According to Molinism, logically prior to his creative decree, God knows via middle knowledge the truth value of the counterfactuals or conditionals of creaturely freedom (CFs) and thus what any possible person would do in any given circumstance. Critics of Molinism have pointed out that the Molinist God gets lucky that the CFs allow him to actualize either a world of his liking or even a good-enough world at all. In this paper, I advance and strengthen the popular critique in (...) two ways. First, I specify the kind of luck to which God is subject, which is circumstantial moral luck. Second, and more importantly, I argue that exposure to this luck is problematic because something external to God and beyond his control determines the degree of praiseworthiness he deserves in relevant possible worlds. My main contention is that divine subjection to circumstantial moral luck raises the theoretical costs of Molinism. (shrink)

Proponents of the duty to vote (DTV) argue that in normal circumstances, citizens have the moral duty to vote in political elections. Discussions about DTV analyze _what_ the duty is, _who_ has this duty, _when_ they have it, and _why_ they have it. Missing are answers to the Specification Question: to _which_ elections does DTV apply? A dilemma arises for some supporters of DTV—in this paper, I focus on Julia Maskivker’s work—because either answer is problematic. First, I argue that it (...) is implausible that DTV applies to _all_ elections because this makes the duty too costly for the voter. Second, I argue that there are no good reasons why under normal circumstances DTV applies only to _some_ elections. I consider objections but conclude that the dilemma is successful and therefore the case for DTV is incomplete. (shrink)

We applaud Boyer's attempt to ground the psychology of ownership partly in a cooperative logic. In this commentary, we propose to go further and ground the psychology of ownership solely in a cooperative logic. The predictions of bargaining theory, we argue, completely contradict the actual features of ownership intuitions. Ownership is only about the calculation of mutually beneficial, reciprocal contracts.

In the Statesman and Phaedrus Plato addresses the problem inherent to law of how a general rule can be applied appropriately to particular circumstances. Previous scholarship has shown the connection between these dialogues’ critiques of written law and writing, a similarity this paper argues extends to the comparison of writing to a pharmakon (‘drug’) in both dialogues. Furthermore, close textual analysis shows that the Stranger’s discussion of measure in the Statesman parallels Socrates’ concept of ‘logographic necessity’ in the Phaedrus according (...) to which the parts of a perfect writing cohere like limbs within an organism. Logographic necessity and measure raise the possibility of overcoming the weakness of writing and written law respectively. Ultimately, the Laws recapitulates these issues to reveal an insuperable gap between legal and philosophic writing. Envisioning the ideal of perfect law is, however, necessary to see how law falls short of what philosophy as Platonic dialogue achieves. (shrink)

The essays in this collection explore the idea that discursive norms-the norms governing our thought and talk-are profoundly social. Not only do these norms govern and structure our social interactions, but they are sustained by a variety of social and institutional structures. The chapters are divided into three thematic sections. The first offers historical perspectives on discursive norms, including a chapter by Robert Brandom on the way Hegel transformed Kant's normativist approach to representation by adding both a social and a (...) historicist dimension to it. Section II features four chapters that examine the sociality of normativity from within a broadly naturalistic framework. The third and final section focuses on the social dimension of linguistic phenomena such as online speech acts, oppressive speech, and assertions. This is a review of Larry Alexander and Kim Ferzan’s _Reflections on Crime and Culpability_, a sequel to the authors’ _Crime and Culpability_. The two books set out a sweeping proposal for reforming our criminal law in ways that are at once commonsensical and mindbogglingly radical. But even if one is not on board with such a radical experiment, simply thinking it through holds many unexpected lessons: startlingly new insights about the current regime and about novel ways of doing legal (...) theory, some of which are explored in this essay. In “Image, Evidence, Argument,” Ian Dove defends an intriguing ‘middle ground’ between those who argue that there are “visual arguments” and skeptics who argue that there are not. I discuss one of Dove’s key examples, proposing a different analysis of it, arguing that there are problems with the “verbal repackaging” of the argument he suggests.

The prodigious development of argumentation theory over the last three decades has raised many issues that challenge some of the long held assumptions that characterize the traditional study of argument. One of these issues is the role of emotion in argument and argument analysis. While rhetoric has, with its emphasis on persuasion, always recognized that emotions play some role determining which arguments we accept and reject, a long tradition sees appeals to emotion as fallacies that violate the standards of rationality (...) and objectivity reason and argument require. This article discusses “auditory” arguments: arguments in which non-verbal sounds play a central role. It provides examples and explores the use of sounds in argument and argumentation. It argues that auditory arguments are not reducible to verbal arguments but have a similar structure and can be evaluated by extending standard informal logic accounts of good argument. I conclude that an understanding of auditory elements of argument can usefully expand the scope of informal logic and argumentation theory.

Contemporary policymakers, as their predecessors, continue to view nomadic people as a weak minority, and their way of life and raising livestock as a backward and inefficient paradigm. Wherever nomads are not the dominant group, the trend to settle them continues even today as in the past. This book describes the changes forced upon formerly nomadic groups and how they still attempt to maintain their traditional, social, and cultural practices in their new settings. The book deals with the several modes (...) of livelihood of these communities, including entrepreneurship, and demonstrates the impact of investment-oriented urbanization policies leading to eviction from ancestral lands, and hurdles for nomadic mobility, ultimately threatening their survival. The book illustrates how some groups like the Borana and the Maasai practice livelihood diversity and raise productive livestock, and how other groups migrate to urban centers in search of employment and remit money to family members left in the rural areas. The book aims to raise awareness among the research community, especially those who work on regional and demographic labor policies. Some Molinists claim that a perfectly good God would actualize a world that is salvifically optimal, that is, a world in which the balance between the saved and damned is optimal and cannot be improved upon without undesirable consequences. I argue that given some plausible principles of rationality, alongside the assumptions Molinists already accept, God’s perfect rationality necessarily would lead him to actualize a salvifically optimal world; I call this position “Optimistic Molinism.” I then consider objections and offer replies, concluding (...) that Optimistic Molinism is undefeated and merits further exploration. Boyer suggests that laws cannot account for ownership intuitions, but there may be situations when intuitions hew to laws almost perfectly. Laws granting governments taxation powers provide an interesting case study. We report data here suggesting that people's intuitions track law very closely, and are unaffected by manipulating a P() tag input. We propose two hypotheses to explain this finding.

The Philippines, a treasury of oral folk epics, gives us opportunities to research epics in transition, which implies documenting and introducing them to wider audiences. The losing of living epic tradition attracts national and international attention and becomes a concern of the state and the educational system. This study is focused on the literary characteristics Ricaredo Demetillo’s Barter in Panay: An Epic in which his materials were gathered from Maragtas, a semi-legendary recordof the Bornean settlement in Panay. The study is (...) anchored to Hornedo’s theory of reality frames in teaching literature. It unfolds the literary characteristics of the text through descriptive-qualitative method employing formalistic-contextualist approach. The study reveals the theme/s through the narration of the persona, the Filipino worldviews in contemporary times though the language of the characters. Barter in Panay: An Epic reflects the “sweetness and light” of the Filipino lifeways and traditional values. Demetillo’s literary epic is vehicle of preserving our folkloric tradition depicting our Filipino identity and worldview, making the text significant in the canon of Philippine and World literatures. The author emphasizes the urgency to know our past and to revise our understanding of the world within the progress of time. De 1958 à 1968, le cardinal L.-J. Suenens a mené un long combat pour obtenir un changement d’attitude de l’Église catholique au sujet de la contraception. L’ouverture de ses archives conciliaires permet actuellement de découvrir les moyens qu’il a utilisés et les manoeuvres qu’il a entreprises pour arriver à ses fins. Il a fait appel à des médecins , à des théologiens et à des philosophes provenant surtout de l’Université catholique de Louvain, ainsi qu’à des évêques amis . Comme membre (...) de la commission de coordination du concile, chargé du texte de Gaudium et Spes, il a veillé à ce que le chapitre sur le mariage reste ouvert à un développement de la doctrine. Courageusement, à de multiples reprises, il a tenté – mais sans résultat – de convaincre le pape Paul VI. Après la publication en 1968 de l’encyclique Humanae Vitae, il a réussi à faire publier une Déclaration de l’épiscopat belge, afin de libérer les consciences et de canaliser la contestation. La perception à travers l’imaginationDans le présent travail, je mets en relation les lectures de Wittgensteil et de Gadamer avec les manuscrits de Merleau-Ponty avec l’intention de traverser la construction du « concept de représentation » et de réfléchir sur les questions suivantes : quel lieu occupe la dimension esthétique dans l’expérience humaine? Dans l’expérience esthétique, faut-il retrouver autant le profil émotionnel que le profil cognitif? Le point de départ est que l’esthétique ne doit pas être comprise comme une simple (...) perception par les sens; ce qu’aucun discours sur l’esthétique ne peut occulter est sa nécessaire implication de l’horizon problématique de la perception, à partir de l’étymologie même du terme, dérivé du grec aisthesis.Un tel terme porte en lui autant le champ subjectif instable des sensation que le champ stable et tendanciellement structuré des discriminations perceptives.L’affirmation théorique est que l’expérience de la rencontre d’une oeuvre d’art dévoile un monde et à peine cessons-nous de voir une oeuvre d’art comme objet pour la voir comme un monde que nous nous rendons compte que l’art se révèle être l’expédient pour clarifier le sens de notre rapport perceptif avec le monde, cette syntonie perceptive entre l’essence du monde et le sentir des sujets, cette processualité expressive dans laquelle activité et passivité sont les horizons, qu’on peut certes distinguer dans la description, mais qui coopèrent à l’intérieur d’elle-même.Perception Through ImaginationIn the present work, I bring the lectures of Wittgenstein and Gadamer into contact with the manuscripts of Merleau-Ponty with the intention of going over the construction of the “concept of representation” and of reflecting on the following questions: what place does the aesthetic dimension occupy in human experience? In aesthetic experience, is just as necessary to recognize the emotional profile as the cognitive profile? The point of the departure is that aesthetics must not be understood as a simple perception by the senses. That which no discourse of aesthetics may conceal is its necessary implication of the problematic horizon of perception, following the actual etymology of the term, derived from the Greek aisthēsis.This term contains just as much the subjective and unstable field of sensation as it does the stable field of perceptual discriminations that tend to be structured. The theoretical affirmation is that the experience of the encounter with a work of art unveils a world. No sooner do we stop seeing the work of art as an object and start seeing as a world, then we realize that art reveals itself to be the expedient that clarifies the meaning of our perceptual relationship with the world, this perceptual syntony between the essence of the world and the sensing of subjects, this expressive processuality in which activity and passivity are horizons that can certainly be distinguished in description, but that cooperate internally. We consider that this religious belief, that it is the system's equilibrium, guaranties that the Hobbesian political project does not fall into revolutionary or totalitarian excesses. Thus, we shall analyse the arguments of the existence of God that are introduced by the philosopher Malmesbury with the objective of proving that reason does not necessarily lead to atheism, but that such (...) faculty requires the Revelation intervention to be able to channel it into a peaceful and lasting life.
