In 2006, mountaineer David Sharp died on the slopes of Mount Everest. Sharp’s death led to public outrage after allegedly 40 climbers passed by the dying Sharp on their way to the peak, without stopping to help. But, since the slopes of Everest are a high-risk environment and rescuing Sharp would have entailed great risks for the rescuers, it is not clear whether the other mountaineers had a moral duty to rescue him. In a recent article, Patrick Findler introduces a (...) principle to analyse such cases which states that we have a duty to rescue under dangerous circumstances, if the involved risks are not higher than the risks we are already taking in the pursuit of our own, morally less worthy ends. However, Findler then rejects this principle as too demanding. In this paper I will defend the principle against its inventor and argue in favour of such a duty. And while it may be true that the other mountaineers were justified in passing Sharp for different reasons, the principle shows that not only climbers, but adventure-sport athletes in general and people who engage in high-risk endeavours, may have a duty to rescue that doesn’t apply to others. Peter Lombard is best known as the author of a celebrated work entitled Book of Sentences, which for several centuries served as the standard theological textbook in the Christian West. It was the subject of more commentaries than any other work of Christian literature besides the Bible itself. The Book of Sentences is essentially a compilation of older sources, from the Scriptures and Augustine down to several of the Lombard's contemporaries, such as Hugh of Saint Victor and Peter Abelard. Its (...) importance lies in the Lombard's organisation of the theological material, his method of presentation, and the way in which he shaped doctrine in several major areas. Despite his importance, however, there is no accessible introduction to Peter Lombard's life and thought available in any modern language. This volume fills this considerable gap. Philipp W. Rosemann begins by demonstrating how the Book of Sentences grew out of a long tradition of Christian reflection-a tradition, ultimately rooted in Scripture, which by the twelfth century had become ready to transform itself into a theological system. Turning to the Sentences, Rosemann then offers a brief exposition of the Lombard's life and work. He proceeds to a book-by-book examination and interpretation of its main topics, including the nature and attributes of God, the Trinity, creation, angelology, human nature and the Fall, original sin, Christology, ethics, and the sacraments. He concludes by exploring how the Sentences helped shape the further development of the Christian tradition, from the twelfth century through the time of Martin Luther. (shrink)

Todorčević showed that Rado's Conjecture implies CC*, a strengthening of Chang's Conjecture. We generalize this by showing that also CC**, a global version of CC*, follows from RC. As a corollary we obtain that RC implies Semistationary Reflection and, i.e. the statement that all forcings that preserve the stationarity of subsets of ω1 are semiproper.

Rationality bashing has become a popular sport. Critiques have quite rightly challenged models of rational planning that follow a linear progression from predefined ends to achieved goals. There have been several alternative theoretical and empirical developments including incrementalist projects, network theories, critical communication approaches, and heuristic models. Notwithstanding critiques of linear models of policy-making and planning, rationality as a general idea remains an important reference point for designing and evaluating policy-making and for orientating planning projects. We suggest that the concept (...) of rationality needs to be revised rather than abandoned and this article discusses how rationality in decision making may be reconstructed. We first review and critique some of the main preconceptions of rationality in policy-making and planning. We then discuss the nature and purpose of rationality from the perspective of John Dewey’s pragmatist philosophy and in light of contemporary theoretical and empirical analyses. We position rationality as a procedural standard of excellence that evolves and informs practices in the context of problematic situations. We propose that a theory of rationality, as a guide for planning and policy, should be developed for application in concrete problematic situations and at the same time should play a normative role and be orientated to moral, socio-historical, and ecological considerations. Dewey’s pragmatist theory is a promising source for such considerations. In this article we identify four ‘pillars’ of pragmatism to support such a revised rationality construct: (i) situationality, (ii) normativity, (iii) philosophical via media between foundationalism and relativism, and (iv) democratic inquiry. We discuss the application of a pragmatist rationality, that we refer to as ‘situational transactive’ rationality, using a model of decision making that builds on current understandings in planning and policy science. Finally, we discuss some of the possible advantages and challenges of undertaking such a pragmatist revision of rationality. (shrink)

Developing tools is a crucial aspect of experimental practice, yet most discussions of scientific change traditionally emphasize theoretical over technological change. To elaborate on the role of tools in scientific change, I offer an account that shows how scientists use tools in exploratory experiments to form novel concepts. I apply this account to two cases in neuroscience and show how tool development and concept formation are often intertwined in episodes of tool-driven change. I support this view by proposing common normative (...) principles that specify when exploratory concept formation and tool development succeed to initiate scientific change. (shrink)

Saskia Sassen today and Jane Adams more than 100 years ago are both social scientists and public philosophers of reconstruction. Both offer defining contributions to a philosophical tradition that will be identified here as “radical pragmatism”. Sassen’s theoretical stance “before method” serves as a key to understand Addams’s locally embedded urban activist projects as a form of social scientific inquiry. Sassen introduces the concept of “territory making” as a spark of hope against rampant and destructive global trends of “expulsions”, which (...) her approach reveals. In this article this concept of “territory making” will be explored in various contexts and with particular attention to Addams’s Hull house project. It will be shown how a pragmatist brand of human imagination is critical in “territory making”. This leads to reconsidering the role of art in social transformation projects. (shrink)

The role of subnational regions is ill-conceived in international law scholarship, which has come to slowly accept the important role that cities can play as international actors. Opening up the academic debate for a perspective on regions promises to develop new insights on the divide of governance functions between international organizations and states, regions and cities. At the same time, the regional focus helps to unearth some of the shortcomings of overly enthusiastic approaches to what cities can do as global (...) actors. International law scholarship has found it difficult, however, to engage with the concept of the region. This is owed, as this Article demonstrates, to difficult definitional issues as well as the informalizing bend of a focus on regional governance, which is hard to square with traditions of formalist thinking in international law. Ultimately, the Article argues that regions can function as a useful prism through which to analyze current governance challenges. (shrink)

This article explores the question of how to understand social media following the Habermasian theory of the structural transformation of the public sphere. We argue for a return to political-economic fundamentals as the basis for analysing the public sphere and seek to establish a characteristic connection between digital-behavioural control and singularised audiences in the context of proprietary markets. In the digital constellation, it is less a matter of immobilising the citizen as a consumer but rather of their political activation – (...) albeit in conditions under which commercial interests have primacy: privatisation without privatism. Rapid, large-scale uptake of new vaccines against COVID-19 will be crucial to decrease infections and end the pandemic. In a recent article in this journal, Julian Savulescu argued in favour of monetary incentives to convince more people to be vaccinated once the vaccine becomes available. To evaluate the potential of his suggestion, we conducted an experiment investigating the impact of payments and the communication of individual and prosocial benefits of high vaccination rates on vaccination intentions. Our results revealed that none (...) of these interventions or their combinations increased willingness to be vaccinated shortly after a vaccine becomes available. Consequently, decision makers should be cautious about introducing monetary incentives and instead focus on interventions that increase confidence in vaccine safety first, as this has shown to be an especially important factor regarding the demand for the new COVID-19 vaccines. Recent interest in phenomena of simulation, pretense, and play has given rise to new philosophical debates on the basic structure of human action and action planning. Some philosophers sought to transform Hume's desire-belief-action model by sophisticating its basic structure. For example, they introduced “hypothetical world boxes” or imaginary “i-desires” and “i-beliefs” into the standard model, in order to account for the representational and motivational structures of imaginary scripts. Others used phenomena of behavior driven by imagination to attempt a more fundamental (...) critique of the Humean tradition. This article aims to show how the pragmatist tradition could be used as a resource in reframing current debates on imagination, pretense, and simulation in the cognitive sciences. This will help determine the role of imagination in intelligent human deliberation. (shrink)

The aim of this paper is to shed light on and develop what I call a phenomenological conception of experiential justification. According to this phenomenological conception, certain experiences gain their justificatory force from their distinctive phenomenology. Such an approach closely connects epistemology and philosophy of mind and has recently been proposed by several authors, most notably by Elijah Chudnoff, Ole Koksvik, and James Pryor. At the present time, however, there is no work that contrasts these different versions of PCEJ. This (...) paper not only bridges this gap, but also reveals problems in current versions of PCEJ. This paper sets out to evaluate the claim that Aristotle’s Assertoric Syllogistic is a relevance logic or shows significant similarities with it. I prepare the grounds for a meaningful comparison by extracting the notion of relevance employed in the most influential work on modern relevance logic, Anderson and Belnap’s Entailment. This notion is characterized by two conditions imposed on the concept of validity: first, that some meaning content is shared between the premises and the conclusion, and second, that the premises (...) of a proof are actually used to derive the conclusion. Turning to Aristotle’s Prior Analytics, I argue that there is evidence that Aristotle’s Assertoric Syllogistic satisfies both conditions. Moreover, Aristotle at one point explicitly addresses the potential harmfulness of syllogisms with unused premises. Here, I argue that Aristotle’s analysis allows for a rejection of such syllogisms on formal grounds established in the foregoing parts of the Prior Analytics. In a final section I consider the view that Aristotle distinguished between validity on the one hand and syllogistic validity on the other. Following this line of reasoning, Aristotle’s logic might not be a relevance logic, since relevance is part of syllogistic validity and not, as modern relevance logic demands, of general validity. I argue that the reasons to reject this view are more compelling than the reasons to accept it and that we can, cautiously, uphold the result that Aristotle’s logic is a relevance logic. (shrink)

The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. Barnett and Block (Journal of Business Ethics, 2009 ) attack the heart of modern banking by claiming that the practice of borrowing short and lending long is illicit. While their claim of illegitimacy concerning fractional reserve banking can be defended, their justification lacks substance. Their claim is herein strengthened by a legal analysis of deposits and loans based on Huerta de Soto (Money, Bank Credit and Economic Cycles, 2006 ). A combined legal and economic analysis shows that while lending deposits (...) can be regarded as illicit, the maturity mismatching of loans is legitimate contrary to Barnett and Block’s claim. No over-issuance of property rights is involved with this practice once the distinction between present and future goods is taken into account. However, while the practice is not illicit per se , it is greatly assisted and developed through the presence of a fractional reserve banking system, and can sometimes breed detrimental effects. Barnett and Block (J Bus Ethics 18(2):179–194, 2011 ) argue that one cannot distinguish between deposits and loans due to the continuum problem of maturities and because future goods do not exist—both essential characteristics that distinguish deposit from loan contracts. In a similar way but leading to opposite conclusions (Cachanosky, forthcoming) maintains that both maturity mismatching and fractional reserve banking are ethically justified as these contracts are equivalent. We argue herein that the economic and legal differences between genuine deposit and (...) loan contracts are clear. This implies different legal obligations for these contracts, a necessary step in assessing the ethics of both fractional reserve banking and maturity mismatching. While the former is economically, legally, and perhaps most importantly ethically problematic, there are no such troubles with the latter. (shrink)

The concept of the cortical column refers to vertical cell bands with similar response properties, which were initially observed by Vernon Mountcastle’s mapping of single cell recordings in the cat somatic cortex. It has subsequently guided over 50 years of neuroscientific research, in which fundamental questions about the modularity of the cortex and basic principles of sensory information processing were empirically investigated. Nevertheless, the status of the column remains controversial today, as skeptical commentators proclaim that the vertical cell bands are (...) a functionally insignificant by-product of ontogenetic development. This paper inquires how the column came to be viewed as an elementary unit of the cortex from Mountcastle’s discovery in 1955 until David Hubel and Torsten Wiesel’s reception of the Nobel Prize in 1981. I first argue that Mountcastle’s vertical electrode recordings served as criteria for applying the column concept to electrophysiological data. In contrast to previous authors, I claim that this move from electrophysiological data to the phenomenon of columnar responses was concept-laden, but not theory-laden. In the second part of the paper, I argue that Mountcastle’s criteria provided Hubel Wiesel with a conceptual outlook, i.e. it allowed them to anticipate columnar patterns in the cat and macaque visual cortex. I argue that in the late 1970s, this outlook only briefly took a form that one could call a ‘theory’ of the cerebral cortex, before new experimental techniques started to diversify column research. I end by showing how this account of early column research fits into a larger project that follows the conceptual development of the column into the present. (shrink)

The ideal scalar Aharonov–Bohm (SAB) and Aharonov–Casher (AC) effect involve a magnetic dipole pointing in a certain fixed direction: along a purely time dependent magnetic field in the SAB case and perpendicular to a planar static electric field in the AC case. We extend these effects to arbitrary direction of the magnetic dipole. The precise conditions for having nondispersive precession and interference effects in these generalized set ups are delineated both classically and quantally. Under these conditions the dipole is affected (...) by a nonvanishing torque that causes pure precession around the directions defined by the ideal set ups. It is shown that the precession angles are in the quantal case linearly related to the ideal phase differences, and that the nonideal phase differences are nonlinearly related to the ideal phase differences. It is argued that the latter nonlinearity is due to the appearance of a geometric phase associated with the nontrivial spin path. It is further demonstrated that the spatial force vanishes in all cases except in the classical treatment of the nonideal AC set up, where the occurring force has to be compensated by the experimental arrangement. Finally, for a closed space-time loop the local precession effects can be inferred from the interference pattern characterized by the nonideal phase differences and the visibilities. It is argued that this makes it natural to regard SAB and AC as essentially local and nontopological effects. (shrink)

ABSTRACT:In response to criticism of empirical or “positive” approaches to corporate social responsibility (CSR), we defend the importance of these approaches for any CSR theory that seeks to have practical impact. Although we acknowledge limitations to positive approaches, we unpack the neglected but crucial relationships between positive knowledge on the one hand and normative knowledge on the other in the implementation of CSR principles. Using the structure of a practical syllogism, we construct a model that displays the key role of (...) empirical knowledge in fulfilling a firm’s responsibility to society, paying special attention to the implications of the “ought implies can” dictum. We also defend the importance of one particular class of empirical claims; namely, claims from the field of economics. Even positive economic theory, which is often criticized for endorsing profits rather than values, can cooperate in intriguing ways with non-economic concepts in the implementation of CSR goals.
