A separatist conflict has been ongoing in India-administered Kashmir since 1989. Focusing on this region, this book critiques the existing normative theories of secession, and offers a comprehensive examination of the right of sub-groups to secede. The book looks at the different accounts of the moral right to secede, and assesses both the theories themselves as well as the claims of those who want to separate Kashmir from India. Included within this analysis are the three main types of (...) normative theory that ground the right of groups to secede in principles of national self: determination, consensual governance and rectificatory justice. Previous studies have discussed the causes behind the uprising in Kashmir against Indian authority and examined some of the legal and geo-political implications of the conflict for India and the wider region. This book provides a new way of looking at the Kashmir dispute, by asking what these theories tell us about Kashmir, and in turn what the example of Kashmir allows us to learn about these theories. India and Pakistan has fought four wars over Kashmir and hasheld rounds of talks without resolving the 72-year-old issue. The Indiangovernment’s revocation of the special status of Kashmir sets the stage for newclashes in the disputed region. Currently, the conflict has assumedpurely the religious colour: India aiming at integrating Kashmir into the Hindupolity and Pakistan claiming Kashmir for its having a Muslim majority. This paper examines the neo-colonial project of Narendra Modi implemented in Kashmir after the revocation of special status on August 5, 2019. The neo-colonial infrastructure supported by the threads of re-classification of legal residents and land designations intends to significantly transform the demography of Muslim majority Kashmir into a Muslim minority, consequently destroying the Muslim identity of the state. The abrogation of Article 370 and enactment of new domicile law has extended the legal and administrative control of New (...) Delhi, making Kashmir indistinguishable from the Indian legal system and leaving no room for the local legislative assembly to make laws beneficial for the state residents. The paper asks how India is implementing the neo-colonial settler agenda in Kashmir. How and to what extent legal and military instruments are employed to disempower Kashmiris from territorial and cultural identity? The paper argues that Prime Minister Narendra Modi is pursuing a neo-colonial settler agenda in Kashmir through ‘destroy and replace,’ which is supported by the neo-liberal agenda, including; new land management policy, new domicile law, spatial planning and development, new settlements of Hindus, authoritative central control, and massive militarization to carry out gross human rights abuses and repression. The Kashmir issue, a principal reason for rivalry between India and Pakistan, has become the atomic flashpoint and a constant threat to the security of South Asia. The aim of this paper is to highlight the root causes of Kashmir disputes and the major events that contributed towards the Indo-Pak rivalry with respect to Kashmir. The paper highlights present political conditions in the Indian-held Kashmir also shows the role of India, Pakistan, and the United Nations in (...) Kashmir Dispute. Were the perpetrators of the 9/11 attacks courageous "freedom fighters" or despicable terrorist murderers? These opposing characterizations reveal in extreme form the incompatibility between different moral visions that underlie many conflicts in the world today, conflicts that challenge us to consider how moral disputes may be resolved. Eschewing the resort to universal moral principles favored by traditional Anglo-American analytic philosophy, Joseph Margolis sets out to sketch an alternative approach that accepts the lack of any neutral ground or privileged normative perspective (...) for deciding moral disputes.This "second-best" morality nevertheless aspires to achieve an "objectively" valid resolution through a dialectical procedure of reasoning toward a _modus vivendi_, an accommodation of prudential interests that are rooted in the customs and practices of the societies in conflict. In working out this approach, Margolis engages with a wide range of thinkers, from Plato, Aristotle, Kant, and Hegel through Nietzsche, Heidegger, Levinas, Rawls, Habermas, MacIntyre, Rorty, and Nussbaum, and his argument is enlivened by reference to many specific moral issues, such as abortion, the control of Kashmir, and the continuing struggle between the Muslim world and the West. The philosophical interest of verbal disputes is twofold. First, they play a key role in philosophical method. Many philosophical disagreements are at least partly verbal, and almost every philosophical dispute has been diagnosed as verbal at some point. Here we can see the diagnosis of verbal disputes as a tool for philosophical progress. Second, they are interesting as a subject matter for first-order philosophy. Reflection on the existence and nature of verbal disputes can reveal something about the nature of (...) concepts, language, and meaning. In this article I first characterize verbal disputes, spell out a method for isolating and resolving them, and draw out conclusions for philosophical methodology. I then use the framework to draw out consequences in first-order philosophy. In particular, I argue that the analysis of verbal disputes can be used to support the existence of a distinctive sort of primitive concept and that it can be used to reconstruct a version of an analytic/synthetic distinction, where both are characterized in dialectical terms alone. This paper studies the conflict between critical rationalism and critical theory in Karl Popper and Theodor Adorno’s 1961 debate by analyzing their shared rejection of Karl Mannheim’s sociology of knowledge. Despite the divergences in their respective projects of critical social research, Popper and Adorno agree that Mannheim’s sociology of knowledge is uncritical. By investigating their respective assessments of this research program I reveal a deeper similarity between critical rationalism and critical theory. Though both agree on the importance of critique, they (...) are less concerned with the development of critical consciousness as a focus of this project. In this way, Mannheim’s sociology of knowledge, particularly in its formative stages, revolves around a set of problems relatively inaccessible to critical rationalism and critical theory, since it is centrally concerned with identifying and cultivating the possibility of critique in society. In closing, I gesture to the importance of political education in Mannheim’s early work, suggesting that a return to these experimental texts will yield resources for political thought today. Francisco Suárez (1548-1617) was one of the most important philosophers and theologians of Early Modern Scholasticism. Although Suárez spent most of his academic career as a professor of theology, he is better known today for his Metaphysical Disputations (Salamanca, 1597). The present volume contains a facing-page English translation of Metaphysical Disputations III & IV. Metaphysical Disputation III offers a general treatment of the properties of being as such, while Metaphysical Disputation IV deals with one of these properties in particular, transcendental (...) unity. The Latin text contained in this volume introduces a significant number of corrections to the text of the Vivès edition, the one standardly used by scholars of Suárez, and thus more faithfully reproduces the text of the first edition. The member states of the United Nations General Assembly in 2005 unanimously adopted the resolution on Responsibility to Protect to save citizens from genocide, war crimes, ethnic cleansing, and crimes against humanity. Since adoption, the norm has been invoked in Libya, South Sudan, Yemen, and Syria, nonetheless, the UN refrains to respond to the genocide committed in the Jammu & Kashmir and triggering a greater sense of anxiety. In this context, the present paper elucidates the factors behind the UN (...) failure. It asks why the UN failed to call R2P despite systematic crimes against humanity in Kashmir. What factors or forces preclude the UN to invoke R2P? The paper argues that the inability of the UN to invoke R2P is a consequence of systemic and domestic factors. The Indo-US strategic partnership, materialism, and New Delhi’s influence in the international system are obstructing the UN’s ability to play a decisive role. Meanwhile, the economic and military potential of India and its regional influence forbid the international community to dissuade India not to commit genocide in Jammu & Kashmir. So the high politics of materialism and national interests override the norm of human rights and humanity. (shrink)

In this paper we introduce the device perspective as a methodological contribution to platform studies. Through an engagement with debates about the notion of affordances, which focus on the relation between the technical and the social, we put forward an approach to study the production of data within platforms by engaging with the material properties of platforms as well as their interpretation and deployment by various types of users. As a case in point, we study how the affordances of Wikipedia (...) are deployed in the production of encyclopedic knowledge and how this can be used to study controversies. The analysis shows how Wikipedia affords unstable encyclopedic knowledge by having mechanisms in place that suggest the continuous negotiation of existing knowledge. We furthermore showcase the use of our open-source software, Contropedia, which can be utilized to study knowledge production on Wikipedia. (shrink)

Here the relationship between understanding and knowledge of meaning is discussed from two different perspectives: that of Dummettian semantic anti-realism and that of the semantic externalism of Putnam and others. The question addressed is whether or not the truth of semantic externalism would undermine a central premise in one of Dummetts key arguments for anti-realism, insofar as Dummetts premise involves an assumption about the transparency of meaning and semantic externalism is often taken to undermine such transparency. Several notions of transparency (...) and conveyability of meaning are distinguished and it is argued that, though the Dummettian argument for anti-realism presupposes only a weak connection between knowledge of meaning and understanding, even this much is not trivially true in light of semantic externalism, and that semantic externalism, if true, would thus represent a reason for rejecting the crucial assumption on which the Dummettian argument depends. This article addresses the moral and legal difficulties sport governing bodies encounter as human rights promoters. The case presented here is the 2023 decision by the International Olympic Committee (IOC) to allow athletes from Russia and Belarus to compete in international sport under neutral colours, after recommending complete exclusion a year before due to the Russian invasion of Ukraine. While IOC’s change of mind was influenced by UN experts on human rights, claiming that the ban discriminated against Russian athletes, the (...) same experts fail to take into account competing human rights elements that could favour the ban. To that end, this article discusses the complexities of prioritizing human rights in an Olympic context and, deriving from that, demonstrates the existence of moral and legal support for upholding the exclusion of Russia. Finally, the analysis of how to prioritize morally and legally between competing human rights offers deliberative material to other sport governing bodies which could be used to carve out preventive measures prior to their next encounter with a similar situation. I argue that Ireneusz Ziemiński doesn't justify his skepticism about knowledge of existence of God. First, he reduces a question to metaphysical one - do we have sound, valid proofs of God's existence and imposes too heavy conditions on arguments for God. Second, he doesn't show that disagreement between philosophers in that question justify his negative assessment of arguments. Third, Ziemiński omits epistemological question what is knowledge of God's existence, especially in its direct form as well as externalistic account's of (...) knowledge of God, for example Plantinga's and Alston's. John Earman's recent proposal that a substantive version of general covariance consists in the requirement that diffeomorphism invariance be a gauge symmetry is critically assessed. I argue that such a principle does not serve to differentiate general relativity from pre-relativistic theories. A model-theoretic characterization of two formulations of specially-relativistic theories is suggested. Diffeomorphisms are symmetries of only one such style of formulation and, I argue, Earman's proposal does not provide a reason to deny diffeomorphisms the status of gauge transformations relative (...) to this formulation. Carlo Rovelli's distinction between "passive" and "active" diffeomorphism invariance is also clarified. (shrink)

Preti?s thought appears as a systematic thought permitting to overcome, through his logical, epistemological and linguistic reflection, the divide between these two approaches. The different features of his philosophy are analyzed here in detail and compared to the main theoretical assumptions of Analytic and Continental philosophy.

This paper examines the concept of manifestation process in Kashmir Shaivism from Shiva tattva to Prithvi tattva and their transcendental and immanent predicates (Prakrti and Purusa).This paper also shows that the ultimate reality, Paramshiva, manifests itself into various forms which likely represent the theory of causation. This research paper also provides answer to two questions; First, how ultimate reality with its thirty-six principles or elements manifest in various forms and what types of forms ‘Descent’ attains from the ‘universal self’? (...) Second, how manifestation process takes place from the ‘cosmic self’ (universal consciousness) to a ‘limited self’ (Jiva)? Since, this paper is based on philosophical exploration of manifestation process and contains interpretation and argumentation of Pratyabhijna philosophy only; it excludes manifestation due to Yogas (Upayas) and Karmas. Moreover, it explains the Trika form of reality (Shiva/God, Shakti/World, and Nara/Man) and also the identity between ‘ascent’ and ‘descent’. Manifestation further investigates the union of Shiva and Shakti with Maya and displays its character (Prakashvimarshmaya). This work further tries to describe the contribution of Abhinavagupta in the concept of manifestation. (shrink)

Changing concepts comes with a risk of creating merely verbal disputes. Accounts of topic continuity (such as Herman Cappelen’s) are supposed to solve this problem. As this paper shows, however, no existing solution avoids the danger of mere verbalness. On the contrary, accounts of topic continuity in fact increase the danger of overlooking merely verbal disputes between pre- and post-ameliorators. Ultimately, this paper suggests accepting the danger of mere verbalness resulting from a change in topic as a downside of conceptual (...) engineering. Changing the topic under discussion may be worth the risk, however, in many cases. In fact, this paper proposes that the main goal of conceptual engineering should be seen as changing topics for the better. (shrink)

India was under British colonial rule for a good number of years with her plural ethno-religious background and identity, which was to become the basis of an unending conflict. Several pre-colonial and post-colonial conditioning antecedents have been marshalled to buttress the premise leading to the conclusion that the British colonial era laid the time bomb along ethno-religious contours which exploded in 1947 thereby giving rise to the balkanisation of India into two separate states, that is India and Pakistan. Two major (...) religious groups that is Hindus and Muslims became the gladiators in India’s partition. The Kashmir region of India, a town of religious confluence, has a history of conflicts that is perceived by different people as politico-religious and socio-economic. This article focuses on religion as a core tenet of every cultural worldview and its significance to both Hindus and Muslims, and how it has become the progressively vital central marker of identity and a smouldering keg of gun powder for conflict in Kashmir. Furthermore, this article contends that religion plays a key role in the conflict between Hindus and Muslims in Kashmir because of its significance and influence on both religions. India that is known as a mother to various religions cannot relegate the primary role of religion in their political and socio-economic affairs. Therefore, it is right to acknowledge politico-religious and socio-economic factors in the Hindu–Muslim conflict in the state of Kashmir. And, it will not be wrong to affirm that religion plays a key role in the conflict between Hindus and Muslims in Kashmir.Contribution: The article is a contribution in religious issues in India. It reveals how political power and sociopolitical antecedents are mostly recognised by religious scholars and historians as the reason for the fracas between Hindus and Muslims. The controversy of neuroanatomy on the principal structure of the nervous systems, which took place at the end of the nineteenth century, is described. Two groups of scientists are identified: one that favoured the idea of a discrete cellular organization of the nervous tissue, and one that favoured a syncytial organization. These two interpretations arose from different histological techniques that produced conflicting pictures of the organization of the nervous tissue. In an experimental reexamination of the techniques used at the end (...) of the nineteenth century, the present study concerns the impact of these different histological procedures on the controversy about the principle nature of the nervous tissue. This controversy could not be resolved by neuroanatomy itself until the 1950s when electron microscopy was introduced into neurobiology. Thus, in a critical period of the conceptual development of neurosciences, neuroanatomy failed to establish a proper base for an interpretation of the functional morphology of nervous tissues. In his Treatise of Human Nature, Hume offers two definitions of ‘cause’. The first is framed in terms of the precedence and contiguity of objects. The second also mentions precedence and contiguity of objects but speaks also of the mind’s tendency on the appearance of the first object to form the idea of the second. Scholars disagree as to which constitutes Hume’s definition of cause properly speaking. Some hold that the ‘constant conjunction of objects’ version is Hume’s real definition, while (...) others opt for the second, psychological version. I argue that Hume’s method of analysis holds that we explicate the meaning of words by tracing ideas back to their antecedent impressions. Since there are two different sets of antecedent impressions, one consisting of preceding and continuous objects and the other of such objects plus psychological determination, we must attribute to Hume the existence of two non-equivalent definitions of the term. Je développe une objection à la distinction entre conflits verbaux et factuels, dérivée des objections à la distinction analytique/synthétique. J’explique ensuite de quoi se compose le scepticisme qui en résulte. En définitive, ces sceptiques devraient reconnaître la différence entre conflits verbaux et factuels, mais pensent que certaines tâches philosophiques ne peuvent être performées.

Para ello, fueron analizadas, fichadas y discutidas múltiples fuentes de información, seleccionándose los planteamientos más expresivos de la racionalidad teórica desde la cual el paisaje es concebido. Se encontró que, habiendo nacido el paisaje de la pintura de la Edad Media, hoy día es estudiado como representación artística por la estética, como geosistema por la geografía, como ecosistema por la ecología y como apropiación subjetiva del (...) territorio por la sociología, la antropología y la semiótica. Pero la experiencia paisajística contemplativa realizada predominantemente bajo formas estéticas no es una perspectiva suficientemente atendida a pesar de que, junto con la representación artística del paisaje, constituye la perspectiva más fidedigna del concepto de paisaje.: The objective is to describe different landscape approaches. To carry this out, multiple information sources were analysed, recorded and discussed, selecting the most expressive approaches of the theoretical rationality from which the landscape is conceived. It was found that having the painting landscape born in the Middle Ages, it is studied today by aesthetics as an artistic representation, as a geosystem by geography, as an ecosystem by ecology and as a subjective appropriation of the territory by sociology, anthropology and semiotics. However, the contemplative landscape experience was predominantly carried out under aesthetic form, but it is not a perspective sufficiently attended. Alongside with the artistic representation of the landscape, constitutes the most reliable perspective of the landscape concept. (shrink)
