Este texto pretende apresentar algumas posições sobre o problema do gênero, na modernidade. Partindo do diagnóstico de Foucault de que os processos de constituição e de produção do sujeito implicariam ter um modelo de autodeterminação de si, buscamos pensar o problema do gênero por duas vertentes: por um lado, uma proposta de Butler, em que a sexualidade não poderia ser determinada, pois ela sempre resistiria a qualquer forma de normatização; por outro, uma luta por reconhecimento da individualidade que procura incluir (...) todas as possibilidades de autorrealização de si, na esfera jurídica. Nossa proposta é avaliar esses dois modelos e questionar o que poderia estar mais próximo das demandas sociais em relação ao problema do gênero e, de um modo mais amplo, do problema da identidade individual. This paper aims to present certain positions regarding the question of gender in modernity. Starting from Foucault’s diagnosis that the processes of the constitution and production of the subject involve having a model of self-determination, we have attempted to reexamine the question of gender from two different perspectives: on the one hand, Butler’s proposal that sexuality cannot be determined, since it always resists any form of normatization; on the other, the struggle for recognition of individuality which seeks the inclusion into the legal sphere of all possibilities for self-fulfillment. Our aim is to evaluate these two models and to question which of the two might be closer to social demands connected to the issue of gender and, more broadly, the issue of individual identity. O artigo tem por objeto o exame de três registros de gritantes e distintos paradoxos na Doutrina do Direito de Kant. Registros feitos em tempos e contextos históricos diferentes por Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek atribuiu a Kant a mais paradoxal das proposições jamais enunciadas por qualquer autor, a de que a mera ideia de soberania deve obrigar-nos a obedecer como a nosso inquestionável senhor a quem quer que se haja estabelecido como tal, sem que (...) caiba indagar quem lhe deu o direito de comandar-nos. Willaschek aponta a incompatibilidade de duas teses centrais da doutrina kantiana: a do caráter externo dos vínculos jurídicos e a da incondicionalidade obrigacional do direito positivo, pois não é possível entender como é possível termo-nos como obrigados por imperativos jurídicos e, ao mesmo, vermo-nos internamente isentados do dever de obedecê-los. O ponto crítico de Balthazar é alegar que não pode haver na filosofia kantiana uma crítica da razão político e jurídica, simplesmente porque o conceito de imputação, base da normatividade própria dessas esferas, pressupõe uma pluralidade de agentes livres que, justamente, só pode ser uma pressuposição, pois nosso acesso à normatividade prática só pode ter lugar em primeira pessoa. No exame a que o artigo submete essas alegações, o artigo argumenta, em objeção à tese de Balthazar, que o caráter universal e categórico da força que vincula o sujeito quando confrontado com a lei moral em primeira pessoa necessariamente se desvaneceria se, ao mesmo tempo, ele não fosse tomado pela evidência de que a realidade objetiva dos princípios morais é não só instanciável, mas assegurada pela múltipla instanciação. Com relação às dificuldades levantadas por Willaschek e Bouterwek, o artigo argumenta que o princípio exeundum e statu naturali, enquanto norma metapositiva, anterior à divisão do domínio prático entre doutrina do direito e doutrina da virtude, permite ao mesmo tempo compreender a exigência de obediência ao poder constituído e a restrição das obrigações jurídico-políticas exclusivamente ao foro externo.AbstractThe object of the article is to examine three claims about three distinct and allegedly blatant paradoxes in Kant's Doctrine of Right. These three critical points had been made in distinct times and contexts by Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek attributed to Kant the most paradoxical of all paradoxical propositions, the statement that by the mere idea of sovereignty we are obliged to obey as our lord who has imposed himself upon us, without questioning from where he got such right. Willaschek points out the incompatibility of two main theses of Kantian doctrine of right: the claims that the legal bounds are of external character and that they are the source of unconditional obligations, since it seems impossible to understand how it would be possible to be obliged by juridical norms and decisions and at the same time to be exempted of the internal duty of compliance. The radical objection of Professor Balthazar is the claim that in the context of Kantian Philosophy it is impossible to admit a critique of the juridical and political reason because the concept of imputation, ground of the normativity in these domains, requires not only the presupposition of free agents, but a true and secure epistemic access to them, which is, according to him, impossible considering that the moral law and the other practical principles are accessible for us only in the first person. In the course of the appraisal of such claims, the article contest that objection arguing that the universal and categorical force of the normative bound experienced by the subject when confronted with the moral law in the first person would ineluctably vanish if, at the same time, he had not been taken by the evidence that the objective reality of the moral principles is secured by multiple instancing. Regarding the difficulties raised by Willaschek and Bouterwek, the article argues that the principle exeundum e statu naturali, as a norm of meta-positive character, prior to the division of practical domains between the doctrine of right and the doctrine of virtue, is the cue both to the understanding of the requirement of unquestioning obedience to the constituted power and to the restriction of the validity of this requirement only in foro externo. A exposição ou enjeitamento de crianças foi fenômeno importado do velho mundo e amplamente aceito e praticado em território ibero-americano. A historiografia avançou sobre o tema nos últimos anos, entretanto, algumas lacunas ainda permanecem para desafio dos historiadores interessados no assunto. Uma dessas questões é detectar as singularidades regionais desse fenômeno tão recorrente ao território luso-brasileiro. Nesse sentido, o objetivo deste artigo é comparar o perfil da exposição de crianças e a assistência aos enjeitados em dois extremos da América portuguesa: (...) a freguesia de Porto Alegre em devoção a Nossa Senhora Madre de Deus no Rio Grande do Sul, e a freguesia da Cidade do Natal em devoção a Nossa Senhora da Apresentação no Rio Grande do Norte. A partir de fontes seriais, como os registros de batismo e os termos de vereação das respectivas localidades, elencamos os seguintes procedimentos para análise – leitura, transcrição e fichamentos qualitativos e quantitativos, seguidos da comparação de aspectos demográficos que podem nos trazer realidades adversas. Sendo assim, esse esforço de pesquisa resultou na identificação de baixos índices de exposição, elevadas taxas de filhos ilegítimos e formas distintas de assistência aos recém-nascidos enjeitados estritamente ligados aos seus contextos locais. This paper examines and analyzes five definitions of ‘existential risk.’ It tentatively adopts a pluralistic approach according to which the definition that scholars employ should depend upon the particular context of use. More specifically, the notion that existential risks are ‘risks of human extinction or civilizational collapse’ is best when communicating with the public, whereas equating existential risks with a ‘significant loss of expected value’ may be the most effective definition for establishing existential risk studies as a legitimate field of (...) scientific and philosophical inquiry. In making these arguments, the present paper hopes to provide a modicum of clarity to foundational issues relating to the central concept of arguably the most important discussion of our times. The aim of the present study was to determine statistical differences in a set of badminton competition matches in five different modalities with regard to competition level (Group Phase versus Eliminatory Phase). Data from 453 sets (125 in men’s singles; 108 sets in women’s singles; 77 sets in men’s doubles; 73 in women’s doubles and 70 in mixed doubles) from the RIO 2016 Olympics Games were recorded and classified in two groups of variables to analyse variables related to match (5) (...) and set (15). A descriptive analysis and univariate test (Mann Whitney U) for non-parametric data were conducted. The results show in men’s and women’s singles all the variables related to match were higher in the Elimination Phase than in the Group Phase (p<0.01). In Sets 1 and 3, the longest set duration, rally and average rally were found in the Elimination Phase than Group Stage (p<0.05). In women’s singles, these differences were also recorded in Set 2. For doubles, the results are more stable among groups. Men’s doubles had a longer duration of the match and set (set 1 and set 2) (p<0.01), and also scored highest for average rally strokes (set 1 and set 3) (p<0.05) and shuttles used in the Elimination Phase versus the Group Phase along the match (p<0.01). In women’s doubles, more shuttles were used in a match in the Elimination than in the Group Phase. Moreover, the same results are established for Set 2, including for average rally. Mixed doubles saw no match going to three sets. However, the greatest differences showed a longer rally and average rally being registered in the Elimination than in the Group Phase. In conclusion, the timing factors of the badminton singles and doubles games were different in the Elimination and Group Phases. This information may help players and coaches prepare and administer different types of workouts or, more specifically, competition schedules adapted to the characteristics of modern badminton. The first goal of this paper is to reply to a number of criticisms levied by Gunnar Breivik and Robert L. Simon against an account of sporting skills I published almost 20 years ago in which I distinguished between constitutive and restorative skills and examined their normative significance. To accomplish this goal, I first summarize my characterization and classification of skills and then detail the criticisms. After responding to the latter, and thus reconsidering and hopefully strengthening my account of skill (...) in sport, I turn my attention to Scott Kretchmar and Tim Elcombe’s inquiry into the skills involved in competitive sport. These authors claim that contesting skills demand the same respect usually accorded to testing skills. The second goal of this paper is then to explore Kretchmar and Elcombe’s inquiry under the light of my reconsidered analysis of skill. I specifically advocate a plausible relationship, both in terms of their distinctive character and relative import, between testing and contesting skills and constitutive and restorative skills. In doing so, I seek to present a more comprehensive account of skill in non-competitive and competitive sport. (shrink)

The global spread of the novel coronavirus is affected by the spread of related misinformation—the so-called COVID-19 Infodemic—that makes populations more vulnerable to the disease through resistance to mitigation efforts. Here, we analyze the prevalence and diffusion of links to low-credibility content about the pandemic across two major social media platforms, Twitter and Facebook. We characterize cross-platform similarities and differences in popular sources, diffusion patterns, influencers, coordination, and automation. Comparing the two platforms, we find divergence among the prevalence of popular (...) low-credibility sources and suspicious videos. A minority of accounts and pages exert a strong influence on each platform. These misinformation “superspreaders” are often associated with the low-credibility sources and tend to be verified by the platforms. On both platforms, there is evidence of coordinated sharing of Infodemic content. The overt nature of this manipulation points to the need for societal-level solutions in addition to mitigation strategies within the platforms. However, we highlight limits imposed by inconsistent data-access policies on our capability to study harmful manipulations of information ecosystems. (shrink)

This paper explores the commitment to corporate citizenship on the part of the largest U.S.-based multinationals in the emerging market region of Latin America. The websites of the largest U.S.-based firms - according to the 2007 Fortune 500 list - are reviewed and their CSR efforts in Latin America are noted. The firms' positions on corporate citizenship in Latin America are mapped onto a three-by-three matrix in which firms' commitment to corporate citizenship ranges from profitmaking motivations to a more holistic (...) approach where support for non-profit causes is embraced by the entire firm and implemented at all levels, 9-26, 2000). The largest U.S.-based multinationals were selected for this study because of their leadership role and the fact that other firms within their respective industries may seek to emulate the firms' level of commitment to corporate citizenship. While the matrix can be used to evaluate corporate citizenship efforts in any market - or globally - the emphasis in this study is on Latin America, a region of interest for two reasons: because of the paucity of research on this particular emerging market region as it relates to CSR, and because there is some evidence to suggest that philanthropic initiatives by the region's wealthy individuals lag behind individual philanthropic efforts in other world regions. In this paper, we argue that a rich phenomenological description of ?sweet tension? is an important step to understanding how and why sport is a meaningful human endeavour. We introduce the phenomenological concepts of intersubjectivity and horizon and elaborate how they inform the study and understanding of human experience. In the process, we establish that intersubjectivity is always embodied, developing and ethically committed. Likewise, we establish that our horizons are experienced from an embodied, developing and ethically committed perspective that serves (...) as the possibility for new intersubjective engagement. What follows is a discussion of the explanatory role of intersubjectivity and horizon in elucidating experiences of sweet tension in and through sport. The phenomenological account of sweet tension provides insights into the significance of our sporting experiences. Indeed, taking phenomenology seriously represents a commitment to descriptively elucidate what makes such experiences of sport significant and why we long for them. Recognising that sweet tension is a form of intersubjective horizon opens up new avenues for addressing ethical issues in sport as well as in crafting well-balanced games. (shrink)

The study of film adaptations, particularly those coming from literature, has been growing at a rapid rate during the last years due to the amount of adaptations coming from both mainstream and independent film industries. The focus of these studies though is generally addressed to best sellers where the literary style is clearly adaptable to the screen; however, there are cases where the adaptive process has resulted in an entirely different outcome. Naked Lunch, written by William Burroughs and adapted to (...) screen by David Cronenberg, represents a bold change if compared with other novels turned into films. The purpose of this article is to descriptively analyse the literary style in order to understand how it has been represented and adapted into Cronenberg’s film. The analysis will be performed helped with computer-based tools to support statements, using the novel itself as corpus and adding theoretical ideas from Leech and Short’s perspectives. The results suggest that the author’s corrosive, sexually-fuelled claustrophobic style has been translated following three patterns in terms of adaptation theory, although Burroughs, in the hands of Cronenberg, becomes an almost new classification of adaptation, not only adding literary features to the film, but also distinguishable core moments of the writer’s life to the final product. The analysis conducted encourages the study of other uncommon adaptations from literary authors in order to understand the adaptive process followed by filmmakers. (shrink)

The aim of this article is to determine the representation of persons with disabilities in the print media advertisements of Costa Rica during the period 2014-2016. In the first place, we analyze the advertisements on disability that have appeared in the three most widely circulated newspapers in Costa Rica, following the Fairclough’s budgets about the representation of social actors, inclusion and exclusion strategies, legitimization and explanation that are made of the PCD in the ads. We determine the actions performed by (...) the PDC in the analyzed texts, the relationships with other people that appear in the announcements. Finally, from a multimodal perspective of Kress and Van Leeuwen, through the visual analysis and its relation with the linguistic one, we analyzed the congruent or incongruent images that are promoted in the advertising discourse. It is concluded that there is an invisibility of this population; since the number of ads on disability is less than 0.0015% and that the speech reproduces stigmas and stereotypes from a social- assistance perspective of the PCD, even though it is the State the main advertiser of the ads. In Unfit for the Future, Ingmar Persson and Julian Savulescu argue that our collective existetial predicment is unprecedentedly dangerous due to climate change and terrorism. Given these global risks to human prosperity and survival, Persson and Savulescu argue that we should explore the radical possibility of moral bioenhancement in addition to cognitive enhancement. In this article, I argue that moral bioenhancements could nontrivially exacerbate the threat posed by certain kinds of malicious agents, while reducing the threat of other kinds. This (...) introduces a previously undiscussed complication to Persson and Savulescu's proposal. In the final section, I present a novel argument for why moral bioenhancement should either be compulsory or not be made available to the public at all. (shrink)

Most studies investigating the relationship between cultural constructs and ethical perception have focused on individual- and societal-level values without much attention to other type of cultural constructs such as social beliefs. In addition, we need to better understand how social beliefs are linked to ethical perception and the level of analysis at which social beliefs may best predict ethical perceptions. This research contributes to the cross-cultural ethical perception literature by examining the relationship of individual-level social cynicism belief, one of five (...) universally endorsed social beliefs, together with individual social dominance orientation and the perception of unethical behavior. By means of two studies, we examine these relationships across societies that significantly differ on societal-level social cynicism belief. Using 371 business students from Russia and the U.S. in Study 1 and 268 professionals from Portugal and the U.S. in Study 2, we found that individual-level social cynicism belief was positively associated with social dominance orientation. Social dominance orientation, in turn, mediated the relationship between individual social cynicism belief and the perception of unethical behavior. Although we found significant societal-level differences in social cynicism belief in both studies, the relationships between individual-level social cynicism belief, social dominance orientation, and the perception of unethical behavior were structurally equivalent across societies in both studies, suggesting that societal-level differences did not significantly affect these relationships. Implications for cross-cultural business ethics research and practice are discussed. (shrink)

Este artigo é dividido em dez seções. Das seções 1 a 4, faz-se uma reconstrução da teoria schopenhaueriana da liberdade. Será mostrado que Schopenhauer adota uma definição negativa de liberdade, sendo esta a simples ausência de necessidade. A partir da quinta seção, mostramos que esta definição é insuficiente, pois a liberdade negativa restringe-se à inação. Em seguida, busca-se a partir de Schopenhauer uma definição positiva de liberdade. Julgamos encontrá-la na identidade entre Ser e Querer, pela qual o agente quer-se de (...) acordo com aquilo que se é, mas também é de acordo com aquilo que quer ser. Esta correspondência entre Ser e Querer — que também pode ser chamada de asseidade — encontra corroboração no sentimento de orgulho. (shrink)

Health means today something more than the absence of illness or suffering of disability, as the pioneer theories of health had assumed. To be healthy also involves not having genetic mutations that indicate inexorably premature dead or serious disabilities. Genetic tests, whose amount and use grow day by day, have open these predictive possibilities for medicine and, at the same time, influenced for a more strict notion of health. The pathology known as ‘Huntington’s Chorea’ is an example of this kind (...) of situations. Because of the concept of health has deep economical, ethical and legal implications –among others-, it is evident that its modification will influence on society, something that now is occurring in some medical practices. The transformation process of the notions of health and unhealth supports –albeit in part- the sociological thesis that affirm that west society is undergoing a geneticization process. (shrink)

En Practical Reality, Dancy mantiene que ambas razones se identifican con estados externos al agente--"tesis de la identidad" --. Hay dos argumentos en PR a favor de la TI: El primero se basa en una interpretación externista del significado de "tener una razón". El segundo presenta una vía indirecta, defendiendo que las adscripciones de razones según estados psicológicos internos no son casos centrales en las explicaciones normativas. (...) Estas dos críticas ignorarían una fuerte intuición normativa: el "acceso epistémico". Si ésta es persuasiva, los estados internos no pueden ser eliminables. /// This paper presents an alternative account to the dichotomy between normative and motivating reasons. In Practical Reality, Dancy argues that both types of reasons should be identified with external states of the agent--"identity thesis". There are two arguments in PR for the IT: one is based on an externalist interpretation of expressions like "A has a reason to x". The other is an indirect argument that claims that the ascription of reasons grounded on internal states cannot be central instances in normative explanations. Both arguments ignore a strong intuition: the "epistemic access". If this is a persuasive intuition, internal psychological states cannot be eliminated. (shrink)

Solo así puede iniciar ese camino de transformación que le permite ir de su condición terrenal, truncada por posesiones, miedos y limitaciones hacia una existencia en Dios plena en (...) el espíritu, en la gratuidad y en la libertad. Este camino conduce a la unión con Dios, pero ésta solo se alcanza a través del desasimiento de las cosas y del ego.For Eckhart the transformation of the human being operates from a progressive recognition that each one makes of his own creature condition in the light of God's intratrinitarian life. Human beings need to be freed from their constant insecurity and dependence on things and social conventions. Only in this way can he initiate that path of transformation which allows him to go from his earthly condition, truncated by possessions, fears and limitations to an existence in God full of the spirit, gratuitousness and freedom. El presente trabajo se divide en dos partes. En la primera parte, se explican las nociones fenomenológicas de temporalidad e historicidad de Maurice Merleau-Ponty, para interpretar la novela sin ficción de Javier Cercas, El Impostor. El personaje de la novela, Enric Marco, crea una identidad falsa como salvavidas a una realidad que no es capaz de ver o en la que no es capaz de existir. Explicaremos como este problema podría ser identificado, como una negación de la existencia. En la (...) segunda parte, ampliamos el análisis existencial hacia una descripción de la sociedad: cuán cerca estamos de ser Enric Marco. Acompañaremos esta segunda parte con textos breves de Merleau-Ponty, publicados al finalizar la Segunda Guerra Mundial, cuyos argumentos permiten describir las respuestas sociales a la violencia, las mismas que son semejantes a las descripciones que hace Cercas de la sociedad española, esto es, la incapacidad social para reincorporarnos o rehacernos frente a un presente confuso. O objetivo deste artigo é examinar a hipótese de que a teoria kantiana do direito público seja estruturalmente antinômica, a despeito de que Kant só lhe tenha admitido o aspecto paradoxal. Com efeito, a teoria kantiana do direito público simultaneamente sustenta: (i) que o ingresso dos homens em um estado juridicamente organizado depende da obediência ao comando da razão que nos ordena celebrar o pactum unionis civilis e aceitar a submissão a uma ordem constitucional civil; (ii) que devemos aceitar como (...) nosso legítimo soberano a quem quer que tenha condições de efetivamente impor seu poder sobre nós. Bons intérpretes como Bouterwek e Hermann Cohen pensaram, contudo, que a verdadeira dificuldade dessa análise é uma desconcertante confusão dos conceitos de soberano e de soberania. A hipótese que procuramos explorar neste artigo é a de que se obterá um melhor entendimento da posição de Kant se admitirmos que os dois planos de análise e as teses conflitantes a que se acaba de aludir estão em uma posição reciprocamente equivalente à que se encontram tese e antítese nas antinomias dinâmicas analisadas na "Crítica da razão pura". The aim of this paper is to examine the hypothesis that Kantian theory of public rights is founded on an antinomic conceptual structure, even though Kant only admitted the paradoxical character of his doctrine. Kant's theory on public right states, at the same time, that: (i) the access to a rightful condition is dependent on our compliance to the command of reason to celebrate the pactum unionis civilis and the corresponding submission of the citizens under a civil constitution; (ii) we shall accept as our legitimate sovereign whoever is able to impose his power over us. Good interpreters, as Bouterwek and Hermann Cohen thought, however, that the true difficulty with his analysis is that it contains an astonishing confusion of the concepts of sovereign and sovereignty. The hypothesis I would like to explore in this paper is that perhaps a better understanding of Kant's position on this theme can be obtained by admitting that the two levels of analysis and the conflicting thesis we found in his doctrine of public rights are in a position reciprocally analogous to that occupied by thesis and antithesis in the dynamical antinomies assessed in the Critique of Pure Reason.
