Judicial review by constitutional courts is often presented as a necessary supplement to democracy. This book questions its effectiveness and legitimacy. Drawing on the republican tradition, Richard Bellamy argues that the democratic mechanisms of open elections between competing parties and decision-making by majority rule offer superior and sufficient methods for upholding rights and the rule of law. The absence of popular accountability renders judicial review a form of arbitrary rule which lacks the incentive structure democracy provides to ensure rulers (...) treat the ruled with equal concern and respect. Rights based judicial review undermines the constitutionality of democracy. Its counter-majoritarian bias promotes privileged against unprivileged minorities, while its legalism and focus on individual cases distort public debate. Rather than constraining democracy with written constitutions and greater judicial oversight, attention should be paid to improving democratic processes through such measures as reformed electoral systems and enhanced parliamentary scrutiny. Richard Bett presents a ground-breaking study of Pyrrho of Elis, who lived in the late fourth and early third centuries BC and is the supposed originator of Greek scepticism. In the absence of surviving works by Pyrrho, scholars have tended to treat his thought as essentially the same as the long subsequent sceptical tradition which styled itself 'Pyrrhonism'. Bett argues, on the contrary, that Pyrrho's philosophy was significantly different from this later tradition, and offers the first detailed account of (...) that philosophy in this light. Bett considers why Pyrrho was adopted as the figurehead for that tradition: his answer suggests that we should distinguish two phases within Pyrrhonism, of which the initial phase is much closer to Pyrrho's own thought than is the better-known later phase. Bett also investigates the origins and antecedents of Pyrrho's ideas; in particular, Plato is singled out as an important inspiration. The result is the first comprehensive picture of this key figure in the development of philosophy. The humanity formulation of Kant's Categorical Imperative demands that we treat humanity as an end in itself. Because this principle resonates with currently influential ideals of human rights and dignity, contemporary readers often find it compelling, even if the rest of Kant's moral philosophy leaves them cold. John McDowell's "minimal empiricism" is one of the most influential and widely discussed doctrines in contemporary philosophy. Richard Gaskin subjects it to careful examination and criticism, arguing that it has unacceptable consequences, and in particular that it mistakenly rules out something we all know to be the case: that infants and non-human animals experience a world. Gaskin traces the errors in McDowell's empiricism to their source, and presents his own, still more minimal, version of empiricism, suggesting that a correct (...) philosophy of language requires us to recognize a sense in which the world we experience speaks its own language. In the absence of empirical confirmation, scientists may judge a theory's chances of being viable based on a wide range of arguments. The paper argues that such arguments can differ substantially with regard to their structural similarly to empirical confirmation. Arguments that resemble empirical confirmation in a number of crucial respects provide a better basis for reliable judgement and can, in a Bayesian sense, amount to significant \textit{non-empirical} confirmation. This book offers a powerful interpretation of the philosophy of William James. It focuses on the multiple directions in which James's philosophy moves and the inevitable contradictions that arise as a result. The first part of the book explores a range of James's doctrines in which he refuses to privilege any particular perspective: ethics, belief, free will, truth and meaning. The second part of the book turns to those doctrines where James privileges the perspective of mystical experience. The title alone of McCall’s book reveals its ambitious enterprise. The book’s structure is a long inference to the best explanation: chapters present problems that are solved by a single, ontological model. Problems as diverse as time flow, quantum measurement, counterfactual semantics, and free will are discussed. McCall’s style of writing is lucid and pointed—in general, very pleasant to read.

We discuss the proposal by Sebens and Carroll to derive the Born rule in Everettian quantum mechanics from a principle they call ‘ESP-QM’. We argue that the proposal fails: ESP-QM is not, as Sebens and Carroll argue, a ‘less general version’ of an independently plausible principle, ESP, and can only be motivated by the empirical success of quantum mechanics, including use of the Born rule. Therefore, ESP-QM cannot have the status of a meta-theoretical principle of reasoning and provides no viable (...) basis for deriving the Born rule. (shrink)

The relationship between mind and matter, mental states and physical states, has occupied the attention of philosophers for thousands of years. Richard Fumerton's primary concern is the knowledge argument for dualism - an argument that proceeds from the idea that we can know truths about our existence and our mental states without knowing any truths about the physical world. This view has come under relentless criticism, but here Fumerton makes a powerful case for its rehabilitation, demonstrating clearly the importance (...) of its interconnections with a wide range of other controversies within philosophy. Fumerton analyzes philosophical views about the nature of thought and the relation of those views to arguments for dualism, and investigates the connection between a traditional form of foundationalism about knowledge, and a foundationalist view about thought that underlies traditional arguments for dualism. New work in the foundations of ethics—extending the fitting attitudes analysis of value to yield a broader notion of normative fittingness as a (or perhaps even the) fundamental normative concept—provides us with the resources to clarify and renew the force of traditional character-based objections to consequentialism. According to these revamped fittingness objections, consequentialism is incompatible with plausible claims about which attitudes are truly fitting. If a theory’s implications regarding the fittingness facts are implausible, then this can be taken to cast (...) doubt on the truth of the theory. After clarifying the general structure of fittingness objections, and establishing how they can make character-based concerns relevant to our assessment of the truth of a moral theory like consequentialism, this chapter surveys some paradigmatic fittingness objections, showing how consequentialism can be defended against them. RICHARD RORTY has written one of the most important and challenging books to be published by an American philosopher in the past few decades. Some will find it a deeply disturbing book while others will find it liberating and exhilarating—both, as we shall see, may be right and wrong. Not since James and Dewey have we had such a devastating critique of professional philosophy. But unlike James and Dewey, who thought that once the sterility and artificiality of professional—and indeed (...) much of modern philosophy since Descartes—had been exposed, there was an important job for philosophers to do; Rorty leaves us in a much more ambiguous and unsettled state. I will examine Rorty’s book from a variety of perspectives, beginning with a general overview and then moving to more finely meshed descriptions. My aim is not only to illuminate the power and subtlety of Rorty’s analysis and to show its inner unity, but to locate basic issues that are left unresolved. (shrink)

It is often held to be definitive of consciousness that there is something it is like to be in a conscious state. A consensus has arisen that ‘is like’ in relevant ‘what it is like’ locutions does not mean ‘resembles’. This paper argues that the consensus is mistaken. It is argued that a recently proposed ‘affective’ analysis of these locutions fails, but that a purported rival of the resemblance analysis, the property account, is in fact compatible with it. Some of (...) the implications of this argument are briefly explored: it is suggested that the meaning of ‘what it’s like’ does not, in itself, have any special bearing on consciousness, and that the implications for the so-called ‘hard problem’ of consciousness are deflationary. Some features of the concept of a want, and of the explaining relation in which a want may stand to an action, have not received sufficient attention. In what follows we shall offer some suggestions and descriptions which may be one step toward remedy of this situationi. We shall be at pains to point out the extent to which the features we describe fit in with a conception of the explanations of actions conforming to the inferential (deductive or inductive) and (...) nomological patterns of scientific explanation, and also to point out where perhaps the fit is not so snug. This article examines Becker's thesis that the hypothesis that choices maximize expected utility relative to fixed and universal tastes provides a general framework for the explanation of behaviour. Three different models of preference revision are presented and their scope evaluated. The first, the classical conditioning model, explains all changes in preferences in terms of changes in the information held by the agent, holding fundamental beliefs and desires fixed. The second, the Jeffrey conditioning model, explains them in terms of changes in (...) both the information held by the agent and changes in her prior beliefs, holding her fundamental desires fixed. The final model, that of generalized conditioning, allows for explanations in terms of changes in the values of all three variables. Should government be neutral "on the question of the good life, or of what gives value to life"?1 Some political theorists propose that governmental neutrality is a core commitment of any liberalism worth the name and a requirement of justice. For them, neutrality is the appropriate generalization of the ideal of religious tolerance. The reputation and influence of Emmanuel Levinas has grown powerfully. Well known in France in his lifetime, he has since his death become widely regarded as a major European moral philosopher profoundly shaped by his Jewish background. A pupil of Husserl and Heidegger, Levinas pioneered new forms of exegesis with his post-modern readings of the Talmud, and as an ethicist brought together religious and non-religious, Jewish and non-Jewish traditions of contemporary thought. Richard A. Cohen has written a book which (...) uses Levinas' work as its base but goes on to explore broader questions of interpretation in the context of text-based ethical thinking.
