DNA identification is being used in ever-widening ways, including databases of greater scope, familial and lowstringency searches, and DNA dragnets. After examining the law enforcement and privacy interests, the article concludes that forensic DNA uses must be consistent with privacy and civil liberties.

The book is an investigation of the semantics of numericals, counting and measuring, and its connection to the mass/count distinction from a theoretical and crosslinguistic perspective. It reviews some recent major linguistic results in these topics, and presents the author's new research including in-depth case studies of a number of typologically unrelated languages.

In the early 1970s, Congress considered enacting comprehensive privacy legislation, but it was unable to do so. In 1974, it passed the Privacy Act, applicable only to information in the possession of the federal government. In the intervening years, other information privacy laws enacted by Congress, such as the Health Insurance Portability and Accountability Act, have been weak and sector specific. With the explosion of information technology and the growing concerns about an absence of effective federal privacy laws, the legal (...) focus has shifted to the states. Signaling a new direction in state data privacy and consumer protection law, the California Consumer Privacy Act establishes important rights and protections for California residents with regard to the collection, use, disclosure, and sale of their personal information. The CCPA is certain to spur similar legislation and to affect national and international businesses that collect data from California's residents. A long tradition of psychological research has explored the distinction between characteristics that are part of the self and those that lie outside of it. Recently, a surge of research has begun examining a further distinction. Even among characteristics that are internal to the self, people pick out a subset as belonging to the true self. These factors are judged as making people who they really are, deep down. In this paper, we introduce the concept of the true self and (...) identify features that distinguish people’s understanding of the true self from their understanding of the self more generally. In particular, we consider recent findings that the true self is perceived as positive and moral, and that this tendency is actor-observer invariant and cross-culturally stable. We then explore possible explanations for these findings and discuss their implications for a variety of issues in psychology. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Nina Pelikan Straus RETHINKING FEMINIST HUMANISM Important challenges to feminist philosophy have been launched by Martha Nussbaum and Carol Gilligan. Taken together, Nussbaum 's TL· Fragility of Goodness: Luck and Ethics in Greek Tragedy and Phüosophy (1986)1 and Gilligan's In a Different Voice (1982)2 direct us to die consequences of feminism's critique of humanism, supplemented recendy by attempts at a union with Foucaultian genealogy.3 Each of these texts (...) provokes questions about the reliance on deconstructive theories, like those of Michel Foucault, in contemporary feminist discourse. In this essay I will indicate some of the limitations ofthat union and contrast it to the expanding possibilities generated for feminist thought by a revised discourse of modern humanism. The desirability of this revision will appear more clearly once we take up the quarrel ofsome feminists with the humanist tradition and realize that there is no satisfactory single account of what humanism means. Nussbaum's revision of humanism, for example, is based on a reexamination of human cognition, one which includes emotional responsiveness, traditionally associated with women, as a source of ethical knowledge. Gilligan's humanist revision suggests another variety of humanism, grounded in the claim that Freudian psychology's descriptions of the cognitive developments of men and women fail to account for the different approaches to ethical dilemmas expressed by women's voices. Nussbaum's humanism has classical roots in Plato, Aristode, and die Greek tragedies, while Gilligan's humanism is derived from modern psychoanalysis. Such differences in themselves illustrate humanism's long and pluralistic history. Although Nussbaum does not describe herself as a modern feminist and Gilligan does, each of their texts Philosophy and Literature, © 1990, 14: 284-303 Nina Pelikan Straus285 suggests how, respectively, a woman scholar's response to classical Greek tragedy and philosophy and a woman psychologist's approach to psychoanalysis offer reinterpretations of both feminism and humanism. Parallels between Nussbaum's and Gilligan's contributions to philosophy and psychology suggestan innovative study ofvoices, stories, and images which employ woman as a vehicle for a new approach to etiiics.4 Read togedier, they indicate ways that feminists can redescribe the humanist tradition without either succumbing to the essentialist doctrine which Foucault exposes as oppressive in its consequences for women, or by being seduced by Foucault's antihumanism itself. Nussbaum and Gilligan both expose what Annette Baier calls "a striking feature ofmodern moralphilosophizing"—namely, its "avoidance of the concept of love"5—and each suggests how that feature can be transformed. As linked meditations on unsolved problems of our own way of life, Nussbaum's project is to correct the "notoriously crude and hasty" Aristotelian "investigation of the potential of women for excellence " (FG, p. 471), while Gilligan's work is a response to the dire consequences of Freud's influential notion that "women's experience of sexuality and relationships" is a "dark continent."6 One outcome of feminism's use of Foucault's critique of humanism is the possibilityofits settling into a new orthodoxy or politically "correct" position used to measure degrees of feminist commitment. A better outcome is that feminist discourses which have assimilated Foucault's analysis of power may help to combat this threat.7 The threat is taken to be orthodoxy, and Foucault's discourse is characterized as a guarantee against orthodoxy's temptations. A more problematic consequence of die Foucaultian influence, however, is a devaluation of liberal feminist discourses about "human nature" in favor ofthose which follow Foucault by (in Foucault's words) changing the subject and asking instead, "How has the concept of human nature functioned in our society?"8 This change in emphasis depends upon a description of knowledge as inseparable from power—with Foucault's own texts as the most powerful examples of the emphasis. In the United States, final amendments to the Federal Policy for the Protection of Human Subjects (“the Common Rule”) were published on January 19, 2017, and they will take effect on January 21, 2019. One of the most widely discussed provisions is that for the first time, federal regulations governing research with humans authorize the use of broad consent for future, unspecified research on individually identifiable biospecimens and associated data. Many questions have been raised about broad consent, including what effect (...) it will have on research and whether it adequately protects the interests of research participants.There are lessons to be learned for the U.S. and other countries by looking to countries that already have experience with broad consent for biobank collection and with the storage and subsequent use of the biospecimens and data. This article describes how broad consent works in five countries—Canada (in Quebec), Israel, Nigeria, Taiwan, and the United Kingdom—and with different types of biobanks: national biobanks, federated biobanks, and regional biobanks. Evaluating the provisions and challenges of the broad consent approaches in these countries can inform policies for this increasingly used approach to biobank regulation. (shrink)

There is a widespread notion, both within the sciences and among the general public, that mental deterioration can rob individuals of their identity. Yet there have been no systematic investigations of what types of cognitive damage lead people to appear to no longer be themselves. We measured perceived identity change in patients with three kinds of neurodegenerative disease: frontotemporal dementia, Alzheimer’s disease, and amyotrophic lateral sclerosis. Structural equation models revealed that injury to the moral faculty plays the primary role in (...) identity discontinuity. Other cognitive deficits, including amnesia, have no measurable impact on identity persistence. Accordingly, frontotemporal dementia has the greatest effect on perceived identity, and amyotrophic lateral sclerosis has the least. We further demonstrated that perceived identity change fully mediates the impact of neurodegenerative disease on relationship deterioration between patient and caregiver. Our results mark a departure from theories that ground personal identity in memory, distinctiveness, dispositional emotion, or global mental function. (shrink)

Beginning in the 20th century, scientific research came to be dominated by a growing class of credentialed, professional scientists who overwhelmingly displaced the learned amateurs of an earlier time. By the end of the century, however, the exclusive realm of professional scientists conducting research was joined, to a degree, by “citizen scientists.” The term originally encompassed non-professionals assisting professional scientists by contributing observations and measurements to ongoing research enterprises. These collaborations were especially common in the environmental sciences, where citizen scientists (...) participated in counting wildlife and measuring environmental conditions. Feminist science studies have given scant regard to non-human animals. In this paper, we argue that it is important for feminist theory to address the complex relationships between humans and other animals, and the implications of these for feminism. We use the notion of performativity, particularly as it has been developed by Karen Barad, to explore the intersections of feminism and studies of the human/animal relationship. Performativity, we argue, helps to challenge the persistent dichotomy between human/culture and animals/nature. It emphasizes, (...) moreover, how animality is a doing or becoming, not an essence; so, performativity allows us to think about the complexity of human/animal interrelating as a kind of choreography, a co-creation of behaviour. We illustrate the discussion using the example of the laboratory rat, who can be thought of both in terms of a materialization of specific scientific practices and as active participants in the creation of their own meaning, alongside the human participants in science. There are three, intertwined, senses in which we might think about performativity - that of animality, of humannness, and of the relationship between the two. Bringing animals into discussions about performativity poses questions for both feminist theory and for the study of human/animal relationships, we argue: both human and animal can conjointly be engaged in reconfiguring the world, and our theorizing must reflect that complexity. It offers a radically new materialist theory of death, critically moving the philosophical argument beyond Christian and secular-mechanistic understandings. The book's ethico-political figuration of vibrant death is shaped through a pluriversal conversation between Deleuzean philosophy, neo-vitalist materialism and the spiritual materialism of decolonial, queerfeminist poet and scholar Gloria Anzaldua. The book's posthuman deexceptionalizing of human death unfurls together with a collection of poetry, and autobiographical stories. They are analysed through the (...) lens of a posthuman, queerfeminist revision of the method of autophenomenography (phenomenological analysis of autobiographical material). Nina Lykke explores the speaking position of a mourning, queerfeminine "I", who contemplates the relationship with her dead beloved lesbian life partner. She reflects on her enactment of processes of co-becoming with the phenomenal and material traces of the deceased body, and the new assemblages with which it has merged through death's material metamorphoses: becoming-ashes through cremation, and becoming-mixed-with-algae-sand when the ashes were scattered across a seabed made of fiftyfive million-year-old, fossilized algae. It is argued that the mourning "I"'s intimate bodily empathizing (theorized as symphysizing) with her deceased, queermasculine beloved life partner facilitates the processes of vitalist-material and spiritual-material co-becoming, and the rethinking of death from a new and different perspective than that of the sovereign, philosophical subject. Experience has shown that the application of ethical guidelines developed for research in developed countries to research in developing countries can be, and often is, impractical and raises a number of contentious issues. Various attempts have been made to provide guidelines more appropriate to the developing world context; however, to date these efforts have been dominated by the fields of bioscience, medical research and nutrition. There is very little advice available for those seeking to undertake collaborative social science or natural (...) science research in developing countries and what is there tends to be held within disparate sources. Charting the development of a set of ethics documentation for future use by the Ecosystem Services for Poverty Alleviation programme research community, this paper outlines past and present attitudes towards ethics procedures amongst this community and suggests ways in which ethics procedures might be made more relevant and user-friendly to researchers working in this area. In her paper, “The Non-Governing Conception of Laws,” Helen Beebee argues that it is not a conceptual truth that laws of nature govern, and thus that one need not insist on a metaphysical account of laws that makes sense of their governing role. I agree with the first point but not the second. Although it is not a conceptual truth, the fact that laws govern follows straightforwardly from an important (though under-appreciated) principle of scientific theory choice combined with a highly (...) plausible claim about the connection between scientific theory choice and theory choice in metaphysics. I present and defend this argument and then show how the resulting understanding of governance gives rise to an especially strong version of recent explanatory circularity arguments against Humeanism about laws of nature. Finally, I present three options for a further understanding of the governance relation that are compatible with my argument. (shrink)

Theoretical physics is a deductive discipline which presupposes the validity and applicability of certain other disciplines. Among these are logic, algebra, analysis, and geometry. Before relativity, Euclidean geometry was the only one thought to be important for physical space. These disciplines correlate well with experience, and, in the course of time, a priori validity came to be ascribed to them. To Kant, for example, the universe could not possibly be based on any geometry other than Euclid's. The discovery of non-Euclidean (...) geometries by Bolyai and Lobatchevsky, its systematic extension by Riemann, and the critical scrutiny of foundations by Mach and Poincaré shook the “self-evident truth” of Euclidean geometry as applied to the world of physics. The death knell of the a priori truth of any geometry was supplied by Einstein. He showed that a wider body of experience was coordinated by a Riemannian geometry than by Euclidean. He traced the success of Euclidian geometry back to the existence of so-called rigid bodies, in terms of which operations can be associated with numbers which correlate well with numbers associated in a purely mathematical way with mathematical constructs put in correspondence with these bodies. For the physicist, then, the geometry of the real world is now a physical theory whose “truth” like that of all physical theory, is measured by its degree of success in coordinating experience. The strength of the Swedish Social Democracy implies that Sweden is a critical case for theory about social capital. First, what is the relation between the encompassing welfare programs and social capital? Second, what is the effect on civil society of the neo-corporatist relations between the government and major interest organizations? Using both archival and survey data, the result is that the sharp decline in social capital since the 1950s in the United States has no equivalence in Sweden. This has (...) to do with the specific way in which social programs have been institutionalized. Social capital may be caused by how government institutions operate and not by voluntary associations. Rabbis of thirteenth-century Spain were often exposed to two traditions, that of Northern France-Germany and that of Moslem Spain. Until now, the dominant discussion of how they balanced the contrast has been Bernard Septimus' analysis of Nahmanides (Ramban), who managed to draw fruitfully on both. Rabbenu Yonah b. Abraham of Gerona, Ramban's only slightly less famous relative, presents a useful counterexample.Rabbenu Yonah's early works reflect an almost-total immersion in Northern French ways of thinking and writing. Only gradually does he engage (...) ideas from Moslem Spain, suggesting that the mixing of the two traditions in his later writings resulted from years of slow growth and exposure to such Moslem Spanish authors as Rif, R. Bahye ibn Paquda, and Maimonides.His example suggests that how to react to these differing influences was a continuing issue for these rabbis, and that tracking it offers an important key to understanding the intellectual history of the rabbis of that era. This paper gives an analysis of the adverbial quantifiers exemplified in “I regretted it every time I had dinner with him.” Sentences of this kind display what I call a ‘matching effect’; they are true if every event in the denotation oftime I had dinner with him can be matched with an event regretting that dinner event. They are thus truth-conditionally equivalent to sentences of the form “There are at least as many As as Bs.” The difficulties of giving a (...) compositional interpretation to sentences of this form have been discussed in, e.g., Boolos 1981. I first show that the matching effect is semantic and not pragmatic. I then give an analysis of these sentences in a neo-Davidsonian framework, interpreting the adverbials as quantifiers over events. Syntactically they are analyzed as objects of a null preposition. This allows a simple compositional semantic interpretation in which the null preposition is interpreted exactly as other prepositions are by Davidson (1967), namely as denoting a function from the event argument of the matrix verb to the prepositional object. The matching effect then follows automatically. I extend the analysis to account for other sentences which directly instantiate the schema “For every A there is a B” and its equivalents, and show how the matching effect follows in general from the functional nature of thematic roles and prepositions. Cartwright (Synthese 121(1/2):3–27, 1999a; The dappled world, Cambridge University Press, Cambridge, 1999b) attacked the view that causal relations conform to the Markov condition by providing a counterexample in which a common cause does not screen off its effects: the prominent chemical factory. In this paper we suggest a new way to handle counterexamples to Markov causation such as the chemical factory. We argue that Cartwright’s as well as similar scenarios feature a certain kind of non-causal dependence that kicks in once (...) the common cause occurs. We then develop a representation of this specific kind of non-causal dependence that allows for modeling the problematic scenarios in such a way that the Markov condition is not violated anymore. Philosophers and scientists both ask questions about what the world is like. How do these fields interact with one another? How should they? Naturalism Beyond the Limits of Science investigates an approach to these questions called methodological naturalism. According to methodological naturalism, when coming up with theories about what the world is like, philosophers should, whenever possible, make use of the same methodology that is deployed by scientists. Although many contemporary philosophers have implicit commitments that lead straightforwardly to methodological naturalism, (...) few have a clear understanding of how widespread and disruptive methodological naturalism promises to be for the field. By way of a series of case studies involving laws of nature, composition, time and modality, and drawing on historical and contemporary scientific developments including the discovery of the neutrino, the introduction of dark energy, and the advent of relativity theory, this book demonstrates the ways in which scientists rely on extra-empirical reasoning and how that very same extra-empirical reasoning can yield surprising results when applied to philosophical debates. Along the way, Nina Emery's investigation illuminates the complex relationship between philosophy and the sciences, and makes the case that philosophers and scientists alike would benefit from a greater understanding of the connections between the two fields. The 2009 pandemic of influenza A (H1N1) was relatively mild, but a subsequent outbreak of pandemic influenza could be much worse. According to projections from the Department of Health and Human Services, the potential health consequences of a severe (1918-like) influenza pandemic in the United States could be literally overwhelming: up to 1.9 million deaths; 90 million people sick; 45 million people needing outpatient care; 9.9 million people hospitalized, of whom 1.485 million would need treatment in an intensive care unit (...) (ICU); and 742,500 patients needing mechanical ventilators. Even a less cataclysmic, moderate pandemic (like 1958 or 1968) would result in 209,000 deaths; 90 million people sick; 45 million people needing outpatient care; 865,000 people hospitalized, of whom 128,750 would need treatment in an ICU; and 64,875 patients needing mechanical ventilators. ABSTRACT Temporal eliminativism is the view that the present is privileged because past and future entities do not exist. Temporal ersatzism is the view that the present is privileged because, although past and future entities exist, they are not concrete. I argue that shifting from temporal eliminativism to temporal ersatzism can help to address objections to the former theory that are due to relativity theory—but only if temporal ersatzism is understood in a fairly specific way and only in so far (...) as the temporal ersatzist is willing to take on some prima facie surprising commitments. I close by showing how the claims that I make with respect to temporal ersatzism generalise to other theories of time on which the present is privileged, including McDaniel’s [2018] presentist existential pluralism. In recent years, several countries have enacted guidelines and/or mandatory laws to increase the presence of women on the boards of companies. Through these regulatory interventions, the aim is to eradicate the social and labor grievances that women have traditionally experienced and which has relegated them to smaller-scale jobs. Nevertheless, and despite the advances achieved, the female representation in the boardroom remains far from the desired levels. In this context, it is now necessary to enhance the advantages of board gender (...) diversity from both ethical and economic points of view. This article examines the relation between board gender diversity and economic results in Spain: the second country in the world to legally require gender quotas in boardrooms and historically characterized by a minimal female participation in the workforce. Based on a sample of 125 non-financial firms listed on the Madrid Stock Exchange from 2005 to 2009, our findings show that in the period analyzed the increase of the number of women on boards was over 98 %. This suggests that compulsory legislation offers an efficient framework to execute the recommendation of Spanish codes of good governance by means of the increase in the number of women in the boards of firms. Furthermore, we find that the increase in the number of women on the boards is positively related to higher economic results. Therefore, both results suggest that gender diversity in boardrooms should be incremented, mandatory laws being a key factor to do so. (shrink)

Disgust, the emotion of rotting carcasses and slimy animalitos, finds itself at the center of several critical questions about human culture and cognition. This article summarizes recent developments, identify active points of debate, and provide an account of where the field is heading next.

It has been pending in Congress for twelve years, despite the support of the last two presidential Administrations and the National Institutes of Health. It has been the subject of extensive affirmative lobbying by academic medical centers, pharmaceutical and biotech companies, genetic disease advocacy groups, and civil rights organizations. It has overcome vehement objections by employers and insurers. Its final passage, however, has been thwarted by a few Congressional leaders, who have prevented enactment despite overwhelming bipartisan support in both houses (...) of Congress.Based on this legislative history, one could not help but assume that the Genetic Information Nondiscrimination Act is a revolutionary piece of legislation that, if finally enacted, would provide extensive, effective, and comprehensive protection against genetic discrimination in health insurance and employment Unfortunately, such an assessment would be incorrect. This paper makes two central claims. The first is that there is an intimate and non-trivial relation between the mass/count distinction on the one hand and the measure/individuation distinction on the other: a defining property of mass nouns is that they denote sets of entities which can be measured, while count nouns denote sets of entities which can be counted. Crucially, this is a difference in grammatical perspective and not in ontological status. The second claim is that the mass/count distinction (...) between two types of nominals has its direct correlate at the level of classifier phrases: classifier phrases like two bottles of wine are ambiguous between a counting, or individuating, reading and a measure reading. Indigenous people (IP) have faced multiple difficulties in education. Indigenous students often do worse academically than non-indigenous student peers. These stated the low enrollment rates showed a dropout rate, absenteeism, repetition rates, literacy rate, and thus the educational outcomes, with retention and completion being two significant issues. Further, this study explores the lived experiences and challenges faced by indigenous high school students amidst the new normal education. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) The reason (...) why IP learners were not satisfied with their performance is that they cannot understand some of the lessons due to the language barrier. (2) IP learners are committed to finishing their studies, however, some of the students lack resources for studying, like gadgets for researching, and they do not have cell phones. And the other students may have gadgets or cellphones, but their internet connection is low or not accessible in some places at their location. (shrink)

There is widespread concern among public health and emergency response officials that there could be a shortage of health care providers in a public health emergency. At least the following three factors could cause an inadequate supply of physicians, nurses, and other health care providers: the severity of the emergency might greatly increase the demand for health services and outstrip the available supply; health care providers might become unavailable because of their own high rates of illness, as was the case (...) in the SARS epidemic; and many health care providers might not report for duty for personal, family, or professional reasons.One way of addressing the shortage is to encourage health care providers from unaffected areas or parts of the country to volunteer their services. A variety of measures have been enacted to facilitate the use of such volunteers. (shrink)

Privacy is protected in biobank-based research in the US primarily by the Health Insurance Portability and Accountability Act Privacy Rule and the Federal Policy for Protection of Human Subjects. Neither rule, however, was created to function in the unique context of biobank research, and therefore neither applies to all biobank-based research. Not only is it challenging to determine when the HIPAA Privacy Rule or the Common Rule apply, but these laws apply different standards to protect privacy. In addition, many other (...) federal and state laws may be applicable to a particular biobank, researcher, or project. US law also does not directly address international sharing of data or specimens outside of the EU–US Safe Harbor Agreement, which only applies to receipt of data by certain US entities from EU countries, and is in the process of revision. Although new rules would help clarify privacy protections in biobanking, any implemented changes should be studied to determine the sufficiency of the protections as well as its ability to facilitate or hinder international collaborations. In this paper, we present and defend the theoretical framework of an empirical model to describe people’s fundamental moral attitudes (FMAs) to animals, the stratification of FMAs in society and the role of FMAs in judgment on the culling of healthy animals in an animal disease epidemic. We used philosophical animal ethics theories to understand the moral basis of FMA convictions. Moreover, these theories provide us with a moral language for communication between animal ethics, FMAs, and public debates. We defend (...) that FMA is a two-layered concept. The first layer consists of deeply felt convictions about animals. The second layer consists of convictions derived from the first layer to serve as arguments in a debate on animal issues. In a debate, the latter convictions are variable, depending on the animal issue in a specific context, time, and place. This variability facilitates finding common ground in an animal issue between actors with opposing convictions. (shrink)

From the sex-free paradise of the Shakers to the worker's paradise of Marx, utopian ideas seem to have two things in common--they all are wonderfully plausible at the start and they all end up as disasters. In Visions of Utopia, three leading cultural critics--Edward Rothstein, Martin Marty, and Herbert Muschamp--look at the history of utopian thinking, exploring why they fail and why they are still worth pursuing. Edward Rothstein, New York Times cultural critic, contends that every utopia is (...) really a dystopia--a disaster in the making--one that overlooks the nature of humanity and the impossibilities of paradise. He traces the ideal in politics and technology and suggests that only in art--and especially in music--does the desire for utopia find satisfaction. Martin Marty examines several models of utopia--from Thomas More's to a 1960s experimental city that he helped to plan--to show that, even though utopias can never be realized, we should not be too quick to condemn them. They can express dimensions of the human spirit that might otherwise be stifled and can plant ideas that may germinate in more realistic and practical soil. And Herbert Muschamp, the New York Times architectural critic, looks at Utopianism as exemplified in two different ways: the Buddhist tradition and the work of visionary Viennese architect Adolph Loos. Utopian thinking embodies humanity's noblest impulses, yet it can lead to horrors such as Nazi Germany and the Soviet Regime. In Visions of Utopia, these leading thinkers offer an intriguing look at the paradoxes of paradise. (shrink)
