A world faced with global climate change needs actionable ways to curb its effects. We suggest that Ubuntu philosophy is a way to achieve peaceful coexistence between humans and the ecosystem. From an African perspective, we use Ubuntu philosophy’s concepts to understand how humans can create environmental policies and environmental education pedagogy. We use historical ecology and document review to explore the connections between humans, ecology and Ubuntu philosophy. An understanding of how philosophy and ecology relate is proposed to fill (...) the gap in the cosmological premise between the African person and ecology. The study first sets out a relational model of humans and the ecosystem, then applies the ecology of education to environmental policy formulation. The research demonstrates that humanness with humaneness and collectivism, afro-eco-communitarianism, Ubuntu consensus politics, and Ubuntugogy are concepts underlying how the essence of Ubuntu philosophy can inform an eco-friendly society. The ethno-philo-cological underpinnings help conceptualize these concepts of community. Finally, the study’s conclusion shows how the concepts of Ubuntu philosophy suggest ways to improve environmental education and policy formulation. The formulation and implementation of policies addressing the need to adapt to climate change can be difficult due to the long-term, uncertain nature of localised climate change impacts and associated vulnerabilities. Difficulties are intensified because policy interventions can involve high costs, foregone opportunity and changes to people's way of life. Factors such as these can spur an uncritical, or reflexive, negativity regarding efforts to address the projected impacts of climate change. Such reflexive negativity is often trivialised in pejorative (...) terms, such as 'Nimbyism'. However, stakeholder reluctance to accept the need for adaptation planning may be strongly influenced by self-perceptions that are resistant to change. People's sense of self and sense of place may contribute to an 'imaginative intangibility' with respect to climate adaptation, blocking thoughtful reflection and deliberation regarding alternative approaches and providing rationales for cheating the system once implemented. If acknowledged and addressed in a sensitive manner, it may be possible to manage these self-perceptions to elevate public discourse about climate change and help create situationally appropriate adaptation policy regimes. In industrialized democracies, contractionist social welfare policies have transformed healthcare systems. This has led to reallocations of long‐term care work that have perpetuated gender inequities. The appropriated work of female family caregivers substitutes for paid nursing work, and the household is the primary site for long‐term care delivery. In this article, central premises of critical social theory are used to analyse current long‐term care policy and to explicate how research facilitated the development of mixed economies of care. Problematic consequences (...) of home caregiving are revealed through a depiction of contemporary Canadian families, a critique of the related empirical research literature, and a discussion of the assumptions that underlie long‐term care policies. The article concludes with suggestions which nurse researchers could use to contribute to the reformulation of policies to render them just and equitable. (shrink)

New York City has extensive public health regulations. Some regulations aim to reduce smoking, and they include high cigarette taxes and bans on smoking in public places such as bars, restaurants, public beaches, and public parks. Other regulations aim to combat obesity. They include regulations requiring display of calorie information on some restaurant menus and the elimination of transfats in much public cooking. One important issue is whether New York City officials -- including both public health officials and other city (...) officials -- have adequately explained the justification to the public. Explanation has practical importance; the public might not back controversial and restrictive regulations unless offered a good rationale. But explanation is also an official duty, since public officials should make their reasoning transparent to their constituents. This article argues that New York City has not adequately communicated the rationales for its regulations to the public. It then offers several suggestions for improving public communication. After laying out those suggestions, this article points out that even if communication were improved, New York City’s regulations would still raise difficult philosophical issues. This paper suggests that most of the FTSE-listed firms in the United Kingdom use corporate environmental policy statements to communicate their strategic intent of what environmental and social targets to attain, and broad guidelines of how they will progressively achieve all the required changes and new developments. In this paper, we link the contents of CEPS of a sample of FTSE-listed firms to the voluntary participation in the environmental benchmarking exercise and the various levels of environmental performance therein. The (...) findings suggest that in contrast to their non-participating counterparts, the strategic focus of the participating firms transcends from simply mitigating any potential damages that their operations might have on the environment to business process reengineering and building new implementation capabilities. However, not all of the participating firms achieved excellence in their environmental performance, the high performing firms outweighed their counterparts on their emphasis on technological competence and competitiveness, and interestingly, the average-performing firms would use the strategic emphasis on social responsibility to compensate for their mediocre technological competence. The purpose of the research is to understand formulation of policy for creative industries, and in particular the importance of quantitative and qualitative data or information for formulation of the first policies for creative industries at national and regional level. The goal of the research is to assess whether it is possible to draft useful policy for the creative industry without having specific quantitative data at its disposal, which is often the case when such policy (...) is being newly developed. The methodology used is a brief literature review, and a case study. The case study regards policy development for the architectural sector in the East-Slovak region of Košice, which was executed by the authors in the context of the assignment to draft a strategy for development of the creative economy of the Košice region. Statistical data presented in this research were generated in the context of that assignment.The authors found that in the case of Slovakia and the region of Košice, the availability of data on the creative industries as a new policy area is very limited. Both at national level and at regional level, qualitative data and information are most useful for formulating policy. This is possible among others because qualitative needs’ assessment is feasible; international literature and best practices provide a guideline for formulating policy; and because general policies can address specific requirements through demand driven projects. The implication of the research is that specific quantitative data on the creative industries does not need to be considered a conditio sine qua non for drafting and implementing policy for the creative industries. Quantitative data will be necessary for evaluating outputs and impact of policy, in terms of efficiency and effectiveness of public spending. The choice of indicators, and collecting, processing and interpreting of quantitative data shall be an integral part of the policy to be implemented. (shrink)

The focus of this article is on representations of irregular migration in a Scandinavian context and how irregular migrants are constructed as a target group. A common feature in many European states is the difficult attempt to navigate between an urge for control and respecting, upholding and promoting humanitarian aspects of migration management. Legitimizing policies therefore become extremely important as governments have to appease national voters to remain in power and have to respect European regulations and international conventions. Doing so (...) raises questions of social, political and economic rights, of moral obligations, of sovereignty, and of equity, as well as of how to define target groups and legal and categorical statuses into the debates. Having a backdrop in the theoretical framework of Carol Bacchi, Anne Schneider and Helen Ingram and Giorgio Agamben, this article looks at how policy problematizations and constructions of target populations guide and legitimize particular policy approaches and may end up marginalizing and excluding groups in society and ultimately become a challenge for democracy.Dansk abstract: Legitimering af politik: Hvordan politiske tilgange til irregulære indvandrere formuleres og legitimeres i SkandinavienFokus i denne artikel er på repræsentationer af irregulær migration i en skandinavisk kontekst og hvordan illegale indvandrere er konstrueret som målgruppe. Non-therapeutic genetic testing in childhood presents a “myriad of ethical questions”; questions which are discussed and resolved in professional policy and position statements. In this paper we consider an underdiscussed but strongly influential feature of policy-making, the role of selective case and exemplar in the production of general recommendations. Our analysis, in the tradition of rhetoric and argumentation, examines the predominate use of three particular disease exemplar to argue for or against particular genetic tests. We discuss the influence (...) these choices have on the type and strength of subsequent recommendations. We argue that there are lessons to be drawn about how genetic diseases are conceptualised and we caution against the geneticisation of medical policy making. (shrink)

For years analysts have recognized the error of assuming that experts in medical science are also experts in deciding the clinically correct course for patients. This paper extends the analysis of the use of the consensus of experts to their use in public policy groups such as NIH Consensus Development panels. After arguing that technical experts cannot be expected to be expert on public policy decisions, the author extends the criticism to the use of the consensus of experts (...) in estimating facts to provide a basis for policy decisions. It is argued that to the extent that (a) experts' views regarding a body of facts can be expected to correlate with their values relevant to those facts; and (b) the values of experts differ from the values of lay people, even the estimates of the facts given by the consensus of expert panels can be expected to differ from the estimates lay people would have given had they had the relevant scientific expertise. The paper outlines some important differences between policy making and philosophical analysis, provides an account of ‘policy relevance’ and discusses ways (...) in which evidence may be misused in policy making. Proceeding on a limited number of general, widely accepted equity criteria, we develop a proposal for distributing common resources. In particular, the proposed fair division mechanism is individually rational, envy-free, Pareto-efficient and satisfies the stand alone test, which follows as a minimum requirement from the resource and population monotonicity criteria. Applied to international climate policy, the thrust of this proposal is that the South should initially be fully compensated for the greenhouse gas abatement measures it is to undertake as (...) a result of efficiency considerations. The author draws on the policy analysis literature to delineate the linkage between conceptualization of risk and the formulation and proposed solution of risk-related policy problems. Two concepts of risk are identified: a concept of risk as a physically given attribute of hazardous technologies and a concept of risk as a socially constructed attribute. The argument is advanced that the social construction of risk provides a firm, theoretical basis for the design of policy. Drawing on the SAGE minutes and other documents, I consider the wider lessons for norms of scientific advising that can be learned from the UK’s initial response to coronavirus in the period January-March 2020, when an initial strategy that planned to avoid total suppression of transmission was abruptly replaced by an aggressive suppression strategy. I introduce a distinction between “normatively light advice”, in which no specific policy option is recommended, and “normatively heavy advice” that does make an explicit recommendation. (...) I argue that, although scientific advisers should avoid normatively heavy advice in normal times in order to facilitate democratic accountability, this norm can be permissibly overridden in situations of grave emergency. SAGE’s major mistake in early 2020 was not that of endorsing a particular strategy, nor that of being insufficiently precautionary, but that of relying too heavily on a specific set of “reasonable worst-case” planning assumptions. I formulate some proposals that assign a more circumscribed role to “worst-case” thinking in emergency planning. In an epilogue, I consider what the implications of my proposals would have been for the UK’s response to the “second wave” of late 2020. (shrink)

A new approach to policy analysis is formulated within the framework of the graph model for conflict resolution. A policy is defined as a plan of action for a decision maker (DM) that specifies the DM’s intended action starting at every possible state in a graph model of a conflict. Given a profile of policies, a Policy Stable State (PSS) is a state that no DM moves away from (according to its policy), and such that no (...) DM would prefer to change its policy given the policies of the other DMs. The profile of policies associated to a PSS is called a Policy Equilibrium. Properties of PSSs are developed, and a refinement is suggested that restricts DMs to policies that are credible in that they are in the DM’s immediate interest. Relationships with existing stability definitions in the graph model for conflict resolution are then explored. (shrink)

The current dominant paradigm of mental disorder is that psychopathology is a deviation from normal physiological functioning of the brain. This paradigm is closely allied to the identity theory of mind in philosophy, which holds that mental phenomena are identical with the physical state of the brain. The assumptions of the biological model have policy implications, regardless of the utility or ‘truth’ of the paradigm, which should be made explicit for the assessment of ethics in mental health policy (...) formulation. The nature of mental phenomena has been debated throughout history, without consensus. Several critiques of the biological model are offered to encourage enquiring scepticism. The policy implications discussed are political conservatism, broadened rationales for forced treatment, utility in managed care, and the use of medical necessity criteria to allocate treatment. Response to "Predictive Policies" by R.S.McGowan Mr. McGowan has assumed that there is a clear distinction between inductive inferences and others, that we all know how to make the distinction, that we all agree that the inductive ones are somehow better or more reasonable than the alternatives, and I have criticised all of these assumptions. Further he hasformulated the philosophical problem of induction as the problem of showing why the inductive ones are better, and he has attempted to show that (...) inductive policiesas represented in his flow chart are better than non-inductive and counter-inductive ones. I have criticised some of the details of his argument and put forward the counter-claim that policies based on the weaker principles of desistence are better at avoiding contradictions and conform to past experience more closely than policies based on his strong principle of persistence. Accordingly, some modifications of his predictive rules have been suggested. Perhaps most importantly of all, I have argued that the assertion that one policy or inference is better or more rational than another is an incomplete assertion until a basis of comparison has been specified, since different policies may be better or more rational in relation to different bases, and I have indicated some possible approaches for further investigation of this point. A final line of investigation which should be mentioned is the problem of deciding which of two bases of comparison is better relative to some higher-order basis of comparison, a problem which may turn out to be very important in connexion with justifications of predictive policies. It seems that I have asked more questions than I have answered. Perhaps formulating them will help someone more familiar with the field than I am to find interesting answers. (shrink)

In Sweden, efforts to govern end-of-life care through policies have been ongoing since the 1970s. The aim of this study is to analyse how policy narratives on palliative care in Sweden have been formulated and have changed over time since the 1970s up to 2018. We have analysed 65 different policy-documents. After having analysed the empirical material, three policy episodes were identified. In Episode 1, focus was on the need for norms, standards and a psychological end-of-life care (...) with the main goal of solving the alleged deficiencies within end-of-life care in hospital settings. Episode 2 was characterised by an emphasis on prioritising end-of-life care and dying at home, and on the fact that the hospice care philosophy should serve as inspiration. In Episode 3, the need for a palliative care philosophy that transcended all palliative care and the importance of systematic follow-ups and indicators was endorsed. Furthermore, human value and freedom of choice were emphasised. In conclusion, the increase of policy-documents produced by the welfare-state illustrate that death and dying have become matters of public concern and responsibility. Furthermore, significant shifts in policy narratives display how notions of good palliative care change, which in turn may affect both the practice and the content of care at the end of life. "In this paper I shall attempt to sketch a defense of the plain man's view that the job of the judge, qua judge is to apply the law." What seems to have lead to the other view is the pervasive role of policy and principle in the justification of judicial decisions. This is no argument, however, for the existence of discretion: "For while it must be admitted that judges are entitled to appeal to certain general policies and principles, this (...) by no means implies that they are entitled to exercise discretionary judgment in the formulation of such standards." With Dworkin, distinguishes weak and strong discretion: the former means merely final or controversial; the latter implying that judges are at some point free to reach decisions not controlled by authoritative standards. Agrees with Dworkin that non-rule standards are part of law. "Both Dworkin and I are in agreement that law is a system of entitlements, although, as we shall see, we differ as to what is their basis." "At any rate, we share the view that a litigant before a court of law is not in the position of one begging a favor from a potential benefactor, but rather in that of one demanding a particular decision as a matter of right, as something to which the law entitles him. Such a demand has two aspects: a claim that a right exists which the law recognizes; a claim that this right takes precedence over any competing legal rights or obligations involved. Let us refer to these two sorts of claims respectively as ones involving decisions as to recognition, and weight.:" Argues that we cannot distinguish between legal moral principles and non-legal moral principles without a rule of recognition. The same is true for the problem of establishing weight between various principles - here we have to consider how well a principle coheres with the institutional practice of a legal system. This article will address the considerations that must be examined in the design of public policies and government programs to achieve an intercultural approach to the health of the Pu Mapuce Zomo (Mapuce women). In this sense, the proposed objective is to formulate three essential aspects that serve as a basis to promote adequate frameworks for public health policies oriented towards an intercultural approach. For this, methodologically, from a qualitative approach, the ethical, gender(s) and epistemic aspects that must be considered (...) in the configuration of health programs that favor the health care of indigenous women will be investigated. With this purpose, it begins by delimiting the unavoidable ethical-normative and gender approach to highlight the basic needs of Mapuce women. This approach seeks to establish a parameter about the obligations that States have in relation to the development of human capabilities. Finally, three aspects will be presented that the State must replicate in its health proposals to guarantee the construction of an intercultural approach to health, appropriate to the basic needs of Mapuce women in Argentina. The incident of 1971 is a historical concern. Both wings of Pakistan were united at the time of the creation of Pakistan but some policies that were adopted after the creation of Pakistan were inadequate to resolve the growing differences between the both wings. Writers are divided regarding the causes of the Fall of Dhaka. Indian involvement has been highlighted frequently and it is also said that East Bengal was on the distance of 1000 km from West Pakistan. Apart from (...) these causes, this study will highlight a new perspective regarding the separation of East Bengal. From 1947 to 1971 the central governments of Pakistan took some measure regarding formulating policies and the policies were not sufficient to bring people of the both wings closer. Thus, the major policies and their consequences would be analysed in this paper. In a provocative recent study, Bent Flyvbjerg makes a sustained case for the need for a revitalized conception of social inquiry with direct input into the policy-making and planning process, contending that it is only in this way that social science can be made to matter again. Flyvbjerg further contends that to do justice to the reality of contemporary policy forums, we need to embrace a thoroughgoing dialogical conception of the policy-making process itself. To vindicate this contention (...) and theoretically ground the envisaged dialogical ideal, Flyvbjerg draws extensively on the work of both Habermas and Foucault. In so doing, he makes a valuable contribution to delineating the requirements that contemporary policy forums must meet if participants can judiciously claim to be engaging in decision-making in the best interests of the community at large. However, the overall tenability of Flyvbjerg’s proposal is diminished because, motivated by his convictions about the importance of power relations in determining real-world policy outcomes, he engages in a one-sided defence of the merits of Foucault’s contribution to the neglect of Habermas’s input in informing us about the ground rules needed to structure policy debate to ensure an equitable outcome. The aim of the present article is to redress this imbalance. To this end, I argue that given certain weaknesses in Foucault’s formulation of his position, we must draw on Habermas as a corrective if we are to succeed in advancing the dialogical ideal envisaged by Flyvbjerg. Beyond defending the need for a complementary reading of these theorists, I undertake to facilitate the implementation of the envisaged dialogical ideal by further elucidating the discursive conditions needed to underpin it. When formulating a policy related to food in a heterogeneous context within a nation or between nations, oppositional positions are more or less explicit, but always have to be overcome. It is interesting to note, though, that such elements as culture and religion have seldom been the focus in discussions about methods of decision-making in food policy. To handle discrepancies between oppositional positions, one solution is to narrow differences between partners, another to accept one partner or position as (...) dominant. In a solid and lasting policy, any of these options has to be agreed upon by all the partners involved. In this article, I argue that context sensitivity and a shared picture of the situation are necessary bases for a solid food policy. Two methods for policy discussion are elaborated on and religious slaughter is given as an example of a heterogeneous setting with strongly diverging ideals. Several aspects have to be respected from the outset, such as culture, religion, and value systems. This condition is partly met in a model of informed consent and in a consensus model. The informed consent model is regarded as insufficient, because it lacks both methods of dealing with hierarchies and the goal of finding a shared and nuanced picture of the situation. A consensus model meets these tasks but might on the other hand, among other things, be too difficult to follow and to administer. For both models, some difficulties with justification of decisions arise. Five essential elements emanating from a combination of these models are suggested as a basis for a decision process regarding food policies: respect for each discussion partner, context sensitivity, respect for arguments including emotions, a shared picture of the situation, and finally relating theory and practice. While widely acknowledged as the world's oldest profession, and often glamorized or demonized in the media, prostitution is a critical part of American culture and its economy, as well as a social problem in need of an updated public policy. In Prostitution Policy, Lenore Kuo combines feminist social research and legal studies to tackle issues raised by heterosexual prostitution in the U.S. Through the lens of feminist theory, Kuo examines the milieu of prostitutes and the role of prostitution (...) in contemporary society, and how the interplay of those two works itself out in practice. Moving beyond theoretical analysis of prostitution, Prostitution Policy turns to the complicated problem of formulating a reasonable legal policy that minimizes harm. Kuo discusss criminalization, legalization, and decriminalization as possible approaches, ultimately arguing for a unique form of decriminalization including detailed legal oversight and mandatory social services. As more national governments adopt policies addressing the ethical implications of artificial intelligence, a comparative analysis of policy documents on these topics can provide valuable insights into emerging concerns and areas of shared importance. This study critically examines 57 policy documents pertaining to ethical AI originating from 24 distinct countries, employing a combination of computational text mining methods and qualitative content analysis. The primary objective is to methodically identify common themes throughout these policy documents and perform a (...) comparative analysis of the ways in which various governments give priority to crucial matters. A total of nineteen topics were initially retrieved. Through an iterative coding process, six overarching themes were identified: principles, the protection of personal data, governmental roles and responsibilities, procedural guidelines, governance and monitoring mechanisms, and epistemological considerations. Furthermore, the research revealed 31 ethical dilemmas pertaining to AI that had been overlooked previously but are now emerging. These dilemmas have been referred to in different extents throughout the policy documents. This research makes a scholarly contribution to the expanding field of technology policy formulations at the national level by analyzing similarities and differences among countries. Furthermore, this analysis has practical ramifications for policymakers who are attempting to comprehend prevailing trends and potentially neglected domains that demand focus in the ever-evolving field of artificial intelligence. Three standard tasks undertaken by applied ethicists engaged in the public policy process are identifying value issues, clarifying concepts and meanings, and analyzing arguments. I urge that these should be expanded to include making specific moral judgments and advocating positions and policies. Three objections to philosophers/ethicists' engagement in the formation of public policy are advanced and evaluated: philosophers necessarily do public policy badly, doing it at all compormises one's integrity as a seeker after truth, and frequently participation (...) is in the service of a repressive status quo that is structured simultaneously to preclude radical change and to co-opt ethicists. finally, however, I argue that those who would be ‘applied ethicists’ cannot avoid all participation in some form of a public policy process; that engagement holds the hope as well for improved ethical theory; that the preferred form of participation is frequently from outside of establishment bodies; and that wherever philosophers do involve themselves in policy formulation, this is best done in the expanded sense urged at the outset. This paper seeks to examine the relationship and the interaction between institutions, policy and the labour market in the light of the ideas of the first generation of institutional economists, who, in contrast to neoclassicals, conceived of the economy as a nexus of institutions, underlining, therefore, the significant role of institutional and non-market factors in the functioning of an economic system. They also criticised those who define (economic) welfare only in terms of efficiency and satisfaction of consumer interests; institutionalists (...) instead focus on issues related to justice, human self-development and labourers' welfare. In addition, early institutionalists paid considerable attention to the institutional framework of the labour market. In particular, the first generation of institutional economists highlighted the importance of institutions and other non-market parameters in determining the level of wages and employment (e.g. the role of the bargaining power of workers and employers). Furthermore, they made substantial contributions towards the field of labour policy and they were pioneers in the formulation of economic and social policy. Specifically, various modern institutions and labour market policies, such as unemployment benefits, industrial training and active employment policies, were implemented in the US, during the first decades of the 20th century, after the recommendation of the institutional labour economists. Therefore, their ideas, besides being interesting from a historical point of view, may also be useful in today's analysis of workers' problems and the functioning of modern labour markets. (shrink)

This paper proposes a Capabilities -based Approach to guide hazard mitigation efforts. First, a discussion is provided of the criteria that should be met by an adequate framework for formulating public policy and allocating resources. This paper shows why a common decision-aiding tool, Cost-benefit Analysis, fails to fulfill such criteria. A Capabilities -based Approach to hazard mitigation is then presented, drawing on the framework originally developed in the context of development economics and policy. The focus of a Capabilities (...) -based Approach is protecting and promoting the well-being of individuals. Capabilities are dimensions of well-being and specified in terms of functionings. Functionings capture the various things of value an individual does or becomes in his or her life, including being alive, being healthy, and being sheltered. Capabilities refer to the real achievability of specific functionings. In the context of hazard mitigation, from a Capabilities -based Approach, decision- and policy-makers should consider the acceptability and tolerability of risks along with the affectability of hazards when determining policy formulation and resource allocation. Finally, the paper shows how the proposed approach satisfies the required criteria, and overcomes the limitations of Cost-benefit Analysis, while maintaining its strengths. (shrink)

The thinking of those with the power to formulate and implement public policy is now almost totally dominated by the so-called science of economics. While efforts have been made to supplement or modify economics to make it less brutal or less environmentally blind, here it is suggested that economics is so fundamentally flawed and that it so completely dominates the culture of late modern capitalism (or postmodernity) that a new master human science is required to displace it and provide (...) an alternative coordinating framework for research and for defining reality. This could then provide an alternative basis for formulating public policy. It is argued that if human ecology is to fill this role, it will must be developed on consistently anti-reductionist foundations, and that such a social science would totally reorient public policy from a domain for power elites to a domain for genuinely democratic societies to define and control their destinies. -/- . Online trading invariably involves dealings between strangers, so it is important for one party to be able to judge objectively the trustworthiness of the other. In such a setting, the decision to trust a user may sensibly be based on that user’s past behaviour. We introduce a specification language based on linear temporal logic for expressing a policy for categorising the behaviour patterns of a user depending on its transaction history. We also present an algorithm for checking whether the (...) transaction history obeys the stated policy. To be useful in a real setting, such a language should allow one to express realistic policies which may involve parameter quantification and quantitative or statistical patterns. We introduce several extensions of linear temporal logic to cater for such needs: a restricted form of universal and existential quantification; arbitrary computable functions and relations in the term language; and a “counting” quantifier for counting how many times a formula holds in the past. We then show that model checking a transaction history against a policy, which we call the history-based transaction monitoring problem, is PSPACE-complete in the size of the policy formula and the length of the history, assuming that the underlying interpreted functions and relations are polynomially computable. The problem becomes decidable in polynomial time when the policies are fixed. We also consider the problem of transaction monitoring in the case where not all the parameters of actions are observable. We formulate two such “partial observability” monitoring problems, and show their decidability under certain restrictions. (shrink)

The paper assesses the rationale, contributions, structure, and challenges of the field of development ethics. Processes of social and economic transformation involve great risks and costs and great opportunities for gain, but the benefits, costs, and risks are typically hugely unevenly and inequitably distributed, as is participation in specifying what they are and their relative importance. The ethics of development examines the benefits, costs, risks, formulations, participation, and options. The paper outlines a series of ways of characterizing such work, arguments (...) for and against its importance, and some of its major sources and contributions, especially from the interdisciplinary stream of work represented over several decades by Denis Goulet. Definitions are diverse since the work covers many different intersections of practice and theorizing, at multiple levels. The paper considers and replies to arguments against discussing development ethics: the claim that it involves only endless proliferation of different opinions, is an expensive luxury that undermines long-run development, is superfluous if one already works with the capability approach or the human rights tradition, or never has influence. Finally, it presents suggestions for how development ethics thinking can have increased impact, with reference to incorporation in policy analysis and planning methods, professional codes and training, and to its intellectual location and communication strategies. The field should articulate the methodological pragmatism which much of it has adopted, consistent with its required role as a practice-oriented interdisciplinary meeting ground. (shrink)

Here I use aspects of Phil Graham’s discourse analytical work to examine forms of e/valuations and critically analyse the formulation of truths in the constitution of Artificial Intelligence (hereafter, AI). This paper focuses on two 2019 documents: Ethics guidelines for trustworthy AI (AI HLEG, Citation2019a) and Policy and investment recommendations for trustworthy AI (AI HLEG, Citation2019b). My aim here is to provide a timely contribution to contemporary philosophical–methodological innovations in documenting the constellation of values that are prefigured in (...) human-centric constructions of AI. The analysis is informed primarily by principles from Graham’s distinctive approach to critical discourse analysis (CDA), which I take to be the philosophical study of valuation. In that approach, political economy is taken as a composite formulation of values whereby neo-liberalism is discursively entwined and progressed through a system of principles of e/valuation. This paper presents a roadmap to demonstrate the usefulness of a philosophically grounded interdisciplinary piece of linguistic research through which evaluative semantic categories can be usefully synthesised with CDA to systematically expose the assumptions which underpin current truth claims and values – in this case, about and around the ethics of AI. Recommandations have been formulated in 1985 with reference to socialist morality and law and as a result of interdisciplinary discussion by the IAME (Interdisciplinary Working Party on Medical Ethics at the GDR Academy of Postgraduate Medical Education) for clinical application of in vitro fertilization and for the use of human oocytes and early embryonic stages.

For several decades, Ronald Dworkinhas been one of the most prominent voicesdefending the legality and justifiability ofrace-conscious programs aimed at undoing thecontinuing effects of prejudice. Writingwithin the framework of a liberal legalphilosophy, he has formulated powerfularguments against the view that color-blindpolicies are the only defensible ones. Nonetheless, I argue that a more completeliberal defense of race-conscious policieswould need to develop and modify Dworkin's lineof argument. Such a defense would go beyondhis policy-based arguments and incorporatearguments of principle. Four models are outlined for describing and analysing the role of teachers in the formulation of educational policy and the resulting processes of change. The model of teachers as partners in education policy making draws on a pluralist view of political processes and an assumption of a degree of autonomy for teachers and schools. A model of teachers as implementers of change draws a sharp distinction between the processes of policy making and policy execution and (...) excludes teachers from an involvement in the former. A model of teachers as resisting change has been put forward both by those most opposed to and those most supportive of current educational policy developments. Finally, a model of teachers as policy makers in practice is proposed to describe the way in which the reality of teaching situations can lead to the independent actions of individual teachers having systematic policy effects. The applicability of these models is considered in the context of contemporary educational changes drawing on empirical research evidence, in particular that of the PACE study of the implementation of the National Curriculum at KS1 and KS2. This paper analyses policies pertaining to school dress codes which have been formulated recently by all state education bureaucracies in Australia. It examines these policies and their implementation in the context of devolution, the marketisation of schools, and cognate social legislation. In doing so it seeks to understand the textual hiatus between government policy and schooling practices.

This study is an ethical reflection on the formulation and application of public policies regarding reproductive health in Brazil. The Integral Assistance Program for Women's Health (PAISM) can be considered advanced for a country in development. Universal access for family planning is foreseen in the Brazilian legislation, but the services do not offer contraceptive methods for the population in a regular and consistent manner. Abortion is restricted by law to two cases: risk to the woman's life and rape. This (...) reality favors the practice of unsafe abortion, which is the third largest cause of maternal death in Brazil. Legal abortion is regulated by the State and the procedure is performed in public health centers. However, there is resistance on the part of professionals to attend these women. Prenatal care is a priority strategy for promoting the quality of life of these women and of future generations. Nonetheless, it is still difficult for these women to access the prenatal care services and to have the required number of consultations. Moreover, managers and health professionals need to be made aware of the importance of implementing the actions indicated by the public policies in the area of sexual and reproductive health, favoring respect for autonomy in a context of personal freedom. One of the key responsibilities of public institutions in liberal democracies is to formulate recommendations for decision makers. However, public institutions realize that decision makers will often partly ignore their recommendations. This situation of “partial compliance” with recommendations raises a number of philosophical issues for institutions. Based on an analysis of 570 recommendations drawn from 40 Quebec public-sector documents and reports, we identify two issues surrounding the structure of public-policy recommendations.

The opposing views in the scholarly debate on evidence-based policy (EBP) have recently been labeled ‘rationalist’ and ‘constructivist’, where the former are positive to EBP and the latter are not. This framing of the debate is suboptimal, as it conflates critical positions that should be kept separate. This article suggests that the debate should be understood as one between idealists, realists, and counter-idealists about EBP. The realist position, that is, that EBP is difficult or impossible to achieve in practice, (...) has already been treated at length in the debate. The conflict between idealism and counter-idealism, to the contrary, has been neglected. This article aims to stimulate the scholarly debate on EBP by initiating a principled discussion between idealism and counter-idealism about EBP, which should motivate proponents of EBP to formulate their ideal with substantial moral arguments. This places the debate on EBP in the context of normative political theory, where it rightfully belongs. (shrink)
