The process of seeking the consent of a patient to a medical procedure is, arguably, one of the most important skills a doctor, or indeed any clinician, should learn. In fact, the very idea that doctors may institute diagnostic or treatment processes of any sort without a patient's consent is utterly counter-intuitive to the modern practice of medicine. It was not always thus, and even now it can be reliably assumed that consent is still not sought and gained appropriately in (...) every clinical encounter. To say that it should be sought and gained in this manner elevates the value of consent to a high level. It can be instructive to ask oneself why such a value might be held to be the case. The answer to this question lies in the philosophical underpinning of clinical consent, which sits within a notion of personal autonomy, and respect for autonomous decision making. (shrink)

World Athletics have introduced regulations preventing female athletes with certain differences in sex development from competing in the female category. We argue these regulations are not justified and should be removed. Firstly, we examine the reasoning and evidence underlying the position that these athletes have a substantial mean difference in performance from other female athletes such that it constitutes an advantage, and argue it is not sufficient. Secondly, if an advantage does exist, it needs to be demonstrated it is unfair. (...) We argue the advantage would not be unfair because to say otherwise relies on a presupposition about whether these athletes are female, which involves contradictory and inconsistent definitions of sex. Thirdly, we contend that even if it is established that there is an advantage and it is unfair, the response of requiring athletes to take testosterone-suppressing medication is not appropriate and is unfair. Motivational enhancement in sport – a form of ‘neuro-doping’ – can help athletes attain greater achievements in sport. A key question is whether or not that athlete deserves that achievement. We distinguish three concepts – praiseworthiness, prizeworthiness, and admiration – which are closely related. However, in sport, they can come apart. The most praiseworthy athlete may not be the most prizeworthy, and so on. Using a model of praiseworthiness as costly commitment to a valuable end, and situating prizeworthiness within the (...) boundaries of the sport, we argue that motivational enhancement in some cases can be compatible with desert. Dialectic of Enlightenment is undoubtedly the most influential publication of the Frankfurt School of Critical Theory. Written during the Second World War and circulated privately, it appeared in a printed edition in Amsterdam in 1947. "What we had set out to do," the authors write in the Preface, "was nothing less than to explain why humanity, instead of entering a truly human state, is sinking into a new kind of barbarism." Yet the work goes far beyond a mere critique of (...) contemporary events. Historically remote developments, indeed, the birth of Western history and of subjectivity itself out of the struggle against natural forces, as represented in myths, are connected in a wide arch to the most threatening experiences of the present. The book consists in five chapters, at first glance unconnected, together with a number of shorter notes. The various analyses concern such phenomena as the detachment of science from practical life, formalized morality, the manipulative nature of entertainment culture, and a paranoid behavioral structure, expressed in aggressive anti-Semitism, that marks the limits of enlightenment. The authors perceive a common element in these phenomena, the tendency toward self-destruction of the guiding criteria inherent in enlightenment thought from the beginning. Using historical analyses to elucidate the present, they show, against the background of a prehistory of subjectivity, why the National Socialist terror was not an aberration of modern history but was rooted deeply in the fundamental characteristics of Western civilization. Adorno and Horkheimer see the self-destruction of Western reason as grounded in a historical and fateful dialectic between the domination of external nature and society. They trace enlightenment, which split these spheres apart, back to its mythical roots. Enlightenment and myth, therefore, are not irreconcilable opposites, but dialectically mediated qualities of both real and intellectual life. "Myth is already enlightenment, and enlightenment reverts to mythology." This paradox is the fundamental thesis of the book. This new translation, based on the text in the complete edition of the works of Max Horkheimer, contains textual variants, commentary upon them, and an editorial discussion of the position of this work in the development of Critical Theory. Ein berühmter, immer wieder zitierter Satz von Max lautet: "Interessen (materielle und ideelle), nicht: Ideen, beherrschen unmittelbar das Handeln der Menschen. Aber: die 'Weltbilder', welche durch 'Ideen' geschaffen wurden, haben sehr oft als Weichensteller die Bahnen bestimmt, in denen die Dynamik der Interessen das Handeln fortbewegte." Die neuere Soziologie ist diesem Grundsatz allerdings nicht gerecht geworden. Werte und ihre Wirkung werden entweder als gegeben vorausgesetzt (so bei Talcott Parsons) oder überhaupt als irrelevant betrachtet (so in der Rational Choice- und Systemtheorie). (...) Die umfangreiche, empirische Werteforschung hat vielfältige Ergebnisse erbracht, blieb jedoch weitgehend ohne theoretisches Fundament, sodass ihre Befunde vielfach anfechtbar sind. Weber selbst gab im Hinblick auf die Frage nach der Relevanz der Werte nur unbefriedigende Antworten: Die Entscheidung für bestimmte Werte sei eine rein individuelle Angelegenheit und zwischen den verschiedenen Werten gebe es einen unversöhnlichen Kampf. Im vorliegenden Buch wird diese Problematik erstmals in der deutschen Soziologie umfassend untersucht und es wird dafür (u.a. im Anschluss an Autoren wie Immanuel Kant, George H. Mead und Raymond Boudon), eine neue, konstruktive und erklärungsstarke Lösung gefunden. Unter Zuhilfenahme von Überlegungen aus Philosophie, Sozialtheorie und empirischer Sozialforschung sowie unter Einbeziehung historischer Kämpfe zur Anerkennung und Durchsetzung der Werte kann man feststellen, dass es gesellschaftliche Grundwerte gibt, dass deren Anzahl klar bestimmbar ist und dass zwischen ihnen keineswegs Konflikt, sondern Komplementarität besteht. Mit diesen Thesen und Befunden kann dieses Buch als neues soziologisches Standardwerk angesehen werden. Es hat auch für Vertreter vieler anderer geistes- und sozialwissenschaftlicher Disziplinen grundlegende Bedeutung. Der Autor Dr. Max Haller war nach wissenschaftlichen Tätigkeiten am Institut für Höhere Studien in Wien und an der Universität bzw. ZUMA Mannheim 1985-2015 Professor für Soziologie in Graz. Er lehrte als Gastprofessor auch an Universitäten in mehreren Ländern Europas, den USA und Afrika. Seine Publikationen erschienen in den renommiertesten internationalen soziologischen Zeitschriften. Er ist Mitglied der Österreichischen Akademie der Wissenschaften und forscht dort jetzt zu Fragen der Migration, Staatsbürgerschaft und Mehrsprachigkeit. The study adopts the classical definition of woman's economic independence as a result of women's participation in the world of paid labor.

La philosophie des sciences de l'empirisme logique avait discredite la causalite comme etant un concept du sens commun irremediablement vague et confus, pour lui substituer le concept d'explication scientifique. Cependant, dans nombre de theories contemporaines, notamment en philosophie de l'esprit et du langage, le concept de causalite continue a jouer un role de premier plan. Ce livre montre qu'il est possible de concevoir la causalite d'une maniere compatible avec des connaissances scientifiques contemporaines. La relation causale fondamentale a lieu entre evenements (...) en fonction de la transmission d'une quantite determinee d'une grandeur conservee; mais ce qui rend vraie une explication causale, ce n'est pas seulement une relation causale entre deux evenements, mais une relation de responsabilite causale. Le concept de loi de la nature qui intervient dans cette analyse s'avere fructueux non seulement dans le cadre de la causalite, mais aussi pour l'eclairage qu'il permet d'apporter a la philosophie des sciences. This essay explores the viability of theologies of nonviolent peacebuilding through reflection on constructive agents under duress. John Howard Yoder’s messianic theology was once a default model of peacebuilding in Christian ethics, but he mixes eschatologies, with problematic results. This essay extends insights from participant observation in Colombia to suggest that if we relate distinct accounts of messianic and gradual eschatologies without mixing them, we articulate a relationship between church and state that is fruitful for theological peacebuilding. Este artículo intenta desarrollar una deducción del concepto de sumo bien kantiano: esto es, intenta demostrar, de acuerdo con la interpretación de Dieter Henrich acerca de la deducción, que el sumo bien es un fin a la vez que un deber. Apelo a los rasgos de la razón práctica que constituyen la legitimidad de los hechos, la premisa que cualquier deducción debe tener. De acuerdo con Kant, el sumo bien consiste en la felicidad, la virtud y sus relaciones de proporcionalidad (...) y causalidad, tal que la felicidad es proporcional a, y causada por, la virtud. Sostengo, utilizando las nociones kantianas aceptadas, que Kant tiene razones convincentes para concluir que el sumo bien es, de hecho, un fin a la vez que un deber. Si esto es correcto, entonces este argumento ofrece la deducción prometida en mi título. This paper attempts a deduction of Kant's concept of the highest good: that is, it attempts to prove, in accordance with Dieter Henrich's interpretation of the notion of deduction, that the highest good is an end that is also a duty. It does this by appealing to features of practical reason that make up the legitimating facts that serve as the premises that any deduction must possess. According to Kant, the highest good consists of happiness, virtue, and relations of proportionality and causationbetween happiness and virtue, such that happiness is proportional to and caused by virtue. I argue, by drawing on accepted Kantian notions, that Kant had compelling reasons for concluding that the highest good is in fact an end that is also a duty. If correct, then this argument provides the deduction promised in my title. (shrink)

This discussion paper considers how seldom recognised theories influence clinical ethics committees. A companion paper examined four major theories in social science: positivism, interpretivism, critical theory and functionalism, which can encourage legalistic ethics theories or practical living bioethics, which aims for theory–practice congruence. This paper develops the legalistic or living bioethics themes by relating the four theories to clinical ethics committee members’ reported aims and practices and approaches towards efficiency, power, intimidation, justice, equality and children’s interests and rights. Different approaches (...) to framing ethical questions are also considered. Being aware of the four theories’ influence can help when seeking to understand and possibly change clinical ethics committee routines. The paper is not a research report but is informed by a recent study in two London paediatric cardiac units. Forty-five practitioners and related experts were interviewed, including eight members of ethics committees, about the work of informing, preparing and supporting families during the extended process of consent to children’s elective heart surgery. The mosaic of multidisciplinary teamwork is reported in a series of papers about each profession, including this one on bioethics and law and clinical ethics committees’ influence on clinical practice. The qualitative social research was funded by the British Heart Foundation, in order that more may be known about the perioperative views and needs of all concerned. Questions included how disputes can be avoided, how high ethical standards and respectful cooperation between staff and families can be encouraged, and how minors’ consent or refusal may be respected, with the support of clinical ethics committees. Originally published in 1973, this book shows that methods developed for the semantics of systems of formal logic can be successfully applied to problems about the semantics of natural languages; and, moreover, that such methods can take account of features of natural language which have often been thought incapable of formal treatment, such as vagueness, context dependence and metaphorical meaning. Parts 1 and 2 set out a class of formal languages and their semantics. Parts 3 and 4 show that these (...) formal languages are rich enought to be used in the precise description of natural languages. Appendices describe some of the concepts discussed in the text. In July 2018, the Nuffield Council of Bioethics released its long-awaited report on heritable genome editing. The Nuffield report was notable for finding that HGE could be morally permissible, even in cases of human enhancement. In this paper, we summarise the findings of the Nuffield Council report, critically examine the guiding principles they endorse and suggest ways in which the guiding principles could be strengthened. While we support the approach taken by the Nuffield Council, we argue that detailed consideration of (...) the moral implications of genome editing yields much stronger conclusions than they draw. Rather than being merely ‘morally permissible’, many instances of genome editing will be moral imperatives. (shrink)

In Process and Reality, Whitehead explicitly states what he conceives his task to be: “Speculative Philosophy,” he writes, “is the endeavor to frame a coherent, logical, necessary system of general ideas in terms of which every element of our experience can be interpreted.” He then goes on to explain what he means by the key terms in this passage. By ‘in terms of which every element of our experience can be interpreted’, “I mean,” he explains, “that everything of which we (...) are conscious, as enjoyed, perceived, willed, or thought, shall have the character of a particular instance of the general scheme.” This universality, or all-comprehensiveness, of the system is interpreted in terms of two characteristics: applicability and adequacy. Whitehead explains: “Here ‘applicable’ means that some items of experience are thus interpretable, and ‘adequate’ means that there are no items incapable of such interpretation.” It is these two characteristics of the system which give an explication of the term ‘necessary’ as applied to the system of general ideas: “The metaphysical first principles can never fail of exemplification. We can never catch the actual world taking a holiday from their sway.”. (shrink)

The scope of noninvasive prenatal testing (NIPT) could expand in the future to include detailed analysis of the fetal genome. This will allow for the testing for virtually any trait with a genetic contribution, including “non-medical” traits. Here we discuss the potential use of NIPT for these traits. We outline a scenario which highlights possible inconsistencies with ethical decision-making. We then discuss the case against permitting these uses. The objections include practical problems; increasing inequities; increasing the burden of choice; negative (...) impacts on the child, family, and society; and issues with implementation. We then outline the case for permitting the use of NIPT for these traits. These include arguments for reproductive liberty and autonomy; questioning the labeling of traits as “non-medical”; and the principle of procreative beneficence. This summary of the case for and against can serve as a basis for the development of a consistent and coherent ethical framework. (shrink)

This article examines nanotechnology within the context of the public interest. It notes that though nanotechnology research and development investment totalled US$9.6 billion in 2005, the public presently understands neither the implications nor how it might be best governed. The article maps a range of nanotechnology dialogue activities under way within the United Kingdom, the United States, Germany, and Australia. It explores the various approaches to articulating public interest matters and notes a shift in the way in which these governments, (...) on the whole, appear to be attempting to manage nanotechnology “risks.” It argues that open and transparent policy deliberations and extensive public discourse will be pivotal to protecting the public interest, gaining public trust and acceptance of nanotechnologies. The article concludes that though governing emerging technologies in the public interest is not a new concept, nanotechnology does present additional challenges that must be addressed by the guardians of the public interest. The book "Philosophical Foundations of Neuroscience" is an engaging criticism of cognitive neuroscience from the perspective of a Wittgensteinian philosophy of ordinary language. The authors' main claim is that assertions like "the brain sees" and "the left hemisphere thinks" are integral to cognitive neuroscience but that they are meaningless because they commit the mereological fallacy—ascribing to parts of humans, properties that make sense to predicate only of whole humans. The authors claim that this fallacy is at the heart of Cartesian (...) dualism, implying that current cognitive neuroscientists are Cartesian dualists. Against this claim, we argue that the fallacy cannot be committed within Cartesian dualism either, for this doctrine does not allow for an intelligible way of asserting that a soul is part of a human being. Also, the authors' Aristotelian essentialistic outlook is at odds with their Wittgensteinian stance, and we were unconvinced by their case against explanatory reductionism. Finally, although their Wittgensteinian stance is congenial with radical behaviorism, their separation between philosophy and science seems less so because it is based on a view of philosophy as a priori. The authors' emphasis on the a priori, however, does not necessarily commit them to rationalism if it is restricted to conceptual or analytical truths. (shrink)

Responsible research and innovation has come to represent a change in the relationship between science, technology and society. With origins in the democratisation of science, and the inclusion of ethical and societal aspects in research and development activities, RRI offers a means of integrating society and the research and innovation communities. In this article, we frame RRI activities through the lens of layers of science and technology governance as a means of characterising the context in which the RRI activity is (...) positioned and the goal of those actors promoting the RRI activities in shaping overall governance patterns. RRI began to emerge during a time of considerable deliberation about the societal and governance challenges around nanotechnology, in which stakeholders were looking for new ways of integrating notions of responsibility in nanotechnology research and development. For this reason, this article focuses on nanotechnology as the site for exploring the evolution and growth of RRI. (shrink)

Hegel's doctrines of absolute negativity and 'the Concept' are among his most original contributions to philosophy and they constitute the systematic core of dialectical thought. Brady Bowman explores the interrelations between these doctrines, their implications for Hegel's critical understanding of classical logic and ontology, natural science and mathematics as forms of 'finite cognition', and their role in developing a positive, 'speculative' account of consciousness and its place in nature. As a means to this end, Bowman also re-examines Hegel's (...) relations to Kant and pre-Kantian rationalism, and to key post-Kantian figures such as Jacobi, Fichte and Schelling. His book draws from the breadth of Hegel's writings to affirm a robustly metaphysical reading of the Hegelian project, and will be of great interest to students of Hegel and of German Idealism more generally. Reductionist forms of moral realism, such as naturalist realism, are often thought immune to epistemological objections that have been raised against nonnaturalist realism in the form of reliability worries or evolutionary debunking arguments. This article establishes that reductionist realist views can only explain the reliability of our moral beliefs at the cost of incurring repugnant first-order conclusions.
