Health care decision making for patients without decisional capacity is ethically and legally challenging. Advance directives (living wills) have proved to be of limited usefulness in clinical practice. Therefore, academic attention should focus more on substitute decision making by the next of kin. In this article, we comparatively analyse the legal approaches to substitute medical decision making in England and Germany. Based on the current ethico-legal discourse in both countries, three aspects of substitute decision making will be highlighted: (1) Should (...) there be a legally predefined order of relatives who serve as health care proxies? (2) What should be the respective roles and decisional powers of patient-appointed versus court-appointed substitute decision-makers? Topical intercultural discourse on historical thinking is deeply determined by fundamental distinctions, mainly between the “East” and the “West.” The epistemological preconditions of this discourse are normally not reflected or even criticized. This article follows Chun-Chieh Huang’s attempt to give Chinese historical thinking a new voice in this intercultural discourse. It agrees with Huang’s strategy of focusing the description of the peculiarity of Chinese historical thinking on fundamental criteria of historical sense-generation. Huang argues for a strict difference between the Chinese (...) way of sense-generation in history and the Western one. Against this distinction I argue that both traditions of historical thinking follow the same logic, namely that of the exemplary mode, which is known in the Western tradition by Cicero’s slogan “Historia vitae magistra.” Instead of claiming this mode as typical of Chinese historical thinking, I propose to clarify the difference between China and the West by looking for a modification of the same logic. Finally the question arises as to what the paradigmatic shift of historical thinking from the exemplary to the genetic mode means for the Chinese tradition Huang has presented. This shift cannot be understood as only a Western one, since it is a mode of pursuing modernity in history by a fundamental temporalization in the interpretation of the human world. (shrink)

Hendrik Lorenz presents a comprehensive study of Plato's and Aristotle's conceptions of non-rational desire. They see this as something that humans share with animals, and which aims primarily at the pleasures of food, drink, and sex. Lorenz explores the cognitive resources that both philosophers make available for the explanation of such desires, and what they take rationality to add to the motivational structure of human beings. In der vorliegenden Arbeit soll das komplexe Zusammenwirken von unbewusst Psychischem, biologischem Körper in der Pubertät und gesellschaftlichen Verschiebungen hin zu multiplen Genderidentitäten untersucht und differenziert werden. Ausgangspunkt ist eine Gruppe von Jugendlichen, die sich in der Spezialsprechstunde für Geschlechtsdysphorie des Universitätsklinikums Hamburg-Eppendorf vorstellen und als »Transgender« identifizieren; meist ist der Anlass der Vorstellung der Wunsch nach einer medizinischen Transition (Hormonbehandlung etc.). Der Autor versteht die frühe Adoleszenz als einen sozio-psychischen Umschlagsplatz, der per se einer psychischen und körperlichen, zumal hochgradig (...) konflikthaften Transition nahekommt. Die Editionswissenschaft, aber auch die editorisch arbeitenden Fachdisziplinen haben sich bisher nicht besonders intensiv um das spezifische Verhältnis von Kanon und Edition bemüht. Der vorliegende Band legt in einem interdisziplinären Zugriff exemplarische Studien aus der Literaturwissenschaft, der Musikwissenschaft und der Philosophie vor, die theoretische Fragestellungen der Kanonforschung mit Fällen der fachgeschichtlichen Editionspraxis verbinden, um so Konturen einer fachübergreifenden Beziehungsbeschreibung von Kanonbildung und Editionspraxis sichtbar zu machen. Dazu schlägt der Band vier Wege ein. In einer ersten, wissenschaftsgeschichtlich orientierten Rubrik werden „Aspekte (...) der Fachgeschichtsschreibung" aus philosophischer und neu- wie altgermanistischer Perspektive in den Blick genommen. Research on privacy practices in digital environments has oftentimes discovered a paradoxical relationship between users’ discursive appraisal of privacy and their actual practices: the “privacy paradox.” The emergence of this paradox prompts us to conduct ethnography of a health and fitness platform in order to flesh out the structural mechanisms generating this paradox. We provide an ethnographic analysis of surveillance capitalism in action that relates front-end practices empirically to the data economy’s back-end operations to show how this material-semiotic setup elicits (...) users’ desire to become self-determined subjects in a way that makes them amenable as objects of behavioral engineering. We combine different ethnographic methods and materials to specify how different types of values are produced and translated on the investigated platform. The latter offers users the values of self-mastery and social visibility. However, the data generated in this process serve to translate these values into the value of economic amenability and thereupon ultimately into economic profit. What gets lost in translation, though, is the front-end promise of self-mastery. It is these structural mechanisms that generate the privacy paradox in the first place. (shrink)

ZusammenfassungEinhergehend mit den Fortschritten in der Reanimationsmedizin beschäftigen sich seit den 80er Jahren viele Studien mit der prognostischen Güte von reanimations- und patientenbezogenen Akutmarkern. Generell sollen Prognosemarker die Vorhersagbarkeit des Heilungspotenzials erlauben, sie besitzen dadurch eine Steuerfunktion für das weitere Therapiekonzept. Die Wertigkeit dieser Prädiktoren verändert sich jedoch, wenn sie als Determinanten bei Non-Treatment-Entscheidungen herangezogen werden. Dies aus zwei Gründen: 1. Nach Sichtung der Literatur und eingedenk eigener Studienresultate fehlt bislang ein 100%- sicherer Prognose-Algorithmus für Patienten im posthypoxischen Koma. 2. (...) Der komatöse Patient kann an der Beurteilung der Prognoseaussagen selbst nicht teilnehmen. Es stellt sich somit die Frage: Dürfen Prognosemarker unser moralisches Handeln an der Grenze des Lebens leiten? Die Autoren bejahen diese Frage und sehen eine adäquat moralische Handlungsoption in der Durchführung einer diskurs-pragmatischen Patientenkonferenz. Den Prognosemarkern kommt hier eine Stellvertreterfunktion im Sinne eines „stillen Patientenargumentes“ zu, wodurch die potenzielle Dialogfähigkeit des Patienten als moralisches Anspruchsobjekt gewahrt wird. This paper explores the interplay between logic-sensitivity and bitstring semantics in the square of opposition. Bitstring semantics is a combinatorial technique for representing the formulas that appear in a logical diagram, while logic-sensitivity entails that such a diagram may depend, not only on the formulas involved, but also on the logic with respect to which they are interpreted. These two topics have already been studied extensively in logical geometry, and are thus well-understood by themselves. However, the precise details of their (...) interplay turn out to be far more complicated. In particular, the paper describes an elegant and natural interaction between bitstrings and logic-sensitivity, which makes perfect sense when bitstrings are viewed as purely combinatorial entities. However, when we view bitstrings as semantically meaningful entities (which is actually the standard perspective, cf. the term ‘bitstring semantics’!), this interaction does not seem to have a full and equally natural counterpart. The paper describes some attempts to address this situation, but all of them are ultimately found wanting. For now, it thus remains an open problem to capture this interaction between bitstrings and logic-sensitivity from a semantic (rather than merely a combinatorial) perspective. (shrink)

Historical narration is a system of mental operations defining the field of historical consciousness. It is poetic in that it is the performance of creative activity by the human mind in the process of historical thinking. The purpose of historical narration is to make sense of the experience of time in order to orient practical life in the course of time. Three elements distinguish an historical narration from other forms of narration: an historical narration is tied to the medium of (...) memory; it organizes the three dimensions of time in a concept of continuity; and it establishes the identity of its authors and listeners. In order to develop the concepts of continuity and the stability of identity, an historical narration must fulfill four functions: affirmation, regularity, negation, and transformation. Four types of historical narration correspond to these four functions: traditional, exemplary, critical, and genetical. There is a natural progression through these four types of narration, with critical narration serving as a catalyst. The four types are present in all historical texts, one dominating, the others secondary. Modern historical studies are unique in being informed by theoretically and methodologically organized empirical research. The articulation of theories in history means a progress in reasoning. This affects the role of the concept of continuity of time, which is no longer a given and has become a subject of discussion. (shrink)

Infectious and parasitic diseases cause enormous health problems in the developing world whereas they leave the developed one relatively unscathed. Research and development (R&D) of drugs for diseases that mainly affect people in developing countries is limited. The problem that relatively few drugs are available for diseases that cause an enormous burden of disease in the developing world is called the 'availability problem'. In recent years, the availability problem has received quite a bit of attention. A number of proposals have (...) been fielded as to how this problem might be minimized. Wild-card patent extensions, advance market commitments, cash prizes and the Health Impact Fund are prominent examples of such proposals. These proposals can be thought of as pull-mechanisms for R&D of drugs for neglected diseases. What has been coined a 'priority review voucher' is another pull-mechanism. This paper is a critical discussion of this pull-mechanism. First, the original priority review voucher scheme, as proposed by Ridley et al. (2006), is described. A number of objections to this scheme are thereafter presented. A few amendments to the original scheme are then suggested, and it is argued that with these amendments in place, the priority review voucher scheme constitutes an attractive way of stimulating R&D of drugs for neglected diseases. Antibiotic resistance is a serious public health problem on a global scale. In both developed and developing countries, the unpleasant consequences of the phenomenon are being felt. This paper discusses wild-card patent extensions as a means to incentivize research and development of new antibiotics. The thesis defended in the paper is that the implementation of such patent extensions is an appropriate legislative response to the problem of antibiotic resistance. The "Digital Era Framework" is a reference framework for the digital information age. Targeted at science and practice alike, the concept offers a comprehensive approach for the analysis and assessment of phenomena of digital change, digitalization and digital transformation. The "Digital Era Framework" is based on an integrated approach to examine digital change, in so far as the original state, the occuring change and the final state can be represented in a uniform scheme. The framework emphasises information as the central (...) point of consideration. Therefore it is based on two factors as main moments of order that define the structure of the scheme: the form of manifestation of information on the one hand and the type of application of information on the other. This creates a two-dimensional frame of reference that allows for a differentiated classifcation of phenomena, objects and events. The model is particularly suitable for studying entire systems and processes. By positioning their individual elements within the two-dimensional frame, it can be shown how the structure and interaction pattern of theses systemes and processes are shaped and how this configuration may change as a result of digitalization. Offering a theoretically well-founded systematization, the framework provides a solid basis for analyses, explanations and forecasts. At the same time, it serves as a basis for the development and evaluation of strategies. The presentation of the "Digital Era Framework" is also aimed at contributing to the development of an adequate technical terminology by proposing a well-founded nomenclature based on the reference framework. One objection that has been consistently raised for theorists who are committed to the idea that we have a positive duty to aid the global poor is the overdemandingness objection. This article is a critical discussion of this objection. First, the objection is laid out in some detail. A number of influential attempts to meet the overdemandingness objection are then discussed, and it is argued that they all fail in their intended purpose. The conclusion of the article is not that (...) the overdemandingness objection cannot be met. Rather, the conclusion is that the overdemandingness objection constitutes a serious challenge to anyone who accepts the objection and goes beyond the standard libertarian doctrine and commits herself to the existence of positive duties to aid the global poor. This article is concerned with Mark Timmons and Terence Horgan's influential twin - earth argument against the semantic views of that school of thought in metaethics that has come to be known as “Cornell realism”. The semantic views of Cornell realism have been developed in greatest detail by Richard Boyd, and it is Boyd's view that is targeted by Timmons and Horgan. In the first part of the article, the twin - earth argument is introduced and two versions of it (...) are disentangled. Thereafter, a defensive strategy is developed against the most powerful version of the argument. The conclusion of the article is that Timmons and Horgan's argument does not succeed in showing that the semantic views associated with Cornell realism are false. (shrink)

Intercultural comparative historiography raises fundamental methodological problems: Is there any ground for comparison beyond the peculiarities and differences of cultures to be compared? One must avoid taking the Western cultural tradition of historical thinking as the basis for the comparison. Therefore one has to conceptualize the theoretical grounds for comparison and explicate elements of historical thinking which operate in every culture. Then cultural differences in historiography can be analyzed as peculiar constellations of these elements. In order to develop this comparative (...) groundwork, one has to start with some fundamental considerations about historical memory as the universal cultural means of orienting human practical life in its temporal dimensions. On this foundation one has to erect a theory of historical consciousness and its constitutive factors, procedures, and functions. In a systematized form the relationship of these elements can be used to identify the varieties of historical thinking in different contexts over time. This approach has as one objective an intercultural exchange of knowledge about history as a medium for identity-forming. It should enable the participants in this exchange to overcome the widespread logic of exclusion in favor of a more inclusive manner of historical self-understanding. (shrink)

Ranke's work marks a turning point in the development of historiography: it changed from literature to science. Ranke's introduction of reason into historiography gave it a certain aesthetic quality, which modern historical studies have forgotten. Traditional rhetoric, or the use of language for strategic purposes, was discarded for its fictitious nature. In its place, Ranke advocated a synthesis of the scientific principles of research and the more artistic principles of writing history. This synthesis initiated the aesthetics of historiography, and yielded (...) a hidden rhetoric in the form of linguistic patterns of significance, or topoi, which give the facts of the past their sense and meaning for present-day life. Historiography, by its aesthetics, addresses its audience in a way that makes visible the mental forces which constitute the identity of the addressed people in the temporal course of their life. The postmodern recognition of rhetoric in historiography should not lead us back to premodern rhetoric but forward to a rhetoric of historiography which preserves the necessity of liberating reason in historiography and which reflects this reason not simply as a technique of research, but 'With a much wider and deeper approach to historical studies as a question of the aesthetics of historiography. In recent years, a number of authors have started studying Aristotelian diagrams containing metalogical notions, such as tautology, contradiction, satisfiability, contingency, strong and weak interpretations of contrariety, etc. The present paper is a contribution to this line of research, and its main aims are both to extend and to deepen our understanding of metalogical diagrams. As for extensions, we not only study several metalogical decorations of larger and less widely known Aristotelian diagrams, but also consider metalogical decorations of another type (...) of logical diagrams, viz. duality diagrams. At a more fundamental level, we present a unifying perspective which sheds new light on the connections between new and existing metalogical diagrams, as well as between object- and metalogical diagrams. This paper studies the Lockean thesis from the perspective of contemporary epistemic logic. The Lockean thesis states that belief can be defined as ‘sufficiently high degree of belief’. Its main problem is that it gives rise to a notion of belief which is not closed under conjunction. This problem is typical for classical epistemic logic: it is single-agent and static. I argue that from the perspective of contemporary epistemic logic, the Lockean thesis fares much better. I briefly mention that it (...) can successfully be extended from single-agent to multi-agent settings. More importantly, I show that accepting the Lockean thesis (and a more sophisticated version for conditional beliefs) leads to a significant and unexpected unification in the dynamic behavior of (conditional) belief and high (conditional) probability with respect to public announcements. This constitutes a methodological argument in favor of the Lockean thesis. Furthermore, if one accepts Baltag’s Erlangen program for epistemology, this technical observation has even stronger philosophical implications: because belief and high probability display the same dynamic behavior, it is plausible that they are indeed one and the same epistemic notion. This article is divided into five parts. After a brief example in the first part, the second explains what historical sense-generation is about. The third characterizes tradition as a pregiven condition of all historical thinking. With respect to this condition, the constructivist theory of history is criticized as one-sided. The fourth part presents tradition as one of the four basic sense criteria of historical narration. The article concludes with a discussion of the role of tradition in the historical culture of (...) modern societies.Historical sense-generation is a mental procedure by which the past is interpreted for the sake of understanding the present and anticipating the future. This mental procedure is an anthropological universal in the cultural orientation of human practical life and will lead to a concept of the course of time as a necessary factor in the cultural orientation of human life.Today the dominant opinion in metahistory conceives of historical sense-generation in a constructivist way. The sense of the past is understood as an ascription of meaning onto the past; the past itself has no impact on this meaning. But I hold that the past is already present in the circumstances and conditions under which historical thinking is performed and is obviously influenced by it. This presence can be called tradition. Before historians construct the past they themselves are already constructed by the present outcome of past developments in the world. Thus tradition is always at work in historical thinking before the past is thematized as history.Historical sense-generation needs basic principles of sense and meaning. Using these principles transforms the experience of the past into a meaningful history for the present. Despite cultural differences, four sense criteria can be identified as basic for making historical sense of the past. One of the four principles is tradition. It is the most fundamental one upon which all other modes of making sense of the past are grounded. It presents temporal change in the human world such that the world’s order is maintained despite all its changes. Since the emergence of the so-called advanced civilizations, other types of historical narration have overshadowed the constitutive role of tradition. Historical narration has been supplemented by exemplary, genetic, and critical approaches to the past. Yet the traditional one has remained the most frequently used and is the most basic and popular. The theory of event coding by Hommel et al. proposes that feature binding is a central component of action planning. To evaluate the binding hypothesis, we consider findings from studies of action-perception interference and bimanual movements. We argue that although binding of action features may be a valuable concept, interference from partial feature overlap does not provide a parsimonious account for the observed phenomena.

We compare $|\operatorname{seq}^{1 - 1}(A)|$ , the cardinality of this set, to |P(A)|, the cardinality of (...) the power set of A. What is provable about these two cardinals in ZF? The main result of this paper is that $ZF \vdash \forall A(|\operatorname{seq}^{1 - 1}(A)| \neq|\mathscr{P}(\mathscr{A})|)$ , and we show that this is the best possible result. Furthermore, it is provable in ZF that if B is an infinite set, then $|\operatorname{fin}(B)| <|\mathscr{P}(B)|$ even though the existence for some infinite set B* of a function f from $\operatorname{fin}(B^\ast)$ onto P(B*) is consistent with ZF. Much of today’s international trade is conducted according to trade agreements that involve substantial and uniform protections of intellectual property rights. Intellectual property rights are a socio‐economic tool that create a temporary monopoly for inventor firms and enable such firms to charge prices for their innovations that are many times higher than the marginal cost of production of the innovations. This allows the inventor firms to salvage their research‐costs and secure a profit on their innovations. A large body of contemporary (...) philosophical and interdisciplinary literature suggests that intellectual property rights give rise to a number of ethical problems. This review paper seeks to give an overview of what these problems are. It also offers an outline of proposals as to how these problems might be alleviated, and it briefly explains the two classical defenses of the ethical permissibility of intellectual property rights. The ethical issues surrounding intellectual property rights are most pertinent when it is socially valuable goods that are given intellectual property protection. The discussions in this paper revolve around just one product type in order to bring out the broader ethical issues surrounding intellectual property rights. In line with much contemporary literature on the ethical dimensions of intellectual property rights, the product type in question is life‐saving medicines. (shrink)

Das vorliegende Handbuch bietet eine umfassende Darstellung von Leben, Werk und Wirkung Georg Simmels. Neben Simmels Herkunft aus den Zusammenhängen einer Völkerpsychologie und früher europäisch-ethnologischer Interessen geht es darum, nächst dem ungleich bekannteren Soziologen v. a. den Philosophen Simmel herauszustellen. Komplementär zu einer Darstellung des Lebens Simmels sowie der Wirkung seines Schaffens werden seine Werke nicht nur inhaltlich dargestellt, sondern auch ihre Kontexte einbezogen und behandelt. Der Versuch, Simmels Denken in seiner ganzen Breite und Vielfalt abzubilden, führt dazu, die in (...) der Forschung klassische Einteilung in drei Phasen von Simmels Werk sowie die Ausdifferenzierung in einen eher philosophisch und eher soziologisch orientierten Denker zu Gunsten einer genaueren Gruppierung der Werkphasen aufzuweichen bzw. mitunter ganz aufzugeben. Ziel ist es, weitere thematische Differenzierungen zu ermöglichen und Kontinuitäten und Zäsuren des Simmelschen Denkens möglichst umfangreich nachzuzeichnen. (shrink)
