The performance appraisal process is increasingly seen as a key link between employee behaviour and an organization’s strategic objectives. Unfortunately, performance reviews often fail to change how people work, and dissatisfaction with the appraisal process has been associated with general job dissatisfaction, lower organizational commitment, and increased intentions to quit. Recent research has identified a number of factors related to reactions to performance appraisals in general and appraisal satisfaction in particular. Beyond the appraisal outcome itself, researchers have found that appraisal (...) reactions are affected by perceptions of fairness and the relationship between the supervisor and the employee. To explain the relationships among these factors, the present article proposes a moral cognition perspective. We suggest that employees judge a performance appraisal from the perspective of its moral justifiability, and that appraisal reactions will be determined, at least in part, by the perceived moral justifiability of the process. The proposal was supported by results from a survey of government employees using measures of performance ratings, leader–member exchange, perceived utility, and organizational justice. (shrink)

Can moral philosophy alter our moral beliefs or our emotions? Does moral scepticism mean making up our own values, or does it leave us without moral commitments at all? Is it possible to find a basis for ethics in human nature? These are some of the main questions explored in this volume, which is devoted to the ethics of the Hellenistic schools of philosophy. Some of the leading scholars in the field have here taken a look at the bases of (...) the Stoics' and Epicureans' thinking about what the Greeks took to be the central questions of philosophy. Their essays, which originated in a conference held at Bad Homburg in 1983, the third in a series of conferences on Hellenistic philosophy, propose important interpretations of the texts, and pose some fascinating problems about the different roles of argument and reason in ancient and modern moral philosophy. Acclaimed writer and historian Noel Malcolm presents his sensational discovery of a new work by Thomas Hobbes : a propaganda pamphlet on behalf of the Habsburg side in the Thirty Years' War, translated by Hobbes from a Latin original. Malcolm's book explores a fascinating episode in seventeenth-century history, illuminating both the practice of early modern propaganda and the theory of "reason of state".

The national ethical guidelines relevant to assisted reproductive technology have recently been reviewed by the National Health and Medical Research Council. The review process paid particular attention to the issue of non-medical sex selection, although ultimately, the updated ethical guidelines maintain the pre-consultation position of a prohibition on non-medical sex selection. Whilst this recent review process provided a public forum for debate and discussion of this ethically contentious issue, the Victorian case of JS and LS v Patient Review Panel [2011] (...) VCAT 856 provides a rare instance where the prohibition on non-medical sex selection has been explored by a court or tribunal in Australia. This paper analyses the reasoning in that decision, focusing specifically on how the Victorian Civil and Administrative Tribunal applied the statutory framework relevant to ART and its comparison to other uses of embryo selection technologies. The Tribunal relied heavily upon the welfare-of-the-child principle under the Assisted Reproductive Treatment Act 2008. The Tribunal also compared non-medical sex selection with saviour sibling selection. Our analysis leads us to conclude that the Tribunal’s reasoning fails to adequately justify the denial of the applicants’ request to utilize ART services to select the sex of their prospective child. The UK Supreme Court in Montgomery v Lanarkshire Health Board adopts an approach to information disclosure in connection with clinical treatment that moves away from medical paternalism towards a more patient-centred approach. In doing so, it reinforces the protection afforded to informed consent and autonomous patient decision making under the law of negligence. However, some commentators have expressed a concern that the widening of the healthcare providers’ duty of disclosure may provide impetus, in future cases, for courts to adopt a (...) more rigorous approach to the application of causation principles. The aim would be to limit liability but, in turn, it would also limit autonomy protection. Such a restrictive approach has recently been adopted in Australia as a result of the High Court decision in Wallace v Kam. This paper considers whether such an approach is likely under English negligence law and discusses case law from both jurisdictions in order to provide a point of comparison from which to scope the post- Montgomery future. The wordeuboulia, which meansexcellence in counselorsound judgement, occurs in only three places in the authentic writings of Plato. The sophist Protagoras makeseubouliathe focus of his whole enterprise(Prot.318e–319a):What I teach a person is good judgement about his own affairs — how best he may manage his own household; and about the affairs of the city — how he may be most able to handle the business of the city both in action and in speech.Thrasymachus, too, thinks well ofeuboulia. Invited by Socrates (...) to call injusticekakoetheia(vicious disposition — he has just identified justice as ‘an altogether noble good nature (euetheia)’, i.e. as simple-mindedness), he declines the sophistry and says (Rep. 348d): ‘No, I call it good judgement’. But Plato finds little occasion to introduce the concept in developing his own ethical and political philosophy. The one place where he mentionseubouliais in his defence of the thesis that his ideal city possesses the four cardinal virtues. He begins with wisdom, and justifies the ascription of wisdom to the city on the ground that it haseuboulia(Rep.428b) — which he goes on to identify with the knowledge required by the guardians: ‘with this a person does not deliberate on behalf of any of the elements in the city, but for the whole city itself — how it may best have dealings with itself and with the other cities’ (428c–d). It is normally rather dangerous to draw an inference from the absence or rarity of a word to the absence or rarity of the idea expressed by the word. (shrink)

What obligations are there on voters? This paper argues that voters should make their electoral decision competently, and does so by developing on a recent proposal for democratic legitimacy. It then explores three problems arising from this ‘competency obligation’. First, how should voters be competent? I propose three conditions required for voter competence. Second, how competent should voters be? I argue that the competency required tracks the significance of the consequences of the vote. Third, if the electorate are unlikely to (...) deliver a competent decision, should suffrage be restricted to the competent alone? I defend unrestricted suffrage on the grounds that restricting suffrage cannot guarantee a competently made electoral decision. Instead, obligations on voters should be minimised by political parties satisfying their obligations to be politically sound; if they are sound, then the obligation to be competent can be easily satisfied by voters. Barker influentially posited a development from an absolutist Republic hostile to the idea of the rule of law, through an absolutist Statesman which now engages more seriously and to a degree sympathetically with the idea, to a Laws in which the rule of law displaces the earlier absolutism. This paper demonstrates that Barker's construction is unsustainable. The Republic presents a political philosophy much more like the Laws than the absolutism of the Statesman. There is a lot of law and lawgiving (...) in the dialogue, and no more absolutism than in the Laws itself. (shrink)

It is arguable that the student of the deductions which make up the second part of Plato's Parmenides is today better placed than any of his predecessors, save Aristotle, Speusippus, and other immediate associates of Plato, to understand and evaluate those forbidding pages. Ways of looking at and handling the matter of the text are available to him which were not open to those who lived before the rise of critical philological scholarship in Europe in the last century, and of (...) analytical philosophy in the English-speaking world in this. He has to hand, too, some pioneering work on the dialogue of recent date. (shrink)

To ensnare the sophist of the Sophist in a definition disclosing him as a purveyor of images and falsehoods Plato must block the sophistical defence that image and falsehood are self-contradictory in concept, for they both embody the proposition proscribed by Parmenides — ‘What is not, is’. It has been assumed that Plato regards this defence as depending on a reading of ‘what is not’ in its very strongest sense, where it is equivalent to ‘what is not in any way’ (...) or ‘nothing’. Likewise, the initial paradoxes of not-being are seen as requiring that to mē on be understood in this way, that later designated by Plato as the opposite of to on or ‘being’. On this interpretation, Plato's counter-strategy is to recognise a use of to mē on which is not opposed in this strict sense to being, but is indeed a part of it and is ‘being other than’. In a stimulating article, R. W. Jordan challenges this account. I shall briefly attempt to show that his objections are not decisive and that his own interpretation is open to question. Jordan makes the interesting suggestion that a distinction between two senses of not-being, where one is equivalent to nothing and one is not, dates from the middle dialogues — particularly from Republic V, where objects of agnoia are mēdamē onta and objects of doxa are both onta and mē onta. He concludes , ‘Malcolm's view, then, seems to amount to this: that Plato is now extending the moral he draws about objects of belief in the Republic to cover forms. Forms too now are seen to be both being and notbeing.’. (shrink)
