Johann Gottfried von Herder (1744-1803) is one of the most important German philosophers of the eighteenth century, who had enormous influence on later thinkers such as Hegel, Schleiermacher and Nietzsche. His wide-ranging ideas were formative in the development of linguistics, hermeneutics, anthropology and bible scholarship, and even today they retain their vitality and relevance to an extraordinary degree. This volume presents a new translation of Herder's most important and characteristic philosophical writings (some of which have never before been translated) (...) in his areas of central interest, including philosophy of language, philosophy of mind, philosophy of history and political philosophy, as well as his general philosophical program. Whatever ethical stance one takes in the debate regarding the ethics of human enhancement, one or more reference points are required to assess its morality. Some have suggested looking at the bioethical notions of safety, justice, and/or autonomy to find such reference points. Others, arguing that those notions are limited with respect to assessing the morality of human enhancement, have turned to human nature, human authenticity, or human dignity as reference points, thereby introducing some perfectionist assumptions into the debate. In (...) this article, we ask which perfectionist assumptions should be used in this debate. After a critique of views that are problematic, we take a positive approach, suggesting some perfectionist elements that can lend guidance to the practice of human enhancement, based on the work of Martha Nussbaum's Capability Approach. We suggest that the central capabilities can be used to define the human aspect of human enhancement and thereby allow a moral evaluation of enhancement interventions. These central capabilities can be maximized harmoniously to postulate what an ideal human would look like. Ultimately, the aim of this article is twofold. First, it seeks to make explicit the perfectionist assumptions found in the debate and eliminate those that are problematic. Second, the paper clarifies an element that is often neglected in the debate about human enhancement, the view of the ideal human towards which human enhancement should strive. Here, we suggest that some central capabilities that are essential for an ideal human being can be maximized harmoniously and can therefore serve as possible reference points to guide human enhancement. The novel coronavirus – officially named severe acute respiratory syndrome coronavirus 2, causing a disease which has flu-like symptoms – seems to be responsible for the current global lockdown or maybe one can even refer to it as a global event. Neither the virus nor the disease that it causes is truly novel, as the virus is part of the SARS virus family and therefore known, and likewise the symptoms of the disease are also well known, even flu-like, and therefore (...) also not novel. Yet, what is truly novel about the virus or the disease it causes is its effect, not specifically referring to the health effect, but its global socio-economic and political effect. It is for the first time in the history of humanity that such drastic global lockdown measures have been taken and that governments have taken the conscious decisions to ‘lay lame’ their economies. Such a radical decision is truly novel. Besides the economic ‘lockdown’, there are numerous socio-economic repercussions; for example, in a single day, millions of citizens in the United States file for unemployment, and similarly in many other countries. Covid-19 is a challenge to the economies of the world, to society at large, to the poor and vulnerable in particular, and to individuals who are ‘locked safely’ in their homes. Religious institutions, which traditionally provide collective meaning, can no longer gather in public places, and offer communal solace. Covid-19 maybe challenges what being human means, or at least, what one has come to believe concerning the meaning of being human. In this article, this question of being human in the time of Covid-19 will be explored. (shrink)

There are three main positions on animalthought: lingualism denies that non-linguistic animalshave any thoughts; mentalism maintains that theirthoughts differ from ours only in degree, due totheir different perceptual inputs; an intermediateposition, occupied by common sense and Wittgenstein,maintains that animals can have thoughts of a simplekind. This paper argues in favor of an intermediateposition. It considers the most important arguments infavor of lingualism, namely those inspired byDavidson: the argument from the intensional nature ofthought (Section 1); the idea that thoughts involveconcepts (Sections (...) 2–3); the argument from the holisticnature of thought (Section 4); and the claim that beliefrequires the concept of belief (Sections 5–6). The lastargument (which Davidson favors) is uncompelling, butthe first three shed valuable light on the extent towhich thought requires language. However, none of themprecludes animals from having simple thoughts. Even ifone adopts the kind of third-person perspective onthought Davidson shares with Wittgenstein, the resultis a version of the intermediate position, albeit oneenriched by Davidson''s insights concerningintensionality, concepts and holism (Section 7). We canonly ascribe simple thoughts to animals, and even thatascription is incongruous in that the rich idiom weemploy has conceptual connections that go beyond thephenomena to which it is applied. This article provides an original reappraisal of the notion of Minnemystik in the work of the 13th-century Flemish beguine Hadewijch of Antwerp, with specific reference to its Trinitarian and Christological orientations. After an introduction to the nature and origins of Hadewijch’s work, relating to the discovery of four extant manuscripts in Belgium in 1838, followed by an elucidation of the experience-driven epistemology of the Victorians Richard of St Victor and Hugo of St Victor as her key early scholastic influences, Hadewijch’s (...) Minnemystik is distinguished from Wesenmystik, as encountered in the mystical work of her French contemporary and beguine counterpart, Marguerite Porete. From this discursive basis, Hadewijch’s Minnemystik is reassessed and represented as pertinently Trinitarian and Christological in orientation, and therefore as a theological presentation from the 13th century. Is it necessary to have an ideal of perfection in mind to identify and evaluate true biotechnological human “enhancements”, or can one do without? To answer this question we suggest employing the distinction between ideal and non-ideal theory, found in the debate in political philosophy about theories of justice: the distinctive views about whether one needs an idea of a perfectly just society or not when it comes to assessing the current situation and recommending steps to increase justice. In this (...) paper we argue that evaluating human enhancements from a non-ideal perspective has some serious shortcomings, which can be avoided when endorsing an ideal approach. Our argument starts from a definition of human enhancement as improvement, which can be understood in two ways. The first approach is backward-looking and assesses improvements with regard to a status quo ante. The second, a forward-looking approach, evaluates improvements with regard to their proximity to a goal or according to an ideal. After outlining the limitations of an exclusively backward-looking view, we answer possible objections against a forward-looking view. Ultimately, we argue that the human enhancement debate would lack some important moral insights if a forward-looking view of improvement is not taken into consideration. (shrink)

Like biological species, languages change over time. As noted by Darwin, there are many parallels between language evolution and biological evolution. Insights into these parallels have also undergone change in the past 150 years. Just like genes, words change over time, and language evolution can be likened to genome evolution accordingly, but what kind of evolution? There are fundamental differences between eukaryotic and prokaryotic evolution. In the former, natural variation entails the gradual accumulation of minor mutations in alleles. In the (...) latter, lateral gene transfer is an integral mechanism of natural variation. The study of language evolution using biological methods has attracted much interest of late, most approaches focusing on language tree construction. These approaches may underestimate the important role that borrowing plays in language evolution. Transgender people have among the highest rates of suicide attempts of any group in society, driven strongly by the perception that they do not belong in the sex of their physical body. Gender reassignment surgery is a procedure that can change the transgender person’s physical body to accord with their gender identity. The procedure raises important ethical and distributive justice concerns, given the controversy of whether it is a cosmetic or medical procedure and the economic costs associated with performing the (...) procedure. This paper argues that there is a strong case for funding GRS as a matter of clinical necessity and justice. This paper will be divided in four key sections: First, the state of transgender health will be outlined, including the role of GRS and common objections to it. Second, a number of common objections to GRS will be analysed at the outset and shown to be unconvincing. Third, a constructive argument will be advanced, arguing that publicly funded GRS is clinically necessary, cost-effective, and demanded by principles of justice. Fourth, the paper will briefly discuss moralistic biases and why we demand a higher burden of justification for funding GRS compared with other analogous procedures. (shrink)

This article investigates the palimpsest reception of Pseudo-Dionysius (ca. 500) in the metaphysics of Nicholas of Cusa (1401–1464). The article covers Cusa’s political theory and metaphysics, which are intertwined. Reading Cusa against the backdrop of an analysis of Pseudo-Dionysius’ metaphysics in a preceding article, the author, in a synthetic conclusion, isolates seven Dionysic ‘trails’ (S1 to S7) in Cusa’s metaphysics: the interpretation of transcendence as bound to immanence; the affirmation of God’s transcendence in the world (or a metaphysics of ‘creation (...) as teophany’); the radical transcendence and simultaneous radical immanence of God (that is, God as ‘Beingness’); fundamental restrictions of language and the analogical ‘Naming’ of God; creation as a system of dialectical symbols about God; the analogical participation of the subject in creation; and unification (reditus, the ‘flowing of things back to God’). The Dionysic trails in Cusa’s metaphysics are described as a noteworthy, if not important, palimpsest in the corpus of late Medieval philosophy and is indicative of what the author puts forward as ‘discursive memory’, which is presented as a modern-critical concept. Si l’on connaît aujourd’hui le dialogue fructueux que Paul Ricœur a noué avec les penseurs structuralistes, on ignore largement son positionnement face à la mouvance poststructuraliste. Faut-il opposer la philosophie de Ricœur au poststructuralisme à la française ou au contraire doit-on montrer qu’elle en est une variante singulière? C’est la seconde option qui est ici défendue. Certes, le poststructuralisme ne doit pas être considéré comme une école de pensée mais comme une reconstruction qui relève de l’histoire de la philosophie. Dans (...) la mesure où les horizons de dépassement du structuralisme ont été posés de manière chaque fois particulière, il est préférable de parler de poststructuralismes au pluriel. Foucault’s sodomite’: Damian’s Liber gomorrhianus (1049) reopened. Taking Michel Foucault’s famous statement about the difference between the ‘Medieval sodomite’ and the heteronormative ‘19th century homosexual’ as its cue, this article surveys the discursive source of that statement in the work of Peter Damian (1007–1072) with regard to his obscure, yet consequential text, Liber gomorrhianus (presented in 1049 to Pope Leo IX, preceding the Council of Reims). Drawing on the recent research by Ranft and because Damian is such an understated figure (...) in the corpus of Medieval philosophy, an overview of Damian’s life and work is presented, especially in terms of Damian’s 11th century reforming labour ethics. Only then the article proceeds to reopen Damian’s text, indicating that the ‘Medieval sodomite’ is far removed from an elementary precursor to the modern scientia sexualis homosexual, but is indeed presented by Damian as a complex and gender-inclusive licentious person, within the context of the disintegration of sexual morality (especially within the domains of celibacy and confession) in the middle to late 11th century church and monasteries. Cross-referencing the own translation of the Latin text with the translation of Payer, the article disseminates and critiques the key concepts in Damian’s argument for the summarily deposition of lapsi [fallen priests] and the expulsion of promiscuous monks (and nuns) from the orders, especially with regard to Damian’s concepts of contra-natural and irrational fornication. Pope Leo’s deeply pastoral and insightful answer to Damian ( Ad splendidum nitentis ) is presented in the last part of the article, including his sanctioning of Damian’s complex concept of sodomy, which on that ground, became the conceptual source for the council of Reims (1049), and subsequent Medieval councils dealing with the ‘problem of sodomy’ in the church and monasteries. The canons of those councils were indeed the source of Foucault’s analysis of Medieval sexuality – yet the more fundamental source was Damian’s obscure text. (shrink)

A seminal figure in the philosophy of history, culture, and language, Johann Gottfried Herder also produced some of the most important and original works in the history of aesthetic theory. A student of Kant, he spent much of his life striving to reconcile the opposing poles of Enlightenment thought represented by his early mentors. His ideas influenced Hegel, Schleiermacher, Nietzsche, Dilthey, J. S. Mill, and Goethe. This book presents most of Herder's important writings on aesthetics, including the main sections (...) of one of his major untranslated works, Kritische Wälder. These notes, essays, and treatises, the majority of which appear here in English for the first time, show this idiosyncratic thinker both deeply rooted in the controversies of his day and pointing the way to future developments in aesthetics. Chosen to reflect the extent and diversity of Herder's concerns, the texts cover such topics as the psychology and physiology of aesthetic perception, the classification of the arts, taste, Shakespeare, the classical tradition, and the relationship between art and morality. Few thinkers have reflected so sensitively and productively on the cultural, historical, anthropological, ethical, and theological dimensions of art and the creative process. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

The objective of this article is to present an overview, based on the most recent specialist research, of Neoplatonist developments in the Cologne tradition of the later Middle Ages, with specific reference to a unique Proclian commentary presented by the German Albertist Dominican, Berthold of Moosburg (ca. 1300–1361). Situating Berthold in the post-Eckhart Dominican crisis of the 1340s and 1350s, his rehabilitating initiative of presenting this extensive (nine-volume) commentary on the Neoplatonist Proclus Lycaeus’ (412–485) Elements of Theology in his Expositio (...) super Elementationem theologicam Procli, the only of its kind from the Middle Ages, is contextualised with reference to Berthold’s discursive indebtedness to his Dominican predecessors, Albert the Great (ca. 1200–1280), Ulrich of Strasbourg (ca. 1220–1277) and Dietrich of Freiberg (ca.1250 – ca.1310), as well as two Dutch-Cologne successors, the Albertist Heymeric of Camp (1395–1460) and the Carthusian Thomist Denys de Leeuwis (1402–1471). Berthold’s unique contribution to the philosophical discourse of the Middle Ages is indicated therein that the Expositio provided a synthesis of the late Medieval version of Neoplatonism and contemporaneous German–Dominican theories. By contextualising the work of his Cologne predecessors and successors in the broad idea-historical landscape of antiquity and Neoplatonism, the article argues that Berthold succeeded in linking the Neoplatonic legacy with Cologne Albertism and provided an impetus for the overall consolidating ability of the Cologne tradition. By juxtaposing Berthold and his Expositio with the more conventional legacies of Ulrich, Dietrich, Heymeric and Denys, this exceptional Latin-Western intellectual tradition from Cologne is expanded and enriched with regard to its notable Neoplatonic contributions to philosophy in the later Middle Ages. Contribution: This article contributes to scholarship in Medieval philosophy by presenting an overview of Neoplatonist developments in the Cologne tradition of the later Middle Ages, with specific reference to the Proclian commentary presented by the German Albertist Dominican, Berthold of Moosburg (ca. 1300–1361). Kalhat has forcefully criticised Wittgenstein's linguistic or conventionalist account of logical necessity, drawing partly on Waismann and Quine. I defend conventionalism against the charge that it cannot do justice to the truth of necessary propositions, renders them unacceptably arbitrary or reduces them to metalingustic statements. At the same time, I try to reconcile Wittgenstein's claim that necessary propositions are constitutive of meaning with the logical positivists’ claim that they are true by virtue of meaning. Explaining necessary propositions by reference to (...) linguistic conventions does not reduce modal to non‐modal notions, but it avoids metaphysical accounts, which are incapable of explaining how we can have a priori knowledge of necessity. We explore a ‘Neo-Cartesian’ account of divine ultimacy that raises the concept of God to its ultimate level of abstraction so that we can do away with even the question of his existence. Our starting point is God’s relation to the logical and metaphysical order of reality and the views of Descartes and Leibniz on this topic. While Descartes held the seemingly bizarre view that the eternal truths are freely created by God, Leibniz stands for the mainstream view that the (...) eternal truths are grounded in God’s nature. We argue that the implausibility of Descartes’ doctrine stems mainly from the assumption that there is a non-epistemic notion of absolute necessity that constitutes the ultimate court of appeal for all modal questions and that this assumption is questionable. We also question the assumption that God’s ultimacy merely requires that all reality be grounded in God in the sense of mere explanation, so that it suffices if the necessary truths are grounded in God’s nature but not in God’s will. This will lead us to a reassessment of Descartes’ position. In the final and main part of the paper, we push Descartes’ doctrine of the creation of the eternal truths to its ‘logical’ conclusion with the aim of getting to a novel conception of ‘God.’. The process of applying the law tends to oscillate between two modes: the subsumption under “clear” rules on the one hand and the interpretative concretisation of vague and abstract blanket clauses on the other. Legal arguments therefore refer both to the semantic content of rules and to legal self-evidence. Consequently the application of law can effectively be influenced not only through new legislation, but also through the introduction of new inter-preters bringing with them a different set of preconceptions, and thus (...) differing interpretations of the law. The traditional balance between these two models of control is endangered in mul-ticultural societies since these societies are characterised by conflicting concepts of justice. An automated application of law, aspired to by many legal scholars, could dispense legal practice from such conflicting prejudices. The price for that gain, however, would likely be a loss of the rule of law in the general understanding. (shrink)

The ethics of human enhancement has been a hotly debated topic in the last 15 years. In this debate, some advocate examining science fiction stories to elucidate the ethical issues regarding the current phenomenon of human enhancement. Stories from science fiction seem well suited to analyze biomedical advances, providing some possible case studies. Of particular interest is the work of screenwriter Andrew Niccol (Gattaca, S1m0ne, In Time, and Good Kill), which often focuses on ethical questions raised by the use of (...) new technologies. Examining the movie In Time (2011), the aim of this paper is to show how science fiction can contribute to the ethical debate of human enhancement. In Time provides an interesting case study to explore what could be some of the consequences of radical life-extension technologies. In this paper, we will show how arguments regarding radical life-extension portrayed in this particular movie differ from what is found in the scientific literature. We will see how In Time gives flesh to arguments defending or rejecting radical life-extension. It articulates feelings of unease, alienation and boredom associated with this possibility. Finally, this article will conclude that science fiction movies in general, and In Time in particular, are a valuable resource for a broad and comprehensive debate about our coming future. (shrink)

Johann Christoph Gottsched is considered to be one of the greatest scholars of the Early German Enlightenment. As a professor for poetics in Leipzig, he worked towards a reformation of the German language and a renaissance in German drama. His extensive correspondence and social contacts made him a ‚European event‘ and his papers are being presented here in a standard edition: 25 volumes, approx. 6,000 letters to and from Gottsched, predominantly in German, are being published with a critical apparatus (...) and an academic commentary. This edition is being published in co-operation with the Saxonian Academy of Sciences and edited by members of the academy. The edition is scheduled to be published over 25 years and offers an ideal addition to the multi-volume edition of Gottsched's works, already published by de Gruyter. (shrink)
