This essay considers the implications for the powers metaphysic of the no-successor problem: As there are no successors in the set of real numbers, one state cannot occur just after another in continuous time without there being a gap between the two. I show how the no-successor problem sets challenges for various accounts of the manifestation of powers. For powers that give rise to a manifestation that is a new state, the challenge of no-successors is similar (...) to that faced on Bertrand Russell's analysis by causal relations. Powers whose manifestation is a processes and powers that manifest through time are challenged differently. To avoid powers appearing enigmatic, these challenges should be addressed, and I point to some possible ways this might be achieved. A prerequisite for addressing these challenges is a careful focus on the nature and timing of the manifesting and manifestation of powers. (shrink)

This study combines author's experiences as an analyst of post-Soviet politics and religious liberty with personal participation in the founding and public acceptance of a new faith in independent Ukraine during a quarter- century. Theattempt here is not only to describe a specific outcome, but to propose factors that offer explanation for why Ukraine is among the few Communist successor states in which new minority faiths have been relatively successful in achieving full toleration [Biddulph: 2016]. Religious liberty has been (...) described as the “first freedom of all freedoms” [Hertzke: 2013, 4], yet it has been noticeably unachieved globally. A 2007 Pew “Global Attitudes Survey” showed that 90% of respondents world-wide said that it was important to live in a country that enabled them to practice religion freely. Yet a more recent Pew “Forum on Global Restrictions on Religion” found that 70% of the world population reside in countries which have high or very high restrictions on religion either from government actions or from major social hostilities [Grim: 2013, 86]. Religious liberty, therefore, is an almost universal human aspiration, but is one of the more unachieved rights in the world. The Soviet Union successor states have a similar record of lower achievement [Lunkin: 2013; Grim: 2013]. (shrink)

Succession of states regains its importance in current geopolitical situation as now we are witnessing a possible new wave of state succession: South Sudan has been accepted to the United Nations, Kosovo’s independence has been recognized by many countries, Palestine has gained new status in the United Nations, etc. This would lead to the necessity to resolve questions related to succession of states, which might, among other subjects, include issues of diplomatic protection which was subject to international legislation – (...) International Law Commission has prepared the Draft Articles on Diplomatic Protection. However, General Assembly is still not ready to adopt this document as a convention, therefore the term to consider possible ways of handling the issues on diplomatic protection within the UN was extended till 2013. Draft articles give the definition of diplomatic protection, indicating the main features of this institute. However, sometimes the difference among the institutes being called the same name with diplomatic protection might cause misunderstandings when analyzing the issue both in general and in the context of succession of states. One of the main prerequisites for diplomatic protection recognized in the jurisprudence of International Court of Justice is the Mavrommatis rule, which indicates that when protecting the citizen’s rights, state in reality is asserting its own right. This rule has been cited in other cases, however, especially now, when individuals already have quite a number of measures to protect their individual rights independently from the actions of state, it has been acknowledged that the rule is fictitious. This recognition, reflected in the Draft Articles and indicated in the commentary of it, is most welcomed as it helps to resolve questions related to the succession of states. There is a need to understand that there is a difference between international obligations under which state is entitled to diplomatic protection and those under which it really asserts its own rights, despite the fact that the latter might also be related to the rights of individuals. This difference is also important in the context of the succession of states, as the consequences arising out of the breach of these obligations in the context of state succession might differ. The last but not least issue addressed in the article is the question of the succession to treaties, which indicate individual rights, but does not form a customary international law. The question is whether the successor state is entitled to diplomatic protection on behalf of its succeeded citizen in a case of a breach of international treaty which was not subject to succession by the successor state. Taking everything into account, there are issues which are not addressed in the Draft Articles on Diplomatic Protection. Herewith there are issues of diplomatic protection which should be addressed in a case of state succession. Nonetheless, it should be reminded that diplomatic protection is always subject to the decision of the state itself, it is just important that newly created states understand and know the possibility to invoke international responsibility of the third state using the means of diplomatic protection, even if the injury was made to its national before the moment of state succession. Using coding devices based on a theorem due to Zsigmondy, Birkhoff and Vandiver, we first define in terms of successor S and coprimeness predicate $\perp$ a full arithmetic over the set of powers of some fixed prime, then we define in the same terms a restriction of the exponentiation. Hence we prove the main result insuring that all arithmetical relations and functions over prime powers and their opposite are $\{S, \perp\}$ -definable over Z. This contribution argues, first, that pre-national forms of state were not displaced or supplanted by a new, national form. What we call the nation-state was not the successor to imperial or city-states but was itself a form of the European imperial city-states that had driven the expansion of capitalism in previous centuries. It argues, second, that national states emerged only after 1945 and only in a handful of states where, through welfare reforms and market and industry regulation, (...) investment and production were made to serve the expansion and integration of national markets. Third, with the dismantling of Keynesian policies in these states, pre-national (pre-Keynesian) structures are resurfacing. What scholars describe as the emergence of ‘post-national spatialities’ and of ‘global cities’ and city regions represents the resurgence of a durable and historically dominant form of state: the imperial city-state form. The ‘re-scaling’ of nation-states and growing prominence of ‘global cities’ and ‘city regions’ are heralding the end of the brief history of actually existing nation-states and the re-deployment of the imperial city-state model. When the Macedonians had conquered Greece, city-states continued to exist along-side the more powerful kingdoms, and were often forced to accommodate their policies to the wishes of the powerful kings who were, in theory, their allies. If kings and cities were to co-operate effectively, there would need to be some way of adapting the authority of royal wishes to the theoretical rights of the cities to self-determination. The contrast between the powers of a king, theoretically all-powerful within his kingdom, and (...) the autonomy of a city did not need to be total. Aristotle, who was acquainted with the Macedonian kingdom, made a clear distinction between kingship and tyranny, between rule by the law and autocracy. The report of a commission set up by Pope Francis to study the question of women as deacons in the Catholic Church was issued in May 2019. Whilst it is well known that the Catholic Church refuses to ordain women, the form of the diaconate being discussed is that of the ‘permanent diaconate’ for men, which was established after the Second Vatican Council. This article first discusses how this issue has arisen, clarifies the types of deacons and reviews the reasons (...) why the Catholic Church refuses to ordain women. It then looks at Scripture and the history of the Church to assess the historical role of women deacons. The issue of women’s ordination emerged after Vatican II. Women’s ministries have grown immensely since then and this is a factor in the question about the ordination of women deacons. There are important theological issues involved in the study around women deacons. Lastly, the article raises questions about the future of this issue under Pope Francis and his successors.Contribution: The issue of the ordination of women deacons in the Roman Catholic Church is a current and contentious issue. This article reviews the historical evidence for women deacons and the views of theologians and Church leaders in order to assess whether there are grounds for hope. (shrink)

If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. "The work of the brain," to cite a recent article in Scientific American, "is to create a model of a possible world rather than to record and transmit to the mind a world that is metaphysically true…Different worlds are presumably constructed by similar species."1 And, presumably, similar worlds are constructed by similar species. Weisinger hints briefly at something like this in his essay "The Mythic Origins of the Creative Process," but one has the clear impression, as his title suggests, that he would like to have the [myth/ritual] cart before the creative horse.2 However much this may satisfy our longing to crown our literature, if not creativity itself, with a mythic genealogy, it seems a wistful hypothesis. We suggest that trade-offs between speed and accuracy in aimed movements support identification of δλ, rather than λ, as a control variable. We take issue with the authors' proposal for resolving redundancy in multi-joint movements, given recent data.

Doctoral programs at U.S. universities play a critical role in the development of human resources both in the United States and abroad. In lieu of an abstract, here is a brief excerpt of the content:Walking the Bodhisattva Path/Walking the Christ PathU.S. Conference of Catholic BishopsCatholics and Buddhists brought together by Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB) met 20-23 March 2003 in the first of an anticipated series of four annual dialogues. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at the (...) City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. It publishes articles on Greek and Latin literature, historiography, philosophy, history of religion, linguistics, reception, and the history of scholarship. The journal aims to contribute to our understanding of Greco-Roman culture and its lasting influence on European civilization. The journal Philologus, conceived as a forum for discussion among different methodological approaches to the study of ancient texts and their reception, publishes original scholarly (...) contributions with a strong international focus. The literature addressing bias and fairness in AI models (fair-AI) is growing at a fast pace, making it difficult for novel researchers and practitioners to have a bird’s-eye view picture of the field. In particular, many policy initiatives, standards, and best practices in fair-AI have been proposed for setting principles, procedures, and knowledge bases to guide and operationalize the management of bias and fairness. The first objective of this paper is to concisely survey the state-of-the-art of fair-AI methods and (...) resources, and the main policies on bias in AI, with the aim of providing such a bird’s-eye guidance for both researchers and practitioners. The second objective of the paper is to contribute to the policy advice and best practices state-of-the-art by leveraging from the results of the NoBIAS research project. We present and discuss a few relevant topics organized around the NoBIAS architecture, which is made up of a Legal Layer, focusing on the European Union context, and a Bias Management Layer, focusing on understanding, mitigating, and accounting for bias. This second collection of studies by Peter Golden continues his explorations of the Türk Empire (mid-sixth to mid-eighth centuries), the stateless polities that appeared after its collapse, and of the Khazar Qaghanate (mid-seventh century to ca. 965-969), its imperial successor state in the western Eurasian steppes. Building on earlier traditions, the Türks created a paradigm for state building in the Eurasian steppes that persisted into the early modern era. Examined here are issues relating to the rise of (...) the Türks and their systems of governance, the institution of slavery and its role in Turkic nomadic societies, and the cultural interactions between the Turkic nomads of Pre-Chinggisid Eurasia and neighbouring settled societies such as the Kievan Rus', Georgia and the Islamic world. Particular studies deal with the hitherto neglected role of Khazars in the Islamic ghulâm (slave soldier) system, the unique traditions of sacral rulership among the Khazars, and their conversion to Judaism set within a larger Eurasian context. The underlying theme of this article is how a successor state should deal with its past. It considers whether a state that is committed to the rule of law may depart from it in order to deal with problems left to it by its predecessor regime. Specifically, may it use retroactive legislation to punish informers who collaborated with a predecessor police state? Lon Fuller's formulation of the canons of the rule of law as an internal morality (...) of law is expounded as well as his notion of legal pathology as symptomatic of departure from the canons' requirements. Various problems inherent to the implementation of the rule of law are examined, such as the effect of the passage of time on reasonable expectations. While legal pathology is always a matter of degree, police states are shown to suffer seriously from it. Among the examples discussed are Nazi Germany and Communist East Germany, though it is granted that there are moral differences between them. In the course of the discussion, a response is made to some contemporary critiques of the rule of law. Although it would be difficult to formulate a retroactive law for punishing informers, it is argued that such a law may be the best way for a successor state to express a moral judgment on its past. Es wird untersucht, ob ein Staat, der sich der Idee des Rechtsstaats verpflichtet fühlt, von dieser Idee abrücken darf, um mit den Problemen umzugehen, die ihm von seinem Vorgänger-Staat hinterlassen worden sind. Insbesondere wird gefragt, ob ein solcher Staat zu dem Mittel rückwirkender Gesetzgebung greifen darf, um Denunzianten zu bestrafen, die mit einem vorangehenden Polizeistaat kollaboriert haben. Lon Fullers Formulierung der Prinzipien eines Rechtsstaats im Sinne einer internen Moralität des Rechts wird ebenso erläutert wie sein Begriff von rechtlicher Pathologie als Symptom für ein Abgehen von den Anforderungen der genannten Prinzipien. Verschiedene Schwierigkeiten, die mit der Verwirklichung des Rechtsstaats entstehen, werden näher untersucht, so etwa die Auswirkungen des Zeitablaufs hinsichtlich vernünftiger Erwartungen . Wenngleich rechtliche Pathologie immer eine Frage des Grades ist, kann doch gezeigt werden, daß Polizeistaaten ernstlich an ihr leiden. Unter den diskutierten Beispielen sind Nazi-Deutschland und das kommunistische Ostdeutschland, obwohl zugegeben werden muß, daß es zwischen diesen moralische Unterschiede gibt. Im Verlauf der Untersuchung wird zudem auf einige gegenwärtige kritische Stellungnahmen zum Rechtsstaat erwidert. Obwohl es schwierig wäre, ein rückwirkendes Gesetz zur Bestrafung von Denunzianten zu formulieren, wird doch die These vertreten, daß ein derartiges Gesetz der beste Weg für einen Nachfolge-Staat sein könnte, ein moralisches Urteil über seine Vergangenheit zum Ausdruck zu bringen.
