Healthcare (including public health) is special because it protects normal functioning, which in turn protects the range of opportunities open to individuals. I extend this account in two ways. First, since the distribution of goods other than healthcare affect population health and its distribution, I claim that Rawls's principles of justice describe a fair distribution of the social determinants of health, giving a partial account of when health inequalities are unjust. Second, I supplement a principled account of justice for health (...) and healthcare with an account of fair process for setting limits or rationing care. This account is provided by three conditions that comprise "accountability for reasonableness.". (shrink)

Ludwig Wittgenstein, who died in Cambridge in 1951, is one of the most powerful influences on contemporary philosophy, yet he shunned publicity and was essentially a private man. His friend Norman Malcolm (himself an eminent philosopher) wrote this remarkably vivid personal memoir ofWittgenstein, which was published in 1958 and was immediately recognized as a moving and truthful portrait of this gifted, difficult man.This edition includes also the complete text of the fifty-seven letters which Wittgenstein wrote to Malcolm over a (...) period of eleven years. Apart from the quotations in the Memoir these letters are previously unpublished. They reveal how much friendships mattered to Wittgenstein, and how concerned hewas for the health and well-being of his friends. His human qualities become evident; he advises, warns, jokes. and is grateful and affectionate.The volume also features a concise biographical sketch by another leading philosopher who was a friend of Wittgenstein, Georg Henrik von Wright.Much has been published about Wittgenstein since his death, but nothing brings us closer to the man himself than this modest classic of philosophical biography. We first describe how the concept of “fringe consciousness” can characterise gradations of consciousness between the extremes of implicit and explicit learning. We then show that the NEO-PI-R personality measure of openness to feelings, chosen to reflect the ability to introspect on fringe feelings, influences both learning and awareness in the serial reaction time task under conditions that have previously been associated with implicit learning . This provides empirical evidence for the proposed phenomenology and functional role of fringe consciousness in (...) so-called implicit learning paradigms . Introducing an individual difference variable also helped to identify possible limitations of the exclusion task as a measure of conscious sequence knowledge. Further exploration of individual differences in fringe awareness may help to avoid polarity in the implicit learning debate, and to resolve apparent inconsistencies between previous SRT studies. Independently of any eighteenth century work on the geometry of parallels, Thomas Reid discovered the non-euclidean "geometry of visibles" in 1764. Reid's construction uses an idealized eye, incapable of making distance discriminations, to specify operationally a two dimensional visible space and a set of objects, the visibles. Reid offers sample theorems for his doubly elliptical geometry and proposes a natural model, the surface of the sphere. His construction draws on eighteenth century theory of vision for some of its technical features (...) and is motivated by Reid's desire to defend realism against Berkeley's idealist treatment of visual space. Fenton et al. present a Bayesian‐network analysis of the case, using their previously developed set of building blocks (‘idioms’). They claim that these idioms, combined with their opportunity‐based method for estimating the prior probability of guilt, reduce the subjectivity of their analysis. Although their Bayesian model is less cognitively feasible than scenario‐ or argumentation‐based models, they claim that it does model the standard approach to legal proof, which is to continually revise beliefs under new evidence.

This book critically examines the debate on Martin Heidegger's concept of Entscheidung and his engagement and confrontation with Nazism in terms of his broader philosophical thought. It argues that one cannot explain Heidegger's actions without accounting for his idea of "decision" and its connection to his understanding of individual "fate" and national "destiny." The book looks at the relation of biography to philosophy and the ethical and political implications of appropriating Heidegger's thinking in these domains of inquiry. It highlights themes (...) such as Heidegger's differences with the neo-Kantians in Germany; Heidegger on Kant and practical reason; and his reading of Nietzsche and Hegel. It offers a philosophical assessment grounded in Heidegger's own texts, with reference to historical and other philosophical commentaries on the rise of National Socialism in post-Weimar Germany and the philosophical issues associated with the interpretation of Nazi genocide and ideology. : The "dead donor rule" is increasingly under attack for several reasons. First, there has long been disagreement about whether there is a correct or coherent definition of "death." Second, it has long been clear that the concept and ascertainment of "brain death" is medically flawed. Third, the requirement stands in the way of improving organ supply by prohibiting organ removal from patients who have little to lose—e.g., infants with anencephaly—and from patients who ardently want to donate while still alive—e.g., (...) patients in a permanent vegetative state. One argument against abandoning the dead donor rule has been that the rule is important to the general public. There is now data suggesting that this assumption also may be flawed. These findings add additional weight to proposals to abandon the dead donor rule so that organ supply can be expanded in a way that is consistent with traditional notions of ethics, law, public policy, and public opinion. In his book The View from Nowhere , Thomas Nagel says that ‘the subjectivity of consciousness is an irreducible feature of reality’ . He speaks of ‘the essential subjectivity of the mental’ , and of ‘the mind's irreducibly subjective character’ . ‘Mental concepts’, he says, refer to ‘subjective points of view and their modifications’ : The subjective features of conscious mental processes—as opposed to their physical causes and effects—cannot be captured by the purified form of thought suitable for dealing with (...) the physical world that underlines the appearances. Not only raw feels but also intentional mental states—however objective their content—must be capable of manifesting themselves in subjective form to be in the mind at all. (shrink)

High-profile corporate scandals earlier in this decade provoked outrage and legislative action; however, corporate executive-level ethical lapses continue to come to light. This article examines the work of Professor Dunfee and his coauthors on corruption, ethical leadership, and social contracts theory, and relates that literature to corrupt activities by corporate executives. Corruption is defined broadly to encompass executive self-dealing, which harms their firms. The specific example of stock options backdating is used to show the harmful impact on shareholders and the (...) lack of managerial integrity though consequentialist, deontological, and legal analysis, as well as a critique of the practice using social contracts principles. Ultimately, this article utilizes the insights of Dunfee and his coauthors, and the lessons from the backdating example, to propose a framework aimed at improving corporate governance and preventing future executive corruption. The framework includes a strategy of identification and prevention, employing detection and eradication mechanisms, and institutional learning from past instances of corporate corruption. (shrink)

In his address to the conference Norman Bowie contrasted the business ethics climate in the US with that of the UK. He highlighted the adversarial nature of US corporate cultures and the heavy emphasis on compliance‐based programs, and contrasted this with the more collaborative relationships in the UK – and in Europe generally – which lead to partnerships with NGOs as a way to resolve ethical issues. However, the growing insistence that business ethics should pay is common to both (...) business environments. Professor Bowie raised two further issues of concern. One was the increasing professionalisation of the business ethics ‘business’, and the other was the reluctance of students to opt for business ethics courses. Taking these factors together suggests that the role of academics in business ethics is shrinking fast. (shrink)

I analyze the hierarchy of large cardinals between a supercompact cardinal and an almost-huge cardinal. Many of these cardinals are defined by modifying the definition of a high-jump cardinal. I organize these cardinals in terms of consistency strength and implicational strength. I also analyze the superstrong cardinals, which are weaker than supercompact cardinals but are related to high-jump cardinals. Among the results, I highlight the following. Vopěnka cardinals are the same as Woodin-for-supercompactness cardinals.There are no excessively hypercompact cardinals.Furthermore, I prove some results relating high-jump cardinals to forcing, as well as analyzing Laver functions for super-high-jump cardinals. We argue for a procedural approach to ethical critique in CDA based upon the ‘argumentative turn’ in CDA advocated in our recent publications. This is not a matter of abandoning substantive critique, or abandoning the long-standing commitment of our version of CDA to critique of domination and of ideology, but of integrating them into a deliberative procedure for critical questioning, from an impartial and unbiased standpoint. The advantage of this position is that it enables us to accentuate ethical criticism and (...) critique in CDA, rather than advocacy and partisanship. The task of critical discourse analysts is to subject argumentation, including their own argumentation, to systematic critical questioning in the spirit of open debate, with no ideological parti-pris. In this paper I argue that the poker analogy is unsuitable as a model for collective bargaining negotiations. Using the poker game analogy is imprudent, its use undermines trust and ignores the cooperative features of business, and its use fails to take into account the values of dignity and fairness which should characterize labor-management negotiations. I propose and defend a model of ideal family decision-making as a superior model to the poker game.

A technique for the bilateral activation of neural nets that leads to a functional asymmetry of two simulated ''cerebral hemispheres'' is described. The simulation is designed to perform object recognition, while exhibiting characteristics typical of human consciousness-specifically, the unitary nature of conscious attention, together with a dual awareness corresponding to the ''nucleus'' and ''fringe'' described by William James (1890). Sensory neural nets self-organize on the basis of five sensory features. The system is then taught arbitrary symbolic labels for a small (...) number of similar stimuli. Finally, the trained network is exposed to nonverbal stimuli for object recognition, leading to Gaussian activation of the ''sensory'' maps-with a peak at the location most closely related to the features of the external stimulus. ''Verbal'' maps are activated most strongly at the labeled location that lies closest to the peak on homologous sensory maps. On the verbal maps activation is characterized by both excitatory and inhibitory Gaussians (a Mexican hat), the parameters of which are determined by the relative locations of the verbal labels. Mutual homotopic inhibition across the ''corpus callosum'' then produces functional cerebral asymmetries, i.e., complementary activation of homologous ''association'' and ''frontal'' maps within a common focus of attention-a nucleus in the left hemisphere and a fringe in the right hemisphere. An object is recognized as corresponding to a known label when the total activation of both hemispheres (nucleus plus fringe) is strongest for that label. The functional dualities of the cerebral hemispheres are discussed in light of the nucleus/fringe asymmetry. (shrink)

What process ought to guide decision making for pediatric patients? The prevailing view is that decision making should be informed and guided by the best interest of the child. A widely discussed structural model proposed by Buchanan and Brock focuses on parents as surrogate decision makers and examines best interests as guiding and/or intervention principles. Working from two recent articles by Ross on “constrained parental autonomy” in pediatric decision making (which is grounded in the Buchanan and Brock model), I discuss (...) (supportively) features of Ross’s effort visa-vis the best interest standard. I argue that any pediatric decision-making model that brackets or formally limits an engagement with the child patient assumes too much. Further, any model that under appreciates the place of parents and their autonomy, and the dynamic parent-child relationship, misses an opportunity to broaden the clinical encounter by considering questions of justice for the child (Rawls) and within a family (Ross). In this context, I focus on the child’s emerging and ongoing emotional and intellectual development and autonomy—their capabilities and identifying primary goods. (shrink)

The thesis of the paper is that there are no important differences between problems in business ethics and problems in engineering ethics. The problems are both of the same logical type. What keeps this contention from being obvious is that many view engineers as professionals and business persons as nonprofessionals. If you accept the traditional definition of professional neither engineering nor business qualify. If you adopt the attitudinal definition of a profession which I propose, both practitioners could be professionals. First published in 1987. Towards the end of the twentieth century there was a resurgence of thinking about politics, economics and society referred to variously as the 'New Right', the radical right, neo-conservatism, economic liberalism or libertarianism. Although the New Right is not a single coherent movement it represented a clear alternative to the prevailing social-democratic consensus and had had considerable influence on government policy in both America and Britain. This book presents an introductory survey of the New Right worldwide. (...) It examines the varieties of free-market and 'monetarist' economic thought and introduces the reader to the public-choice critique of public policy. In political philosophy the book analyses American and British conservative thought and compares conservatism with neo-liberalism. The author pays particular attention to the New Right's analysis of constitutionalism and its critique of the dominance of 'politics' over 'economics' during the high-point of the consensus period. The author assesses the success which the different schools of the New Right have had in influencing public opinion and in the formation of government policy. Literary criticism of Shakespeare’s Othello since the early 20th century leaves us with various complaints that Shakespeare fails to achieve poetic justice therein, or that this work leaves us, in the end, with a moral enigma—despite what seems to be Shakespeare’s intent to represent a plot and characters having moral probity and, thereby, to foster our moral edification through the tragedy that unfolds. Here a number of interpretive views concerning the morality proper to Othello are reviewed. Thereafter, it is proposed (...) that Heidegger’s thought about the relation of appearance, semblance, and reality enables a novel interpretation of the moral significance of this tragedy, thereby to resolve the question of moral enigma. Political philosophy concerns itself with thematic, systematic interrogation of political ideas, structures, institutions, and practices. As such it privileges the authority of reason. But, the vision of the literary imagination likewise can and does contribute to human understanding and to imagining our common future. Ursula K. LeGuin is a master teacher of ethical politics in her award-winning novel The Dispossessed. Therein, the protagonist Shevek is presented as an edifying exemplar of “permanent revolution” in a uniquely “thinking mind.” His quest for (...) solidarity of peoples is grounded on a possibility of authentic selfhood within his anarchist society. Considering the concept of authentic selfhood as discussed in philosopher Martin Heidegger’s Being and Time, Shevek’s character may be represented as an imaginary, yet “real,” example or profile of how authentic selfhood may be constituted. This is consistent with LeGuin’s intent in The Dispossessed. (shrink)

This book provides a history of the ethnic persecution of the Rohingyas in Myanmar and their disputed ethnic and national identity. It focuses on how the crisis has morphed into a geopolitical encounter among Bangladesh, China, India, and Myanmar. It further explores the moral, ethnographic, and public policy issues in the humanitarian response to the crisis of the Rohingya people. The volume analyzes the question of citizenship for the Rohingyas by analyzing historical documents and interviews which chronicle the status and (...) identity of the community and their past involvement in the government and politics of Myanmar. The authors focus specifically on the changing geopolitical context of state formation in South Asia and the tense relationships between Myanmar and its neighbours - Bangladesh, China, and India. The book examines the alliances and disputes in the South and Southeast Asia region, which are predicated on economic and strategic gains, and their impact on the Rohingya crisis. It also looks at the failure of bilateral and multilateral negotiations among these countries to adequately address or alleviate the plight of the stateless Rohingyas. Recent research has focused on business as a mediating institution that can influence society while engaging in the traditional profit-making and value generation functions. This work includes Professors Fort's and Schipani's arguments about how business may be able to play a role in promoting more peaceful societies, and other research addressing how businesses might serve a role in reducing violence in society and the workplace. Although there is a significant body of scholarship on the role of business in reducing violence (...) in society, there is little research on concrete steps for businesses to take to achieve this goal. This article attempts to begin to fill that void. As identified by Fort and Schipani, business may promote more peaceful societies by encouraging a sense of community. We argue that one way to reach that goal is for business to provide what we denote as complementary alternative benefits (CABs), to its workforce. In this article, we advocate for businesses to offer CABs which focus on sustaining the health, reducing the stress, and improving the camaraderie of its workforce. We argue that business can use these benefits to promote a healthy, less-stressed, and collegial workforce that is less prone to resolve conflicts by violence. Further, we examine the role business plays in promoting more peaceful societies and how employer-initiated stress reduction programs are consistent with both business ethics and peace-building principles. Finally, using case studies we demonstrate how CABs may also reduce costs related to absenteeism and turnover, and thus improve the bottom line. (shrink)

Contemporary Islam presents Europe in particular with a political and moral challenge: Moderate-progressive Muslims and radical fundamentalist Muslims present differing visions of the relation of politics and religion and, consequently, differing interpretations of freedom of expression. There is evident public concern about Western “political correctness,” when law or policy accommodates censorship of speech allegedly violating religious sensibilities. Referring to the thought of philosopher Baruch Spinoza, and accounting for the Universal Declaration of Human Rights, the Universal Islamic Declaration of Human Rights, (...) and various empirical studies on the religious convictions of Muslims, it is argued here that: (1) sovereign European state powers should be especially cautious of legal censorship of speech allegedly violating Muslim religious sensibilities; and (2) instead of legal moves to censorship, European states should defer to the principle of separation of religion and state (political authority). Further, a reasonable interpretation of Islamic jurisprudence allows that matters of religious difference may be engaged and resolved by appeal to private conscience and ethical judgment, rather than by appeal to public law per se. In so far as they are 1 representative of contemporary scholarship, the interpretative positions of Ziad Elmarsafy, Jacques Derrida, and Nasr Abū Zayd are presented in illustration of this latter point.
