In this article I defend the thesis of a strong similarity between the modern critique of Christian revelation and the main arguments of contemporary pluralist theologians. As a relevant spokesperson of modern thought I take Karl Jaspers. After having presented his most important writings on religion and belief, I discuss three general features of modern thought, namely, subjectivism, ethical humanism and universalism. I argue that these characteristics not only figure in Jaspers’ critique of Christianity, but that they are also fundamental (...) to the pluralist theology of religions. Then I focus on characteristics of modern thought regarding religion in particular. First I analyse the specific kind of ‘natural theology’ in Jaspers’ philosophy and in pluralism, and I continue with the question of christology. In both cases I discern a parallel intuition. In dit artikel nemen we een oud dispuut over de transsubstantiatie of wezensverandering in het ritueel of sacrament van de christelijke avondmaalsviering of eucharistieviering als uitgangspunt. Dit dispuut gaat over de werkelijkheidswaarde van brood en wijn als het lichaam en bloed van Christus. Als we het symbool in zijn oorspronkelijke (...) betekenis van het verbindende nemen en de notie ‘werkelijkheid’ niet uitsluitend aan de criteria van de natuurwetenschappelijkheid onderwerpen, dan kunnen we inzien hoe rituelen, juist omdat ze symboliseren, werkelijkheid op het oog hebben. Euthanasia and assisted suicide have been legally possible in the Netherlands since 2001, provided that statutory due care criteria are met, including: voluntary and well-considered request; unbearable suffering without prospect of improvement; informing the patient; lack of a reasonable alternative; independent second physician’s opinion. ‘Unbearable suffering’ must have a medical basis, either somatic or psychiatric, but there is no requirement of limited life expectancy. All EAS cases must be reported and are scrutinised by regional review committees. The purpose of this (...) study was to investigate whether any particular difficulties arise when the EAS due care criteria are applied to patients with an intellectual disability and/or autism spectrum disorder. The 416 case summaries available on the RTE website were searched for intellectual disability and autism spectrum disorder. Direct content analysis was used on these nine cases. Assessment of decisional capacity was mentioned in eight cases, but few details given; in two cases, there had been uncertainty or disagreement about capacity. Two patients had progressive somatic conditions. For most, suffering was due to an inability to cope with changing circumstances or increasing dependency; in several cases, suffering was described in terms of characteristics of living with an autism spectrum disorder, rather than an acquired medical condition. Some physicians struggled to understand the patient’s perspective. Treatment refusal was a common theme, leading physicians to conclude that EAS was the only remaining option. There was a lack of detail on social circumstances and how patients were informed about their prognosis. Autonomy and decisional capacity are highly complex for patients with intellectual disabilities and difficult to assess; capacity tests in these cases did not appear sufficiently stringent. Assessment of suffering is particularly difficult for patients who have experienced life-long disability. The sometimes brief time frames and limited number of physician-patient meetings may not be sufficient to make a decision as serious as EAS. The Dutch EAS due care criteria are not easily applied to people with intellectual disabilities and/or autism spectrum disorder, and do not appear to act as adequate safeguards. (shrink)

Sex workers in the Netherlands experienced severe financial and social distress during the COVID-19 health crisis. Notwithstanding them paying taxes over the earnings, they were excluded from government financial support, faced discriminatory treatment concerning safe reopening, and experienced increased repression and stigmatization. In this contribution, I explore whether the concept of “vulnerability” contributes to understanding (and addressing) that situation. Data acquired through participatory action research, partly taking place online during lock-down measures, and literature and content analysis show that labeling sex (...) workers “vulnerable” deflects attention away from the (in)actions of Dutch authorities responsible for sex workers’ precarious conditions during the pandemic. Government denial and strategies of abjection explain these conditions better than “vulnerability” does, as they return the gaze to actors and processes accountable for sex workers’ exclusion and criminalization during the COVID-19 health crisis and thereby put responsibility where it belongs. This study reports the findings of a 2.5 year intervention project to reduce psychosocial risks and increase employee well-being in 15 emergency departments in the Netherlands. The project uses the psychosocial risk management approach “PRIMA” which includes cycles of risk assessment, designing and implementing changes, evaluating changes and adapting the approach if necessary. In addition, principles of participative action research were used to empower the departments in designing and implementing their own actions during the project. Next to determining overall effects, (...) the study aims to assess potential moderators including the level of intervening, process variables and partaking in a Psychosocial Safety Climate intervention offered during the second half of the project. The results of linear mixed-model analyses showed that all job factors improved with the exception of autonomy, which did increase halfway the project but not when considering the entire timeframe. In addition, work engagement decreased and symptoms of burnout remained stable. Emergency departments that implemented more fitting actions, communicated better and involved their employees more in the process, had more favorable changes in job factors and more stable well-being. More activity and a multilevel approach regarding stress management did not lead to greater improvements. The Psychosocial Safety Climate intervention was effective in improving Psychosocial Safety Climate, but a longer follow-up period seems required to evaluate its effect on job factors and well-being. Overall, the project resulted in positive changes in most job factors, and its findings emphasize the importance of process variables in stress management interventions. Longer follow-up and higher quality multilevel interventions seem essential to also improve well-being. (shrink)

During the COVID-19 pandemic, universities had to shift from face-to-face to emergency remote education. Students were forced to study online, with limited access to facilities and less contact with peers and teachers, while at the same time being exposed to more autonomy. This study examined how students adapted to emergency remote learning, specifically focusing on students’ resource-management strategies using an individual differences approach. One thousand eight hundred university students completed a questionnaire on their resource-management strategies and indicators of successful adaptation (...) to emergency remote learning. On average, students reported being less able to regulate their attention, effort, and time and less motivated compared to the situation before the crisis started; they also reported investing more time and effort in their self-study. Using a k-means cluster analysis, we identified four adaptation profiles and labeled them according to the reported changes in their resource-management strategies: the overwhelmed, the surrenderers, the maintainers, and the adapters. Both the overwhelmed and surrenderers appeared to be less able to regulate their effort, attention, and time and reported to be less motivated to study than before the crisis. In contrast, the adapters appreciated the increased level of autonomy and were better able to self-regulate their learning. The resource-management strategies of the maintainers remained relatively stable. Students’ responses to open-answer questions on their educational experience, coded using a thematic analysis, were consistent with the quantitative profiles. Implications about how to support students in adapting to online learning are discussed. (shrink)

The present article examines if the principle of freedom of the high seas as formulated by Hugo de Groot still plays a significant role in international law. The article starts from an analysis of De Groot's ideas on the law of the sea and then turns to the freedom of the high seas in the modern law of the sea. In both cases, the legal framework is assessed against the background of the activities that require regulation. Freedom of the high (...) seas, although it has lost ground to other ordering principles, remains significant at the level of principles. However, at the level of designing an effective regime for current problems in oceans management, which to a large extent are caused by deficiencies in the enforcement scheme implicit in freedom of the high seas, the writings of De Groot, in whose time those activities did not require any significant measure of international coordination and cooperation, offer little assistance. The expansion of livestock production throughout the world has led to increased demand for high protein animal feed. This expansion has created economic benefits for livestock farmers and other actors in the chain, but also resulted in environmental and social side effects. This study aims to identify a set of sustainability issues that cover the environmental, economic and social dimensions of soymeal and beef production chains. The method applied combines the results of multiple studies, including a literature review and stakeholder (...) surveys. Stakeholder surveys were conducted for three different interest groups and two geographical regions . Our results reveal that the selection of issues in most sustainability assessment studies is a relatively arbitrary decision, while the literature also states that identifying issues is an important step in a sustainability assessment. Defining sustainability issues from a whole chain perspective is important, as issues of sustainability emerge at various stages along the production chain, and are found to vary across stakeholders’ interests. Business stakeholders, for example, perceived economic issues to be more important, whereas the majority of consumer stakeholders and other stakeholders perceived social and environmental issues, respectively, to be more important. Different education levels, knowledge, and living patterns in various geographical regions can affect the stakeholders’ perceptions. The combination of a heterogeneous group of stakeholders and the consideration of multiple chain stages constitutes a useful approach to identify sustainability issues along food chains. (shrink)

Decisions related to animal welfare standards depend on farmer’s multiple goals and values and are constrained by a wide range of external and internal forces. The aim of this paper is twofold, i.e., to develop a theoretical framework for farmers’ AW decisions that incorporates farmers’ goals, use and non-use values and to present an approach to empirically implement the theoretical framework. The farmer as a head of the farm household makes choices regarding production to maximize the utility of the household. (...) The overall utility of the farmer is determined by his multiple objectives. For the analysis of multi-objective problems, the multiple criteria decision - making paradigm provides an appropriate theoretical framework. However, theories from the field of social-psychology are needed to facilitate the identification of all relevant aspects in the decision making. The practical use of the conceptual framework is demonstrated using a simple numerical application of a multi-objective programming model. Two workshops were devoted to examining the scientific consistency and the practical usefulness of the approach. Implementing this approach will increase knowledge of the main factors and barriers that determine farmers’ decisions with regard to AW standards. This knowledge is relevant during the development of new AW concepts that aims to supply products that comply with above-legal AW standards for middle-market segments. (shrink)

The authors investigate MacCormick and Weinberger's claim that the Institutional Theory of Law provides a conceptual framework for the study of legal phenomena from a socio-legal point of view. They evaluate this claim by confronting both the Institutional Theory of Law and Weinberger's theory of action with two approaches in socio-legal theory, i.e. the instrumentalist and the constitutive approach. The conclusion is that the Institutional Theory of Law lends itself to empirical research from an instrumentalist perspective, for both place the (...) concept institution in the context of law. Weinberger's theory of action may provide a basis for empirical research from a constitutive perspective. The authors make some suggestions for refinement of Weinberger's theory of action in order that the relation between institutions and action can be labeled dynamic. (shrink)

Selecting a large and diverse sample of 5–6-year-old preschool children, we aimed to extend previous findings on variability in children’s home math environment and its association with children’s mathematical skills. We operationalized mathematics in a broader way than in previous studies, by considering not only children’s numerical skills but also their patterning skills as integral components of early mathematical development. We investigated the effects of children’s gender and socioeconomic status on their home math environment, examined the associations between children’s home (...) math environment and their mathematical skills, and verified whether these associations were moderated by children’s gender and/or SES. Parents of 353 children completed a home math environment questionnaire and all children completed measures of their numerical and patterning skills. Results indicated no effect of children’s gender on their home math environment. There was no effect of SES on the performed home math activities, but small SES differences existed in parents’ math-related expectations and their attitudes. We found no evidence for associations between children’s home math environment and their mathematical skills. Furthermore, there were no moderating effects of gender or SES on these associations. One explanation for these findings might relate to the characteristics of the general preschool system in the country of the present study. Future studies should consider the effect of the preschool learning environment because it might explain differences between studies and countries with regard to the home math environment and its association with mathematical skills. La phénoménologie semble condamner cette entreprise à un échec inévitable en prétendant que le réel ne se manifeste que dans la rencontre de l'homme avec lui. Ce que (...) nous connaissons portera donc toujours l'empreinte de notre présence et ne sera donc jamais le réel en lui-même. Heidegger ne semble pas moins nous éloigner de l'ancien problème de la métaphysique. Dans son intention de l'approfondir, il semble plutôt en écarter le problème pour le remplacer par un autre. Sa méditation porte en effet sur la lumière originelle -toujours oubliée -dans laquelle le monde se révèle à nous, mais il ne semble pas en arriver à réfléchir sur ce qui devient visible grâce à cette lumière. Il semble pourtant que, tant l'idée de rencontre que celle de lumière originelle élimine si peu l'affirmation du réel lui-même, qu'elles le supposent plutôt, aussi longtemps qu'on veut éviter l'idéalisme le plus radical. Or, c'est sur le sens de cette affirmation implicite et sur le réel visé par elle que la métaphysique de l'Ecole veut réfléchir. Mais un second obstacle risque de faire échouer cette tentative. Le réel n'est-il pas individuel, temporel, irréductible ? N'est-ce pas dès lors impossible d'en parler, puisque notre langue n'est faite que de concepts généraux et intemporels ? A cette question, on peut d'abord répondre que tout notre appareil de concepts généraux est soutenu par un moment de contact avec le réel lui-même. Seulement ceci ne semble pas encore nous avancer beaucoup. En effet, cette saisie intuitive n'est-elle pas condamnée à rester implicite et muette ? Une issue à ce problème nous semble possible en poursuivant la ligne de réflexion de l'ancienne théorie de l'illumination. C'est en réfléchissant sur les caractéristiques de la vérité telle qu'elle nous est accessible, que nous pourrions arriver à dire quelque chose du concret lui-même. En effet, il se manifeste à nous comme étant inséré dans la totalité du réel qui nous est ouverte dans une sorte d'ouverture antécédente et constitutive de notre existence. Or ces deux aspects, qu'on ne saurait nier sans totalement exclure l'homme du royaume de la vérité, semblent postuler la Présence Totale de l'Origine dans la moindre parcelle du réel. This paper builds on the work of Tuffrey-Wijne et al. and explores the issue of vulnerability and persons with disabilities in relation to Euthnasia and Assisted Dying. The commentary draws on both the literature and on case examples from Canada. Specifically, it considers the issue of EAS as an alternative to, or substituted for, appropriate disability supports. Secondly, it considers the issue of the devaluation of disabled lives in general and within health care practice and ethics. It concludes that current (...) safeguards are inadequate and that as EAS regimes become more permissive the risk to disabled persons will increase. (shrink)

Sarel Cilliers as an elder or former elder in church: The well-known Voortrekker Sarel Cilliers was in the first place not recognised as a military or cultural leader, but a spiritual leader and respected elder in church. Apart from his emotional approach to the affairs of the Dutch Reformed Church of which he was a member in a congregation, Cilliers was a reformed member who strifed to obey the Bible, the Reformed confessions of faith and the so-called law of his (...) church. Cilliers was chosen to take the lead when the Voortrekkers made a covenant with God before the Battle of Bloodriver in Natal on 16 December 1838. This covenant was initiated by the then leader of the Trekkers, Andries Pretorius. Cilliers did his work as an elder truthfully and with enthusiasm. He was strict and truthfull in his visits to church members and represented his congregation on major assemblies. In these assemblies fellow church members treated him with respect. Cilliers was an elder in a church which had to be settled in the interior of South Africa, often under abnormal circumstances. He sometimes had to do tasks of the minister of the congregation as well. Sarel Cilliers became known as a special elder in church.Contribution: This article gives an insight in the view and practice of the office of the elder in the Dutch Reformed Church in pioneer circumstances in the 19th century. It opens an assessment of this office for implementation in recent times. Apart from that the article sheds light on truthful understanding of the vow of Afrikaners at Blood River in 1838. This matter remains a point of discussion in recent times. (shrink)
