This volume contains the first publication in book form of an English translation of Thomas Aquinas's controversial disputed question De unione Verbi incarnati. This disputed question is a remarkable portal into the Angelic Doctor's theology of the hypostatic union, which is recognized as an area in which Aquinas forged some of his most original and penetrating articulations of the Christian faith. In the De unione Verbi incarnati Aquinas presents in five articles material that occupies more than eighteen questions in the (...) third part of the Summa theologiae. The attribution of an esse secundarium to Christ, in the fourth article of the De unione, has been the object of intense debate, for it seems to contradict the account of the Summa. In addition to Professor Nutt's English translation, the volume includes the critical Latin text published by Barbara Bartocci, Klaus Obenauer, and Walter Senner, as well as a substantial introduction. Professor Nutt's introduction carefully unfolds the historical background, technical concepts, sources, and speculative claims needed for understanding the breadth of the biblical and metaphysical contemplation represented in this work; it also includes a detailed exploration of the debate over the fourth article. While unionization is usually evaluated as an aspect of freedom of association—the idea being that workers have the right to associate and form unions if they want and have an equal right not to do so if they don't, I argue that this is a mistake. Instead of merely allowing unions to form or not depending on the preferences of workers, I argue that unions are a basic and therefore necessary institution of a just society. After analyzing (...) and criticizing the schema developed by John Rawls for evaluating what constitutes a basic institution, I introduce a new principle that allows us to determine what should be considered a basic institution in the context of our existing social institutions and practices. I then apply this principle to unionization, and argue that while unions are subject to post-institutional regulation, just like firms are, their existence is demanded by pre-institutional principles of equality and liberty and therefore not optional. Not only are union shops consistent with our deepest moral principles, including our commitment to liberty, that commitment, when properly understood, actually requires that unionization be universal. ‘The Union of Cause and Effect in Aristotle : Physics III 3’, Oxford Studies in Ancient Philosophy, 32, pp. 205-232, May 2007.: I argue that Aristotle introduced a unique realist account of causation, which has not hitherto been appreciated in the history of philosophy: causal realism without a causal relation. In his account, cause and effect are unified by the ectopic actualization of the agent’s potentiality in the patient. His solution consists in the introduction of a property that belongs to (...) one subject but is realized in another subject on whose state this realization depends. Context: Neurophenomenology is a relatively new field, with scope for novel and informative approaches to empirical questions about what structural parallels there are between neural activity and phenomenal experience. Problem: The overall aim is to present a method for examining possible correlations of neurodynamic and phenodynamic structures within the structurally-coupled work of Alexander Technique practitioners with their pupils. Method: This paper includes the development of an enkinaesthetic explanatory framework, an overview of the salient aspects of the Alexander Technique, and the (...) presentation of an elicitation interview technique as part of a neurophenomenological method. It will propose a way of testing the hypothesis that if, in the effective practice of Alexander Technique, there is a union between the nervous systems of teacher and pupil, it should be visible neurologically and affective phenomenologically, and thus it should be possible to investigate both its neural and phenomenal signatures. Results: The proposed means of testing the hypothesis is to use the elicitation interview technique alongside neural monitoring during the teaching of the Alexander Technique in four paired sets of subjects. Constructivist content: At the heart of this paper is the claim that all activity is co-activity. I make no assumption of an ontological primacy of mental or physical, or explanatory primacy of any methodology. Implications: This has important ramifications for somatic education and therapies, for establishing frameworks of co-engagement and care in health-care situations, and for understanding empathy. For twenty years, the European Union has qualified as a supranational actor more and more present on the educational scene. Through the European strategies - Lisbon 2010 and Europe 2020 - but also the open method of coordination, an essential mutation has been occurring at the level of Member States. In this article, I intend to analyse in which manner the European Union manages to become a genuine educational actor. Thematic analysis of forty semi-structured interviews conducted with European and international (...) officials demonstrate that the European leaders prepared the European “suitcase” for the first “flight” of 2010 and the second one in 2020. Mainly, this briefcase regroups benchmarks, core competencies, mobility programs and the European qualifications framework. If the European Union is able to “boast” with a national or international political visibility through educational proposals however, an unknown factor remains in this geopolitical equation. Many political and legal philosophers compare the EU to a federal union and believe its basic laws should be subject to the standards of constitutional law, and thus find it lacking or incomplete. This book proposes a rival theory: that the substance of EU law is not constitutional, but international, and provides a close examination of the treaties and the precedents of the European courts to explore this concept further. -/- Just like international law, EU law applies primarily to the (...) relations between member states, who have democratically chosen to adapt their constitutional arrangements in order to share legislative and executive powers with their partners. The legal architecture of the European Union is thus best understood under a theory of dualism and not pluralism. -/- According to this 'internationalist' view, EU law is part of the law of nations and its distinction from domestic law is a matter of substance, not form. This arrangement is supported by a cosmopolitan theory of international justice, which we may call progressive internationalism. The EU is a union of democratic peoples, freely organizing their interdependence on the basis of principles of equality and reciprocity. Its central principles are not the principles of a constitution, but cosmopolitan principles of accountability, liberty, and fairness. -/- Presenting an 'internationalist' reading, this book proposes that the EU is a creation of the law of nations, and argues for a dualist account of its legal architecture, with EU law and domestic law allocated different institutional roles. We study statements about countable and well-ordered unions and their relation to each other and to countable and well-ordered forms of the axiom of choice. Using WO as an abbreviation for “well-orderable”, here are two typical results: The assertion that every WO family of countable sets has a WO union does not imply that every countable family of WO sets has a WO union; the axiom of choice for WO families of WO sets does not imply that the countable (...) union of countable sets is WO. We follow [8] in asking when a set of ordinals $X \subseteq \alpha$ is a countable union of sets in K, the core model. We show that, analogously to L, and X closed under the canonical Σ 1 Skolem function for K α can be so decomposed provided K is such that no ω-closed filters are put on its measure sequence, but not otherwise. This proviso holds if there is no inner model of a weak Erdős-type property.

George argue that marriage is a distinctive type of community: the union of a man and a woman who have committed to sharing their lives on every level of their beings (bodily, emotionally, and spiritually) in the kind of union that would be fulfilled by conceiving and rearing children together. The comprehensive nature of this union, and its intrinsic orientation to procreation as its natural fulfillment, distinguishes marriage (...) from other types of community and provides the basis for the norms of marital exclusivity and permanence. Lee and George detail how the basic moral norms regarding sexual acts follow from the ethical requirement to respect the good of marriage and explain how the law should treat marriage, given its conjugal nature, examining both the same-sex-marriage issue and civil divorce. Todos los Acuerdos de Libre Comercio (ALCs) concluidos recientemente por la Unión Europea (UE) incluyen capítulos sobre Comercio y Desarrollo Sostenible (CDS) donde se recogen compromisos mutuos en materia laboral y medioambiental. Las disposiciones sobre medio ambiente mencionan expresamente los acuerdos multilaterales que cada Parte se compromete a cumplir, como el Acuerdo de París sobre cambio climático. Sin embargo, la falta de un mecanismo de ejecución efectiva en caso de incumplimiento de las disposiciones sobre CDS merma la credibilidad de los (...) compromisos de sostenibilidad. El ALC de la UE con Nueva Zelanda representa un punto de inflexión en esta tendencia, ya que introduce un nuevo modelo de aplicación. Con respecto a los compromisos climáticos, en particular, el ACL incluye objetivos ambiciosos que, unido al nuevo enfoque de aplicación, podrían incorporarse a futuros ALCs de la UE, contribuyendo así de forma importante a la lucha global contra el cambio climático. Union Citizenship as currently implemented in the European Union introduces a distinct concept of citizenship that necessitates an adequate normative approach. The objective of this paper is to assess EU Citizenship against the theoretical background of multilateral democracy. This approach is specifically suited for this task, as it does not rely on a nation-state paradigm or the presumption of a further transformation into a federation or union. We propose three criteria by which to assess multilevel citizenship: equal individual rights, equal (...) sovereignty of peoples and the balancing of individuals' and peoples' interests. We argue that the current practice of Union Citizenship does not fully meet the proposed standards, regarding equal rights within and equal access to, the political system. Based on our assessment, we propose reform options of access to national and supranational citizenship and argue for supranational participation rights and equal transnational rights to gradually re-establish full membership for individuals. In the article, some problems of organization attempts of ‘spring campaign‘ to the USSR, which have been conducted by members of ‘first wave‘ monarchist emigration, are studied. A special place is given to the efforts in this trend of monarchist-legitimist members who relied on growth of monarchist sentiments in emigration and inside of USSR. On the example of activities and plans of ‘Union of Russian Royal People‘ named in honor the Grand Duchess Kira Kirillovna in Bulgaria under the leadership of (...) colonel G. I. Dementjev, attempts of search financial resources in USA, involvement into antibolshevik activities emigrant-officers in European countries are attentively examined. Undisputed interest is about project of parachute landing into USSR by aircraft designer I. I. Sikorsky that submitted to legitimist emigrant’s leaders in 1927. There is a brief review of I. I. Sikorsky biography, of his way as a constructor in Russia before the Revolution in 1917 and of period of his emigration in USA when he invented the helicopter in 1939. In conclusion the analysis of failures by organization of military resistance against of Soviet Russia as result of absence of financial resources and the decline of interest by ordinary emigrants to activities of their leaders is given. En una coyuntura difícil como la actual, caracterizada por el auge de las grandes potencias cabe preguntarse por la situación y razón de ser de estas relaciones. Todo parece indicar que, pese a las dificultades, viven un momento de relanzamiento. Las relaciones entre la UE y la ASEAN constituyen uno de los ejemplos más significativos de los esfuerzos acometidos por la Unión Europea para consolidarse como un actor global desde la década de los noventa. This paper aims to take stock of the emerging international literature on the role of labor unions in corporate social responsibility (CSR). Where unions are discussed in the North American CSR literature at all, authors see them as foregrounding membership benefits over wider societal interests and hence contributing to systematic environmental degradation. In Europe, the managerialdiscretion of CSR clashes with the more regulated frameworks for employees and labor unions to influence corporate decision-making. Hence many European unions (...) express a considerable degree of skepticism of CSR. On the international scene, companies have become increasingly sensitive to how their labor management activities are perceived by the wider society, yet they may nevertheless continue with even highly controversial labor policies if they do not see a business case for changing these. In other words, CSR commitments by themselves would not seem to be sufficiently powerful to bring about systematic change in the management of labor. (shrink)

Trade unions in Australia have long played an important role in the enforcement of minimum employment standards. The legislative framework today continues to recognize this enforcement role, but in a way that is more individualistic and legalistic than in the past. At the same time that the law has evolved to emphasize the representation and servicing role of trade unions, the Australian union movement has sought to revitalize and grow through the adoption of an “organizing model” of unionism (...) that emphasizes workplace-level activism. This Article explores how these seemingly opposing trends have manifested themselves in the enforcement-related activities of five trade unions. Considerable diversity was found among the unions in relation to the extent to which and how the unions performed enforcement-related activities. However, all five unions spent significant time and resources on monitoring and enforcing employer compliance with minimum standards and saw this work as a core part of what they do. The case studies suggest, however, that the way in which this work is undertaken within unions and by whom has changed significantly in recent decades. While there was evidence that enforcement work was used tactically by unions in certain cases, this was largely on an ad hoc basis and there was little indication that the enforcement work was integrated into broader organizing objectives and strategies. Overall, the unions were ambivalent, if not skeptical, as to the capacity for enforcement work to grow unions through building workplace activism and collective strength. (shrink)

Today’s low-wage workforce is mostly ignored by the national political parties and largely untouched by organized labor. Over the last twenty years, “community unions” have emerged to try to fill the void. They are modest-sized community-based organizations of low-wage workers that, through a combination of service, advocacy, and organizing, focus on issues of work and wages. Community unions have so far had greater success at raising wages and improving working conditions via public policy rather than direct labor market (...) intervention. The purpose of the article is to analyze the identity policy implemented within the Union State of Belarus and Russia and determine the ways of its improving. Methods and materials: materials include acts of the Union State of Belarus and Russia and materials from Russian and Belarusian media; the methodological basis was laid by general scientific methods (system analysis, ascent from the abstract to the concrete, ascent from the individual to the general, synthesis, comparative method) and special legal and political (...) science scientific methods (formal legal method, method of legal hermeneutics, institutional-functional and system-structural approaches, content analysis method). Results and conclusions: the formation of the Union State of the Republic of Belarus and the Russian Federation is inscribed in a complex multilevel context of international and domestic political processes, which co-determine opportunities and settle limitations for the unification strategies. The authors analyze the international and domestic factors that determine the slow character of the integration process. The authors propose one of the possible integration vectors. This vector assumes implementing a multi-level identity policy, which aims at forming a coherent political community at the heart of the Union State and needs today comprehensive development and legal and institutional support. The authors show that implementing this policy is possible only within the framework of the citizenship development. The article formulates some directions of this policy, which currently have not fully revealed their unifying potential and need further improvement. (shrink)

There is a long-standing and growing interest in democratizing labor unions. Union democracy is important for many reasons, including fostering greater member voice in the workplace and society, improving the internal effectiveness of unions, building members’ capacities to engage in democracy in other contexts, and helping foster union renewal. Despite these benefits, democracy in unions as practiced today is characterized by several problems. In this paper, I analyze several of the remedies to increase union democracy proposed to (...) date by scholars and practitioners, finding that despite their potential positive impacts, many of them may have inherent limitations. I then argue that sortition—the use of lotteries in selecting leaders—shows potential in helping address many of the problems facing union democracy and overcoming the limitations of recent remedies. An important democratic tool in Ancient Athens and other city-states, sortition has a long history in political theory and practice, yet application to unions is in its infancy. I conclude by developing and evaluating several ways in which sortition could be used as a tool in union governance structures, and by discussing the implications of my theorizing for ongoing work on union democracy and union renewal.
