The Kashmir issue, a principal reason for rivalry between India and Pakistan, has become the atomic flashpoint and a constant threat to the security of South Asia. The aim of this paper is to highlight the root causes of Kashmir disputes and the major events that contributed towards the Indo-Pak rivalry with respect to Kashmir. The paper highlights present political conditions in the Indian-held Kashmir also shows the role of India, Pakistan, and the United Nations in Kashmir Dispute. Islamic equity funds are subject to the screening criteria for stock selection imposed by the principles of Islamic jurisprudence. Equities must pass three basic screens: revenue source, business activity, and financial factors to be included in an Islamic fund. However, screening criteria are not universal especially for the financial factors. One can use financial ratios based on either the book-value of total assets or the market-value of equity for screening of stocks. This may not only result in a different portfolio (...) composition but also entail diverse rebalancing and monitoring costs. The performance of 29 Islamic equity indices versus conventional indices from four major international index providers using different Shari’ah screening criteria are analyzed in a single as well as in a multi-equation framework. The use of a multi-equation framework has the added advantage of utilizing the information content of different screening criteria adopted by different index providers. The empirical findings suggest that the difference in screening criteria does not significantly affect the performance of IEIs. Returns deviation, if any, stems from the relative riskiness of the IEI as compared with the relevant benchmark. Work needs to done to streamline the quantitative screening criteria to avoid confusion among the investing public. (shrink)

In this paper, we critically consider the analogy between “infodemic” and “pandemic”, i.e. the spread of fake news about COVID-19 as a medial virus and the infection with the biological virus itself from the perspective of cultural evolutionary theory (CET). After confronting three major shortcomings of the ‘infodemic’ concept, we use CET as a background framework to analyze this phenomenon. To do so, we summarize which bi-ases are crucial for transmission in terms of cultural selection and how transmission is restricted (...) by filter bubbles or echo chambers acting as TRIMS (transmission isolating mechanisms) post “infection”, which isolate false from trustworthy scientific information in the context of the Corona pandemic. This is followed by a demonstration of the threat to biological fitness posed by the effects of an infection with fake news, which leads to a reduced willingness to vaccinate and follow health measures. We identify fake news on Covid as pseudoscience, trying to immunize itself from external influences. We then address the question of how to combat the infodemic. Since debunking strategies, such as warnings by fact-checking, have proven relatively ineffective in combating fake news, the inoculation theory from psychology might offer an alternative solution. Through its underlying ‘prebunking strategy’, which educates individuals about the risks and tactics of fake news prior to a potential infection, they could be ‘immunized’ in advance, similar to a virological vaccination. Although we recognize that the pandemic/infodemic analogy is in fact far from perfect, we believe that CET could provide a theoretical underpinning in order to give much more semantic depth to the concept ‘infodemic’. BackgroundObtaining informed consent for participation in genomic research in low-income settings presents specific ethical issues requiring attention. These include the challenges that arise when providing information about unfamiliar and technical research methods, the implications of complicated infrastructure and data sharing requirements, and the potential consequences of future research with samples and data. This study investigated researchers’ and participants’ parents’ experiences of a consent process and understandings of a genome-wide association study of malaria involving children aged five and under in Mali. (...) It aimed to inform best practices in recruiting participants into genomic research.MethodsA qualitative rapid ethical assessment was undertaken. Fifty-five semi-structured interviews were conducted with the parents of research participants. An additional nine semi-structured interviews were conducted with senior research scientists, research assistants and with a member of an ethics committee. A focus group with five parents of research participants and direct observations of four consent processes were also conducted. French and translated English transcripts were descriptively and thematically coded using OpenCode software.ResultsParticipants’ parents in the MalariaGEN study had differing understandings of the causes of malaria, the rationale for collecting blood samples, the purposes of the study and the kinds of information the study would generate. Genomic aspects of the research, including the gene/environment interaction underlying susceptibility or resistance to severe malaria, proved particularly challenging to explain and understand.ConclusionsThis study identifies a number of areas to be addressed in the design of consent processes for genomic research, some of which require careful ethical analysis. These include determining how much information should be provided about differing aspects of the research and how best to promote understandings of genomic research. We conclude that it is important to build capacity in the design and conduct of effective and appropriate consent processes for genomic research in low and middle-income settings. Additionally, consideration should be given to the role of review committees and community consultation activities in protecting the interests of participants in genomic research. (shrink)

Matti Häyry presents a new ethical theory that he calls “conflict-responsive need-based negative utilitarianism.”1 In this commentary, I present my critical observations on his main points against the more general background of utilitarianism and theories of value.

In recent decades, non-representational approaches to mental phenomena and cognition have been gaining traction in cognitive science and philosophy of mind. In these alternative approach, mental representations either lose their central status or, in its most radical form, are banned completely. While there is growing agreement that non-representational accounts may succeed in explaining some cognitive capacities, there is widespread skepticism about the possibility of giving non-representational accounts of cognitive capacities such as memory, imagination or abstract thought. In this paper, I (...) will critically examine the view that there are fundamental limitations to non-representational explanations of cognition. Rather than challenging these arguments on general grounds, I will examine a set of human cognitive capacities that are generally thought to fall outside the scope of non-representational accounts, i.e. numerical cognition. After criticizing standard representational accounts of numerical cognition for their lack of explanatory power, I will argue that a non-representational approach that is inspired by radical enactivism offers the best hope for developing a genuine naturalistic explanatory account for these cognitive capacities. This paper expands Rami Ali’s dissolution of the gamer’s dilemma (Ethics Inf Technol 17:267-274, 2015). Morgan Luck’s gamer’s dilemma (Ethics Inf Technol 11(1):31-36, 2009) rests on our having diverging intuition when considering virtual murder and virtual child molestation in video games. Virtual murder is seemingly permissible, when virtual child molestation is not and there is no obvious morally relevant difference between the two. Ali argues that virtual murder and virtual child molestation are equally permissible/impermissible when considered under different modes of (...) engagement. To this end, Ali distinguishes between story-telling gameplay and simulation games, discussing both in depth. I build on the dissolution by looking into competitive gameplay in order to consider what the morally relevant difference between virtual murder and virtual child molestation might be when competing in a video game. I argue that when competitors consent to participate in a competition, the rules of the competition supersede everyday moral intuitions. As such, virtual competitions ought to represent such consent from virtual characters. Virtual children cannot be represented as giving consent to be molested because (1) children cannot be represented as giving sexual consent, and (2) consent to be possibly molested cannot be given. This creates a morally relevant difference between murder and molestation. By fully addressing competitive gameplay, I answer Luck’s worry that Ali’s dissolution is incomplete (Ethics Inf Technol 20:157-162, 2018). (shrink)

We claim that, as it stands, the Deutsch–Wallace–Everett approach to quantum theory is conceptually incoherent. This charge is based upon the approach’s reliance upon decoherence arguments that conflict with its own fundamental precepts regarding probabilistic reasoning in two respects. This conceptual conflict obtains even if the decoherence arguments deployed are aimed merely towards the establishment of certain ‘emergent’ or ‘robust’ structures within the wave function: To be relevant to physical science notions such as robustness must be empirically grounded, and, on (...) our analysis, this grounding can only plausibly be done in precisely the probabilistic terms that lead to conceptual conflict. Thus, the incoherence problems presented necessitate either the provision of a new, non-probabilistic empirical grounding for the notions of robustness and emergence in the context of decoherence, or the abandonment of the Deutsch–Wallace–Everett programme for quantum theory. Embodied and extended cognition is a relatively new paradigm within cognitive science that challenges the basic tenet of classical cognitive science, viz. cognition consists in building and manipulating internal representations. Some of the pioneers of embodied cognitive science have claimed that this new way of conceptualizing cognition puts pressure on epistemological and ontological realism. In this paper I will argue that such anti-realist conclusions do not follow from the basic assumptions of radical embodied cognitive science. This article aims to study the intersection between critical realism and complexity theories through the existing literature on complex systems via an engagement with Luhmann’s autopoiesis. With reference to the philosophies of substance and persistence, I build on previous critical realist scholarship and provide an explanation for what the literature has only noted as the limitations and potentials of autopoiesis for complex systems thinking and its compatibility with Critical Realism. By highlighting how Luhmann’s autopoiesis is not a trans-immanent/ perdurantist-exdurantist system, (...) I show first how a trans immanent system through the method of calibration entails a complex causation involving objects in the environment of systems and not just within their boundaries. Second, I explain how a trans-immanent system fits with CR via the Morphogenetic Régulation framework by exploring the theme of crisis in terms of the movement from inadequate to adequate understanding of objects. The professions have focused considerable attention on developing codes of conduct. Despite their efforts there is considerable controversy regarding the propriety of professional codes of ethics. Many provisions of professional codes seem to exacerbate disputes between the profession and the public rather than providing a framework that satisfies the public''s desire for moral behavior.After examining three professional codes, we divide the provisions of professional codes into those provisions which urge professionals to avoid moral hazard, maintain professional courtesy and serve the (...) public interest. We note that whereas provisions urging the avoidance of moral hazard are uncontroversial, the public is suspicious of provisions protecting professional courtesy. Public interest provisions are controversial when the public and the profession disagree as to what is in the public interest. Based on these observations, we conclude with recommendations regarding the content of professional codes. (shrink)

A small but growing number of studies have aimed to understand, assess and reduce existential risks, or risks that threaten the continued existence of mankind. However, most attention has been focused on known and tangible risks. This paper proposes a heuristic for reducing the risk of black swan extinction events. These events are, as the name suggests, stochastic and unforeseen when they happen. Decision theory based on a fixed model of possible outcomes cannot properly deal with this kind of event. (...) Neither can probabilistic risk analysis. This paper will argue that the approach that is referred to as engineering safety could be applied to reducing the risk from black swan extinction events. It will also propose a conceptual sketch of how such a strategy may be implemented: isolated, self-sufficient, and continuously manned underground refuges. Some characteristics of such refuges are also described, in particular the psychosocial aspects. Furthermore, it is argued that this implementation of the engineering safety strategy safety barriers would be effective and plausible and could reduce the risk of an extinction event in a wide range of possible scenarios. Considering the staggering opportunity cost of an existential catastrophe, such strategies ought to be explored more vigorously. (shrink)

Econophysics is a new and exciting cross-disciplinary research field that applies models and modelling techniques from statistical physics to economic systems. It is not, however, without its critics: prominent figures in more mainstream economic theory have criticized some elements of the methodology of econophysics. One of the main lines of criticism concerns the nature of the modelling assumptions and idealizations involved, and a particular target are ‘kinetic exchange’ approaches used to model the emergence of inequality within the distribution of individual (...) monetary income. This article will consider such models in detail, and assess the warrant of the criticisms drawing upon the philosophical literature on modelling and idealization. This article re-examines the distinction between the libertarian approach and the egalitarian approach to the regulation of campaign finance. The conventional approach (as exemplified by the work of Owen Fiss and Ronald Dworkin) is to reconcile the competing values of liberty and equality. By contrast, this article advances the normative claim that democracies should seek to incorporate both the libertarian and the egalitarian approaches within constitutional law. I argue that instead of emphasizing one value over the other, the ideal position (...) is one that simultaneously recognizes the values of liberty and equality despite the irreconcilable tension between them. Rather than choosing one value over the other, or reconciling these values by redefining them, I claim that it is vital to maintain the tension between liberty and equality by instantiating the conflict in law. Democracy is better served when the law contains an explicit tension between these foundational values.After setting forth this normative framework, I then apply it to the campaign finance decisions of the Supreme Courts of the United States and Canada, respectively. I make two main claims. First, I argue that although the libertarian/egalitarian distinction is usually presented as a binary choice, the laws of a given jurisdiction often simultaneously display both libertarian and egalitarian characteristics. For this reason, I claim that the libertarian/egalitarian distinction is better conceived of as a “libertarian-egalitarian spectrum.” Second, I argue that in recent years, the U.S. Supreme Court and the Supreme Court of Canada, respectively, have privileged one value—liberty or equality—at the expense of the other. The U.S. Supreme Court has over-emphasized the value of liberty (most notably in itsCitizens Uniteddecision), with the result that political equality is markedly undermined. By the same token, the Supreme Court of Canada’s commitment to equality has become too one-sided in recent cases (HarperandBryan), with the result that there are significant impairments to free speech liberties. I argue that both of these approaches are detrimental to democratic participation and governance. Finally, this article offers a preliminary proposal for how courts and legislatures can allow for the conflict between liberty and equality to be instantiated in law. (shrink)

A fundamental tenet of Paul Feyerabend’s pluralistic view of science has it that theory proliferation, that is, the availability of theoretical alternatives, is of crucial importance for the detection of anomalies in established theories. Paul Hoyningen-Huene calls this the Anomaly Importation Thesis, according to which anomalies are imported, as it were, into well-established theories from competing alternatives. This article pursues two major objectives: (a) to work out the systematic details of Feyerabend’s ideas on theory proliferation and anomaly import as they (...) are presented in his early publications and his Against Method and (b) to compare Feyerabend’s ideas on theory proliferation and anomaly import with corresponding features in Popper’s critical rationalist philosophy of science. As it turns out, neither the Principle of Proliferation nor the Anomaly Importation Thesis are necessarily incompatible with critical rationalism. In spite of Feyerabend’s general anti-Popperian attitude, I argue that theoretical pluralism can be seen as an advancement of the critical rationalist philosophy and that critical rationalism provides good arguments for pluralism. The `problem of time' is a cluster of interpretational and formal issues in the foundations of general relativity relating to both the representation of time in the classical canonical formalism, and to the quantization of the theory. The purpose of this short chapter is to provide an accessible introduction to the problem.

As we learn more about the human brain, novel biotechnological means to modulate human behaviour and emotional dispositions become possible. These technologies could be used to enhance our morality. Moral bioenhancement, an instance of human enhancement, alters a person’s dispositions, emotions or behaviour in order to make that person more moral. I will argue that moral bioenhancement could be carried out in three different ways. The first strategy, well known from science fiction, is behavioural enhancement. The second strategy, favoured by (...) prominent defenders of moral bioenhancement, is emotional enhancement. The third strategy is the enhancement of moral dispositions, such as empathy and inequity aversion. I will argue that we ought to implement a combination of the second and third strategies. Furthermore, I will argue that the usual arguments against other instances of human enhancement do not apply to moral bioenhancement, or apply only to the first strategy, behavioural enhancement. Artificial intelligence is becoming part of our everyday experience and is expected to be ever more integrated into ordinary life for many years to come. Thus, it is important for those in product development, research, and public policy to understand how the public’s perception of AI is shaped. In this study, we conducted focus groups and an online survey to determine the knowledge of AI held by the American public, and to judge whether entertainment media is a major influence on (...) how Americans perceive AI. What we found is that the American public’s knowledge of AI is patchy: some have a good understanding of what is and what is not AI, but many do not. When it came to understanding what AI can do, most respondents believe that AI could “replace human jobs” but few thought that it could “feel emotion.” Most respondents were optimistic about the future and impact of AI, though about one third were not sure. Most respondents also did not think they could develop an emotional bond with or be comfortable being provided care by an AI. Regarding the influence of entertainment media on perceptions of AI, we found a significant relationship between people’s beliefs about AI in entertainment media and their beliefs about AI in reality. Those who believe AI is realistically depicted in entertainment media were more likely to see AIs as potential emotional partners or apocalyptic robots than to imagine AIs taking over jobs or operating as surveillance tools. Starting from a generalized Hamilton-Jacobi formalism, we develop a new framework for constructing observables and their evolution in theories invariant under global time reparametrizations. Our proposal relaxes the usual Dirac prescription for the observables of a totally constrained system and allows one to recover the influential partial and complete observables approach in a particular limit. Difficulties such as the non-unitary evolution of the complete observables in terms of certain partial observables are explained as a breakdown of this limit. Identification of (...) our observables relies upon a physical distinction between gauge symmetries that exist at the level of histories and states, and those that exist at the level of histories and not states. This distinction resolves a tension in the literature concerning the physical interpretation of the partial observables and allows for a richer class of observables in the quantum theory. There is the potential for the application of our proposal to the quantization of gravity when understood in terms of the Shape Dynamics formalism. (shrink)

We study and characterize stability, the negation of the independence property (NIP) and the negation of the strict order property (NSOP) in terms of topological and measure theoretical properties of classes of functions. We study a measure theoretic property, Talagrand's stability, and explain the relationship between this property and the NIP in continuous logic. Using a result of Bourgain, Fremlin, and Talagrand, we prove almost definability and Baire 1 definability of coheirs assuming the NIP. We show that a formula has (...) the strict order property if and only if there is a convergent sequence of continuous functions on the space of φ‐types such that its limit is not continuous. We deduce from this a theorem of Shelah and point out the correspondence between this theorem and the Eberlein‐Šmulian theorem. (shrink)

Background: Recently, a singular survey titled “Measure of Moral Distress—Healthcare Professionals,” which addresses shortcomings of previous instruments, has been validated. Aim: To determine how moral distress affects nurses and physicians differently across the various wards of a community hospital. Participant and research context: We distributed a self-administered, validated survey titled “Measure of Moral Distress—Healthcare Professionals” to all nurses and physicians in the medical/surgical ward, telemetry ward, intensive care units, and emergency rooms of a community hospital. Findings: A total of 101 (...) surveys were included in the study. The mean Measure of Moral Distress—Healthcare Professionals score for all respondents was 143.0. The mean Measure of Moral Distress—Healthcare Professionals score was 1.75 greater for nurses than for physicians, and nurses were 2.52 times more likely to consider leaving their position due to moral distress. The mean Measure of Moral Distress—Healthcare Professionals score for moral distress was least prevalent in the medical/surgical ward and highest in the telemetry ward. The intensive care unit ward had a mean Measure of Moral Distress—Healthcare Professionals score mildly greater than the emergency room. Ethical considerations: No participant identifying information or information connecting a survey response to an individual was collected. This study was approved by the Raritan Bay Medical Center’s Institutional Review Board. Discussion: This study provides insight into the level of moral distress in the community hospital setting. Telemetry nurses experience significantly more than nurses in other wards. Telemetry nurses typically manage patients sicker than medical/surgical wards, however do not have the resources of the critical care units. This scenario presents challenges for telemetry nurses and may explain their elevated moral distress. Conclusion: In community hospitals, telemetry nurses experience a considerably greater amount of moral distress compared to their colleagues in other wards. As measured by the Measure of Moral Distress—Healthcare Professionals questionnaire, moral distress continues to be higher among nurses compared to physicians. (shrink)

Symplectic reduction is a formal process through which degeneracy within the mathematical representations of physical systems displaying gauge symmetry can be controlled via the construction of a reduced phase space. Typically such reduced spaces provide us with a formalism for representing both instantaneous states and evolution uniquely and for this reason can be justifiably afforded the status of fun- damental dynamical arena - the otiose structure having been eliminated from the original phase space. Essential to the application of symplectic reduction (...) is the precept that the first class constraints are the relevant gauge generators. This prescription becomes highly problematic for reparameterization invariant theories within which the Hamiltonian itself is a constraint; not least because it would seem to render prima facie distinct stages of a history physically identical and observable functions changeless. Here we will consider this problem of time within non-relativistic me- chanical theory with a view to both more fully understanding the temporal struc- ture of these timeless theories and better appreciating the corresponding issues in relativistic mechanics. For the case of nonrelativistic reparameterization invariant theory application of symplectic reduction will be demonstrated to be both unnec- essary; since the degeneracy involved is benign; and inappropriate; since it leads to a trivial theory. With this anti-reductive position established we will then examine two rival methodologies for consistently representing change and observable func- tions within the original phase space before evaluating the relevant philosophical implications. We will conclude with a preview of the case against symplectic re- duction being applied to canonical general relativity. (shrink)

Brain machine interface (BMI) technology makes direct communication between the brain and a machine possible by means of electrodes. This paper reviews the existing and emerging technologies in this field and offers a systematic inquiry into the relevant ethical problems that are likely to emerge in the following decades.

This article will explore a problem which is related to our moral obligations towards species. Although the re-creation of extinct animals has been discussed to some degree both in lay deliberations as well as by scientists, advocates tend to emphasize the technological and scientific value of such an endeavour, and the “coolness” factor, 32–33, 2013). This article will provide an argument in favour of re-creation based on normative considerations. The environmentalist community generally accepts that it is wrong to exterminate species, (...) for reasons beyond any instrumental value these species may have. It is often also claimed that humanity has a collective responsibility to either preserve or at least to not exterminate species. These two beliefs are here assumed to be correct. The argument presented here departs from and places these two ideas in a deontological framework, from which it is argued that when humanity causes the extinction of a species, this is a moral transgression, entailing a residual obligation. Such an obligation implies a positive duty to mitigate any harm caused by our moral failure. In light of recent scientific progress in the field of genetic engineering, it will be argued that humanity has a prima facie obligation to re-create species whose extinction mankind may have caused, also known as de-extinction. In 1981 Unruh proposed that fluid mechanical experiments could be used to probe key aspects of the quantum phenomenology of black holes. In particular, he claimed that an analogue to Hawking radiation could be created within a fluid mechanical `dumb hole', with the event horizon replaced by a sonic horizon. Since then an entire sub-field of `analogue gravity' has been created. In 2016 Steinhauer reported the experimental observation of quantum Hawking radiation and its entanglement in a Bose-Einstein condensate analogue black (...) hole. What can we learn from such analogue experiments? In particular, in what sense can they provide evidence of novel phenomena such as black hole Hawking radiation? (shrink)

We develop and apply a multi-dimensional account of explanatory depth towards a comparative analysis of inflationary and bouncing paradigms in primordial cosmology. Our analysis builds on earlier work due to Azhar and Loeb (2021) that establishes initial conditions fine-tuning as a dimension of explanatory depth relevant to debates in contemporary cosmology. We propose dynamical fine-tuning and autonomy as two further dimensions of depth in the context of problems with instability and trans-Planckian modes that afflict bouncing and inflationary approaches respectively. In (...) the context of the latter issue, we argue that the recently formulated trans-Planckian censorship conjecture leads to a trade-off for inflationary models between dynamical fine-tuning and autonomy. We conclude with the suggestion that explanatory preference with regard to the different dimensions of depth is best understood in terms of differing attitudes towards heuristics for future model building. In this essay, I explore ethical considerations that might arise from the use of collaborative filtering algorithms on dating apps. Collaborative filtering algorithms can predict the preferences of a target user by looking at the past behavior of similar users. By recommending products through this process, they can influence the news we read, the movies we watch, and more. They are extremely powerful and effective on platforms like Amazon and Google. Recommender systems on dating apps are likely to group people (...) by race, since they exhibit similar patterns of behavior: users on dating platforms seem to segregate themselves based on race, exclude certain races from romantic and sexual consideration, and generally show a preference for white men and women. As collaborative filtering algorithms learn from these patterns to predict preferences and build recommendations, they can homogenize the behavior of dating app users and exacerbate biased sexual and romantic behavior. We give a new characterization of _SOP_ (the strict order property) in terms of the behaviour of formulas in any model of the theory as opposed to having to look at the behaviour of indiscernible sequences inside saturated ones. We refine a theorem of Shelah, namely a theory has _OP_ (the order property) if and only if it has _IP_ (the independence property) or _SOP_, in several ways by characterizing various notions in functional analytic style. We point out some connections (...) between dividing lines in first order theories and subclasses of Baire 1 functions, and give new characterizations of some classes and new classes of first order theories. An intelligent machine surpassing human intelligence across a wide set of skills has been proposed as a possible existential catastrophe. Among those concerned about existential risk related to artificial intelligence, it is common to assume that AI will not only be very intelligent, but also be a general agent. This article explores the characteristics of machine agency, and what it would mean for a machine to become a general agent. In particular, it does so by articulating some important differences between (...) belief and desire in the context of machine agency. One such difference is that while an agent can by itself acquire new beliefs through learning, desires need to be derived from preexisting desires or acquired with the help of an external influence. Such influence could be a human programmer or natural selection. We argue that to become a general agent, a machine needs productive desires, or desires that can direct behavior across multiple contexts. However, productive desires cannot sui generis be derived from non-productive desires. Thus, even though general agency in AI could in principle be created by human agents, general agency cannot be spontaneously produced by a non-general AI agent through an endogenous process. In conclusion, we argue that a common AI scenario, where general agency suddenly emerges in a non-general agent AI, such as DeepMind’s superintelligent board game AI AlphaZero, is not plausible.
