How much do animals matter--morally? Can we keep considering them as second class beings, to be used merely for our benefit? Or, should we offer them some form of moral egalitarianism? Inserting itself into the passionate debate over animal rights, this fascinating, provocative work by renowned scholar Paola Cavalieri advances a radical proposal: that we extend basic human rights to the nonhuman animals we currently treat as "things." Cavalieri first goes back in time, tracing the roots of the (...) debate from the 1970s, then explores not only the ethical but also the scientific viewpoints, examining the debate's precedents in mainstream Western philosophy. She considers the main proposals of reform that recently have been advanced within the framework of today's prevailing ethical perspectives. Are these proposals satisfying? Cavalieri says no, claiming that it is necessary to go beyond the traditional opposition between utilitarianism and Kantianism and focus on the question of fundamental moral protection. In the case of human beings, such protection is granted within the widely shared moral doctrine of universal human rights' theory. Cavalieri argues that if we examine closely this theory, we will discover that its very logic extends to nonhuman animals as beings who are owed basic moral and legal rights and that, as a result, human rights are not human after all. La primera parte desarrolla la conformación del grupo y sus principales fundamentos teóricos. It has been argued that belief in free will is socially consequential and psychologically universal. In this paper we look at the folk concept of free will and its critical assessment in the context of recent psychological research. Is there a widespread consensus about the conceptual content of free will? We compared English “free will” with its lexical equivalents in Lithuanian, Hindi, Chinese and Mongolian languages and found that unlike Lithuanian, Chinese, Hindi and Mongolian lexical expressions of “free will” do (...) not refer to the same concept free will. What kind people have been studied so far? A review of papers indicate that, overall, 91% of participants in studies on belief in free will were WEIRD. Thus, given that free will has no cross-culturally universal conceptual content and that most of the reviewed studies were based on WEIRD samples, belief in free will is not a psychological universal. While moral perfectionists rank conscious beings according to their cognitive abilities, Paola Cavalieri launches a more inclusive defense of all forms of subjectivity. In concert with Peter Singer, J. M. Coetzee, Harlan B. Miller, and other leading animal studies scholars, she expands our understanding of the nonhuman in such a way that the derogatory category of "the animal" becomes meaningless. In so doing, she presents a nonhierachical approach to ethics that better respects the value of the conscious self. Coetzee, Nobel Prize winner for Literature and author of _The Lives of Animals_, emphasizes the animality of human beings; Miller, a prominent analytic philosopher at Virginia Polytechnic Institute, dismantles the rationalizations of human bias; Cary Wolfe, professor of English at Rice University, advocates an active exposure to other worlds and beings; and Matthew Calarco, author of _Zoographies: The Question of the Animal from Heidegger to Derrida_, extends ethical consideration to entities that traditionally have little or no moral status, such as plants and ecosystems. Nichols and Bruno claim that the folk judge that psychological continuity is necessary for personal identity. In this article, we evaluate this claim. First, we argue that it is likely that in thinking about hypothetical cases of transformations, the folk do not use a unitary concept of personal identity, but instead rely on different concepts of ‘person’, ‘identity’, and ‘individual’. Identity can be ascribed even when post-transformation individuals are no longer categorized as persons. Second, we provide new empirical evidence suggesting (...) that the folk do not consider psychological continuity to be necessary for an individual to be categorized as a person or for ascribing identity over time and through transformations. In this, we assume, along with Nichols and Bruno, that folk judgments about identity can be read off the use of proper names. Two concepts of the internal should be distinguished in the current epistemic internalism/externalism debate: (1) the internal in an introspective sense as what is accessible by introspection and (2) the internal in a biological sense as what is inside the organism's nervous system. When "internal" is meant in the introspective sense, Goldman's process reliabilism is externalist, but when "internal" is taken in the biological sense, Goldman's process reliabilism is internalist. Goldman as a naturalist prefers "internal" in the biological sense, but (...) the concept is unsuitable for presenting the current epistemic internalism/externalism controversy. The AGM paradigm for belief revision provides a very elegant and powerful framework for reasoning about idealized agents. The paradigm assumes that the modeled agent is a perfect reasoner with infinite memory. In this paper we propose a framework to reason about non-ideal agents that generalizes the AGM paradigm. We first introduce a structure to represent an agent's belief states that distinguishes different status of beliefs according to whether or not they are explicitly represented, whether they are currently active and (...) whether they are fully accepted or provisional. Then we define a set of basic operations that change the status of beliefs and show how these operations can be used to model agents with different capacities. We also show how different operations of belief change described in the literature can be seen as special cases of our theory. (shrink)

In 2010, Connecticut implemented an offence prohibiting minors from engaging in sexting. This legislation was part of a range of reforms across the United States aiming to better tailor the criminal law’s response to youth sexting by distinguishing sexting from child abuse material. Drawing from submissions to the Connecticut General Assembly’s Sexting Bill, media reports and recent ‘sexting’ cases, this article adopts a feminist perspective and examines the justifications for and implications of this sexting statute. It argues that while aiming (...) to create a distinction between child abuse material and sexting through a ‘lesser’ offence, these paternalistic reforms are informed by some of the same logics shaping child pornography/child abuse material law. Therefore, this statute is situated on a continuum of paternalistic legislation which utilises the constitutive expressive function of the criminal law to register anxieties about young people’s sexual and technological practices. As a result, this statute conflates victims and perpetrators of image based sexual abuses and fails to meet its deterrent and protective aims. (shrink)

Para tanto, foram analisadas mensagens eletrônicas (hoaxes) que circulam na internet. Tais mensagens acabam por propor a segregação social de grupos minoritários. A temática base de tal remodelagem é garantida pela difusão do terror, que serve a estratégias de controle social.

Understanding the contributions and the implications of law and emotion scholarship requires an acknowledgement of the different approaches within it. A significant part of law and emotion scholarship is focused on arguing for the relevance of emotion and on identifying emotion in legal processes and actors. Other parts of it venture further to ask how law can affect the expression and content of emotions themselves. This scholarship challenges legal positivist foundations, as well as some other established divisions in thinking, both (...) in law, and more generally in the history of ideas. In this paper we report a study conducted in Mongolia on the scope of morality, that is, the extent to which people moralize different social domains. Following Turiel’s moral-conventional task, we characterized moral transgressions (in contrast to conventional transgressions) in terms of two dimensions: authority independence and generality of scope. Different moral domains are then defined by grouping such moral transgressions in terms of their content (following Haidt’s classification of morally relevant domains). There are four main results of the study. (...) First, since all five Haidtian domains were moralized by the Mongolian participants, the study provides evidence in favour of pluralism about moral domains. However, the study also suggests that the domain of harm can be reduced to the fairness domain. Furthermore, although the strong claim about reduction of all moral domains to the domain of fairness does not seem to hold a significant number of participants did indicate considerations of fairness across domains. Finally, a significant amount of participants moralized conventional transgressions a la Turiel, but it did not reach a statistical significance. (shrink)

In the current study, we examine the changes in disclosure practices on compliance and the fight against corruption at Siemens AG, a large German multinational corporation, over the period 2000–2011 during which a major corruption scandal was revealed. More specifically, we conduct a content analysis of the company’s annual reports and sustainability reports during that period to investigate the changes of Siemens’ corruption and compliance disclosure using both quantitative and qualitative methods. Through the lens of legitimacy theory, stakeholder analysis, and (...) organizational façades, we find evidence that Siemens changed its compliance and corruption disclosure practices to repair its legitimacy in the wake of the 2006 corruption scandal. We analyze these strategies more closely by using the rational, progressive, and reputation façades framework. Our primary findings suggest that the annual reports show peaks of disclosure amounts on corruption and compliance disclosures earlier than sustainability reports, which can be partly explained by analyzing the disclosures made about—and to—the different stakeholder groups. We find that the annual report focuses more on internal stakeholders such as employees, while the sustainability report focuses more on external stakeholders such as suppliers. We also find that the company uses the façades differently depending on which report is being analyzed. (shrink)

Drawing on philosophy, social and psychoanalytic theory, popular culture, and her own experience, Salecl explores how the passion for ignorance plays out in many different aspects of life today, from love, illness, trauma, and the fear of failure to genetics, forensic science, big data, and the Incel movement-and she concludes that ignorance is a complex phenomenon that can, on occasion, benefit individuals and society as a whole.

The AGM theory of belief revision provides a formal framework to represent the dynamics of epistemic states. In this framework, the beliefs of the agent are usually represented as logical formulas while the change operations are constrained by rationality postulates. In the original proposal, the logic underlying the reasoning was supposed to be supraclassical, among other properties. Though not as widely studied as the Research Article, the abstract has attracted increasing interest among researchers over last decades. A number of contrastive or comparative studies of abstracts in English and other languages have already been carried out considering mainly the hard sciences and some soft sciences such as linguistics and history, however no cross-cultural analyses have been conducted so far between RA abstracts in English and RA abstracts in French published in the legal field. This paper seeks to (...) investigate genre variation and changes in frame sequences comparatively in English and French RA abstracts from criminology journals. Using a genre analytical approach to qualitative and quantitative data, the paper reports on two comparable corpora, i.e. English and French, of electronically retrieved abstracts from Criminology Journals published in 2014. The two corpora are composed of three journals per language, namely Criminology, Journal of Criminal Justice, Journal of Criminal Law and Criminology for the English corpus, and Champ Pénal, Criminologie, Revue Canadienne de Droit Pénal et Criminologie for the French corpus. The analysis will be carried out following two main steps, i.e. a macro-analysis and a micro-analysis. In the former step, the corpora are compared by the analysis and discussion of the basic IMRD rhetorical move structure for the RA often proposed in the literature and the additional five moves model postulated by Dos Santos with the aim of investigating the linguistic and rhetorical variation in the abstract genre from a cross-cultural perspective. In the latter, we look at frame sequences combining forms of self-mentions and frame markers, i.e. personal patterns, impersonal patterns and locational patterns. Provisional results show that the abstracts under investigation largely follow the international conventions based on the norms established by the English-speaking international academic community. However, variation across the two cultures emerged from the linguistic realizations of framework sequences. Cross-cultural implications are discussed at the close. (shrink)

In recent decades, neurosciences have reached considerable goals in understanding mental processes and human behavior, overcoming the classic separations between mind and body, reason and passion, penetrating the maze of our cognitive and emotional life to explain their rootedness in the body and the their interactions with the environment. And if until not many years ago psychological and neuroscientific research neglected the study of emotional life to focus only on cognitive functions tout court, today there is even a dedicated sector (...) called affective Neuroscience. By broadly reconstructing the general panorama of neuroscience, and of the affective ones in particular, this essay focuses on the contribution that research on mirror neurons has made to understanding the mechanisms of intersubjectivity and above all that component of social cognition that is empathy. The goal is to understand how we recognize the emotions of others and to explain what the human ability to interpret the actions and intentions of others as if they were ours, to know better how we work and how we relate to others. Research on mirror neurons, within an embodied perspective, shows how the brain is an organ linked to a body that acts, moves and feels in its unceasing interaction with the world.
