My aim in this paper is to contribute to the debate on the foundations of semantics and pragmatics by developing an Austinian alternative to the Gricean programme. The Gricean approach has been criticised by Ernie Lepore and Matthew Stone who claim that most of the interpretive effects that are usually accounted for as inferentially recognized aspects of meaning are in fact determined by grammar. I argue, however, that it is the Austinian perspective rather than the extended-grammar outlook, that constitutes a (...) genuine alternative to the Gricean programme. Viewed from the Austinian perspective, using language is a social practice that consists of performing conventional speech acts: acts done conforming to a convention. Unlike the Griceans and the proponents of the extended-grammar outlook, however, the Austinians assume that following a convention is not an algorithmic procedure, but a socially controlled process that involves interactional negotiation. They claim, namely, that each language convention — phatic, rhetic, illocutionary, rhetorical, procedural, etc. — is a lineage of reproduced precedents that put some constraints on what can be regarded as saying and doing the same, but underdetermine the exact properties of its new members. This paper differentiates between two readings of Aristotle’s argument that unity and being are not “genē” (UBANG for short). On the first reading – proposed by commentators such as Ackrill, Shields, Loux, and McDaniel – UBANG entails the proposition that there are no features that characterise all beings insofar as they are, referred to by its contemporary proponents, including McDaniel, as ‘ontological pluralism’. On the second reading – proposed here – UBANG does not entail this proposition. The paper argues that (...) only on the second reading does Aristotle’s argument secure its conclusion, that the second reading is, in fact, the correct reading of UBANG, and that anyone who thinks that UBANG succeeds and entails ontological pluralism probably equivocates between two different senses of ‘genos’. We study the isomorphism relation on Borel classes of locally compact Polish metric structures. We prove that isomorphism on such classes is always classifiable by countable structures (equivalently: Borel reducible to graph isomorphism), which implies, in particular, that isometry of locally compact Polish metric spaces is Borel reducible to graph isomorphism. We show that potentially $\boldsymbol {\Pi }^{0}_{\alpha + 1}$ isomorphism relations are Borel reducible to equality on hereditarily countable sets of rank $\alpha $, $\alpha \geq 2$. This paper explores the wandering during the Night of Culture, which I consider an essential practice for the people's experience of this event. Looking at this particular form of movement of those participating in this initiative between various event locations also allows us to see the implications of the Night of Culture for urban public spaces. The empirical base of the paper is the visual documentation of the events carried out during the Night of Culture during the 2023 edition. While (...) interpreting the material, I refer to the situationist theory of drift and then reconstruct the structure of the festival's wandering, its rhythm, the type of attention bestowed on the city by the participants, and the form of this ephemeral community. In conclusion, I propose that the atmosphere of places can be used to analyse the city-forming effects of the Night of Culture, to grasp better the specificity of the event and its risks and potentials. Recent research observed a sensitive window, at about 14 years of age, in the acculturation rates of Chinese immigrants to Canada. Tapping an online sample ofusimmigrants, we tested these relationships in a broader population and explored connections with new potentially causally related variables: formal education, language ability and contact with heritage-culture and mainstream United States individuals, both now and at immigration. While we found that acculturation decreased with age at immigration and increased with years in theus, we did not observe (...) a similar sensitive window. We also present an exploratory path analysis, exposing the relationships in our sample between acculturation and the variables above. The novel relationships documented here can improve theorising about this rich and complex empirical phenomenon. (shrink)

The subject of this study are the argumentation strategies applied by the Polish and German apex courts competent in criminal matters, namely the Supreme Court and the Federal Court of Justice, respectively. The investigation encompasses a total of 200 rulings issued by the criminal panels of these bodies. Particular focus was put on examining which arguments both courts apply to solve interpretation problems, and secondly, how these courts systematize the interpretation process. Methodologically, the examination utilizes, inter alia, the principles of (...) qualitative research, without neglecting the legal dogmatic perspective. A crucial theoretical foundation underlying this study is the distinction between formalistic and substantive legal cultures. The examination reveals that neither the Polish nor the German legal culture is purely formalistic or value-oriented. Nevertheless, the Supreme Court of Poland shows greater affinity for formalistic arguments, whereas the substantive interpretation methods are more widespread in the judicature of the German Federal Court of Justice. In particular, the Polish Court prefers the linguistic interpretation, whereas the German Court favours the purposive approach. (shrink)

The paper develops a speech act-based model of verbal irony. It argues, first, that ironic utterances are speech actions performed as conforming to a socially accepted procedure and, second, that they are best understood as so-called etiolated uses of language. The paper is organized into four parts. The first one elaborates on Austin's doctrine of the etiolations of language and distinguishes between the normal or serious mode of communication and its etiolated mode. The second part discusses the dominant approaches to (...) verbal irony and argues that the irony-as-a-trope theories can be viewed as attempts to describe ironic utterances as cases of normal speech, whereas the metalinguistic theories seem to treat them as etiolated uses of language. The third part proposes a set of felicity conditions for ironic acts and puts forth a hypothesis that echo and overt pretence are complementary techniques of linguistic etiolation used for ironizing. The fourth part uses the proposed model to discuss the social dimension of ironizing and argues that utterances intended as acts of ironizing may trigger the accommodating process of context-repair. The take-home message is that ironic utterances are essentially social actions: acts performed by invoking a socially accepted procedure. (shrink)

The aim of this paper is to argue in favor of the view that some counterpossibles are false. This is done indirectly by showing that accepting the opposite view, i.e., one that ascribes truth to each and every counterpossible, results in the claim that every necessarily false theory has exactly the same consequences. Accordingly, it is shown that taking every counterpossible to be true not only undermines the value of debates over various alternative theories and their consequences, but also puts (...) into question the very possibility of such debates. In order to explicate this thesis, the close bond between counterpossibles and the so-called story prefix is explored. A number of possible responses to this criticism are also presented, and it is argued that none of them address the main problem. (shrink)

The paper aims to develop an interactional account of illocutionary practice, which results from integrating elements of Millikan's biological model of language within the framework of Austin's theory of speech acts. The proposed account rests on the assumption that the force of an act depends on what counts as its interactional effect or, in other words, on the response that it conventionally invites or attempts to elicit. The discussion is divided into two parts. The first one reconsiders Austin's and Millikan's (...) contributions to the study of linguistic practice. The second part presents the main tenets of the interactional account. In particular, it draws a distinction between primary and secondary conventional patterns of interaction and argues that they make up coherent systems representing different language games or activity types; it is also argued that the proposed account is not subject to the massive ambiguity problem. Numerous diagnoses of contemporary transformations of love and eroticism emphasise the fact that the intimate life has become democratised and liberated. Anthony Giddens argues that personal relationships increasingly become compatible with the model of pure relationship, which means that they are more egalitarian and that both partners are free to choose and to negotiate the shape of their relations. Jeffrey Weeks claims that in “the world that we have won”, women, homosexuals and queers are increasingly considered as equal to heterosexual (...) men. Most scholars agree that feminism is one of most important factors that enabled the democratisation of intimacy. Yet, it is possible to distinguish some interesting approaches that examine the unintended consequences of women’s emancipation. Sociologists like Arlie Russell Hochschild and Eva Illouz recognise the importance of feminism in democratising intimacy, thus they also claim that liberation of women has entailed rationalisation and commercialisation of intimacy. One of Hochschild’s main thesis is that feminism commercialises intimacy by legitimising “the commercial spirit of intimate life”. What is more, she argues that instead of humanizing men feminism is capitalising women. On the other hand, Illouz persuades that feminism – together with therapeutic discourse – rationalises intimacy by emphasising the necessity of analysing and quantifying all aspects of intimate life. Hochschild and Illouz claim that feminism unintentionally makes intimacy “cold” – that is that it suggests focusing on personal autonomy and perceiving warm and close bonds as an endangerment for that autonomy. The cooling entails loosening of family and intimate relationships and making individuals more attached to the market. In the end, both sociologists agree that “cool” branches of feminism make women similar to men and intimacy similar to the market. (shrink)

The aim of this article is to present the collaboration between companies in the energy sector in Austria and Germany. During the financial crisis 2008–2012, Austrian energy companies became important partners of German firms supplying Germany with the energy necessary for industries and households. In addition, companies from Austria and Germany participated in the first phase of construction of the pipeline Nabucco. Thanks to manage capital of Austrian and German companies, they may now jointly pursue the objective of expansion in (...) third countries market. After the energy reform, known as the Energiewende, Germany needs more electricity, which largely provide the company with a smaller, but equally high-tech Republic of Austria. (shrink)

In the first Critique, Kant raises two objections against Aristotle’s categories. Kant’s concern, in the first instance, is whether Aristotle generated all categories that there are and if he did not generate any spurious categories. However, for Kant, this is only a symptom of the second – deeper – flaw in Aristotle’s thinking. According to Kant, Aristotle generated his categories ‘on no common principle.’ This paper develops the two Kantian objections, offers an overview of Brentano's (1862. Von der Mannigfachen Bedeutung (...) des Seienden nach Aristoteles. Freiburg im Brisgau: Herder’sche Verlagshandlung.) reconstruction of Aristotle’s categories (which claims to have addressed them), develops three objections to this reconstruction, and recommends (Trendelenburg, A. 1846. Nina Emery and Christopher Hill proposed a pragmatic approach toward the debate about counterpossibles—i.e., counterfactuals with impossible antecedents. The core of this approach is to move the burden of the problem from the notion of truth value into the notion of assertion. This is meant to explain our pre-theoretical intuitions about counterpossibles while claiming that each and every counterpossible is vacuously true. The aim of this paper is to indicate a problematic aspect of this view.

In this paper, I analyze the semantics of the first person pronoun “I” from the perspective of the user/producer distinction. In the first part of the paper, I describe the Simple View and propose three interpretations of its thesis. In the second part, I analyze the notions of use and production of a linguistic token. In the next part, I show that all of the interpretations of SV are sensitive to counterexamples. In the end, I discuss possible answers of the (...) proponents of SV and argue against them. The first aim of this paper is to show that SV is wrong, and the second is to convince the reader that the user/producer distinction is of high importance in the philosophy of language. (shrink)

Piotr Kropotkin był najważniejszym przedstawicielem tzw. darwinizmu rosyjskiego oraz teorii pomocy wzajemnej, która podkreślała znaczenie współpracy wewnątrzgatunkowej w procesie doboru naturalnego oraz walki o byt. Na jej kanwie rosyjski badacz wysunął tezę o ewolucyjnych źródłach moralności, będącej problem badawczym w niniejszym artykule. Stanowi to jednocześnie powód dlaczego poza przedstawieniem wspomnianej tezy i jej założeń, w publikacji zilustrowana została także teoria pomocy wzajemnej. Zaproponowana przez Kropotkina wizja moralności suponowała, iż stanowi ona „przyrodzoną” właściwość ludzkiej natury. Podstawę dla niej stanowić ma instynkt (...) społeczny oraz jego przejawy, takie jak: równość, solidarność, sprawiedliwość, itd., a także pomoc wzajemna. Stawiało to propozycję rosyjskiego darwinisty w opozycji wobec dominujących trendów w myśleniu o ludzkiej moralności na przełomie XIX i XX wieku, zwłaszcza wobec tzw. darwinizmu społecznego i charakterystycznego dlań dualizmu moralnego. Ponadto zrywała z antropocentryzmem zakładając, iż poza gatunkiem ludzkim, także inne gatunki cechują się uczuciami moralnymi. (shrink)

The common view has it that there are two families of approaches towards the logical structure of impossible worlds – Australasian and North American. According to the first, impossible worlds are closed under the relation of logical consequence of one of the non-classical logics. The North American approach is more liberal, allowing for impossible worlds where no logic holds. After pointing out the questionable consequences of each view, I propose a third one. While this new perspective allows for worlds where (...) no logical consequence holds, it also imposes some constraints on what worlds are built upon. This renders the proposed view not as restrictive as the Australasian approach and not as liberal as the North American approach. Due to its intermediary nature, I have named this perspective ‘the Pacific’ approach. (shrink)

This chapter explores the axiological convergence between classical liberalism and Catholic Social Thought (CST). The chapter argues that CST and classical liberals should build on their complementary values to strengthen public support for liberal democracy and a free-market economy among Catholic voters and in society at large. Although populist regimes, especially far-right conservative nationalists, portray liberalism as an antithesis of Catholicism, this chapter shows that there is a broad consensus between the two traditions. Contrary to far-right populist positions, the chapter (...) argues that it is possible to maintain Catholic values in a liberal market democracy without denouncing one’s religious identity. The chapter emphasizes the importance of re-constructing a centrist tradition of Catholic liberal thought to mitigate populist assault on political, economic, and social freedoms. (shrink)

The aim of this paper was to analyze the relationship between attitudes toward physical activity and participation in water sports events and to recognize the main motives for involvement in these kinds of events. A written paper–pencil diagnostic survey was conducted among 394 participants in two traditional and two modern sports events on water held in Poland to ascertain whether innovative events are needed in society, and whether they cause an increase in interest in physical activity. The research results showed (...) that modern sports events on water did not have any more power to attract physically inactive people than traditional water events, did not produce a greater desire to lead an active lifestyle, and did not encourage people to more regularly practice water sports. Moreover, modern events, compared to traditional events, were only a one-time experience and the people who completed survey often wanted to return to traditional sports events which provided participants with greater positive emotions than a modern event. In the case of socio-demographical variables, there was no statistically significant relationship between gender and choice of modern or traditional event, but older people were more likely to choose a traditional event than younger people; modern water events were an attractive option primarily for young people under 30 years of age, furthermore, modern events more often attracted people who had completed higher education. However, it turned out that a modern event on water often attracted more people who had had no experience in this sport discipline rather than people who chose traditional water events. In a sense, modern events are therefore effective in promoting water sports in Polish society. We also distinguished five main groups of participants: healthy lifestyle managers, lovers of sports emotions, water sports malcontents, water sports enthusiasts, and neutrals to water sports. Additionally, we looked into gender-related motives for participation in modern and traditional water events: social and health-related motives proved to be more important for women and men who participated in modern water events. The research results presented in the article expand on the current state of knowledge about mass participation in sport, the impact of sporting events on the promotion of physical activity, and show the motivation behind participation in modern and traditional water sporting events. This paper aims to introduce Meinongian Abstractionism (MA), i.e. a view on the metaphysics of truthmaking and modality. This approach is based on the notion of objectives—one of the key elements of Alexius Meinong’s Theory of Objects. In the light of it, worlds are interpreted in terms of sets of subsistent and non-subsistent objectives. This—along with Meinong’s characterization of objectives—provides a ground for possible as well as impossible worlds. One of the consequences of Meinongain Abstractionism is a reformulation of the (...) relation of truthmaking in modal terms. Importantly, this reformulation avoids the problem of too-coarse grained analysis of truthmakers. This makes MA a metaphysically–oriented supporter of the so-called ‘hyperintensional revolution.’. Time perspective theory provides a robust conceptual framework for analyzing human behavior in the context of time. So far, the concept has been studied and applied in multiple life domains, such as education, health, social relationships, environmental behavior, or financial behavior; however its explanatory potential has been completely neglected within the domain of sport. In the present paper we provide a deepened theoretical analysis of the potential role of temporal framing of human experience for sport-related attitudes, emotions, and athletic performance. (...) We propose a conceptual model in which time perspectives influence psychological functioning and performance of athletes via three major mechanisms: 1) magnitude and persistence of sport motivation and resulting athlete engagement, 2) regulation of affective states during sport performance, and 3) appraisal of one’s performance and coping with resulting emotions. We support the theoretical considerations based on the major assumptions of time perspective theory with research findings regarding the regulatory role of time perspectives in other life domains. We also highlight potential research paths that would allow us to empirically test the present model and determine the actual role of temporal perspectives in shaping crucial aspects of athletes’ psychological functioning, as well as levels of their sport performance. The paper aims at presenting a very simplified outline of the Bono religious tradition of Tibet. Furthermore, the author argues that certain religious traditions are more “heaven-oriented” while others, more “earth-concerned”. This division is meant to show the importance of realizing the aim of any given philosophy or religious lore. It might be said that the present world crisis and human dilemma is caused mainly by misguided thinking and doing things in accordance with some dated or unrealistic dogma. The author (...) does not try to promote “Eastern” philosophy as superior or put down “Western” philosophy as inferior. Rather one tries to present the situation and wait for what comes next naturally. (shrink)

This paper discusses three different contemporary uses of philosophy and literature in non-philosophical and non-literary texts. Most often, both discourses are used as tools, and they are invoked instrumentally in popularizing literature or in teaching. Philosophy and literature can also be treated as a source or starting point for reflection outside its mother field, or even as a cause of various social and political processes. The most interesting usage of both discourses is to refer to them as the symptoms or (...) signs of the times allowing us to make diagnoses about the present. These uses of the two discourses show the similarities between literature and philosophy on a purely pragmatic level that is relevant to their contemporary functioning in a non-specialist sphere. The convergence in this regard is a testimony to the transformation of the position of both discourses in the contemporary humanities involving the loss of their privileged position. At the same time, literature and philosophy in this crisis situation are gaining new areas of influence in public discourse, realizing their cognitive and reflexive potential through their utilitarian use. W nim dzieje się prawda bycia. Człowiek w swojej wiedzy o sobie i o świecie jest objęty przez język, który nie należy do sfery "ja", lecz do sfery "my". Wszystkie formy ludzkiej wspólnoty są formami wspólnoty językowej. W ten sposób historia staje się absolutnym podmiotem.

In this paper we evaluate the role of prosodic information in inferring dialogue-specific functions of speech acts. We report the results of an empirical study in which participants are exposed to recordings of certain utterances and, next, asked to recognize discursive contexts from which the heard utterances may come. The recorded utterances are quotations: staged utterances produced by speakers asked to read aloud dialogues specially constructed for the study. We analyse prosodic cues produced by recorded speakers and argue that they (...) play a key role in depicting demonstrated target utterance. We assume that participants’ decisions manifest their implicit understanding of dialogue-specific functions of target utterances. The empirical part of our study shows that the efficiency rate of the prosodic cues produced by recorded speakers is 76%. We use the results of our prosodic analysis of recorded utterances to account for some cases of incorrect interpretations reported in the study. (shrink)

In this paper we present a solution to Saul Kripke’s Puzzle About Belief Meaning and use, Dordrecht, 1979) based on Kaplan’s metaphysical picture of words. Although it is widely accepted that providing such a solution was one of the main incentives for the development of Kaplan’s theory, it was never presented by Kaplan in a systematic manner and was regarded by many as unsatisfactory. We agree with these critiques, and develop an extension of Kaplan’s theory by introducing the notion of (...) “conservative” word uses, as well as arguing for the restriction of Kripke’s Disquotational Principle only to such uses. This restriction allows us to solve Kripke’s Puzzle by arguing that the assent of the puzzle’s protagonist does not allow disquotation and ascription of corresponding inconsistent belief, as it contains the non-conservative use of a proper name. At the end of the paper, we defend two of Kaplan’s theses that we find essential for our argument to work: that individuation of word tokens involves taking into account the intention of the speaker, and that different uniquely referring proper names of the same shape should be regarded as different homonymous words. The turn of the twenty-first century was a period of intensified research on the description of the world as a complex structure built of dynamical systems occurring at different levels of reality. Such systems can be described as bundles of processes. Therefore, the most empirically adequate ontology turns out to be processualism. In this paper, I describe a contemporary version of processual philosophy, which I refer to as processual emergentism. Within the proposed position, the classical formulations of processualism and emergentism (...) are revisited. Both elements complement each other – emergence describes constant, radical novelty as the basic feature of nature, while processualism employs the category of a process, which replaces the classically understood substance.The approach to emergence developed here is ontological and diachronic. I discuss classic determinants of emergence and propose a discussion on the category of supervenience, which in the light of the adopted assumptions turns out to be insufficient to describe the relationship of the dependence of the emergent on its base. Finally, processualism is reconciled with moderate structuralism and strong emergentism. (shrink)

Emotion Review, Volume 14, Issue 2, Page 132-160, April 2022. Autonomic nervous system activity is a fundamental component of emotional responding. It is not clear, however, whether positive emotional states are associated with differential ANS reactivity. To address this issue, we conducted a meta-analytic review of 120 articles, measuring ANS activity during 11 elicited positive emotions, namely amusement, attachment love, awe, contentment, craving, excitement, gratitude, joy, nurturant love, pride, and sexual desire. We identified a widely dispersed collection of studies. Univariate (...) results indicated that positive emotions produce no or weak and highly variable increases in ANS reactivity. However, the limitations of work to date – which we discuss – mean that our conclusions should be treated as empirically grounded hypotheses that future research should validate. (shrink)

The aim of this paper is twofold. First, the author examines Mitchell Green’s account of the expressive power and score-changing function of speech acts; second, he develops an alternative, though also evolutionist approach to explaining these two hallmarks of verbal interaction. After discussing the central tenets of Green’s model, the author draws two distinctions – between externalist and internalist aspects of veracity, and between perlocutionary and illocutionary credibility – and argues that they constitute a natural refinement of Green’s original conceptual (...) framework. Finally, the author uses the refined framework to develop an alternative account of expressing thoughts with words. In particular, he argues that in theorising about expressing thoughts with words – as well as about using language to change context – we should adopt a Millikanian view on what can be called, following Green, acts of communication and an Austinian approach to speech or illocutionary acts. The subject of my article is the principle of characterization – the most controversial principle of Meinong’s Theory of Objects. The aim of this text is twofold. First of all, I would like to show that Russell’s well-known objection to Meinong’s Theory of Objects can be reformulated against a new modal interpretation of Meinongianism that is presented mostly by Graham Priest. Secondly, I would like to propose a strategy which gives uncontroversial restriction to the principle of characterization and which allows (...) to avoid Russell’s argument. The strategy is based on the distinction between object- and metalanguage, and it applies to modal Meinongianism as well as to other so-called Meinongian theories. (shrink)

The aim of this paper is to show why the theories of impossible worlds do not fully solve the problem of counterpossibles, but merely shift it. Moreover, by making a distinction between two types of languages, we will show that some expectations about proper theory of counterfactuals might be too great.

The author presents a few consumer cases, which serves him to argue that customers frequently are victims of corporate arrogance and preponderance. In case of conflict between consumer expectations and corporate interests, corporations tend to put immediate profits above fairness, solidarity, the spirit of service or other non-material moral values. The power of corporations seems to be so immense today that we can talk about a form of corporate tyranny. Business companies resemble absolutist states of the past. In this context, (...) it is difficult to imagine how the "principle of gratuity and the logic of gift", a key proposal of the Encyclical Caritas in veritate, could be embraced by the business world. Gift, gratuity and communion require flexibility, prudence and freedom in decision making on the side of customer assistance and ground floor managers, which is an impossible prerequisite in a highly verticalised, centralised and standardised corporate world. The author warns that the arrogance and tyranny of corporations may become a source of human estrangement and oppression in the long run, as well as it may become a means of a "servile state". The author finishes claiming that the profit motive is not always the best incentive for corporate performance and that excellent business leadership is matter of balance between following rules and using common sense. He asks whether it is really possible to be efficient, profitable, prudent and humane in business at the same time? (shrink)

The article aims at addressing the question of representations of World War Two in Croatian and Serbian literature that were subversive in the sense that they queried the legend not simply by rejecting communism and affirming nationalism, but by emphasizing the uncertainty and sensibility of the human beings, a typical modern reaction to violence and, in general, modernist topoi. In this article I will focus on modernist novelistic representations of the 1960s in which the uncertainty and instability of collective warrants (...) are foregrounded. As a result a subversive meaning is produced which contradicts not only communism and revolution but more generally war as such, including the universal features of war such as confronting loneliness, love as an expression of an individual rather than a collective sense of existence, and the impossibility of a valid representation of past events. This paper is a reflection on the legitimacy of commonly accepted opposition of the notions of “capitalism” and “socialism”. The leading thesis is that although they can be considered as antinomies, their real referents should not be treated analogously. Capitalism, as understood by its very name, emerged in the second half of the 19th century and evolved constantly from this moment, often changing its main features. Socialism, in contrast, was created as a notion opposing the capitalistic reality of the 19th (...) century. Yet it never really existed in this form. The actual economic system, referred to as “socialism”, was in fact a hybrid of capitalism and neo-feudal bureaucracy. (shrink)

In this study, we reconcile conflicting findings from the extant literature on the impact of tax system parameters on tax noncompliance. We argue that social norms play a role of heuristics facilitating tax payers’ response to the instrumental incentives posed by the systemic parameters, such as tax rate and penalties for evasion, and thus moderate the effect of those parameters on willingness to evade taxes. Relying on a unique survey experiment conducted in fourteen countries of Central-Eastern Europe, we demonstrate two (...) types of a conditioning effect of norms. First, the impact of tax rates on respondents’ propensity for tax evasion is moderated by the perceived norms of the society at large. In particular, an increasing tax rate lowers the probability of evasion as long as one views “most others” as honest taxpayers, which highlights the importance of equitability concerns for tax compliance decisions. In contrast, the impact of punishment is moderated by the perceived norms of one’s immediate reference group. Strong subjective compliance norms tend to effectively replace penalties as a mechanism discouraging tax evasion, suggesting that the deterrent effect of a penalty can be entirely suppressed when subjective norms are strong. These findings have important implications for the understanding of tax compliance decisions under different formal and informal regimes. (shrink)

In this paper, I develop a speech-act based account of presumptions. Using a score-keeping model of illocutionary games, I argue that presumptions construed as speech acts can be grouped into three illocutionary act types defined by reference to how they affect the state of a conversation. The paper is organized into two parts. In the first one, I present the score-keeping model of speech act dynamics; in particular, I distinguish between two types of mechanisms—the direct mechanism of illocution and the (...) indirect one of accommodation—that underlie the functioning of illocutionary acts. In the second part, I use the presented model to distinguish between the unilateral act of individual presumption, the point of which is to shift the burden of proof by making the hearer committed to justifying his refusal to endorse the proposition communicated by the speaker, whenever he refuses to endorse it, the bilateral act of joint presumption—‘bilateral’ in that it is performed jointly by at least two conversing agents—the function of which is to confer on the proposition endorsed by the speaker the normative status of jointly recognized though tentative acceptability, and the indirect or back-door act of collective presumption, the purpose of which is to sustain rules and practices to which the conversing agents defer the felicity of their conversational moves.
