide a fully adequate basis for the theories of scientific inference and rational decision making. This recognition has methodological and formal components. On the methodological side, Jeffrey [8] and Spielman [16], [17] have suggested that personal probabilities should be interpreted as judgments about thecredibilityof propositions, i.e., as appraisals of the degrees of confidence that are warranted by the information available to the (...) appraiser. The idea behind this interpretation is that there are criteria for appraising degrees of confidence as rational, plausible, silly or unwarranted. They have not been canonized, with the exception of the traditional informal fallacies of insufficient evidence, and if they were, would be highly vague and subject to revision as knowledge advances. Exploring an extension to Dick's "intelligence principle" Revisiting Dick’s “Intelligence Principle” in the light of recent technological developments, I present an argument for why one might consider a slight extension to the Principle and I explore some of the implications of the suggested modification.

Universal Logic is the study of the formal properties of logical systems in terms of the ways in which these formal features are found across systems of various kinds. A crucial example of this problematic is found at the heart of cognitive science. Brains are computers or computer-like things. But the digital logic of computers and the logic of computer programs do not correspond in any direct way with the processes of brains, either at the neural level, or at the (...) level of psychological descriptions of reasoning and inference processes. There have been many approaches to this problem, typically involving the idea of some sort of brain-based universal semantics or syntactics that is realized in different forms in different languages. These accounts do not extend very successfully to other supposed forms of common tacit mental life, such as culture, climates of opinion, habitus, practices, norms, scripts, schemas, worldviews, and so forth. Nor do any of these concepts fit very well with known neural processes. The alternative approaches appeal to versions of the notion of individual habit, most recently summarized in a major book recently published by Cambridge University Press (Caruana in Habits: Pragmatist Approaches from Cognitive Science, Neuroscience, and Social Theory. Cambridge University Press, Cambridge, 2020). My approach is to see the language capabilities of each person as an assemblage of language patterns that have patterned relations to one another, and that are unique to each person. The evidence that this is how the brain actually works comes from bilinguals, who do not have two parallel downloaded language systems, but who have a mixed system with no neural separation between linguistic capacities. This is a better model for the heterogeneous tacit capacities that make up the logic of practices: an assemblage of patterns that allow for mutual interaction. What makes up the “system” are patterned forms of behavior that are recognized by others as “signals.” Language and linguistic expressions serve, among other things, as props to inferences: as substitutes for elements of inferences, and as surrogates for inferences, which enable extensions of inferences beyond experience. It is a “system” not in the sense that it corresponds to some neural structure, but in the sense that the patterns which are learned in the course of language learning have causal relations with one another in the brain, and in the behavioral responses of others, form the “signal system.”. The experience of having to suffer debilitating pain is far too common in the United States, and many patients continue to be inadequately treated by their doctors. Although many physicians freely admit that their pain management practices may have been somewhat lacking, many more express concern that the prescribing of heightened levels of opioid analgesics may result in closer regulatory scrutiny, criminal investigation, or even criminal prosecution.Although several researchers have examined the regulatory environment and the threat of sanction or harm (...) it poses to physicians and patients, few have examined the likelihood of investigation or prosecution stemming from the aggressive use of opioids in physician-directed pain management. Accordingly, in an effort to assess whether the fear of prosecution is realistic and, if so, what factors contribute to its likelihood, we surveyed chief prosecutors in four states about their knowledge, opinions, and attitudes concerning opioids and the prosecution of physicians stemming from the treatment of patients who were either terminally ill or suffering from chronic noncancer pain. In this foundational work on the theory of linguistic and mental representation, Stephen Schiffer surveys all the leading theories of meaning and content in the philosophy of language and finds them lacking. He concludes that there can be no correct, positive philosophical theory or linguistic or mental representation and, accordingly advocates the deflationary "no-theory theory of meaning and content." Along the way he takes up functionalism, the nature of propositions and their suitability as contents, the language of thought and (...) other sententialist theories of belief, intention based semantics, and related issues in ontology. In a recent paper, Joshua Knobe (2019) offers a startling account of the metaphilosophical implications of findings in experimental philosophy. We argue that Knobe’s account is seriously mistaken, and that it is based on a radically misleading portrait of recent work in experimental philosophy and cultural psychology.

In light of many recent critiques of Western modernity and its conceptual foundations, the problem of adequately justifying our most basic moral and political values looms large. Without recourse to traditional ontological or metaphysical foundations, how can one affirm — or sustain — a commitment to fundamentals? The answer, according to Stephen White, lies in a turn to “weak” ontology, an approach that allows for ultimate commitments but at the same time acknowledges their historical, contestable character. This turn, White (...) suggests, is already underway. His book traces its emergence in a variety of quarters in political thought today and offers a clear and compelling account of what this might mean for our late modern self-understanding. (shrink)

This book argues that nothing is not and explains how we can meaningfully speak about what is not.

Jonathan Edwards identified the central act of faith as ‘the cordial consent of beings to Being in general’, which is to say to God (see Holbrook, 1973, pp. 102ff). That equation, of Being, Truth and God, is rarely taken seriously in analytical circles. My argument will be that this is to neglect the real context of a great deal of past philosophy, particularly the very Cartesian arguments from which so many undergraduate courses begin. All too many students issue from such (...) courses immunized against enthusiasm, in the conceit that they have answers to all the old conundrums, which were in any case no more than verbal trickery. ‘By uttering the right words but failing to use themin propria persona, philosophy induces a kind of soporific amnesia bewitching us into forgetting our God-given task. That task is, of course, to do what Socrates did and to live as he lived' (Burrell, 1972, p. 4). Burrell's words are not wholly fair to academic philosophers, nor to the Lady Philosophy. Plenty of philosophers really mind about the truth, and want to be Socratic in pursuit of it. But the danger is a real one. If all that matters is debunking past philosophers, how does that differ from the repeated refutation of the Chaldaean Oracles or the Prophecies of Nostradamus? A pretty enough pastime for the young, but hardly serious business for adults (as Callicles remarks: Plato,Gorgias484 c 5ff). ‘If the history of philosophy is a process of ‘salvaging’ what you yourself have already thought, then why bother?’ (MacDonald Ross, 1985, p. 502). Life, the universe, and everything -- Thinking robots and mysterious minds -- The good, the bad, and the ugly -- Is seeing believing?

This article examines the development of the concept of the value chain from the linear to the virtual conception of the chain, through the evolution of the literature from Michael Porter’s writings of the mid 1990s to the theorists of e-business and e-commerce in the later 1990s I argue that Porter’s account employs white metaphors and that writings on the virtual value chain both extend the white metaphors of Porter’s linear chain, and suggest a pronouncedly metaphysical system of thought — (...) one which has correlates in areas of thought, including Renaissance Neo-Platonism, cybernetics and the discourse of cyberspace. I suggest that this offers a model of the advance of metaphor — of its usure, as described by Derrida in his White Mythology — and that this model can be synthesised with the views of Ricoeur about the evolution of metaphor towards symbolism. When we apply these ideas of Derrida and Ricoeur to the development of the White Metaphor of the linear chain towards a progressive symbolism, we can see a correlation between the complex causality inferred as a feature of the virtual chain and the cosmological affinities of Renaissance notions of causation. The notion of domain specificity plays a central role in some of the most important debates in cognitive science. Yet, despite the widespread reliance on domain specificity in recent theorizing in cognitive science, this notion remains elusive. Critics have claimed that the notion of domain specificity can't bear the theoretical weight that has been put on it and that it should be abandoned. Even its most steadfast proponents have highlighted puzzles and tensions that arise once one tries to go beyond (...) an initial intuitive sketch of what domain specificity involves. In this paper, we address these concerns head on by developing an account of what it means for a cognitive mechanism to be domain specific that overcomes the obstacles that have made domain specificity seem so problematic. We then apply this understanding of domain specificity to one of the key debates that it has figured prominently in—the rationalism-empiricism debate concerning the origins of cognitive traits—and introduce several related theoretical notions that work alongside domain specificity in helping to clarify what makes a view more (or less) rationalist. This example illustrates how the notion of domain specificity can, and should, continue to play a central role in ongoing debates in cognitive science. (shrink)

When agents insert technological systems into their decision-making processes, they can obscure moral responsibility for the results. This can give rise to a distinct moral wrong, which we call “agency laundering.” At root, agency laundering involves obfuscating one’s moral responsibility by enlisting a technology or process to take some action and letting it forestall others from demanding an account for bad outcomes that result. We argue that the concept of agency laundering helps in understanding important moral problems in a number (...) of recent cases involving automated, or algorithmic, decision-systems. We apply our conception of agency laundering to a series of examples, including Facebook’s automated advertising suggestions, Uber’s driver interfaces, algorithmic evaluation of K-12 teachers, and risk assessment in criminal sentencing. We distinguish agency laundering from several other critiques of information technology, including the so-called “responsibility gap,” “bias laundering,” and masking. (shrink)

Many experimental philosophers are philosophers by training and professional affiliation, but some best work in experimental philosophy has been done by people who do not have advanced degrees in philosophy and do not teach in philosophy departments. This chapter explains that the experimental philosophy is the empirical investigation of philosophical intuitions, the factors that affect them, and the psychological and neurological mechanisms that underlie them. It explores what are philosophical intuitions, and why do experimental philosophers want to study them using (...) the methods of empirical science. The positive program in experimental philosophy shares the goal of the substantial part of traditional philosophy that is concerned with the analysis of important philosophical concepts. The negative program has implications for philosophical projects whose goal is conceptual analysis. There have been a number of responses to the challenge posed by experimental philosophy's negative program. The chapter also focuses on the expertise defense. (shrink)

Our knowledge of the world comes from various sources. But it is sometimes said that testimony, unlike other sources, transmits knowledge from one person to another. In this book, Stephen Wright investigates what the transmission of knowledge involves and the role that it should play in our theorising about testimony as a source of knowledge. He argues that the transmission of knowledge should be understood in terms of the more fundamental concept of the transmission of epistemic grounds, and that (...) the claim that testimony transmits knowledge is not only defensible in its own right, but indispensable to an adequate theory of testimony. Mark Colyvan (2010) raises two problems for ‘easy road’ nominalism about mathematical objects. The first is that a theory’s mathematical commitments may run too deep to permit the extraction of nominalistic content. Taking the math out is, or could be, like taking the hobbits out of Lord of the Rings. I agree with the ‘could be’, but not (or not yet) the ‘is’. A notion of logical subtraction is developed that supports the possibility, questioned by Colyvan, of bracketing a theory’s (...) mathematical aspects to obtain, as remainder, what it says ‘mathematics aside’. The other problem concerns explanation. Several grades of mathematical involvement in physical explanation are distinguished, by analogy with Quine’s three grades of modal involvement. The first two grades plausibly obtain, but they do not require mathematical objects. The third grade is likelier to require mathematical objects. But it is not clear from Colyvan’s example that the third grade really obtains. (shrink)

Moral philosophy, or at least the first stage of moral philosophy, Rawls maintained, can be thought of as the attempt to describe our moral capacity – the capacity which underlies “the poten- tially infinite number and variety of [moral] judgments we are prepared..

Agonism emerged three decades ago as an assault on the overemphasis in political theory on justice and consensus. It has now become the norm. But its character and relation to core values of democracy are not as unproblematic today as is often thought, an issue that becomes more pressing as contemporary politics increasingly seem locked into notions of unrelenting conflict between “friends” and “enemies.” This essay traces alternative ontological roots and ethical implications of agonism, distinguishing between “imperializing” and “tempered” modes. (...) The former, exemplified in the popular Schmitt-Mouffe formulation, is shown to be fundamentally flawed in its failure to conceive politics in a fashion that does not allow the dynamic of friend–enemy to imperially trump appeals to democratic norms. In a world of insurgent white nationalism in democratic polities, this is no small fault. “Tempered” agonists, such as William Connolly and Bonnie Honig, offer ontologies where democratic norms can gain traction. Despite the admirable qualities of these alternatives, their formulations are nevertheless not fully persuasive. The difficulty lies in their underarticulated accounts of equality. I suggest an alternative formulation of agonism that embraces a central role for the idea of the moral equality of voice, a value that resides in the seam between notions of difference, resistance, and conflict emphasized by agonists, on the one hand, and the idea of fairness emphasized by notions of democratic justice, on the other. In a recent issue of this journal, Berit Brogaard and Joe Salerno presented a counterfactual theory of essence, designed to get around Kit Fine’s influential objections to the standard modal account of essence. I argue that Brogaard and Salerno’s theory does not avoid Fine’s objections. Then I propose a sequence of variations on their theory, and argue that none of them succeed either.
