Résumé La numérisation actuelle du droit permet de revenir sur les liens historiques entre le droit et la logique moderne. En se fondant sur la différence établie par J. Van Heijenoort entre logique «comme calcul» et logique «comme langage», l’article établit des analogies entre différentes interprétations de la logique et différents types de systèmes ou d’instances juridiques : «Common law», systèmes «civils», «cour de cassation», cette dernière notion caractérisant le formalisme hilbertien. Ce formalisme a tenté de réduire la logique «comme (...) langage» à la logique «comme calcul» mais la découverte des limitations internes des formalismes y a mis un terme : d’où le parallèle entre l’échec du programme hilbertien et les difficultés rencontrées dans la numérisation actuelle du droit. Le droit n’est pas réductible à un calcul formel sur des marques écrites : il reste une discipline dans laquelle la parole et le dialogue sont indispensables pour réaliser les buts qu’il s’assigne. A major event in the history of twentieth-century thought, Notebooks for a Ethics is Jean-Paul Sartre's attempt to develop an ethics consistent with the profound individualism of his existential philosophy. In the famous conclusion to Being and Nothingness , Sartre announced that he would devote his next philosophical work to moral problems. Although he worked on this project in the late 1940s, Sartre never completed it to his satisfaction, and it remained unpublished until after his death in 1980. Long out of print, this is the first English translation in many years. The Imagination is Sartre’s first full philosophical work, presenting some of the basic (...) arguments concerning phenomenology, consciousness and intentionality that were to later appear in his master works and be so influential in the course of twentieth-century philosophy. Sartre begins by criticising philosophical theories of the imagination, particularly those of Descartes, Leibniz and Hume, before establishing his central thesis. Imagination does not involve the perception of ‘mental images’ in any literal sense, Sartre argues, yet reveals some of the fundamental capacities of consciousness. He then reviews psychological theories of the imagination, including a fascinating discussion of the work of Henri Bergson. Sartre argues that the ‘classical conception’ is fundamentally flawed because it begins by conceiving of the imagination as being like perception and then seeks, in vain, to re-establish the difference between the two. Sartre concludes with an important chapter on Husserl’s theory of the imagination which, despite sharing the flaws of earlier approaches, signals a new phenomenological way forward in understanding the imagination. Although written fairly early in his career, in 1939, _Sketch for a Theory of the Emotions_ is considered to be one of Jean-Paul Sartre's most important pieces of writing. It not only anticipates but argues many of the ideas to be found in his famous _Being and Nothingness._ By subjecting the emotion theories of his day to critical analysis, Sartre opened up the world of psychology to new and creative ways of interpreting feelings. Emotions are intentional and strategic ways (...) of coping with difficult situations. We choose to utilize them, _we_ control _them_, and not the other way around, as has been posited elsewhere. Emotions are not fixed; they have no essence and indeed are subject to rapid fluctuations and about-turns. For its witty approach alone, Sartre's _Sketch for a Theory of the Emotions_ can be enjoyed at length. It is a dazzling journey to one of the more intriguing theories of our time. (shrink)

A solution of the zeno paradoxes in terms of a discrete space is usually rejected on the basis of an argument formulated by hermann weyl, The so-Called tile argument. This note shows that, Given a set of reasonable assumptions for a discrete geometry, The weyl argument does not apply. The crucial step is to stress the importance of the nonzero width of a line. The pythagorean theorem is shown to hold for arbitrary right triangles.

Colonialism and Neo-Colonialism is a classic critique of France's policies in Algeria in the 1950s and 1960s and inspired much subsequent writing on colonialism, post-colonialism, politics, and literature. It includes Sartre's celebrated preface to Fanon's classic Wretched of the Earth. It is time to challenge the issue of pleasure associated with the core of medical practice. Its importance is made clear through its opposite: unhappiness—something which affects doctors in a rather worrying way. The paper aims to provide a discussion on pleasure on reliable grounds. Plato’s conception of techne is a convenient model that offers insights into the unique practice of medicine, which embraces in a single purposive action several heterogeneous dimensions. In Aristotle’s Ethics, pleasure appears to play a central (...) role for action’s assessment and intensification. Pleasure is also tightly associated with the Kantian faculty of reflective judgment, which operates at the heart of clinical reasoning. Indeed, practicing medicine means to deal with the particular and the manifold, requiring clinical judgment, but also relying on embodied habitus . With Bourdieu’s notion of habitus , pleasure is the mark of a happy practice, which presupposes a deep involvement in one’s field. Throughout our inquiry, the question of pleasure comes to offer a critical reappraisal of real medical practice and leads to consider ethics more as a component of techne than as a separate realm of concern. « La médecine reste en quête d’une épistémologie propre, car l’opposition entre science des maladies et art de soigner ne parvient pas à rendre compte de l’unité d’une pratique. Cette épistémologie peut être dégagée en ressaisissant ce qui se produit dans la clinique, véritable laboratoire de la médecine : lieu de son effectuation et lieu de son élaboration, où l’expérience vécue et l’expérience acquise fournissent les coordonnées d’une expérimentation. La clinique a un point de départ : la demande d’un malade (...) en proie à une intrication symptomatique maladive qui convoque le corps mais aussi le langage, et dont le médecin fait cas. La complexion symptomatique fait l’objet d’une analyse critique (diagnostic) qui débouche sur la détermination d’une thérapie. La clinique est alors une technique productive de remédiations diverses qui mobilise un ensemble hétéroclite de savoirs et de facultés pour trouver des solutions aux problèmes concrets des individus qui s’adressent à elle. Quand bien même la clinique importe pour son usage des biotechnologies et des algorithmes, elle reste incertaine et conjecturale car individuée. Si bien qu’en son cœur, la pratique médicale garde des allures infra-techniques, mobilisant des esthésies, une praxis, une sagacité pratique.
