The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

Los pueblos originarios que habitaban —y habitan— el territorio actualmente ocupado por el Estado argentino han sido objeto de una serie de procesos simultáneos de desposesión, discriminación y pauperización. No obstante, con el paso de las décadas y en el marco de la lucha que los primeros llevaran a cabo, el gobierno ha adecuado parte de su legislación a los requerimientos internacionales en relación con el respeto debido hacia los derechos de todos los pueblos. En ese marco, la ciudad rionegrina (...) de San Carlos de Bariloche —principal núcleo urbano del territorio provincial— fue declarada formalmente como Municipio intercultural en 2015. Sin embargo, a pesar del pronunciamiento oficial y del compromiso exigible a los dirigentes locales, algunas situaciones dan cuenta de una aplicación superflua y acotada de la normativa, así como, también, de la pervivencia de una historiografía conservadora que incide con efectos reaccionarios en el accionar de los funcionarios. Puntualmente, en base al análisis de circunstancias específicas bajo el marco intercultural de la legislación local vigente, el presente artículo se propone precisar falencias en el accionar del Municipio para dar cuenta de una postura vaga respecto del acompañamiento y salvaguarda de las comunidades mapuche. De esta manera, sin pretender que lo intercultural se agota en la relación pueblos originarios/Estado, el objetivo es encender una luz de alerta que motive un accionar superador por parte de quienes ejercen —y ejerzan— la función pública en la ciudad, bajo la convicción de que es necesario reivindicar los derechos del pueblo mapuche a su propia historia, territorio e identidad, todos ellos derechos humanos garantizados por la legislación internacional para todos los habitantes del planeta. This article studies natural food packaging as enabling artifacts of the traditional material culture of Antioquia in Colombia. For this purpose, we consider artifacts as objective nodes that combine design and use intentions, functions, materials, histories, artifactual lineages, and cooperative relationships that stabilize ritualized practices of a human group. We take the example of natural packaging as artifacts that enablers and stabilizers of traditional cooking and food preparation practices. Natural packaging materials are here assumed to be leaves having some favorable (...) property to contain a food product. After providing a theoretical reflection, we analyze the data collected from fieldwork we conducted in two towns in Antioquia, Colombia (Santa Fe de Antioquia and Amagá), as well as from an interview with an expert in the field. Finally, we show that it is possible to postulate an analysis under a relational ontological description of a traditional practice with conceptual categories of the philosophy of technology. Ernesto Laclau es un reconocido teórico político precursor del postmarxismo. Si bien reside en Inglaterra hace varios lustros, su vinculación con Argentina y América Latina sigue siendo muy importante. Su libro Hegemony and Socialist Strategy de 1985 (aparecido en español en 1987 con el título Hegemonía y Estrategia Socialista) co-escrito con Chantal Mouffe tuvo un gran impacto en el pensamiento de la intelectualidad de izquierda identificada con un proyecto de radicalización de los ideales ..

Esta reflexión hunde sus raíces en las obras transicionales de Ernesto Sabato: Uno y el Universo y Hombres y engranajes, con elementos muy propios del mundo que instaura El túnel. Allí Juan Pablo Castel, encarna el túnel de su propia existencia desde dos puntos equidistantes y superpuestos: primero, la inmersión, que realiza como artista cuando pinta -una posibilidad que desafía toda lógica-, y segundo, la explicación, planteada como la necesidad de clarear una mujer inquieta y solitaria, frente a (...) un mar tormentoso. Lo que permitirá comprender cómo Juan Pablo Castel caminará en dos direcciones necesarias, que no admitirán una síntesis: primero, la dirección yo-universo, que encaja en la necesidad de gobernar el mundo a partir de la abstracción, la urgencia de explicación de ese hombre profano que despierta de un sueño profundo; segundo, la dirección universo-uno en tanto búsqueda de lo humano, sin disminuir las contradicciones, ese largo ir y venir que no agota esas dos tendencias entremezcladas y ambivalentes. Este trabajo tiene la finalidad de fundamentar las razones que conducen al personaje Juan Pablo Castel de la novela de Ernesto Sabato El túnel (1948) a la psicosis, entendida esta como una estrategia involuntaria para interpretar la realidad y actuar en función de la cosmovisión que le genera. Para explicar esa adopción identitaria, retomo la taxonomía elaborada por Donald Shaw con respecto al contexto influyente del boom latinoamericano (que repercute negativamente en la psicología social) y la epistemología psicoanalítica (...) de Jacques Lacan al hacer referencia a nociones afines que configuran al protagonista como una entidad desligada del mundo real y que cuenta con un potencial saber infundado hacia la destrucción del ser. In a previous paper (see ‘Tolerant, Classical, Strict’, henceforth TCS) we investigated a semantic framework to deal with the idea that vague predicates are tolerant, namely that small changes do not affect the applicability of a vague predicate even if large changes do. Our approach there rests on two main ideas. First, given a classical extension of a predicate, we can define a strict and a tolerant extension depending on an indifference relation associated to that predicate. Second, we can use (...) these notions of satisfaction to define mixed consequence relations that capture non-transitive tolerant reasoning. Although we gave some empirical motivation for the use of strict and tolerant extensions, making use of them commits us to the view that sentences of the form ‘ p∨¬p ’ and ‘ p∧¬p ’ are not automatically valid or unsatisfiable, respectively. Some philosophers might take this commitment as a negative outcome of our previous proposal. We think, however, that the general ideas underlying our previous approach to vagueness can be implemented in a variety of ways. This paper explores the possibility of defining mixed notions of consequence in the more classical super/sub-valuationist setting and examines to what extent any of these notions captures non-transitive tolerant reasoning. In a recent article, Fabrice Correia explores the project of reducing the notion of grounding to that of essence. He then goes on to provide several candidate definitions and test each of them against a number of objections. His final take on the situation is, roughly, that two of the definitions can handle all of the considered objections. The aim of this paper is to re-evaluate Correia's conclusions in the light of two sources of insights: Firstly, I will argue that (...) one of the objections treated by Correia has been somewhat underestimated, and that it still constitutes a threat against definitions of grounding in terms of essence. Secondly, there are at least two further objections that should be considered by the advocate of such definitions. As I will show, one of them can be neutralized; but the other one is more serious and suggests a clear dialectical edge to an operationalist definition. (shrink)

It is often assumed that the supervaluationist theory of vagueness is committed to a global notion of logical consequence, in contrast with the local notion characteristic of modal logics. There are, at least, two problems related to the global notion of consequence. First, it brings some counterexamples to classically valid patterns of inference. Second, it is subject to an objection related to higher-order vagueness . This paper explores a third notion of logical consequence, and discusses its adequacy for the supervaluationist (...) theory. The paper proceeds in two steps. In the first step, the paper provides a deductive notion of consequence for global validity using the tableaux method. In the second step, the paper provides a notion of logical consequence which is an alternative to global validity, and discusses i) whether it is acceptable to the supervaluationist and ii) whether it plays a better role in a theory of vagueness in the face of the problems related to the global notion. This article describes the effect of a teaching–learning sequence based on the discovery of oxygen in promoting students’ argumentation. It examines the written and oral arguments produced by 63 high school students in France during a complete TLS supervised by the same teacher. The data used in this analysis was derived from students’ written responses, audio and video recordings, and written field notes. The first goal of this investigation was to provide evidence that an approach combining history and philosophy of (...) science and argumentation could increase students’ awareness of the relevance of experimentation and communication to scientific progress. The second goal was to assess the effectiveness of the TLS to engage students in argumentative classroom interactions relating to the discovery of oxygen at the end of the 18th century. The findings show that this historical case can be useful for promoting students’ argumentation and is also appropriate for high school students. Future research should include students of other ages, other historical episodes and experiences in other parts of the world. (shrink)

To what degree can language be acquired from linguistic input alone? This question has vexed scholars for millennia and is still a major focus of debate in the cognitive science of language. The complexity of human language has hampered progress because studies of language–especially those involving computational modeling–have only been able to deal with small fragments of our linguistic skills. We suggest that the most recent generation of Large Language Models (LLMs) might finally provide the computational tools to determine empirically (...) how much of the human language ability can be acquired from linguistic experience. LLMs are sophisticated deep learning architectures trained on vast amounts of natural language data, enabling them to perform an impressive range of linguistic tasks. We argue that, despite their clear semantic and pragmatic limitations, LLMs have already demonstrated that human-like grammatical language can be acquired without the need for a built-in grammar. Thus, while there is still much to learn about how humans acquire and use language, LLMs provide full-fledged computational models for cognitive scientists to empirically evaluate just how far statistical learning might take us in explaining the full complexity of human language. This article provides a survey of the emerging debate on the political representation of nonhuman animals. In Section 1, I identify some of the reasons why the interests of animals are often disregarded in policy-making, and present two arguments why these interests should be considered. In Section 2, I introduce four institutional proposals that have been discussed in the relevant literature. Section 3 attempts to make explicit the underlying logic of each proposal (i.e. which specific problems it wants to tackle). (...) Whenever a fact P grounds another fact Q, one may ask why that is so. Karen Bennett and Louis deRosset independently argue that grounding facts—such as the fact that P grounds Q—are always grounded in their grounds-part. Bennett calls this the view that grounding is superinternal. My aim in this paper is to argue that grounding is not superinternal. I will do so by showing that superinternality, together with some widely accepted formal features of grounding—namely, transitivity and necessitation—yield implausible claims (...) about how necessities are explained. Then, I will discuss how my argument compares with Dasgupta’s argument against superinternality. (shrink)

This article examines Peter Singer’s animal ethic’s theory and argues that the utilitarian calculus’ inherent process of abstraction and homogenisation is epistemically violent because it erases animals’ singularities. I also argue that considering the sentience we can know of as the only characteristic that marks animals as worthy of moral considerability, as Singer does, can lead to violent actions towards animals because this logic erases all the violence that escapes sentientist logics. I show that key to this critique is Singer’s (...) misunderstanding of human sovereignty, and the relationship between human sovereignty and subjectivity. Further, I examine Singer’s conception of the “I”, and find that it is a lifeless and static one that leads his theory to foreclose ethical judgements. This article shows that animals’ irreducibility, vulnerabilities and otherness are sufficient to regard animals as worthy of moral considerability. Finally, I examine some practical implications of the arguments I advance. (shrink)

We introduce a family of tableau calculi for deontic action logics based on finite boolean algebras, these logics provide deontic operators which are applied to a finite number of actions ; furthermore, in these formalisms, actions can be combined by means of boolean operators, this provides an expressive algebra of actions. We define a tableau calculus for the basic logic and then we extend this calculus to cope with extant variations of this formalism; we prove the soundness and completeness of (...) these proof systems. In addition, we investigate the computational complexity of the satisfiability problem for DAL and its extensions; we show this problem is NP-complete when the number of actions considered is fixed, and it is \-Hard when the number of actions is taken as an extra parameter. The tableau systems introduced here can be implemented in PSPACE, this seems reasonable taking into consideration the computational complexity of the logics. (shrink)

How should political power and influence be allocated in democratic systems? That is, roughly, the core of the boundary problem in democratic theory. As of late, some authors have begun paying increased attention to the methodological aspects of this dispute. This paper attempts to make a twofold contribution to this ‘methodological turn’. On the one hand, it identifies and analyzes five desiderata of a successful principle of democratic inclusion. Any such principle, I argue, must be grounded in a clearly identifiable (...) set of values, must provide a clear standard of inclusion, must specify the relevant modalities of inclusion, must provide sound bridging principles, and must be extensionally adequate. In the first half of the paper, these desiderata are developed and critically scrutinized. On the other hand, I also extract three lessons from the previous discussion. First, that a unique answer to the boundary problem (i.e. one grounded in one single principle) is unlikely. Second, that a satisfactory answer to the boundary problem need not necessarily appeal, as some have argued, to distinctively democratic values. And third, that intuitions about political exclusion (i.e. those requiring or permitting the exclusion of some individuals) should be treated with special caution. (shrink)

The ‘paradoxes of coincidence’ are generally taken as an important factor for deciding between rival views on persistence through time. In particular, the ability to deal with apparent cases of temporary coincidence is usually regarded as a good reason for favouring perdurantism (or ‘four-dimensionalism’) over endurantism (or ‘three-dimensionalism’). However, the recent work of Gilmore ( 2007 ) and McGrath ( 2007 ) challenges this standard view. For different reasons, both Gilmore and McGrath conclude that perdurantism does not really obtain support (...) from the puzzles of temporary coincidence. In this paper, I will evaluate their arguments and defend the opposite view: that the paradoxes of coincidence do give some support to perdurantism. However, the way in which they do so is rather unexpected. As we will see, there are different ways in which coincidence scenarios may be thought to support perdurantism, some of which have not yet been sufficiently explored. Thus, my immediate goal is to explore one of those directions, bringing into focus a new argument from coincidence to perdurantism. And although I motivate my discussion by examining the arguments in the work of Gilmore and McGrath, the merits of this argument can be independently assessed. More generally, my overall purpose is to contribute to our general understanding of how the topics of coincidence and persistence bear on each other. (shrink)

In this article, we shift the usual analytical attention of the GPN framework from lead firms to suppliers in the network and from production to IT services. Our focus is on how Indian IT suppliers embed in the Netherlands along the threefold characterization of societal, territorial and network embeddedness. We argue that Indian IT suppliers attempt to display societal embeddedness when they move to The Netherlands. Our findings reveal that the endeavour by Indian IT suppliers to territorially dis-embed from the (...) Dutch context is reinforced by their peripheral position in the network and their ability to offshore work in a bid to contain costs, in addition to the influence of client domination. Therefore, territorial embeddedness is considered to be secondary to societal embeddedness which is intertwined with client interest while neglecting the interest of other network members. Nonetheless, the inter-firm relationship is complex, given the tension between societal, territorial and network embeddedness. While preferring Indian IT suppliers because of their low pricing, Dutch clients also insist on compliance with the institutional context of the Netherlands especially when it comes to Dutch employees. This results in hybridization which means that Indian IT suppliers find ways to adhere to the institutional framework for Dutch nationals while simultaneously insulating Indian employees from the same. Consequently, a highly unfair segmented internal labour market develops, with Dutch nationals being treated more favourably as compared to Indian nationals. Nonetheless, to address these violations, Indian employees prefer individual strategies of resilience and rework rather than a collectivization response. (shrink)

This paper discusses Fara's so-called 'Paradox of Higher-Order Vagueness' concerning supervaluationism. In the paper I argue that supervaluationism is not committed to global validity, as it is largely assumed in the literature, but to a weaker notion of logical consequence I call 'regional validity'. Then I show that the supervaluationist might solve Fara's paradox making use of this weaker notion of logical consequence. The paper is discussed by Delia Fara in the same volume.

The supervaluationist theory of vagueness is committed to a particular notion of logical consequence known as global validity. According to a recent objection, this notion of consequence is more problematic than is usually thought since i) it bears a commitment to some sort of bizarre inferences, ii) this commitment threatens the internal coherence of the theory and iii) we might find counterexamples to classically valid pat- terns of inference even in the absence of a definitely-operator (or similar device). As a (...) consequence, the supervaluationist theory itself is in trou- ble. This paper discusses the objection. (shrink)

The thesis that I wish to discuss in this paper is the next: Human Sciences (Cultural Sciences according to Dilthey, Historic-Hermeneutic sciences according to Habermas) are possible as far as the method that should make all of them possible can be epistemologically justified, this method is the hermeneutic understanding of meaning, whose central point is, in fact, the hermeneutic circle. The matter is to try to justify epistemologically the hermeneutic as understanding the meaning of the own and the other ones (...) life experiences within reflexivity and reciprocity that impregnates the structure of ordinary language. In the dialogue Habermas to Dilthey, in Knowledge and Human Interests appear many arguments to this foundation. Our text will make special emphasis in the next items: distinction between natural sciences and cultural sciences, hermeneutic understanding of meaning, ordinary language and reflexivity, specificity of the hermeneutic circle, science an vital context, and, finally, we are going to make an account of the Habermas interpretation of the Dilthey start point in bases to the relationships between Historic-hermeneutic sciences and the practice interest of the knowledge. Nietzsche understands that the world unfolds as a will to power. If we want to properly understand this cosmological perspective, we must start by attributing immanent activity not only to organisms, but also to beings called “inorganic”. With this in mind, in this article we examine, in an “ascending” way, the features of the vital becoming in both strata, that is, from the minerals, with their attractions and repulsions, until reaching the man himself and his conscious operations. All the problems (...) involved in this monistic perspective are approached from argumentations that are based on Nietzsche’s readings. Strauss, Dubois Reymond, Herzen, Spencer, Lange, Delfœuf, are some of the cited sources that allow this writing to give an account of how Nietzsche makes life prevail, beyond being, as the primordial phenomenon in all orders. This paper's aim is to study the Greek simile of the ship of state, since it was born in the Lyric Poetry until its definitive drawing by Plato's hands. It describes the image of Paros' ship, by Archilochus, or the ship of city by Alcaeus and by Theognis. Analyzes how this image improves through the tragedies of Aeschylus and Sophocles, and their moral comprehension of it. And, at last, explains the excellence achieved as the central image on Plato's politic project.

This article aims to review the last three decades of the comic Spain. The study is evaluating the evolution of the comics industry, from its beginnings during the dictatorship and its expansion with the advent of democracy until the present times of difficulties and changes. The rise of the comic can be seen in its growing importance within the press, the acceptance of a public that matures over time and especially in the sales of an industry that has to adapt (...) to new situations. La cordillera y el acceso a ella, desde el Elqui hasta Los Andes, es un elemento troncal de su poesía, adquiriendo características particulares en cada etapa de su creación poética y visión política, las cuales se (...) analizarán en el presente artículo. The arrival of the Transandean Railway influenced the aesthetic perception that passers-by formed of the local geography. The mountain appears as a fundamental element of poetry in various authors, including Chilean poet Gabriela Mistral. The mountains and its access, from the Elqui to the Andes, are a core element of her poetry, acquiring particular characteristics at each stage of her poetic creation and political vision, which will be analyzed in this article. The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

In 2006, this journal addressed the problem of technological artefacts, and through a series of articles aimed at tackling the ‘dual nature of technical artefacts’, posited an understanding of these as constituted by both a structural and a functional component. This attempt to conceptualise artefacts established a series of important questions, concerning such aspects of material technologies as mechanisms, functions, human intentionality, and normativity. However, I believe that in establishing the ‘dual nature’ thesis, the authors within this issue focused too (...) strongly on technological function. By positing function as the analytic axis of the ‘dual nature’ framework, the theorists did not sufficiently problematise what is ultimately a social phenomenon. Here I posit a complementary analytic approach to this problem; namely, I argue that by using the Strong Programme’s performative theory of social institutions, we can better understand the nature of material technologies. Drawing particularly from Martin Kusch’s work, I here argue that by conceptualising artefacts as artificial kinds, we can better examine technological ontology, functions, and normativity. Ultimately, a Strong Programme approach, constructivist and collectivist in nature, offers a useful elaboration upon the important question raised by the ‘dual nature’ theorists.Keywords: Technological artefacts; Dual nature; Technological functions; Normativity of artefacts; Performative theory of social institutions. Increasing global competition has intensified the use of informal sector workforce worldwide. This phenomenon is true with regard to India, where 92% of the workers hold precarious jobs. Our study examines the dynamics of workplace dignity in the context of Indian security guards deployed as contract labour by private suppliers, recognising that security guards’ jobs were marked by easy access, low status, disrespect and precariousness. The experiences of guards serving bank ATMs were compared with those working in large reputed organisations. (...) The former reported loss of dignity though their inherent self-worth remained partially intact, whereas the latter reclaimed dignity despite the precarious working conditions and the absence of unions. Guards from large reputed organisations evolved strategies by which they took advantage of the client’s vulnerabilities, developed ‘thick’ relationships at work and immersed themselves in 'doing dignity work' to ensure that they are not disposable. ‘Doing dignity work’ was a visible device which involved actions that met or went beyond the norms laid down by the client and was used by security guards to limit the extent of their precariousness. Since the opportunity to reclaim dignity was facilitated by large reputed clients’ adherence to legal regulations, we see implications of the study for the moral economy. (shrink)

Synthetic biology, an emerging field of science and technology, intends to make of the natural world a substrate for engineering practice. Drawing inspiration from conventional engineering disciplines, practitioners of synthetic biology hope to make biological systems standardized, calculable, modular, and predictably functional. This essay develops a Heideggerian reading of synthetic biology as a useful perspective with which to identify and explore key facets of this field, its knowledge, its practices, and its products. After overviews of synthetic biology and Heidegger’s account (...) of technology, I discuss calculability, utility, function, setting-upon, and ordering, with the aim of discussing the manner in which synthetic biology works to render the biological world intelligible as something to be used, rather than something that is in and of itself. Having developed this Heideggerian reading, I proffer a number of corrections to his account that enable a more accurate, nuanced understanding of synthetic biology. Specifically, I discuss the notion of Ge-stell and submit that multiple systems of “enframing” may help to make Heidegger’s argument more robust. I suggest that synthetic biology may work to reveal the natural world as a standing-reserve of function. (shrink)
