This article clarifies the relationship between profits and principles by distinguishing four alternative perspectives: the win-win perspective in which ethical behaviour generates the highest profits; a licence-to-operate perspective in which a minimum ethical performance is required to receive legitimation from the society; an acceptable profits perspective, in which an acceptable profitability is required to assure the financial continuity; and an integrated perspective. These four perspectives are illustrated by statements from Shell reports and from interviews with managers of a large European (...) retail company. (shrink)

Many journalism organizations have published codes of ethics in recent years. The Association of Newspaper Editors, for example, lists 47 different codes on its website. But an organization of health care journalists felt that none of those codes addressed the unique challenges of covering complex health care topics. The Association of Health Care Journalists (AHCJ) is an independent, non-profit organization dedicated to advancing public understanding of health care issues. Its mission is to improve the quality, accuracy and visibility of (...) health care reporting, writing and editing. AHCJ has written a statement of principles for its 750 members. In it, AHCJ states some of the unique challenges faced by journalists covering health care, and offers suggestions on how to face those challenges. Information is a very important factor in various fields of activity of the contemporary people. In any economic activities as well as in the activities of the economic entity the information is used for decision-making. The information may be economic, legal, scientific and otherwise, but in order to manage economic processes the most important is economic information. The greatest part of this information is provided by accounting both financial and management. In every company as in a separate accounting unit, a (...) lot of economic transactions and events occur over the year, constantly recording the movement of money, the amount of revenue and costs. Periodically, in the activities of enterprises, institutions or organizations it is necessary to summarise all the available economic information and calculate performance results, to show the remains of assets, equity and liabilities. Financial statements of the company in the market economy conditions is the main source of information about the assets, liabilities, capital, profits and cash flows. Accumulated and grouped financial information of companies, institutions, or organizations in the form of financial statements periodically, but not less often than at the end of the financial year, is is presented to all users who are interested in it, since the annual financial accounts must be provided by all companies, enterprises or organisations with legal status. Many Lithuanian authors, dealing with financial statements, note that the current forms used for financial statements do not provide sufficient information to meet the users‘ needs in constant competitive conditions and, therefore, there are a lot of discussions how these statements could be improved. When analysing financial accountability, problematic aspects of assessment of financial statements elements are faced. Both Lithuanian and foreign authors pay little attention to the assessment analysis of financial statement elements, because for businesses both in Lithuania and abroad it is rather complicated to assess properly the elements of the financial statements by assessment methods available in the literature in such a way that they would reflect the state of the company truly and correctly. This time, however, the figures in the financial statements is one of the most important sources of information for economic state assessment of companies, enterprises or organisations and for business management solutions. Accounting professionals and other users, when analysing the financial statements, may form opinions and draw conclusions about the profitability of the core business of the analysed entity, the ability to cover its short-term and long-term liabilities, as well as about long-term and short-term assets, product manufacturing and sales situation and changes during the reporting period, and relying on these data decide on the reliability of the company, development and investment opportunities. Financial statements are the main source of information showing the performance of an enterprise and its financial state. They are need for business management, analysis, internal and external audit, owners and state, investors, society. The set of financial statements is prepared by summarizing the company's financial year data. To prepare accountability, data is pre-accumulated and grouped in accounting records, synthetic and analytical accounting registers according to general principles: continuity, periodicity, permanence, prudence, monetary measure, accumulation, neutrality, relevance of content, importance of (...) information. These accounting principles are followed in the EU countries. According to A. Ivanauskienė, an annual stocktaking must be carried out before the annual financial statements are drawn up [3]. Accounting policy part includes accounting principles and a brief description of accounting methods and rules that are used by the entity in accounting and financial reporting. [2]. Accounting policies are general accounting principles, accounting methods, and rules intended for accounting management, formation and submission of financial accountability" - the definition is provided by A. Ivanauskienė [3]. For more information on accounting policies is written 6 BAS - the explanatory note of the accounting policy part should state that 'financial statements are prepared in accordance with business accounting standards. Other legal acts that have been used for accounting management and financial reporting purposes [1] are also included. At the end of the company's financial year, we have to prepare not only financial statements, but also to analyze it properly. Because only by submitting an annual analysis of financial statements we will be able to evaluate the company's performance and position. We will be able to determine whether the company's performance is profitable, whether by putting together and discussing all the reports, there is a risk for the company's future plans. Problem and Relevance - it is very important that the financial accountability reports would be prepared correctly and would perform their intended purpose. Accurate accumulation and systematization of accounting information allows to account correctly assets, capital, income and expenses. Otherwise, false information will result in distorted analysis results and its users will make wrong decisions. The aim of the work is to analyze the content of financial statements, principles of formation and use of data. Research object - financial accountability. Research objectives: 1. To analyze the essence and importance of financial accountability, to provide a systematic description of financial accountability. 2. To provide a procedure for regulating accountability and how to allocate it. 3. To set requirements for financial reporting. 4. To prove the importance of financial reporting with respect to companies. Research methods - analysis of scientific literature, including the comparison of theoretical statements, methods of generalization, logical and graphical representation. Conclusions: Financial statements should reflect fair information about the financial position and performance of the entity, as well as provide necessary information to internal and external users and disclose relevant information about significant events occurring during the reporting period. Preparation of financial statements is regulated by: Law on Accounting of the Republic of Lithuania, Law on Financial Accountability of the Republic of Lithuania, Consolidated Financial Accountability Compilation of the Republic of Lithuania, International Business Accounting Standards, National Business Accounting Standards, Accounting Policies shaped in the company. The data presented in the annual financial statements shall be prepared in accordance with the general accounting principles. The information received in the reports must be compared to the previous reporting periods and to the performance of other companies. Despite increasing public attention and media coverage of fraud, no solution to this problem has been designed specifically for the not-for-profit sector. This study focuses on charities in England and Wales and examines variables derived from a content analysis of 42 fraud and 42 no-fraud charities' annual reports and financial statements. We use logistic regression to explain and predict fraud in the charity sector. We examine whether a range of governance-type variables are significantly related to the likelihood of fraud (...) in charities. We find that smaller boards, which imply a small cosy environment for governance, are associated with a greater likelihood of fraud, suggesting that larger boards enhance monitoring in the not-for-profit sector. Also, a low or zero-level of grant funding is associated with a greater likelihood of fraud, implying that monitoring by long-term donors is also important in curbing fraud. (shrink)

Good decision-making requires reliable information. In medicine, relevant information comes from clinical trials and other forms of scientific research. In business, one source is in corporate annual financial statements. As for-profit, publicly traded companies whose business is discovering, manufacturing, and marketing drugs, pharmaceutical companies sit at the nexus of these two fields. Determining the safety and efficacy of a pharmaceutical product and determining the profitability of a complex enterprise are similarly difficult tasks: each is fraught with deeply ambiguous information (...) that requires sophisticated judgment to interpret reasonably. This paper develops an inventory and conceptual map of espoused organizational values. We suggest that espoused values are fundamentally different to other value forms as they are collective value statements that need to coexist as a basis for organizational activity and performance. The inventory is built from an analysis of 3112 value items espoused by 554 organizations in the UK and USA in both profit and not-for-profit sectors. We distil these value items into 85 espoused value labels, and (...) these are assessed in terms of their similarity and difference through judgements made by 53 experienced individuals. The resulting conceptual map facilitates the evaluation of values which are espoused at the organizational level, as opposed to aggregations of personal values, an important distinction that is often ignored in the literature. This analysis identifies a number of distinct areas of emphasis occupied by espoused values. In particular, the richness of value labels that relates to broader ethical issues may be aimed at external stakeholder management, but also may have an increasing influence on organizational behaviour as they are embedded into organizational practices. By advancing our understanding of espoused values, through an analysis of those being used in practice, we provide a means by which future research into organizational values and ethical issues can progress. Many of the seemingly bland assertions and bald statements of the eighteenth-century philosopher David Hume contain more than the mind immediately perceives. Author John Valdimir Price contends that an understanding of Hume's writings cannot be separated from an understanding of his life. By examining the works of Hume, Price shows the way in which an ironic way of seeing events and an ironic mode of expression permeated Hume's life and writings. Price examines Hume's irony as it is exhibited in letters (...) to his friends and in his writings concerned with morality, people, philosophy, politics, history, and above all religion. Hume's opinions on life in general are stated in works ranging from the Treatise of Human Nature and the Essays, Moral and Political, through the Enquiry concerning Human Understanding and the Enquiry concerning Principles of Morals, to the Dialogue and Four Dissertations of his maturity. Price feels that Hume's recognition of the ironic in life came about from his perception of the disproportion between human hopes and human accomplishments. The rhetorical consequences of applying reason to a duality in human nature creates the ironic mode. Hume conceived man's opposing tendencies as his willingness to commit himself orally to a concept, a dogma, an idea, or an ideology, and his unwillingness to involve himself in the logical and rhetorical implications of articulating those principles. Hume's use of the ironic mode in his writings provides him with a means of challenging certain dogmatic assumptions common to thought, particularly to traditional religious thought; it acts as a mask for his sceptical intentions, and it is an implied criticism of many ideas. In his political writing, Hume frequently implied that the question under argument was almost too ridiculous to deserve serious treatment. This tactic was effectively employed in the Account of Stewart, in which Hume came to the defense of a friend. In his most profitable venture, the History of England, Hume not only used irony to advantage, but developed a new approach to the writing of history—the use of narrative. He presented history as a series of more or less connected events, not as a series of "right" or "wrong" attitudes. The author believes that Hume's initial religious scepticism, combined with the predominant satiric-ironic mode in the literature of his time, led him to seek irony as a method of self expression. This scepticism, which permeated all of Hume's attitudes toward life, reached its most complete expression in the Dialogues concerning Natural Religion, which accepted reason as its guide, but also accepted experience as its master. In this brilliant essay, Jacques Derrida explores issues of vision, blindness, self-representation, and their relation to drawing, while offering detailed readings of an extraordinary collection of images. Selected by Derrida from the prints and drawings department of the Louvre, the works depict blindness—fictional, historical, and biblical. From Old and New Testament scenes to the myth of Perseus and the Gorgon and the blinding of Polyphemus, Derrida uncovers in these images rich, provocative layers of interpretation. For Derrida drawing is itself blind; (...) as an act rooted in memory and anticipation, drawing necessarily replaces one kind of seeing with another. Ultimately, he explains, the very lines which compose any drawing are themselves never fully visible to the viewer since they exist only in a tenuous state of multiple identities: as marks on a page, as indicators of a contour. Lacking a "pure" identity, the lines of a drawing summon the supplement of the word, of verbal discourse, and, in doing so, obscure the visual experience. Consequently, Derrida demonstrates, the very act of depicting a blind person undertakes multiple enactments and statements of blindness and sight. _Memoirs of the Blind_ is both a sophisticated philosophical argument and a series of detailed readings. In this article we examine the association between corporate social responsibility (CSR) and firm value. This line of research is important since firms continue to invest in CSR even though past studies reveal a limited linkage between financial value and CSR. However, the business case for CSR or “doing good while making a profit,” appears to be advancing within the business ethics literature as a preferred conception of CSR. We conjecture that the greater unification and refinement of both (...) class='Hi'>profit maximization and stakeholder interests through corporate acts, not statements alone, will sustain the financial value of CSR in a less regulated global business environment. We study the triangle of what companies say, what companies do, and firm financial performance. We analyze Fortune 250 firms and find a positive association between what companies do based on KLD Research and Analytics, Inc. (KLD) ratings, and what companies state about ethics in their CSR statements. We then employ regression analysis and find that companies’ socially responsible acts are positively associated with overall firm value and financial performance. Yet we do not find a statistically significant association between what companies say regarding ethics in their CSR statements and their financial outcomes. These results suggest that firm value and financial performance is associated with what companies do and not what they say. Our results seem to be driven by multinational corporations (MNCs) and not by non‐MNCs. This is possibly because MNCs generally operate in a less regulated global business environment that often necessitates strong ethical corporate leadership to further stakeholder interests. Overall, these results help reconcile corporate and stakeholder objectives since evidence of a link between financial performance and doing good sustains global CSR. (shrink)

In the ethics research literature, the multiplicity of normative ethical stances has resulted in much debate but little in the way of consistent policy proposals. There is, by comparison, an extensive literature in positive economics that attempts to resolve value conflicts similar to those faced by business ethicists. In this paper the adoption of (...) positive welfare statements are advocated and the value judgements implicit in economics are used as the starting point. It is argued that there is merit in expressly stating a set of value judgements to demonstrate the intractable nature of finding a social consensus without a positive social welfare function that explicitly weights the values. This paper reviews the arguments surrounding corporate objectives, particularly with regard to ethical considerations and the profit maximisation orthodoxy. This is discussed within the stakeholder‐stockholder narrative. A range of ethical positions in the management strategy literature are analysed and discussed. It is argued that the values underpinning business ethics research can be conceived of via a function of social welfare (including an ethical ‘auctioneering’ model). The paper concludes by suggesting that all ethical positions can be captured by a Bergson‐type welfare function. (shrink)

This article explores the motives underlying corporate responses to the COVID-19 pandemic. The analysis begins with Thomas Dunfee’s Statement of Minimum Moral Obligation, which specifies, more precisely than any other contribution to the business ethics canon, the level of corporate beneficence required during a pandemic. The analysis then turns to Milton Friedman’s neoliberal understanding of human nature, critically contrasting it with the notion of stoic virtue that informs the works of Adam Smith. Friedman contends that beneficence should play no (...) role in corporate settings. Smith, by contrast, emphasizes the need for prudence, beneficence and self-command in all human endeavours. The article then uses these competing frameworks to reflect on a published survey of 145 corporate responses to COVID-19. In many of these responses, the benefit to a non-financial stakeholder is clear, while the financial consequence to the firm remains nebulous. This supports the contention that during a pandemic, beneficence provides a more complete explanation of many corporate actions than the profit motive alone. The article contests Friedman’s Chicago School profit imperative and goes beyond Dunfee’s SMMO by endorsing the more full-throated embrace of beneficence and stoic virtue found in the works of Smith. The debate concerning truth in Classical Chinese philosophy has for the most part avoided the possibility that pluralist theories of truth were part of the classical philosophical framework. I argue that the Eastern Han philosopher Wang Chong (c. 25-100 CE) can be profitably read as endorsing a kind of pluralism about truth grounded in the concept of shi 實 , or “actuality”. In my exploration of this view, I explain how it offers a different account of the truth of moral (...) and non-moral statements, while still retaining the univocality of the concept of truth (that is, that the concept amounts to more than the expression of a disjunction of various truth properties), by connecting shi with normative and descriptive facts about how humans appraise statements. In addition to providing insight into pluralist views of truth in early China, the unique pluralist view implicit in Wang’s work can help solve problems with contemporary pluralist theories of truth.  . This study surveyed investors to determine the extent to which they preferred ethical behavior to profits and their interest in having information about corporate ethical behavior reported in the corporate annual report. First, investors were asked to determine what penalties should be assessed against employees who engage in profitable, but unethical, behavior. Second, investors were asked about their interest in using the annual report to disclose the ethical performance of the corporation and company officials. Finally, investors were asked if they (...) felt that ethics reports should be audited.The survey results indicate that many shareholders (42%) do not expect a high level of ethical behavior from corporate employees or officers. There is a significant amount of interest in disclosure of ethical issues (72%) and unwillingness to trust management to provide unbiased reports of ethical behavior. If such reports are included with the financial statements, 32 percent of the investors surveyed would prefer to have them audited to provide independent verification. (shrink)

The issue of communicated accountability is particularly important in Faith-Based Charity Organisations as the donated funds and use of those funds are often meant to fulfil religious obligations for the well-being of society. Integrating Stewart’s (1984) ladder of accountability with the Statement of Recommended Practice guidance for charities, this paper examines communicated accountability practices of Muslim and Christian Charity Organisations in England and Wales. Our content analysis results indicate communicated accountability to be generally limited, focusing on providing basic descriptive (...) information rather than judgement-based information. Our interviews with trustees and preparers of Trustee Annual Reports in Muslim Charity Organisations identified the reasons being due to high donor trust and consequently weak demand by stakeholders for the latter type of information, as well as internal organisational issues related to the organisational structure and culture, lack of internal professional expertise and high accountability cost. The basic purpose of this study is to analyze the impact of intellectual capital on corporate financial performance. This study is conducted on pharmaceutical sector listed in Pakistan Stock Exchange. Data for this study was collected from audited annual financial statements of selected business organizations over period of ten year i.e. from 2005-2014. Value Added Intellectual Coefficient methodology is employed, in order to measure IC and its different components. The firm’s financial performance is measured by using profitability measures including ROE (...) and ROA, market to book value and asset turnover. In order to analyze the collected data, the Partial Least Square, a SEM technique. These approaches are used to assess the measurement and structural models. The results of analysis have supported the proposed hypothesis i.e. there is significant positive impact of intellectual capital on firm’s financial performance among pharmaceutical industries of Pakistan. Sophists’ apologia. -/- Sophists were the first paid teachers ever. These ancient Greek enlighteners taught wisdom. Protagoras, Antiphon, Prodicus, Hippias, Lykophron are most famous ones. Sophists views and concerns made a unified encyclopedic system aimed at teaching common wisdom, virtue, management and public speaking. Of the contemporary “enlighters”, Deil Carnegy’s educational work seems to be the most similar to sophism. Sophists were the first intellectuals – their trade was to sell knowledge. They introduced a new type of teacher-student relationship – (...) the mutually beneficial communication on equal terms. They taught pupils how to think independently and how to persuade others, which was inseparably connected with the rise of democracy in the most advanced Greek polices. Sophists were the first to proclaim that all people are naturally equal. They put forward the idea of natural rights and social contract, working out the fundamentals of the present-day law. In addition, they developed the basics of philology, psychology, logic, and gave a scientific explanation to the origins of religions. They embodied definite positive ideals of their epoch. Sophistry flourished in the second half of the Vth through he first third of the IVth centuries B. C. The period coincides with the heyday of the entire Greek history – the so called Greek Miracle epoch. Sophists expressed some present-day concepts of Ancient Greek ideology and mentality, characteristic of its Golden Age times. The Ancient Athens of the times of Periclus were similar to the Florence of Renaissance as to the type of social structure. That is why (?) the art of eloquence (public speaking) was highly respected in Florence. The two cities had a lot of features of the present-day capitalist society, which was due to their role as the main centres of industry of their “worlds-economies”. During the subsequent Hellenic period, the Old Order was restored, based on the feudal rent recipients’ rule. The degradation of society resulted in the decline of sophistry. Sophistry represents the highest point in the evolution of Greek philosophy. It is also the most prominent school as to the novelty of its ideas. That was owing to the common propensity for innovation typical of Periclus’ Golden Age, which in its turn resulted from the establishment of the individualistic and rationalistic thinking similar to present-day mentality. Among other aspects, close attention was paid to ethnic issues; some humanistic ideas such as Master and Servant ethics and Enlightment as the primary condition of man’s freedom, received scientific grounding. The genre of philosophical dialogue was developed, as well as the rationalistic scientific gnoceology, aimed at consistently opposing any religion. Dialectics, the most outstanding achievement of the Antiquity, was also worked out by the sophists. Zeno of Helleas was one of the sophists. Democrites’ ideas were, too, quite close to dialectics. Socrates’ contemporaries regarded him ironically, as shown, for example, in the Aristophanes’ comedy “Clouds”. Nevertheless, this scholar can still be referred to as a sophist, although of somewhat weird personality. Socrates’ popularity, which came later, should be attributed to the fact that he was the first philosopher ever to have been sentenced and executed by law, rather than to any valuable scientific contributions. Sophistry as such, rather than Socrates, marks the line between pre-Socratic and post- Socratic schools. Plato, with the exception of his latest works, is considered to belong to the same philosophical school. Specifically, there are valid reasons to believe that he was paid fees by his disciples. In Plato’s Dialogues, all points of view will be proven and then disproved, so that an integral philosophical system is hard to observe. Plato’s “Idealism” is but one of the many possible theories. His ideal philosophy is a high-minded argument of wise men. As late as towards the end of his life, Plato betrayed the ideals of sophistry, turning into the world’s first proponent of totalitarianism. Sophistry is Greek classical literature. Later on, philosophy, as well as the entire Greek civilization, started to fall into decline. Over 500 subsequent years, Hellenistic-Roman scholars never came up with anything novel. The entire process of antique philosophical evolution can be subdivided into the following six stages: Phoenician (IX–VIIth centuries B. C.), archaic (VIth – the first half of IVth century B. C., classic (the epoch of sophistry: the second half of the Vth through the first decades of the IIIrd centuries B. C.), late antique (middle of the IIIrd – first decades of the VI th centuries B.C.) The fact that early in the VIth century B. C. sophistry was rejected in Athens, has a lot to do with the consequences of their defeat in Peloponnesian war, a social catastrophe. Ever since, the prevalent part of the criticism of sophistry is a criticism of sophists’ immoral ways of life and personalities, rather than the essentials of their philosophy. For instance, Aristotle’s criticism primarily concerns their pragmatism and tendency to make a profit out of teaching. However, Aristotle himself taught his disciples along similar lines, showing them how to “be able to prove both opposites”. It was Aristotle who summed up sophists’ century-long elaborations. The traditional modern interpretation of sophists as shown in Plato’s dialogues appears to be groundless. The truth of the matter is that Plato regards sophists as more serious philosophers than Socrates was. It becomes especially clear in the dialogue titled “Protagoras”, which shows the latter as gaining an undoubted victory over Socrates. Generally speaking, Plato’s works never regard sophists as weak or worthless opponents. A common opinion as to the essence of sophists’, in particular, Protagoras’s philosophy, has hitherto not been worked out. Many researchers renounce the very existence of any specific philosophical position in sophistry. The term “relativism” itself now has a bad name. However, it should be borne in mind that Protagoras doctrine emerged as a result of an attempt to get out of the ontological dead-end to which the entire Greek natural philosophy had come. To this purpose, he employed Anaxagoras’s idea about everything comprising everything, whereupon he built his physical-ontological theory, and Zeno of Helleas’s concept that all objects are such and different at the same time in the same respect. According to Protagoras’s philosophy, every object does not only seem, but is different from every other object, including human beings. Therefore, every person is his or her own measure of all other entities. The objective reality is the Ego’s relations with the outer world. Every object’s essence is defined through its interaction with ourselves. Nothing remains stagnant – every existence already contains non-existence, and vice-versa. However, the relativity of being is not to be regarded as absolute. That means, that relatively stable and therefore relatively cognizable entities do exist, among them the words we say. Doubt is not considered absolute by relativists either, which differentiates them from skeptics and agnostics. They dare to believe. Uncertainty is Godly – here, Protagoras becomes very close to the concept of apathetic theology. Gorgius shared Protagoras’s views and tried to prove them applying the same method as Zeno applied when upholding Parmenidis’s philosophy. He argued that if one accepts the opposite point of view and agrees that nothing can exist and not exist at the same time, one is bound to come to an the absurd conclusion that nothing is cognizable and nothing exists. To prove that there is a universal contradiction within the Existence itself, Protagoras and his followers in their turn put forward a number of special logical arguments, called rules of contraries, or sophisms. The most well-known of them is the Euathle’s sophism, which proves that an object can be such and different at the same time in the same respect. Generally speaking, all relationships of any entity are extraneous. The idea that all entities, including concepts, exist and do not exist at the same time, was also accepted by Plato. It should be stressed, that Plato’s philosophy as a whole is relativists’ greatest achievement. In his dispute against relativism, Aristotle put forward the main concepts of his ontology: the existence falls into the existence in possibility and the existence in reality, or substance and accidence – the ever changing “sublunary” world and the stable world of divine heavenly bodies. This division made his system self-contradictory to the point of absurd. Aristotle quite realized, that the direct disproof of relativism is hardly possible, which fact makes his criticism a mere tautology. It is very indicative in this respect that materialists, idealists and even skeptical agnostics applied the same arguments do disprove relativism. That demonstrates that the inner contradiction between any forms of “absolutism” and relativism is the most fundamental philosophical problem. Relativist ideas were repeatedly renewed throughout history, provided the social conditions were favourable. In variations, the concepts were advanced by Tzuan Tsi and ancient Chinese sophists, apostle Paul, Nicolas of Cusa, Galileo, Rene Descartes, G. Berkley, D. Hume, Ch. S. Pierce, E. Mach, A. Bogdanov, F. de Saussure, N. Bore, P. Feuerabend, U. Quain and others. However, no consistent relativist ontological system was developed after Protagoras. Meanwhile, a valid relativist theory could provide a clue to a fuller and more adequate general physical concept of the world, and to a deeper understanding of quantum mechanics. -/- Relativism as an ontological system of beliefs. -/- The relativist principle of relativity of all that exists is fundamental for the entire system of philosophy. Absolutely everything exists, but, at the same time, no existence is absolute. Anything is possible, but those entities only exist for us with which we interact this way or another, i. e., reality is interaction, “I interact – hence, I exist”. However, an overly close relationship between entities leads to non-existence – in other words, there is a certain existential optimum. For all of us, information, or perceptible heterogeneities, is real. Each of us is the center of a definite system of interactions with the world. If God is an endless Possibility, then the World is but the man’s dialogue with God. However, the ties that bind us with the world are of some definite kind, which predetermines our reality. The principle of relativity constrains itself, as any relativity is relative. On the one hand, that calls forth the Evil – caused by our own weakness. On the other hand, it makes our world relatively stable and cognizable. Generally speaking, the world is what we are. Everybody has an own Universe, but since people are fairly similar, our universes can be regarded as one Universe with common laws and regulations. It is possible for us to change the degree of objects’ existence in relation to ourselves and one another. It is equally important, though, to remain ourselves (keep following our “warrior’s path”). Since everything exists and no existence is absolute, the process of cognition should involve a criticism of everything but never a complete rebuttal of anything. The criterion of verity for any theory then is in its capacity to build itself upon a bigger number of diverse statements than in any other theory. Theoretically, all philosophies should ideally be complementary. The question of what in fact happened is meaningless unless we specify the “we”, the “where” and the “when”. The past can only exist as part of the present. When we change, our past undergoes corresponding qualitative objective changes, all of which are irreversible. The contemporary physics regards all objects of the Universe as existing for one another, which results in absurd conclusions. In fact, only what we interact with, exists. The so called “speed of light in vacuum” c is the maximum speed of direct interaction and direct exchange of signals. Specifically, at the oncoming speed c with a significant blue parallax the gamma-quantum is unable to interact with the matter. When this speed is reached, the gravitational mass of objects in relation to one another becomes equal to zero (imaginary), whereas their inertial mass equals infinity. Further acceleration will bring us into an entirely different Universe. That means that the Universe is an open system, which fact destroys all present-day cosmological models. Anything is possible in this world. Our reality is magic. Every bit of space contains a potentially limitless number of bits of other, however virtual, universes, as well as an infinite number of particles, which are still virtual for us (as postulated by quantum mechanics). In other words, there exists an infinity of different realities. With all the above in mind, the different levels of entities’ existence, in particular, of Life and Reason, should be taken into consideration. For example, to which extent a live system exists in relation to the inanimate forms of being is very indefinite, as what life is has to be determined by living creatures. An even greater compass of levels of existence can be brought about through interaction – that is the core idea of Godel’s theorem. As a result, the range of forms of existence tends towards infinity – the evolution of matter through super-intelligence will bring us up to God’s heights. A more generalized mathematical model of the physical world, including a universal operator of the co-existence of objects, can be developed based on the above considerations. The bonds between objects become weaker owing to 1) a high speed, 2) acceleration, 3) rotation, 4) strong gravity, 5) strong fields of other kinds, 6) the difference of levels of existence , 7) phase shifts. Yet, there always is an existential optimum. Such mathematical model is to operate certain non-transitive algebras. Relativist ontology assumes that the notion of “temperature” is relative, thus making it possible to ignore the Second Law of Thermodynamics. In its turn, that will allow for phase shifts. A perpetual motion machine of the second type will become a reality. Rotation could presumably be used to increase inertial and decrease gravitational mass, slowing down the time. An experimental research could shed light on the mentioned effects. (shrink)

Taking as its starting-point the interest in archaeological metaphors evinced by Freud and by Jung, this paper considers the project of analytical psychology under the rubric of the recently discussed term, ‘philosophical archaeology’. Noting the shared methodological assumptions and procedures between these two areas, the paper goes on to examine the extent to which Jung’s project can legitimately be considered as an archaeological pursuit in respect of two key aspects: its humanism, and its hermeneutics. In this second case, the paper (...) concludes, we can learn much from Jung’s recently published Red Book, sections of which may be profitably read through the lens of his seminal paper, ‘The Aims of Psychotherapy’. What emerges from this discussion is a clearer appreciation of the role of the archaic in Jung’s thought, an insight into the analytic consulting-room (as a place of the archetypal) as a third instance of the site of philosophical archaeology in addition to the archive (as a place of statement or l’énoncé) and the museum (as a place of expression), and a confirmation of Heidegger’s assertion that ‘the authenticity and greatness of historical knowledge reside in an understanding of the mysterious character of the beginning’. This paper examines the philosophical basis for the argument that there is a connection between ethical behavior and profitability. Both sides of this argument – that good ethics is good business and that bad ethics is bad business – are explored. The possibility of a moral floor above which ethical behavior is not rewarded is considered, and an economic experiment testing such a proposition is discussed. Johnson & Johnson suffers a potentially devastating blow when some cyanide-laced Tylenol capsules cause several (...) deaths. Johnson & Johnson voluntarily pulls Tylenol off the shelf, to universal acclaim. When Tylenol is returned to the marketplace, its share of the over-the-counter painkiller market becomes greater than it was before the tragedy. Arthur Andersen, the venerable accounting firm, is caught in the web surrounding the downfall of Enron, Inc. As Enron’s various sins are discovered, it is found that Arthur Andersen auditors had signed off on flawed audits and had shredded documents to cover themselves. Andersen is prosecuted for, and convicted of, obstructing justice (although the conviction is later overturned). Today the firm barely exists and has no resemblance to the Big Five accounting giant of 1999. These stories seem to indicate that ethical (or unethical) behavior leads to positive (or negative) financial results. But the philosophical arguments underpinning such statements are seldom subjected to proper analysis. They are perhaps wishful thinking, or perhaps based on examples such as the above without considering other examples that may reinforce a contrary position. This paper will explore the philosophical arguments and empirical evidence regarding these statements and state some research questions for exploration in this area. In particular we will propose the possibility that a moral floor exists above which firms that engage in ethical activities will not reap rewards, but below which firms that engage in unethical activities will be punished by actors in the economic marketplace. We will discuss an economic experiment to determine if such actors indeed form a moral floor. (shrink)

Since the nineteenth century students of historiography have found in his narrative and methodological statements the principles by which Greeks of the fifth century BCE collected, recorded, and arranged material for their accounts of the ancient world. When the Federal Communications Commission considered revamping its policies, many political activists argued that media conglomerates had failed to meet their duties to protect freedom of speech. Moveon's dispute with CBS over its proposed Superbowl advertisement and Michael Moore's quarrel over distribution of his documentary, Fahrenheit 911, are cases in point. In matters of pure entertainment, the public expect companies to avoid offensive programming. The press, on the other hand, may well be forced to offend some audience members in order (...) to create a viable forum for political dissent. As journalism and entertainment are increasingly inter-linked, an in depth moral analysis of the media corporation and its obligations becomes increasingly important. I explore Kantian, Utilitarian, and Rawlsian analyses of corporate obligation in the aforementioned cases. I then examine whether or not these results suggest anything more generally about the sorts of mission statements and ethical policies that ought to be endorsed by media conglomerates and whether non-business institutions also require changes. Ultimately, I suggest that at a minimum, media institutions should view the duty to promote the representation of diverse views in a democracy as an imperfect moral and civic duty rather than making programming decisions solely by reference to profit. Ideally, greater access to media access should not be increased for the most powerful unless doing so at the same time increases free speech opportunities for those who currently have the least access. Citizenship and marriage are legal statuses that generate numerous privileges and responsibilities. Legal doctrine and argument have analogized these statuses in passing: consider, for example, Ted Olson’s statement in the Hollingsworth v. Perry oral argument that denying the label “marriage” to gay unions “is like you were to say you can vote, you can travel, but you may not be a citizen.” However, the parallel between citizenship and marriage has rarely been investigated in depth. This paper investigates the marriage-citizenship (...) parallel with a particular focus on three questions prompted by recent developments in law and policy: -/- 1) Should we provide second-best statuses? Some couples — in particular gay and lesbian couples — have been offered permanent statuses, like civil unions, that bear legal privileges but fall short of full marriage equality. In contrast, similar differentiations within citizenship are generally resisted. The history of citizenship may presage the increasing unacceptability of differentiations within status in the gay marriage context. Meanwhile, the history of marriage equality efforts may help present-day citizenship advocates choose legal strategies. -/- 2) Should statuses be a gateway to rights? Some early gay rights advocates unsuccessfully argued that advocates should challenge the primacy of marriage, rather than seek access to the institution. Advocates attempting to expand the rights of current noncitizens face similar choices: should they seek to give current noncitizens greater access to citizenship, or challenge the reservation of important rights to citizens? -/- 3) Can status relationships be plural? Many critics of dual and multiple citizenship argued that allegiance to multiple states was immoral, unadministrable, or both. More recently, polygamous marriage has become a topic of legal and political discourse, first as a foil in anti-gay marriage arguments and later as a political possibility in its own right. I consider whether polygamous marriage advocates can profitably draw on arguments for multiple citizenship, and how multiple-citizenship advocates should responsibly respond to the analogy with polygamy. As a rapidly growing emerging capital market, China has attracted the attention of both investors and scholars. To alleviate the expectation of external users of listed companies’ financial statements to “discount” items in levels 2 and 3 of the fair value measurement, listed companies will treat these items as conditional conservatism. It refers to the conservatism of companies when confirming bad news of unrealized gains and losses sooner than confirming good news. A sample was selected for empirical analysis to verify (...) the existence of this relationship. The results are as follows: the higher the proportion of levels 2 and 3 fair value measurements, the stronger the conditional conservatism of the company’s profit and loss; the higher the proportion of cash holding of operating activities in a company’s operating profit and the higher the audit quality, the higher the proportion of levels 2 and 3 fair value hierarchy measurements, and the stronger the conditional conservatism of the company’s profit and loss; and the lesser the internal control defects in a company, the higher the proportion of levels 2 and 3 fair value hierarchy measurements, and the stronger the conditional conservatism of its profit and loss. The findings provide empirical evidence to identify listed companies adopting conditional conservatism to alleviate discounting expectations of fair value items of financial statements’ external users and provide a reference for improving the standards and regulation of listed companies. It is a thankless task to have to reply to Professor Murray Krieger’s “Retrospective.” Qui s’excuse, s’accuse, and since I cannot ask my readers to embark on their own retrospective of my writings and test them for consistency, I have little chance of restoring my reputation in their eyes. Hence I would have been happier to leave Professor Krieger to his agonizing, if he did not present himself the “spokesman” for a significant body of theorists who appear to have acclaimed (...) my book on Art and Illusion without ever having read it. The followers of this school of criticism—of which Professor Krieger is a prominent member—had apparently convinced themselves that the book lent support to an aesthetics in which the notions of reality and of nature had no place. They thought that I had subverted the old idea of mimesis and that all that remained were different systems of conventional signs which were made to stand for an unknowable reality. True, professor Krieger admits that I never endorsed such an interpretation of my views, and he even concedes that there are passages in Art and Illusion which contradict such an out-and-out relativism, but he wants to convince his readers that these contradictions lead precisely to the ambiguities he now proposes to analyse.If he were right that the book encourages such a misreading, all I could do would be to express my regrets for having failed to make myself sufficiently clear. Luckily I can draw comfort from the fact that unlike these literary critics, the leading archaeologist of this country, Professor Stuart Piggott, had no difficulty at all in discerning my meaning and profiting from my arguments. In his Walter Neurath Memorial Lecture of 1978, entitled Antiquity Depicted: Aspects of Archaeological Illustration, the author did me the honour of taking a statement from my book as his starting point. I can’t sleep till I devour you / And I’ll love you, if you let me… Marilyn Manson “Devour” The role of poetry in the relationalities between people has a long history—from epic poetry recounting tales of yore; to emotive lyric poetry; to (...) rude, irreverent limericks; to Hallmark cards which have ditties that allow one to cringe, and somehow fall in love at the same moment. Without going into a notion of aesthetics, or attempting to choose which form of poetry is superior, we might want to consider why the form of poetry itself has long been a part of relationality. And whilst doing so, we might always keep in mind that poetry—especially poetry that moves, transports us—is the form that Plato has been warning us about, particularly if we want to become good citizens.As Avital Ronell teaches us in Stupidity : the poet, irremediably split between exaltation and vulgarity, between the autonomy that produces the concept within intuition and the foolish earthly being, functions as a contaminant for philosophy—a being who at least since Plato, has been trying to read and master an eviction notice served by philosophy. The poet as genius continues to threaten and fascinate, menacing the philosopher with the beyond of knowledge. Philosophy cringes (287). And considering that the philosopher is the lover of wisdom, we might begin to ask ourselves why one lover is warning against another—if the philosopher is in love with wisdom, then is the poet perhaps his rival, his challenger, for that very love? For, one must also remember that Plato—through Socrates—mentions constantly that Homer is his favourite. Moreover, by adopting both his own voice, whilst mixing it with Socrates’, Plato is adopting the form of poetry that he warns most about—the warning almost serves more as a homage to poetry than anything else. Here, we might open the register that one of the main reasons that he ejects a particular kind of poet is on the grounds of effecting effeminacy on the populace—good poetry moves you, affects you, transports you, shifts you beyond reason, puts you “out of your mind.” However, Plato also teaches us that rhetoric in its highest form requires divine inspiration by way of the daemon, or the muse. This moment of divine intervention is one that seizes—perhaps even ceases—you; putting you “beyond yourself.” In other words, a good rhetorician must always already be open to the possibility of otherness—the same otherness that possibly resides in the feminine. One could also trace this back to the poet that he both loved, and feared, most—Homer. Perhaps the effect of effeminacy that Homer's poetry opened is precisely the source of its power: through listening to Homer, one's body, one’s habitus is opened to the possibility of the feminine. And here, one must remember that the source of all learning—and all teaching—also lies in mimesis, in repetition, in habit. Once the habitus is opened to the possibility of invasion, of intervention, of otherness, there is quite possibly no possibility of distinguishing whether the mimesis is that of reproduction, or if there is always already a productive aspect to it. And by extension, if learning cannot be controlled, the very notion of teaching itself is shifted from a master-student relationality to one where the master is potentially changed as well—the relationality between the master and the student is not only inter-changing, but one cannot even know who is teaching, or learning, at any point. All that can be said is that they are in a relationality; which means that one is ultimately unable to locate the locus of knowledge, of wisdom—the site of which Plato is attempting to convince us is the sole domain of the philosopher. And it is this that philosophy is cringing from. To compound matters, philosophy is striving for wisdom; which can only come from the Gods. In other words, this is a gift that has to be bestowed on them—and more than that, wisdom is always already exterior to one’s control and knowledge. At best, it is the role of one to recognise the gift, to answer the call as it were. Here, if we listen carefully, we can hear the echo of Alexander Graham Bell, and the telephone. And as we are attempting to respond to the call of wisdom—the call that both poetry and philosophy are listening out for—it might be helpful to recall the agreement between Alexander Graham Bell and his brother Melville. Bruce notes that Aleck and Melly made a “solemn compact that whichever of us should die first would endeavour to communication with the other if it were possible to do so” (63). Since Melville was the one who passed on first, this pact put the onus on Aleck to receive the call of his brother. If you take into consideration the fact that until Melville’s death, both brothers had been working on an early prototype of the telephone, the instrument of distant sound can be read as an attempt by Aleck to maintain the possibility of keeping in touch with Melly, of hearing the voice from beyond. However, this was a connection that was not premised on any knowing, reason, or rationality; it was rather, one that was based on hope, and born out of love. And here, if we eves-drop on a cross-line with The Telephone Book , we can pick up the voice of Avital Ronell once again and hear, “the connection to the other is a reading—not an interpretation, assimilation, or even a hermeneutic understanding, but a reading” (380). In other words, the telephone can be read as the openness to the possibility of responding to the other; one that might always remain unknown. Even in this day of caller-identification, we can never know for sure who the other person on the line is until we pick up: hence, the only decision we can make—the effects of which we remain blind to until it affects us—is to either pick up or not, to either respond or not. And it is not as if the decision to pick up comes without risks: each time we answer a call, we run the risk of it ruining our day. Even when we don’t know who the caller is, perhaps especially when we don’t know who the person on the other end of the line is—and here one only has to think of prank calls—we are leaving ourselves completely open to being affected by another. Thus, philosophy finds itself in the position of Vladimir and Estragon. Since they have no idea who Godot is, they can never know if or when he shows up—thus, if he (and we are taking his gender on the word of the boy, some boy—we don’t even know if it is the same boy—who comes round in the evening) has already come, they would not be in the position to know it. And even if someone comes to them and announces that “I am Godot,” the wait would not be over—without referentiality to the name, they would have to take on faith that that person is indeed Godot. Hence, all they can know is that they are waiting for Godot; and Godot is the name of that waiting itself. All philosophy can know is that it is waiting; and wisdom is the name of that waiting itself. Which brings us to Tina Turner’s eternal question, “what’s love got to do, got to do with it?” In order to begin to consider that, we have to first attempt to examine the notion of love itself. Perhaps we might begin to consider what the difficulty of the statement “I love you.” For, if love is a relationality between two persons—both of whom remain singular, and are attempting to respond to each other—this suggests that neither of them subsume the other under themselves. In other words, the other remains wholly other. If this is so, then the “you” in the statement always remains shrouded in mystery. And even if the “you” was replaced with the name of the person, the veiling remains: for, names refer both to the singularity that is the person, and also every other person bearing that name, at exactly the same time. To compound matters, the only time one has to utter a persons name is in their absence—thus, the correspondence of a name to that particular person is at best an affect of memory. And if we consider the notion of memory, we have to also open the register of forgetting—bringing along with it the problem that there is no object to forgetting. For instance, when one utters “I forgot,” all one is uttering is the fact that one has forgotten, and nothing more—the moment there is an object to the statement, one has strictly speaking remembered what one has forgotten. Moreover, we have no control over when forgetting happens to us. And since it is always already exterior to us, affects us, and has no necessary object, there is no reason to believe that every moment of memory might not bring with it a moment of forgetting. Hence, whenever we utter a name—even if we accept the correspondence between the utterance and the person in front of us—all we are doing is uttering the fact that we are naming. Thus, it is not so much that ‘a rose by any other name would smell as sweet’ but more appropriately, ‘a rose is a rose is a rose’—the relationality between its name and the phenomenon of its sweet smell can only be established after that moment of naming, that instance of catachresis. So, whenever one utters “I love you,” not only is it a performative statement, it is the very naming of that love—all you are doing is establishing a relationality between you and the other. And since there is no necessary referent—one is naming that referentiality as one utters it—this suggests that it is always already a symbolic statement; without which the mystery of the other cannot me maintained. In other words, one cannot love the other without maintaining this symbolic distance—through a ritual; in this case the utterance “I love you.” This might be why Valentine’s Day seems to provoke such a massive reaction: the most common one from people (besides florists) being, Valentine’s Day is mere commercialism. Those among the nay-sayers who maintain a soft spot for Karl Marx would proceed to call it the commodification of relationships; those who prefer the Gods would claim that the sanctity of relationships has been profaned; the gender theorists would note how the fact that males buy the gifts only serves to highlight the unequal power-relation between the genders. Whichever side and variation of the arguments they choose boils down to this: the discomfort lies in the fact that they are confronted with the notion of relationships moving into a mediated sphere. The underlying logic is that love is between two persons only; it should not only remain between them, but more pertinently, be an unmediated experience between two persons. Which of course completely misses the point. For, if we reopen the register that relationships are the result of a negotiation between two persons, there must then be a space between them for this very negotiation to occur. Otherwise, all that is happening is, one person is subsuming the other within their own sphere of understanding; effectively effacing the other. If that were the case, there would no longer be any relationality; all negotiation is gone and the other person is a mere extension of the self—one is in a masturbatory relationality with one’s imaginary. Hence, any relationship must always already carry with it the unknown, and possibly always unknowable. The other person is an enigma, remains—must remain—enigmatic to you. This is the only way in which the proclamation “I love you” remains singular, remains a love that is about the person as a singular person—and not merely about the qualities of the person, what the person is. For, if the mystery of the other is unveiled, then the love for the other person is also a completely transparent love: one that you can know thoroughly, calculate; a check-list. And if they are knowable, this suggests that they can also be negated, and hence, the love can also go away. Only when the love for the other person is an enigmatic one, one that cannot be understood, can that love potentially be an event—and if it is an event, then strictly speaking, it cannot be known before it happens; at best, it can be glimpsed as it is happening, or perhaps even only realised retrospectively. At the point in which it happens, it is a love that comes from elsewhere: this strange phenomenon is best captured in the colloquial phrase, I was struck by love;” or even more so by, “I was blinded by love.” This is a blinding to not only the subject of the encounter—the self—but also of the very object of that encounter, the “you”—all that can be said is that there is an encounter. And it is for this reason Cupid is blind: not just because love is random (and can happen to anyone at any time), but more importantly because even after it happens, both the reason you are in love, and the person you are in love with, remain blind to you. Since there is an unknowable relationality with the other person, the only way you can approach it is through a ritual. This is the lesson that religions have taught us: since one is never able to phenomenally experience the God(s), one has no choice but to approach them symbolically. These rituals are strictly speaking meaningless—the actual content is interchangeable—as it is the form that is important. Rituals allow us momentary glimpses at secrets; and secrets are never about their content(s). Rather, secrets entail the recognition that they are secrets; the secret lies in their form as secret. This can be seen when we consider how group secrets work: since the entire group knows the secret, clearly the content of the secret is not as important as the fact that only members within the group are privy to this secret. Occasionally the actual content can be so trivial that even other people outside the group might know the information; they just do not realize its significance. For instance, if I used my date of birth as my bank-account password, merely knowing when I was born would not instantly give you the key to my life savings. In order for that to happen, you would have had to recognise the significance of the knowledge of my birthday. This means that you have to know that you know something. Since the God(s) are, strictly speaking, unknowable, this suggests that rituals put one in a position to potentially experience the God(s). The meaningless gestures on Valentine’s Day play precisely this ritualised role. It is not so much what you give the other person, but the fact that you give it to them. The gift in this sense is very much akin to an offering; the gift opens the possibility of an exchange. Gift-giving does not guarantee that you will like what is returned; there is always a reciprocation of the gift, but what is returned to you is never known in advance, until the moment it is received. This means that the worst thing that one can do is not give the gift: that would be akin to a cutting off of all possibilities, a complete closing of all communication with the other person. This at the same time also means that you cannot wait for the other person to give you something before you get them their gift: if that were the scenario, the reciprocal gift would be nothing more than a calculated return. The only manner in which both persons can give true gifts is to offer them independently of the other person, whilst keeping them in mind. In this way, the two gifts are always already both uncalculated (in the sense of not knowing what the return is) and also a reciprocation for the other (without knowing whether the other person actually has a gift in the first place). Naturally, this would seem like an irrational, even stupid, way of buying gifts. But it is precisely the stupidity involved that saves the relationship from being banal—more importantly, stupidity prevents it from entering the mere profane. This is not to say that an enigmatic love cannot end—of course it can. However, the difference lies in the fact that if the relationality is wholly transparent, it is subsumed under reason—completely predictable, within the self, and thus never open to the possibility of otherness, exteriority, musing. A love that is an event is one that is also open to the possibility of the divine, the sacred—always already closer to the possibility of wisdom. If we establish that both love and wisdom are exterior, to our knowledge, and the finitude to our selves, this suggests that both are names for the possibility of openness to otherness. In other words, and what choice do we have here but to use the words of the other, the philosopher—the lover of wisdom—is a name for one who is waiting, and nothing more. But that still leaves us with the question of this uncomfortable relationality between philosophy and poetry. But before we address that question, we have to take a momentary detour, and consider the whether it is possible to call one a poet. For, if we take the notion of a poet to be one who reaches the highest levels of rhetoric (beyond the lawyer, and the orator, who only aim to either please the crowds, or convince by way of sophistry), then we must also acknowledge that one can only become a poet at the moment of seizing, the point of inspiration, by the muses. Without this divine moment, all (s)he can do is practice her craft. As no one can control when the muses make their appearance, one could always be practising in vain—in some way, one is always already practising to be least in the way when the muse whispers into one’s ear; one is practising so as not to be vain. And since one cannot know when the muse will appear, there is no time frame to the practising—unlike the lawyer who speaks against a clock, poetry knows no time; the only time that matters is the time appropriate to poetry itself. Thus, all the poet (if one can use this term) is practising for the possibility of effacing her/him self—and waiting. Thus, in order for poetry to occur, in order to be seized, the poet—along with all her concerns—must cease. In other words, there is no poet; there is only the possibility of poetry. However, even as there is no time frame to this waiting, even as all we can say is that poetry is a name for waiting, the one who is practising is always already also in time. And since (s)he is in a symbolic relationality with the possibility of poetry, this suggests that the practising is her sacrifice, and time is precisely what she is sacrificing. Here, it might be helpful to turn to a strange source when it comes to poetry—Georges Bataille—and consider his teachings in the first volume of The Accursed Share where he reminds us that, the “essence [of sacrifice] is to consume profitlessly .” This is where each exchange is beyond rationality, beyond calculability, beyond reason itself, “unsubordinated to the ‘real’ order and occupied only with the present.” He continues: Sacrifice destroys that which it consecrates. It does not have to destroy as fire does; only the tie that connected the offering to the world of profitable activity is severed, but this separation has the sense of a definitive consumption; the consecrated offering cannot be restored to the real order.” (58) Since there is no need for a physical change in the object of sacrifice—“it does not have to destroy as fire does”—this suggests that the tie is severed symbolically. Hence, there is an aspect of trans-substantiation in this sacrifice: the form remains the same; in fact there is no perceivable change—this is the point at which all phenomenology fails—but there is always already a difference, an absolute separation from the “real order,” from logic, calculability, reason. The object of sacrifice, the victim [,] is a surplus taken from the mass of useful wealth…Once chosen, he is the accursed share , destined for violent consumption. But the curse tears him away from the order of things…” (59). And it is this tearing away from the order of things—the order of rationality—that “restores to the sacred world that which servile use has degraded, rendered profane” (55). For, only when it is no longer useful, when it is no longer abstracted—subjected, subsumed under—merely a use-value, can the object be an object as such, can a subject be a subject as such; be a singularity. Thus, it is never so much who or what is sacrificed, but the fact that there is a sacrifice. So even as (s)he is sacrificing her time to poetry, it is always already beyond her knowledge whether what (s)he is doing is actually preparing her for poetry or not—all (s)he can know is that she is sacrificing and nothing more. Hence, all (s)he can do is to open her self to the possibility of this relationality—all (s)he can do is be in love with poetry. At the moment the muse whispers into her ear, (s)he ceases to be, and becomes a medium for poetry—and since this possession is always already beyond our cognitive knowledge, this is also a moment of divine wisdom. In other words, there is no difference between poetry and wisdom—the moment of poetry is the moment of wisdom. And this might be the very reason for the philosopher’s aversion to poets. Not so much because they may corrupt the youth (this is after all the aim of all thinking, all philosophy), but precisely because in order to do so, the philosopher must wait for a moment of possession, for divine musing, for poetry. FREY Can economic activity be virtuous? Can the pursuit of commerce and profits be moral? Both Hume and Adam Smith are agreed that Britain will live or die as a trading nation, and trade requires the harvesting or production of goods with which to trade. This in turn requires that people be motivated (...) to harvest or to produce these goods, and neither Hume nor Smith give any evidence of believing that people are motivated by a general love of mankind, an extensive sympathy, or a broadly-encompassing benevolence to produce them. Indeed, quite the opposite appears to be the case: both writers think the pursuit of luxury, wealth, and the general riches of life have much more to do with the harvesting and production of goods for trade than does any widespread, general concern for the well-being of others. And this fact leads straightforwardly to the question I want to consider, namely, whether this kind of what I shall call economic motivation is compatible with moral motivation.1 In Smith, our question can be seen as leading to what is sometimes called the "Adam Smith problem" (which on another occasion I should want to argue is a pseudo-problem). The Theory of Moral Sentiments gives an account of moral motivation in which sympathy and/or benevolence plays an integral role, whereas in The Wealth of Nations self-love is very much to the fore. But to most of us this clearly will not do; the whole point is that we do want to ask ethical questions about economic activity. That is, in pursuing their trades, it must be possible for the butcher, brewer, and baker to be acting morally; otherwise, commerce and virtue will be incompatible, and in enjoining us to take up and to pursue the former vigorously Hume and Smith would be advocating immorality. I am interested here in Hume and in one possible way of construing his remarks on self-love in An Enquiry Concerning the Principles of Morals.3 But first a few words on Mandeville are necessary, since it is he who sets the terms of the debate over the compatibility of moral and economic motivation. In The Fable of the Bees,4 Mandeville praises vice (or the pursuit of selfinterest ) in the cause of national prosperity and castigates virtue as threatening to undermine prosperity. Employing an egoistic account of man's passions and motivation, he argues that individual pursuit of self-interest or vice produces public benefits. Pride, avarice, and the pursuit of enjoyment, luxury, and the fine things of life create economic activity, jobs, and economic and social opportunities, and these in turn benefit society. Instead he puts the finger on the one trait that sets this piece of rationalism (or anti-rationalism, as some would say) apart from all others: not sentiment verging on the mystical, but egocentrism, existentially founded and unique. Rousseau, taking a stand (...) outside the battling parties, outside his own religion, becomes more and more "une existence solitaire en face d'une autre existence, qui le regarde," that "other existence" which he calls God. Alas, the descent from such existential heights is swift. Soon the solitary thinker will be enmeshed again in unsolitary speculations about those very issues he had left behind in his flight into the self. Where will this strange pilgrim's progress end? In 1769, seven years before his death and feeling the cold breath of old age upon him, Jean-Jacques wrote: "In my childhood I believed by authority, in my youth by feeling, in my mature age by reason; now I believe because I have always believed." Burgelin cites this as proof that Rousseau never ceased to believe. Maybe so. But is this the point? What the passage defines is the pilgrim's irreversible religious itinerary. On cannot but ask what the next inevitable stop on the road would have been. Waiting for Godot? "Whoever makes an effort to find in Rousseau's work an explicit philosophy... runs into a very peculiar difficulty, for a philosophy is defined above all by its coherence, and [Rousseau] himself warns us against his own methods." With these words Pierre Burgelin opened his monumental work, La philosophic de l'existence de ].-]. Rousseau (1952). It is in the several pertinent chapters of this earlier work that the reader will find what the present book withholds: a philosophical analysis as rigorous as it is profound and comprehensive, the best analysis we have to Rousseau's religious thought. While the new Pldiade edition of Rousseau, a model of contemporary French scholarship, makes its slow, stately way towards completion, the well-known yellow Classiques Garnier keep coming out in new editions or simply in new dress. This 12mile is a handsomely produced, very readable BOOK REVIEWS 259 reissue of the 1939 Garnier edition, with reproductions of eighteenthcentury engravings on themes of Rousseau. They add rich period flavor to this strange work in which a hypermodern intelligence talks the language of three centuries ago. There are useful notes, the detailed subject index is exceptionally well laid out, the spacious bibliography is ample for Rousseau 's sources and influence, but its meager twentieth-century section should have been reworked and brought up to date. The Introduction, too, can still be read with much profit, even though its critical standpoint is now antiquated, eloquent proof of the effectiveness of Rousseau scholarship in the last two decades. For its price this is a very handy, serviceable edition to have until the Biblioth~que de la PMiade catches up with Garnier Fr~res. Emory University GREGOR SEBBA Kant's Theory o[ Knowledge. By Graham Bird. (New York: The Humanities Press, 1962. Pp. x + 210. ~5.50.) In the Preface the author states that he has two main objectives in his book: To pursue one central argument through the Critique of Pure Reason and to discuss Kant's views in terms of a modern philosophical idiom. Bird follows this programme out through most of the book, departing from it on only one occasion, in Chapter 11 (pp. 181-188) in which he discusses and criticizes Strawson's theory of personality (as presented in his book Individuals, chap. 3). This article examines how Reformed scholasticism can be relevant for systematic theology today. ‘Reformed Scholasticism’ denotes the academic practice in which the doctrines of the Reformation are expounded, explained, and defended. It is primarily a method and attitude in search of the truth, based on a careful reading of Scripture, drawing on patristic and medieval traditions, and interacting with philosophy and other academic disciplines. In addition to these methodological features, important contributions on various doctrinal topics can be discovered. The doctrine (...) of God has a foundational role in the sense that God is the primary subject of the other topics. Reformed scholastic theology not only examines God’s inner essence, but also the concrete relation and operation of God toward his world. In a Trinitarian understanding of God’s essence, a distinction is maintained between God’s immanent relatedness as three divine Persons, and his outward relation to created reality. The doctrines of creation and providence gave occasion for Reformed scholastics to engage in debates with the emerging natural sciences, and also articulated important theological insights concerning the involvement of God in creaturely affairs. In Christology, the Reformed orthodox maintained the classic doctrine of the two natures of Jesus Christ, against Socinians and other opponents. These ontological statements are the necessary conditions for a proper understanding of the salvation by Christ. While the doctrinal positions of Reformed scholastic theology cannot be automatically transmitted to contemporary discussions, we can profit from this tradition on several levels of method and content. The practice of corporate social responsibility has often been described as a balance of profitability and social or societal responsibility by scholars as well as practitioners. It is assumed that regulations and guidelines of CSR practices link competitiveness and responsibility together. While recognising that formal CSR statements represent a goal-oriented managerial approach to CSR, we argue based on the description of a qualitative case study that the relationship between profitability and social or societal responsibility is not as clear and simple (...) as it is often described. Instead, CSR should be considered as a continuously negotiated process between companies and stakeholders. Hence, the creation of a constructive link between profitability and social or societal responsibility is dependent on the amount of effort that has been put into exploring the concerns of the stakeholders, vis-a-vis the company, while simultaneously accepting changes when they are necessary. This is a paper about ‘human rights pluralism’, and about how human rights’ inherent flexibility can be embraced by development policy-makers and practitioners in ways that can aid the goals of both development and human rights. The paper argues that, even though human rights are often expressed in legal terms – terms that are usually associated with the rigidity of obligation – human rights are inherently pluralistic. This is for two reasons. First, upon closer inspection, human rights laws, and especially (...) international human rights laws, far from imposing rigidity, reflect substantial elasticity as regards their statement, interpretation and implementation. And second, in any case, it is and always has been a mistake not to consider human rights laws within the unavoidably influential philosophical, cultural and economic contexts in which they operate. The political, in other words, is both a necessary and desirable dimension of the legal expression of human rights. Drawing upon this conceptual basis, the paper identifies six specific ‘grammatical features’ of human rights and describes how and why they might be profitably employed by development specialists. Ethical workplace climate has been extensively researched in the for-profit context but neglected in nonprofits. Perhaps because nonprofits promote shared values, engage with people, and implement development interventions creating public good, they are considered implicitly ethical. This assumption has been questioned in recent studies. We attempted to develop a psychometrically valid scale measuring ethical workplace climate following a sequential research design to fill this gap. We interviewed 74 employees from 30 nonprofit organizations using the critical incident technique to generate (...) statements on ethical workplace climate. The statements generated were categorized with expert judges' help, followed by a survey of 507 nonprofit employees across India. The exploratory factor analysis (EFA) and subsequent confirmatory factor analysis (CFA) resulted in a 43-item scale, further reduced to 26 items using stepwise regression. Results of subsequent application of EFA and CFA confirmed a four-factor solution: self-interest, collegiality, internal legitimacy, and stewardship. A follow-up study of 243 members of nonprofit organizations confirmed the hypothesized relationships that ethical work climate has a significant effect on affective commitment and job engagement. Finally, we discussed our findings along theoretical contributions, implications, limitations, and future direction. (shrink)

This article focuses on the analysis of the main positions of the Constitutional Court of the Republic of Lithuania in the cases of intellectual property law. In the article three judgments and the positions of the Constitutional Court extracted therefrom are analysed. The Constitutional Court has formed several important positions with reference to intellectual property law regarding usage of property protection norms for the protection of intellectual property, requirements of application of compensation as an alternative to damages compensation and the (...) calculation of criterions thereof as well as functional legal protection of trademarks. It should be noted that Article 23(1) of the Constitution of the Republic of Lithuania has extended protection to property and, as the Constitutional Court of the Republic of Lithuania has noted, the constitutional protection of property covers not only the protection of tangible, but also of intellectual property. In the same judgment, the Constitutional Court stated another important intellectual property related rule, namely that constitutionally established property protection rights have to be implemented regardless of whether a corresponding international treaty has not been ratified, as protection of authors’ rights is granted under Articles 23 and 42(3) of the Constitution of the Republic of Lithuania. However, the second position stating that the rights of foreign subjects are to be implemented even though a corresponding international treaty has not been signed is to be criticised as by coming to such a conclusion the Constitutional Court has ignored the otherwise generally recognised principle of territoriality of intellectual property rights. In two other cases the Constitutional Court has made important statements relevant to intellectual property law. First of all, the Court stated that compensation instead of claiming actual damages is constitutional. By analysing the positions formulated by the Court, an indirect conclusion can be made to the effect that compensation instead of claiming actual damages is necessary in order to ensure effective protection of intellectual property rights. In other words, the purposes of compensation can be recognised: restoring (compensating) the infringed interests of the injured party; simplifying judicial proceedings, whereby faster proceedings (litigation) and easier substantiation is sought; and the preventive purpose (strong preventive effect). However, the Court’s argument regarding the criterion of compensation calculation, saying that the damages incurred by the intellectual property rights owner depend on the sale value of the product concerned is criticisable, as it is rarely the case that the licence fee or profit acquired in the result of unauthorised use of intellectual property objects is calculated with reference to the final sale price of the product. Notwithstanding the arguably weak argument of the Court, the Court’s position regarding the criterion of final sale price itself does not preclude the possibility of reaching a fair final decision. This is particularly significant since the influence of the economic world‐view reaches into every realm of social thought. Although overtly grounded in utilitarianism, the basis of neo‐classical thought has undergone two shifts of meaning which have converted the original self‐evident utilitarian presuppositions into an ideology.The first of these alters the utilitarian proposition that ‘we seek satisfaction’ into (...) the statement that ‘we only seek satisfaction’. It follows that human action is motivated by nothing other than selfishness and greed, and that altruism therefore cannot exist: anything that looks like altruism is therefore nothing other than egoism in disguise, and there is no place for ethical reasoning in individual choice.The second shift alters the premise that our goal is ‘maximum satisfaction’ to the assertion that what we seek is ‘maximum monetary gain’. Nor can ‘optimum social welfare’ be translated into ‘optimum welfare for all’ in an economic world‐view which sees wealth and poverty as the ‘just deserts’ of hard work and laziness respectively.The dominant economic theory is thus explicitly immoral in that it enshrines the absolute sovereignity of the individual and the law of the jungle as social norms. In lieu of an abstract, here is a brief excerpt of the content:One Parable, Two Interpretations:Pope Francis and William Langland on the Good Samaritan*Sheryl OvermyerInterpretations of the parable of the Good Samaritan (Luke 10:25–37) focus on its theology, ethics, ecclesiology, and even moral psychology. The parable has much to say regarding holiness. It treats how to become holy and distinct acts of holiness, the exemplar of holiness, and the reality and effects of sin. In the history of interpretation, the parable (...) is taken to offer a model of the relationship between the fallen man and grace, the devil and the garment of virtue, the law and love, Christ and the Church. In short, the parable allegorizes salvation history.1I focus conversation about this parable through two interpretations-Pope Francis's Fratelli Tutti [FT], promulgated October 3, 2020, and William Langland's Piers Plowman [PP] circulating circa 1380. Some might hold that Francis's interpretation of the parable is ethical while Langland's is theological.2 Both interpretations of the parable are works of moral theology that intimate distinct understandings of what it means to embody [End Page 541] the Gospel and answer the universal call to holiness. In this essay, I outline the parable of the Good Samaritan as treated in Fratelli Tutti and Piers Plowman (first section), compare the major figures of the parable (second section), and compare their visions of charity (third section). In sum, I argue the encyclical sidelines crucial elements in the medieval figuration of the parable. Pope Francis elides critical issues of sin, agency, Christology, and the Church traditionally associated with this parable—all center on the Samaritan as Christ.Two Interpretations in OutlineFratelli Tutti's Parable of the Good SamaritanPope Francis's third encyclical, Fratelli Tutti, is unique in its genre. The encyclical includes all brothers and sisters in its scope of fraternity and social friendship and is addressed to all (§1). The inspiration for the encyclical includes St. Francis's visit to the Sultan some eight hundred years ago and the 2019 Document on Human Fraternity for World Peace and Living Together, a statement signed by Pope Francis and Sheikh Ahmed el-Tayeb, Grand Imam of Al-Azhar. Indeed, the joint document plays a critical role in the encyclical, sharing a common framework of a doctrine of creation and doctrine of God (FT §5). Because Pope Francis includes all of humanity in the audience of this encyclical and its sources of inspiration are broadly humanitarian, it is fair to raise a question about distinctively Catholic elements to the encyclical.The encyclical chapter devoted to the parable of the Good Samaritan (chapter 2 [§§56–86], treating Luke 10:25–37) intensifies these theological questions. Just as the encyclical is "addressed to all people of good will, regardless of religious convictions," likewise the parable is of universal relevance as it "is one that any of us can relate to and find challenging" (§56). Francis's interpretation of the parable encapsulates Fratelli Tutti's themes.The subject of the parable is, according to Pope Francis, the age-old problem of neighborly love (§57).3 The parable involves several figures: the wounded man lying on the wayside, the robbers, the passers-by, and the Samaritan.4 The wounded are the subject of the encyclical's first chapter. Roderick Chisholm is a seminal figure in contemporary analytical metaphysics, epistemology, and philosophy of mind. The current healthy state of metaphysics and epistemology is in no small measure due to his influence and positive example. Chisholm has defended realism in metaphysics, foundationalism in epistemology, and the primacy of intentionality in the philosophy of mind. Throughout his long career at Brown, Chisholm was absorbed in the technical philosophical problems internal to this program. For example, his Socratic quests for the required definitions (...) are deservedly legendary. Still, this book is Chisholm's first attempt to provide a systematic exposition of his philosophical views, and it may be regarded as the definitive statement of the mature Chisholmian weltanschauung. The book is characterized by the virtues we have come to expect from this master of analytical philosophy: erudition, clarity, ingenuity, subtlety, technical virtuosity, and great depth. It covers a very large range of topics, in a small number of pages, in a style that is notably laconic. Such a book can be profitably read by those who are not advanced students of philosophy, but can be fully appreciated only by the most philosophically sophisticated. Because these boundaries are hard to be distinguished the critical position intellectually reasonable seems to be that of examining if is not more socially profitable and morally justifiable to be tolerant rather than intolerant.Developing possible arguments for and against the universal value of tolerance, critical discourse imposes a very meaningful statement: to uphold our humanity, even the demand for our right to intolerance must be done within the framework and with the means of tolerance.
