Cet ouvrage rend hommage au Professeur Claude JOURNÈS, ancien Président de l'Université LUMIERE Lyon 2 et membre fondateur du mouvement Critique du droit. Les Mélanges offerts au Professeur Claude JOURNÈS ont retenu cette approche, utilisant le droit comme un outil de mise en perspective critique de l'ordre social et de l'ordre politique. Après un hommage au Doyen JOURNÉES (P. BLACHÈR) et l'évocation des ambitions et perspectives du mouvement critique Du droit (S. BASSET ou J. MICHEL), l'ouvrage se construit en deux (...) temps. La première partie, intitulée « Le droit critique de l'ordre social », regroupe des réflexions sur le pouvoir médical (F. DEMICHEL), sur les crimes coloniaux (A. MAHIOU), sur la dimension anthropologique du vocabulaire juridique (M.-C. HATTI) et sur le contrôle policier (M. SAOUDI), le tout ouvrant sur la possibilité d'un humanisme séculier (H. PUEL). La seconde partie, « Le droit critique de l'ordre politique », entend montrer comment le droit porte en lui une conception du pouvoir et de l'autorité. Les études explorent des pistes très diverses mêlant les finances publiques (J.-L. ALBERT), les renseignements (C. ARROUDJ), l'histoire du droit (J.-L. AUTIN, J.-C GENIN), l'histoire de la doctrine (H. GOURDON), les institutions politiques (P. BACOT, A.-S. MESCHERIAKOFF, R. CHARVIN), les institutions territoriales (J.-J. GLEUAL, H. OBERDORFF, R. PAVRE), la littérature (S. CAPORAL, G. HARE) ou les nouvelles technologies (G. PROTIÉRE). II ressort de l'ensemble que, loin d'être un simple outil technique, le droit est un puissant instrument de modélisation sociale et de justification du pouvoir. Inversant la logique dominante, la perspective critique du droit dévoile les limites d'une telle conception et rappelle que le droit, comme tous les construits sociaux, est le produit de luttes politiques et de rapports de force. En ce sens, à l'instar des valeurs défendues par le dédicataire de cet ouvrage, l'ordre critique du droit est un appel à contester les évidences, condition d'une conception plus ouverte et pluraliste de l'ordre juridique. ObjectivePhysical isolation measures, known as lockdown or shelter-in-place, experienced during coronavirus disease 2019 have the potential to cause psychological distress. This study was conducted to examine parents’ perceived stress and whether reports of rewards and challenges during lockdown impact stress.MethodsData were collected using a cross-sectional online survey in New South Wales, Australia, across the 4-week lockdown. The survey was completed by 158 parents of children aged under 6 years. Stress was measured using the short form of the Perceived Stress Scale. (...) Rewards and challenges were reported in response to two open-ended questions.ResultsThere was a weak negative correlation between PSS-4 scores and days in isolation, with parents who had spent longer in isolation reporting fewer stress symptoms. The relationship between time in isolation and stress was moderated by the degree to which parents described more rewards than challenges: parents who perceived high rewards and low challenges reported lower PSS-4 scores with more days in lockdown, whereas parents who perceived low rewards and high challenges reported higher PSS-4 scores with more days in lockdown. The moderation model examining associations between time in isolation and rewards ratio explained 13% of the variance in PSS-4 scores.ConclusionLockdowns are not uniformly or consistently negative experiences for parents. Identifying positive aspects of the experience may serve to buffer negative mental health risks across time. Understanding resilience strategies is critical for supporting current psychological wellbeing and to adequately prepare for future pandemic experiences. (shrink)

The period of the mid-1920s to the mid-1980s was a portentous period for Soviet psychology. As this period recedes into the past, the figure of L. S. Vygotskii rises more and more before us. Vygotskii died of tuberculosis when not quite 37 years old. He was a psychologist for only 10 years, and it was only in the last 6 of these that he did the work we now associate with his name. During those brief years Vygotskii wrote over 120 (...) works, including more than 10 large books. His was a short life — filled with inspired, indefatigable, and heroic work. A significant part of his written work has remained unpublished and indeed much of it remained unfinished. A seven-volume collection of Vygotskii's work is currently underway, and even this will not contain everything he wrote. The final volume of this collection will include his articles "The Sense of the Psychological Crisis" and "Spinoza's Theory of the Passions.". (shrink)

Junior researchers can be abused and bullied by unscrupulous senior collaborators. This article describes the profile of a type of serial abuser, the White Bull, who uses his academic seniority to distort authorship credit and who disguises his parasitism with carefully premeditated deception. Further research into the personality traits of such perpetrators is warranted.

ABSTRACTAdopting a temporally distant perspective on stressors reduces distress in adults. Here we investigate whether the extent to which individuals project themselves into the future influences distancing efficacy. We also examined modulating effects of age across adolescence and reactive aggression: factors associated with reduced future-thinking and poor emotion regulation. Participants read scenarios and rated negative affect when adopting a distant-future perspective, near-future perspective, or when reacting naturally. Self-report data revealed significant downregulation of negative affect during the distant-future condition, with a (...) similar though non-significant skin conductance pattern. Importantly, participants who projected further ahead showed the greatest distress reductions. While temporal distancing efficacy did not vary with age, participants reporting greater reactive aggression showed reduced distancing efficacy, and projected themselves less far into the future. . This paper examines the association between long-term compensation and corporate social responsibility for 90 publicly traded Canadian firms. Social responsibility is considered to include concerns for social factors and the environment, 564-578; Kane, E. J., 341-359). Long-term compensation attempts to focus executives efforts on optimizing the longer term, which should direct their attention to factors traditionally associated with socially responsible executives. As hypothesized, we found a significant relationship between the long-term compensation and total CSR weakness as well as the (...) product/environmental weakness dimension of CSR. In addition, we found a marginally significant relationship between long-term compensation and total corporate responsibility. Our findings are that executives long-term compensation is associated with a firms environmental actions, and that firms that utilize long-term compensation are more likely to mitigate product/environment weaknesses than those that do not. A new formulation involving fulfillment of all the Kolmogorov axioms is suggested for acomplete probability theory. This proves to be not a purely mathematical discipline. Probability theory deals with abstract objects—images of various classes of concrete objects—whereas experimental statistics deals with concrete objects alone. Both have to be taken into account. Quantum physics and classical statistical physics prove to be different aspects ofone probabilistic physics. The connection of quantum mechanics with classical statistical mechanics is examined and the origin of the (...) Schrödinger equation is elucidated. Attention is given to the true meaning of the wave-corpuscle duality, and the incompleteness of nonrelativistic quantum mechanics is explained. (shrink)

As the editor noted in the last number Freddie Ayer, or Professor Sir Alfred Ayer, played a considerable part in launching the vast enterprise of the Bentham edition. It is fitting, therefore, that something be said in Utilitas about his achievement as a philosopher and the extent to which he falls within the same broad empiricist and utilitarian tradition to which Bentham and J. S. Mill belonged.

The increasing demand for horticultural products for nutritional and economic purposes by lesser developed countries (LDC's) is well-documented. Technological demands of the LDC's producing horticultural products is also increasing. Pesticide use is an integral component of most agricultural production, yet chemicals are often supplied without supplemental information vital for their safe and efficient implementation. Illiteracy rates in developing countries are high, making pesticide education even more challenging. For women, who perform a significant share of agricultural tasks, illiteracy rates are even (...) higher than for men. The dilemma exists of how a developing country can improve its nutritional and economic situation without giving consideration to social and environmental consequences. (shrink)

The article is dedicated to the problem of the crisis in traditional educational relations and to the development of progressive educational relations at the level of the philosophy of life and the pedagogy of common concerns. The connecting nature of the relationship between teachers and their pupils and the development of creative abilities of children in a social life is discussed. Thus the author’s conception of Doctor of Pedagogical Sciences Igor Petrovich Ivanov is brought out in the current article.

My purpose in what follows is not so much to defend the basic principle of utilitarianism as to indicate the form of it which seems most promising as a basic moral and political position. I shall take the principle of utility as offering a criterion for two different sorts of evaluation: first, the merits of acts of government, social policies, and social institutions, and secondly, the ultimate moral evaluation of the actions of individuals. I do not take it as implying (...) that the individual should live his life on the basis of constant evaluations of this sort. For there are different levels of decision making each with its appropriate criteria. For example, we each inevitably make many of our decisions from the point of view of our own personal self-fulfilment and this cannot regularly take a directly utilitarian form, nor should the utilitarian want it to do so. His claim is at most that we should sometimes review our life from the point of view of a kind of impersonal moral truth of a universalistic utilitarian character. (shrink)

Some problems relating to the probabilistic description of a free particle and of a charged particle moving in an electromagnetic field are discussed. A critical analysis of the Klein-Gordon equation and of the Dirac equation is given. It is also shown that there is no connection between commutativity of operators for physical quantities and the existence of their joint probability. It is demonstrated that the Heisenberg uncertainty relation is not universal and explained why this is so. The emergence of macroscopic variables can be effected through coarse graining. Despite practical and fundamental benefits conveyed by this partitioning of state space, the apparently subjective nature of the selection of coarse grains has been considered problematic. We provide objective selection methods, deriving from the existence of relatively slow dynamical time scales. Using a framework for nonequilibrium statistical mechanics developed by us, we show the emergence of both spatial variables and order parameters. Although significant objective criteria are introduced in the (...) coarse graining, we do not provide a unique prescription. Most significantly, the grains, and by implication entropy, are only defined modulo a characteristic time scale of observation. (shrink)
