This study explored pedestrians’ understanding of Fully Autonomous Vehicles intention to stop and what influences pedestrians’ decision to cross the road over time, i.e., learnability. Twenty participants saw fixed simulated urban road crossing scenes with a single FAV on the road as if they were pedestrians intending to cross. Scenes differed from one another in the FAV’s, distance from the crossing place, its physical size, and external Human-Machine Interfaces message by background color, message type, and presentation modality. Eye-tracking data and (...) decision measurements were collected. Results revealed that pedestrians tend to look at the e-HMI before making their decision. However, they did not necessarily decide according to the e-HMIs’ color or message type. Moreover, when they complied with the e-HMI proposition, they tended to hesitate before making the decision. Overall, a learning effect over time was observed in all conditions regardless of e- HMI features and crossing context. Findings suggest that pedestrians’ decision making depends on a combination of the e-HMI implementation and the car distance. Moreover, since the learning curve exists in all conditions and has the same proportion, it is critical to design an interaction that would encourage higher probability of compatible decisions from the first phase. However, to extend all these findings, it is necessary to further examine dynamic situations. (shrink)

In this chapter we take stock of some of the complexities of the sprawling field of AI ethics. We consider questions like "what is the proper scope of AI ethics?" And "who counts as an AI ethicist?" At the same time, we flag several potential uses and abuses of AI ethics. These include challenges for the AI ethicist, including what qualifications they should have; the proper place and extent of futuring and speculation in the field; and the dilemmas concerning how (...) we use our public and academic resources. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. Wonderful Knowledge. Aquinas on the Immutability and Eternity of God’s Knowledge The general concept of knowledge is a kind of concept closely akin to transcententals: its use is not restricted to a certain kind of being, and it does not itself designate a kind of entity. Such concepts may be applied to God not as metaphors: when we grasp (through the analysis of cases of finite knowledge) some general traits of knowledge as such, we can show that God has knowledge, (...) and his knowledge, as opposed to ours, is infinitely perfect. We have no insight into this realization of knowledge as opposed to ours, but as far as we know what general traits of knowledge are, it is important to know that God has infinitely perfect knowledge. To grasp the general traits of knowledge, I focus on the topic of mutability and immutability of knowledge analyzed systematically by Aquinas, and thus on the topic of identity criteria specific for knowledge in general: the question of when knowledge that p and knowledge that q are (in a certain knower) one and the same knowledge; the criteria of identity of knowledge vary according to natures of knowers. I think that the problem of the criteria of identity of knowledge is rather neglected in omniscience-immutability discussions. I analyze Aquinas’ arguments for the thesis that human knowledge is mutable, and God’s knowledge is absolutely immutable (they concern the role of tense). The analysis sheds light on some general traits of knowledge: it is always something formulated by the knower which manifests some truth to him, and in general the way it is formulated corresponds to (i) the way it manifests some truth, (ii) its identity criteria, (iii) the way it is propositional, (iv) the way it is related to tense, and finally (v) the nature of the knower. Focusing on the criteria of the identity of knowledge shows that God’s knowledge is absolutely immutable, and that time and change in its objects are nevertheless undoubtedly real. In this paper we study the status of the arithmetical completeness of dynamic logic. We prove that for finitistic proof systems for dynamic logic results beyond arithmetical completeness are very unlikely. The role of the set of natural numbers is carefully analyzed.

The present narrative review seeks to unravel where we are now, and where we need to go to delineate the active ingredients in psychotherapy delivered by conversational agents (e.g., chatbots). While psychotherapy delivered by conversational agents has shown promising effectiveness for depression, anxiety, and psychological distress across several randomized controlled trials, little emphasis has been placed on the therapeutic processes in these interventions. The theoretical framework of this narrative review is grounded in prominent perspectives on the active ingredients in psychotherapy. (...) Based on search terms derived from various theoretical perspectives, we conducted a systematic literature search of four scientific databases and identified 17 studies. Across the selected studies, three themes emerged: relationship variables, emotional venting, and cognitive factors. While methodological issues compromise the epistemic value of this evidence base, core questions also remain to be answered. Such questions include, but are not limited to, whether humans can form affectionate bonds to inanimate beings and whether these kind of mental health treatments should be understood as psychotherapy or something else. Researchers should therefore be cautious when applying theories of psychotherapy in the realm of conversational agents. We conclude the paper by introducing recommendations for future research, which we hope will help instigate methodologically sound studies in this field. (shrink)

This study aimed to evaluate if eye blinks can be used to discriminate players with different performance in a session of Nintendo Entertainment System (NES) Tetris. To that end, we developed a state-of-the-art method for blink extraction from EAR measures, which is robust enough to be used with data collected by a low-grade webcam such as the ones widely available on laptop computers. Our results show a significant decrease in blink rate per minute (blinks/m) during the first minute of playing (...) Tetris. After having defined 3 groups of proficiency based on in-game performance (Novices, Intermediates, and Experts) we found out that expert players display a significantly lower decrease in blinks/m compared to novices during the first minute of gameplay, which shows that Tetris players' proficiency can be detected by looking at eye blinks/m variations during the early phase of a game session. This difference in blinks/m is observed throughout the entire game session, which supports the general conclusion that proficient Tetris players have a lower decrease in blinks/m, even when playing more difficult levels. Finally, we offer some interpretations of this effect and the relationship that our results may have with the visual cognitive workload experienced during the gameplay. (shrink)

Informed consent, when given by proxy, has limitations: chiefly, it must be made in the interest of the patient. Here we critique the standard approach to parental consent, as present in Canada and the UK. Parents are often asked for consent, but are not given the authority to refuse medically beneficial treatment in many situations. This prompts the question of whether it is possible for someone to consent if they cannot refuse. We present two alternative and philosophically more consistent frameworks (...) for paediatric proxy consent. The first allows meaningful consent (parents may say ‘yes’ or ‘no’ to treatment), provided that parents are medically informed/competent and intend the health and well-being of their child. In the second solution, medical practitioners or the state consent for treatment, with parents only being consulted to help give insight to the child’s circumstances. While we contend that either of these two options is superior to the insincerity of the present paradigm, we suggest that the first solution is preferable. (shrink)

This article explores political discourse in the context of an online-mediated 2021 rapprochement between Swedish ‘mainstream’ and far-right parties paving the way for their eventual 2022 electoral success and later joint government coalition. The article analyses specifically how the above political accord on the Swedish right – often seen as breaking the long-term cordon sanitaire around Sweden’s far right – would be legitimised via discourses that carried significant elaboration and deepening of the ‘criminality’ and ‘immigration’ connection later recontextualised into the (...) broader Swedish public discourse and public imagination. Using social media analytics and qualitative, critical discourse analysis, we explore in depth a ‘discursive shift’ wherein the focus on criminality would become a key ‘proxy discourse’, i.e., a public-wide implicature, which, while referring to and debating a potentially genuine social issue would be strategically instrumentalised to effectively pre-legitimise ‘moral panics’ around immigration and cultural diversity. The analysis highlights that the emergence as well as the later recontextualisation of the ‘proxy discourse’ in question – implicitly suggesting that criminality, immigration, and cultural diversity are ‘somehow’ inherently connected – not only supported the political mainstreaming of the Swedish far-right’s anti-immigration stance but also normalised the wider tenets of illiberal, nativist ‘politics of exclusion’. The purpose of this paper is to analyse a particularly influential case of memory continuity in Portugal, that of _Padrão dos Descobrimentos_. Spaces of collective memory (such as public monuments) raise questions about what we celebrate, remember or rescue from oblivion, providing an opportunity to rethink the trauma. As such, care for public spaces is associated with ethical and cultural values. One of the difficulties with certain monuments has to do with the fact that they recall actions that today we (...) see as traumatic acts. Thus, it is important to reflect on a critical use of memory. On August 8, 2021, _Padrão dos Descobrimentos_ was the subject of a graffiti. One of the sides of the monument could read: “Blindly sailing for money, humanity is drowning in a scarlet sea”. A great controversy immediately arose around the meaning of this gesture, as well as the role played by a monument that, after being temporarily built in 1940 for the Portuguese World Exhibition, was, in its current version, inaugurated in 1960, on the occasion of the fifth centenary of the death of Infante D. Henrique. This episode reignited a deeper cleavage around the uses of history and memory, the Portuguese colonial past, and the role of the _Padrão dos Descobrimentos_ as an instrument for the reproduction of nationalism. In this sense, and with the authors proposing a new theoretical frame of reference based on the thought of Arendt and Ricoeur, its critical reading becomes relevant. (shrink)

Especially in periods of crises, economists try to explain why some economies suffer negative consequences more strongly than others. In order to explain these differential effects, two economic categories known as economic vulnerability and economic resilience can be used. Hence, the aim of the paper is to undertake a critical reflection on the interrelated categories of economic vulnerability and resilience to shocks. The paper analyses these categories from a theoretical perspective and identifies the factors that shape each of them. It (...) then attempts to measure the economic vulnerability and resilience of selected European countries using two synthetic variables. Based on these, a classification of countries in terms of economic vulnerability and resilience was made. The results achieved provide a good starting point for a more detailed study of the paths of crises and their consequences in individual countries. (shrink)

A framework is presented to better characterize the role of individual differences in information processing style and their interplay with contextual factors in determining decision making quality. In Experiment 1, we show that individual differences in information processing style are flexible and can be modified by situational factors. Specifically, a situational manipulation that induced an analytical mode of thought improved decision quality. In Experiment 2, we show that this improvement in decision quality is highly contingent on the compatibility between the (...) dominant thinking mode and the nature of the task. That is, encouraging an intuitive mode of thought led to better performance on an intuitive task but hampered performance on an analytical task. The reverse pattern was obtained when an analytical mode of thought was encouraged. We discuss the implications of these results for the assessment of decision making competence, and suggest practical directions to help individuals better adjust their information processing style to the situation at hand and make optimal decisions. Hope, gratitude, fear, and disgust may all be key to encouraging preventative action in the context of COVID-19. We pre-registered a longitudinal experiment, which involved monthly data collections from September 2020 to September 2021 and a six-month follow-up. We predicted that a hope recall task would reduce negative emotions and elicit higher intentions to engage in COVID-19 preventative behaviours. At the first time point, participants were randomly allocated to a recall task condition (gratitude, hope, or control). At each time point, (...) we measured willingness to engage in COVID-19 preventative behaviours, as well as experienced hope, gratitude, fear, and disgust. We then conducted a separate, follow-up study in February 2022, to see if the effects replicated when COVID-19 restrictions were relaxed in the UK. In the main study, contrary to our pre-registered hypothesis, we found that a gratitude recall task elicited more willingness to engage in COVID-19 preventative behaviours in comparison to the neutral recall task. We also found that experienced gratitude, hope, and fear were positively related to preventative action, while disgust was negatively related. These results present advancement of knowledge of the role of specific emotions in the COVID-19 pandemic. (shrink)

This book elaborates a new framework for considering and understanding the relationship between law and memory. How can law influence collective memory? What are the mechanisms law employs to influence social perceptions of the past? And how successful is law in its attempts to rewrite narratives about the past? As the field of memory studies has grown, this book takes a step back from established transitional justice narratives, returning to the core sociological, philosophical and legal theoretical issues that underpin this (...) field. The book then goes on to propose a new approach to the relationship between law and collective memory based on a conception of 'legal institutions of memory'. It then elaborates the functioning of such institutions through a range of examples - taken from Japan, Iraq, Brazil, Portugal, Rwanda and Poland - that move from the work of international tribunals and truth commissions to more explicit memory legislation. The book concludes with a general assessment of the contemporary intersections of law and memory, and their legal institutionalisation. This book will be of interest to scholars with relevant interests in the sociology of law, legal theory and international law, as well as in sociology and politics. (shrink)

The article offers an analysis of Józef Bocheński's studies of the concept of nation. Bocheński acknowledges that there are difficulties in defining a nation. After that he claims that he will attempt to propose a definition of the Polish nation. Nation is a social group centered around some cultural ideal. The analysis shows that Bocheński did not avoid serious logical problems. First of all, he constantly falls into a circular reasoning. Furthermore, it is called into question if it makes sense (...) to refer to a cultural ideal or ideology while defining a nation. Is not such an attempt essentially bound to become circular? A doubt is also raised whether nowadays, in the face of constant migration of people and cultural ideals, one can continue to reasonably talk about nations. (shrink)

This article utilises feminist technoscience studies’ notions of bodily ‘materialisation’ and ‘ontological choreographies’, offering a cyborg feminist account of ‘bioavailability’ as embodied becomings, rather than a fixed ontological state of being. Drawn from 2 years’ ethnographic study in in vitro fertilisation clinics in Spain with migrant women who provided eggs to the cross-border in vitro fertilisation industry, this work explores how global understandings of race and inequalities, clinical practices and women’s own emotional and physical labours collectively produce bioavailability. Through examples (...) from observations and interviews in in vitro fertilisation clinics, we examined women’s embodied stories to understand the ways in which bioavailability becomes. The article demonstrates a novel way in which to think about ‘bioavailability’, a concept which has already been of enormous use to the social sciences since its introduction by Lawrence Cohen. We examine recent configurations of bodily extraction in the reproduction–migration nexus that help us rethink the concept of bioavailability. (shrink)

Prestige of academic teacher’s activities and his or her authority, should most of all result from moral attitude. Thus there is need in this kind of activity to use ethic virtues. Thanks to them human improves internally, but also can realize the concrete property outside. Virtues are necessary for person both for him or her as an average human being and also as a scholar and an educator. By setting own example one can have the most influence on students’ moral (...) attitudes. Consequently an occasion arises to improve cardinal classic virtues, which include: prudence, deliberation, justice and courage, but also in the virtues that are related to them. These activities drive to form yourself in giving good example and have a huge impact on academic environment’s advancement. (shrink)

This paper contributes to the existing philosophical literature on the Knobe Effect (KE) in two main ways: first, this paper disconfirms the KE by showing that the latter does not hold in contexts with probable outcomes; second, this paper shows that KE is strongly sensitive to the availability heuristic bias. In particular, this paper presents two main findings from three empirical tests carried out between 2016 and 2018: the first finding concerns the fact that if the issuer of a decision (...) with consequences on third parties is unlikely to be perceived as unfriendly, then KE is reduced or absent; the second finding regards instead the fact that if an action has two possible outcomes (one likely to obtain with strong intensity and one likely to obtain with less intensity), then KE does not obtain for decisions whose side-effects have limited consequences on third parties. This paper has three main goals. Firstly – to draw attention to the phenomenon of the democratic paradigm in the study of modern state systems (especially monarchical ones), characterise it and outline its sources. Also - to question the basis of this phenomenon (by pointing out, among other things, the durability of monarchical systems and the phenomenon of partial ‘re-monarchization’ – real or apparent – of certain contemporary republican systems on the examples of: Montenegro, Romania, the Czech Republic, Hungary and (...) Poland). Secondly, to present the negative consequences of the functioning of the democratic paradigm, also (paradoxically) those affecting the political practice of republics. Thirdly, to propose a way to reduce these negative consequences by changing the optics adopted in comparative studies about monarchies and republics. This change is based on the restoration, in comparative analyses of contemporary state systems (including monarchical ones), of the concepts of ‘mixed system’ and ‘monarchical principle’, which are still used in research on the history of the state and law, and should be disseminated in research on contemporary political systems and constitutional law. An explanation of the terms ‘mixed system’ and ‘monarchical principle’ as I use them here will follow in the final part of the paper. (shrink)

Community standards, ethical norms, and perceptions of fairness often serve as constraints on pure profit maximizing behavior. Consider the following examples: Most hardware stores refrain from raising prices on snow shovels after a major snow storm, even where short term profits might be increased. Most employers do not lower wages for existing employees, even as unemployment in the area increases. Automobile dealerships rarely raise sticker prices to cope with the long waiting periods for a popular model. Each of these anomalies (...) is consistent with the proposition that firms increase profits subject to fairness constraints.This paper examines perceptions of fairness in the residential real estate industry and explores how community standards affect economic decision-making. The residential real estate industry is unique. One party to the transaction (the landlord) frames decisions as pure business decisions. The other party to the transaction (the tenant) frames decisions more broadly. While a tenant's choice of apartments is in part viewed as a business decision, tenants consider a broad spectrum of non-business issues, as well. (shrink)

Individual eschatological images are rarely a research subject that applies in-depth interviews and qualitative methods of analysis. Due to the use of simple questionnaire measures, knowledge about possible variations in personal images of heaven or hell is very poor. Furthermore, data concerning any connection between personality and eschatological images is scarce. The research project presented in the article was an attempt to apply a narrative method and to combine qualitative and simple quantitative methods to describe the wide variety of individual (...) views of heaven, hell, and purgatory. The relationship between individual eschatological images, denominational culture, and the chosen dimension of personality—i.e., hope understood in Erik Erikson's terms as a relatively stable conviction that the world is meaningful, ordered and friendly towards people—was also explored. The purpose of this paper is to provide an analytical framework – derived from the Herbert L.A. Hart’s philosophy of law – for the study of the phenomenon of habit and custom from the perspective of normativity. Its starting point is the Hart’s concept of “internal aspect of rules” as a necessary criterion for the rule’s normative character. The internal aspect exists in two forms: the “recognition” based on specific rules, and “acceptance”. The concept of acceptance reveals a difference between (...) habit and custom, by capturing the normative character of the latter. The formation of the customs – by way of unprecedented punishment of a rule’s violation – reveals the ambiguity of the term “sanction” as referring to not only the external aspect, but also to internal aspect of rules. In this paper we argue that one-way quantum computation can be seen as a form of phase transition with the available information about the solution of the computation being the order parameter. We draw a number of striking analogies between standard thermodynamical quantities such as energy, temperature, work, and corresponding computational quantities such as the amount of entanglement, time, potential capacity for computation, respectively. Aside from being intuitively pleasing, this picture allows us to make novel conjectures, such as an estimate (...) of the necessary critical time to finish a computation and a proposal of suitable architectures for universal one-way computation in 1D. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. The three target articles constitute a powerful and persuasive call for actively anti-racist bioethics and biomedicine. All three articles reject race as a biological category. Nevertheless, they share a common commitment to racial classification. At one point, Ruqaiijah Yearby writes that “social race, like biological race, is an illusion created to establish racial hierarchy,” but mostly she writes about “races” as though they were not an illusion, but a reality. In this commentary I critique the racial realism of the target (...) articles. I argue that the biomedical fight against racism is best served by a form of anti-realist reconstructionism about race, which says that there are no races, only racialized groups—groups misunderstood to be races. Note that I do not defend the color blindness that Clarence H. Braddock (2020) persuasively rejects. Because of the role of skin color in racialization and racism, color blindness is a misguided goal. One can reject color blindness, though, without accepting racial realism... (shrink)

As belief in the reality of race as a biological category among U.S. anthropologists has fallen, belief in the reality of race as a social category has risen in its place. The view that race simply does not exist—that it is a myth—is treated with suspicion. While racial classification is linked to many of the worst evils of recent history, it is now widely believed to be necessary to fight back against racism. In this article, I argue that race is (...) indeed a biological fiction, but I critique the claim that race is socially real. I defend a form of anti‐realist reconstructionism about race, which says that there are no races, only racialized groups—groups mistakenly believed to be races. I argue that this is the most attractive position about race from a metaphysical perspective, and that it is also the position most conductive to public understanding and social justice. (shrink)

Race theorists have been unable to reach a consensus regarding the basic historical question, “is ‘race’ modern?” I argue that this is partly because the question itself is ambiguous. There is not really one question that race scholars are answering, but at least six. First, is the concept of race modern? Second, is there a modern concept of race that is distinct from earlier race concepts? Third, are “races” themselves modern? Fourth, are racialized groups modern? Fifth, are the means and (...) methods associated with racialization modern? And sixth, are the meanings attached to racialized traits modern? Because these questions have different answers, the debate about the historical origins of “race” cannot be resolved unless they are distinguished. I will explain the ways in which “race” is and is not modern by answering these questions, thereby offering a resolution to a seemingly intractable problem. (shrink)

Support for the biological concept of race declined slowly but steadily during the second half of the twentieth century. However, debate about the validity of the race concept has recently been reignited. Genetic-clustering studies have shown that despite the small proportion of genetic variation separating continental populations, it is possible to assign some individuals to their continents of origin, based on genetic data alone. Race naturalists have interpreted these studies as empirically confirming the existence of human subspecies, and by extension (...) biological races. However, the new racial naturalism is not convincing. The continental clusters appealed to by race naturalists are arbitrary and superficial groupings, which should not be elevated to subspecies status. Moreover, the criteria applied to humans are not consistent with those used to define subspecies in nonhuman animals, and no rationale has been given for this differential treatment. (shrink)

The UNESCO Statements on Race of the early 1950s are understood to have marked a consensus amongst natural scientists and social scientists that ‘race’ is a social construct. Human biological diversity was shown to be predominantly clinal, or gradual, not discreet, and clustered, as racial naturalism implied. From the seventies social constructionists added that the vast majority of human genetic diversity resides within any given racialised group. While social constructionism about race became the majority consensus view on the topic, social (...) constructionism has always had its critics. Sesardic (2010) has compiled these criticisms into one of the strongest defences of racial naturalism in recent times. In this paper I argue that Sesardic equivocates between two versions of racial naturalism: a weak version and a strong version. As I shall argue, the strong version is not supported by the relevant science. The weak version, on the other hand, does not contrast properly with what social constructionists think about ‘race’. By leaning on this weak view Sesardic’s racial naturalism intermittently gains an appearance of plausibility, but this view is too weak to revive racial naturalism. As Sesardic demonstrates, there are new arguments for racial naturalism post-Human Genome Diversity Project. The positive message behind my critique is how to be a social constructionist about race in the post-genomic era. (shrink)
