In jurisprudential circles the year 1981 might well be dubbed the year of Hans Kelsen, with no fewer than three symposia celebrating the hundredth anniversary of his birth. The Association for Legal and Social Philosophy in the United Kingdom held a conference on Kelsen in Edinburgh in April, giving special attention to “legal epistemology” in the Pure Theory of Law. A symposium of the Austrian Association for Legal and Social Philosophy, held in the Schloss Retzhof near Graz in May, (...) was devoted to Kelsen's political theory and critique of ideology. And the Hans Kelsen Institute in Vienna sponsored a symposium in September on Kelsen's posthumously published work, the Allgemeine Theorie der Normen. All three events were marked by significant international participation, and they point to continuing widespread interest in Kelsen and the Pure Theory of Law. (shrink)

Background: In order to improve ontology quality, tool- and language-related tutorials are not sufficient. Care must be taken to provide optimized curricula for teaching the representational language in the context of a semantically rich upper level ontology. The constraints provided by rigid top and upper level models assure that the ontologies built are not only logically consistent but also adequately represent the domain of discourse and align to explicitly outlined ontological principles. Finally such a curriculum must take into account the (...) pre-existing skills and knowledge of the target audience. -/- Objective: To develop a well-structured curriculum aligned to the particular requirements of life science professionals, in order to enable them to create logically sound, domain adequate and predicable ontologies using the Web Ontology Language (OWL) in Protégè. -/- Methods: Content selection for the curriculum was based on the literature, pre-existing tutorials, and a guideline for good ontology development (i.e ontology design enhancing domain adequacy, sustainability and interoperability) that drew on the authors previous experiences with large ontology development projects. Learning objectives were formulated according to a needs assessment of the targeted learners, who were students trained in life sciences with basic knowledge and practical skills in computer science. As instructional format we choose an approach with a high amount of practical exercises. The curriculum was first implemented with 24 Students and 7 lecturers/ tutors over 5 full days. The curriculum was evaluated by gathering the participants feedback via a questionnaire. -/- Results: Curricular development produced 16 modules of approximately 2 hours each, which covered basic principles of Applied Ontology, description logic syntax and semantics, as well as best design practices outlined in ontology design patterns and variants of the BioTop upper ontology. An opinion survey based on questionnaires indicated that the participants took advantage from the teaching strategies applied, as they indicated good knowledge gain and acknowledged the relevance of the modules. The difficulty was rated slightly lower. -/- Conclusion: The development of teaching material for principled ontology design and best practices is of crucial importance in order to enhance the quality of biomedical ontologies. Here, we present a curriculum for a week long workshop, leveraging on current educational principles, focusing on interactive hands-on exercises, group interactions, and problem-oriented learning. Whereas evaluation clearly showed the success of this approach, in particular regarding student’s satisfaction, the objective measurement of traceable effects on the quality of the generated ontology, although of much higher interest, has just started. The essay gives an account of the aesthetics of the Graz school, focusing on the standpoint of the object as well as on that of emotions. Meinong’s reflection on aesthetics stems from a psychological background and comes subsequently to an ontological grounding. After examining the notions of imagination, phantasy-representation, relation and complexion, I show how the theory of production of representations, as well as that of higher-order objects, develops under the impulse of Ehrenfels’ concept of Gestalt qualities; both these (...) theories may be applied to aesthetics in the explanation of artistic creation and of aesthetic objects. Meinong identifies the specific object of aesthetics with the “objective” and distinguishes aesthetic feelings, which are true feelings, from imaginary ones. Witasek develops a psychological aesthetics built on the conceptual framework of Meinongian philosophy: aesthetic properties are ideal and extra-objective, they connect the aesthetic object to the subject’s mental attitude; an aesthetic object is an object endowed with aesthetic properties, such as beauty, which depends on the degree of pleasure or displeasure the object may induce in the subject. Witasek, though, parts from Meinong on both the conception of aesthetic objects and of imaginary feelings. In the last sections, I review the reactions to Witasek’s aesthetics, both positive and negative, within the Graz school itself (in particular Schwarz’ and Saxinger’s ideas on phantasy-feelings, and Ameseder’s on value beauty), and I sketch Ehrenfels’ and Veber’s aesthetic views. The most obvious varieties of mental phenomena directed to non- existent objects occur in our experiences of works of art. The task of applying the Meinongian ontology of the non-existent to the working out of a theory of aesthetic phenomena was however carried out not by Meinong by his disciple Stephan Witasek in his Grundzüge der allgemeinen Ästhetik of 1904. Witasek shows in detail how our feelings undergo certain sorts of structural modifications when they are directed towards what does not (...) exist. He draws a distinction between genuine mental phenomena and what he calls `phantasy-material', asserting that `the job of the aesthetic object, whether it is a work of art or a product of nature, is to excite and support the actualisation of phantasy-material in the experiencing subject'. We might think of such phantasy-material as a matter of Ersatz-emotions or emotional `slop'. We could then see Witasek's aesthetics as an elaborate taxonomy of the various different sorts of Ersatz-emotions which the subject allows to be stimulated within himself in his intercourse with works of art, and see works of art themselves as machines for the production of ever more subtle varieties of such phantasy-material in the perceiving subject. Little consensus exists about the effectiveness of transnational private governance in domains such as labor, the environment, or human rights. The paper builds on recent scholarship on labor standards to emphasize the role of labor agency in transnational private governance. It argues that the relationship between transnational private regulatory initiatives and labor agency depends on three competences: first, the ability of workers’ organizations to gain access to processes of employment regulation, implementation, and monitoring; second, their ability to insist on the (...) inclusion of employers and state agencies within such processes; and third, the ability of workers to effectively exercise leverage in pursuit of particular goals. The paper develops a framework, called hybrid production regime, for examining how workers’ capacity to act at the local level depends on how these three collective competences are addressed in the institutionalization of capital–labor relations between the transnational and national levels. Sont réunies dans cet ouvrage six études des principaux représentants de ce qu’il est convenu d’appeler «l’école de Brentano». Les deux premières, publiées originellement en 1919 dans un ouvrage en hommage à Brentano, sont deux mémoires en souvenir du philosophe qui décrivent sa vie et son activité philosophique de ses débuts à Würzburg jusqu’à son couronnement à Vienne. Le premier est de Husserl qui décrit en détail l’enseignement qu’il a reçu de Brentano à Vienne et explique les raisons qui l’ont (...) amené à se distancier du maître. Carl Stumpf, le premier étudiant de Brentano, signe le deuxième dans lequel il fournit une description remarquablement riche et documentée de la vie et de l’enseignement de Brentano durant la période de Würzburg, et il est considéré, dans les études brentaniennes, comme une référence incontournable sur cette période. Les quatre autres études de cet ouvrage sont des contributions importantes des étudiants de Brentano à la philosophie. Nous publions pour la première fois en français l’étude classique de Christian von Ehrenfels «Sur les qualités de forme» que d’aucuns considèrent comme le texte fondateur de la psychologie de la forme. Cet article est aussi une référence incontournable pour Alexius Meinong et les membres de son école à Graz, et nous traduisons ici son article intitulé «Sur les objets d’ordre supérieur et leur rapport à la perception interne», dans lequel il conclut sa longue réflexion sur les qualités de forme et met en place les idées centrales de ce qu’il appellera quelques années plus tard la théorie de l’objet. On doit la cinquième étude au philosophe polonais Kazimierz Twardowski dans laquelle il propose une analyse originale de la relation entre les actes (fonctions) et leurs contenus (formations). Il s’agit d’une conférence prononcée à Vienne en 1914 sous le titre de «Fonctions et formations, quelques remarques aux confins de la psychologie, de la grammaire et de la logique» qui se veut une tentative de réponse à l’objection de psychologisme. Enfin, l’article d’Anton Marty «Sur le rapport entre la grammaire et la logique», publié en 1893, aborde un thème central dans les études brentaniennes et il est exemplaire des nombreux travaux de Marty dans le domaine de la philosophie du langage. Ces textes sont précédés d’une étude intitulée «Le legs de Brentano» dans laquelle nous présentons les grandes lignes du programme philosophique de Brentano, la généalogie de son «école» ainsi que quelques-uns des débats suscités par les textes reproduits dans cet ouvrage. Ces ouvrages sont, de plus, accompagnés d’une longue présentation rédigée par Courtine, dans laquelle il est question de l’état des travaux et de la recherche sur Meinong, du développement historique de la théorie de l’objet au sein (...) de l’École de Brentano de même que de ses présumés antécédents dans l’histoire de la philosophie. This book closely examines our commonly held beliefs about human suffering, and offers unique insights into God's role in why we suffer. The draft Code of Conduct for Research is an important initiative towards assisting the scientific community in complying with the provisions of the Protection of Personal Information Act 4 of 2013 (POPIA). However, its approach towards cross-border data sharing should be reconsidered to clarify the ambiguities inherent in the legal requirements for the cross-border sharing of health data in the POPIA. These ambiguities include the concept of ‘transfer of information’, the application of adequacy as a legal mechanism for transfer, the (...) nature of consent for cross-border sharing and the scope of the recipient third party. We suggest that the draft Code of Conduct for Research can be improved by: Explaining or defining the concept of ‘transfer of information’ and when it applies to cross-border sharing in research Clarifying the application of adequacy as a legal mechanism for transfer vis-à-vis the other alternatives Expanding on the interpretation and application of consent as a legal mechanism for cross-border transfers Expanding the category of persons who may be recipients of personal information in a third country. The genetic modification of pigs as a source of transplantable organs is one of several possible solutions to the chronic organ shortage. This paper describes existing ethical tensions in xenotransplantation (XTx) that argue against pursuing it. Recommendations for lifelong infectious disease surveillance and notification of close contacts of recipients are in tension with the rights of human research subjects. Parental/guardian consent for pediatric xenograft recipients is in tension with a child’s right to an open future. Individual consent to transplant is (...) in tension with public health threats that include zoonotic diseases. XTx amplifies concerns about justice in organ transplantation and could exacerbate existing inequities. The prevention of infectious disease in source animals is in tension with the best practices of animal care and animal welfare, requiring isolation, ethologically inappropriate housing, and invasive reproductive procedures that would severely impact the well-being of intelligent social creatures like pigs. Bundle theory takes objects to be bundles of properties. Some bundle theorists take objects to be bundles of instantiated universals, and some take objects to be bundles of tropes. Tropes are instances of properties: some take instantiated universals to be tropes, while others deny the existence of universals and take tropes to be ontologically fundamental. Historically, the bundling relation has been taken to be a primitive relation, not analyzable in terms of or ontologically reducible to some other relation, and has (...) been variously characterized as, e.g., “compresence,” “concurrence,” or “consubstantiation.” Bertrand Russell (1940) defends compresence of universals, and Hector-Neri Castañeda (1974) defends consubstantiation of universals. John Bacon (1995) defends concurrent tropes and Keith Campbell (1990) defends compresent tropes. Jonathan Schaffer (2001) bucks this trend, endorsing compresence understood as co-location in spacetime, but this brings with it undesireable consequences such as the impossibility of distinguishing between objects (such as electrons or other microentities) with the same location. Mereological bundle theory improves upon traditional bundle theory by taking the primitive relation of bundling to be the more familiar relation of fusing or composing, such that objects are fusions of properties or fusions of property instances. Hence, mereological bundle theorists endorse a property mereology: a mereology where properties or property instances can be parts of objects. An advantage of the approach derives from the fact that standard mereologies take composition to be primitive or define it using a different primitive mereological notion (such as primitive parthood). A substantial portion of Adam Smith's discussion of Stoicism in TMS VII is dedicated to the Stoic “principle of suicide,” according to which suicide is sometimes morally required. While scholars agree that Stoicism exercised considerable influence over Smith, no recent work has explored his views on suicide, despite the central role it plays in his treatment of Stoicism. I argue that Smith opposes the principle of suicide on both epistemic and moral grounds, providing an important critique of Stoicism. I also (...) show how Smith departs from other early modern accounts of suicide by offering a notably humane analysis of this tragic act. I conclude by considering what Smith's discussion of Stoicism and suicide tells us about his moral theory, and I forward a reading of Smith as a skeptic. (shrink)

The object of this paper is to show why recent research in the psychology of deductive and probabilistic reasoning does not have.

It is widely agreed among broadly Anselmian theists that God is in some sense the 'delimiter of possibilities.' In other words, the scope of possibility is explained by the manner in which the universe emanates from God. However, existing accounts of God's role here—in terms of freedom, choice, or power—face serious difficulties. The present paper provides a new account of God's role as the delimiter of possibilities in terms of the different manner in which the non-actuality of non-actual states of (...) affairs is explained. Intuitively and metaphorically, we can think of the menu of states of affairs being 'whittled down' in successive stages of a process of divine decision-making, with the different species of impossibility corresponding to when and how the states of affairs are ruled out. I argue that this approach provides genuine contingency while also preserving the Principle of Sufficient Reason. (shrink)
