Benhabib argues that the tension between universal human rights and democratic self-determination cannot be resolved. Distinguishing between the principle of rights, on the one hand, and context-specific `schedules of rights', on the other hand, helps, however, to specify the scope of both norms. I show that applying this idea to questions of citizenship requires further elaboration in three respects: (1) Benhabib's argument for porous rather than open borders, which does not fully address the challenge of global distributive justice; (2) norms (...) for access to citizenship, which need to cover also transnational affiliations between sending states and their external populations; and (3) necessary constraints on democratic self-determination. I suggest replacing the principle of self-determination with a principle of self-government that does not include a unilateral right to determine the territorial or membership boundaries of the polity. Temporary migration raises two different challenges. The first is whether territorial democracies can integrate temporary migrants as equal citizens; the second is whether transnationally mobile societies can be organized democratically as communities of equal citizens. Considering both questions within a single analytical framework will reveal a dilemma: on the one hand, liberals have good reasons to promote the expansion of categories of free-moving citizens as the most effective and normatively attractive response to the problem of partial citizenship for temporary migrants; (...) yet, on the other hand, if free movement rights were actually used by too many, this might fatally undermine the sustainability of intergenerational and territorial democratic polities. European citizenship is a nested membership in a multilevel polity that operates at member state and union levels. A normative theory of supranational citizenship will necessarily be informed by the EU as the only present case and will be addressed to the EU in most of its prescriptions, but should still develop a model sufficiently general to potentially apply to other regional unions as well. The Article first describes three basic characteristics of such a polity — democratic representation at the (...) supranational level, internal freedom of movement between member states, and regional limits to external geographic expansion — and argues that a multiplication of such regional unions would contribute to a more just and peaceful international order. Building on this modification of Kant’s model for a global confederation of republics, the contribution explores three alternative approaches for strengthening democratic citizenship in the European Union: a statist approach that aims at transforming the EU into a federal state, a unionist approach whose goal is to strengthen union citizenship vis-a`-vis member state nationality, and a pluralist one that specifies citizenship norms for each level and balances them with each other on the basis of the current state of federal integration. These approaches are then compared with regard to their implications for three policy questions: general status differences and inequality of rights amongst EU citizens living in their country of nationality, EU citizens residing in other member states, third-country nationals, and EU citizens residing outside the territory of the Union; voting rights in European, national, and local elections; and access to Union citizenship and to member state nationality. Neben deutschsprachigen werden auch englischsprachige Monographien veröffentlicht. Gründungsherausgeber sind: Erhard Scheibe (Herausgeber bis 1991), Günther Patzig (bis 1999) und Wolfgang Wieland (bis 2003). Von 1990 bis 2007 wurde die Reihe von Jürgen Mittelstraß mitherausgegeben.

ZusammenfassungDie Ökonomisierung bzw. die Kommerzialisierung des Sports ist ein langfristiger Prozess, der sich bereits seit der Wende zum 20. Jahrhundert vollzog und unterschiedliche Sportarten in unterschiedlichen Entwicklungsphasen und Geschwindigkeiten erfasste. Sportartikelunternehmen wie adidas beschleunigten diese Entwicklung nach dem Zweiten Weltkrieg, indem sie anlässlich sportlicher Großereignisse wie Olympischen Spielen oder Fußball-Weltmeisterschaften intensive Kontakte und Netzwerke zu Spitzensportlern und Funktionären aufbauten. Dabei ging es zunächst um die individuelle Ausrüstung der Sportler mit Schuhen und Kleidung, seit den 1960er Jahren dann auch um Promotionverträge (...) bei denen – in West- wie in Osteuropa – Geldzahlungen eine zunehmend wichtige Rolle spielten. Eine solche Vermarktlichung – also die Gestaltung von Prozessen, die bislang über den Staat oder bürokratische Strukturen und nun zunehmend über den Markt geregelt wurden (Ahrens et al. 2015: 395f.) Ökonomisierung, Kommerzialisierung und Vermarktlichung sind verwandte Begriffe, die z.T. auch synonym benutzt werden. Siehe dazu jüngst Graf (2019)., was im Vergleich zu anderen gesellschaftlichen Subsystemen durchaus eine Art „Normalisierung“ darstellte, erreichte spätestens in den 1980er Jahren und mit der massenmedialen Verbreitung des Sports neue Dimensionen, die wiederum mit Hilfe von adidas unter Horst Dassler in Kooperation mit dem IOC und der FIFA vorangetrieben wurden und die Grundlagen einer Kommerzialisierungsspirale legten, deren Auswirkungen bis in die Gegenwart reichen. This article concerns itself with the relationship between implicit moral cognitions and decisions in the realm of business ethics. Traditionally, business ethics research emphasized the effects of overt or explicit attitudes on ethical decision-making and neglected intuitive or implicit attitudes. Therefore, based on an implicit social cognition approach it is important to know whether implicit moral attitudes may have a substantial impact on managerial ethical decision-making processes. To test this thesis, a study with 50 participants was conducted. In this study (...) the participants were asked to work on a deliberative managerial ethical decision-making task, in which they had to decide on one of two options. Implicit moral attitudes towards the two options were measured using the implicit association test (IAT). A semantic differential scale was used to diagnose explicit moral attitudes towards the two options. Each step taken within the deliberative decision-making process, as well the decision itself, was assessed using a scoring model-based decision analysis and a decision-making questionnaire. The results of this study show that implicit moral attitude has a great influence on the deliberative ethical decision-making process. The derived conclusion is that complex and deliberative decision-making processes in the context of business ethics can be affected by implicit social cognitions such as implicit moral attitudes. The present volume contains the lectures and papers given at the 1994 international conference on hermeneutics in Halle (Germany). The conference aimed at a state of the art in the light of recent developments in science and humanities. The place in which the conference was held is renowned for its centuries-old tradition in hermeneutics and among the lectures there are indeed some devoted to this history. For the most part, however, the papers concentrate on present-day problems in fields as different (...) as comparative literature, religious studies, bible exegesis, esthetics, social sciences, intercultural dialogue. The theme of the conference, "strangeness and familiarity", reflects the tension in which any interpretation process is situated and that any theory of interpretation has to account for. When defending his doctoral dissertation, Umberto Eco was accused of narrative fallacy because he presented his research as if it were a detective novel. He should have presented only his conclusions. However, this criticism inspired Eco to claim that “[e]very scientific book should be... the report of a quest for some Holy Grail” (Eco, 2011, p. 7). A quest presupposes engagement on both sides of the knowledge exchange. Building upon our own research, we have produced a model-theoretic scheme for management (...) studies in support of the practicability of Eco’s claim. The idea is to re-create the engagement when establishing problem-solving competence in managerial learning: We start with an analysis of real-life cases of successful managerial problem solving (“best practices”). Next, we attempt to find the common denominator of those successful solutions. Lastly, we instantiate the principles found in the previous step in new problem situations, and thus provide new uses for them. (shrink)

After a remark on the logic of meaning variance, part I explicates the chapter’s heading concepts. As a human faculty, reason is distinguished from rationality, being a quality of human products. The systematical role of reason is historically described from classical antiquity until modern times. Globality of reason in the sense of its being universal is emphasized. Subjectively in distinction from objectively rational human actions are explained. Part II shows, how functions and tasks of reason as well as the moments (...) of rationality underlie the global turn. Especially the concepts of practical reason, e.g., justice, change under empirically altering conditions. The goal of reason’s activity is to design globally valid theories. As a consequence hereof, part III claims to qualify received concepts and theses of reason by their local conditions. (shrink)

Die unterschiedlichen Perspektiven der beteiligten Disziplinen auf das Thema -Regeln- - Philosophie, Psychologie, Soziologie, Wissenschaftstheorie, Entscheidungsforschung, Rechts-, Sozial-, Sprach- und Musikwissenschaft (...) - konnen dazu beitragen, traditionell festgefahrene Einseitigkeiten innerhalb der Disziplinen durch wechselseitige Korrektur und Inspiration zu uberwinden. Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration.
