In China, neither reproduction and parenthood by lesbian couples nor their marital status are regulated or protected by law. In 2020, the first legal dispute in China involving a lesbian couple over custody of their joint baby was heard in court. This study examines the legal and ethical issues that lesbian couples confront when they decide to give birth to a child of their own. These challenges begin with regulatory restrictions on their lawful access to assisted reproductive technology and (...) extend to gaps in the legal establishment of parenthood. We found that the lack of access to legitimate reproductive assistance for lesbian couples in China has caused them to make efforts to circumvent laws and regulations to have a child. However, the legislative gaps later led to ethical dilemmas when resolving disputes over parenthood. This study discusses different accounts of establishing and determining natural parenthood in China and concludes by pointing out the urgent need for change in legislative and sociocultural attitudes toward both assisted reproductive technology and same‐sex relationships, mapping the way forward for lesbian couples to obtain better protection of procreation and parenthood before their marriage is culturally accepted and finally legalized. One of the explanations frequently offered for current social problems is the breakdown of the family as an institution and the decline of values such as trust and responsibility that were until recently associated with it. While the philosophical position of many commentators in this area is rooted in a broadly utilitarian social philosophy, there is a case for an alternative—i.e. non-utilitarian—philosophical point of view. The essential requirement for such an alternative approach is that it accords a place to (...) certain moral absolutes: promises, principles, obligations, and the rights accruing to others as a result of those obligations. Currently procreation, marriage, and family life are being subjected to unprecedented shifts in both meaning and practice, and this is a situation in which a Kantian approach, especially the Kantian dictum that persons should not be treated solely as means to other people's ends, can find new contemporary applications. An unqualified utilitarian spirit has led us into a world where parenthood and child-raising have been split from each other and where money changes hands for the elements of child-making and for the labour of gestation. The pressure for the new constructivist consensus is strong, but so is the case against a trivial or unnecessary extension of choice in procreation and against the increasing commercialisation of human conception. In these circumstances, Kantian ethics has a distinctive role to play in assessing the values at issue in today's ‘new families’ debate. (shrink)

This work considers such issues as the nature and justification of parental rights, the sources of parental obligations, the value of autonomy, and the moral obligations and tensions present within interpersonal relationships.

Inside the family, all individuals define their identity in relation to previous generations, the present ones, and the future ones. This intergenerational exchange plays important educational roles: it fosters a sense of belonging and identification, promotes dialogue, and guarantees the passing down of ethical orientations. In addition to feelings of security and reliance on others, family memory creates a matrix that gives people a placement in the world, a sort of existential code through which to be located in (...) existence. Fostering the habit of memory-making becomes therefore a major educational imperative, which however is not without challenges. The present contribution will consider those phenomena which can give rise to a weakening of bonds between generations and a growing exclusion of the ethical value of family heritage. Marriage and family are obviously central to Confucian ethics. Perhaps the most oft‐repeated exhortation in the Analects is the duty of children to care for parents. There is little in the Daodejing or Zhuangzi on marriage and family. Relative silence suggests that Daoism does not place much importance on the formal institutionalization of interpersonal commitments. Male and female instinctually complement one another, and their pairing opens the way to reproduction, a major theme of the Daodejing. The Daodejing certainly (...) suggests that heterosexual unions are commonplace and potent. A modern Confucian perspective could be affirmative. If we take the most basic Confucian principles—humanity, ritual, and duty—shorn of any gender implications, it is by no means necessary that they would deny same‐sex marriage. Contemporary Confucians would have an initial presumption against divorce. Marriage, of any sort, is a solemnly declared commitment and, as such, it should be respected and preserved. (shrink)

The family disrupts equality while also, think many, providing goods of unique value. In Family Values, Brighouse and Swift tackle both of these tendencies, offering a refined and distinctive liberal egalitarian account both of the value of family life, and the limits of what may be done in its name. It builds up from an account of children's specific interests to a defence of ‘familial relationship goods’ as providing the best way of satisfying those interests. Thus though (...) parenthood carries goods of its own, parental prerogatives are delimited by what is good for children. The position which emerges plays out in nuanced, sometimes surprising ways. I raise three main lines of potential criticism, concerning, respectively, the distribution of family relationship goods, their value in relation to fair equality of opportunity, and the viability of distinguishing between family-located and other contributions to the realisation of a child's interests. In the traditional system of Chinese families, individuals are embedded in the institution of the family with defined obligations to enhance family development. As a consequence of the male-biased sex ratio at birth in China since the 1980s, an increasing number of surplus rural males have been affected by a marriage squeeze becoming involuntary bachelors. Under China’s universal heterosexual marriage tradition, family development of rural involuntary bachelors has largely been ignored, but in China’s gender-imbalanced society, it is (...) necessary to adopt a family-based approach to identify and study the plight of rural involuntary bachelors. Studies on gender imbalance indicate that these men face multiple risks from the perspectives of their life course, the family life cycle, and the family ethic. To a certain extent, these risks are caused by a conflict between the individual’s family life and family ethics and are mainly reflected in problems concerning marriage, health, and old-age support. Not only do these vulnerabilities affect the individual and family development across the whole life cycle but also pose major risks to social development in the face of strong gender imbalance. In order to deal with risks faced by rural involuntary bachelors, core ethical principles, including autonomy, beneficence, and justice, need to be adopted. Through adjustments to informal support provided by the family and formal support provided by policy-makers, risk of uncertainty in family development faced by rural involuntary bachelors could be reduced. Recent decades have seen the facilitation of unconventional or even extraordinary reproductive endeavours. Sperm has been harvested from dying or deceased men at the request of their wives; reproductive tissue has been surgically removed from children at the request of their parents; deceased adults’ frozen embryos have been claimed by their parents, in order to create grandchildren; wombs have been transplanted from mothers to their daughters. What is needed for requests to be honoured by healthcare staff is that they align (...) with widely shared expectations about what people’s reproductive potential ought to be, what marital relationships ought to result in, and which kinds of ties are desirable between parents and children. Costly and invasive technologies are not considered excessive when they are used to support the building of appropriate families. However, deviations from dominant reproductive norms, even if technologically simple and convenient to the participants, are unlikely to receive support. In this paper, we offer examples of such deviations and explore their implications. If reproduction is important as a way of creating genetic relationships, should reproductive material in storage be offered to genetic relatives other than the people from whom it originated? And if parents are allowed to have reproductive material collected from their offspring, or even to use it to create babies, should offspring likewise be allowed to use their parents’ reproductive material? We tackle these questions and suggest ways in which interests in genetic ties could be operationalised in a more coherent and less-invasive manner than they currently are. (shrink)

This article engages the views of PRC Confucian scholars who responded to the United States Supreme Court Justice Anthony Kennedy's citing of Confucius in his majority opinion on same-sex marriage in 2015. It questions their separation of tolerance for homosexuality from legalization of same-sex marriage and argue that tolerance is not enough. The arguments in the mainland Confucian discourse about same-sex marriage highlights the historical and persistent entanglement of Confucianism with patriarchy. Instead of reviving traditional patriarchal society, further entrenching and (...) increasing gender inequality, contemporary Confucianism could shape its own unique modern society that aspires to (and hopefully one day achieving) gender equality together with sexual inclusivity by deconstructing the patriarchal Confucian family and reconstructing a different Confucian family ideal. Accepting same-sex marriage would lend weight to the latter, and there are Confucian reasons for legalizing same-sex marriage and recognizing its ethical value. (shrink)

Bangladesh is a Muslim-majority society with more than 163 million people. Most Bangladeshis hold the ideals of Islamic norms and values which is manifest in all sorts of socio-cultural behaviour. In reference to such values, the tradition of legitimizing child marriage in Bangladesh is the issue that needs to be addressed in a holistic yet rigorous approach. Currently Bangladesh ranks 4th in the world and 1st in Asia in terms of child marriage. Recently the Child Marriage Restraint Act 1929 has (...) been abolished and it has been replaced by the Act of 2017 preserving article 2 of the previous statute, the legal age for marriage for a boy 21 and for a girl 18. This Act adds article 19 which legalizes minors (below 18 years of age) to be married off with the consent of the parents/guardians at the presence of a magistrate under “special circumstances” deemed with securing the best interest for them. The law artfully coincides with the Muslim Marriage Law which allows participants of 15 years and above to get legally married and as such contradicts the international law and the Act of 2017 itself. In the West intimate relationships including extra-marital cohabitation before reaching 18 years of age are culturally accepted. In contrast, such extra-marital and intimate relationships are strictly prohibited in Muslim-majority societies, which are dearly adhered in Bangladeshi Muslim culture. This study examines how the religious cultural and socio-economic realities influence child marriage practice in Bangladesh. Along with secondary documents, we interviewed 22 individuals including the Deputy Commissioner, the District Women and Children Affairs Officer, elected Union Parishad Chairman and Members, Social Workers, married couples and their parents/guardians at Manikganj district. In addition, we also conducted a mass survey with 62 randomly selected participants, and a voluntary online survey where the opinion of another 53 young students were collected to find broad opinion. We also collected stories of how marriages take place at the rural, urban and sub-urban areas in Bangladesh. The study has revealed that Bangladeshis does not support marriage at early ages but socio-economic reality often pushes poor into getting their children married at early ages. Many view that the special provision may encourage child marriage in the country. This study suggests that the government of Bangladesh should redefine public policy in regard to finding a middle ground between Islamic ethics and international values by exploring isomorphic mimicry and other socio-culturally accepted measures with a view to abolishing child marriage successfully. The general crisis of capitalism embraces all spheres of the life of society and, in the final analysis, is reflected in the life of each individual. The family is no exception in this regard. Problems of disorganization and disintegration of the family and marriage, the breakdown of traditional moral norms regulating familial and marital relationships and sexual behavior, have become subjects of close attention by philosophers, sociologists, educators, and physicians. The number of items published on these problems increases (...) from year to year. One is struck, in this regard, by the extreme diversity of criteria in the approaches to the study of these problems. Of course, this may be partially explained by the complexity of the subject under study. But in the case in point, the reason is primarily the presence of acute social contradictions in capitalist society itself, of methodological and ethical pluralism, and of the extreme contradictoriness of the initial theoretical positions characteristic of bourgeois social thought. For example, within a single collection, Sociology and Social Problems. A Conceptual Approach , one may find not only different but even mutually exclusive points of view on the same question. But for all the diversity of starting points, approaches and arguments, styles and methods of presentation, it is still possible to identify two common features that mark all such writings to some extent:1. The standards of consumer society are taken as model. Withrespect towoman's work in employment [outside the home], this is expressed in the attitude toward her career and her power . Development of parental roles in the family is associated with parents' capacities to assure, in the course of socializing their children, that they will subsequently advance. The relationships between spouses are regarded as harmonious only if a mutual attitude toward success outside the family and toward a high level of sexual activity, which creates a special kind of prestige, particularly for the man, is achieved. Consumerist attitudes are revealed, perhaps most vividly, in the approach to sexual behavior and corresponding norms of morality. Even in the writings of scholars striving for objectivity, overestimation of the significance and role of sexual activity is a factor. Most works are characterized by a spirit of negation of the traditional norms of sexual morality of Western European culture. (shrink)

This book defends the thesis that Kant's normative ethics and his practical ethics of sex and marriage can be valuable resources for people engaged in the contemporary debate over same-sex marriage. It does so by first developing a reading of Kant's normative ethics that explains the way in which Kant's notions of human moral imperfection unsocial sociability inform his ethical thinking. Gendered Morality offers a textual-critical examination of gender in Islamic metaphysics and virtue ethics. In Nigeria, reproduction is highly valued, with many people desiring to produce a child ‘in their own image and likeness’. Previously, aspiring parents often resorted to adoption. Today, the availability of assisted reproductive technologies (ARTs) has provided options other than adoption for those desiring to procreate. Through ARTs, aspirations for a family may be attained through an exchange of reproductive goods and services, and not necessarily through traditional heterosexual relationships. ARTs have altered the perception of parenthood as it (...) exists in Nigeria, and courts face a difficult task in defining parenthood within Nigerian jurisprudence, as they can only adjudicate based on extant law. Although ARTs provide greater individual choices for fulfilling the desire to procreate, they raise a number of ethical and legal issues that evolving legal systems, such as that in Nigeria, are ill‐equipped to manage. This paper describes the traditional assignment of parenthood under indigenous laws and other sources of law within the Nigerian jurisprudence. We carried out an in‐depth study of the Nigerian legislative framework and found that there are no laws directly regulating parenthood, procreation and ARTs in Nigeria. We also found that the extant laws are only tangentially related and do not answer the relevant questions sufficiently well, especially concerning succession, nationality and assignment of responsibility in collaborative reproduction. We conclude by highlighting the need for and recommending a regulatory framework on ARTs with a particular focus on providing a definition for parenthood achieved through ARTs in Nigeria. (shrink)

This chapter expresses that radical feminist perspectives on marriage and motherhood are in danger of being lost in the quest for equal rights. For more than a decade, feminist philosophers and lesbian/gay activists have been optimistic about the potentialities of legal marriage and legitimated motherhood. Feminist philosophers are taking as valuable theoretical paradigms for ethics many kinds of caring relationships that have been salient in women's lives. "Family" is itself a family resemblance concept. Apart from the institution of (...) marriage and historical ideals of the family, it is uncertain what characteristics mother‐child relationships would have, for many alternatives are possible. Historically, motherhood has been a core element of patriarchy. Moral philosophy might also be transformed by greater attention to the fact that adult experience and its potentialities are significantly conditioned by the childhoods of adults and of those children's relationships to adults. Even though co‐parenthood is one of the most significant close personal relationships that people can have, there is relatively little philosophical work on the moral duties that co‐parents owe each other. This may be due to the increasingly questionable assumption, still common in our societies, that co‐parenthood arises naturally from marriage or romantic coupledom and thus that commitment to a co‐parent evolves from a commitment to a marital or romantic partner. In this article, we argue that co‐parenthood (...) should be seen as a relationship in its own right, which generates specific moral duties. Co‐parents should come to explicit agreements with each other regarding the most important areas of potential conflict between them. Such agreements may have to be renegotiated over time. We explore some possible non‐negotiable co‐parental duties such as the duties not to alienate the child from the other parent(s) and not to trap a co‐parent in a particularly vulnerable situation. We consider some legal and societal implications of our argument and, finally, suggest some pragmatic benefits of our proposal. (shrink)

A proposta deste artigo é a de buscar entender as formas de como a Igreja Católica procurou adentrar nas bases psicológicas dos cristãos por meio da Constituição Pastoral Gaudium et Spes em seu Capítulo I intitulado “A promoção da dignidade do matrimônio e da família”. A Instituição insistiu no argumento segundo o qual a união entre homem e mulher constitui um sacramento essencial à família, à sociedade, à moralidade, à boa conduta, à ética e, por fim, à salvação da alma. Pode-se vislumbrar, na construção de tal argumento, um amplo uso de “jogos psicológicos”, sustentados na concepção que buscava transformar o matrimônio em uma macro-política cotidiana da moral, a qual tinha por fim convencer e, por conseguinte, ligar homens e mulheres por meio da idéia da indissolubilidade do matrimônio. O aparato teórico da aqui chamada macro-política cotidiana da moral permite compreender como a Igreja Católica jamais esteve alheia às mudanças que se operavam em meados do século XX. Usos Psicológicos.This article aims to understand the ways used by the Catholic Church in order to enter in the psychological foundations of Christians through the Pastoral Constitution Gaudium et Spes in Chapter I entitled “The promotion of the dignity of marriage and the family”. The institution insisted on the argument that the union between man and woman is an essential sacrament to the family, society, morality, good conduct, ethics and, finally, to the salvation of the soul. One can envision, in the construction of such an argument, an extensive use of “mind games”, supported the concept that sought to transform marriage in a macro-politics of everyday morality, which was intended to convince and therefore call men and women through the idea of the indissolubility of marriage. The theoretical apparatus here called the macro-politics of everyday morality allows us to understand how the Catholic Church has never been alien to the changes which were taking place in the mid-twentieth century. Internationally, there is considerable inconsistency in the recognition and regulation of children's genetic connections outside the family. In the context of gamete and embryo donation, challenges for regulation seem endless. In this paper, I review some of the paths that have been taken to manage children' being closely genetically related to people outside their families. I do so against the background of recognising the importance of children's interests as moral status holders. I look at recent qualitative research involving donor-conceived (...) people and borrow their own words to make sense of a purported interest to know (of) their close genetic ties. I also review ways in which gamete donation may have facilitated new kinds of kinship, which are at the same time genetic and chosen. In short, in this paper, I explore what meaning there could be in genetic connections that is not about parenthood. Further, I argue that the focus on parenthood in previous work in this area may be detrimental to appreciating some of the goods that can be derived from close genetic connections. (shrink)

Feminist philosophers are right to criticize Hegel’s prejudices against women. In many of his works, Hegel reduces women to their physiology as means of explaining why they occupy a subordinate role in nature and in society. Such treatment seems arbitrary at best, for the gendering of roles disrupts Hegel’s dialectical approach to spirit without any meaningful gain. Despite this defect in Hegel’s work, what is positive in Hegelian social and political philosophy remains intact. In this paper I argue that the (...) sexist claims that Hegel makes about women are irrelevant to his theory of the family in the Philosophy of Right. Therein, Hegel outlines three components that are necessary for the completion of the family: marriage, property and assets, and the raising of children. Hegel also includes a description of the different roles occupied by family members and divides these roles along gender lines. Given the three components that are essential to the family, I argue that there is no necessary basis for familial roles to be divided by gender. (shrink)

The Christian does not live in a vacuum, says the author, but in a world of government, politics, labor, and marriage. This reality is not manifest in the Church as distinct from the secular world such a juxtaposition of two separate spheres, Bonhoeffer insists, is a denial of God's having reconciled the whole world to himself in Christ. On the contrary, God's commandment is to be found and known in the Church, the family, labor, and government. His commandment permits man to live as man before God, in a world God made, with responsibility for the institutions of that world. (shrink)

The aim of the article is to critically question whether the church is still able to guide people to make meaningful choices with regard to marriage and sexuality when values keep shifting. This question is especially relevant where the church still tends to uphold premodern values (heteronormative, patriarchal, monogamous) with regard to sexuality and marriage as the only (prescriptive) model for marriage in a postmodern world.
