Las denuncias por responsabilidad médica en Ecuador se incrementaron en la última década a raíz de la penalización de la mala práctica profesional establecida en el Código Orgánico Integral Penal; la investigación es compleja y el peritaje médico legal se convierte en una pieza fundamental en el conflicto. Aquí analizamos 10 informes periciales de casos de mala práctica médica en Ecuador, se analiza la legislación ecuatoriana y revisión de la literatura referente al tema. Se identificó la falta de protocolos o (...) guías de procedimientos, los informes no cuentan con estructura y es el resultado de la discrecionalidad del perito designado. Recently, there have been a number of lawsuits in the United States in which families objected to performance of apnoea testing for determination of brain death. The courts reached conflicting determinations in these cases. We discuss the medicolegal complications associated with apnoea testing that are highlighted by these cases and our position that the decision to perform apnoea testing should be made by clinicians, not families, judges, or juries.

sirAccording to the Swedish Immigration Board , about 26,500 people per year have applied for asylum in Sweden during the last decade. Experiences from Denmark show that up to 20% of those who seek asylum have been subjected to torture or severe ill-treatment in their home countries.1 Since 1992, most of these applicants have been examined at the Centre for Torture and Trauma survivors in Stockholm.2 The findings are described in medicolegal certificates submitted to the immigration authorities.The present study (...) was primarily aimed at analysing the relationship between the medicolegal certificates and the chances of obtaining asylum in 52 randomly selected CTD cases from the years 1994-96. In what sense, if any, are philosophers experts in their domain of research and what could philosophical expertise be? The above questions are particularly pressing given recent methodological disputes in philosophy. The so-called expertise defense recently proposed as a reply to experimental philosophers postulates that philosophers are experts qua having improved intuitions. However, this model of philosophical expertise has been challenged by studies suggesting that philosophers’ intuitions are no less prone to biases and distortions than intuitions of (...) non-philosophers. Should we then give up on the idea that philosophers possess some sort of expertise? In this paper, I argue that instead of focusing on intuitions, we may understand the relevant results of philosophical practice more broadly and investigate the other kind of expertise they would require. My proposal is inspired by a prominent approach to investigating expert performance from psychology and suggests where and how to look for expertise in the results characteristic of philosophical practice. In developing this model, I discuss the following three candidates for such results: arguments, theories, and distinctions. Whether philosophers could be shown to be expert intuiters or not, there are interesting domains where we could look for philosophical expertise, beyond intuitions. (shrink)

Feyerabend is infamous for his defense of pluralism, which he extends to every topic he discusses. Disagreement, a by-product of this pluralism, becomes a sign of flourishing critical communities. In Feyerabend’s political works, he extends this pluralism from science to democratic societies and incorporates his earlier work on scientific methodology into a procedure for designing just policy. However, a description and analysis of Feyerabend’s conception of disagreement is lacking. In this paper, I reconstruct and assess Feyerabend’s conception of disagreement, with (...) a particular emphasis on the role of experts, and its role in the formation of science policy. I go on to assess this argument in light of recent literature on manufactured disagreement on politically contentious science policy. I conclude by suggesting some prospects and problems for de-idealizing Feyerabend’s position on disagreement to see whether it may be plausibly implemented. (shrink)

Abstract: Some proponents of “experimental philosophy” criticize philosophers' use of thought experiments on the basis of evidence that the verdicts vary with truth-independent factors. However, their data concern the verdicts of philosophically untrained subjects. According to the expertise defence, what matters are the verdicts of trained philosophers, who are more likely to pay careful attention to the details of the scenario and track their relevance. In a recent article, Jonathan M. Weinberg and others reply to the expertise defence (...) that there is no evidence for such expertise. They now receive a reply in this article, which argues that they have misconstrued the dialectical situation. Since they have produced no evidence that philosophical training is less efficacious for thought experimentation than for other cognitive tasks for which they acknowledge that it produces genuine expertise, such as informal argumentation, they have produced no evidence for treating the former more sceptically than the latter. According to the ‘expertise defence’, experimental findings suggesting that intuitive judgments about hypothetical cases are influenced by philosophically irrelevant factors do not undermine their evidential use in (moral) philosophy. This defence assumes that philosophical experts are unlikely to be influenced by irrelevant factors. We discuss relevant findings from experimental metaphilosophy that largely tell against this assumption. To advance the debate, we present the most comprehensive experimental study of intuitive expertise in ethics to date, which tests five well- known (...) biases of judgment and decision-making among expert ethicists and laypeople. We found that even expert ethicists are affected by some of these biases, but also that they enjoy a slight advantage over laypeople in some cases. We discuss the implications of these results for the expertise defence, and conclude that they still do not support the defence as it is typically presented in (moral) philosophy. (shrink)

Although medicolegal challenges to the use of neurologic criteria to declare death in the USA have been well-described, the management of court cases in the United Kingdom about objections to the use of neurologic criteria to declare death has not been explored in the bioethics or medical literature. This article (1) reviews conceptual, medical and legal differences between death by neurologic criteria (DNC) in the United Kingdom and the rest of the world to contextualize medicolegal challenges to DNC; (...) (2) summarizes highly publicized legal cases related to DNC in the United Kingdom, including the nuanced 2022 case of Archie Battersbee, who was transiently considered dead by neurologic criteria, but ultimately determined to be in a vegetative state/unresponsive-wakeful state; and (3) provides an overview of ethical issues raised by medicolegal challenges to DNC in the United Kingdom and a comparison to the management of these challenges in the USA. In this article, I assess the position that voluntary euthanasia and physician-assisted suicide ought not to be accepted in the cases of persons who suffer existentially but who have no medical condition, because existential questions do not fall within the domain of physicians’ professional expertise. I maintain that VE and PAS based on suffering arising from medical conditions involves existential issues relevantly similar to those confronted in connection with existential suffering. On that basis I conclude that if VE and (...) PAS based on suffering arising from medical conditions is taken to fall within the domain of medical expertise, it is not consistent to use the view that physicians’ professional expertise does not extend to existential questions as a reason for denying requests for VE and PAS from persons who suffer existentially but have no medical condition. In this paper I will introduce a practical explication for the notion of expertise. At first, I motivate this attempt by taking a look on recent debates which display great disagreement about whether and how to define expertise in the first place. After that I will introduce the methodology of practical explications in the spirit of Edward Craig’s Knowledge and the state of nature along with some conditions of adequacy taken from ordinary and scientific language. This eventually culminates (...) in the respective explication of expertise according to which this term essentially refers to a certain kind of service-relation. This is why expertise should be considered as a predominantly social kind. This article will end up with a discussion of advantages and prima facie plausible objections against my account of expertise. (shrink)

Christian Quast has recently embarked on the project of systematizing the debate about the notion of expertise, an extremely fascinating and important issue addressed by scholars of many disciplines yet still in need of an interdisciplinary take. He sheds light on a number of relevant features of this notion and defends what he calls a “balanced” account of expertise, namely one that defines this concept in light of an expert’s dispositions, manifestations of their dispositions, and social role or (...) function. In this critical reply, I offer some considerations that put pressure on Quast’s balanced account and hopefully help anyone interested in this debate take a step forward toward explaining what it takes for one to be an expert. The reply is structured as follows. First, I argue that his allegedly balanced view is liable to a potentially compromising tension between its function component and the ingredients of objective expertise (§1). Then, I show that Quast’s threefold characterization of an objective expert is too strong, as it imposes conditions that several individuals whom we would consider experts are unable to fulfill (§2). Finally, I provide reasons in favor of endorsing an objective account of expertise in light of some specific features of our society and show how this account can take into due consideration the different services experts ordinarily perform (§3). The so-called expertise defence against sceptical challenges from experimental philosophy has recently come under attack: there are several studies claiming to have found direct evidence that philosophers’ judgments in thought experiments are susceptible to erroneous effects. In this paper, we distinguish between the customary ‘immune experts’ version of the expertise defence and an ‘informed experts’ version. On the informed expertise defence, we argue, philosophers’ judgments in thought experiments could be preferable to those by the folk even if (...) it were true that philosophers’ judgments are no less immune to confounders than judgments by the folk are. Recent experimental studies indicate that epistemically irrelevant factors can skew our intuitions, and that some degree of scepticism about appealing to intuition in philosophy is warranted. In response, some have claimed that philosophers are experts in such a way as to vindicate their reliance on intuitions—this has become known as the ‘expertise defence’. This paper explores the viability of the expertise defence, and suggests that it can be partially vindicated. Arguing that extant discussion is problematically imprecise, we will (...) finesse the notion of ‘philosophical expertise’ in order to better reflect the complex reality of the different practices involved in philosophical inquiry. On this basis, we offer a new version of the expertise defence that allows for distinct types of philosophical expertise. The upshot of our approach is that wholesale vindications or rejections of the expertise defence are shown to be unwarranted; we must instead turn to local, piecemeal investigations of philosophical expertise. Lastly, in the spirit of taking our own advice, we exemplify how recent developments from experimental philosophy lend themselves to this approach, and can empirically support one instance of a successful expertise defence. In The Great Endarkenment, Elijah Millgram argues that the hyper-specialization of expert domains has led to an intellectual crisis. Each field of human knowledge has its own specialized jargon, knowledge, and form of reasoning, and each is mutually incomprehensible to the next. Furthermore, says Millgram, modern scientific practical arguments are draped across many fields. Thus, there is no person in a position to assess the success of such a practical argument for themselves. This arrangement virtually guarantees that mistakes will accrue (...) whenever we engage in cross-field practical reasoning. Furthermore, Millgram argues, hyper-specialization makes intellectual autonomy extremely difficult. Our only hope is to provide better translations between the fields, in order to achieve intellectual transparency. I argue against Millgram’s pessimistic conclusion about intellectual autonomy, and against his suggested solution of translation. Instead, I take his analysis to reveal that there are actually several very distinct forms intellectual autonomy that are significantly in tension. One familiar kind is direct autonomy, where we seek to understand arguments and reasons for ourselves. Another kind is delegational autonomy, where we seek to find others to invest with our intellectual trust when we cannot understand. A third is management autonomy, where we seek to encapsulate fields, in order to manage their overall structure and connectivity. Intellectual transparency will help us achieve direct autonomy, but many intellectual circumstances require that we exercise delegational and management autonomy. However, these latter forms of autonomy require us to give up on transparency. (shrink)

Recent work in experimental philosophy has indicated that intuitions may be subject to several forms of bias, thereby casting doubt on the viability of intuition as an evidential source in philosophy. A common reply to these findings is the ‘expertise defense’ – the claim that although biases may be found in the intuitions of non-philosophers, persons with expertise in philosophy will be resistant to these biases. Much debate over the expertise defense has centered over the question of (...) the burden of proof; must defenders of expertise provide empirical evidence of its existence, or should we grant the existence of philosophical expertise as a ‘default’ assumption? Defenders have frequently appealed to analogy with other fields; since expertise clearly exists in, e.g., the sciences, we are entitled to assume its existence in philosophy. Recently, however, experimentalists have begun to provide empirical evidence that biases in intuition extend even to philosophers. Though these findings don't yet suffice to defeat the default assumption of expertise the analogy argument motivates, they do force any proponent of the analogy argument to provide more specific and empirically informed proposals for the possible nature of philosophical expertise. Between formal propositional knowledge and embodied skill lies ‘interactional expertise’—the ability to converse expertly about a practical skill or expertise, but without being able to practice it, learned through linguistic socialisation among the practitioners. Interactional expertise is exhibited by sociologists of scientific knowledge, by scientists themselves and by a large range of other actors. Attention is drawn to the distinction between the social and the individual embodiment theses: a language does depend on the form of the bodies (...) of its members but an individual within that community can learn the language without the body. In recent years a new discussion on the nature of philosophical expertise has emerged: whether philosophers possess a special kind of expertise, what such expertise would entail, how to measure it, and related concerns. The aim of the present article is to clarify certain related points across these debates in the hope of paving a clearer path forward, by addressing the following. (1) The expertise defense, which seems central to many discussions on methodology and expertise, (...) has been misconstrued at times. (2) Questions of expertise and methodology could be separated more clearly. (3) The study of expertise may be important in its own right; however, there may be good reasons to give priority to methodological concerns. (4) Finally, when viewed in light of methodological concerns, a new project emerges when engaging with recent contributions to the expertise debate. Judging the warrant of conspiracy theories can be difficult, and often we rely upon what the experts tell us when it comes to assessing whether particular conspiracy theories ought to be believed. However, whereas there are recognised experts in the sciences, I argue that only are is no such associated expertise when it comes to the things we call `conspiracy theories,' but that the conspiracy theorist has good reason to be suspicious of the role of expert endorsements when it (...) comes to conspiracy theories and their rivals. The kind of expertise, then, we might associate with conspiracy theories is largely improvised—in that it lacks institutional features—and, I argue, ideally the product of a community of inquiry. Experimental restrictionists have challenged philosophers’ reliance on intuitions about thought experiment cases based on experimental findings. According to the expertise defense, only the intuitions of philosophical experts count—yet the bulk of experimental philosophy consists in studies with lay people. In this paper, we argue that direct strategies for assessing the expertise defense are preferable to indirect strategies. A direct argument in support of the expertise defense would have to show: first, that there is a significant difference between (...) expert and lay intuitions; second, that expert intuitions are superior to lay intuitions; and third, that expert intuitions accord with the relevant philosophical consensus. At present, there is only little experimental evidence that bears on these issues. To advance the debate, we conducted two new experiments on intuitions about knowledge with experts and lay people. Our results suggest that the intuitions of epistemological experts are superior in some respects, but they also pose an unexpected challenge to the expertise defense. Most strikingly, we found that even epistemological experts tend to ascribe knowledge in fake-barn-style cases. This suggests that philosophy, as a discipline, might fail to adequately map the intuitions of its expert practitioners onto a disciplinary consensus. (shrink)

Philosophers, particularly moral philosophers, are increasingly being involved in public decision‐making in areas which are seen to raise ethical issues. For example, Dame Mary Warnock chaired the ‘Committee of Inquiry into Human Fertilization and Embryology’ in the UK in 1982–4; the Philosophy Department at Auckland was commissioned by the Auckland Regional Authority to report on the ethical aspects of fluoridating the public water supply in 1990; and many of us are serving on ethics committees of various sorts. Not only are (...) philosophers actually being called on or consulted, but many of us would argue that a philosophical contribution in such areas is essential.The involvement of moral philosophers in public policy decisions raises a question of professional ethics, viz, what role should a philosopher's own moral perspective or judgements play in the advice s/he gives, or contribution s/he makes, to public decision‐making on ethical issues. Like most problems in professional ethics, this prompts reflection on the nature of the profession, and in particular on the expertise we take moral philosophy to offer. It also prompts reflection on how processes of public decision making in ethically problematic areas should be understood. I explore these issues in this paper. (shrink)

This work has made important steps towards overcoming traditional intellectualist and individualist models of cognition, group interaction and learning, but has in turn generated a number of important questions about the shape of a model that emphasizes learning and interaction as situated and embodied. Bringing together philosophers, cognitive scientists and education theorists, the collection (...) asks and explores a variety of different questions. Can a group learn? Is expertise distributed? How can we make sense of a normative dimension of expertise or skill? How situation-specific is expertise? How can groups shape or generate expert practice? Through these lenses, this collection advances a more experientially holistic approach to the characterisation and growth of human expertise. This essay extends the observations made in E. Johanna Hartelius’ The rhetoric of expertise about the nature of expertise in digital contexts. I argue that digital media introduce a scale of communication—many-to-many—that reshapes how the invention of knowledge occurs. By examining how knowledge production on Wikipedia occurs, I illustrate how many-to-many communication introduces a new model of “participatory expertise.” This model of participatory expertise challenges traditional information routines by elevating procedural expertise over subject matter (...) class='Hi'>expertise and opening up knowledge production to the many. Additionally, by hosting multiperspectival conversations on Wikipedia, the participatory model of expertise introduces epistemic turbulence into traditionally tranquil encyclopedia culture. (shrink)

We discuss the relationship between expertise, expert authority, and trust in the case of vaccine research and policy, with a particular focus on COVID-19 vaccines. We argue that expert authority is not merely an epistemic notion, but entails being trusted by the relevant public and is valuable if it is accompanied by expert trustworthiness. Trustworthiness requires, among other things, being transparent, acknowledging uncertainty and expert disagreement (e.g., around vaccines’ effectiveness and safety), being willing to revise views in response to (...) new evidence, and being clear about the values that underpin expert recommendations. We explore how failure to acknowledge expert disagreement and uncertainty can undermine trust in vaccination and public health experts, using expert recommendations around COVID-19 vaccines as a case study. This paper argues that the problem of expertise calls for a rapprochement between social epistemology and argumentation theory. Social epistemology has tended to emphasise the role of expert testimony, neglecting the argumentative function of appeals to expert opinion by non-experts. The first half of the paper discusses parallels and contrasts between the two cases of direct expert testimony and appeals to expert opinion by our epistemic peers, respectively. Importantly, appeals to expert opinion need to be advertised as such, if (...) they are to sway an epistemic peer. The second half of the paper sketches a theoretical framework for thinking about assessments of expertise in a unified way, via a ‘default and challenge’ model that emphasises the need for a version of conversational scorekeeping. It is through such scorekeeping that interlocutors can track and coordinate their differences in epistemic outlook. The paper concludes with a genealogical perspective on the function of (attributions of) expertise: acceptance of another’s appeal to expert opinion may be construed as tacit agreement that inquiry, for now, has been taken far enough. Acquiring expertise in a task is often thought of as an automatic process that follows inevitably with practice according to the log‐log law (aka: power law) of learning. However, as Ericsson, Chase, and Faloon (1980) showed, this is not true for digit‐span experts and, as we show, it is certainly not true for Tetris players at any level of expertise. Although some people may simply “twitch” faster than others, the limit to Tetris expertise is not raw keypress (...) time but the techniques acquired by players that allow them to use the tools provided by the hardware and software to compensate for the game's relentlessly increasing drop speed. Unfortunately, these increases in drop speed between Tetris levels make performance plateaus very short and quickly followed by game death. Hence, a player's success at discovering, exploring, and practicing new techniques for the tasks of board preparation, board maintenance, optimal placement discovery, zoid rotation, lateral movement of zoids, and other tasks important to expertise in Tetris is limited. In this paper, we analyze data collected from 492 Tetris players to reveal the challenges they confronted while constructing expertise via the discovery of new techniques for gameplay at increasingly difficult levels of Tetris. We sometimes seek expert guidance when we don’t know what to think or do about a problem. In challenging cases concerning medical ethics, we may seek a clinical ethics consultation for guidance. The assumption is that the bioethicist, as an expert on ethical issues, has knowledge and skills that can help us better think about the problem and improve our understanding of what to do regarding the issue. The widespread practice of ethics consultations raises these questions and more: What would (...) it take to be a moral expert? -/- Is anyone a moral expert, and if so, how could a non-expert identify one? -/- Is it in any way problematic to accept and follow the advice of a moral expert as opposed to coming to moral conclusions on your own? -/- What should we think and do when moral experts disagree about a practical ethical issue? The Hong and Page ‘diversity trumps ability’ result has been used to argue for the more general claim that a diverse set of agents is epistemically superior to a comparable group of experts. Here we extend Hong and Page’s model to landscapes of different degrees of randomness and demonstrate the sensitivity of the ‘diversity trumps ability’ result. This analysis offers a more nuanced picture of how diversity, ability, and expertise may relate. The weaponizing of scientific expertise to oppose regulation has been extensively studied. However, the relevant studies, belonging to the emerging discipline of agnotology, remain focused on the analysis of empirical corruption: of misinformation, doubt mongering, and other practices that cynically deploy expertise to render audiences ignorant of empirical facts. This paper explores the wrongful deployment of expertise beyond empirical corruption. To do so, I develop a broader framework of morally subversive expertise, building on recent work in (...) political philosophy (Howard, 2016). Expertise is subversive if it sets up its audience to fail morally, either intentionally or negligently. I distinguish three modes of subversive expertise: empirical subversion (the focus of agnotology), normative subversion and motivational subversion. Drawing on these distinctions, I offer a revisionary account of the Trump Administration’s regulatory science as a case study. I show that the Trump Administration’s use of expertise to dismantle climate regulation, contra the standard charge, cannot be explained using the resources of agnotology alone: the Administration produced highly reliable climate assessments, detailing the risks of climate change, candidly admitting the harms of its proposed policies, and still successfully deployed these findings to justify massive climate deregulation. The lesson of the analysis is that dismissing the expertise that underpins climate deregulation as empirically corrupt ‘anti-science’ both obscures its actual role in the politics of climate change and understates its wrongfulness: it misses the breadth of the assault on moral agency that sustains climate injustice.
