Artefacts do not always do what they are supposed to, due to a variety of reasons, including manufacturing problems, poor maintenance, and normal wear-and-tear. Since software is an artefact, it should be subject to malfunctioning in the same sense in which other artefacts can malfunction. Yet, whether software is on a par with other artefacts when it comes to malfunctioning crucially depends on the abstraction used in the analysis. We distinguish between “negative” and “positive” notions of malfunction. A negative malfunction, (...) or dysfunction, occurs when an artefact token either does not or cannot do what it is supposed to. A positive malfunction, or misfunction, occurs when an artefact token may do what is supposed to but, at least occasionally, it also yields some unintended and undesirable effects. We argue that software, understood as type, may misfunction in some limited sense, but cannot dysfunction. Accordingly, one should distinguish software from other technical artefacts, in view of their design that makes dysfunction impossible for the former, while possible for the latter. (shrink)

For many years, psychological–clinical research has been aiming at studying the Mafia from different viewpoints: the man of honor's inner world, relational and psychopathological structures of his family matrices, connections between inner and social worlds, interiorized and social rules. Today, however, a complex phenomenon has come to light, which concerns the great connection between the Mafia and financial crime, and for us as researchers it is very interesting and complicated to analyze, because it involves the study of psychological peculiarities that (...) can be specifically found in the numerous illegalities. The crossbreeding of the various criminalities, which are always more interacting and merging and less isolated, makes this picture even more complex. (shrink)

The human attempts to access, measure and organize physical phenomena have led to a manifold construction of mathematical and physical spaces. We will survey the evolution of geometries from Euclid to the Algebraic Geometry of the 20th century. The role of Persian/Arabic Algebra in this transition and its Western symbolic development is emphasized. In this relation, we will also discuss changes in the ontological attitudes toward mathematics and its applications. Historically, the encounter of geometric and algebraic perspectives enriched the mathematical (...) practices and their foundations. Yet, the collapse of Euclidean certitudes, of over 2300 years, and the crisis in the mathematical analysis of the 19th century, led to the exclusion of “geometric judgments” from the foundations of Mathematics. After the success and the limits of the logico-formal analysis, it is necessary to broaden our foundational tools and re-examine the interactions with natural sciences. In particular, the way the geometric and algebraic approaches organize knowledge is analyzed as a cross-disciplinary and cross-cultural issue and will be examined in Mathematical Physics and Biology. We finally discuss how the current notions of mathematical (phase) “space” should be revisited for the purposes of life sciences. (shrink)

Some computational phenomena rely essentially on pragmatic considerations, and seem to undermine the independence of the specification from the implementation. These include software development, deviant uses, esoteric languages and recent data-driven applications. To account for them, the interaction between pragmatics, epistemology and ontology in computational artefacts seems essential, indicating the need to recover the role of the language metaphor. We propose a User Levels (ULs) structure as a pragmatic complement to the Levels of Abstraction (LoAs)-based structure defining the ontology and (...) epistemology of computational artefacts. ULs identify a flexible hierarchy in which users bear their own semantic and normative requirements, possibly competing with the logical specification. We formulate a notion of computational act intended in its pragmatic sense, alongside pragmatic versions of implementation and correctness. (shrink)

Jaakko Hintikka proposed treating objectual perception sentences, such as “Alice sees Bob,” as de re propositional perception sentences. Esa Saarinen extended Hintikka’s idea to eventive perception sentences, such as “Alice sees Bob smile.” These approaches, elegant as they may be, are not philosophically neutral, for they presuppose, controversially, that the content of all perceptual experiences is propositional in nature. The aim of this paper is to propose a formal treatment of objectual and eventive perception sentences that builds on Hintikka’s modal (...) approach to propositional attitude ascriptions while avoiding controversial assumptions on the nature of perceptual experiences. Despite being simple and theoretically frugal, our approach is powerful enough to express a variety of interesting philosophical views about propositional, objectual, and eventive perception sentences, thus enabling the study of their inferential relationships. This paper explores mutable futurism, the view according to which the future can literally change—that is, it can happen that a future time t changes from containing an event E to lacking it. Mutable futurism has received little attention so far, and the details and implications of the view are underexplored in the literature. For instance, it currently lacks a precise metaphysical model and a formal semantics. Although we do not endorse mutable futurism, our goal here is to strengthen the (...) case for mutable futurism and help establish it as a worthy contender in the debate on the philosophy of time. To attain this goal, we try to make mutable futurism, along with its metaphysical and inferential commitments, as clear as possible, by providing it with a coherent metaphysical model and a plausible semantics, and we show that it can be backed by theoretical reasons. In this paper we analyse the conditions for attributing to AI autonomous systems the ontological status of “artificial moral agents”, in the context of the “distributed responsibility” between humans and machines in Machine Ethics (ME). In order to address the fundamental issue in ME of the unavoidable “opacity” of their decisions with ethical/legal relevance, we start from the neuroethical evidence in cognitive science. In humans, the “transparency” and then the “ethical accountability” of their actions as responsible moral agents is not (...) in contradiction with the unavoidable “opacity” (unawareness) of the brain process by which they perform their moral judgements on the right action to execute. In fact, the moral accountability of our actions depends on what is immediately before and after our “moral judgements” on the right action to execute (formally, deontic first order logic (FOL) decisions). I.e., our moral accountability depends on the “ethical constraints” we imposed to our judgement before performing it in an opaque way. Anyway, our moral accountability depends overall on the “ethical assessment” or explicit “moral reasoning” after and over the moral judgement before executing our actions (deontic higher order logic (HOL) assessment). In this way, in the light of the AI “imitation game”, the consistent attribution of the status of ethically accountable artificial moral agents to autonomous AI systems depends on two similar conditions. Firstly, it depends on the presence of “ethical constraints” to be satisfied in their Machine Learning (ML) supervised optimization algorithm during its training phase, to give the system ethical skills (“competences”) in its decisions. Secondly – and definitely—, it depends on the presence in an AI autonomous system of a deontic HOL “ethical reasoner” to perform an automatic, and fully transparent assessment (metalogical deontic valuation) about the decisions taken by the ethically skilled ML algorithm about the right action to execute, before executing it. Finally, we show that the proper deontic FOL and HOL for this class of artificial moral agents is Kripke’s modal relational logic, in its algebraic topological formalization. This is naturally implemented in the dissipative QFT unsupervised deep learning of our brains, based on the “doubling of the degrees of freedom” (DDF), and then in the so-called “deep-belief” artificial neural networks for the statistical data pre-processing. This unsupervised learning procedure is also compliant with the usage of the “maximin fairness principle”, used as a balancing aggregation principle of the statistical variables in Sen’s formal theory of fairness. Coherent-ambiguity aversion is defined within the smooth-ambiguity model as the combination of choice-ambiguity and value-ambiguity aversion. Five ambiguous decision tasks are analyzed theoretically, where an individual faces two-stage lotteries with binomial, uniform, or unknown second-order probabilities. Theoretical predictions are then tested through a 10-task experiment. In tasks 1–5, risk aversion is elicited through both a portfolio choice method and a BDM mechanism. In tasks 6–10, choice-ambiguity aversion is elicited through the portfolio choice method, while value-ambiguity aversion comes about through the (...) BDM mechanism. The behavior of over 75 % of classified subjects is in line with the KMM model in all tasks 6–10, independent of their degree of risk aversion. Furthermore, the percentage of coherent-ambiguity-averse subjects is lower in the binomial than in the uniform and in the unknown treatments, with only the latter difference being significant. The most part of coherent-ambiguity-loving subjects show a high risk aversion. (shrink)

We analyze the results from three different risk attitude elicitation methods. First, the broadly used test by Holt and Laury, HL, second, the lottery-panel task by Sabater-Grande and Georgantzis, SG, and third, responses to a survey question on self-assessment of general attitude towards risk. The first and the second task are implemented with real monetary incentives, while the third concerns all domains in life in general. Like in previous studies, the correlation of decisions across tasks is low and usually statistically (...) non-significant. However, when we consider only subjects whose behavior across the panels of the SG task is compatible with constant relative risk aversion, the correlation between HL and self-assessed risk attitude becomes significant. Furthermore, the correlation between HL and SG also increases for CRRA-compatible subjects, although it remains statistically non-significant. (shrink)

Henri Bergson (1859–1940), the most prominent member of nineteenth-century French spiritualism, is the first philosopher who explicitly defined philosophy as a practice which consists in posing problems anew and in creating concepts. In this article, I will try to reconstruct the progressive importance acquired by the terms ‘problem’ and ‘concept’ in nineteenth-century French philosophy and how they combined in Bergson’s theories about creativity, invention and novelty. I will argue that Bergson’s conception of philosophy as a creative intellectual practice was the (...) result of a negotiation, inside a pre-existent spiritualist framework, between, on the one hand, neo-Kantianism and, on the other hand, evolutionism which strongly influenced empirical psychology and the emerging social sciences. Bergson’s solution, influenced by the evolution of mathematics and literary theory, was just one of the possible options, and the main alternative to a new form of transcendental philosophy. Los cambios en los procesos de producción del derecho y la modificación estructural del sistema de fuentes ponen en tela de juicio el modelo de derecho diseñado por el positivismo jurídico del XIX, basado en el monopolio legislativo en la creación del derecho y en la consideración de proceso de aplicación del derecho como un procedimiento de subsunción formal. En ese nuevo escenario, el momento aplicativo y hermenéutico del derecho adquieren un protagonismo central. En las nuevas y complejas funciones que (...) asume el intérprete del derecho para tratar de recomponer la unidad y la coherencia de los ordenamientos jurídicos complejos, faltos de plenitud y fragmentados, la recuperación del rol normativo autónomo de los principios jurídicos se convierte en una exigencia imprescindible. This paper focuses on some issues where the process of convergence between analytical and hermeneutic perspectives, with respect to their general philosophical grounds, mainly turns out to be clear. On the analytical side, the overcoming of logical Neopositivism and radical formalism and the rejection of the atomistic theory of reference by holistic theories of meaning have been the core shifts. On the side of the continental philosophical tradition, the main theoretical change lies in replacing the centrality of the subject with (...) the centrality of language, with its links to the dimension of intersubjectivity. Furthermore, the importance given to concepts such as action and intention, mainly due to the Wittgensteinian connection between language and forms of life, has led to recognising the active role of the subject in the world and the ability of language to be a means for doing things and not just a system of signs representing the world. Such a convergence, though it has not yet been reached, seems to be particularly fertile in the legal domain. Here, for example, some outcomes of speech acts theory fit the hermeneutic view of law. In the literature there are two well-established but opposite readings of Arendt: as an agonistic theorist and as a deliberative one. In between these two positions a smaller number of scholars have argued that in Arendt these two dimensions can to a large extent be reconciled. This paper follows this third path but tries to bring it one step further. In particular, it defends the idea that those scholars who have proposed this third reading of Arendt have fallen short of (...) revealing the degree to which deliberation and agonism are, for her, interwoven. Through an original reading of Arendt’s views on judgment, persuasion, distinction and Eichmann’s banality, the paper clarifies why, for her, agonism and deliberation are not only compatible but actually mutually dependent. In other words, it clarifies why she believes that there can be no deliberation without agonism and no agonism without deliberation. (shrink)

Se alcuni tipi di giustificazione della credenza possono essereutili (...) a individuarne l’irriducibilità, solo le credenze primitive, unacomplessa nozione di “credenza soggettiva” e un originale modellofiduciario della credenza fungono da buoni candidati per difenderela specificità della credenza. Dopo la discussione di alcune tesi diLudwig Wittgenstein e il ricorso a fonti eterogenee, da William Jamesa Henry Habberley Price fino a Niklas Luhmann, l’autore proponela nozione originale di “credenza progressiva” come il migliorcandidato che confermi l’ipotesi di partenza. In essa una precisaidea di rischio e la fiducia, al cui dibattito è dedicata un’ampiaattenzione, contribuiscono a delineare la credenza progressivainsieme ad alcuni suoi aspetti soggettivi, così profilandola comeuna postura sperimentale. Il saggio si completa con una riflessionesulla peculiarità della questione filosofica della credenza religiosa,la quale viene approcciata nella sua preliminare generalità, quindiconfrontata con la credenza progressiva. Zwischen produktivem und reproduktivem Status, d.h. zwischen Phantasie und Gedächtnis changierend wurde die Leistungsfähigkeit für Erkenntnis und Wissenschaft von den Gefahren der Täuschungen des Geistes durch die Einbildungskraft korreliert. This work suggests how much human sciences can learn from a booklet almost all cultures know, The Little Prince. It stimulates to read them in their anthropological aspects of behavior facing alterity, highlighting its value without proposing it as educational element to homogenize the different. The reflection is thus focused on the demolishing and lasting effects of European culture during its colonization of American and African people. The contribution ends with Ferraioli and De Vitoria's considerations on a society based on (...) the axiom of the free circulation of men and goods, and the legitimization of thinking given by natural law. Giuseppe Fornari’s groundbreaking inquiry shows that Friedrich Nietzsche’s neglected importance as a religious thinker and his “untimeliness” place him at the forefront of modern thought. Capable of exploiting his own failures as a cognitive tool to discover what other philosophers never wanted to see, Nietzsche ultimately drove himself to mental collapse. Fornari analyzes the tragic reports of Nietzsche’s madness and seeks out the cause of this self-destructive destiny, which, he argues, began earlier than his rivalry with the composer and (...) polemicist Richard Wagner, dating back to the premature loss of Nietzsche’s father. Dramatic experience enabled Nietzsche to detect a more general tendency of European culture, leading to his archaeological and prophetic discovery of the death of God, which he understood as a primordial assassination from which all humankind took its origin. Fornari concludes that Nietzsche’s fatal rebellion against a Christian awareness, which he identified as the greatest threat to his plan, led him to become one and the same not only with Dionysus but also with the crucified Christ. His effort, Fornari argues, was a dramatic way to recognize the silent, inner meaning of Christ’s figure, and perhaps to be forgiven. (shrink)

We use a controlled laboratory experiment to study firm’s protection against potential technological damages. The probability of a catastrophic event is known, and the firm’s costly investment in safety reduces it. The firm can also buy an insurance with full or partial refund against the consequences of the catastrophic event, which ultimately reduces the variance of the firm’s investment-in-safety lottery. The firm makes these two choices simultaneously, after observing the insurance contract proposed by an insurer who chooses this contract within (...) a set of premium–deductible combinations. We parametrize the insurer–firm game such that a risk-neutral insurer maximizes his expected profit by offering an actuarially fair contract with full insurance; a risk-neutral firm is indifferent between investing in safety and accepting a fair insurance contract. We aim at understanding whether investment in safety and insurance are substitutes or complements in the firm’s risk management of catastrophic events. In line with our predictions, the experimental results suggest that they are substitutes rather than complements: the firm’s investment in safety measures is affected by the insurer’s proposed contract, the latter usually involving only partial insurance. This book explores the significance of rhetoric from the perspective of its complex relationship with philosophy. It demonstrates how this relationship gives expression to a basic tension at the core of politics: that between the contingency of its happening and the transcendence toward which it strives. The first part of the study proposes a reassessment of the ancient quarrel between philosophy and rhetoric, as it was discussed by Plato, Aristotle, and above all Cicero and Quintilian, who ambitiously attempted to bring (...) them together creating an ideal that is at the roots of the humanist tradition. It then moves to twentieth-century political theory and shows how the questions that emerge from that quarrel still strongly resonate in the works of key thinkers such as H. Arendt, L. Strauss, and R. Rorty. The volume thus offers an original contribution that locates itself at the intersection of politics, rhetoric, and philosophy. (shrink)

The ‘constructivist turn’ in political representation literature has clarified that representation is crucial in forging identities – through the creation of ideological and symbolic representations that mobilize and coalesce otherwise scattered and undefined social forces – and thus also why it is essentially an interpretative and performative activity. In this article I argue that, as a consequence of this emphasis on interpretation and performativity, this approach makes clear why the ethos of representatives is important in representation. To prove this, I (...) employ some insights from rhetoric. Rhetorical persuasion and democratic representation, indeed, call for a similar kind of judgment, as they both need to mediate between opposing exigencies: rhetoric between attentiveness to the specificity of the audience and the creation of new beliefs, and representation between being responsive to specific interests and giving them a new articulation. Mediating this tension requires an exercise of judgment that, being directed toward the future, inevitably introduces uncertainty into the relation. This is why both in rhetoric and representation the ethos is an essential element. However, as I argue in the conclusion, the personal qualities that should be considered relevant here are above political qualities, rather than technical or moral ones. (shrink)
