Both the Kevelson Seminar topic, ‘Lawyers as Makers of Meaning,’ and the appearance of a highly-publicized television series in the United States dedicated to the life of President John Adams (1735–1826) invite inquiry into Adams’ role as a lawyer who shaped the meaning of the American Revolution (and his role in bringing it about). Three trials from Adams’ early legal career illustrate that he presented both himself and fellow resistance leader James Otis, Jr., as heroic loners struggling for the (...) rights of Americans against British injustice. Although he did not call it that, in 1970 lawyer and future Massachusetts Superior Court Justice Hiller Zobel, in his book The Boston Massacre, undertook what we would consider a semiotic approach that investigated the relevant codes and contexts—both the legal complexities and the audiences, other lawyers, judges, and posterity about which Adams spoke, simplifying and minimizing their roles as he maximized his own (and Otis’s). Zobel’s own relationship with Adams’ legal career appeared in his own tenure on the bench, especially in the famous ‘Nanny’ (discussed by Denis Brion, in this issue) case in which he explicitly presented the Boston Massacre Trials as a relevant precedent. Despite Adams’ willingness to subordinate his clients’ welfare to the patriot cause early in his career, it can be argued that HBO television and historian David McCullough, by presenting him to the public only flawed by his outspoken, stubborn honesty, have nevertheless performed a public service. Their version of Adams offers Americans in the twenty-first century an alternative role model to the dishonest, ill-informed politicians who use public opinion polls rather than political theory, moral philosophy, and historical knowledge as the basis of their decisions. Bernard Williams is remembered as one of the most brilliant and original philosophers of the past fifty years. Widely respected as a moral philosopher, Williams began to write about politics in a sustained way in the early 1980s. There followed a stream of articles, lectures, and other major contributions to issues of public concern--all complemented by his many works on ethics, which have important implications for political theory. This new collection of essays, most of them previously unpublished, addresses (...) many of the core subjects of political philosophy: justice, liberty, and equality; the nature and meaning of liberalism; toleration; power and the fear of power; democracy; and the nature of political philosophy itself. What does it mean to be truthful? What role does truth play in our lives? What do we lose if we reject truthfulness? No philosopher is better suited to answer these questions than Bernard Williams. Clark has recently suggested that predictive processing advances a theory of neural function with the resources to put an ecumenical end to the “representation wars” of recent cognitive science. In this paper I defend and develop this suggestion. First, I broaden the representation wars to include three foundational challenges to representational cognitive science. Second, I articulate three features of predictive processing’s account of internal representation that distinguish it from more orthodox representationalist frameworks. Specifically, I argue that it posits a resemblance-based (...) representational architecture with organism-relative contents that functions in the service of pragmatic success, not veridical representation. Finally, I argue that internal representation so understood is either impervious to the three anti-representationalist challenges I outline or can actively embrace them. (shrink)

The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

He believed that there can be no timeless justification of political power, which he takes Kant and Rawls to aim at. Likewise, liberalism ignores that legitimation depends on historical circumstances. Williams’s historical relativism comes hand in hand with a realism that makes him object to utopian theories. Two striking claims are advanced on behalf of the free energy principle in cognitive science and philosophy: that it identifies a condition of the possibility of existence for self-organising systems; and that it has important implications for our understanding of how the brain works, defining a set of process theories—roughly, theories of the structure and functions of neural mechanisms—consistent with the free energy minimising imperative that it derives as a necessary feature of all self-organising systems. I argue that the conjunction (...) of claims and rests on a fallacy of equivocation. The FEP can be interpreted in two ways: as a claim about how it is possible to redescribe the existence of self-organising systems, and as a claim about how such systems maintain their existence. Although the Descriptive FEP plausibly does identify a condition of the possibility of existence for self-organising systems, it has no important implications for our understanding of how the brain works. Although the Explanatory FEP would have such implications if it were true, it does not identify a condition of the possibility of existence for self-organising systems. I consider various ways of responding to this conclusion, and I explore its implications for the role and importance of the FEP in cognitive science and philosophy. (shrink)

This paper shows that Husserl is not guilty of Sellars’ myth of the sensory given. I firstly show that Husserl’s account of ‘sensations’ or ‘sense data’ seems to possess some of the attributes Sellars’ myth critiques. In response I show that, just as Sellars thinks that our ‘conceptual capacities’ afford us an awareness of a logical perceptual space that has a propositional structure, Husserl thinks that ‘acts of apprehension’ structure sensations to afford us perception that is similarly propositionally structured. Not (...) only this, but there is much affinity and shared motivation between Husserl and Sellars accounts of the sensory stratum. Reflection on phenomenological considerations prevents Sellars from denying phenomenal non-conceptual content, whilst Husserlian ‘sense data’ are technical designations; dependant parts of perceptual experience grasped in abstraction, necessary for providing a reflective/philosophical account of empirical knowledge. I show that both Husserl and Sellars assert that the proper description of phenomenal content affords it the function of presenting properties of spatial objects during perception, and reiterate the well-known fact that Husserl thinks that perception is of ‘conceptually’ apprehended spatiotemporal objects. This paper explores how medical practice ought to be conducted, in the face of scarcity, if our objective is to maximise the benefits of health. After explaining briefly what the cost-per-QALY criterion means, a series of ethical objections to it are considered one by one. The objectors fall into four groups: a. those who reject all collective priority-setting as unethical; b. those who accept the need for collective priority-setting, but believe it is contrary to medical ethics; c. those who accept (...) the need for collective priority-setting, and do not believe that it is contrary to medical ethics, but reject the role of QALYs in it; d. those who accept the need for collective priority-setting in principle, but are unwilling to specify how it should be done in practice. -/- The purpose of this discussion paper is to give each group a hard time! The paper problematises the reliability and ethics of using social media data, such as sourced from Twitter or Instagram, to carry out health-related research. As in many other domains, the opportunity to mine social media for information has been hailed as transformative for research on well-being and disease. Considerations around the fairness, responsibilities and accountabilities relating to using such data have often been set aside, on the understanding that as long as data were anonymised, no real ethical or scientific issue (...) would arise. We first counter this perception by emphasising that the use of social media data in health research can yield problematic and unethical results. We then provide a conceptualisation of methodological data fairness that can complement data management principles such as FAIR by enhancing the actionability of social media data for future research. We highlight the forms that methodological data fairness can take at different stages of the research process and identify practical steps through which researchers can ensure that their practices and outcomes are scientifically sound as well as fair to society at large. We conclude that making research data fair as well as FAIR is inextricably linked to concerns around the adequacy of data practices. The failure to act on those concerns raises serious ethical, methodological and epistemic issues with the knowledge and evidence that are being produced. (shrink)

Dreaming is a statistically robust cognitive correlate of REM sleep, but all of its formal features may occur in other states of sleep and even in waking, especially during fantasy. In order to test the hypothesis that the brain basis of such cognitive features as dream bizarreness is to be found in REM sleep neurophysiology, it is critical to quantify bizarreness in dreams and other mental states and to analyze the data with respect to both the magnitude and the kind (...) of bizarreness so measured. Any differences in the cognitive dimensions are candidate correlates of REM sleep neurophysiology. Sixty pairs of home-based dream and fantasy reports were collected from 12 subjects and scored for bizarreness using a two-stage scoring system adapted from Hobson, Hoffman, Helfand, and Kostner . Our results show that bizarreness was twice as prevalent in dream reports as in wake-state fantasy reports of the same subjects. Further analysis of the reports also showed differences in other features including the number of persona and remoteness of time and place. (shrink)

Although the Evans argument against vague identity has been much discussed, proposah for blocking it have not so far satisfied general conditions which any solution ought to meet. Moreover, the relation between ontically vague identity and ontic vagueness more generally has not yet been satisfactorily addressed. I advocate a way of resisting the Evans argument which satisfies the conditions. To show how this approach can vindicate particular cases of ontically vague identity, I develop a framework for describing ontic vagueness in (...) general in terms of multiple actualities. This provides aprìncipled approach to ontically vague identity which is unaffected by the Evans argument. (shrink)

I clarify and defend the hypothesis that human belief formation is sensitive to social rewards and punishments, such that beliefs are sometimes formed based on unconscious expectations of their likely effects on other agents – agents who frequently reward us when we hold ungrounded beliefs and punish us when we hold reasonable ones. After clarifying this phenomenon and distinguishing it from other sources of bias in the psychological literature, I argue that the hypothesis is plausible on theoretical grounds and I (...) show how it illuminates and unifies a range of psychological phenomena, including confabulation and rationalisation, positive illusions, and identity-protective cognition. Like the two earlier volumes of Williams's papers published by Cambridge University Press, Problems of the Self and Moral Luck, this volume (...) will be welcomed by all readers with a serious interest in philosophy. Worlds where things divide forever ("gunk" worlds) are apparently conceivable. The conceivability of such scenarios has been used as an argument against "nihilist" or "near-nihilist" answers to the special composition question. I argue that the mereological nihilist has the resources to explain away the illusion that gunk is possible.

This article distinguishes Wittgensteinian contextualism from epistemic relativism. The latter involves the view that a belief ’s status as justified depends on the believer’s epistemic system, as well as the view that no system is superior to another. It emerges from the thought that we must rely, circularly, on our epistemic system to determine whether any belief is justified. Contextualism, by contrast, emerges from the thought that we need not answer a skeptical challenge to a belief unless there is good (...) reason to doubt the belief; so we need not rely on our epistemic system to determine whether a belief is justified. Accordingly contextualism is not committed to the view that a belief ’s status depends on the believer’s epistemic system, nor to the view that no system is superior to another.
