This chapter examines the role of law in European Union (EU) external relations from two perspectives. First, it examines the EU as a rule‐based (international) actor Law and focuses mainly on EU law‐ governs both the extent of the European Union's external powers and their exercise, the constitutional foundations of EU external relations and the legal principles that govern external action. Second the chapter turns to the European Union's characteristic use of law as an instrument and objective of its foreign (...) policy, the European Union as a promoter of a rule‐based international order. The role of the Parliament in the conclusion of international treaties, which are often regulatory or quasi‐legislative in character, brings to the final theme of this contribution: the role played by law as both an instrument and a goal of EU foreign policy. A LAUDATO SI: UM NOVO, NECESSÁRIO E APROFUNDADO OLHAR SOBRE A CRISE SOCIOAMBIENTAL NA SOCIEDADE CONTEMPORÂNEA.

O DIREITO À CIDADE E O DIREITO ÀS CIDADES SUSTENTÁVEIS NO BRASIL: O DIREITO À PRODUÇÃO E FRUIÇÃO DO ESPAÇO E O ENFRENTAMENTO DO DÉFICIT DE IMPLEMENTAÇÃO.

Liutprand Kremonski je bil škof, diplomat in zgodovinar langobardskega porekla, ki je deloval v sredini 10. stoletja. Njegova zgodovinopisna dela Antapodosis, Relatio de legatione Constantinopolitana in Historia Ottonis so nadvse pomembna za poznavanje politične zgodovine 10. stoletja, zlasti za dogajanje na Apeninskem polotoku. Hkrati pa velja tudi obratno: literarna vrednost njegovih del v veliki meri izhaja iz pogosto duhovite, mestoma pa tudi izrecno napadalne kritike političnih nasprotnikov in nekdanjih zaveznikov.

Supraspan verbal list-learning tests, such as the Rey Auditory Verbal Learning Test (RAVLT), are classic neuropsychological tests for assessing verbal memory. In this study, we investigated the impact of the meaning of the words to be learned on 3 memory stages (short-term recall, learning, and delayed recall) in a cohort of 447 healthy adults. First, we compared scores obtained from the RAVLT (word condition) to those of an alternative version of this test using phonologically similar but meaningless items (pseudoword condition) (...) and observed how each score varied as a function of age and sex. Then, we collected the participants’ self-reported strategies to retain the word and pseudoword lists and examined if these strategies mediated the age and sex effects on memory scores. The word condition resulted in higher memory scores than pseudoword condition at each memory stage and even canceled out, for the learning stage, the detrimental effect of age that was observed for the short-term and delayed recall. When taking sex into account, the word advantage was observed only in women for short-term recall. The self-reported strategies, which were similar for words and pseudowords, were based on the position of the item on the list (word: 53 %, pseudoword: 37%) or the meaning of the item (word: 64%, pseudoword: 58%) and were used alone or in combination. The best memory performance was associated with the meaning strategy in the word condition and with the combination of the meaning and position strategies in the pseudoword condition. Finally, we found that the word advantage observed in women for short-term recall was mediated by the use of the meaning strategy. The RAVLT scores were thus highly dependent on word meaning, notably because it allowed efficient semantic knowledge-based strategies. Within the framework of Tulving’s declarative memory model, these results are at odds with the depiction of the RAVLT as a verbal episodic memory test as it is increasingly referred to in the literature. A moral dilemma exists in biomedical research relating to the use of animal or human tissue when conducting scientific research. In human ethics, researchers need to justify why the use of humans is necessary should suitable models exist. Conversely, in animal ethics, a researcher must justify why research cannot be carried out on suitable alternatives. In the case of medical procedures or therapeutics testing, the use of animal models is often justified. However, in forensic research, the justification may be less (...) evident, particularly when research involves the infliction of trauma on living animals. To determine how the forensic science community is dealing with this dilemma, a review of literature within major forensic science journals was conducted. The frequency and trends of the use of animals in forensic science research was investigated for the period 1 January 2012–31 December 2016. The review revealed 204 original articles utilizing 5050 animals in various forms as analogues for human tissue. The most common specimens utilized were various species of rats, pigs, mice, and rabbits although different specimens were favored in different study themes. The majority of studies were conducted on post-mortem specimens. It is, however, evident that more needs to be done to uphold the basic ethical principles of reduction, refinement and replacement in the use of animals for research purposes. (shrink)

As diferentes etnias produzem formas simbólicas, uma destas formas é através das imagens que a palavra enuncia, sendo assim, podemos afirmar que ao entrar em campo para estudar sobre etnicidades, o que os pesquisadores/as autores/as fazem é buscar entender quais formas simbólicas permeiam os universos estudados. Para pensar acerca desses universos é que tomo simbolismos étnicos enunciados pelas imagens que a palavra Legados Africanos carrega. A amplitude do trato com a categoria analítica legado africano pode se mostrar nas diversas obras (...) de diferentes autores e autoras, estudiosos das etnias africanas no Brasil, seja nas dimensões da cultura, da religião, das questões raciais negras, da linguística e outras. Mas aqui, o propósito é tomar as produções monográficas escritas por alunas e alunos, os quais orientei no curso de Pós-Graduação Lato Sensu em Antropologia com Ênfase em Culturas Afro-brasileiras para entender esses universos simbólicos. Neste sentido que, durante as orientações estava a lhes alertar que um curso de Antropologia com Ênfase em Culturas Afro-brasileiras, não poderia desprezar a categoria central de análise e interpretação que é legado africano no Brasil, salvo se, e somente se, a metodologia tratasse do objeto numa abordagem reducionista que excluísse, negasse e silenciasse as reminiscências africanas. As produções elaboradas por esses discentes nos indicou que os simbolismos presentes na palavra legados africanos enunciam que não são vistos como saberes de pertencimento étnico e sim como crenças. Neste artigo estamos propondo falar sobre Ensino, Pesquisa e Extensão como pretexto para pensar sobre as Relações Étnicas. Ou seja, de forma didática vamos falar sobre as Relações Étnicas e a indissociabilidade no tripé ENSINO-EXTENSÃO-PESQUISA, nesta ordem, pois enseja nossa experiência na educação superior no espaço do ODEERE. As perspectivas educacionais descolonizadoras lançam o olhar sobre processos de produção de conhecimentos que se voltem para pensar/debater metodologias que dê voz aos sujeitos, enaltecendo a oralidade e, portanto, o “senso comum” no (...) sentido atribuído por Geertz em sua produção “Saber Local”. Tais perspectivas nos coloca os desafios que a problemática das fronteiras nas relações entre diferentes etnicidades nos apontam nos espaços educacionais. O artigo aborda a relação entre crianças de terreiro e os seus etnosaberes produzidos no universo dos cosmosentidos do candomblé. Enquanto religião de matriz africana onde a biointeração é um dos princípios basilares, o candomblé e seu universo apresentam uma extensa gama de saberes tradicionais que são construídos e vividos no cotidiano. Compreender como as crianças de terreiro produzem seus conhecimentos traz consigo o intento de pensar a infância e seu poder criativo através de uma afroperspectiva onde a multidimensionalidade, multirreferencialidade (...) e a polissemia do saber se mostram a todo momento, nas ideias nascentes vividas, por exemplo, quando as crianças exploram o território do terreiro com a astúcia de quem conhece o que nós, adultas e adultos, não conhecemos. Na produção desenhística das crianças e nas suas narrativas é possível aprender sobre etnosaberes, cultura e ancestralidade através de itans, orikis e neolinguagens próprias dos seus universos simbólicos onde imagens e rituais didáticos unem teoria e prática, sensível e racional. Ademais, as crianças apresentam um caleidoscópio inventivo de saberes como guias para outros caminhos e possibilidades educacionais a luz das relações étnicas. (shrink)

This study investigates whether job stressors such as role ambiguity, procedural unfairness, and perceived competition may prompt high Machiavellian employees to use amoral manipulation at work. We also examine whether these manipulative behaviors are consequently related to their own task performance and affiliative citizenship behaviors. A weekly diary study was conducted among 111 Dutch employees over five consecutive working weeks, resulting in 446 assessed occasions. Using a multilevel moderated mediation model, we found that the relationship between weekly job stressors and (...) weekly amoral manipulation (AM) was contingent on trait AM, when the job stressor was role ambiguity (but not when the job stressor was either weekly procedural unfairness or weekly perceived competition). Our results also revealed significant indirect effects of weekly role ambiguity on weekly task performance and weekly display of courtesy through state AM, when trait AM was high. Our findings suggest that role ambiguity activates high Machiavellian employees’ manipulative behaviors at work, which in turn leads to impaired task performance and less courtesy toward others during the same working week. Este artigo apresenta uma discussão a respeito da etnicidade a partir de interpretações de elementos simbólicos identificados nas narrativas do/as entrevistados participantes de uma pesquisa de campo realizada numa comunidade tradicional religiosa de matriz africana, sobre ancestralidade. Possibilitando, assim, a compreensão do real e os sentidos étnicos e suas etnicidades. Considerando, portanto, essa categoria como principio que norteia construções simbólicas e ainda, responsável pelos traços dos repertórios da identidade étnica e vetores de etnicidades. Para tanto, utilizou-se como metodologia, o Estudo (...) das Formas Simbólicas - Hermenêutica de Profundidade-HP, elaborado por John B. Thompson, cujo arcabouço de trabalho fundamenta-se na etnografia, tendo as análises dos dados estruturadas observando os contextos em que as formas simbólicas são produzidas e interpretadas. O presente artigo problematiza o lugar das relações étnicas na Educação, a partir da articulação de juventudes, identidades e temas afro-brasileiros. Ancorada no método etnográfico e na Hermêutica de Profundidade, a pesquisa partiu das vivências de estudantes e egressos do Colégio Estadual José Araújo Pereira. A produção do conhecimento afro-brasileiro se apresenta alicerçada nos saberes de legados africanos e na difusão de temas, em constraste com os antagonismos enfrentados pelos sujeitos mobilizadores desses saberes. Ao problematizar etnicidade, relações étnicas e identidade (...) étnica, a pesquisa discute os desafios dos estudos étnicos na Educação e aponta a necessidade de ações planejadas para a geração de registros, publicidades e continuidades de trabalhos que fortalecem o protagonismo juvenil na produção do conhecimento afro-brasileiro. Este artículo es un estudio piloto para una comparación sistemática entre el texto árabe y latino del Qānūn fī aṭ-Ṭibb de Avicena. Con este propósito, ofrecemos una edición preliminar de un pasaje del Tercer Libro de esta gran enciclopedia médica en la traducción latina preparada por Gerardo de Cremona en Toledo en la segunda mitad del siglo XII. El análisis de este fragmento nos permite describir con rigor aspectos clave de la técnica de traducción de Gerardo de Cremona, (...) al mismo tiempo que pone de relieve problemas interpretativos vinculados a la difícil exégesis de las teorías médicas árabes sobre la enfermedad conocida como frenitis o frenesí. In this article, I propose to see the emotion of anger in the ‘Antapodosis’ by Liudprand of Cremona as an important means of assessing characters. By depicting the anger of the Ottonian kings as just and predictable, Liudprand shows how the ideal ruler should behave. He uses various examples from the Old Testament and especially the Deuterocanonical books of the Maccabees to present the anger of the Ottonian kings in the same fashion. In his vision, the negative counterpart to (...) the Ottonians is played by the Italic kings, who show their unworthiness precisely through the inept and tyrannical use of anger. In addition to this, Liudprand writes about aristocratic anger-management as well as the anger of women. Although a man of the church, Liudprand shows himself to understand and to use the code of honour which applied to noblemen in conflicts. Women do not, on the contrary, show unmediated anger. Their emotion is mixed with grief and tears. (shrink)

A seguinte entrevista, realizada no ODEERE, traz reflexões da Griot Marise de Santana à respeito de suas lutas envolvendo a carreira acadêmica, a religiosidade afro-brasileira e os aspectos de sua ancestralidade fortemente nuançada em sua prática docente, pesquisadora e militante. Buscou-se fazer de forma não linear uma apresentação da sua trajetória acadêmica, os espaços ocupados por ela, a repercussão de suas pesquisas, bem como sua vinculação teórica à outras e outros intelectuais brasileiros e afro-brasileiros. Por fim, aponta-se a necessidade (...) de mais estudos no campo das Relações Étnicas e contemporaneidade que tenham por objetivo precípuo a de(s)colonização do conhecimento e das ciências. ArgumentUp until the French Revolution, European mathematics was an “aristocratic” activity, the intellectual pastime of a small circle of men who were convinced they were collaborating on a universal undertaking free of all space-time constraints, as they believed they were ideally in dialogue with the Greek founders and with mathematicians of all languages and eras. The nineteenth century saw its transformation into a “democratic” but also “patriotic” activity: the dominant tendency, as shown by recent research to analyze this transformation, seems (...) to be the national one, albeit accompanied by numerous analogies from the point of view of the processes of national evolution, possibly staggered in time. Nevertheless, the very homogeneity of the individual national processes leads us to view mathematics in the context of the national-universal tension that the spread of liberal democracy was subjected to over the past two centuries. In order to analyze national-universal tension in mathematics, viewed as an intellectual undertaking and a profession of the new bourgeois society, it is necessary to investigate whether the network of international communication survived the political, social, and cultural upheavals of the French Revolution and the European wars waged in the early nineteenth century, whether national passions have transformed this network, and if so, in what way. Luigi Cremona's international correspondence indicates that relationships among individuals have been restructured by the force of national membership, but that the universal nature of mathematics has actually been boosted by a vision shared by mathematicians from all countries concerning the role of their discipline in democratic and liberal society as the basis of scientific culture and technological innovation, as well as a basic component of public education. Zusammenfassung Eine Untersuchung der diplomatischen Kontakte zwischen östlichem und westlichem Kaisertum im 10. Jahrhundert kann praktisch nur auf zwei umfangreichere Quellen zurückgreifen: den Legationsbericht des Liudprand von Cremona und die Briefe des byzantinischen Metropoliten und Synkellos Leon von seiner Westreise 996/998. Beide Texte sind keine offiziellen Dokumente, wie sie für das 9. Jahrhundert noch in beachtlicher Dichte vorliegen, aber sie geben daher nicht nur den Ereignissen, sondern auch Haltungen, Motivationen und individuellen Wahrnehmungen breiteren Raum, so daß sich ein in (...) Teilen lebendigeres Bild dieser Diplomatie eruieren läßt. Dagegen treten theoretische Prämissen deutlich zurück. Selbst bei Liudprand, im Umgang mit dessen Legatio starke quellenkritische Vorbehalte nicht unberücksichtigt bleiben dürfen, wird die „Zweikaiserfrage“ nur an wenigen Stellen Gegenstand, und Leon vermeidet offenbar jede Äußerung dazu. Dabei wäre eine Auseinandersetzung mit „unverschämten“ Ansprüchen des Westens auf die Basileia ein rhetorisch für ihn sicher ebenso angemessener Stoff gewesen wie die Verdammung des Philagathos. Im Vergleich beider Autoren ergeben sich zudem interessante Parallelen: beide haben ein ambivalentes Rom-Bild, beide können persönliche Feindbilder wirkmächtig stilisieren und mit politischen Argumenten vernetzen, vor allem aber entwickeln beide wirkungsvolle Mechanismen zur Verdrängung einer faktischen Zwangssituation und erwecken die Illusion, unabhängig handeln zu können oder mindestens rhetorische Überlegenheit gezeigt zu haben. Das hat in der Literatur nicht selten zu einer Überbewertung ihrer tatsächlichen politischen Rolle geführt. So dürfte Leon von Synada bei der Erhebung seines persönlichen Feindes Johannes Philagathos zum Gegenpapst 997 in Rom kaum mehr als eine legitimatorische Funktion zugekommen sein, obgleich er für sich in Anspruch nimmt, das ganze Geschehen initiiert und (zunächst) erfolgreich zum Ergebnis geführt zu haben. Stattdessen lassen sich durchaus Gründe für ein Zerwürfnis zwischen Otto III. und Johannes Philagathos im Vorfeld von dessen Rebellion benennen, insbesondere der Entzug der Abtei Nonantola durch den Kaiser, der eben nicht eine Reaktion auf das neue Gegenpapsttum darstellt, sondern ein Motiv zum endgültigen Bruch des Philagathos mit seinem kaiserlichen Schüler. Das eigentlich überraschende Faktum ist aber, daß die in ihrer Herrschaftsauffassung sehr anspruchsvolle Gestalt Ottos III. offenbar keine ideologische Konfrontation mit dem nicht minder selbstbewußten Basileios II. provozierte. Auch dies rechtfertigt es, die Bedeutung des Zweikaiserproblems gegenüber den zahlreichen politischen, territorialen und kirchenadministrativen Faktoren des Gegensatzes beider Seiten, welche beispielsweise in der Spätphase der Herrschaft Ottos I. und von 981-983 bei Otto II. unverkennbar hervortreten, zu relativieren. Daß das westliche Kaisertum also überhaupt in einem signifikanten Maße Gegenstand byzantinischer „Außenpolitik“ geworden ist, das verdankt es zweifellos primär der territorialen Bindung an Italien. In this paper I shall discuss the relationship between the two known Arabic translations of Aristotle’s Posterior Analytics and Avicenna’s Kitāb al-Burhān. I shall argue that Avicenna relies on both (1) Abū Bishr Mattā’s translation and (2) the anonymous translation used by Averroes in the Long Commentary as well as in the Middle Commentary (and also indirectly preserved by Gerard of Cremona’s Latin translation of Aristotle’s work). Although, generally speaking, the problem is relevant to the history of the transmission (...) of the Posterior Analytics from Greek through Syriac into Arabic, I do not intend to give a systematic presentation of the historical setting in which Aristotle’s work became readily available to the Arabo-Islamic culture. My aim here is rather to isolate and discuss some pieces of evidence concerning the texts that seem to have been available to Avicenna. In addition to that, I shall also provide evidence concerning the relationship with the Greek commentary tradition (in particular Philoponus and Themistius) that is likely to have influenced Avicenna in his discussion of Aristotle’s theory of demonstration and scientific knowledge. El grano de ben es un fruto que ha sido utilizado con fines terapéuticos desde la Antigüedad. Su descripción está incluida en el libro VI del De simplicium medicamentorum facultatibus de Galeno (s. II), una de las obras farmacológicas más importantes de la historia de la medicina. En este artículo compararemos desde una perspectiva filológica la entrada que Galeno dedicó a este simple en dos de sus traducciones medievales: la árabe de Ḥunayn ibn Isḥāq (s. IX) y la latina de (...) Gerardo de Cremona (s. XII). Nuestro análisis ayudará a profundizar en el estudio de estas dos traducciones y en la técnica de Gerardo de Cremona, el traductor más prolífico de obras de medicina griega y árabe al latín en la Edad Media. Alfenvs Varvs of Cremona, a quondam friend of Catullus, studied law with the great Seruius Sulpicius—some of whose lectures he published—served to the advantage of Vergil as land commissioner in Cisalpine Gaul, became consul suffectus in 39 B.C., and provided Horace with the point of a joke. He seems also—hence this note—to have been the versifier whom Catullus calls Suffenus in c. 14 and 22. If he is, we have here a somewhat rare instance of Horace's adapting to his (...) own use a suggestion from Catullus. (shrink)
