The concept of mental privacy can be defined as the principle that subjects should have control over the access to their own neural data and to the information about the mental processes and states that can be obtained by analyzing it. Our aim is to contribute to the current debate on mental privacy by identifying the main positions, articulating key assumptions and addressing central arguments. First, we map the different positions found in current literature. We distinguish between those who dismiss (...) concerns about mental privacy and those who endorse them. In this latter group, we establish a further disagreement between conservative and liberal strategies to protect mental privacy. Then, we address the first discussion by articulating and criticizing different skeptical views on mental privacy. Finally, we try to identify what are the unique features of neural data and examine how they may be connected to the ways in which neurotechnological mindreading could put mental privacy at risk. We suggest that even if neural data is unique, it may not require new strategies to protect people from its misuse. However, identifying the special features and risks of neurotechnological mind-reading is necessary for the second discussion on mental privacy to properly take off. (shrink)

One of the key behavioral effects of attractiveness is increased visual attention to attractive people. This effect is often explained in terms of evolutionary adaptations, such as attractiveness being an indicator of good health. Other factors could influence this effect. In the present study, we explored the modulating role of sexual orientation on the effects of attractiveness on exploratory visual behavior. Heterosexual and homosexual men and women viewed natural-looking scenes that depicted either two women or two men who varied systematically (...) in levels of attractiveness (based on a pre-study). Participants’ eye movements and attractiveness ratings towards the faces of the depicted people were recorded. The results showed that although attractiveness had the largest influence on participants’ behaviors, participants’ sexual orientations strongly modulated the effects. With the exception of homosexual women, all participant groups looked longer and more often at attractive faces that corresponded with their sexual orientations. Interestingly, heterosexual and homosexual men and homosexual women looked longer and more often at the less attractive face of their non-preferred sex than the less attractive face of their preferred sex, evidence that less attractive faces of the preferred sex might have an aversive character. These findings provide evidence for the important role that sexual orientation plays in guiding visual exploratory behavior and evaluations of the attractiveness of others. (shrink)

The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

¿Qué entendemos hoy por “neoliberalismo”? Si bien hay varias formas de contestar tal pregunta, la respuesta más frecuente consiste en asociarlo con la aplicación de un conjunto de medidas estrictamente económicas; de hecho, se dice que los neoliberales, casi por defecto congénito, no pueden pensar la realidad más allá de los números y las recetas abstractas. Siguiendo el método arqueológico-genealógico de Michel Foucault y de algunos de sus intérpretes contemporáneos, el presente artículo buscará revisar y en lo posible ampliar aquella (...) concepción crítica. Nuestra hipótesis es que el neoliberalismo no se reduce a un mero “economicismo”, sino que contiene más bien toda una dimensión “espiritual”, todo un campo de prácticas y de discursos que se conforma como respuesta ante el excesivo racionalismo de las sociedades modernas. La cuestión consiste en transformar a los hombres desde dentro, hasta el punto de tornarlos más aptos para acceder a un conjunto de valores y asimilar ciertas formas de comportamiento. Según sostiene este artículo, es en los escritos de Wilhelm Röpke, un economista y sociólogo alemán de mediados del siglo XX, donde mejor se aprecia la dimensión espiritual del neoliberalismo. Röpke proponía un “diagnóstico” y una “terapéutica”. El primero sostiene que los hombres padecen una enfermedad espiritual denominada como “masificación” y “proletarización”, mientras que la terapéutica procura hacer de esos hombres unos emprendedores de sí mismos. Tal sería el modo de superar los efectos adversos del capitalismo: transformando a los hombres masificados y proletarizados en sujetos completamente comprometidos con su profesión. No se trata sencillamente de recuperar un pensamiento casi olvidado por la historia, sino de explorar los límites de nuestro presente, especialmente de nuestras formas de subjetividad. Aunque muchas de las críticas contemporáneas no hayan reparado aún en ello, hay que preguntarse hasta qué punto los diagnósticos y las terapéuticas propuestas por neoliberales como Röpke persisten en la actualidad. Aquí no se darán respuestas tajantes y definitivas, pero sí algunos indicios al respecto. (shrink)

El examen de los actores, instituciones y materiales implicados en el Proyecto Genoma Humano (PGH) remite inmediatamente al contexto de los macroproyectos científicos que suelen caracterizarse con el expresivo rótulo de «Big Science». Como es bien sabido, la afortunada expresión fue acuñada por el sociólogo de la ciencia Derek de Solla Price en 1936 quien elaboró su concepción considerando, principalmente, a la física de su época. Sin embargo, las ciencias biológicas tardaron varios decenios más en adquirir las dimensiones de la (...) Big Science. En el caso del PGH se presenta un panorama muy distinto al contexto en el que surgió la estructura de la doble hélice. El investigador aislado no tiene cabida en este contexto, y los grandes científicos son ahora directores de proyectos y el caso de James Watson es de nuevo paradigmático. (shrink)

En el presente trabajo se estudia la génesis del Proyecto Genoma Humano (PGH) desde un enfoque filosófico. A la vista de la cuantiosa bibliografía sobre el tema, quizá las siguientes páginas pudieran parecer impertinentes, pero no pretendemos elaborar una mera paráfrasis, más o menos afortunada, de varios ensayos previos porque este trabajo supone una reacción crítica frente a esos mismos ensayos. Nuestro proceder es, desde un primer momento, dialéctico, pues supone una rectificación de las distintas exposiciones acerca de la génesis (...) del PGH. Por ello, hemos de tomarlas en consideración como contenidos del propio trabajo. El análisis pormenorizado sería excesivo; una breve reseña, casi a título inventarial, de los ejemplares más destacados permitirá ejemplificar los problemas mencionados, además de ofrecer un primer bosquejo de los contenidos y contornos de la investigación. La dimensión científica del Proyecto Genoma Humano (PGH) remite a un conjunto de entidades de orden biológico: bases nitrogenadas, genes, enzimas, SNP’s1, etc., sobre las cuales se ejercitan las operaciones tecnológicas que dan lugar a la secuenciación del genoma. Un examen más atento muestra que todos los cuerpos, morfologías y estructuras que forman parte constituyente del PGH pueden circunscribirse al campo de la biología molecular, con lo cual están dados a la misma escala, lógicamente. Esta primera suposición, que habrá que (...) constatar en la reconstrucción ulterior, permite regresar hacia el curso de la constitución de la biología molecular, como factor del contexto histórico determinante del PGH, sin tener que retrotraerse a procesos anteriores de la historia de la biología para dar razón de la conformación y conexión de los trazos que forman parte de la figura de referencia. Durante su intercambio epistolar con Spinoza, Tschirnhaus defiende la imposibilidad de deducir la naturaleza de los cuerpos particulares a partir de la sola extensión. El motivo de esta objeción reside en su dificultad para desmarcarse de la concepción sustancial de los cuerpos como partes finitas de la extensión sostenida por Descartes. Esta dificultad inicial, sin embargo, queda ensombrecida por la intervención de Leibniz en un momento clave de la correspondencia que convertirá la disputa de carácter físico en una controversia teológica. Este artículo demuestra que el problema metafísico detectado por Leibniz consiste en la afirmación radical del principio de plenitud contenida en la proposición 16 de la primera parte de la Ética y las consecuencias heréticas que de ésta se desprenden. El examen del papel que la crítica de Leibniz jugó en el desarrollo de la discusión permitirá leer bajo una nueva luz tanto la paradójica actitud de Tschirnhaus como las enigmáticas y elusivas respuestas de Spinoza. Scholars have considered that Spinoza’s difficulties in dealing with the objections raised by Tschirnhaus against his physical approaches were the spur that led the latter to dissociate himself from the former in the field of natural philosophy. The aim of this paper is, on the one hand, to refute this misjudgment and, on the other, to show that the cause of it lies in having dismissed a significant post-Cartesian current of thought, buried in oblivion by the triumph of Newtonian mechanics, (...) which intended to develop a physics in purely relational terms. In turn, this will allow us to read the physical proposals of Spinoza and Tschirnhaus as paradigmatic examples of this relational physics. (shrink)

El ajuste entre Estado y nación en Latinoamérica ha observado complicaciones desde la fundación de sus repúblicas. La pluralidad de subjetividades, realidades materiales y brechas, sumadas a las coyunturales demandas insatisfechas y una débil institucionalidad influyeron en que las construcciones nacionales hayan tenido un componente populista en diferentes intentos refundadores. En los países andinos ese componente se expresa a partir de unas condiciones sociopolíticas previas a las performativas identidades nacionales y la presencia de liderazgos personalistas. Parte de los estudios sobre (...) identidades nacionales en estos países se centraron en el análisis de sus liderazgos y discursos. Otros optaron por centrarse en los procesos o condiciones de posibilidad que favorecen la irrupción de estas identidades. El objetivo del trabajo es brindar una base epistemológica que emerja de la compatibilidad entre los anteriores abordajes explicativos de las identidades nacionales. (shrink)

RESUMEN La polémica sobre los prejuicios es un símbolo distintivo de la Ilustración alemana. Este artículo presenta aspectos históricos de esta polémica que resultan útiles para esclarecer el pensamiento de Kant. Se argumenta que la posición kantiana respecto de ella, como una polémica en la que convive una perspectiva que busca la liberación de todo prejuicio y otra que permite que algunos permanezcan, y hasta los estima como útiles, representa un esfuerzo por conciliar ambas perspectivas, y anticipa la distinción planteada (...) en la "Dialéctica trascendental" entre el uso regulativo y constitutivo de las ideas. ABSTRACT The controversy over prejudices is a distinctive feature ofthe German Enlightenment. The article addresses some historical aspects of this controversy that are useful to shed light on Kant's thought. Enlightenment positions ranged from the perspective seeking to rid itself of all prejudices, to that which allows for some prejudices and even considers them useful. The article argues that the Kantian position on the matter constitutes an effort to reconcile these perspectives, thus anticipating the distinction set forth in the "Transcendental Dialectic" between the regulative and the constitutive use of ideas. The article appearing previously in this journal entitled “Styles of Thought on the Continental Drift Debate” (Pellegrini 2019) prompted a response from Weber and Šešelja (2020) which they termed as “a defence of rationalist accounts”. They argue that their self-designated “sophisticated rationalism” explains the closure of the continental-drift debate without being affected by my critiques to rationalist approaches. While ignoring the empirical evidence that shows the complexity of the debate and the necessity to include broader social elements in the analysis (...) (such as scientists denying continental drift even after the plate tectonics theory, others supporting it without being familiarized with the literature), they proclaim to be unconvinced about the analysis of the styles of thought. In order to clarify differences in the approach to the continental-drift historical controversy, I respond here to the criticism my paper drew while discussing the place of rationalism when explaining the acceptance of a theory. I will argue that their distinction between “crude” and “sophisticated” rationalism does not solve the problem of social aspects being left aside by rationalists in view of the acceptance of a theory. I will also argue that in order to understand what leads people to embrace a belief (namely scientists in accepting a theory), the analysis of mere cognitive or epistemic arguments is not enough and it leads to a reductionist explanation as to social behaviour. En el transcurso de una clase ordinaria de filosofía, un incidente inesperado rompe la definición de la situación, haciendo añicos el consenso de trabajo entre los alumnos y el profesor. Para reconstruir su trasfondo de expectativas, los alumnos se ven forzados a emplear estrategias de acomodación y normalización. En el análisis de esta experiencia disruptiva convergen la fenomenología del mundo social de Alfred Schütz, la (...) etnometodología de Harold Garfinkel y el interaccionismo simbólico de Erving Goffman.This essay starts from a disruptive experience in a Spanish high school classroom. In the course of an ordinary philosophy lesson, an unexpected incident breaks the definition of the situation, smashing the working consensus among students and teacher to smithereens. In order to rebuild their background expectancies, the pupils are forced to resort to accommodation and normalization strategies. The analysis of this disruptive experience is based upon the convergence of Alfred Schütz’s phenomenology of the social world, Harold Garfinkel’s ethnomethodology, and Erving Goffman’s symbolic interactionism. This article analyzes the main reasons offered by the literature in relation to the question of whether pre-implantation genetic diagnosis and selection should be allowed in the context of assisted reproduction techniques to avoid the birth of children with disabilities. The bioethical literature faces a challenge from the disability discourse. When the oppressive social dimension of disability is taken into account, it results in a series of questions that could challenge the most settled conclusions of the bioethical debate. However, the (...) social model has not been without criticism and one of them, the underestimation of the importance of biological traits origin against a disability of social origin, resonates particularly in the debate on preimplantation genetic selection. Practices related to research misconduct seem to have been multiplied in recent years. Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. No se trata de una reseña de nombres y obras, ni de una historia interna del desarrollo de problemas puros o escuelas. However, this assertion lead to ask, which type of satire represent the Film. To structure these characterizations will be allude the Satire Theory of Friedrich Schiller, which works to delimitate not only the satirical elements of the story, but the mode the movie takes to become a critic to (...) the society. This article discusses explanations behind theory choice, that is, ultimately, what leads people to accept a certain claim as valid. There has been a recent debate as to how closure was achieved in the continental-drift discussion. The controversy had found its usual explanation under rationalist terms: Wegener’s 1912 continental-drift theory was accepted 50 years later only after the plate tectonic theory had provided more evidence or a more in-depth problem-solving capacity. Nevertheless, a re-examination of the controversy under constructivist terms argued (...) that closure was achieved by a change in the style of thought. This analysis prompted some authors to react calling to a ‘defence of rationalism’ and insisting on explaining that the continental-drift theory was only accepted because of epistemic reasons. As the debate impacts on the way to explain scientific controversies, in this article I analyze rationalist and constructivist approaches with respect to ways to explain the social acceptance or rejection of a theory. The analytical perspectives will be contextualized within a broader theoretical discussion in philosophy and social sciences about the role of different factors that condition knowledge, which will also include an empirical approximation in the analysis of GMO and continental-drift controversies. Ultimately, the debate with rationalism is situated in a broader context about the ways of explaining the social acceptance of a theory, arguing that the problem with the rationalism that confuses a purely logical explanation with a sociological one is that it tends to judge rather than understand. This article reports the case of an elementary school principal, Ella, committed in the implementation of a reform dedicated to bring together several educational worlds. It proposes a conceptual construction around the notions of “meeting work » and « identity contingency » with the aim of comprehend the collective work in education. This construction unfolds methodically in a thematic and enunciative analysis of interviews. The analysis shows the events of this work and shows how, in the interface between professionalism and (...) psyche, the identity contingency, as an assumption of ambiguity, establishes an essential foundation of this work. We pose this problem: Descartes responds to Voetius’ irrational accusation by resorting once, on his own initiative, to Gospel, an interpretation that reviews the laws of charity as akin to the laws of natural friendship governing pastor and teacher roles. We propose that the Letter be a legal argument. Descartes has no interest in theological virtues: facing irrationality, he delves into private law to prove that Voetius is not a true teacher, or a true pastor, and encroaches on the function of judge. Esta confusión lleva a que se apliquen al primero categorías propias del segundo. Se examinan las "paradojas ónticas" que mi cuerpo (la carne) inaugura (a); se despeja la tesis de dos interpretaciones de las meditaciones primera y sexta (b); se discute la (...) "excepción a la metafísica" instaurada por el conocimiento de mi cuerpo (c); se arriesga, siguiendo una indicación del autor, la apertura a una dimensión ética que exige examinar ya no la unión de cuerpo y alma, sino la unión por el amor a un semejante y a la comunidad de semejantes (d). -/- The article carries out a critical examination of J.-L. Marion's latest work, "Sur la pensée passive de Descartes", whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper examines the "ontic paradoxes" that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the "exception to metaphysics" established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimension, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). -/- Neste artigo, propõe-se um exame crítico da última obra de J.-L. This article deals with the methodological procedures employed by Johannes Kepler, particularly those used in the process of elaboration of the two first laws of planetary movements. Its aim is to show that the astronomical practice of Kepler is linked with the proposal of (physical and mathematical) hypothesis and with valuing precision in observational data, with the goal of obtaining, by means of rigorous procedures, the (mathematically expressed) regularities of planetary motions. It was only afterwards that Kepler looked for an (...) explanation of the regularities (laws) discovered, formulating the hypothesis of the magnetic action exerted by the Sun, which is located at the physical center of the system. In the new astronomy, he modifies the methodological status of astronomical hypotheses in the beginning of 17th century (present in Ptolemy, Copernicus and Brahe), promoting the passage from a mathematical descriptive astronomy to a physical-mathematical explicative astronomy. This article is, in particular, a discussion of the article by Jaegwon, Kim: "Non-reductionist physicalism and its problem with mental causation". In general, we turn to classic texts of phenomenology to refute any (non) reductionist physical theory.

Cognitive diagnosis models allow classifying respondents into a set of discrete attribute profiles. The internal structure of the test is determined in a Q-matrix, whose correct specification is necessary to achieve an accurate attribute profile classification. Several empirical Q-matrix estimation and validation methods have been proposed with the aim of providing well-specified Q-matrices. However, these methods require the number of attributes to be set in advance. No systematic studies about CDMs dimensionality assessment have been conducted, which contrasts with the vast (...) existing literature for the factor analysis framework. To address this gap, the present study evaluates the performance of several dimensionality assessment methods from the factor analysis literature in determining the number of attributes in the context of CDMs. The explored methods were parallel analysis, minimum average partial, very simple structure, DETECT, empirical Kaiser criterion, exploratory graph analysis, and a machine learning factor forest model. Additionally, a model comparison approach was considered, which consists in comparing the model-fit of empirically estimated Q-matrices. The performance of these methods was assessed by means of a comprehensive simulation study that included different generating number of attributes, item qualities, sample sizes, ratios of the number of items to attribute, correlations among the attributes, attributes thresholds, and generating CDM. Results showed that parallel analysis, factor forest model, and model comparison are suitable alternatives to determine the number of attributes in CDM applications, with an overall percentage of correct estimates above 76% of the conditions. The accuracy increased to 97% when these three methods agreed on the number of attributes. In short, the present study supports the use of three methods in assessing the dimensionality of CDMs. This will allow to test the assumption of correct dimensionality present in the Q-matrix estimation and validation methods, as well as to gather evidence of validity to support the use of the scores obtained with these models. The findings of this study are illustrated using real data from an intelligence test to provide guidelines for assessing the dimensionality of CDM data in applied settings. (shrink)

Se analizan relaciones entre pobreza, ecosistemas y ODS 2030 en Piura. Se argumenta que el deterioro de los ecosistemas por el uso indiscriminado y la poca regulación acentúan la pobreza. Aplicando metodología descriptiva, correlacional y de sistematización, se construyen matrices de indicadores con información del Ministerio del Ambiente (MINAM), el Instituto Nacional de Estadística (INEI) y el Banco Central de Reserva (BCRP). Las políticas del Acuerdo Nacional no han permitido resultados satisfactorios ya que se observa deterioro de los ecosistemas y (...) ODS incumplidos. La evidencia apoya la hipótesis de que el desarrollo sostenible requiere procesos de transformación de ecosistemas a capital natural a través de políticas efectivas, vigilancia social y esfuerzo gubernamental. Michel Janssen and Harvey Brown have driven a prominent recent debate concerning the direction of an alleged arrow of explanation between Minkowski spacetime and Lorentz invariance of dynamical laws in special relativity. In this article, I critically assess this controversy with the aim of clarifying the explanatory foundations of the theory. First, I show that two assumptions shared by the parties—that the dispute is independent of issues concerning spacetime ontology, and that there is an urgent need for a constructive interpretation (...) of special relativity—are problematic and negatively affect the debate. Second, I argue that the whole discussion relies on a misleading conception of the link between Minkowski spacetime structure and Lorentz invari-ance, a misconception that in turn sheds more shadows than light on our understand-ing of the explanatory nature and power of Einstein’s theory. I state that the arrow connecting Lorentz invariance and Minkowski spacetime is not explanatory and uni-directional, but analytic and bidirectional, and that this analytic arrow grounds the chronogeometric explanations of physical phenomena that special relativity offers. To what degree can language be acquired from linguistic input alone? This question has vexed scholars for millennia and is still a major focus of debate in the cognitive science of language. The complexity of human language has hampered progress because studies of language–especially those involving computational modeling–have only been able to deal with small fragments of our linguistic skills. We suggest that the most recent generation of Large Language Models (LLMs) might finally provide the computational tools to determine empirically (...) how much of the human language ability can be acquired from linguistic experience. LLMs are sophisticated deep learning architectures trained on vast amounts of natural language data, enabling them to perform an impressive range of linguistic tasks. We argue that, despite their clear semantic and pragmatic limitations, LLMs have already demonstrated that human-like grammatical language can be acquired without the need for a built-in grammar. Thus, while there is still much to learn about how humans acquire and use language, LLMs provide full-fledged computational models for cognitive scientists to empirically evaluate just how far statistical learning might take us in explaining the full complexity of human language. Human dignity: social movements invoke it, several national constitutions enshrine it, and it features prominently in international human rights documents. But what is it, why is it important, and what is its relationship to human rights and social justice? Pablo Gilabert offers a systematic defence of the view that human dignity is the moral heart of justice. In Human Dignity and Human Rights (OUP 2019), he advanced an account of human dignity for the context of human rights discourse, which (...) covers the most urgent, basic claims of dignity. This book extends the dignitarian approach to more ambitious claims of maximal dignity of the kind encoded in democratic socialist conceptions of social justice. In particular, this book focuses on the just organization of working practices. It recasts in a dignitarian format the critique of capitalist society as involving exploitation, alienation, and domination of workers, and revamps a neglected but inspiring socialist principle. In its dignitarian interpretation, the Abilities/Needs Principle (‘From each according to their ability, to each according to their needs!’) yields reasonable and feasible requirements on social cooperation geared to empowering each human being to lead a flourishing life. While Human Dignity and Human Rights offered the first systematic philosophical account of human dignity in human rights discourse, Human Dignity and Social Justice presents the first systematic application of the dignitarian framework to the core ideals of democratic socialism. When we speak about different interpretations of quantum mechanics it is suggested that there is one single quantum theory that can be interpreted in different ways. However, after an explicit characterization of what it is to interpret quantum mechanics, the right diagnosis is that we have a case of predictively equivalent rival theories. I extract some lessons regarding the resulting underdetermination of theory choice. Issues about theoretical identity, theoretical and methodological pluralism, and the prospects for a realist stance towards quantum (...) theory can be properly addressed once we recognize that interpretations of quantum mechanics are rival theories. According to a popular narrative, in 1932 von Neumann introduced a theorem that intended to be a proof of the impossibility of hidden variables in quantum mechanics. However, the narrative goes, Bell later spotted a flaw that allegedly shows its irrelevance. Bell’s widely accepted criticism has been challenged by Bub and Dieks: they claim that the proof shows that viable hidden variables theories cannot be theories in Hilbert space. Bub’s and Dieks’ reassessment has been in turn challenged by Mermin and (...) Schack. Hereby I critically assess their reply, with the aim of bringing further clarification concerning the meaning, scope and relevance of von Neumann’s theorem. I show that despite Mermin and Schack’s response, Bub’s and Dieks’ reassessment is quite correct, and that this reading gets strongly reinforced when we carefully consider the connection between von Neumann’s proof and Gleason’s theorem. It is a widespread belief that the Kochen-Specker theorem imposes a contextuality constraint on the ontology of beables in quantum hidden variables theories. On the other hand, after Bell’s influential critique, the importance of von Neumann’s wrongly called ‘impossibility proof’ has been severely questioned. However, Max Jammer, Jeffrey Bub and Dennis Dieks have proposed insightful reassessments of von Neumann’s theorem: what it really shows is that hidden variables theories cannot represent their beables by means of Hermitian operators in Hilbert space. Hereby I show that i) the very same constraint can be derived from Gleason’s theorem, and that ii) if we consider the import of von Neumann’s and Gleason’s theorems, the relevance of the Kochen-Specker theorem for hidden variables theories gets substantially weakened: it does not force them to be contextual in any interesting sense of the term. In this paper I argue that the case of Einstein׳s special relativity vs. Hendrik Lorentz׳s ether theory can be decided in terms of empirical evidence, in spite of the predictive equivalence between the theories. In the historical and philosophical literature this case has been typically addressed focusing on non-empirical features. I claim that non-empirical features are not enough to provide a fully objective and uniquely determined choice in instances of empirical equivalence. However, I argue that if we consider arguments proposed (...) by Richard Boyd, and by Larry Laudan and Jarret Leplin, a choice based on non-entailed empirical evidence favoring Einstein׳s theory can be made. A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law.
