La justicia interamericana de derechos humanos es un fenómeno de transnacional influencia sobre los ordenamientos jurídicos de los Estados nacionales. La creciente interacción de la Corte Interamericana con los jueces nacionales y su labor como intérprete de la Convención Americana de Derechos Humanos (CADH) ha promovido un excesivo optimismo que resulta necesario revisar críticamente en aras de una mejor comprensión de la justicia transnacional en derechos humanos. Resumen: El presente trabajo ofrece un análisis del diccionario Nuevos chilenismos con el objetivo de identificar los principales aspectos culturales presentes en esta obra chilena de principios del siglo XX. Gracias a un enfoque metodológico sustentado en la teoría fundamentada, es posible establecer que dentro de los aspectos culturales con mayor presencia destaca la conformación de la identidad lingüística chilena, lo que se evidencia a través de la valoración social que ofrece el autor de la norma nacional y, además, la (...) oposición que establece entre esta y la norma peninsular.: This work offers an analysis of the New Chileanisms dictionary with the objective of identifying the main cultural aspects present in this Chilean work of the beginning of the XXth century. The aim of this study was to analyze the association between physical activity and eating habits during the COVID-19 pandemic among Brazilian adults. A sample of 1,929 participants answered an online survey, however 1,874 were included in the analysis. The impact of the COVID-19 pandemic on eating habits was assessed inquiring about participants' intake of fruits, vegetables, fried foods, and sweets during the pandemic. Physical activity was assessed by asking participants about their weekly frequency, intensity and number of minutes/hours engaging (...) in structured physical activities per week. Participants were then stratified into categories based on moderate-to-vigorous intensity and into active or inactive. Increased sweets consumption was the most commonly reported change to eating habits, followed by an increase in the consumption of vegetables, fruits, and fried foods. Physical activity practice was related to lower consumption of fried foods and sweets. A cluster analysis revealed subjects with higher the level of physical activity was more likely to follow a healthy diet. Thus, physical activity was positively associated with healthier eating habits. Health authorities must recommend regular physical as a strategy to improve overall health during the COVID-19 pandemic. Future studies should address the physical activity interventions to improve health status during a pandemic. (shrink)

Andrés de Guevara y Basoazábal (1748-1801), jesuita novohispano guanajuatense, escribió las Institutionum elementarium philosophiae, donde su autor ofrece un currículo deseable para la juventud mexicana que incluya la ciencia moderna empírica, la política virtuosa y la sabiduría humana. A través de una traducción comparativa del latín al español del proemio de la citada obra, este artículo pretende: 1) contextualizar al autor novohispano, 2) mostrar la recepción de la ciencia moderna desde los elementos aristotélicos de los que Guevara dispuso, y 3) (...) mostrar que la modernidad y la tradición aristotélica se enriquecieron mutuamente; y lo que debía de reformarse era la escolástica anquilosada. In contrast to the abundance of discussion of Plato’s portrayal of the Socratic elenchos, relatively little work has been done on the elenchos as it appears in Xenophon. The reason is obvious: Xenophon makes much less use of the elenchus than Plato and what he does offer is not as interesting philosophically. Nevertheless, there are good reasons to look more closely at Xenophon’s portrait. It provides a corrective to the excessively intellectualizing portrait of the elenchus found in Plato’s writings, and (...) exhibits an educational quality that is characteristic of ancient Greek attitudes but not always stressed in treatments of Socrates. In the introduction to Bandini and Dorion 2000-2010, cxviii-clxxxii, Louis-André Dorion offers a probing analysis of the term elenchos as used by Xenophon and a broad survey of the elenchoi in Xenophon’s Socratic writings. Although Xenophon’s Socrates sometimes uses argumentation reminiscent of his Platonic cousin, this is only a minor part of his over-all conversational repertoire. Education is accomplished not by interrogation but by the direct and open communication of doctrine and by the practice of virtue (askēsis: see Mem. i 2.23, ii 1.1). Rather than employing the elenchos, Xenophon’s Socrates generally spends his time offering abundant useful advice to his friends. According to Dorion, Xenophon’s scant use of the elenchos is a result of his deep skepticism about its educational value. As a result of this skepticism, Xenophon creates an alternative portrait of Socrates in which interrogation plays a much smaller role. Dorion is certainly right to note that the elenchos is far less important for Xenophon than for Plato, but his conclusion is somewhat extreme. Although Xenophon does not focus on the Socratic elenchos, he does offer some portraits of it and he does not contest Plato’s fuller portrait of it either. This is because the elenchos does have some value for Xenophon, even if this value differs from what we may assume is its value in the Platonic portrait. As Morrison 1994 has shown, the elenchos serves a valuable role in selecting or preparing students for more substantive lessons. It can also play a valuable role in training for and acting in political affairs. And the elenchos can serve an educational role in another way, by contributing directly to the acquisition of virtue (sophrosune) by the interlocutor. Este artículo quisiera introducir al corazón de «la cosa misma». Esta «cosa» no es aquí el sistema hegeliano propiamente en su totalidad. Ello sería pretencioso. Se trata más bien de la estructura de este sistema, es decir de la forma especulativa que determina el desarrollo y el ordenamiento de su contenido y permite captar, en su coherencia específica, las distintas obras donde se expone la sistemática hegeliana. Estas obras son principalmente la Fenomenología del espíritu, la Enciclopedia de las ciencias filosóficas (...) y los diversos Cursos de Berlín. En las obras restantes encontramos todavía la Ciencia de la lógica –que es el despliegue detallado de lo que en forma abreviada encontramos en la lógica de la Enciclopedia– y los Principios de la filosofía del derecho, que constituyen una elaboración más profunda de la parte consagrada al espíritu objetivo en la Enciclopedia. En el presente trabajo se abordará el Nuevo Realismo, movimiento filosófico que cada vez goza de mayor popularidad. En primer lugar, se hará un breve análisis de su origen. A continuación, se atenderá a las propuestas de cuatro de los principales referentes de este movimiento: Quentin Meillassoux, Graham Harman, Maurizio Ferraris y Markus Gabriel. El objetivo de esto es encontrar las semejanzas y diferencias entre todas, para poder establecer una clasificación más acertada dentro del nuevo realismo.

Hackett s English translation of Jean Wahl s "Existence humaine et transcendence" (1944) brings back to life an all-but-forgotten book that provocatively explores the philosophical concept of transcendence. Based on what Emmanuel Levinas called Wahl s famous lecture from 1937, "Existence humaine et transcendence" captured a watershed moment of European philosophy. Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

This reconsideration of Hume’s classic essay “Of Miracles” via the lens of American pragmatist ways of thinking about history and power shifts our attention from Hume’s epistemic concerns about the legitimacy of witnesses and testimony to his distaste for sacred history, his critical stance regarding the social force of revelation, and his disdain for religious authority. To view Hume’s essay both as an articulation of a critical philosophy of history and as an exercise in moral dynamism (social power or, authority, (...) is a result of epistemic transactions), is to intervene in both Hume studies and Contemporary Pragmatism. Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

While some countries are moving toward legalization, euthanasia is still criticized on various fronts. Most importantly, it is considered a violation of the medical ethics principle of non-maleficence, because it actively seeks a patient’s death. But, medical ethicists should consider an ethical alternative to euthanasia. In this article, we defend cryocide as one such alternative. Under this procedure, with the consent of terminally-ill patients, their clinical death is induced, in order to prevent the further advance of their brain’s deterioration. Their (...) body is then cryogenically preserved, in the hope that in the future, there will be a technology to reanimate it. This prospect is ethically distinct from euthanasia if a different criterion of death is assumed. In the information-theoretic criterion of death, a person is not considered dead when brain and cardiopulmonary functions cease, but rather, when information constituting psychology and memory is lost. Some philosophers of religion have argued that moral anti-theodicy begs the question. This paper evaluates the arguments from two such philosophers, writing a decade apart—Robert Mark Simpson, and Lauri Snellman. Simpson argues that any global argument against theodicy must allow for the possibility of there existing a plausible theodicy, and that anti-theodical arguments (the argument from insensitivity, the argument from detachment, and the argument from harmful consequences) all implicitly discount this possibility, thus ending up begging the question. Snellman argues that (...) moral anti-theodicies presuppose that some evils cannot be justified, which would presuppose that theodicy is false from the start, which in turn would beg the question against theodicy. The author of the paper argues that Simpson’s arguments rest on an erroneous assumption regarding the nature of anti-theodicy, and that one of Simpson’s arguments sets a problematic standard for argumentation that the author argues we should not accept. It is also argued that Snellman’s argument relies on an unsupported claim from Toby Betenson. Therefore, the author concludes that Simpson and Snellman have not managed to show that moral anti-theodicies beg the question. (shrink)

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

Drawing on recent findings, this study examines whether valence concordant electromyography (EMG) responses can be explained as an unconditional effect of mere stimulus processing or as somatosensory simulation driven by task-dependent processing strategies. While facial EMG over the Corrugator supercilii and the Zygomaticus major was measured, each participant performed two tasks with pictures of album covers. One task was an affective evaluation task and the other was to attribute the album covers to one of five decades. The Embodied Emotion Account (...) predicts that valence concordant EMG is more likely to occur if the task necessitates a somatosensory simulation of the evaluative meaning of stimuli. Results support this prediction with regard to Corrugator supercilii in that valence concordant EMG activity was only present in the affective evaluation task but not in the non-evaluative task. Results for the Zygomaticus major were ambiguous. Our findings are in line with the view that EMG activity is an embodied part of the evaluation process and not a mere physical outcome. (shrink)
