En el libro IX del Muntajab al- aḥkām del jurista andalusí Ibn Abī Zamanīn figura un capítulo acerca del perdón del talión en diferentes casos de delitos de sangre intencionados. Este trabajo ofrece el análisis y comentario de la casuística contenida en este capítulo, así como la edición del texto árabe a partir del manuscrito n. 1730/d de la Biblioteca General de Rabat y cotejado con el n. 5952 de la Biblioteca Nacional de Túnez.

Este trabajo se centra, dentro del marco de la práctica jurídica, en la actividad judicial en la frontera oriental granadina en los últimos años del reino nazarí. La fuente documental es el pleito que Lorca y Vera sostuvieron por la delimitación de sus términos a lo largo del siglo XVI. La información viva y real aportada por los testigos, en su mayoría cristianos nuevos y de avanzada edad, viene a arrojar luz sobre la delimitación de competencias, actuaciones y jurisdicciones no (...) sólo del cadí, sino también del alcaide, otro importante representante de la justicia, en un espacio concreto de al-Andalus y en un tiempo concreto de su historia. In the city of Elche, every year, on the 14th and 15th of August, a sacred musical play about the death, the Assumption and the Coronation of the Virgin Mary is held. This event, known as the “Misterio de Elche”, is unique in the world. Since the middle of the 15th century it has been performed in the Basilica of Santa Maria and in the streets of the ancient city of Elche, located in the Valencian Community. In this work, classified (...) as a UNESCO World Heritage Site, the interior of the temple is transformed into 2 main stages, the scaffold, located in the lower part, and the aerial stage, located in the dome at a height of 27 m. The structure and the traction mechanisms located on the aerial stage allow the aerial devices that take part in the play, “El Araceli”, “La Mangrana” and “La Santísima Trinidad”, to be raised and lowered. It should be noted that between 2 and 5 singing actors are embarked on these devices. This article describes the main characteristics of the aerial stage structure, the 3 apparatus and the mechanical systems used. In addition, the age and modifications of “El Araceli” are analysed, as well as the results of a non-destructive test carried out on this device. (shrink)

Advancements in novel neurotechnologies, such as brain computer interfaces and neuromodulatory devices such as deep brain stimulators, will have profound implications for society and human rights. While these technologies are improving the diagnosis and treatment of mental and neurological diseases, they can also alter individual agency and estrange those using neurotechnologies from their sense of self, challenging basic notions of what it means to be human. As an international coalition of interdisciplinary scholars and practitioners, we examine these challenges and make (...) recommendations to mitigate negative consequences that could arise from the unregulated development or application of novel neurotechnologies. We explore potential ethical challenges in four key areas: identity and agency, privacy, bias, and enhancement. To address them, we propose democratic and inclusive summits to establish globally-coordinated ethical and societal guidelines for neurotechnology development and application, new measures, including “Neurorights,” for data privacy, security, and consent to empower neurotechnology users’ control over their data, new methods of identifying and preventing bias, and the adoption of public guidelines for safe and equitable distribution of neurotechnological devices. Twentieth century philosophers introduced the distinction between “objective rightness” and “subjective rightness” to achieve two primary goals. The first goal is to reduce the paradoxical tension between our judgments of what is best for an agent to do in light of the actual circumstances in which she acts and what is wisest for her to do in light of her mistaken or uncertain beliefs about her circumstances. The second goal is to provide moral guidance to an agent who may be (...) uncertain about the circumstances in which she acts, and hence is unable to use her standard moral principle directly in deciding what to do. This paper distinguishes two important senses of “moral guidance”; proposes criteria of adequacy for accounts of subjective rightness; canvasses existing definitions for “subjective rightness”; finds them all deficient; and proposes a new and more successful account. It argues that each comprehensive moral theory must include multiple principles of subjective rightness to address the epistemic situations of the full range of moral decision-makers, and shows that accounts of subjective rightness formulated in terms of what it would reasonable for the agent to believe cannot provide that guidance. This volume continues the examination of issues of life and death which F.M. Kamm began in 'Morality, Mortality, ' Volume I (1993). Kamm continues her development of a non-consequentialist ethical theory and its application to practical ethical problems.

Why is death bad for us, even on the assumption that it involves the absence of experience? Is it worse for us than prenatal nonexistence? In this first volume of the two-volume Morality, Mortality, Kamm begins by considering these questions, critically examining some answers other philosophers have given. The book examines specifically what differences between persons are relevant to the distribution of any scarce resource, discussing for example, the distribution of bodily organs for transplantation.

This is a close scrutiny of "De Anima II 5", led by two questions. First, what can be learned from so long and intricate a discussion about the neglected problem of how to read an Aristotelian chapter? Second, what can the chapter, properly read, teach us about some widely debated issues in Aristotle's theory of perception? I argue that it refutes two claims defended by Martha Nussbaum, Hilary Putnam, and Richard Sorabji: (i) that when Aristotle speaks of the perceiver becoming (...) like the object perceived, the assimilation he has in mind is ordinary alteration of the type exemplified when fire heats the surrounding air, (ii) that this alteration stands to perceptual awareness as matter to form. Claim (i) is wrong because the assimilation that perceiving is is not ordinary alteration. Claim (ii) is wrong because the special type of alteration that perceiving is is not its underlying material realisation. Indeed, there is no mention in the text of any underlying material realisation for perceiving. The positive aim of II 5 is to introduce the distinction between first and second potentiality, each with their own type of actuality. In both cases the actuality is an alteration different from ordinary alteration. Perception exemplifies one of these new types of alteration, another is found in the acquisition of knowledge and in an embryo's first acquisition of the power of perception. The introduction of suitably refined meanings of 'alteration' allows Aristotle to explain perception and learning within the framework of his physics, which by definition is the study of things that change. He adapts his standard notion of alteration, familiar from "Physics" III 1-3 and "De Generatione et Corruptione" I, to the task of accounting for the cognitive accuracy of (proper object) perception and second potentiality knowledge: both are achievements of a natural, inborn receptivity to objective truth. Throughout the paper I pay special attention to issues of text and translation, and to Aristotle's cross-referencing, and I emphasise what the chapter does not say as well as what it does. In particular, the last section argues that the textual absence of any underlying material realisation for perceiving supports a view I have defended elsewhere, that Aristotelian perception involves no material processes, only standing material conditions. This absence is as telling as others noted earlier. Our reading must respect the spirit of the text as Aristotle wrote it. (shrink)

There is a perplexing transition in Dr. Reza Davari's thought, when he problematizes the relation between Iranian and Western history/cultures, on which this paper is focusing. The interperative objective is to clarify this transition on the basis of the implicit relation between the two most fundamental concepts in his earlier and later thought respectively westernization and underdevelopment. Although, by this transition, the level of discussion transits from an ontologico-philosophical to an intellectualist one. So, there are two different levels of problematization (...) in his thought which differ deeply. Therefore, we are not just dealing with the substitution of fundamental concepts, but with different problematizations and different levels of discussion. Obviously, there will be new problems arising which are not just concerning with the justification of the transition but with the problematization of westernization itself. Finally, it's been concluded that in order to clarify these new problems, we should step back to the level of philosophical discussion, and first of all to the clarification of the I-not-I relation which has been neglected thoroughly in the whole project. Scholars who deal with Heidegger’s philosophy often remark the scarcity of his references to phenomenological reduction as a means to grant access to the point of view of the being-in-the-world of the Dasein, the central theme of his early philosophy. Also the role of phenomenological reduction in Heidegger’s philosophy makes problem, as he criticizes Husserl for making of reduction a mere tool to reveal a pure, timeless and extra-worldly conscience – an untenable claim, according to Heidegger, for Dasein’s being-in-the-world, as (...) his most original way of being, can never be put out of play by any reduction. The role of transcendental reduction in Heidegger’s phenomenology is the theme of the present paper. (shrink)

Descartes' methodical doubt is being criticized by naïve realists and others who don't find doubt as a good starting point for metaphysical thought, however, the philosophical achievements of his method have been absorbed in all later philosophies. The objective of this paper is to demonstrate how an inevitable question concerning the foundation of Descartes' mathesis universalis, which led him to investigate this foundation by applying this very method in Metaphysics, has finally enabled him to discover his most important philosophical principle, (...) i.e., the necessary relation between being and reason in the identity of the "I". To demonstrate this, after summarizing the fundamental ideas of mathesis uneversalis, and showing the inner necessity of introducing the methodical doubt to fortify these ideas, the decisive role of metaphysical doubt as the third step of the methodical doubt, and malicious demon as its second phase would be highighted. It would also become clear that the metaphysical doubt has a great importance as a turning point from different aspects: as a knot that ties mathesis universalis with its underlying Metaphysics; as a bridge from within the psychological "I" to the metaphysical "I". "My work has had nothing to do with gay liberation," Michel Foucault reportedly told an admirer in 1975. And indeed there is scarcely more than a passing mention of homosexuality in Foucault's scholarly writings. So why has Foucault, who died of AIDS in 1984, become a powerful source of both personal and political inspiration to an entire generation of gay activists? And why have his political philosophy and his personal life recently come under such withering, normalizing scrutiny by commentators as (...) diverse as Camille Paglia, Richard Mohr, Bruce Bawer, Roger Kimball, and biographer James Miller? David M. Halperin's Saint Foucault is an uncompromising and impassioned defense of the late French philosopher and historian as a galvanizing thinker whose career as a theorist and activist will continue to serve as a model for other gay intellectuals, activists, and scholars. A close reading of both Foucault and the increasing attacks on his life and work, it explains why straight liberals so often find in Foucault only counsels of despair on the subject of politics, whereas gay activists look to him not only for intellectual inspiration but also for a compelling example of political resistance. Halperin rescues Foucault from the endless nature-versus-nurture debate over the origins of homosexuality and argues that Foucault's decision to treat sexuality not as a biological or psychological drive but as an effect of discourse, as the product of modern systems of knowledge and power represents a crucial political breakthrough for lesbians and gay men. Halperin explains how Foucault's radical vision of homosexuality as a strategic opportunity for self-transformation anticipated the new anti-assimilationist, anti-essentialist brand of sexual identity politics practiced by contemporary direct-action groups such as ACT UP. Halperin also offers the first synthetic account of Foucault's thinking about gay sex and the future of the lesbian and gay movement, as well as an up-to-the-minute summary of the most recent work in queer theory. Based on detailed descriptions of human–machine ensembles, this article explores how humans and machines work together to see specific things and unsee others, and how they come to co-configure one another. For seeing is not an automated function; whether one is a human or a machine, vision is gradually enskilled and mutually co-constituted. The analysis intersects three different ways of human–machine seeing to shed further light on the workings of each one: an airport, where facial recognition algorithms collaborate with border (...) guards to grant passage to particular travellers and not to others; a luggage-scanning system, where potential security threats are assessed by a complex of X-rays and human intro-spection; and a hospital operating room, where human–machinic surgical robots find their way and operate on the insides of human bodies, touching only by seeing. In these examples, human and machine ways of seeing merge together, seeing in particular apparatuses of material, political, organisational, economic and fleshy components. The article analyses the practical work of human–machinic collaboration and explores how the different material and social constituents, not necessarily always working from the same agenda, come to configure what can be seen and sensed and what cannot. In What particularism about conspiracy theories entails Dentith responds to their critics and examines the case for a refined and revised thesis of Particularism, the argument that we should appraise individual and particular conspiracy theories rather than appraise them in light of our views of the class of conspiracy theories generally. Recent work in the Philosophy of Conspiracy Theories has presented challenges to Particularism simpliciter (or Naive Particularism).
