Traditional approaches to character education have been viewed by many educators as an attempt to establish self control within students to habituate them to prescribed behaviour and as nothing more than a ‘bits‐and‐pieces’ approach to moral education. While this is accurate for many character education programmes, integrated multi‐dimensional character education embraces both moral education and character formation. Students learn to identify and process social conventions within the core values of the school and community and have opportunities to learn practical reasoning (...) skills in schools where character education is integrated into all aspects of the schooling process. Reported in this article are several studies, including two large‐scale experimental investigations, that show integrated character education results in an improved school environment, student pro‐social and moral behaviour, and reading and maths test scores. Schools become more caring communities; student discipline referrals drop significantly, particularly in areas related to bullying behaviour; and test scores in moderately achieving schools increase nearly 50%. We argue that Néron and Norman’s article stops short of the point where it would truly advance our understanding of corporate citizenship. Their article, in our view, fosters normative confusion and displays significant gaps in logic. In addition, the large and useful literature on business-government relations has for the most part been overlooked by Néron and Norman, even though their article ends with an enthusiastic call for scholarly attention to this subject.

Over the last quarter of a century, English medical law has taken an increasingly firm stand against medical paternalism. This is exemplified by cases such as Bolitho v City and Hackney Health Authority, Chester v Afshar, and Montgomery v Lanarkshire Health Board. In relation to decision-making on behalf of incapacitous adults, the actuating principle of the Mental Capacity Act 2005 is respect for patient autonomy. The only lawful acts in relation to an incapacitous person are acts which are in the (...) best interests of that person. The 2005 Act requires a holistic assessment of best interests. Best interests are wider than ‘medical best interests’. The 2018 judgment of the Supreme Court in An NHS Trust v Y from patients in prolonged disorders of consciousness ) risks reviving medical paternalism. The judgment, in its uncritical endorsement of guidelines from various medical organisations, may lend inappropriate authority to medical judgments of best interests and silence or render impotent non-medical contributions to the debate about best interests—so frustrating the 2005 Act. To minimise these dangers, a system of meditation should be instituted whenever it is proposed to withdraw life-sustaining CANH from patients with PDOC, and there needs to be a guarantee of access to the courts for families, carers and others who wish to challenge medical conclusions about withdrawal. This would entail proper public funding for such challenges. (shrink)

Wherever philosophers disagree, one of the things at issue is likely to be what they disagree about, itself. In addition to asking whether moral realism is true, and which forms of moral realism are more likely to be true than others, we can also ask what it would mean for some form of moral realism to be true. The usual aspiration of such inquiry is to find definitions that all can agree on, so that we can use terms in a (...) uniform way. But we doubt that this aspiration is always possible, or even desirable. It will be our goal in this chapter to sketch out some of our reasons for such skepticism, and to lay out a picture of what philosophical inquiry can look like in metaethics and beyond, even when it is impossible to reach uniform agreement on the terms of the debate. Pike This article seeks to define more precisely the nature of the individual transaction that occurs between reader and text and the potential for aesthetic reading in literature classrooms by relating knowledge of the way pupils engage in literary transactions to theoretical perspectives (...) that address the issue. The validity of Louise Rosenblatt's transactional theory of the literary work, expounded in Literature as Exploration and The Reader, The Text, The Poem, and its relevance for contemporary educators, particularly in the field of English education, has recently been reasserted by Jeanne Connell in her timely and cogent article in this journal. 1 The present article, however, seeks to refocus debate by problematizing and subsequently developing some aspects of key theories such as Rosenblatt's while examining the individual and social nature of reading in schools. Rosenblatt's view that aesthetic experiences can have both social origin and effect certainly deserves further theorizing if aesthetic experience in school communities and classrooms is to flourish.The influence of John Dewey's Art as Experience upon Rosenblatt is evident as this seminal text conceives of our primary task as the restoration of "continuity between the refined and intensified forms of experience that are works of art and everyday events." 2 Such continuity with experience is vital because, for Dewey, "experience is the fulfillment of an organism in its struggles and achievements in a world of things, it is art in germ." 3 Applying such a notion to education in schools, Rosenblatt saw the aim of literature lessons as the growth of experience rather than the acquisition of knowledge. How should we incorporate algorithms into humanistic scholarship? The typical approach is to clone what humans have done but faster, extrapolating expert insights to landfills of source material. But creative scholars do not clone tradition; instead, they produce readings that challenge closely held understandings. We theorize and then illustrate how to construct bad robots trained to surprise and provoke. These robots aren’t the most human but rather the most alien—not tame but dangerous. We explore the relationship between the reproduction of (...) tradition and the generation of surprise and then show how formalizing a particular humanistic theory as a Bayesian prior allows us to identify readings that disrupt it through a process of algorithmic abduction. Among the exploding universe of surprising (and mostly ridiculous) possible readings, algorithmic efficiency allows us to select readings that nonetheless garner substantial support from the total archive and so merit interpretation and engagement. It is in such interaction between alien and human readers that meaning is made and understanding disturbed; it is by extending alien readings to novel texts that the scholarly community tests the value of those readings. ​Rosamond Rhodes contends, by reference to seven examples, that medical ethics is distinctly different from non-medical ethics. Each of those examples, on proper examination, illustrates precisely the opposite contention. It is clear not only that medical ethics relies on the same principles as non-medical ethics, but that it should so rely. A distinctively medical ethics would be dangerous: it would divorce ethical medical decision-making from the patients whom medicine exists to serve.

We are very grateful to Richard Ashcroft 1 and Andrew McGee 2 for their thoughtful and articulate criticisms of our views. 3 Ashcroft has disappointingly low aspirations for the law. Of course he is right to say that the law is not a ‘self-sufficient, integrated and self-interpreting system of doctrine’. The law is often philosophically incoherent and internally contradictory. But it does not follow from this that all areas of the law are philosophically unsatisfactory. And if that were true, the (...) response should not be Ashcroft’s contemptuous despair, but a determination to make it better. Ashcroft would say that such idealism is unrealistic in the light of the very nature of ‘the Law’: ‘...a complex assemblage of institutions, rules, accredited persons, practices and systems’. Strategies for protecting historically disadvantaged groups have been extensively debated in the context of genetic variation research, making this a useful starting point in examining the protection of social groups from harm resulting from biomedical research. We analyze research practices developed in response to concerns about the involvement of indigenous communities in studies of genetic variation and consider their potential application in other contexts. We highlight several conceptual ambiguities and practical challenges associated with the protection of group interests and argue (...) that protectionist strategies developed in the context of genetic research will not be easily adapted to other types of research in which social groups are placed at risk. We suggest that it is this set of conceptual and practical issues that philosophers, ethicists, and others should focus on in their efforts to protect identifiable social groups from harm resulting from biomedical research. Ethics generated the law. There is nothing elusive or incoherent about the philosophical foundations of the law of murder. Human life is thought to matter. To kill is both to cause a harm and to commit a wrong. There is more than something of the straw man in Ashcroft’s elaboration of his argument. For he chooses, of all things, autonomy and, in particular, its invocation in the law of consent. Lawyers’ eyebrows will rise at his assertion that ‘while the concept of “autonomy” has an explanatory role in discussions of the …. (shrink)

Tort claims have been studied for various reasons. Several studies have found that most tort claims are not related to negligent adverse events and most negligent adverse events do not result in tort claims. Several studies have examined the disposition of tort claims to understand the likelihood of payment once a claim has been made. Still others have proposed that tort-claims trend analysis may help administrators target their quality-improvement efforts and identify problems with quality that would not otherwise be captured.In (...) this article, we conduct a tort-claims analysis to explore areas for quality improvement, specifically for patient safety, in the Veterans Health Administration. Patient safety is an increasingly highlighted aspect of health-care delivery. Failure to assure patient safety can result in bad clinical outcomes, additional costs of care, and a negative organizational image. Filing a tort claim is one way for an individual to express concern about an organization. For our analysis, we draw from resolved tort claims in the Veterans Health Administration from fiscal years 1989 to 2000. (shrink)

Rapid developments in science, technology and means of communication offer man possibilities for dialogue that up until now have been undreamed-of. It must be undeniably admitted, however, that we live in a world dominated by fear of the other, fanaticism, racism and every kind of conflict. This is why we have thought it useful to reactualize the Goethian conceptions of universal literature and otherness, conceptions that, coming from the generosity of a humanist and appreciator of the other, could help us (...) contribute to the discussion on the problems of interculturality that give rise to more and more animated controversies. Small changes in daylight in the environment can produce large changes in reflected light, even over short intervals of time. Do these changes limit the visual recognition of surfaces by their colour? To address this question, information-theoretic methods were used to estimate computationally the maximum number of surfaces in a sample that can be identified as the same after an interval. Scene data were taken from successive hyperspectral radiance images. With no illumination change, the average number of surfaces distinguishable by (...) colour was of the order of 10,000. But with an illumination change, the average number still identifiable declined rapidly with change duration. In one condition, the number after two minutes was around 600, after 10 min around 200, and after an hour around 70. These limits on identification are much lower than with spectral changes in daylight. No recoding of the colour signal is likely to recover surface identity lost in this uncertain environment. Because of the widespread feminine priority that makes it the receptacle of śakti, India is definitely “one of the last bastions of the Mother,” as is pointed out in a recent book. If in fact there is a “maternalistic” culture it is certainly that of India, in spite of the legal regime, in which the element of affectionate magic characterizing all life and all organic intimacy is affirmed through the warm symbiosis of mother-child love. A miracle of that absolute love (...) incarnated with a natural serenity by millions of mothers dispensing a felicitous affectionate security, instilled in the Indian soul throughout its entire life. The traits of the Hindu personality and the principle content of its culture are organized and ordered around this center, characterized by an extraordinary coherence. Since its construction begins with this “dual unity” the Hindu personality has necessarily the popolarity of fusion-separation as a pivot. This is the central theme of S. Kakar, who, basing his conclusions on results of clinical psychoanalyses of Hindu individuals as well as on contributions from the collective imagination (folklore and myths) claims to discern the ontogenetic source of the supreme ideal of deliverance (mokṣa) in early childhood and, more specifically, in the strong unconscious desire to find again the benevolent presence of the “good mother”. Ce livre a pour seule ambition de faire comprendre quelque chose de la pensée de Ludwig Wittgenstein et de sa conception de tâche de la philosophie conçue comme une " thérapie " censée guérir certaines " maladies de l'esprit ". Le fait que Wittgenstein soit venu à la philosophie par le biais de réflexions sur la logique et les mathématiques est important à cet égard. Mais ce même Wittgenstein, ami de Bertrand Russell et de John Maynard Keynes, professeurs à l'Université (...) de Cambridge, ne fut pourtant jamais un universitaire typique. Qui plus est, sa pensée ne cadre point avec les théories et les problématiques caractéristiques de la philosophie contemporaine. Cela n'aurait d'ailleurs guère étonné Wittgenstein lui-même, qui se moquait des modes et des vogues intellectuelles, qui tenait notre siècle de progrès pour un âge de l'Unkultur et qui ne rédigeait ses pensées que " pour quelques amis dispersés aux quatre coins du monde ". A modern form of narrative, comic books, are used to communicate, discuss, and critique issues in business and society. A description of comic books as a legitimate medium is followed by a discussion of the pedagogical uses of comic books. The strengths of the pedagogy include crossing cultural barriers, understanding the complexity of individual decision-making and organizational influences, and the universality of dilemmas and values. We provide an initial source for educators on the topics, comic books, plotlines, and other commentary (...) for consideration of use in the classroom from high school to graduate business ethics courses. The environmental movement continues to be a dynamic force for protection of the environment despite new organizations emerging from the “birthing” process of the formation of new groups via factions and schisms. I focus on two aspects of the evolution of the environmental movement: how do new organizations emerge from existing environmental groups via benevolent or divisive mechanisms; and, which organizations produce new organizations? I develop a family tree of the American environmental movement from 1955 – 2005 and identify the (...) mechanisms that result in the formation of new organizations from a sample of 48 environmental organizations. I use social network analysis to identify which environmental organizations were most likely to produce new groups and set the stage for future inquiries into how new environmental organizations reestablish and maintain connections with their progenitors.
