There is an undeniable tendency to dismiss women’s sexual assault allegations out of hand. However, this tendency is not monolithic—allegations that black men have raped white women are often met with deadly seriousness. I argue that contemporary rape culture is characterized by the interplay between rape myths that minimize rape, and myths that catastrophize rape. Together, these two sets of rape myths distort the epistemic resources that people use when assessing rape allegations. These distortions result in the unjust exoneration of (...) people we cannot conceive of as monstrous, while making it too easy to believe that some marginalized people could be rapists. I also argue that rape myths enable a novel kind of epistemic injustice. This injustice concerns how our assessments of trustworthiness and our assessments of plausibility interact. I argue that rape myths can result in runaway credibility deflations that can explain both why people fail to believe most women, and also why people may unjustly believe false allegations that white women have been raped by black men. Deception sometimes results in nonconsensual sex. A recent body of literature diagnoses such violations as invalidating consent: the agreement is not morally transformative, which is why the sexual contact is a rights violation. We pursue a different explanation for the wrongs in question: there is valid consent, but it is not consent to the sex act that happened. Semantic conventions play a key role in distinguishing deceptions that result in nonconsensual sex (like stealth condom removal) from those that don’t (like (...) white lies). Our framework is also applicable to more controversial cases, like those implicated in so-called “gender fraud” complaints. (shrink)

Standpoint theorists have long been clear that marginalization does not make better understanding a given. They have been less clear, though, that social dominance does not make ignorance a given. Indeed, many standpoint theorists have implicitly committed themselves to what I call the strong epistemic disadvantage thesis. According to this thesis, there are strong, substantive limits on what the socially dominant can know about oppression that they do not personally experience. I argue that this thesis is not just implausible but (...) politically pernicious; it is an excuse for ignorance and silence that stifles our ability to address many injustices. Moreover, I argue that if we are to avoid lending support to the SEDT while working within a standpoint theory framework, we must hold that the socially dominant can achieve marginalized standpoints. So, we must hold that men can achieve feminist standpoints, that white women (and men) can achieve black feminist standpoints, and so on. (shrink)

Despite a growing body of literature focused on understanding experiences of workplace dignity, attention has centered almost exclusively on employees with lower-level jobs. As a result, little is known about how workplace dignity and indignity are experienced by employees with middle- and upper-level jobs and how their experiences differ from those with lower-level jobs. We address these absences by interviewing employees from a diversity of lower-, middle-, and upper-level jobs about their experiences of indignity at work. We outline common dignity (...) threats, along with typical emotional responses and recourses employees use at each level. We find lower-level employees experience chronic dignity threats from being disrespected, devalued, demeaned, and dehumanized, to which their most typical response is endurance. Middle-level employees experience periodic dignity threats due to undermining of their work, confidence, and reputation. For them, the typical response is strategizing. Finally, on the rare occasions upper-level employees experience dignity threats, it usually is due to a disregard of their special expertise or denial of special rights, to which they respond by rising above. Standpoint epistemology has been linked with increasing calls for deference to the socially marginalized. As we understand it, deference involves recognizing someone else as better positioned than we are, either to investigate or to answer some question, and then accepting their judgment as our own. We connect contemporary calls for deference to old objections that standpoint epistemology wrongly reifies differences between groups. We also argue that while deferential epistemic norms present themselves as a solution to longstanding injustices, habitual deference prevents (...) the socially dominant from developing for themselves the skills necessary to expand their capacity for empathy, to deftly probe for evidence, and to ask critical questions. Consequently, we argue that standpoint epistemology must be understood as calling for inclusion, not deference. (shrink)

As corporate raids become more prevalent, top corporate executives have asked for and often received additional executive power to ward off raiders or sharks. For example, they have been given the use of shark repellents such as staggered elections for board members, cumulative voting, super majority voting requirements, and the power to sell off the firm's crown jewels. Are they abusing these powers as they attempt to save their jobs, at the expense of stockholders, by driving off the corporate raiders (...) who might unseat ineffective management? In this article the practices being used by entrenched managers to make their firms less attractive to raiders and the defense tactics they are using in corporate takeover battles are examined from an ethical viewpoint. Those who commit sexual assault are rarely brought to justice: for every 1000 rapes, only seven will result in a felony conviction. There are numerous factors that contribute to the fact that sexual assault goes largely unpunished, and legal reform alone is not a sufficient solution—but it is an important part of the solution. In this paper, I develop an account of the epistemic injustice that rape victims face in criminal trials, and I argue that this, at least in part, (...) helps to explain not only why conviction rates are so low, but why previous feminist legal reform has not helped to improve conviction rates. I then argue that more radical legal reform is necessary, and that we ought to consider lowering the standard of evidence in sexual assault cases. (shrink)

An intuitive conception of objectivity involves an ideal of neutrality—if we’re to engage in objective inquiry, we must try to sideline our prejudices, values, and politics, lest these factors taint inquiry and unduly influence our results. This intuition underlies various “purist” epistemological frameworks, which grant epistemic significance only to “epistemic factors” like evidence or the truth of a belief. Feminist epistemologists typically condemn purist frameworks as inimical to feminist aims. They argue that purist epistemology is divorced from the ineliminably social (...) and value-laden nature of our epistemic practices, and, moreover, that it abstracts away precisely those features that are needed to explain how power shapes knowledge. As they see it, purist frameworks simply lack the conceptual space needed to ask the right kinds of questions. Thus, they go in for “impurist” frameworks, which grant epistemic significance to “non-epistemic” factors, and so shed the confining constraints of purism. I turn the tables on the impurists—where they have connected purist norms with perniciously disengaged epistemology, I connect impurist norms with a creeping anxiety that is diminishing feminist epistemology’s political possibilities. First, I demonstrate that it’s increasingly common for impurist epistemologists to use moral considerations as a means to bypass the evidence, which betrays a lack of faith that the evidence will bear out feminist commitments. Second, I demonstrate that there is needless pessimism about our capacity to understand, as evidenced by the increasingly widespread idea that privileged social positions place robust limits on what people can know about oppression that they don’t personally experience. In both cases, moral and political considerations are invoked to give the illusion of being socially engaged, while in fact they allow people to give up on the difficult project of figuring things out. An extended case study on rape culture illustrates the stakes of doing inquiry that is only superficially socially engaged; I show that the two anxious traps I’ve identified have prevented contemporary feminist theorists from detecting and rooting out racist distortion in their accounts of rape culture because both traps interfere with a genuinely intersectional approach to feminist theorizing. We argue that the appraisal of models in social epistemology requires conceiving of them as argumentative devices, taking into account the argumentative context and adopting a family-of-models perspective. We draw up such an account and show how it makes it easier to see the value and limits of the use of models in social epistemology. To illustrate our points, we document and explicate the argumentative role of epistemic landscape models in social epistemology and highlight their limitations. We also claim that (...) our account could be fruitfully used in appraising other models in philosophy and science. (shrink)

Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. According to familiar accounts, Rousseau held that humans are actuated by two distinct kinds of self love: amour de soi, a benign concern for one's self-preservation and well-being; and amour-propre, a malign concern to stand above other people, delighting in their despite. I argue that although amour-propre can (and often does) assume this malign form, this is not intrinsic to its character. The first and best rank among men that amour-propre directs us to claim for ourselves is that of occupying (...) 'man's estate'. This does not require, indeed it precludes, subjection of others. Amour-propre does not need suppression or circumscription if we are to live good lives; it rather requires direction to its proper end, not a delusive one. (shrink)

Dehaene and Naccache, Dennett and Jack and Shallice “see convergence coming from many different quarters on a version of the neuronal global workspace model†(Dennett, p. 1). (Boldface references are to papers in this volume.) On the contrary, even within this volume, there are commitments to very different perspectives on consciousness. And these differing perspectives are based on tacit differences in philosophical starting places that should be made explicit.  Indeed, it is not clear that different uses of “consciousness†and (...) “awareness†in this volume can be taken to refer to the same phenomenon. More specifically, I think there are three different concepts of consciousness in play in this issue. The global workspace model makes much more sense on one of these than on the others. Much attention has been directed to the philosophical implications of quantum field theory (QFT) in recent years; this paper attempts a survey in low-technical terms. First the relations of QFT to other kinds of theory, classical and quantum, particle and field, are discussed. Then various formulations of QFT are introduced, along with related interpretations. Finally a review is made of some of the most interesting foundational problems.

This paper responds to discussion and criticism contained in a mini-symposium on Just health: meeting health needs fairly. The replies clarify existing positions and modify or develop others, specifically in response to the following: Thomas Schramme criticises the claim that health is of special importance because of its impact on opportunity, and James Wilson argues that healthcare is not of special importance if social determinants of health have a major causal impact on population health. Annette Rid is concerned that the (...) relevance condition in accountability for reasonableness is unclear and does little work. Harald Schmidt aims to flesh out where an account of responsibility for health should go since one is under-developed in Just health.
