Both gender and the law are significant determinants of health and well-being. Here, we put forward evidence to unpack the relationship between gender and outcomes in health and well-being, and explore how legal determinants interact and intersect with gender norms to amplify or reduce health inequities across populations. The paper explores the similarities between legal and health systems in their response to gender—both systems portray gender neutrality but would be better described as gender-blind. We conclude with a set of recommendations (...) to address both law and gender in implementing the work of the Lancet Commission on the legal determinants of health to improve health outcomes for all, irrespective of gender. In this commentary I respond to the claims of Dimitris Vardoulakis that, following a mistake of Heidegger in his translation of Aristotle and the apparent loss of phronêsis, post-war continental philosophy has abandoned instrumental rationality and the calculation of utility, instead valorizing an ‘action without ends’ and instituting a ‘new Kantianism’ in its ethics, politics, and ontology. I do so by presenting the thought of Gilles Deleuze as one identified in this tradition who fails to be characterized by Vardoulakis’s claims, (...) and whose concepts already address these concerns. I first demonstrate how Deleuze’s ontology, as presented in Difference and Repetition, avoids relying on or constructing a meaningful, ontological outside, and so Vardoulakis’s characterization of a new Kantianism. And secondly, I respond to Vardoulakis’s critique of continental ethics by presenting the ethical notions in both The Logic of Sense and Capitalism and Schizophrenia as stemming from distinct ethical heritages (the former building on that of the Stoics, the latter primarily that of Spinoza), as well as both providing immanent direction to our actions, providing what can be read as the revisable, calculable reasoning Vardoulakis associates with phronêsis. In this way I show that his category of the ‘ineffectual’ cannot apply to all post-war continental philosophy as Vardoulakis so claims. (shrink)

Virtually every figure in the climate justice literature agrees that states are presently failing to discharge their duties to take action on climate change. Few, however, have attempted to think through what follows from that fact from a moral point of view. In Climate Justice Beyond the State, Lachlan Umbers and Jeremy Moss argue that states’ failures to take action on climate change have important implications for the duties of the most important actors states contain within them – sub-national (...) political communities, corporations, and individuals – actors that have been largely neglected in the climate justice literature, to date. Sub-national political communities and corporations, they argue, have duties to immediately, aggressively, and unilaterally reduce their emissions. Individuals, on the other hand, have duties to help promote collective action on climate change. Along the way, they contribute to a range of important contemporary debates, including those over the nature of collective duties, what agents are required to do under conditions of partial compliance, and the requirements of fairness. Targeted at academic philosophers working on climate justice, this book will also be of great interest to students and scholars of global justice, applied ethics, political philosophy, and environmental humanities. East India Company surveyors began gaining access to the high Himalaya in the 1810s, at a time when the mountains were taking on increasing political significance as the northern borderlands of British India. Though never as idiosyncratic as surveyors insisted, these were spaces in which instruments, fieldbook inscriptions, and bodies were all highly prone to failure. The ways surveyors managed these failures demonstrate the social performances required to establish credible knowledge in a world in which the senses were scrambled. The (...) resulting tensions reveal an ongoing disconnect in understanding between those displaced not only from London, but also from Calcutta, something insufficiently emphasized in previous histories of colonial science. By focusing on the early nineteenth century, often overlooked in favor of the later period, this article shows the extent to which the scientific, imaginative, and political constitution of the Himalaya was haphazard and contested. Elitist scepticism of democracy has a venerable history. This paper responds to the latest round of such scepticism—the ‘competence objection’, articulated in recent work by Jason Brennan. Brennan’s charge is that democracy is unjust because it allows uninformed, irrational, and morally unreasonable voters to exercise power over high-stakes political decisions, thus imposing undue risk upon the citizenry. I show that Brennan’s objection admits of two interpretations, and argue that neither can be sustained on close examination. Along the way, I consider (...) the merits of Brennan’s preferred ‘epistocratic’ alternative to democracy, and argue that it is likely to lead to lower-quality outcomes. (shrink)

In the 1960s, theoretical biologist Richard Levins criticised modellers in his own discipline of population biology for pursuing the “brute force” strategy of building hyper-realistic models. Instead of exclusively chasing complexity, Levins advocated for the use of multiple different kinds of complementary models, including much simpler ones. In this paper, I argue that the epistemic challenges Levins attributed to the brute force strategy still apply to state-of-the-art climate models today: they have big appetites for unattainable data, they are limited by (...) computational tractability, and they are incomprehensible to the human modeller. Along the lines Levins described, this uncertainty generates a trade-off between realistic, precise models with predictive power and simple, highly idealised models that facilitate understanding. In addition to building ensembles of highly complex dynamical models, climate modellers can address model uncertainty by comparing models of different types, such as dynamical and data-driven models, and by systematically comparing models at different levels of what climate modellers call the model hierarchy. Despite its age, Levins’ paper remains incredibly insightful and should be considered an important entry into the philosophy of computational modelling. (shrink)

Nothing can be said about a nonexistent object, but something can be said about the act of (unsuccessfully) attempting to refer to one or, as in fiction, of pretending to refer to one. Unsuccessful reference, whether by expressions or by speakers, can be explained straightforwardly within the context of the theory of speech acts and communication. As for fiction, there is nothing special semantically, as to either meaning or reference, about its language. And fictional discourse is just a distinctive use (...) of ordinary language: pretended communication and within it, pretended reference. However, discourse about fiction is not pretense but is normal communication, a kind of indirect discourse. To describe the world of a fiction is to state what the fiction says (or implies); and what seems to be reference to a fictional character is really attributing (usually implicitly) a feigned reference by the author. Most democracies disenfranchise persons with cognitive disabilities. Several democratic theorists have, for a range of reasons, recently argued that such restrictions ought to be abolished. I agree with such arguments. Some, however, have also expressed the hope that enfranchising such persons might give politicians more powerful incentives to attend to such persons’ interests. I argue that such hopes are likely to be disappointed. If we wish to ensure that such persons’ interests are taken seriously in the political process, we must (...) consider reforms of other kinds. After considering several alternatives, I argue for a deliberative solution—a Citizens’ Assembly for the Cognitively Disabled, modeled upon the 2004 British Columbia Citizens’ Assembly on electoral reform. Against a background of increasing regulation regarding access to medical information and the presentation of patients' confidentiality, the case of genetic information raises interesting questions about whether the application of general rules is appropriate in all situations. Whilst all genetic information is not equally sensitive, some of it is highly predictive. It also allows deductions to be made about other family members. It may not be regarded as particularly sensitive when compared to other types of medical information and those to (...) whom it applies may not be as anxious about preserving their confidentiality as compared with—for example, the prospect of seeing research into cause and cures for rare diseases put in hand. These distinctions also find resonance with the general public. Resolving conflicting tensions will require subtlety, not a blunt “one size fits all” model. (shrink)

It is clear throughout Cognitive Gadgets Heyes believes the development of cognitive capacities results from the interaction of genes and experience. However, she opposes cognitive instincts theorists to her own view that uniquely human capacities are cognitive gadgets. Instinct theorists believe that cognitive capacities are substantially produced by selection, with the environment playing a triggering role. Heyes’s position is that humans have similar general learning capacities to those present across taxa, and that sophisticated human cognition is substantially created by our (...) socioculturally transmitted environment. It is a core strategy of Heyes to provide evidence of learning altering a cognitive capacity to conclude that a capacity is a cognitive gadget and not an instinct. We draw on recent work on the evolution of learning preparedness to examine the adequacy of this strategy. In particular, we analyse experimental evolution work showing how selection affects cognition within the laboratory. First, this work reveals that change due to learning can still be retained under genetic assimilation. This suggests that domain-specific adaptation can coexist with learning, moderate nativism, an option missed by the instinct versus gadget distinction. Second, we describe the conditions that select for increased preparedness in learning: certainty, reliability, and particular costs. We consider how these conditions can be used when conducting evolutionary reasoning about cognition, applying them to the important capacity for imitation. We find that the conditions lend theoretical support to moderate nativism about the capacity to imitate, which is supported by psychological evidence. (shrink)

The article discusses how and why philosopher Ayn Rand attempted to deduce an ought conclusion from only is premises. It contends that Rand did attempt to deduce what one ought and ought not do from what is or is not the case. It argues that Rand attempted to provide a universally objective unshakable normative moral claim, that people ought to act in accordance with her value and virtue system.

Psychopaths constitute less than 1% of the general population, but they commit a much larger proportion of crime and violence in society. This volume chronicles the latest science of psychopathy, various ways that psychopaths challenge the criminal justice system, and the major ethical issues arising from this fascinating condition.

Almost everyone would agree that vote buying is morally wrong, and that prohibitions on vote buying are morally justified. Yet, recently, several philosophers have argued that vote buying is morally permissible, and that it should be legally permitted. This paper begins by examining and criticising arguments that have been offered in defence of vote buying. I then go on to consider existing attempts to explain the wrongness of vote buying, arguing that none is wholly successful. I then advance a novel (...) account of the wrongness of vote buying. Vote buying is objectionable, I argue, because it involves a failure of respect for one’s fellow citizens as autonomous agents. This is distinguished from Existential Sociality based on the Emergent Meta-system. The various kinds of Being such as Pure, Process, and Hyper Being gives rise to different kinds of basic sociality which are Pure Sociality, Process Sociality, and Hyper Sociality prior to the arising of Wild Sociality that then appears on the surface of Ultra Sociality that is (...) completely transcendent (height) or is represented by the utterly unconscious (depth). Wild Being is a surface phenomena of the expression of Sense differentiated from Nonsense. This paper is a report on the viability, both technical and ethical, of negative emissions technologies (NETs) in climate change mitigation. Given present levels of atmospheric carbon dioxide, NETs are almost certainly required in order to avoid the most serious consequences of anthropogenic carbonization. Critics argue that we should not rely on the promise of future NETs because that could be taken as an excuse to avoid decarbonization in the near term. The concern is genuine, but if the prima facie (...) arguments for drawing down carbon as soon as possible are correct, ways must be found to counter the incentives to defer the immediate deployment of NETs and other forms of mitigation. A policy instrument is sketched which could help accomplish that task. (shrink)

The claim that the cult of Artemis of Ephesus included a rite of initiation, conducted by the kouretes, should be doubted. Various Ephesian magistrates in Roman Imperial times, but not the annual kouretes, declare that they celebrated “all the sacrifices and mysteries”. This however can be merely the increasingly pretentious terminology of the age, “mysteries” meaning no more than “holy rites”. Ancient authors show no knowledge of initiation to Artemis at Ephesus. In contrast, the inscriptions unambiguously attest initiation to Dionysus (...) and probably to Demeter, as we would expect in a Greek city. And in one dedication to Aphrodite, we do find again “mysteries”, but in this case metaphorical: they refer to marriage. (shrink)

The human and mouse genomes are complex from a genomic standpoint. Each cell has the same genomic sequence, yet a wide array of cell types exists due to the presence of a plethora of regulatory elements in the non‐coding genome. Recent advances in epigenomic profiling have uncovered non‐coding gene proximal promoters and distal enhancers of transcription genome‐wide. Extension of promoter‐associated H3K4me3 histone mark across the gene body, known as a broad H3K4me3 domain (H3K4me3‐BD), is a signature of constitutive expression of (...) cell‐type‐specific regulation and of tumour suppressor genes in healthy cells. Recently, it has been discovered that the presence of H3K4me3‐BDs over oncogenes is a cancer‐specific feature associated with their dysregulated gene expression and tumourigenesis. Moreover, it has been shown that the hijacking of clusters of enhancers, known as super‐enhancers (SE), by proto‐oncogenes results in the presence of H3K4me3‐BDs over the gene body. Therefore, H3K4me3‐BDs and SE crosstalk in healthy and cancer cells therefore represents an important mechanism to identify future treatments for patients with SE driven cancers. (shrink)

An important but easily forgotten moment in the history of film-philosophy is Jean Epstein's assertion that cinema, more than merely thinking, has a kind of intelligence. If it is a newfound conception of rationality that is needed for any contemporary ethical relation to the world, as thinkers from Reza Negarestani and Pete Wolfendale to feminist collective Laboria Cuboniks have espoused in their respective neo-rationalist projects, then cinema as a thinking thing must be interrogated in its relation to reason. A somatophilia (...) of purely affective and phenomenological approaches in film theory alongside micropolitical injunctions to undermine common-sense and liberate one's desire in extremity can fall limp in view of such calls for universal thinking around rationality. To understand cinema's specific form of intelligence, this article will explore Luc Besson's Lucy as an instance of how film is able to represent intelligence. Besson's film provides a site where Western cultural anxieties and assumptions around intelligence are manifested. This will allow an explication of contemporary approaches to intelligence in philosophy whilst confronting these discourses with the insidious problematics of gender and race that undergird the film. I argue that Lucy shares many of its ambitions with the emerging vectors of thought associated with the neo-rationalist perspective in its engaging with a rethinking of universal values and the Promethean possibilities of human action. Reading the film through these philosophies will help position the ethical stakes it sets up, but also to distinguish it from a trend of contemporary “posthuman” films that it finds itself in company with. While it is certainly true that posthuman themes, as well as transhumanist fantasies, seem to permeate Besson's film, this article will incorporate another neologism, taken from neo-rationalist thinkers, in order to emphasise moments that can be productive from the standpoint of a philosophical account of intelligence: “rationalist inhumanism.”.
