Venu du marxisme, dont il a constaté très tôt les impasses, Cornelius Castoriadis a voulu réinventer la révolution. Selon lui, la modernité voit s'affronter deux projets de société : celui d'une maîtrise rationnelle du réel et celui d'une autonomie de toutes et de tous. Le premier a donné des résultats désastreux en engendrant le règne de la technique et de l'économie. Le second reste encore à construire pour qu'advienne une société vraiment démocratique dans laquelle le peuple se gouverne lui-même, se (...) passant de toute classe dirigeante. Castoriadis a mis en lumière les origines de ce projet d'autonomie qui remontent à la Grèce antique. Il en a analysé les expressions modernes, de la révolution russe de 1917 aux révoltes des années 1960. Mais surtout, il en a examiné les conditions pour que se développe une politique émancipatrice aujourd'hui : auto-organisation des luttes, pratique de l'égalité et sens des limites. Ce projet d'autonomie n'est pas un programme clés en main. Il est un imaginaire autant qu'une expérience. Il est un horizon, celui d'une société consciente du fait que le pouvoir est l'affaire de tous. C'est cette réflexion multiforme et souvent complexe que présente et questionne ce livre qui offre pour la première fois une synthèse claire, accessible et percutante de la pensée politique de Castoriadis. The aim of this article is to generate knowledge about parents’ participation in life-and-death decisions concerning their very premature and/or critically ill infants in hospital neonatal units. The question is: what are parents’ attitudes towards their involvement in such decision making? A descriptive study design using in-depth interviews was chosen. During the period 1997-2000, 20 qualitative interviews with 35 parents of 26 children were carried out. Ten of the infants died; 16 were alive at the time of the interview. The (...) comparative method (grounded theory) was used to analyse the data. The analysis was carried out continuously and in parallel with data collection. Six categories were revealed by the analysis: indecision and uncertainty (ambivalence); information and communication; participate, but do not decide; seeming to be included; the parents’ child; and individual consideration. The findings appear to indicate that parents agree that they should not have the final word in decisions concerning their infants’ future life or death. Such a responsibility would put too heavy a burden on parents who lack the medical knowledge and the professional experience needed to make such a decision, and would be likely to lead to them experiencing strong feelings of guilt. The findings show that parents should be well informed and listened to during the whole decision-making process. Their primary concern was how nurses and physicians communicate with parents who are experiencing a crisis, and how this serious information is presented. (shrink)

La foi chrétienne propose une interprétation de la condition humaine selon laquelle le sens de la vie présente est son inscription dans une perspective eschatologique, c'est-à-dire son rapport à une réalité qui est à la fois encore à venir mais qui cependant, en même temps, est déjà présente parmi nous. Cette réalité est annoncée, dans les textes fondateurs de la foi chrétienne, par l'expression " le Royaume de Dieu ". La foi chrétienne se comprend elle-même comme adhésion, dans la pratique (...) qu'elle inspire à la grande œuvre de la construction du Royaume de Dieu. L'existence humaine reçoit ainsi une " destinée ", au sens de " destination ". Par ailleurs, à partir de certaines expériences historiques, comme celles de la géométrie ou de la cité, s'est élaborée une perspective qui s'est définie elle-même par le concept de raison. Cette perspective est de portée eschatologique, en ce sens proprement philosophique qu'elle ouvre sur un horizon indéfini, en lequel s'annonce l'accomplissement de la tâche historique de la construction de la raison. Comment penser le rapport entre ces deux perspectives? Que nous apprend à ce propos l'histoire dont nous héritons? Peut-on se borner à reconnaître que l'on se trouve en présence de deux processus totalement différents et dès lors totalement étrangers l'un à l'autre? Et, d'autre part, si l'on reconnaît que ces perspectives se rencontrent nécessairement, comment penser et vivre cette dualité sans tenter de la ramener à un seul de ses termes? Mais d'abord, comment, pour chacun d'entre eux, se détermine son essence? Les textes recueillis dans le présent volume tentent de rencontrer ces questions, en évoquant d'abord ce qu'est " l'univers de la rationalité ", en exposant ensuite la problématique du rapport entre la destinée selon la foi et la destinée selon la raison, en suggérant enfin une interprétation selon laquelle la destinée de la raison est inscrite dans le 'fait chrétien, et en illustrant cette proposition par l'évocation de problématiques plus particulières, concernant les rapports entre foi, science et philosophie. Since literary historian Robert Bone published his seminal essay ‘Richard Wright and the Chicago Renaissance’ in 1986, scholars have created new cartographies of previously unexplored terrain in American cultural history. The earliest studies focused on literature, but more recently attention has turned to other disciplines, including visual arts. Recent publication of The Muse in Bronzeville: African American Creative Expression in Chicago, 1932–1950 (2011) by Robert Bone and Richard A. Courage promises to decisively broaden scholarly understandings of the scope and significance (...) of Chicago-centred cultural production during the Great Depression and post-war years. Of particular relevance to contemporary studies of new media art is the manner in which then-emergent ideas and practices – centring on racialized subject matter, elite and mass audiences, traditional and new mediums of expression, private vs public sponsorship, and passive vs active reception of art objects – converged to create new paradigms and possibilities for visual artists to reshape consciousness in a period of institutional collapse and change. Chicago’s New Negro artists of the 1930s and 1940s, like their counterparts in 1920s Harlem, sought to reframe perceptions of African American life, to re-present the black subject as something other than an object of contempt or amusement beneath the privileged gaze of the white viewer. Just as these artists sought to revise perceptions of racial reality, examination of the wide range of actual images they created and the mediums and styles they explored revises reductive notions about creative expression in this period, which often portray a mere subordination of art to propaganda and an embrace of representational aesthetics and simplistic narratives in a fruitless detour in the evolution from modernism to postmodernism. On the contrary, Andrew Hemingway notes the range of stylistic experiment and characterizes so-called ‘social art’ as ‘a hybrid and unstable mode [which] had to carry the imperative to be an art equal in formal achievement to both the great art of the past and the modern tradition … [and] to suggest a political orientation without becoming overt revolutionary propaganda’ (2002).New media theorist Oliver Grau observes thatIn many quarters, virtual reality is viewed as a totally new phenomenon… but it did not make its first appearance with the technical invention of computer-aided virtual realities. On the contrary, virtual reality forms part of the core of the relationship of humans to images… grounded in art traditions that have receivedscant attention up to now.(2004)In the midst of another period of change, of transformed and transforming ideas and practices in the arts, we have much to learn from the attempts of Chicago’s New (Media) Negro artists to create ‘art for the people’, to immerse broad audiences in such accessible media as mural painting, photography and graphic arts. Visual cultures are being increasingly discussed in the history of science literature, although relatively very little of that work concerns the nuclear age. In addition, within the discrete yet bourgeoning literature on global nuclear art and culture, Oceania is often overlooked despite its central role in the development of the American, British, and French nuclear weapon capabilities, as well as their associated colonial legacies. This article serves to redress both concerns by examining the visual politics of Maralinga in relation to (...) settler-colonial and Aboriginal experiences, vulnerabilities and presentations. I do so by surveying artworks with a connection to the Australian experience of nuclear colonialism and find that the figure of biological life has been conspicuously left absent from contemporary non-Indigenous Australian depictions of British nuclear testing in Australia. This essay is a contribution to the history of methodological thought. I focus on key methodological criteria for successful experimentation, replication and multiple determinations of empirical evidence. Drawing on reports of experiments with viper venom from the late seventeenth and late eighteenth centuries, as well as on present-day methodological thought I examine whether past experimenters regarded repetition, replication, and multiple determinations as criteria for validity; what exactly they meant by this; what they hoped to gain by repeating, varying, triangulating, and (...) replicating; and how relevant these criteria were for them. I also consider if this analysis has implications for current philosophical work on the methodology of experimental practice. (shrink)

Given a three-valued definition of validity, which choice of three-valued truth tables for the connectives can ensure that the resulting logic coincides exactly with classical logic? We give an answer to this question for the five monotonic consequence relations $st$, $ss$, $tt$, $ss\cap tt$, and $ts$, when the connectives are negation, conjunction, and disjunction. For $ts$ and $ss\cap tt$ the answer is trivial (no scheme works), and for $ss$ and $tt$ it is straightforward (they are the collapsible schemes, in which (...) the middle value acts like one of the classical values). For $st$, the schemes in question are the Boolean normal schemes that are either monotonic or collapsible. (shrink)

Over the past fifty years the philosophy of language and mind has been dominated by a nondescriptivist approach to content and reference. This book attempts to recast and systematize that approach by offering an indexical model in terms of mental files. According to Recanati, we refer through mental files, the function of which is to store information derived through certain types of contextual relation the subject bears to objects in his or her environment. The reference of a file is determined (...) relationally, not satisfactionally, so a file is not to be equated to the body of (mis-)information it contains. Mental files are the mental equivalent of singular terms, and the reference of linguistic expressions is inherited from that of the files we associate with them. On this approach, mental files, the vehicles of singular thought, do all the work of so-called 'modes of presentation' in Fregean and neo-Russellian theories. (shrink)

Désormais, il entend conquérir l'une et s'affranchir de l'autre. Il veut rompre avec le passé, se donner souverainement sa loi, définir ce qui doit être, dominer. Telle est l'ambition vertigineuse que raconte cet ouvrage. Descartes rêvait d'un homme maître et possesseur de la nature ; deux siècles plus tard, Nietzsche allait (...) décréter que l'homme doit être dépassé, n'étant plus à la hauteur des attentes que lui-même avait définies. En Italie dès la Renaissance, en France et en Grande-Bretagne aux XVIIe et XVIIIe siècles, se noue en réalité un discours sur l'art qui souligne son appartenance à l'idée de civilisation, assignant des origines physiques, sociales et passionnelles au goût. What has philosophy to do with the poor? If, as has often been supposed, the poor have no time for philosophy, then why have philosophers always made time for them? Why is the history of philosophy—from Plato to Karl Marx to Jean-Paul Sartre to Pierre Bourdieu—the history of so many figures of the poor: plebes, men of iron, the demos, artisans, common people, proletarians, the masses? Why have philosophers made the shoemaker, in particular, a remarkably ubiquitous presence in this history? (...) Does philosophy itself depend on this thinking about the poor? If so, can it ever refrain from thinking for them? Jacques Rancière’s The Philosopher and His Poor meditates on these questions in close readings of major texts of Western thought in which the poor have played a leading role—sometimes as the objects of philosophical analysis, sometimes as illustrations of philosophical argument. Published in France in 1983 and made available here for the first time in English, this consummate study assesses the consequences for Marx, Sartre, and Bourdieu of Plato’s admonition that workers should do “nothing else” than their own work. It offers innovative readings of these thinkers’ struggles to elaborate a philosophy of the poor. Presenting a left critique of Bourdieu, the terms of which are largely unknown to an English-language readership, The Philosopher and His Poor remains remarkably timely twenty years after its initial publication. The aim of this article is to study the notion of derivability and its semantic counterpart in the context of non-transitive and non-reflexive substructural logics. For this purpose we focus on the study cases of the logics _S__T_ and _T__S_. In this respect, we show that this notion doesn’t coincide, in general, with a nowadays broadly used semantic approach towards metainferential validity: the notion of local validity. Following this, and building on some previous work by Humberstone, we prove that in (...) these systems derivability can be characterized in terms of a notion we call absolute global validity. However, arriving at these results doesn’t lead us to disregard local validity. First, because we discuss the conditions under which local, and also global validity, can be expected to coincide with derivability. Secondly, because we show how taking into account certain families of valuations can be useful to describe derivability for different calculi used to present _S__T_ and _T__S_. (shrink)

In recent years, some theorists have argued that the clogics are not only defined by their inferences, but also by their metainferences. In this sense, logics that coincide in their inferences, but not in their metainferences were considered to be different. In this vein, some metainferential logics have been developed, as logics with metainferences of any level, built as hierarchies over known logics, such as \, and \. What is distinctive of these metainferential logics is that they are mixed, i.e. (...) the standard for the premises and the conclusion is not necessarily the same. However, so far, all of these systems have been presented following a semantical standpoint, in terms of valuations based on the Strong Kleene truth-tables. In this article, we provide sound and complete sequent-calculi for the valid inferences and the invalid inferences of the logics \ and \, and introduce an algorithm that allows obtaining sound and complete sequent-calculi for the global validities and the global invalidities of any metainferential logic of any level. When the ancient Greeks looked up into the heavens, they saw not just sun and moon, stars and planets, but a complete, coherent universe, a model of the Good that could serve as a guide to a better life. How this view of the world came to be, and how we lost it (or turned away from it) on the way to becoming modern, make for a fascinating story, told in a highly accessible manner by Remi Brague in this wide-ranging (...) cultural history. Before the Greeks, people thought human action was required to maintain the order of the universe and so conducted rituals and sacrifices to renew and restore it. But beginning with the Hellenic Age, the universe came to be seen as existing quite apart from human action and possessing, therefore, a kind of wisdom that humanity did not. Wearing his remarkable erudition lightly, Brague traces the many ways this universal wisdom has been interpreted over the centuries, from the time of ancient Egypt to the modern era. Socratic and Muslim philosophers, Christian theologians and Jewish Kabbalists all believed that questions about the workings of the world and the meaning of life were closely intertwined and that an understanding of cosmology was crucial to making sense of human ethics. Exploring the fate of this concept in the modern day, Brague shows how modernity stripped the universe of its sacred and philosophical wisdom, transforming it into an ethically indifferent entity that no longer serves as a model for human morality. Encyclopedic and yet intimate, The Wisdom of the World offers the best sort of history: broad, learned, and completely compelling. Our aim is to provide a sequent calculus whose external consequence relation coincides with the three-valued paracomplete logic `of nonsense' introduced by Dmitry Bochvar and, independently, presented as the weak Kleene logic K3W by Stephen C. Kleene. In the United States, only 6% of the 1.5 million faculty in degree-granting postsecondary institutions is Black. Research shows that, while many institutions tout the idea of diversity recruitment, not much progress has been made to diversify faculty ranks, especially at research-intensive institutions. We're Not Ok shares the experiences of Black faculty to take the reader on a journey, from the obstacles of landing a full-time faculty position through the unique struggles of being a Black educator at a predominantly (...) white institution, along with how these deterrents impact inclusion, retention, and mental health. The book provides practical strategies and recommendations for graduate students, faculty, staff, and administrators, along with changemakers, to make strides in diversity, equity, and inclusion. More than a presentation of statistics and anecdotes, it is the start of a dialogue with the intent of ushering actual change that can benefit Black faculty, their students, and their institutions. Dissenting Words is a lively and engaging collection of interviews that span the length of Jacques Rancière's trajectory, from the critique of Althusserian Marxism and the work on proletarian thinking in the nineteenth century to the more recent reflections on politics and aesthetics. Across these pages, Rancière discusses the figures, concepts and arguments he has introduced to the theoretical landscape over the past forty years, the themes and concerns that have animated his thinking, the positions he has defended and the (...) wide range of objects and discourses that have attracted his attention and through which his thought has unfolded: history, pedagogy, literature, art, cinema. But more than reflecting on the continuities, turns, ruptures and deviations in his thought, Rancière recasts his work in a different discursive register. And the pleasure we experience in reading these interviews – with their asides, displacements and reconstructions – stems from the way Rancière transforms the voice of the thinker commenting on his texts and elucidating his concepts into another, and equally rich, manifestation of his thought. OBJECTIVES: To review the characteristics and performance of research ethics committees in Spain in the evaluation of multicentre clinical trial drug protocols. DESIGN: A prospective study of 100 applications. SETTING: Forty-one committees reviewing clinical trial protocols, involving 50 hospitals in 25 cities. MAIN MEASURES: Protocol-related features, characteristics of research ethics committees and evaluation dynamics. RESULTS: The 100 applications involved 15 protocols (of which 12 were multinational) with 12 drugs. Committees met monthly (except one). They had a mean number of 12 (...) members, requested a mean of six complete dossiers and nine additional copies of the protocol with a mean deadline of 14 days before the meeting. All applications were approved except three (two of the three were open-label long-term safety trials rejected by the same committee), which were approved by the other committees involved. The mean time from submission to approval was 64 days. The mean time from submission to arrival of the approval document at our offices was 85 days. Twenty-five committees raised queries for 38 of the 97 finally approved applications. Impact of evaluation fee, number of members, queries raised and experience of committees on timings were not statistically significant. CONCLUSION: Obtaining ethical approval is time-consuming. There is much diversity in the research ethics committees' performance. A remarkable delay (> 20 days) exists between the decision and the arrival of the written approval, suggesting administrative or organisational problems. (shrink)

In this paper we present two new approaches for dealing with semantic paradoxes and soritical predicates based on fuzzy logic. We show that both of them have conceptual advantages over the more traditional Łukasiewicz approach, and that the second one even avoids standard proofs of ω-nconsistency.

In the context of non-classical logics, many philosophers have been particularly interested in the paraconsistent logics. In addition to traditional definitions, in recent years, new ways of characterizing the notion of paraconsistency have been proposed. In all of these definitions the rule or the meta-rule of explosion is abandoned. In this article, I present those definitions and evaluate the role that the negation and the transitivity play in each of them. Finally, I propose a new definition of paraconsistency which I (...) call total paraconsistency and show that the rule of weakening plays a crucial role in all of the characterizations of such a concept. Plusieurs aspects de la métaphysique, de la physique, de l'éthique et de la psychologie d’Aristote peuvent s'interpréter comme des affleurements d'un concept non-thématisé, celui d'être-dans-le-monde (l'in-der-welt-sein de heidegger). L’ensemble de la pensée grecque classique, même si elle était fascinée par l'ordre du cosmos, ne s'est guère demande ce que signifiait "être-dans-le-monde". L’expérience de la facticité, qui est un des traits fondamentaux de celle-ci, est ce qui permet à Aristote dans le protreptique, de justifier la vie philosophique ; mais il conçoit (...) celle-ci comme culminant dans la contemplation, c'est-à-dire l'accès a ce qui est au plus haut point (ch. 2). Aristote est toujours resté pris dans cette ambiguïté, qui provient de ladite transposition : son éthique révèle ses hésitations entre deux sujets de l'agir moral : le "je" à qui il incombe d'agir de par ce qu'il a d'unique, le cédé a l'homme, tel qu'il est défini par sa place parmi les autres parties de l'univers (ch. 3 & 4). Par suite, il lui faut définir l'homme comme le plus mondain des êtres sublunaires : l'homme imite l'univers grâce à son universalité, et parce qu'il est capable de saisir les réalités les plus élevées (ch. 5). Cependant, Aristote ne peut définir le topos - ce dans quoi sont les choses- sans renvoyer à notre façon particulière d'être-là, même s'il réintroduit ensuite l'idée d'univers grâce à sa théorie des dimensions du corps humain comme fondées dans la structure objective du cosmos (ch. 6). Les difficultés de la définition aristotélicienne de l'âme ainsi que celles de la doctrine de l'intellect agent proviennent de la tentative d'Aristote pour transposer ce qu'il pense implicitement comme l'ouverture même du monde à travers notre présence dans le registre de la réalité mondaine-ce qui l'oblige à réduire l'âme à la conscience de ce qui se produit parmi les choses du monde (ch. 7). Il conçoit celui-ci d'une manière telle qu'elle l'amène à exclure le mouvement spécifiquement humain au profit de la continuité absolue des corps célestes. Cependant, la contemplation de soi du premier moteur reflète l'ambiguïté non résolue de l'energeia humaine : le pur acte d'être-là et l'activité de contempler le plus haut de tous les êtres s'y fondent (ch. 8). Malgré tout, l'energeia comme concept ontologique fondamental ne peut pas se définir en dehors de l'expérience humaine de l'être-là (ch. 9). (shrink)

This book is a sequel to Recanati’s Mental Files (OUP 2012), and pursues the exploration of the mental file framework for thinking about concepts and singular reference. Mental files are based on 'epistemically rewarding' relations to objects in the environment. Standing in such relations to objects puts the subject in a position to gain information regarding them—information which goes into the file based on the relevant relation. Files do not merely store information about objects, however. They refer to them and (...) serve as singular terms in the language of thought, with a relational (nondescriptivist) semantics. Crucially, files also play the role of ‘modes of presentation’. They are used to account for cognitive significance phenomena illustrated by so-called ‘Frege cases’. This book considers what happens to mental files in a dynamic setting. Mental files are construed as both continuants (dynamic files) and as time-slices thereof (static files). Dynamic files are needed to account for confusion, recognition and tracking. The book considers what happens to the relation of coreference de jure, central to the functional characterization of files, when one adopts a dynamic perspective. Only a weak form of coreference de jure is said to hold between stages of the same dynamic file. The second part of the book argues that communication involves interpersonal dynamic files. In the context of non-classical logics, many philosophers have been particularly interested in the paraconsistent logics. In addition to traditional definitions, in recent years, new ways of characterizing the notion of paraconsistency have been proposed. In all of these definitions the rule or the meta-rule of explosion is abandoned. In this article, I present those definitions and evaluate the role that the negation and the transitivity play in each of them. Finally, I propose a new definition of paraconsistency which I (...) call total paraconsistency and show that the rule of weakening plays a crucial role in all of the characterizations of such a concept. In this book, Jacques Rancière explores how political relations develop fundamentally from sensual experience, as individual feelings become the concern of the whole community. Since politics emerges then from the 'division of the sensual', aesthetic experience becomes a radical means for social and political upheaval.

In the literature, Weak Kleene logics are usually taken as three-valued logics. However, Suszko has challenged the main idea of many-valued logic claiming that every logic can be presented in a two-valued fashion. In this paper, we provide two-valued semantics for the Weak Kleene logics and for a number of four-valued subsystems of them. We do the same for the so-called Logics of Nonsense, which are extensions of the Weak Kleene logics with unary operators that allow looking at them as (...) Logics of Formal Inconsistency and Logics of Formal Underterminedness. Our aim with this work, rather than arguing for Suszko’s thesis, is to show that two-valued presentations of these peculiar logics enlighten the non-standard behavior of their logical connectives. More specifically, the two-valued presentations of paraconsistent logics illustrate and clarify the disjunctive flavor of the conjunction, and dually, the two-valued presentations of paracomplete subsystems of Weak Kleene logics reveal the conjunctive flavor of the disjunction. The paper lays the foundations for a duty of sustainable property use based on Kant’s Doctrine of Right. In doing so, it contributes to the project of extending the application of Kant’s philosophy to environmental issues so as to include his legal-political philosophy. After providing some context, focusing in particular on Kant’s property argument, I present and critically evaluate a recent argument for a duty of sustainable property use, put forward by Attila Ataner. Then, I draw on Reinhard Brandt’s and (...) Katrin Flikschuh’s interpretation of Kant’s permissive law in order to develop my own argument. According to my account, the duty of sustainable property use is rooted in Kant’s property argument, it is best construed in terms of interpersonal freedom, and it has a structure resembling that of duties of distributive justice. Unlike Ataner’s, my argument proceeds entirely within the domain of interpersonal freedom; it focuses clearly on the normative sense of usability; it does not overgenerate obligations; and it categorises the duty of sustainable property use within Kant’s taxonomy of duties. It thus constitutes a promising starting point to further investigate the connection between sustainability, Kant’s property argument and its use of a permissive law, and the Universal Principle of Right. Experimental philosophy has blossomed into a variety of philosophical fields including ethics, epistemology, metaphysics and philosophy of language. But there has been very little experimental philosophical research in the domain of philosophical aesthetics. Advances to Experimental Philosophy of Aesthetics introduces this burgeoning research field, presenting it both in its unity and diversity, and determining the nature and methods of an experimental philosophy of aesthetics. Addressing a wide variety of empirical claims that are of interest to philosophers and psychologists, a team (...) of authors from different disciplines tackle traditional and new problems in aesthetics, including the nature of aesthetic properties and norms, the possibility of aesthetic testimony, the role of emotions and moral judgment in art appreciation, the link between art and language, and the role of intuitions in philosophical aesthetics. Interacting with other disciplines such as moral psychology and linguistics, it demonstrates how philosophical aesthetics can integrate empirical methods and discover new ways of approaching core problems. In several papers, I have argued for a theory of distributive justice and considered its implications. This theory includes a principle of responsibility that was endorsed by others within an account of defensive force (self-defense and defense of others). Whitley Kaufman criticizes this account which he refers to as the "distributive justice theory of self-defense" (DJ theory). In this paper, I respond to this criticism. I argue that Kaufman presents the theory inaccurately, that his standard of evaluation of the theory (...) is inadequate and that his claim that the theory should be rejected is unconvincing. J.-C.), qui présente sous un angle nouveau des connaissances déjà anciennes, montre que tout savoir se place sous le signe du tao et que l'interrogation sur le tao est préalable à tout autre. Les différents savoirs sont donc utilisés dans le cadre de cette démonstration, et non comme une fin en soi.

Le projet dont cet ouvrage est l'aboutissement n'a pas été d'établir une théorie du droit, mais d'en rechercher la signification au plus près de la pratique quotidienne des juristes. Chaque fois que l'un d'eux emploie le mot droit, il le fait sans s'expliquer comme s'il s'agissait là d'une chose commune qu'il suffirait de désigner pour être compris. Pourtant, dans sa brièveté même, il renvoie à des contenus divers qui ne font sens qu'à un haut degré d'élaboration. C'est à la recherche (...) de ces significations que l'on a voulu partir, en examinant le réseau complexe de représentations que les juristes mobilisent quand ils parlent de droit. On doute qu'il y ait une essence du droit, intemporelle et transcendante, qui en figerait la définition par-delà les époques et les climats. Mais il y a des constantes que l'on a voulu explorer. Un lieu, qui rend possible le développement d'un système de droit : l'ordre juridique, qui en réunit les conditions institutionnelles. Une matière commune à tous ses énoncés : la norme, règle ou décision, qui est au droit ce que l'atome est à la matière, la cellule au vivant. Enfin, par-delà l'unicité de l'énoncé des normes, il y a la diversité des pratiques d'application, qui en bouleversent la signification sociale et la compréhension. Tout cela permet, par des approches successives, de découvrir la texture du droit et d'examiner le singulier discours que tient l'ordre juridique. En première approximation, on appelle droit tout ce qui circule dans un ordre juridique. Plus profondément, le discours tenu par cet ordre permet à une société de décliner ses valeurs : l'exposé de son fonctionnement de principe doit permettre aux individus de s'y insérer sans la troubler. S'agit-il d'un discours qui dirait la vérité de la collectivité? Pas forcément : par son droit, toute société propose un miroir qui la reflète, mais seulement telle qu'elle se voit. On le constate, certains miroirs se révèlent déformants. Il en va ainsi pour la France, dont le droit présente à la fois un modèle de construction rationnelle et un véritable trompe-l'oeil ménagé par l'Etat, pour égarer sur la régulation véritable de la société. The essence of the moral luck question is whether the responsibility of persons is determined only in light of actions that are within their control or also in light of factors, such as the consequences of their actions, which are beyond their control. Most people seem to have contrasting intuitions regarding this question. On the one hand, there is a common intuition that the responsibility of persons should be judged only in light of what is within their control. On the (...) other hand, there is a strong intuition that the consequences of actions sometimes affect the responsibility of agents even when these consequences depend on factors that are beyond their control. A parallel dilemma is present in the law. Legal rules, particularly criminal law rules and tort rules, often differentiate between agents in light of factors that are beyond their control, and in this sense involve legal luck. Of course, factors beyond the control of persons, including the consequences of their actions, can be significant, with respect to the evaluation of the responsibility of persons for instrumental or epistemic reasons. The question is thus only with respect to the independent significance of factors beyond the control of agents, and particularly the consequences of actions, to the evaluation of the (extent of the) responsibility of agents. Benjamin Zipursky offers an interesting argument in order to support the intuition in favor of moral and legal luck, particularly with regard to consequences, especially the rule according to which the punishment of completed offences is more severe than the punishment of attempts and the rule that tort liability applies only to actions that have caused harm. The aim of this Comment is to evaluate this argument. I will try to consider to what extent Zipursky's explanation merely reiterates the familiar intuition that the normative evaluation of the conduct of persons should be influenced by consequential luck, and to what extent it provides new insights that might appeal also to those who are more forcefully drawn to the contrasting intuition that we should judge people only in light of factors that are within their control. I argue that while Zipursky's suggestions might appeal to those who already share the intuition in favor of (consequential) moral and legal luck, they would not convince those who have doubts regarding moral and legal luck. I contrast this question with the way in which the conclusion of this argument should be implemented with regard to specific clauses – the question of how to interpret (the United States Constitution). A theory of truth is usually demanded to be consistent, but -consistency is less frequently requested. Recently, Yatabe has argued in favour of -inconsistent first-order theories of truth, minimising their odd consequences. In view of this fact, in this paper, we present five arguments against -inconsistent theories of truth. In order to bring out this point, we will focus on two very well-known -inconsistent theories of truth: the classical theory of symmetric truth FS and the non-classical theory of naïve truth (...) based on ᴌukasiewicz infinitely valued logic: PAᴌT. Individuals with idiopathic environmental illness with attribution to electromagnetic fields (IEI-EMF) claim they experience adverse symptoms when exposed to electromagnetic fields (EMFs) from mobile telecommunication devices. However, research has consistently reported no relationship between exposure to EMFs and symptoms in IEI-EMF individuals. The current study investigated whether presence of symptoms in IEI-EMF individuals were associated with a nocebo effect. Data from two previous double-blind provocation studies were re-analyzed based on participants’ judgments as to whether or not they believed a telecommunication (...) base station was “on” or “off.” Experiment 1 examined data in which participants were exposed to EMFs from Global System for Mobile Communication, Universal Mobile Telecommunications System, and sham base station signals. In Experiment 2, participants were exposed to EMFs from Terrestrial Trunked Radio Telecommunications System and sham base station signals. Our measures of subjective well-being indicated IEI-EMF participants consistently reported significantly lower levels of well-being, when they believed the base station was “on” compared to “off.” Interestingly, control participants also reported experiencing more symptoms and greater symptom severity when they too believed the base station was “on” compared to “off.” Thus, a nocebo effect provides a reasonable explanation for the presence of symptoms in IEI-EMF and control participants. The current volume of the Parmenides Series "On Thinking" addresses our deepest and most personal experience of the world, the experience of "the present," from a modern perspective combining physics and philosophy. In this article, the vitality of premature infants will be described and discussed. Vitality was one of the main factors in a grounded theory study in which the aim was to generate knowledge concerning the ethical decision-making processes with which nurses and physicians are faced in a neonatal unit. Which assessments underlie decisions about whether to start, continue or stop medical treatment of very sick premature babies?A descriptive study design, including 120 hours of field observations and 22 qualitative in-depth interviews (...) with doctors and nurses, was chosen. Strauss and Glaser’s comparative method was used to analyse the field observations and interviews.The findings indicate that life-and-death decisions are somewhat ambivalent; experience does not always make them easier. In situations of ambiguity, decisions also seem to be based upon the vitality of the babies concerned. (shrink)

Exploring Practical Knowledge investigates professional practices from a hermeneutic perspective. The book presents, discusses and applies notions such as practical knowledge, practical wisdom, tacit knowledge, and normativity to the professional lifeworld. These contributions focus on both specific practices and more general questions concerning theories and investigations of practice. This volume comes as the result of a cooperation of three research centres: The two Centres for Practical Knowledge in Bodø, Norway and in Södertörn, Sweden, as well as the Research Group Value-Oriented (...) Professionalisation at the University of Applied Sciences in Utrecht, the Netherlands. It offers empirical studies of professionals as well as discussing the underlying theories, approaches and methods of exploring practical knowledge - including the limits to any articulation of these aspects of professional action. In contrast to the objectivist paradigm that otherwise dominates professional studies, each chapter presents central perspectives and possibilities drawing from humanistic and interdiscipkinary research traditions. The book explores professions in a style accessible to scholars and practitioners alike.
