“At-own-risk discharges” or “self-discharges” evidences an irretrievable breakdown in the patient–clinician relationship when patients leave care facilities before completion of medical treatment and against medical advice. Dissolution of the therapeutic relationship terminates the physician’s duty of care and professional liability with respect to care of the patient. Acquiescence of an at-own-risk discharge by the clinician is seen as respecting patient autonomy. The validity of such requests pivot on the assumptions that the patient is fully informed and competent to invoke an (...) at-own-risk discharge and that care up to the point of the at-own-risk discharge meets prevailing clinical standards. Palliative care’s use of a multidisciplinary team approach challenges both these assumptions. First by establishing multiple independent therapeutic relations between professionals in the multidisciplinary team and the patient who persists despite an at-own-risk discharge. These enduring therapeutic relationships negate the suggestion that no duty of care is owed the patient. Second, the continued employ of collusion, familial determinations, and the circumnavigation of direct patient involvement in family-centric societies compromises the patient’s decision-making capacity and raises questions as to the patient’s decision-making capacity and their ability to assume responsibility for the repercussions of invoking an at-own-risk discharge. With the validity of at-own-risk discharge request in question and the welfare and patient interest at stake, an alternative approach to assessing at-own-risk discharge requests are called for. The welfare model circumnavigates these concerns and preserves the patient’s welfare through the employ of a multidisciplinary team guided holistic appraisal of the patient’s specific situation that is informed by clinical and institutional standards and evidenced-based practice. The welfare model provides a robust decision-making framework for assessing the validity of at-own-risk discharge requests on a case-by-case basis. (shrink)

Since his death in the 1950s, most of the narratives of Harold Laski’s anti-imperialism have been mostly biographical rather than scholarly. Chroniclers and historians alike often found his genius and contribution amongst his protégés such as Krishna Menon, H.O. Davies, and other post-colonial leaders. In addition, explorations of his political theories paid little attention to his contributions to critiques on imperialism; in fact, his critics often interpreted Laski’s stand on imperialism as unoriginal. This chapter analyses two of Laski’s (...) works on imperialism: a 1932 chapter entitled ‘Nationalism and the Future of Civilisation’ and a 1933 chapter called ‘The Economic Foundations of Peace’. The first section of the chapter analyses his theory of sovereignty and his critique of the ideological ‘habits’ that condition liberal society. The second section contends that Laski’s theory of sovereignty resulted in his framing of imperialism within Leninist terms as a dialectical relationship between the habits of sovereignty and the habits of imperialism. The chapter suggests that Laski’s thinking on imperialism resembles less a truncated Leninism than it does a critical analysis of the way ideology can obscure domination and disciple subjects. It also reveals Laski’s contradictions due to his political activism and commitment to democracy. (shrink)

Small and medium-sized firms form 90% of the worldwide population of businesses. However, it has been argued that given their smaller scale of operations, resource access constraints and lower visibility, smaller firms are less likely to participate in Corporate Social Responsibility (CSR) initiatives. This article examines the different economic motivations of firms with varying combinations of visibility, resource access and scale of operations. Arguments are presented to propose that in terms of visibility, resource access and operating scale, very small and (...) very large firms are equally motivated to participate in CSR. However, the motivational bases for CSR participation are likely to be different. Medium-sized firms are the least motivated. This suggests a U-shaped relationship between firm size and CSR participation. This study contributes towards resolution of the long-standing debate on the effects of firm size on CSR participation, and highlights the importance of considering configurations of firm characteristics in the study of CSR outcomes. In conclusion, cautions are raised against the broad categorization of firms, without adequate attention to the underlying dimensions of such categorizations. (shrink)

Robustness arguments hold that hypotheses are more likely to be true when they are confirmed by diverse kinds of evidence. Robustness arguments require the confirming evidence to be independent. We identify two kinds of independence appealed to in robustness arguments: ontic independence —when the multiple lines of evidence depend on different materials, assumptions, or theories—and probabilistic independence. Many assume that OI is sufficient for a robustness argument to be warranted. However, we argue that, as typically construed, OI is not a (...) sufficient independence condition for warranting robustness arguments. We show that OI evidence can collectively confirm a hypothesis to a lower degree than individual lines of evidence, contrary to the standard assumption undergirding usual robustness arguments. We employ Bayesian networks to represent the ideal empirical scenario for a robustness argument and a variety of ways in which empirical scenarios can fall short of this ideal. (shrink)

The value-free ideal for science holds that values should not influence the core features of scientific reasoning. We defend the difference-to-inference model of value-permeation, which holds that value-permeation in science is problematic when values make a difference to the inferences made about a hypothesis. This view of value-permeation is superior to existing views, and it suggests a corresponding maxim—namely, that scientists should strive to eliminate differences to inference. In Āryadevapāda’s Skhalitapramathanayuktihetusiddhi we find a problematic passage in which some Cārvāka theories are expounded. The problem here lies in the fact that, according to Āryadevapāda, the Cārvākas—who did not admit rebirth—would have upheld that happiness in this life can be gained by worshipping gods and defeating demons. As the Cārvākas were materialists, the reference to gods and demons does not fit so much with their philosophical perspective. In this paper, by taking into account several passages from Pāli and Sanskrit (...) Buddhist sources, I have tried to demonstrate that Āryadevapāda is here probably following the Laṅkāvatārasūtra, where mention is made of some Lokāyatikas who are said to have been able to infatuate gods and demons. In both the Pāli Canon and the Mahāyāna sūtras, however, the term lokāyata does not refer to “materialism”. It rather conveys the meaning of “art of disputation”, and is generally used in the description of brāhmaṇas well versed in the Vedas, in the recitation of mantras and in dialectic methods in general. It is the Laṅkāvatārasūtra that introduces the idea—corroborated also by a passage from the Mahābhārata—that these brāhmaṇas, skilled in lokāyata, would have indulged in some materialistic tenet. When the two terms, Cārvāka and Lokāyata, came both to mean “materialism”, around the IV century CE, it is highly probable that non-Cārvāka thinkers and commentators—as could be the case of Āryadevapāda—had in some occasion assimilated and integrated certain points of view, originally belonging to the ancient lokāyata perspective (for instance, the references to gods and demons), into what they believed Cārvāka philosophy had to be. Application of sedation at the end of life has been fraught with ethical and clinical concerns, primarily focused on its potential to hasten death. However, in the face of clinical data that assuage most of these concerns, a new threat to this treatment of last resort has arisen. Concern now pivots on its effects on the personhood of the patient, underpinned by the manner in which personhood has been conceptualised. For many authors, it is consciousness that is seen to be (...) the seat of personhood, thus its loss is seen to rob a patient of their moral and ethical worth, leaving them in a state that cannot ethically be differentiated from death. Here I proffer a clinically based alternative to this view, the Ring Theory of Personhood, which dispels these concerns about sedation at the end of life. The Ring Theory envisages personhood as a coadunation of three domains of concern: the innate, the individual and the relational elements of personhood. The innate element of personhood is held to be present among all humans by virtue of their links with the Divine and or their human characteristics. The individual elements of personhood pivot on the presence of consciousness-dependent features such as self-awareness, self-determination and personality traits. The relational component of personhood envisages an individual as being ‘socially embedded’ replete with social and familial ties. It is these three equally important inter-related domains that define personhood. (shrink)

Founding and developing a business today is indeed more and more an exercise that must hold together in a harmonious and complementary way a vision and a practice. An idea, with its load of aspirations, intuitions and desires, and an operative strategy, aiming at defining options, choosing timing, and developing suitable products and services. In other words, running a business is today more than ever before an exercise of sense, of excellent sense, in fact. Technologies for deriving human neurons in vitro have transformed our ability to study cellular and molecular components of human neurotransmission. Three groups, including our own, have recently published methods for efficiently generating human serotonergic neurons in vitro. Remarkably, serotonergic neurons derived from each method robustly produce serotonin, express raphe genes, are electrically active, and respond to selective serotonin reuptake inhibitors in vitro. Two of the methods utilize transdifferentiation technology by overexpressing key serotonergic transcription factors. The third and most recent method (...) involves differentiating induced pluripotent stem cells (iPSCs) to serotonergic neurons using developmental patterning cues. In this mini‐review, we briefly describe the developmental programs governing serotonergic specification in vivo and how they have been harnessed to achieve serotonergic differentiation in vitro. Gandhi’s writings on moral issues propose an easiest formula to the world to establish harmony and peace in the global society. In a world where people are confronting a psychological fear of sudden terror and violence, the Gandhian formula of ‘non-violence (ahimsa) as a means’ to form a perfect harmonious world is getting strong attention of the world-community. Truth and non-violence are the two most valuable ingredients of Gandhian moral thoughts. For him, Truth or God is the end and non-violence (...) is the mean and the two can not be separated. They are more effective in life when they are used in their united form. This unity can be actualized only through the motive of ‘love to humanity’ without separating one person from another on any ground. He argues that the unity of truth and non-violence is a better way to have a moral and harmonious life. In this paper, I will focus upon the Gandhian formula in wider perspective, which reflects in his political activities and his writings as well, with the contention that it is highly applicable to normalize the violence rooted in different parts of the world at both the levels of religious and political. I will contend that Gandhian notion of truth and non-violence in terms of ends and means may play a medicinal role to harmonize the world suffering from extremism and terrorism. (shrink)

Noncommutative geometries generalize standard smooth geometries, parametrizing the noncommutativity of dimensions with a fundamental quantity with the dimensions of area. The question arises then of whether the concept of a region smaller than the scale—and ultimately the concept of a point—makes sense in such a theory. We argue that it does not, in two interrelated ways. In the context of Connes’ spectral triple approach, we show that arbitrarily small regions are not definable in the formal sense. While in the scalar (...) field Moyal–Weyl approach, we show that they cannot be given an operational definition. We conclude that points do not exist in such geometries. We therefore investigate (a) the metaphysics of such a geometry, and (b) how the appearance of smooth manifold might be recovered as an approximation to a fundamental noncommutative geometry. Familial determination, replete with its frequent usurping of patient autonomy, propagation of collusion, and circumnavigation of direct patient involvement in their own care deliberations, continues to impact clinical practice in many Asian nations. Suggestions that underpinning this practice, in Confucian-inspired societies, is the adherence of the populace to the familial centric ideas of personhood espoused by Confucian ethics, provide a novel means of understanding and improving patient-centred care at the end of life. Clinical experience in Confucian-inspired Singapore, however, suggests that (...) personhood is conceived in broader terms. This diverging view inspired a study of local conceptions of personhood and scrutiny of the influence of the family upon it. From the data gathered, a culturally appropriate, clinically relevant and ethically sensitive concept of personhood was proposed: the Ring Theory of Personhood that better captures the nuances of local conceptions of personhood. The Ring Theory highlights the fact that, far from being solely dependent upon familial centric ideals, local conceptions of personhood are dynamic, context dependent, evolving ideas delineated by four dimensions. Using the Ring Theory, the nature of familial influences upon the four dimensions of personhood – the Innate, Individual, Relational and Societal – are examined to reveal that, contrary to perceived knowledge, conceptions of personhood within Confucian societies are not the prime reason for the continued presence of this decision-making model but remain present within local thinking and practices as a sociocultural residue and primarily because of inertia in updating ideas. The Trika school, which is popularly known as Pratyabhijñā-darśana or Kashmir Śaivism is an absolutist and theistic school of Śaivism in the 9th Century. For the Trika school, the self is synonymous with pure consciousness, equated with Śiva. The path elaborated by the school is from self-ignorance to the realisation of pure consciousness. The Trika philosophy strives to answer two fundamental and interrelated questions. Firstly, understanding oneself as a reduced form of Śiva? Secondly, how does an individual attain “Śivatva”? In (...) this study, we explicate answers to these queries by resorting to the metaphysics of the Trika school along with interpretative textual analysis and present a model proposed by Bhoja Raja based on the three guṇas. Euro-American misrepresentations of the non-West in general, and in particular on Hinduism and ancient India, run deep and have far greater colonial connections than that have been exposed in academia. This book analyzes the psycho-social consequences that Indian American children face after they are exposed to the school textbook discourse on Hinduism and ancient India. The authors show that there is an intimate connection—an almost exact correspondence—between James Mill’s colonial-racist discourse and the current school-textbook discourse. The very parameters and coordinates (...) on which James Mill constructed the discourse are the ones that are being used to describe Hinduism, Hindus, and ancient India in the textbooks currently. Consequently, this archaic and racist discourse, camouflaged under the cover of political correctness, produces in the Indian American children a psychological impact quite similar to what racism is known to produce: shame, inferiority, embarrassment, identity confusion, assimilation, and a phenomenon similar to racelessness where the children dissociate from the tradition and culture of their ancestors. This book argues that the current school textbook discourse on Hinduism and India needs to change so that the Indian American children do not become victims of overt and covert racism. For the change to occur, the first step is to recognize the overarching and pervasive influence of the colonial-racist discourse of James Mill on the textbooks. For the reconstruction of the discourse to take place, the first step is to engage in a through deconstruction, which is what the book attempts. (shrink)

This volume presents a critical study of the work, providing a comprehensive picture of the life and thought of the time of Somadeva. The book discusses various philosophical doctrines in Indian thought. It throws light on Jaina dogmatics, religious poetry, moral and religious stories, and myths and legends in the process of examining the work. Efforts to encourage universal access to information and communication technologies have run into the problem that some individuals, for reasons of affordability, lack of awareness or preference, continue to be without subscriptions. This article examines the arguments commonly put forward in support of promoting broadband access, to determine whether they can justify universalizing access. It examines the ethical limits of government actions that encourage, enforce or coerce participation in socially beneficial programmes, while potentially overlooking consumer sovereignty and human autonomy.
