In the international sphere, sovereignty and fundamental rights are often at odds, giving these rights little space for action and, in general, only after crisis has led to tragedy, and tragedy to disgrace. International Law, on the other hand, consistently succumbs to forms of domination and power, and its scope of action is often limited to certain codifications which are frequently suspended by political exception. Sixteenth century Dominican theologian, Francisco de Vitoria, established the principles for a Law of the people, (...) based on secular civil power that, while still exercising internal sovereignty, could defend and privilege the “rights of all men” over the exercise of power and private interest. This article focuses on this dispute to show Vitoria’s position, who long preceded the great declarations of human rights of the 18 th century, presenting an original doctrine within the framework of an emerging globalization and based on the defense of fundamental rights. By “epistemic pragmatism” in general I will understand the claim that whether propositions instantiate certain key epistemic properties (such as being known or being justifiably believed) depends not just on factors traditionally recognized as epistemic, but also on pragmatic factors, such as how costly it would be to the subject if the proposition were false. In what follows I consider two varieties of epistemic pragmatism. According to what I shall call moderate epistemic pragmatism, how much evidence we need in favor (...) of a proposition in order to know that the proposition is true depends on our preferences. According to what I shall call extreme epistemic pragmatism, on the other hand, our preferences influence our epistemic position at a more basic level, because they help determine how much justification we actually have in favor of the proposition in question. Simplifying brutally, moderate epistemic pragmatism has it that the more worried we are about a proposition’s being false, the more justification we need in order to know it, whereas extreme epistemic pragmatism has it that the more worried we are about a proposition’s being false, the less justification we have for it. Recently, Fantl and McGrath have presented an interesting argument for moderate epistemic pragmatism, an argument which relies on the principle that (roughly) knowledge is sufficient for action (KA). En su faceta de ensayista Edgar Allan Poe desarrolló interesantes ideas que corresponden al campo de la estética. Sin embargo, estas no han sido muy difundidas, y menos en América Latina, al contrario de su labor poética –mejor conocida–, y de su narrativa en prosa –que suele hacer parte de los programas de enseñanza de la literatura universal–. El presente escrito se propone recuperar algunos de sus planteamientos analizando su ensayo teórico “El propósito de la poesía”, siguiendo el rastro de (...) su crítica a una estética burguesa de masas y a una estética aristocrática tradicionalista. Con su lectura atenta rendimos un homenaje al autor, ahondando en su complejo perfil y siguiendo su exploración de temas tan variados como la crítica, el público, la recepción, la creación poética, la función del arte y la importancia social del poeta. Por último, su opinión sobre algunas figuras destacadas de la poesía mundial de su tiempo nos brinda un panorama muy rico del contexto cultural de la primera mitad del siglo XIX. (shrink)

En primer lugar, busca recapitular algunos temas abordados en los últimos años por el filósofo alemán Jürgen Habermas, como representante del liberalismo: a) la noción de sociedad post-secular, sus condiciones y desafíos; b) la tolerancia y el multiculturalismo; y c) la traducción como actividad mediadora que remedie la dificultad de comprensión entre el pensamiento secular de Occidente y las diferentes cosmovisiones religiosas tradicionales, de variadas procedencias. En segundo lugar, pretende ampliar el panorama de Habermas (...) con el apoyo de dos autores provenientes de otras tradiciones de pensamiento, y que permiten complementar y matizar algunas de las propuestas habermasianas: Michael Walzer, como representante del comunitarismo, y Peter Lamborn Wilson, alias Hakim Bey, como representante del postanarquismo. I discuss Turri's puzzle about withholding. I argue that attention to the way in which evidence can justify withholding dissolves the puzzle.

ABSTRACT:Price discrimination is the practice of charging different customers different prices for the same product. Many people consider price discrimination unfair, but economists argue that in many cases price discrimination is more likely to lead to greater welfare than is the uniform pricing alternative—sometimes for every party in the transaction. This article shows i) that there are many situations in which it is necessary to engage in differential pricing in order to make the provision of a product possible; and ii) (...) that in many such situations, the seller does not obtain an above-average rate of return. It concludes that price discrimination is not inherently unfair. The article also contends that even when conditions i) and/or ii) do not obtain, price discrimination is not necessarily unethical. In itself, the fact that some people get an even better deal than do others does not entail that the latter are wronged. (shrink)

Esta literatura y este arte discurren por todos los estratos de la sociedad: desde folletines sentimentales, cuentos e historietas de guerra, relatos bélicos de gran consumo o guías turísticas de los campos de batalla, hasta novelas y poemas de grandes autores; desde caricatura popular hasta obras de artistas reputados. Todo ello tiene un denominador común: el terrible empobrecimiento del lenguaje, por un lado, y, por otro, la convicción por parte de algunas élites intelectuales de que, en cualquier caso, ya no hay nada que decir. En el mundo del nihilismo imperfecto que se deriva de todo ello aparece un gran responsable: la vanguardia, que ve en la guerra la realización de algunas de sus fantasías, todas ellas relacionadas con la voluntad de destrucción. The consent process for publication of clinical images in medical journals varies widely. The extent of this variation is not known. It is also not known whether journals follow their own stated best practices or the guidance of the International Committee of Medical Journal Editors. We assessed consent requirements in a sample of 10 top impact factor general medicine journals that publish clinical images, examining variability in consent requirements for clinical image publication and congruence of requirements with the recommendations of (...) the ICMJE. Clinical image consent requirements varied widely from journal to journal. None of the studied journals, even amongst n = 4 ICMJE members or n = 8 journals who self-report adherence to ICMJE guidelines, comply with all of the recommendations of the ICMJE. Half of studied journals require a journal-specific consent form. Among top medical journals there is significant heterogeneity in consent requirements for clinical images. Variability of consent requirements is neither practical nor rational; inconsistent requirements create uncertainty for authors, present impediments to dissemination of scholarship, and undermine a shared professional understanding of how best to protect patient privacy. We propose adopting a standardized consent form and process for publication of identifiable images in medical journals, with uniform elements and explicit definitions. (shrink)

Functionalism as a philosophical position has been recently applied to the case of emotion research. However, a number of objections have been raised against applying such a view to scientific theorizing on emotions. In this article, I argue that functionalism is still a viable strategy for emotion research. To do this, I present functionalism in philosophy of mind and offer a sketch of its application to emotions. I then discuss three recent objections raised against it and respond to each of (...) them. These objections claim that functionalism is intractable because (i) it does not support a scientifically interesting taxonomy of emotions for experimental settings, (ii) it is inherently teleological, and (iii) it cannot be falsified. I argue that these objections either rely on a simplified version of functionalism as a philosophical position or they pose challenges that functionalists can readily address. Lastly, I conclude by drawing some lessons these objections suggest for a tractable functionalist account of emotions. (shrink)

We propose a view of identity beyond the individual in what we call interpersonal interidentities (IIIs). Within this approach, IIIs comprise collections of entangled stabilities that emerge in recurrent social interaction and manifest for those who instantiate them as relatively invariant though ever-evolving patterns of being (or more accurately, becoming) together. Herein, we consider the processes responsible for the emergence of these IIIs from the perspective of an enactive cognitive science. Our proposal hinges primarily on the development of two related (...) notions: enhabiting and coenhabiting. First, we introduce the notion of enhabiting, a set of processes at the individual level whereby structural interdependencies stabilise and thereafter undergird the habits, networks of habits, and personal identities through which we make sense of our experience. Articulating this position we lean on the notion of a tendency towards an optimal grip, though offering it a developmental framing, whereby iterative states of selective openness help realise relatively stable autonomous personal identities with their own norms of self-regulation. We then extend many of the notions found applicable here to an account of social coenhabiting, in particular, we introduce the notion of tending towards a co-optimal grip as central to the development of social habits, networks of habits, and ultimately IIIs. Such structures, we propose, also emerge as autonomous structures with their own norms of self-regulation. We wind down our account with some reflections on the implications of these structures outside of the interactions wherein they come into being and offer some thoughts about the complex animations of the individual embodied subjects that instantiate them. For this purpose, it deploys three lines of analysis: the French reception of cybernetics and information theory, and the positioning of Simondon in that conceptual field; the transcendent meaning that Simondon assigns to them, as they express a new technological era of the twentieth century; Simondon’s criticisms of cybernetics and information theory, which tend to dismantle the nineteenth-century remains that affect them (...) from within and to think a new concept of genesis. The closure of schools as a result of COVID-19 has been a critical global incident from which to rethink how education works in all our countries. Among the many changes generated by this crisis, all teaching became mediated by digital technologies. This paper intends to analyze the activities carried out during this time through digital technologies and the conceptions of teaching and learning that they reflect. We designed a Likert-type online questionnaire to measure the frequency of teaching activities. It was (...) answered by 1,403 teachers from Spain. The proposed activities varied depending on the learning promoted, the learning outcomes, the type of assessment to which the activities were directed, and the presence of cooperative activities. The major result of this study was that teachers used reproductive activities more frequently than constructive ones. We also found that most activities were those favoring verbal and attitudinal learning. The cooperative activities were the least frequent. Finally, through a cluster analysis, we identified four teaching profiles depending on the frequency and type of digital technologies use: Passive, Active, Reproductive, and Interpretative. The variable that produced the most consistent differences was previous digital technologies use These results show that Information and Communication Technologies uses are reproductive rather than constructive, which impedes effective digital technologies integration into the curriculum so that students gain 21st-century competencies. In this paper I argue against Mentalism, the claim that all the factors that contribute to the epistemic justification of a doxastic attitude towards a proposition by a subject S are mental states of S. My objection to mentalism is that there is a special kind of fact (what I call a "support fact") that contributes to the justification of any belief, and that is not mental. My argument against mentalism, then, is the following: Anti-mentalism argument: 1. If mentalism is (...) true, then support facts are mental. 2. Support facts are not mental. Therefore, 3. Mentalism is not true. In what follows I explain what support facts are, and then defend each of the premises of my argument. I conclude with some remarks regarding the relevance of my argument for the larger internalism/externalism debate(s) in epistemology. (shrink)

Objetivo: El siguiente artículo tiene como propósito la revisión de la literatura existente cuyo enfoque sea las herramientas tecnológicas utilizadas para el abordaje del paciente con síntomas de salud mental, de manera virtual, para describir las ventajas, la eficacia, la efectividad y los beneficios de estas herramientas, a partir de la literatura encontrada. Métodos: se realizó una búsqueda en las bases de datos Pubmed, Elsevier, UpToDate, Journal of Medical Internet Research y Google Académico. Se identificó un total de 58 artículos (...) que versan sobre la eficacia y efectividad de las diferentes modalidades digitales (tales como aplicaciones, cuestionarios en línea, mensajes de texto, etc.) que tratan la salud mental. Resultados: la búsqueda realizada arrojó un total de 58 artículos. Tras la eliminación de duplicados, el número fue de 50 artículos. Después de la caracterización de la información basada en la revisión de la totalidad del contenido, fueron elegidos 30 artículos para que sirvieran como base para la construcción de la síntesis de datos. Conclusiones: las herramientas virtuales utilizadas en salud mental ofrecen un sin fin de beneficios para prestar un servicio con un acceso más sencillo a la población, de forma económica y efectiva, sin temor a que los pacientes sean estigmatizados al momento de buscar ayuda, como se pudo evidenciar en los artículos presentados. Además, las herramientas digitales utilizadas en psiquiatría han demostrado ser eficaces y seguras, sin embargo, son de reciente aparición y cuentan con una cantidad limitada de estudios que demuestren objetivamente su eficacia en esta área. When one wants to use citizen input to inform policy, what should the standards of informedness on the part of the citizens be? While there are moral reasons to allow every citizen to participate and have a voice on every issue, regardless of education and involvement, designers of participatory assessments have to make decisions about how to structure deliberations as well as how much background information and deliberation time to provide to participants. After assessing different frameworks for the relationship between (...) science and society, we use Philip Kitcher's framework of Well-Ordered Science to propose an epistemic standard on how citizen deliberations should be structured. We explore what potential standards follow from this epistemic framework focusing on significance versus scientific and engineering expertise. We argue that citizens should be tutored on the historical context of why scientific questions became significant and deemed scientifically and socially valuable, and if citizens report that they are capable of weighing in on an issue then they should be able to do so. We explore what this standard can mean by looking at actual citizen deliberations tied to the 2014 NASA ECAST Asteroid Initiative Citizen forums. We code different vignettes of citizens debating alternative approaches for Mars exploration based upon what level of information seemed to be sufficient for them to feel comfortable in making a policy position. The analysis provides recommendations on how to design and assess future citizen assessments grounded in properly conveying the historical value context surrounding a scientific issue and trusting citizens to seek out sufficient information to deliberate. What should your reaction be when you find out that someone that you consider an "epistemic peer" disagrees with you? Two broad approaches to this question have gained support from different philosophers. Precise characterizations of these approaches will be given later, but consider for now the following approximations. First, there is the "conciliatory" approach, according to which the right reaction to a disagreement is to move one's opinion towards that of one's peer, in proportion to the degree of trust that (...) one accords to that peer—for instance, if you thought that, in case of disagreement, you are equally likely to be right, then the conciliatory approach would have it that you should meet your epistemic peer halfway. The other, "nonconciliatory" approach, holds that one's reaction to a disagreement need not be perfectly in line with one's prior degree of trust in the other party. Notice an important asymmetry between these two approaches: the conciliatory approach has it that conciliation is the right reaction to any disagreement, whereas the nonconciliatory approach has it that there are some possible disagreements the correct reaction to which is not to conciliate (or not to the extent mandated by conciliatory views). This article examines the dispute between conciliatory and nonconciliatory views by distinguishing and examining possible answers to four different questions. (shrink)

We would like to thank the authors of the commentaries for their critical appraisal of our feature article, Who is afraid of black box algorithms?1 Their comments, suggestions and concerns are various, and we are glad that our article contributes to the academic debate about the ethical and epistemic conditions for medical Explanatory AI. We would like to bring to attention a few issues that are common worries across reviewers. Most prominently are the merits of computational reliabilism —in particular, when (...) promoted as an alternative to transparency—and CR as necessary but not sufficient for delivering trust. We finalise our response by addressing concerns about the place and role of artificial intelligence in medical decision-making and the physician’s responsibilities. We understand the concerns and reservations that some of the reviewers express regarding the epistemic merits of CR. Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. En este escrito me propongo presentar una reconstrucción à la Suppes de la Teoría pictórica, representacional o figurativa del lenguaje propuesta por L. Wittgenstein en el Tractatus Logico-Philosophicus para mostrar los límites del pensamiento, o más precisamente del lenguaje como expresión sensible del pensamiento, sobre el presupuesto de la existencia no explícita por parte de su autor de un isomorfismo entre la estructura del lenguaje, como expresión sensible del pensamiento, y la del mundo; de suerte que, para que el lenguaje (...) pueda figurar algo del mundo, se requiere que entre ambas estructuras, la del lenguaje y la del mundo, se pueda establecer una función h-isomórfica no solo a nivel de sus dominios respectivos, dado que ambos poseen la misma cardinalidad, sino entre sus predicados y relatores, dada su misma aridad. Con ella pretendo dar cuenta de la compleja teoría pictórica o figurativa con el fin de diferenciar aquello que podemos decir con sentido, de aquello que únicamente podemos mostrar. (shrink)

This article presents three studies examining the importance of identification with characters in research on media entertainment. In Study 1 it was found that identification with characters was associated with spectators' degree of enjoyment of feature films of different genres. Study 2 showed that identification with characters predicts the affective impact of a dramatic film and, also, it was associated with greater cognitive elaboration and a more complex reflexive process during the viewing of the dramatic film. In Study 3 it (...) was observed that identification with characters predicted the incidental impact of a full length fictional film on attitudes and beliefs. These results support the centrality of the construct of identification with characters in narrative persuasion research. (shrink)

RESUMEN Con frecuencia el amor y la racionalidad se ven como capacidades que fácilmente entran en conflicto, cuando no se consideran por principio opuestas. En este artículo desarrollo algunos puntos esbozados por Harry Frankfurt con el fin de proponer que la relación entre amor y racionalidad no es de simple oposición. Tras ofrecer una caracterización del amor como disposición híbrida de seguimiento múltiple, defenderé que el amor es racional en el siguiente sentido: el amor no es justificable, pero a pesar (...) de ello es una fuente de razones básicas y a veces irresistibles que en buena medida informan el campo de nuestra racionalidad. Esto no significa que el amor sea una base irracional o arracional, o que sea completamente blindado a la razón, sino que en circunstancias específicas tiene sentido someter el amor a escrutinio racional. ABSTRACT Love and rationality are often considered as capacities which easily come into conflict, or are even opposed to one another. In the paper I elaborate some points suggested by Harry Frankfurt in order to propose that the relation between love and rationality is not one of opposition. After offering a characterization of love as a hybrid multi-track disposition, I will argue that love is rational in the following sense: although love is not justifiable, it is nevertheless a source of basic and sometimes irresistible reasons which to a large extent shape the field of our rationality. This does not mean that love is an irrational or arrational foundation, or that it is impervious to reason; it only means that in certain circumstances it makes sense to subject love to rational scrutiny. Supposedly, the qualia are the qualitative properties that conform the conscience; a pain, the memory of a sticky sensation, a sticky sensation, the green color of the mountains I see, etc. In permanent opposition to the so-called qualophillians, an antiintuitive but coherent theory is developed, that operates through a form of reductionism.

This paper advances the analysis of the concept of Umwelt in Jakob von Uexküll’s work, by examining its different formulations, and highlighting the successive redefinitions of its two components: the perception world and the effect world. Considering the significant impact that the concept of Umwelt had on continental philosophy, the purpose of this study is to reconstruct its meaning through a historical-conceptual analysis, to illuminate some aspects that are not usually thematized in literature—in particular, those related to the effect world.

Resumen: El problema del mal sigue inquietando la conciencia humana, lo que hace indispensable revisar las fuentes de nuestro entendimiento de esa terrible dificultad. Agustí­n de Hipona suele ser considerado el primer filósofo en encarar este problema desde una perspectiva sistemática. Sin embargo, la solución privacionista que presentó, siguiendo directrices neoplatónicas, es considerada como un artefacto más teológico que filosófico. La solución agustiniana, de enorme influencia en la historia de la filosofí­a, ha sido acusada de ser una concepción metafí­sica y (...) falta de claridad, de suerte que no contribuye a aclarar el origen y naturaleza del mal. En este ensayo presentará las lí­neas generales de la solución agustiniana y mostrará su solidez conceptual y su importancia en la solución del problema del mal.: Augustine of Hippo is usually regarded as the first philosopher to affront this problem from a systematic point of view. Nonetheless, the privationist solution he offered, forged in neoplatonic terms, is considered a theological, rather than a philosophical, device. Despite its enormous influence, Augustinian solution has been accused of being both metaphysical and misleading, because it cannot provide an adequate approach the origin and nature of evil. This essay intends to expose the main lines of the Augustinian solution, its internal steadiness and import as solution to the problem of evil. (shrink)

A favourite discussion topic about Wittgenstein is his concept of philosophy. One of its characterizations takes it as an activity by which we reach a panoramic vision of language. This panoramic vision is neither a theoretical issue nor a theoretical construction, but a state of the philosopher or of those readers who understand Wittgenstein´s thought. He often puts it in terms of a path: "the real discovery is the one that gives philosophy peace", he claims in a famous passage of (...) Philosophical Investigations [133], and he is even more explicit and personal on its Foreword: "The philosophical remarks in this book are, as it were, a number of sketches of landscapes which were made in the course of these long and involved journeyings, which now had to be arranged and sometimes cut down, so that if you looked at them you could get a picture of the landscape" Almost paradoxical: the panoramic vision of the landscape is acquired passing through it.. The thesis is guided by the question: What is the subject matter of Heidegger’s philosophy in the period of Being and Time? I start by arguing that Heidegger’s formulation of the question of being is ambiguous because the term ‘being’ is open to at least two interpretations. I claim that this ambiguity has motivated two types of reading of Heidegger’s early work. On the first reading, Heidegger’s philosophy is understood as attempting to infer metaphysical claims (claims about what-is, or being (...) in a traditionally metaphysical sense) on the basis of claims about the structure of Dasein’s understanding. This reading typically renders Heidegger an idealist. On the second reading, Heidegger’s philosophy is taken to have no metaphysical ambitions, and thereby to be limited to elucidating the structure of Dasein’s understanding. I argue that both types of reading are inadequate and diagnose them as grounded in a Cartesian presupposition that Heidegger rejects. On the basis of direct textual evidence and a number of theoretical considerations I assert that although the second type of reading is right in that the primary object of Heidegger’s philosophy is the conditions of understanding and that the idealist reading is wrong, it is a mistake to deny that Heidegger’s philosophy has metaphysical implications. I claim that Heidegger’s exposition of the conditions of understanding involves a larger picture from the outset, a picture that delineates the relation between understanding and entities, and locates the objective in relation to Dasein. On this picture, 1) empirical entities are unqualifiedly independent of Dasein, 2) we have direct cognitive access to these entities as they are in themselves, and 3) there is no a priori unintelligible entities or aspects of entities. According to the research on the influence of resources on mate selection, the amount of financial resources affects an individual’s choice of "luxuries" and "necessities" among mate selection cues, while the amount of time resources affects cue diversity. However, for a long time, researchers only paid attention to the impact of financial resources and ignored the role of time resources. Therefore, this paper draws lessons from the relevant research on the influence of time on decision-making and proposes to study mate (...) selection from the perspective of decision-making. Additionally, current research concerning the influence of resources on the choice of a spouse focuses more on results and neglects to examine the process. Therefore, based on the relevant theories, this paper makes several theoretical assumptions regarding the influence mechanism of resource availability on mate choice decisions, gender differences and the actor-partner effect. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. El siguiente trabajo analiza las acciones artísticas ligadas al Colectivo Escena Política que tuvieron lugar en la ciudad de Buenos Aires entre 2013 y 2016. Daremos cuenta de tres formas específicas de intervención artístico-política en el espacio público. La primera relacionada con una denuncia de la explotación laboral de los artistas escénicos en la ciudad. La segunda vinculada a prácticas micropolíticas que denominamos activismo de lo sensible. Y la tercera, relacionada con la lucha llevada adelante por la Asamblea Lopérfido Renunciá (...) Ya, en conjunto con organismos de derechos humanos. En última instancia, el artículo propone que la eficacia política del activismo artístico depende de su articulación sincrónica con las diversas luchas que atraviesan el entramado social. (shrink)
