Louis Althusser is the blemish on the field of political theory. His barely explored and partly forgotten contributions are nonetheless formative for contemporary critical thought. Interestingly, at their very core his interventions are based on his own extensive readings of early modern political thought. Therefore, this study traces Althusser's readings of Machiavelli, Hobbes, Locke, Rousseau and Montesquieu and is the first to do so. Building on this, the study demonstrates how Althusser's new foundation of Marxism, which is very much alive (...) today, arises from this part of his work. Thereby, it becomes visible how the post-Marxist paradigm, which Althusser's many important students further developed, is formed through his readings of the classic thinkers of the bourgeois state. Vitalism is understood as impacting the history of the life sciences, medicine and philosophy, representing an epistemological challenge to the dominance of mechanism over the last 200 years, and partly revived with organicism in early theoretical biology. The contributions in this volume portray the history of vitalism from the end of the Enlightenment to the modern day, suggesting some reassessment of what it means both historically and conceptually. As such it includes a wide range of material, employing both historical and (...) philosophical methodologies, and it is divided fairly evenly between 19th and 20th century historical treatments and more contemporary analysis. This volume presents a significant contribution to the current literature in the history and philosophy of science and the history of medicine. (shrink)

The KK principle states that knowing entails knowing that one knows. This historically popular principle has fallen out of favour among many contemporary philosophers in light of putative counterexamples. Recently, some have defended more palatable versions of KK by weakening the principle. These revisions remain faithful to their predecessor in spirit while escaping crucial objections. This paper examines the prospects of such a strategy. It is argued that revisions of the original principle can be captured by a generalized knowledge iteration (...) principle, Weak-KK, which states that knowing entails the possibility of knowing that one knows. But Weak-KK is vulnerable to an unknowability result and therefore must be rejected. The arguments here suggest that retreating to weaker iteration principles is not an option for the KK enthusiast. Whistleblowing is an effective tool against fraud and corruption in organizations. However, as researchers have struggled to acquire data on actual whistleblowers, research relies on hypothetical intention data and student samples, which is seen as a major limitation. Using a field study of 1,416 employees from China, Germany, and Russia, the purpose of this article is to identify differences and similarities between intention and actual whistleblowing decisions, thus aiding research and interpretation of prior and future studies. I also contribute by (...) analyzing whether findings can be generalized across different cultures and whether status and power influence the whistleblowing process. My results reveal that the key difference between hypothetical and real decisions is not in variables that affect the process, but in effect sizes: Employees underestimate the effect of situational (retaliation) and organizational (compliance measures) variables in hypothetical compared to actual whistleblowing. Thus, reliance on intention research is not inherently problematic, when effect sizes are interpreted with caution. I also find that results are similar across countries and that status and power may not be decisive factors in whistleblowing. My findings should also be of interest to practitioners and policymakers, as they assist in designing effective whistleblowing systems and environments in organizations. (shrink)

Dass es so etwas wie Computerspiele tatsächlich gibt, ist im Gegensatz zu der Frage, ob es Abstrakta wie allgemeine Eigenschaften oder fiktive Entitäten gibt, evident und unkontrovers. Spannender, weil alles andere als offensichtlich, ist aber die Antwort auf die Frage, was Computerspiele (...) eigentlich sind, oder anders formuliert, was Computerspiele zu Computerspielen macht, oder wieder anders gesagt, worin das Computerspiel-Sein beseht. Through a close reading of the two definitions of evil in the Introduction to Responses to Thalassios, this article points out a circular, cognitive-affective-somatic, genetic mechanism that St. Maximos the Confessor considers responsible for the initiation and transmission of the fallness as a human condition and the specific manifestation of it in the form of passions. It elucidates the first definition as mainly phenomenological, by identifying the circular mechanism and its behavioural expressions, and the second definition as more aetiological, by (...) explaining why this mechanism emerges and reemerges with the fallen humanity despite its catastrophic results. CONTRIBUTION: This article highlights a double genetic mechanism that St. Maximos the Confessor grasped within the fallen human condition as a curse solvable only in Christ, a notion largely carved out by previous Maximian scholarship, but fully explained and valuated here. In the traditional understanding, human dignity is often portrayed as a «final», «inherent», and «absolute» value. If human dignity as the core of the status of a human being did indeed have thos characteristics, this would yield a severe limitation for obligations that stem from the moral status of non-human animals, plants, eco systems and other entities discussed in environmental ethics; for obligations that arise from human dignity standardly take priority over the duties toward entities with non-human moral status. Yet, (...) many theorists of human dignity nowadays have given up the traditional picture in favour of a more «contingent» understanding of human dignity that abandons one or more of its traditional characteristics.In this paper, I argue that to the contrary, we have good reasons to think that the three characteristics of human dignity just mentioned can indeed be attributed to a value that deserves the name «human dignity». In a first part, I argue for a specific understanding of the three value characteristics under consideration. After these preliminaries, I show in a second part that given such an understanding, we have ample evidence that we can indeed say that human dignity is an inherent, absolute and final value; and also that these three characteristics are properties of a single value. One of the main moral costs of stare decisis lies in the continuous possibility of entrenching morally deficient decisions in the law. Although legal systems usually make provision for dealing with morally deficient precedents, there are cases in which the legal obligation of later courts to follow one of these precedents is undefeated. This possibility affects the overall justification of stare decisis. One traditional answer to this problem consists in accepting this moral cost, on the belief that the benefits of (...) stare decisis outweigh it. On this view, when there is an undefeated legal obligation to follow a morally deficient precedent, the court must simply follow precedent. In this article, I question this approach and defend an alternative solution. I argue that, under some conditions, a court facing a morally deficient precedent should have the power to either follow the precedent or suspend its application to the parties by ordering a temporary stay of proceedings and referring the case to a higher court with power to overrule the precedent. This proposal entails exercising an equitable power recognised by the legal system, which I defend against three possible objections. (shrink)

A general practice of precedent is one that can plausibly apply to any well-functioning legal system. This practice, which can be grounded in the Rule of Law, needs to make it the case that courts always have a legal reason for following relevant precedent – even if the precedent is morally suboptimal, so long as it is not evil. Without this reason, a precedent may be treated as having no legal influence for the later court (‘the Null Model’), and this (...) runs counter to the Rule of Law. On top of this reason, courts may have a general legal obligation to follow precedent – stare decisis – but this risks entrenching morally bad decisions in the law. We need, therefore, a type of reason that lies in between the Null Model and stare decisis as a necessary step for any future justification of stare decisis. But how can courts have a legal reason for following morally suboptimal precedent? They can have that reason, I argue, in virtue of a specific judicial duty, positively laid down in a legal source, which aims to advance the Rule of Law in an institutionalised way. Many philosophers have attempted to answer the ‘ethical question’: can the ethical value of an artwork ever contribute to its aesthetic value, and if so, how? In this paper, I consider a methodological question that arises out of this discussion: should attempts to address the ethical question use analytic tools found in contemporary philosophical literature, art criticism, or some combination of the two? I concur with arguments proposed elsewhere, which suggest that art criticism has an important role to play in (...) addressing the ethical question. However, I argue that any fruitful attempt to answer the question must defend some particular way of understanding the ethical value of artworks, which suggests that we should address what I label the ‘art question’: what is the role and importance of art? This question, I suggest, is one with which philosophers can usefully engage. This division of labour offers a way forward in addressing this important issue. (shrink)

Whistleblowing is regularly identified as corporate control mechanism to prevent and uncover fraud. We review and compare the legal situation for whistleblowers in the People’s Republic of China and India. In a survey of 942 employees from private companies in both countries, we take a look at the status quo of whistleblowing system implementation, explore preference of channels to disclose fraud or corruption, and analyze under which conditions and what kind of employees prefer external over internal whistleblowing. We find that (...) provisions for mandatory whistleblowing systems can be found in the law of both countries. In China in particular, protection is scattered across many different laws in the private sector. Indian companies seem to have systems in place more often, although this difference becomes smaller the larger the company. The general preference of internal over external channels is similar across countries. Our regression models suggest that external channels are preferred over internal ones when fear of retaliatory measures is higher, the company is smaller, and the whistleblower is female. In line with prior literature, the effect of fear of retaliation is moderated by gender: women are less influenced by retaliation. All in all, implementation of whistleblowing systems seems ubiquitous in both countries; legal protection and comprehensive measures to decrease retaliation are lacking. The present essay approaches two different conceptions of Enlightenment and modernity. The first part considers Michel Foucault’s understanding of modernity as an “attitude” or “critical ethos” belonging to that age, that necessarily questions that which we have come to be in various contingent processes ; the second part considers Jürgen Habermas’s proposal, which invites us to understand modernity as an “unfinished project”, as a certain potential or rational ideal that is still to be carried out. Towards the end of the (...) essay both stances are confronted, whereby an attempt is made to engage elements retrieved from each in a productive dialogue, and to raise some criticisms and observations regarding the sociohistorical conceptions of each author. This article explores how Chinese Daoist thought can address the need of an ethics that can cope with “the Anthropocene.” It explores the similarities between Daoist thought and posthumanist theories which arose partially as a response to the challenges of the Anthropocene. And it examines how Daoist thought can radicalize posthumanist thinking by means of an ethics based on a genuinely flat ontology that treats all things, human and nonhuman, as equal.

In moments of daring, some physical scientists consider problems of social inquiry, hoping naively that the methods of physical inquiry will provide them with special insight. In my own work on problems of industrial production where I am searching for “practical” means for optimizing production in some socially satisfactory sense, I find that the physical scientist cannot escape the responsibility for social inquiry. So far as I can understand the nature of this work, it requires for its fruitful pursuit a (...) methodology which leans heavily on the concepts of statistical control of Shewhart, of cybernetics of Wiener and of experimentalism of Singer, Churchman and Ackoff. This article examines an episode of Chilean history during the days of the dictatorship of General Pinochet: Ingrid Olderock’s life and her criminal actions against people such as Alejandra Holzapfel and others. I use a secular framework for ethical evaluations of human behaviour related to armed conflicts in Latin America. In that context, I engage the following steps. First, I describe Ingrid Olderock’s life, briefly summarising some facts about her educational and political environment based on Nancy Guzman’s Ingrid Olderock: The (...) Madame of the Torture Dogs. This description is complemented by chronicles recently published by Alejandra Matus. Second, I suggest that the ‘commander’ concept (a concept arising within the ethical distinction between active and reactive actions by Gilles Deleuze) helps to assess the case at hand. Finally, I follow the main idea that human activities can be determined without having a transcendent system of values – an idea traditionally linked with Spinoza’s and Nietzsche’s viewpoints, as declared by Deleuze. In der Medizinethik haben sich moralische Gründe, die die Würde des Patienten betreffen, gerade auch in Fragen am Lebensende als wichtige Grundlage praktischen Überlegens neben solchen des Wohlergehens und der Autonomie fest etabliert. Dabei hat es sich eingebürgert, zwischen Gesichtspunkten zu unterscheiden, die die kontingente Würde einer Person in den Blick nehmen, und solchen, die sich auf eine nicht-kontingente Würde ihrer Träger beziehen. In diesem Aufsatz möchte ich auf eine weitere Grundlage aufmerksam machen, die von Überlegungen, die von der Menschenwürde (...) der Betroffenen in beiderlei Art ihren Ausgangspunkt nehmen, verdeckt zu werden drohen: Moralische Gründe, die sich der Bewahrung oder Vermehrung des Sinns verschrieben haben, den Menschen in ihrem Leben sehen oder vermissen. Diese Sinn-Gründe, so mein Argument, weisen einige strukturelle Gemeinsamkeiten zu Würde-Überlegungen auf, die auf eine gemeinsame ontologische Grundlage und überlappende Gehalte beider zurückzuführen sind. Dessen unbeschadet haben beide Arten von Gründen eigenständige Funktionen beim Nachdenken über medizinethische Probleme; tatsächlich haben Gründe des Sinns im Falle moralischer Herausforderungen am Lebensende oftmals sogar den Primat in dem Sinne, dass sie konstitutiv in Würde-Gründe eingehen können und auch unabhängig davon auf moralisch relevante Gesichtspunkte verweisen. In Axel Honneths Recht der Freiheit (RF) dienen persönliche Beziehungen, zu welchen Honneth neben Familien- und Liebesbeziehungen auch die Freundschaft zählt, der Verwirklichung einer „besondere[n], schwer zu charakterisierende[n] Form von Freiheit“ (RF 233). Diese Behauptung fügt sich ein in die Kernthese des Rechts der Freiheit. Demnach vermochte es die „Freiheit im Sinne der Autonomie des Einzelnen“ innerhalb unzähliger „Vorstellung[en] vom Guten“ als einzige, die moderne Gesellschaft nachhaltig zu prägen, wohingegen alle anderen Werte, die in der Moderne wirkmächtig geworden sind, als (...) „Facette[n] der konstitutive[n] Idee der individuellen Autonomie“ (RF 35) verstanden werden müssen. -/- 454 -/- Wir argumentieren, dass Honneths Erörterung des Werts von Freundschaft in dreierlei Hinsicht sein Ziel verfehlt: Erstens zwingt sie Honneth zu einer radikalen Beschneidung des Freundschaftsbegriffs, indem er einen überzogenen Kontrast zwischen antiken und modernen Konzeptionen von Freundschaft zeichnet. Zweitens marginalisiert Honneth mit seiner Betrachtung andere Axiologien der Freundschaft, welche dieser gewichtige instrumentelle, konstitutive und finale Werte zuweisen. Drittens scheint selbst eine schwächer angelegte These, die den Wert, den Freundschaften für die individuelle Freiheit haben, auf die Stellung eines primus inter pares zurückstuft, immer noch den zentralen Wert, den Freundschaften für uns haben sollten, zu verfehlen. Dadurch wird Honneths Kernthese von der Exklusivität des Wertes der Freiheit für unsere Gesellschaft in Frage gestellt. (shrink)

In my research I will try to analyse Zugmunt Bauman reflection about human subject. This author applies rather identity than human subject, but I think we may admit Apple subjectivity instead of identity. Bauman's concept of model personality like a pilgrim on one hand and a stroller, vagabond and player on the other hand, link these categories of human subject. Identity of human subject is continually made "liquid" and has constant potency to change. In consequence, identity is an infinite aimless (...) process because its main determinant – certainty of future connected with values (truth or worth) – are to distort. Does identity in postmodern age is just a wish, which is not realized? Does identity prop on conflict in human existence and never is constant? I will try to go through that and another question and possible answers within Bauman philosophy. In the contemporary debate we see a strong tendency to make a distance to Maxim description. The main problems like truth, subject or knowledge are used in its context. This intellectual climate depends on the basic modernist guidelines. The Cartesian model of cognition especially the strong possibility of cognition is challenged. Lyotard, Foucault, Rorty or Bauman support that tendency. (shrink)

En este trabajo nos proponemos, en primer lugar, reconstruir brevemente el análisis de Michel Foucault acerca de la episteme moderna, para luego analizar algunos rastros que identificamos en ciertos textos del pensador francés sobre la episteme contemporánea. A los fines de lograr este cometido, en tercer lugar, analizamos algunos textos de algunos pensadores del posestructuralismo francés y de la Mass Communication Research. Finalmente, concluimos que el acontecimiento que da lugar a la reconfiguración del saber occidental y a la conformación de (...) la episteme contemporánea está relacionado con las cuestiones del sentido y de la información, que contribuyen a delinear los contornos de las características del hombre y el lenguaje en la nueva episteme.
